संख्या जी0ए0डी0(ई0)-बी0(2)-3/97.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, 124-राजपत्र/2018-13-09-2018 (4601) 4602 राजपत्र, हिमाचल प्रदेश, 13 सितम्बर, 2018/22 भाद्रपद, 1940 इस विभाग की समसंख्यक अधिसूचना, तारीख 14-1-2014 द्वारा अधिसूचित, हिमाचल प्रदेश सैनिक कल्याण विभाग, उप-निदेशक, सैनिक कल्याण, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सैनिक कल्याण विभाग, उप-निदेशक, सैनिक कल्याण, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2018 है। (2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबंध-''क'' का संशोधन.--हिमाचल प्रदेश सैनिक कल्याण विभाग, उप-निदेशक, सैनिक कल्याण, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2014 (जिसे इसमें इसके पश्चात्‌ ''उक्त नियम'' कहा गया है) के उपाबंध ''क'' में,--

(क) स्तम्भ संख्या 4 (ii) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

''(ii) संविदा पर नियुक्त कर्मचारियों के लिए उपलब्धियां : ` 35,000/- प्रतिमास (स्तम्भ संख्या 15-क में दिए गए ब्यौरे के अनुसार)।'';

(ख) स्तम्भ संख्या 15-क (ii) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"(II) संविदात्मक उपलब्धियां.--संविदा के आधार पर नियुक्त उप-निदेशक सैनिक कल्याण को ` 35,000/- की समेकित नियत संविदात्मक रकम (जो पे बैंड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रति मास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौत्तरी की जाती है, तो पश्चात्‌वर्ती वर्ष (वर्षों) के लिए संविदात्मक उपलब्धियों में ` 1050/- की रकम (पे बैंड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी।"

(ग) स्तम्भ संख्या 15-क (VII)(क) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

''(क) संविदा के आधार पर नियुक्त व्यक्ति को ` 35,000/- की नियत संविदात्मक रकम (जो पे बैंड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष (वर्षों) के लिए संविदात्मक रकम में ` 1050/- (पे बैंड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) की वार्षिक वृद्धि का हकदार होगा और कोई अन्य सहबद्ध प्रसुविधाएं, जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा।''; और (घ) स्तम्भ संख्या 15-क (VII) (ग) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

''(ग) संविदा पर नियुक्त व्यक्ति, एक कैलेण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0 टी0 सी0 आदि के लिए हकदार4603 राजपत्र, हिमाचल प्रदेश, 13 सितम्बर, 2018/22 भाद्रपद, 1940 नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगा।

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कैलेण्डर वर्ष तक संचित किया जा सकेगा और आगामी कैलेण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा''।

3. उपाबंध-''ख'' का संशोधन.--उक्त नियमों से संलग्न उपाबंध-''ख'' में,--

(क) क्रम संख्या 2 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''2. प्रथम पक्षकार की संविदात्मक रकम ` 35,000/- प्रतिमास होगी।''; और

(ख) क्रम संख्या 4 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

NOTIFICATION

Shimla-2, the 11th July, 2018

No. GAD(E)-b(2)-3/97.—In exercise of the powers conferred by proviso to article 309 of the constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Sainik Welfare Department Deputy Director, Sainik Welfare, Class-I (Gazetted)4604 राजपत्र, हिमाचल प्रदेश, 13 सितम्बर, 2018/22 भाद्रपद, 1940 Recruitment and Promotion Rules, 2014 notified vide this Department notification of even number, dated 14-01-2014, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Predesh Sainik Welfare Department, Deputy Director Sainik Welfare, Class-I (Gazetted) Recruitment and Promotion (First Amendment) Rules, 2018.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure "A".—In Annexure "A" to Himachal Pradesh Sainik Welfare Department, Deputy Director Sainik Welfare Class-I (Gazetted) Recruitment and Promotion Rules, 2014 (here in after referred to as "the said rules"),—

(a) for the existing provisions against Column-4 (ii), the following shall be substituted, namely :

"(ii) Emoluments for Contract Employee(s) ` 35,000/- P.M. (as per details given in Column No. 15A)." ;

(b) for the existing provisions against Column 15-A(II), the following shall be substituted, namely : —

"(II) CONTRACTUAL EMOLUMENTS.—The Deputy Director, Sainik Welfare, appointed on contract basis will be paid consolidated fixed contractual amount @ ` 35,000/- per month (which shall be equal to minimum of the pay band+grade pay). An amount of ` 1050/- (3% of the minimum of pay band+grade pay of the post) as annual for the subsequent year(s) will be allowed if contract is extended beyond one year";

(c) for the existing provisions against Column 15-A(VII)(a), the following shall be substituted, namely :—

"(a) The contractual appointee will be paid fixed contractual amount @ ` 35,000/- P.M. (which shall be equal to minimum of Pay Band+Grade pay). The contractual appointee will be entitled for annual increase in contractual amount @ ` 1050/- (3% of the minimum of pay band+grade pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given." ; and

(d) for the existing provisions against Column 15-A(VII)(c), the following shall be substituted, namely :—

"(c) The contract appointee will be entitled for one day's casual leave after putting on month's service, 10 days medical leave and 5 days special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical reimbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee :

Un-availed casual leave medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year".

(a) for the existing provision against Sl. No. 2, the following shall be substituted, namely :—

"2. The contractual amount of the First PARTY will be ` 35,000/- per month.";

and

(b) for the existing provisions against Sl. No. 4, the following shall be substituted, namely :—

"4. The contract appointee will be entitled for one day's casual leave after putting on month's service, 10 days medical leave and 5 days special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. No. STE-F (2)-7/2018.—The Governor of Himachal Pradesh is pleased to notify that the Himachal Pradesh Council for Science, Technology and Environment (HIMCOSTE), Shimla would be the Nodal Agency for establishing and operationalisation of the Sub Regional Science Centre at Palampur, Distt. Kangra which is being fully funded by the Ministry of Culture, Govt. of India through National Council for Science Museum (NCSM), Kolkata instead of the Department of Language, Art & Culture, Government of Himachal Pradesh.

Himachal Council for Science, Technology and Environment will coordinate with Ministry of Culture, Govt. of India, and with NCSM, Kolkata for its early establishment and operationalisation.

Whereas, the above named applicants have made an application before me under Section 8(4) of the Himachal Pradesh Registration of Marriage Act, 1996 alongwith relevent records and affidavits stating therein that they have solemnized their marriage on dated 17-06-2017 at their place of residence with hindu rites and customs but due to some unavoidable circumstances, it could not be entered in the records of Gram Panchayat Chakloo, Distt. Chamba, H.P. well in time.

And whereas, they have also stated that they were not aware of the laws for the registration of marriage with the registrar of marriage and now, therefore, necessary order for the registration of their marriage be passed, so that their marriage could be registered by the concerned authority.

Brikhmani under section 15 of Special Marriage Act, 1954 that they have solemnized their marriage on 21-12-2016 according to Hindu rites and customs at Village Tarna mata Mandir Mandi, District Mandi, H. P. and they are living together as husband and wife since then. Hence, their marriage may be registered under Special Marriage Act, 1954.

Therefore, the general public is hereby informed through this notice that any person who has any objection regarding this marriage, can file the objection personally or in writing before this court on or before 13-09-2018. After that no objection will be entertained and marriage will be registered.
