No. Per(AP.B)D(7)-1/2017.—In continuation of this department O.M. No. Per(AP.B)D(8)- 1/2005 dated 15-02-2006, No. Per(AP.B)B(2)-3/2001 dated 29-05-2006, 19- 04-2007, 16-04-2008, 17-03-2010, 09-03-2011, 01-06-2011, 16-04-2014 and No. Per(AP-B)D(7)-1/2017 dated 06-07- 2017 on the subject cited above, the undersigned is directed to re-iterate that all the departments 92-राजपत्र/2018-30-07-2018 (3613)3614 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2018/8 श्रावण 1940 will ensure that statutory rules/orders/regulations are invariably published in the Government Gazette strictly as per the prescribed law without any mistakes and delay. It will also be ensured by the departments that the short title, commencement and year of publication of every rule should be the same. Any lapse in this regard will be viewed seriously.

Dated, the 30th July, 2018

No. SEC.16-70/2014-II-2206.—Whereas the State Election Commission has issued Election Programme vide its Notification No. SEC. 16-70/2014-II- dated 03-07-2018 for the conduct of by-elections to Panchayati Raj Institutions in the State on 29-07-2018;

And Whereas in pursuance to the Election Programme issued by the State Election Commission the District Election Officer (Panchayat)-cum-Deputy Commissioner Bilaspur has issued Notice of Election Programme for the conduct of by-elections to the post of Member of Ward No.7 of Gram Panchayat Patta Development Block Ghumarwin;

And whereas the District Election Officer (Panchayat)-cum-Deputy Commissioner Bilaspur vide its letter No. BLP-Panch-Election/2018-203, dated 29-07-2018 has informed this Commission that the Presiding Officer of the said ward has adjourned the poll in this ward as the polling party while issuing the ballot paper to the electors, entered name of the elector on the ballot paper itself. The District Election Officer (P) has requested the Commission to fix the day for the conduct of fresh poll in this ward.

Now therefore, the State Election Commission is of the considered view that this action of the polling party is in violation of Section 158E of the Himachal Pradesh Panchayati Raj Act, 1994 read with Rule 50 of the Himachal Pradesh Panchayati Raj (Election) Rule, 1994 hence election process in this ward has been vitiated.

Consequently the State Election Commission in exercise of the powers vested in it under Article 243-K of the Constitution of India, Section160 of the Act ibid read with Rules 32 (5), 71(2) (a) of the Rule ibid, hereby declare the poll of the Ward No.7 of Gram Panchayat Patta Development Block Ghumarwin as void and invalidates the cast ballot papers inserted in the ballot box. Further the Commission appoints the 31st day of July, 2018 to take the fresh poll in this ward between 7.00 (A.M.) hours to 3.00 (P.M.) hours. The counting of votes shall be taken up immediately after the close of the poll at the Gram Panchayat Headquarters and the result of the election shall be declared immediately after the counting is over.

The State Election Commission further directs that in the fresh poll the indelible ink mark shall be put on the forefinger of the right hand (repeat right hand) of the elector. The polling party shall be supplied fresh authenticated copies of electoral rolls of the ward concerned alongwith new series of the ballot paper. New polling party shall be appointed to take the fresh poll.

Further, the polled ballot box, unused ballot papers marked copy of the electoral rolls and other papers connected with this poll shall be sealed and kept in the custody of Block Development Officer Ghumarwin and will not be opened till further orders.
