सं0 रैव0(एस0टी0)सराँह/अधिसूचना/20/2018-295-99.--सम्पदा काहन खास, तहसील पच्छाद, जिला सिरमौर, हिमाचल प्रदेश का कार्य भू-व्यवस्था माननीय उच्च न्यायालय हिमाचल प्रदेश के वाद संख्याः 107-राजपत्र/2018-21-08-2018 (4131) 4132 राजपत्र, हिमाचल प्रदेश, 21 अगस्त, 2018/30 श्रावण, 1940 CWP No. 8072/2014 में पारित आदेश की पालना में पैमाईश समाप्त होकर मुसावी व खतौनी मय मुतफर्क नक्शाजात तैयार हो चुके हैं जिसकी पड़ताल व तस्दीक आखिरी आज दिनांक 06-08-2018 को मुकाम काहन में जलसा आम में मुकम्मल कर दी गई है। जिसके उपरान्त भू-राजस्व अभिलेख तैयार किया जाना है।

अतः हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 की धारा 33(6) के अन्तर्गत यह अधिसूचना जारी करके सम्पदा काहन के भूस्वामी, मुजारेयान, मुर्तेहनान, पट्टादारान, काबिजान आदि को सूचित किया जाता है कि हाल भू-व्यवस्था में जिस कदर अभिलेख तैयार किया गया है, उसका निरीक्षण पटवारी भू-व्यवस्था सम्पदा काहन व गिरदावर कानूनगो भू-व्यवस्था वृत्त कांगरधरयार के कार्यालय (नजदीक जोहड़/गौतम निवास स्थित सराँह) में आ करें, यदि किसी का कोई उज़र-एतराज हो तो दिनांक 05-09-2018 तक अधोहस्ताक्षरी के कार्यालय में लिखित रूप में प्रस्तुत/भेजने की व्यवस्था करें। इसके बाद कोई भी उज़र व आपत्ति मान्य नहीं होगी। यदि किसी का कोई उजर-एतराज विहित अवधि में प्राप्त नहीं होता है तो यह समझा जाएगा कि किसी को कोई उजर व एतराज नहीं है तथा तैयार भू-राजस्व अभिलेख को अन्तिम रूप दिया जाएगा।

No. 11-1/85(Lab)ID/2018/Dehra.—It appears to the undersigned that an industrial dispute exists between Shri Madan Lal s/o Shri Harbans Lal, r/o V.P.O. Rajwal, Tehsil Mukerian, District Hoshiarpur, Punjab and the Managing Director, M/s Horizon Polymers, Plot No. 192 to 195, 212 to 219, Phase-III, Industrial Area, Sansarpur Terrace, District Kangra, H. P. on the issue of alleged termination of his services w.e.f. 24-10-2017 (as alleged by workman).

As per the report under section 12(4) of the Industrial Disputes Act, 1947 submitted by the Conciliation Officer, he tried his level best to settle the dispute during conciliation proceedings but could not succeed. The report so received has been considered by the undersigned and as per power vested under sub-section 5 of Section 12 of the Act ibid, the undersigned has decided that this dispute is required to be legally adjudicated by the Labour Court/Industrial Tribunal.

Therefore, the undersigned while exercising the powers of appropriate Government vested in me vide Himachal Pradesh Government Notification No. Shram (A) 4-9/2006-IV-Loose, dated 15th February, 2014 and as per power vested under sub-section 1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court/Industrial Tribunal Dharamshala, constituted under Section 7 of Act ibid, on the following issue/issues for legal adjudication:—

"Whether termination of services of Shri Madan Lal s/o Shri Harbans Lal, r/o V.P.O. P., (ii) the Block Medical Officer (BMO), Janjehali, Mandi-cum- Chairman/Member Secretary of RKS (Rogi Kalyan Samiti), Janjehali, District Mandi, H. P., (iii) the Medical Officer, PHC Gada Gossain, Bali Chowki, Mandi, H.P. who was employed as sweeper-cum-helper on the issue of termination of his services during November 2016 (as alleged by workman).

प्रार्थी श्री राजेश कुमार पुत्र श्री होशियार सिंह, निवासी महाल चलौल, मौजा घुठियालता, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) ने स्वयं उपस्थित होकर प्रार्थना-पत्र प्रस्तुत किया कि मेरा नाम आधार कार्ड, ग्राम पंचायत नाहलियां के परिवार रजिस्टर तथा अन्य सभी जगह राजेश कुमार दर्ज है जबकि राजस्व विभाग पटवार वृत्त घुठियालता-1 के महाल चलौल, महाल समैहल, महाल मुण्डल, महाल नाहली उपरला के अभिलेख में मेरा नाम गलती से राजेश कुमार की जगह राकेश कुमार दर्ज हो चुका है, जो कि गलत है। वास्तव में भिन्न-भिन्न दो नामों का मैं एक ही व्यक्ति हूं। अतः राजस्व अभिलेख में मेरा नाम राकेश कुमार के बजाये राकेश कुमार उपनाम राजेश कुमार दर्ज किया जाये।

अतः सर्वसाधारण को सुनवाई हेतु बजरिये इश्तहार व मुस्त्री मुनादी द्वारा सूचित किया जाता है कि इस सम्बन्ध में किसी प्रकार का उजर एतराज हो तो वह दिनांक 31-08-2018 को असालतन व वकालतन पेश होकर अपना एतराज दर्ज करवा सकता है। उसके उपरान्त कोई भी उजर एतराज जेर समायत न होगा तथा राजेश कुमार पुत्र होशियार सिंह, निवासी गांव चलौल, मौजा घुठियालता, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) का नाम राजस्व अभिलेख महाल चलौल, समैहल, मुण्डल व महाल नाहली उपरला के अभिलेख में राकेश कुमार के बजाये राकेश कुमार उपनाम राजेश कुमार दर्ज करने के आदेश पारित कर दिये जायेंगे।

Hence, this proclamation is issued to the general public if they have any objection/claim regarding date of birth of above named in the record of Registrar, Birth & Death, Municipal Corporation Shimla may file their claims/objections on or before one month of publication of this notice in Govt. Gazette in this court, failing which necessary orders will be passed.
