सं0 पी0बी0डब्ल्यू0(बी0)एफ(5)17/2014.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव बखीरना गंगटोली, तहसील रोहडू, जिला शिमला, हिमाचल प्रदेश में डब्बल लाईन पुल सम्पर्क सडक वाह्य पथ मार्ग के निर्माण 116-राजपत्र/2018-01-09-2018 (4397) 4398 राजपत्र, हिमाचल प्रदेश, 01 सितम्बर, 2018/10 भाद्रपद, 1940 हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है। 2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप-धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यों को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, विन्टर फिल्ड शिमला (हि0 प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

2018 का विधेयक संख्यांक 10 हिमाचल प्रदेश लोक सेवा आयोग (अतिरिक्त कृत्य) विधेयक, 2018

(विधान सभा में पुरःस्थापित रूप में)

हिमाचल प्रदेश लोक सेवा आयोग को, व्यक्तियों की भर्ती के सम्बन्ध में सिफारिशें करने और विभिन्न संस्थानों में सेवाओं के बारे में, अतिरिक्त कृत्य साैंपने के लिए विधेयक।4407 राजपत्र, हिमाचल प्रदेश, 01 सितम्बर, 2018/10 भाद्रपद, 1940 भारत गणराज्य के उनहत्त्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश लोक सेवा आयोग (अतिरिक्त कृत्य) अधिनियम, 2018 है।

(2) यह उस तारीख को प्रवृत्त होगा जो राज्य सरकार, राजपत्र (ई-गजट), हिमाचल प्रदेश में अधिसूचना द्वारा नियत करे।

2. परिभाषाएं--इस अधिनियम में, जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,--

(क) ''आयोग'' से, हिमाचल प्रदेश लोक सेवा आयोग अभिप्रेत है;

(ख) ''सरकार या राज्य सरकार'' से, हिमाचल प्रदेश सरकार अभिप्रेत है;

(ग) ''संस्थान'' से, कोई प्राधिकरण, बोर्ड, निगम, निगमित निकाय या अनुसूची में यथा सम्मिलित कोई अन्य संस्थान अभिप्रेत है;

(घ) ''अधिसूचना'' से, राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित अधिसूचना अभिप्रेत है;

(ङ) ''विहित'' से, इस अधिनियम के अधीन बनाए गए नियमों द्वारा विहित अभिप्रेत है;

(च) ''अनुसूची'' से, इस अधिनियम से संलग्न अनुसूची अभिप्रेत है; और

(छ) ''राज्य'' से, हिमाचल प्रदेश राज्य अभिप्रेत है।

3. आयोग के अतिरिक्त कृत्य.--(1) किसी संस्थान के कर्मचारियों की नियुक्ति और सेवा की शर्तों से सम्बन्धित किसी विधि में अन्तर्विष्ट किसी बात के होते हुए भी,--

(क) सम्बद्ध प्रशासनिक विभाग के माध्यम से विहित रीति में किए गए अनुरोध पर, आयोग का यह कर्त्तव्य होगा कि ऐसे संस्थान की समूह 'क', 'ख' या 'ग' सेवा की भर्ती हेतु सिफारिशें करना या भर्ती करने के लिए परीक्षाएं/साक्षात्कार संचालित करना;

(ख) आयोग से विहित रीति में प्रशासनिक विभाग के माध्यम से परामर्श किया जा सकेगा,- (i) किसी संस्थान की भर्ती और सेवा की शर्तों से सम्बन्धित समस्त मामलों पर;

(ii) किसी संस्थान की सेवाओं के लिए नियुक्तियां करने में और एक सेवा से अन्य सेवा में प्रोन्नतियां करने में तथा ऐसी नियुक्तियों या प्रोन्नतियों के लिए अभ्यर्थियों की उपयुक्तता पर अनुसरित किए जाने वाले सिद्धान्तों पर;

(iii) किसी संस्थान के अन्तर्गत सेवारत किसी व्यक्ति को प्रभावित करने वाले समस्त अनुशासनात्मक मामलों, जिनके अन्तर्गत ऐसे मामलों से सम्बन्धित अभ्यावेदन और याचिकाएं भी हैं, पर;

(iv) कोई व्यक्ति, जोे किसी संस्थान में सेवारत है या जिसने उसमें सेवा की है, अपने कर्त्तव्य के निष्पादन में किए गए या किए जाने के लिए तात्पर्यित कार्यों की बावत उसके विरुद्ध संस्थित विधिक कार्यवाहियों के प्रतिवाद में उस द्वारा या उसकी ओर से उपगत कोई लागत ऐसे संस्थान की निधियों में से संदाय करने के किसी दावे पर;

4408 राजपत्र, हिमाचल प्रदेश, 01 सितम्बर, 2018/10 भाद्रपद, 1940 (v) किसी व्यक्ति को संस्थान में सेवा करते समय क्षति होने के सम्बन्ध में पेंशन का अधिनिर्णयन करने के लिए किसी दावे पर और ऐसे अधिनिर्णय की रकम के सम्बन्ध में किसी प्रश्न पर;

और आयोग का यह कत्र्तव्य भी होगा कि उसको इस प्रकार निर्दिष्ट किसी मामले पर और संस्थानों के कर्मचारियों से संबंधित किसी अन्य मामले, जिसे सरकार उसे निर्दिष्ट करे, में सलाह देने परः परन्तु सरकार अधिसूचना द्वारा उन मामलों को, जिनमें आयोग से परामर्श किया जाना आवश्यक नहीं होगा या तो साधारणतया या मामलों की किसी विशिष्ट श्रेणी या किन्हीं विशिष्ट परिस्थितियों में विनिर्दिष्ट कर सकेगी।

(2) किसी मामले पर आयोग और संस्थान के बीच किसी मतभेद की दशा में, संबद्ध संस्थान मामला सरकार को निर्दिष्ट करेगा और उस पर सरकार का विनिश्चय अंतिम होगा।

4. संस्थानों के लिए की गई भर्ती का पुनर्विधिमान्यकरण.--इस अधिनियम के प्रवृत्त होने से पूर्व किसी संस्थान के सन्दर्भ में आयोग द्वारा की गई भर्तियों पर सिफारिशें इस अधिनियम के अधीन पुनर्विधिमान्यकरण की गई समझी जाएंगी।

5. आयोग द्वारा सरकार को विवरणियां आदि प्रस्तुत करना.--आयोग ऐसी विवरणियां, अभिलेख और सूचना आदि, जो विहित की जाए, सरकार को प्रस्तुत करेगा।

6. अनुसूची को संशोधित करने की शक्ति.--राज्य सरकार लोक सेवा आयोग से परामर्श के पश्चात्‌, राजपत्र (ई-गजट), हिमाचल प्रदेश में अधिसूचना द्वारा, अनुसूची में किसी प्रविष्टि को जोड़ सकेगी या उसका लोप कर सकेगी या अनुसूची को अन्यथा संशोधित कर सकेगी और तदुपरि अनुसूची संशोधित की गई समझी जाएगी।

7. अधिनियम का अध्यारोही प्रभाव होना.--इस अधिनियम के उपबन्ध तत्समय प्रवृत्त किसी अन्य विधि में उनसे असंगत किसी बात के होते हुए भी, या इस अधिनियम से अन्यथा किसी विधि के आधार पर प्रभावी किसी लिखत के होते हुए भी प्रभावी होंगे।

8. नियम बनाने की शक्ति.--(1) सरकार, आयोग के परामर्श से और अधिसूचना द्वारा पूर्व प्रकाशन के पश्चात्‌ इस अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए नियम बना सकेगी।

(2) विशिष्टतया और पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियम निम्नलिखित के लिए उपबन्ध कर सकेंगे-

(क) संस्थान या किसी अन्य सक्षम प्राधिकरण द्वारा आयोग से परामर्श करने के लिए अनुसरित की जाने वाली प्रक्रिया;

(ख) कोई मामला, जो आयोग के साथ परामर्श करने के प्रयोजन के लिए आनुषंगिक या आवश्यक हो;

और

(ग) आयोग द्वारा प्रस्तुत की जाने वाली विवरणियों, अभिलेखों और सूचना आदि के लिए; और (घ) कोई अन्य मामला जिसके लिए इस अधिनियम के अधीन नियम बनाए जाएं।

(3) इस अधिनियम के अधीन बनाया गया प्रत्येक नियम, इसके बनाए जाने के पश्चात्‌ यथाशीघ्र विधान सभा के समक्ष, जब यह कम से कम पन्द्रह दिन की अवधि के लिए सत्र में हो, जो एक या दो आनुक्रमिक सत्रों में पूरी हो सकेगी, रखा जाएगा और यदि उस सत्र के, जिसमें यह इस प्रकार रखा गया है, सत्र के ठीक अवसान से पूर्व विधान सभा उस नियम में कोई उपान्तरण करती है या विधान सभा विनिश्चय करती है कि नियम नहीं बनाया जाना चाहिए, तो वह नियम, यथास्थिति, ऐसे उपान्तरित रुप में ही प्रभावी होगा या वह निष्प्रभाव हो जाएगा। तथापि, ऐसे किसी उपान्तरण या बातिलीकरण से तद्‌धीन पहले की गई किसी बात की विधिमान्यता पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा।4409 राजपत्र, हिमाचल प्रदेश, 01 सितम्बर, 2018/10 भाद्रपद, 1940 अनुसूची

उद्‌देश्यों और करणों का कथन

भारत के संविधान का अनुच्छेद 320, लोक सेवा आयोग के कृत्यों को विनिर्दिष्ट करता है और अनुच्छेद 321 राज्य विधानमण्डल को अधिनियमिति द्वारा राज्य सरकार की सेवाओं और विभिन्न संस्थानों की सेवाओं की बावत लोक सेवा आयोग को अतिरिक्त कृत्यों के प्रयोग करने का उपबन्ध करने हेतु सशक्त करता है। इन संस्थानों में उपयुक्त व्यक्तियों की नियुक्ति सुनिश्चित करने और उनकी सेवा-शर्तों को विनियमित करने के आशय से हिमाचल प्रदेश लोक सेवा आयोग को उन कृत्याें, जिनका यह राज्य की सेवाओं के बारे में 4410 राजपत्र, हिमाचल प्रदेश, 01 सितम्बर, 2018/10 भाद्रपद, 1940 प्रयोग करता है, को सौंपना आवश्यक समझा गया है। इसलिए इस सम्बन्ध में विधि अधिनियमित करना अनिवार्य समझा गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है।

Bill No. 10 of 2018 THE HIMACHAL PRADESH PUBLIC SERVICE COMMISSION (ADDITIONAL FUNCTIONS) BILL, 2018

(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

A

BILL

to entrust the additional functions to the Himachal Pradesh Public Service Commission

with regard to making recommendations for recruitment of persons and as respects the services of

various institutions.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-ninth Year of the Republic of India as follows:—

1. Short title and commencement.—This Act may be called the Himachal Pradesh Public Service Commission (Additional Functions) Act, 2018.

(2) It shall come into force on such date as the State Government may, by notification in the Rajpatra (e-Gazette), Himachal Pradesh, appoint.

2. Definitions.—In this Act, unless the context otherwise requires,—

(a) "Commission" means the Himachal Pradesh Public Service Commission;

(b) "Government" or "State Government" means the Government of Himachal Pradesh;

(c) "Institution" means an authority, board, corporation, body corporate or any other institution as included in the SCHEDULE;

(d) "notification" means a notification published in the Rajpatra (e-Gazette), Himachal Pradesh;

(e) "prescribed" means prescribed by rules made under this Act;

(g) "State" means the State of Himachal Pradesh.

3. Additional functions of the Commission.—(1) Notwithstanding anything contained in any law relating to the appointment and conditions of service of employees of an institution,—

(a) on request being so made through the Administrative Department concerned in the manner prescribed, it shall be the duty of the Commission to make recommendations for recruitment or to conduct examinations/interviews for making recruitment to the services to Group A, B or C of such institution;

(b) the Commission may be consulted in the manner prescribed through the Administrative Department,—

(i) on all matters relating to recruitment and conditions of service of an institution;

(ii) on the principles to be followed in making appointments to services of an institution and in making promotions from one service to another and on the suitability of candidates for such appointments or promotions;

(iii) on all disciplinary matters affecting a person serving under an institution including memorials and petitions relating to such matters;

(iv) on any claim by or in respect of a person who is serving or has served in the institution that any cost incurred by him in defending legal proceedings instituted against him in respect of acts done or purporting to be done in the execution of his duty, for paying out of the funds of such institution;

(v) on any claim for the award of a pension in respect of injuries sustained by a person while serving in the institution and any question as to the amount of such award;

and it shall be the duty of the Commission to advise on any matter so referred to them and on any other matter relating to employees of the institutions which the Government may refer to them:

Provided that the Government may, by notification, specify the matters in which, either generally or in any particular class of cases or in any particular circumstances, it shall not be necessary to consult the Commission.

(2) In the case of any difference of opinion between the Commission and the institution on any matter, the institution concerned shall refer the matter to the Government and the decision of the Government thereon shall be final.

4. Revalidation of recruitment made for the Institutions.—The recommendations on recruitments made by the Commission with reference to any Institution before coming into force of this Act shall be deemed to have been revalidated under this Act.

5. Commission to furnish returns etc. to the Government.—The Commission shall furnish such returns, records and information etc. to the Government as may prescribed.

6. Power to amend the SCHEDULE.—The State Government after consultation with the Commission, may, by notification in the Rajpatra (e-Gazette), Himachal Pradesh, add to or delete any entry of the SCHEDULE, or otherwise amend the SCHEDULE, and thereupon the SCHEDULE shall be deemed to have been amended.

7. Act to have overriding effect.—The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act.

8. Power to make rules.—(1) The Government in consultation with the Commission and after previous publication, may make rules for carrying out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for,—

(a) the procedure to be followed by the institution or any other competent authority for consultation with the Commission;

(b) any matter which is incidental to, or necessary for, the purpose of consultation with the Commission;

(c) the returns, records and information etc. to be furnished by the Commission; and (d) any other matter for which rules may be made under this Act. (3) Every rule made under this Act shall be laid, as soon as may be, after they are so made, before the State Legislative Assembly, while it is in session, for a period of not less than fifteen days, which may be comprised in one session or in two successive sessions and, if before the expiry of the session in which they are so laid or of the session immediately following, the Assembly makes any modification(s) in the rules or the Assembly decides that the rules should not be made, such rules shall have effect only in such modified form or be of no effect, as the case may be. However, any such modification or annulment shall be without prejudice to the validity of anything done earlier thereunder.

STATEMENT OF OBJECTS AND REASONS

Article 320 of the Constitution of India, specifies the functions of the Public Service Commission and article 321 empowers the State Legislature, by an enactment, to provide for exercise of additional functions by the Public Service Commission as respects the services of the State and also as respects the services of various institutions. In order to ensure that proper persons are appointed to these institutions and to regulate their service conditions, it is considered necessary to entrust the Himachal Pradesh Public Service Commission with the same functions as it exercises as respects the services of the State. Hence, it has been considered necessary to enact a law in this regard.

This Bill seeks to achieve the aforesaid objectives.

उपरोक्त मुकद्दमा इस न्यायालय में विचाराधीन है जिसमें वादीगण ने प्रार्थना-पत्र मय हल्फिया ब्यान इस आशय से गुजारा है कि उनकीे शादी हिन्दू रीति रिवाज से दिनांक 12-10-2013 को हुई है परन्तु गलती के कारण उनकी शादी का पंजीकरण ग्राम पंचायत मुन्दला, विकास खण्ड रैत, जिला कांगड़ा के रिकार्ड में नहीं करवाया है। जिसे वादीगण अब दर्ज करवाना चाहते हैं।
