संख्याः कार्मिक (नियुक्ति-IV)-बी(1)-01/2016(पार्ट).--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा 2504 राजपत्र, हिमाचल प्रदेश, 14 जून, 2018/24 ज्येष्ठ, 1940 आयोग के परामर्श से, इस विभाग की अधिसूचना संख्याः कार्मिक(ए-I)-ए(1)-3/92 तारीख 25 फरवरी, 1997 द्वारा अधिसूचित कार्मिक विभाग, सहायक विधि परामर्शी एवं अवर सचिव (विधि), वर्ग-I (राजपत्रित) भर्ती एवं प्रोन्नति नियम, 1997 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश कार्मिक विभाग, सहायक विधि परामर्शी एवं अवर सचिव (विधि), वर्ग-I (राजपत्रित), भर्ती और प्रोन्नति (प्रथम संशधन) नियम, 2018 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त हाेंगे।

2. उपबन्ध-''अ'' का संशोधन.--(1) कार्मिक विभाग, सहायक विधि परामर्शी एवं अवर सचिव (विधि), वर्ग-I (राजपत्रित), भर्ती और प्रोन्नति नियम, 1997 के उपबन्ध-अ में;

(क) स्तम्भ संख्या 4, के सामने उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-- ''पे बैंड ` 15600-39100 ` 6600/- ग्रेड पे'';

(ख) स्तम्भ संख्या 9, के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- ''लागू नहीं ''

(ग) स्तम्भ संख्या 11, के सामने उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-- ''वरिष्ठ विधि अधिकारियों में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर वरिष्ठ विधि अधिकारियों में से प्रोन्नति द्वारा जिनका वरिष्ठ विधि अधिकारी और विधि अधिकारी के रूप में संयुक्ततः छः वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके छः वर्ष का नियमित सेवाकाल हो, जिसमें वरिष्ठ विधि अधिकारी के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी।''

(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धाें के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे;

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।2505 राजपत्र, हिमाचल प्रदेश, 14 जून, 2018/24 ज्येष्ठ, 1940 स्पष्टीकरण.--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसे डिमोबीलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(2) इसी प्रकार स्थायीकरण के सभी मामलाें में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी :

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

(घ) स्तम्भ संख्या 17, के सामने उपबन्ध के स्थान पर निम्नलिखित उपबन्ध रखा जाएगा, अर्थात्‌ः-- ''सेवा में प्रत्येक सदस्य को आगामी उच्चतर पद पर प्रोन्नति के लिए समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथाविहित विभागीय परीक्षा उत्तीर्ण करनी होगी।"

No. Per (A-IV)-B(1)-1/2016(Part).—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Department of Personnel, Assistant Legal Re-membrancer-cum-Under Secretary (Law), Class-I (Gazetted), Recruitment & Promotion Rules, 1997, Notified vide this Department's Notification No. Per(A-1)-A(1)-3/92, dated 25th February, 1997, namely :—

1. Short title and commencement.—(1) These rules may be called the Department of Personnel, Assistant Legal Remembrancer-cum-Under Secretary (Law), Class-I (Gazetted), Recruitment & Promotion (First Amendment), Rules, 2018.

(2) These rules shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2506 राजपत्र, हिमाचल प्रदेश, 14 जून, 2018/24 ज्येष्ठ, 1940 2. Amendment in Annexure-I.—In Annexure-I to the Department of Personnel, Assistant Legal Remembrancer-cum-Under Secretary (Law), Class-I (Gazetted), Recruitment & Promotion Rules, 1997 :—

(a) for the provision against Column No. 4, the following shall be substituted, namely :—

"Pay Band ` 15600—39100+ ` 6600 Grade Pay"

(b) for the provision against Column No. 9, the following shall be substituted, namely :—

"Not applicable"

(c) for the provision against Column No. 11, the following shall be substituted, namely :—

"By promotion from amongst the Senior Law Officers with five years' regular service of regular combined with continuous adhoc service rendered, if any in the grade, failing which by promotion from amongst the Senior Law Officers who possess six years of regular service or regular combined with continuous adhoc service rendered, if any, as Senior Law Officer and Law Officer combined which shall also include two years' essential service as Senior Law Officer (English).

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules :

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration :

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years' of that prescribed in the R & P Rules for the post, whichever is less :

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion :

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of Vacancies in the Himachal State Non- Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of the Ex-Servicemen (Reservation of Vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(2) Similarly, in all cases of confirmation adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R & P Rules :

Provided that inter-se seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged." (d) for the provision against Column No. 17, the following provision shall be substituted, namely :—

"Every member of the service shall pass a Department Examination as prescribed in the H.P. Department Examination Rules, 1997, as amended from time to time".

No. 6532-70/MA-MC-I-CMO.--Whereas, there is an apprehension of out-break of epidemic like cholera, gastroenteritis/diarrhea and dysentry etc, during forthcoming summer & rainy seasons. Therefore, it is essential to take prenentive measures to check the out-break of such water-borne diseases in the District.

Hence, I, Rakesh Kumar Prajapati, IAS, District Magistrate, District Una, in exercise of the power conferred upon me by the Government vide its notification No. 17-7/81 M & FPP dated 02-07-1974 under the Epidemic Diseases Act, 1897 do hereby order to prohibit:--

(1) The sale of articles of food unfit for human consumption and exposed to dust and flies.

vegetables, exposed to dust and flies, not covered with wire-gauze or glass covers.

(3) The sale of sweet meats/meat, fish/chat, biscuits and other articles of food including milk, cold drinks, unless covered from dust and flies.

(4) The sale of ice-candies, ice cream prepared with water which is without the certificate of Analyst and Bacteriologist.

(5) The use of un-tinned utensils, chipped crockery and dirty water.

(6) Any activity or unauthorized pursuit/business by any one which may cause apprehension of out break of any epidemic anywhere & around inhabited vicinity/ locality.

Any person acting in contravention to this order is punishable U/S 188 I.P.C.

It is also ordered that in the event of suspected out break of such diseases, all people living in the locality shall undergo cholera inoculation and will co-operate in adopting all preventive measures.

Also, I do hereby authorize the C.M.O./M.O.H./B.M.Os, M.Os/in-charge of civil/Rural Hospitals, PHCs, Civil and rural dispensaries, Asstt. Unit officers, Health.

Supervisors/M.O., District Ayurvedic Officer/Ayurvedic Officer/Food Safety Officers/ Inspectors and Sanitary Inspectors of Municipal Committees/Nagar Panchayat and all the Executive Magistrates in the Una District to enter into and inspect any market, building, shop or place used for storage and manufacture of the aforesaid articles and to seize/remove or to dispose of the same in any manner they think fit in order to prevent the manufacturing of the articles being prepared in contravention of the above order and otherwise unfit for human consumption.

It is further directed that all water storage tanks Government & private should be cleaned with bleaching power and chlorination should be done properly in all storage tanks, Government & private bowies, spring etc.

These orders shall come into force with immediate effect and shall continue till further orders.
