संख्याः पी0डब्लय0ू डी0-(सी)एफ(7)-2/2017.--धर्मशाला रोपवेज़ लिमिटेड, एलिफनस्टोन बिल्डिंग, सैकण्ड फ्लोर, 10 वीर निर्माण रोड, फोर्ट, मुम्बई-400001, ने धर्मशाला से मैक्लोडगंज के बीच यात्री आकाशी रज्जूमार्ग का निर्माण करने की अनुज्ञा प्राप्त करने के लिए आवेदन किया था;

55-राजपत्र/2018-12-06-2018 (2427) 2428 राजपत्र, हिमाचल प्रदेश, 12 जून, 2018/22 ज्येष्ठ, 1940 और राज्य सरकार ने हिमाचल प्रदेश आकाशी रज्जूमार्ग अधिनियम, 1968 (1969 का 7) की धारा 6 कीे उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए प्रस्तावित रज्जू मार्ग के सम्बन्ध में सभी हितबद्व व्यक्तियों ने तारीख 28 अप्रैल, 2018 के राजपत्र हिमाचल प्रदेश में प्रकाशित इस प्रकार की समसंख्यक सूचना तारीख 3 मई, 2018 द्वारा इस सूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीस दिन के भीतर आक्षेप/सुझाव आमन्त्रित किए थे;

और राज्य सरकार द्वारा उक्त विनिर्दिष्ट अवधि के भीतर कोई आक्षेप/सुझाव प्राप्त नहीं हुआ। अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश आकाशी रज्जूमार्ग अधिनियम, 1968 (1969 का 7) की धारा 7 कीे उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए धर्मशाला रोपवेज़ लिमिटेड (सम्प्रवर्तक) को निम्नलिखत निर्बधनों और शर्तों के अध्याधीन रहते हुए धर्मशाला से मैकलोडगंज तक आकाशी रज्जूमार्ग का सन्निर्माण करने के लिए प्राधिकृत करते हैः-

1. इस रज्जूमार्ग के सन्निर्माण के लिए वित्तीय समापन के संप्रवर्तक द्वारा महाराष्ट्र बैंक के साथ पूर्ण कर लिया है;

2. संप्रवर्तक द्वारा रज्जूमार्ग के प्रतिस्थापन से सम्बद्ध सिविल संकमों का सन्निर्माण संयन्त्र और मशीनरी अन्तिम आदेश के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से छहः मास के भीतर प्रारम्भ कर दिया जाएगा;

3. संप्रवर्तक द्वारा इस परियोजना का सन्निर्माण, अन्तिम आदेश के ई-गजट में प्रकाशन की तारीख से छत्तीस मास के भीतर पूर्ण कर लिया जाएगा;

4. संप्रवर्तक के, राज्य सरकार या स्थानीय प्राधिकरण द्वारा किसी भी दशा में कोई भी रियायत या गारन्टी या वित्तीय सहायता नहीं दी जाएगी;

5. इस आकाशी रज्जूमार्ग का प्रचालन इस अधिनियम और तद्‌धीन विराचित नियमों के उपबन्धों के अनुसार किया जाएगा;

6. लेखा परीक्षण और लेखों की बाबत नियम, संप्रवर्तक और पर्यटन एवं नागरिक उड्‌डयन विभाग हिमाचल प्रदेश के मध्य निष्पादित रियायत करार में अधिकथित उपबन्धों के अनुसार होंगे;

7. अवसंरचात्मक डिजाइनज, सामग्री की गुणवता, सुरक्षा के कारक, दबाब परिकलन की पद्धति और ऐसे अन्य तकनीकी ब्यौरों की बाबत विनिर्देश भारतीय मानक ब्यूरो द्वारा यथा अधिकथित के अनुरूप होंगे किन्तु टावर की ऊंचाई में परिवर्तन सहित स्थल की स्थितियों के कारण आयाम और विनिर्देश के विचलन की दशा में संप्रवर्तक, यथास्थिति, निरीक्षक, रज्जूमार्ग/विशेषज्ञता समिति की पूर्ण अनुज्ञा अभिप्राप्त करेगा;

8. संप्रवर्तक मार्गोेंं और संचार के अन्य सार्वजनिक साधनों के ऊपर आकाशी रज्जूमार्ग के सन्निर्माण की बाबत उन नियमों का अनुसरण करेगा जो हिमाचल प्रदेश राज्य में लागू हैं;

9. संप्रवर्तक, राज्य सरकार की पूर्व अनुज्ञा के बिना किसी व्यक्ति को उपरोक्त आकाशी रज्जूमार्ग या उसके किसी भाग का विक्रय नहीं करेगा, उसे अन्तरित नहीं करेगा, पट्‌टे पर नहीं देगा या शिकमी नहीं करेगा;

10. यदि संप्रवर्तक, पूर्वोक्त अधिनियम और तद्‌धीन विराचित नियमों के उल्लंघन में करार या अधिनियमों में विनिर्दिष्ट किसी भी शर्त को कोई भंग करता है या संप्रवर्तक उपरोक्त रज्जूमार्ग के संचालित करने/चलाने में असफल रहता है तो राज्य सरकार आकाशी रज्जूमार्ग को समस्त2429 राजपत्र, हिमाचल प्रदेश, 12 जून, 2018/22 ज्येष्ठ, 1940 विल्लंगमों से रहित या आकाशी रज्जूमार्ग की अवमूल्यित कीमत पर, अपने अधिकार में ले सकेगा। यदि राज्य सरकार उक्त आकाशी रज्जूमार्ग को अपने अधिकार में लेने का आशय नहीं रखती है तो स्थानीय प्राधिकरण, अवमूल्यित कीमत पर या जैसा स्थानीय प्राधिकरण और संप्रवर्तक के मध्य आपसी करार किया जाए उसका क्रय कर सकेगा;

11. संप्रवर्तक, आकाशी रज्जूमार्ग के संचालन के लिए विद्युत ऊर्जा या मुख्य रूप से इस शर्त के अध्याधीन उपयोग करेगा कि यदि विद्युत आपूर्ति बन्द होती है तो संप्रवर्तक आकाशी रज्जूमार्ग के संचालन के लिए हर समय डीजल जनरेटिंग सैट की व्यवस्था तैयार रखेगा;

12. इस आकाशी रज्जूमार्ग के अधीन रखा जाने वाला न्यूनतम हैडवे हिमाचल प्रदेश आकाशी रज्जूमार्ग नियम, 1972 के नियम 3 के अनुसार होगा;

13. रज्जूमार्ग के अन्तर्गत स्थल (प्वाईंटस), जिन पर पुल या गार्डज विनिर्मित या अनुरक्षित रखे जाएंगे उन मानकों के अनुरूप होंगे जो भारतीय मानक ब्यूरो द्वारा यथा अधिकथित किए गए हैं;

14. संप्रवर्तक, आयुध अधिनियम, 1969 के अन्तर्गत आयुध और गोला बारूद के सिवाय यात्रियों को उनके सामान जैसे कि ब्रीफकेस/अटैची/सूटकेस/हैण्डबैग आदि सहित ले जाएगा;

15. संप्रवर्तक, राज्य सरकार द्वारा अनुमोदित दरों से अधिक दरें प्रभारित नहीं करेगा;

16. संप्रवर्तक, आदेश में विर्निदिष्ट शर्तों के सम्यक्‌ अनुपालन के लिए, राज्य के पक्ष में किसी राष्ट्रीयकृत बैंक से बैंक गारंटी के रूप में पांच करोड़ रूपये की प्रतिभूति देगा। किसी भी शर्त के भंग की दशा में राज्य सरकार उसे समपहृत करने के लिए स्वतन्त्र होगी। प्रतिभूति के समपहरण का आदेश करने से पूर्व रियायत ग्राही (कन्शेसनर ), संप्रवर्तक को निश्चित रूप से पन्द्रह दिन के भीतर भंग को परिशोधित करने के लिए कारण बताओ नोटिस देगा और यदि संप्रवर्तक परिशोधित करने में और भंग के लिए उपयुक्त स्पष्टीकरण देने में असफल रहता है तो, राज्य सरकार अपने अन्य अधिकाराें पर प्रतिकूल प्रभाव डाले बिना ऐसा आदेश कर सकेगी, जैसे वह उचित समझे;

17. संप्रवर्तक द्वारा, राजपत्र (ई-गजट), हिमाचल प्रदेश में अन्तिम आदेश के प्रकाशन से एक मास की अवधि के भीतर विभिन्न अधिनियमों और अधिसूचनाओं के अधीन समस्त आवश्यक अनुमोदन अभिप्राप्त करने होंगे;

18. संप्रर्वतक, विश्वसनीय युक्तियों, संकेत व्यवस्था, उपयुक्त रूप से डिजाइन किए गए फिक्सचर और स्ट्रक्चर रोपस, मशीनरी, गियर और अन्य साधित्रों की व्यवस्था करेगा। संप्रवर्तक प्रतिदिन यह निरीक्षण करेगा कि क्या मशीनरी, साधित्र आदि सही रूप में हैं और उन्हें नियमित रूप से उचित प्रकार से ग्रीस और तेल दिया गया है;

19. संप्रवर्तक, राज्य सरकार को पूंजी और राजस्व व्यय, प्राप्तियों और टैरिफ की ऐसी विवरणियां, ऐसे अन्तराल पर और ऐसे प्ररूप में प्रस्तुत करेगा जो राज्य सरकार द्वारा समय-समय पर विहित किया जाए;

20. संप्रवर्तक, निरीक्षक/विशेषज्ञ समिति या उनके प्राधिकृत प्रतिनिधि को समस्त युक्तियुक्त समयों पर आकाशी रज्जूमार्ग का निरीक्षण करने के लिए अनुज्ञात करेगा;

21. पूर्वोक्त अधिनियम या तद्‌धीन बनाए गए नियमों के किसी भी उपबन्ध का उल्लंघन आदेश की शर्त के भंग के रूप में समझा जाएगा; और 2430 राजपत्र, हिमाचल प्रदेश, 12 जून, 2018/22 ज्येष्ठ, 1940 22. इस रज्जूमार्ग की बाबत किसी भी प्रकार के माध्स्थ्‌म के लिए सचिव (विधि), हिमाचल प्रदेश सरकार एक मात्र मध्यस्थ होगा। मध्यस्थ के समक्ष कार्यवाहियां माध्यस्थ्‌म और सुलह अधिनियम, 1996 के उपबन्धों द्वारा विनियमित होंगी।

PUBLIC WORKS DEPARTMENT

ORDER

Shimla-171002, the 4th June, 2018

No. PWD(C)F(7)2/2017.—Whereas, Dharamshala Ropeway Ltd., Elphinstone Building, 2nd Floor, 10 Veer Nirman Road, Fort, Mumbai-400001, had applied for permission to construct a passenger aerial ropeway from Dharamshala and Mcleodganj;

And whereas, in exercise of the powers conferred under sub-section (2) of section 6 of Himachal Pradesh Aerial Ropeways Act, 1968 (Act No. 7 of 1969), the State Government had invited the objections(s)/suggestion(s) vide this Government notice of even No. dated 28th April, 2018, published in the Himachal Pradesh Rajpatra dated 3rd May, 2018 in relation to the proposed aerial ropeway from all the interested persons within thirty days from the date of publication of the notice in the Rajpatra Himachal Pradesh;

And whereas, no objection(s)/suggestion(s) have been received by the State Government within the stipulated period;

Now therefore, the Governor of Himachal Pradesh in exercise of the powers conferred by sub-section (1) of Section 7 of the Act ibid, is pleased to authorize the construction of an aerial ropeway from Dharamshala and Mcleodganj by Dharamshala Ropeway Ltd. (Promoter) subject to the following restrictions and conditions:—

1. that the financial closure for construction of this ropeway has been completed by the promoter with Bank of Maharashtra;

2. that the construction of civil works, plant and machinery connected with the ropeway installation shall be started by the promoter within six months from the date of publication of Final Order in the Rajpatra (e-Gazette), Himachal Pradesh;

3. that the construction of this project shall be completed by the promoter within thirty six months from the date of publication of Final Order in the e-gazette;

4. that no concession or guarantee or financial assistance in any condition will be given by the State Government or the local Authority to the promoter;

rules framed thereunder;

6. that the rules regarding Audits and Accounts shall be as per the provisions laid down in the Concession Agreement executed between the promoter and the Department of Tourism and Civil Aviation, Himachal Pradesh;

7. that the specifications relating to the structural designs, quality of material, factors of safety, method of computing stresses and other such technical details in conformity with those as laid down by the Bureau of Indian Standards, provide that any deviation on the dimension and specification on account of site conditions including the change in the height of the tower, the promoter shall obtain the prior permission of the Inspector, Ropeway/Expert committee as the case may be;

8. that the promoter shall follow the rules which are applicable in the State of Himachal Pradesh regarding construction of aerial ropeway over the roads and other public ways of communications;

9. that the promoter shall not sell, transfer, lease or sublet the aforesaid aerial ropeway or part thereof to any other person without the prior permission of the State Government; 10. that in case the promoter commits any breach of the conditions specified in the agreement or acts in contravention of the provision of the Act ibid and rules framed thereunder or promoter fails to operate/run the aforesaid ropeway, the State Government may take over/resume the aerial ropeway free from all encumbrances or on such depreciated value of the aerial ropeway. In case State Government do not intend to take over the said ropeway, the local authority may purchase the same on the depreciated value or as may be mutually agreed between the local authority and the promoter;

11. that the promoter shall use electric power as the main mode for operating the aerial ropeway subject to the condition that in case, the failure of electricity, the promoter shall always keep stand by arrangements of diesel generating set for operating the aerial ropeway;

12. that the minimum head way to be maintained under this ropeway shall be as per the rule 3 of the Himachal Pradesh Aerial Ropeways Rules, 1972;

13. that the points under Aerial Ropeway at which bridges or guards shall be constructed and maintained in conformity with those as laid down by the Bureau of Indian Standards;

14. that the promoter shall carry passengers with their luggage such as briefcase/attachee/suitcase/handbag etc. on the aerial ropeway except arms and ammunitions as covered under the Arms Act, 1959;

15. that the promoter shall not charge the rates higher than the rates approved by the State Government;

16. that the promoter shall submit a security of Rupees 5.00 Crore (Five Crore) in the shape of Bank Guarantee from a nationalised Bank in favour of the State for the due compliance of the conditions specified in the order. In case of breach of any condition,2432 राजपत्र, हिमाचल प्रदेश, 12 जून, 2018/22 ज्येष्ठ, 1940 the State Government shall be at liberty to forfeit the same. Before ordering the forfeiture of the security, the Concessioner shall give show cause notice to the promoter to rectify the breach within 15 days positively and if the promoter fails to rectify and give suitable explanation for breach, the State Government may make order as it may think fit without prejudice to them other rights of the State Government; 17. that all necessary approvals under various Acts and Notifications will have to be obtained by the promoter within a period of one month from the publication of the Final Order in Rajpatra (e-Gazette) Himachal Pradesh;

18. that the promoter shall provide reliable devices, provisions for the signaling, suitable designed fixtures and structures ropes, machinery, gear and other appliances. The promoter shall daily inspect whether the machinery appliances etc. are in order and properly greased and oiled regularly;

19. that the promoter shall submit to the State Government such returns of Capital and revenue expenditure, receipts and tariff at such interval and in such form as may be prescribed by the State Government from time to time;

20. that the promoter shall allow the inspector/expert committee or their authorised representative to inspect the aerial ropeway at all reasonable times;

21. that the contravention of any of the provisions of the Act ibid or rules framed thereunder shall be termed as a breach of condition of the order; and

22. that the sole arbitrator for any type of arbitration in respect of this ropeway shall be Secretary (Law) to the Government of Himachal Pradesh. The proceedings before the Arbitrator shall be regulated by the provisions of the Arbitration and Conciliation Act, 1996.

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमोें का संक्षिप्त नाम दी रूल्ज ऑफ बिजनेस ऑफ दी गवर्नमैैंट ऑफ हिमाचल प्रदेश (सेवेनटीन्थ अमेंडमेंट) रूल्ज, 2018 है ।2433 राजपत्र, हिमाचल प्रदेश, 12 जून, 2018/22 ज्येष्ठ, 1940 (2) ये नियम राजपत्र, हिमाचल प्रदेश (ई-गजट) मेें प्रकाशित किए जाने की तारीख से प्रवृत्त होंंगे। 2. शेड्‌यूल का संशोधन.--दी रूल्ज ऑफ बिजनेस ऑफ दी गवर्नमैैंट ऑफ हिमाचल प्रदेश, 1971 से संलग्न शेड्‌यूल के क्रम संख्या 15 मेें प्रथम परंतुक के पश्चात्‌ निम्नलिखित द्वितीय परंतुक जोड़ा जाएगा, अर्थात :-

No. 5-1/71-GAD(CC).—In exercise of the powers conferred by clause (2) and (3) of article 166 of the Constitution of India, the Governor, Himachal Pradesh, is please to make the following rules further to amend the Rules of Business of the Government of Himachal Pradesh, 1971 framed vide Order No.5-1/71-GAD(CC) Dated 25th January, 1971, namely :—

1. Short title and Commencement.—(1) These rules may be called the Rules of Business of the Government of Himachal Pradesh (17th Amendment) Rules, 2018.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Amendment of SCHEDULE.—In Sl. No. 15 of the SCHEDULE appended to the Rules of Business of the Government of Himachal Pradesh, 1971, after the first proviso, the following second proviso shall be added, namely :—

"Provided further that the Administrative Department shall be competent to create

supernumerary posts with the prior concurrence of the Finance Department, without

placing the matter for discussion at the Meeting of the Council."

संख्या फिन(पेन)ए(3)-1/09 पार्ट-V.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश राज्य को लागू सेन्ट्रल सिविल सर्विसिज (पेेंंशन) रूल्ज, 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं; अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम सेन्ट्रल सिविल सर्विसिज (पेेेंंशन) हिमाचल प्रदेश (संशोधन) नियम, 2018 है।2435 राजपत्र, हिमाचल प्रदेश, 12 जून, 2018/22 ज्येष्ठ, 1940 (2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. रूल 49 का संशोधन.--हिमाचल प्रदेश राज्य को लागू सेन्ट्रल सिविल सविसिज (पेंशन) रूल्ज, 1972 के रूल 49 के सब रूल (2) के प्रथम परन्तुक के पश्चात्‌ निम्नलिखित द्वितीय परन्तुक अन्तःस्थापित किया जाएगा, अर्थात्‌ :-

No. Fin (Pen) A (3)-1/09-Part-V.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Central Civil Services (Pension) Rules, 1972, in their application to the State of Himachal Pradesh, namely :—

1. Short title and commencement.—(1) These rules may be called the Central Civil Services (Pension) Himachal Pradesh (Amendment) Rules, 2018.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette) Himachal Pradesh.

2. Amendment of rule 49.—In sub-rule (2) of rule 49 of the Central Civil Services (Pension) Rules,1972, in their application to the State of Himachal Pradesh, after the first proviso, the following second proviso shall be inserted, namely :—

"Provided further that the first proviso shall not be applicable in case of Class-III and

Solan (H.P.) have filed an application alongwith affidavit in the court of undersigned that they have solemnized their marriage on 06-02-2013 according to Hindu custom at Kaleshwer Mandir, Sanatan Dharam Sabha, Housing Board Colony, Phase-1, Tehsil & Distt. Solan (H.P.). Hence their marriage may be registered under the H.P. Registration of Marriage Act, 1996 in Cantonment Board Subathu, Tehsil & Distt. Solan, H.P.

Therefore, by this proclamation, the general public is hereby informed that any person having any objection for the delayed registration of marriage of above person in Cantonment Board Subathu, Tehsil & Distt. Solan (H.P.) may submit their objection in writing or appear in person in this court on or before 03-07 2018 at 10.00 A.M. failing which no objection will be entertained after expiry of date.

Viro Singh, r/o Nawagiri, Tehsil & District Muger (Bihar) के साथ हुआ है। लेकिन अज्ञानता के कारण अपने विवाह का इन्द्राज स्थानीय रजिस्ट्रार विवाह पंजीकरण ग्राम पंचायत कोटला कलां, तहसील ऊना, जिला ऊना (हि0 प्र0) में न करवा सका।

अतः इस सन्दर्भ में आम जनता को सूचित किया जाता है कि उपरोक्त वर्णित के विवाह का इन्द्राज रजिस्ट्रार विवाह स्थानीय पंजीकरण ग्राम पंचायत कोटला कलां, तहसील ऊना, जिला ऊना (हि0 प्र0) में दर्ज करवाने बारे किसी को एतराज हो तो वह दिनांक 01-07-2018 को इस न्यायालय में उपस्थित होकर प्रस्तुत कर सकता है, अन्यथा इसके बाद उक्त वर्णित विवाह पंजीकरण हेतु आगामी कार्यवाही अमल में लाई जायेगी। इसके बाद कोई भी एतराज काबिले समायत न होगा।
