35-राजपत्र/2018-18-05-2018 (1575)1576 राजपत्र, हिमाचल प्रदेश, 18 मई, 2018/28 वैशाख, 1940 उक्त अनुसूची में दर्शित वन भूमि/बंजर भूमि सरकार की सम्पत्ति है, या जिस पर सरकार के सांपत्तिक अधिकार हैं या सरकार उसकी वन उपज के सम्पूर्ण या किसी भाग की हकदार है;

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वोक्त अधिनियम की धारा 29 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करते हैं कि उक्त अधिनियम के अध्याय-4 के उपबन्ध उक्त वन भूमि/ बंजर भूमि को लागू होंगे और जो एतद्‌पश्चात्‌ पूर्वोक्त अधिनियम की धारा 29 की उप-धारा (2) के उपबन्धों के अधीन ''संरक्षित वन'' कहलाएगी ।

NOTIFICATION

Shimla-2, the 19th April, 2018

No.FFE-B-F(14)-117/2013.—Whereas the nature and extent of the rights of the Government and of private persons in or over the Forest Land/ Waste Land specified in the schedule inserted to this Notification have been enquired into and recorded as required under Sub- Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/ Waste Land shown in the said schedule is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the Forest Produce therein;

Now, therefore, in exercise of the powers conferred by Sub-Section (1) of Section-29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter- IV of the Act shall apply to the said Forest Land/ Waste Land and shall hereafter be called as "Protected Forests" under the provisions of Sub-Section (2) of Section-29 of the Act ibid.

No.FFE-B-F(14)-125/2013.—Whereas the nature and extent of the rights of the Government and of private persons in or over the Forest Land/ Waste Land specified in the schedule inserted to this Notification have been enquired into and recorded as required under sub- section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/ Waste Land shown in the said schedule is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the Forest Produce therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section-29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the Act shall apply to the said Forest Land/ Waste Land and shall hereafter be called as "Protected Forests" under the provisions of sub-section (2) of Section-29 of the Act ibid.

The terms and conditions for engagement of Co-terminus, Class-III(OSD) in the Office of

Council of Ministers on co-terminus basis

1. The incumbent on co-terminus basis will be appointed only on the specific recommendations of Hon'ble Chief Minister, H.P. or the Hon'ble Minister concerned only.

2. The incumbent will have to submit a certificate of his/her fitness from Government/ Registered Medical Practitioner.

3. The services of the co-terminus appointee will be co-terminus with the tenure of the Hon'ble Chief Minister or the Hon'ble Minister concerned and the services will automatically come to an end immediately with the completion of tenure of office.

4. The service of the Co-terminus appointee will be purely on temporary basis and liable to be terminated in case the performance/conduct of the co-terminus appointee is not found satisfactory.

5. Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the services.

6. The designation of such co-terminus will be "Officer on Special Duty (Co-terminus)".

7. The co-terminus appointee will be paid fixed emoluments at the rate of Rs.25,000/- per month.

8. The co-terminus appointee should have passed 10+2 Examination or its equivalent from a recognized Board of School Education/University. The co-terminus should possess a minimum speed of 30 words per minute in English Typewriting or 25 words per minute in Hindi typewriting on Computer and should also have the knowledge of "Word Processing" in Computer.

9. The co-terminus appointee have to produce character certificate issued by an Executive Magistrate or equivalent Officer on the report of concerned Police Station at the time of initial joining and in case any complaint etc. is received based on facts/comes to the notice, his/her services will be terminated after giving opportunity of being heard.

10. The co-terminus appointee will be entitled for one day casual leave after putting one month service. This leave can be accumulated up to one year. No leave of any other kind will be admissible to the co-terminus appointee. He/she shall not be entitled for Medical reimbursement and LTC etc. only maternity leave will be given as per Rules.

11. The co-terminus appointee shall not be entitled for any amount for the period of absence from duty.

12. The provisions of service rules like FR, SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of co-terminus appointee.

13. The co-terminus appointee shall not be entitled for his/her regularization at any later stage.

15. The co-terminus appointee shall be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to clerks at the minimum of pay scale.

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy 1596 राजपत्र, हिमाचल प्रदेश, 18 मई, 2018/28 वैशाख, 1940 Sources and Terms and Conditions for Tariff Determination) (First Amendment) Regulations, 2018.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 1.—In sub-regulation (2) of Regulation 1 of the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2017 (hereinafter referred as "the said Regulations") for the words and figures "31st March, 2020", the words and the figures "31st March, 2019 or the date of commencement of the new Renewable Energy Regulations framed by the Commission, whichever is earlier" shall be substituted.

3. Amendment of Regulation 9.—In sub-regulation (1) of Regulation 9 of the RE Tariff Regulations, 2017 for the words and figures "31st day of March, 2020", the words and figures "31st March, 2019 or the date of commencement of the new Renewable Energy Regulations framed by the Commission, whichever is earlier" shall be substituted.
