संख्याः टी0सी0पी0-एफ-(5)4/2017.--हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 13 की उपधारा (1) के अधीन अधिसूचना संख्याः टी0सी0पी0-एफ- (5)4/2017 तारीख 13-09-2018 द्वारा ''अर्की योजना क्षेत्र'' का गठन कर लिया गया है;

और उक्त योजना क्षेत्र के विद्यमान भू-उपयोग के मानचित्र (नक्शे) को पूर्वोक्त अधिनियम की धारा 15 की उपधारा (1) के अधीन अभी तक प्रकाशित नहीं किया गया है;

और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि पूर्वोक्त योजना क्षेत्र में भू-उपयोग में परिवर्तन या उस पर किसी निर्माण संक्रिया से सतह या किसी भूमि या मिट्‌टी पर हानिकारक अवरोध होने की सम्भावना है या मिट्‌टी के संरक्षण, भूमि के खिसकने से रोकथाम करने या कटाव से संरक्षण हेतु हानिकारक समझा गया है या पूर्वोक्त अधिनियम के उपबब्धोंं के अनुसार उक्त क्षेत्र की योजना बनाना और विकास करना कठिन होने की सम्भावना है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 15-क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ''अर्की़ योजना क्षेत्र'' के विद्यमान भू-उपयोग मानचित्र (नक्शे) पर इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए रोक लगाते हैं।

NOTIFICATION

Shimla-2, the 13th September, 2018

No. TCP-F (5)-4/2017.—WHEREAS, "Arki Planning Area" has been constituted under sub- section (1) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No.12 of 1977) vide Notification No. TCP-F (5)-4/2017 dated 13-09-2018.

AND WHEREAS, existing land use map of the said planning area has not yet been published under sub-section (1) of Section- 15 of the aforesaid Act;

AND WHEREAS, the Governor of Himachal Pradesh is satisfied that in the aforesaid planning area, the change of the land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips, or protection against erosion, or is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act.

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing land use map of the "Arki Planning Area" for a period of five years from the date of publication of this notification in the Official Gazette of Himachal Pradesh.

AND WHEREAS, existing land use map of the said planning area has not yet been published under sub-section (1) of Section 15 of the aforesaid Act;

No. TCP-F (5)-4/2017.—WHEREAS "Shri Naina Devi Ji Planning Area" has been constituted under sub-section (1) of section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notification No. TCP-F (5)-4/2017 dated 13-09-2018:

AND WHEREAS, existing land use map of the said planning area has not yet been published under sub-section (1) of section 15 of the aforesaid Act;

AND WHEREAS the Governor of Himachal Pradesh is satisfied that in the aforesaid planning area, the change of the land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips, or protection against erosion, or is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act.

Shimla-2, the 13th September, 2018

No. TCP-F (5)-4/2017.—WHEREAS, "Jubbal Planning Area" has been constituted under sub-section (1) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No12 of 1977) vide Notification No. TCP-F (5)-4/2017 dated 13-09-2018;

AND WHEREAS, existing land use map of the said planning area has not yet been published under sub-section (1) of Section 15 of the aforesaid Act;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing land use map of the "Jubbal Planning Area" for a period of five years from the date of publication of this notification in the Official Gazette of Himachal Pradesh.

और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि पूर्वोक्त योजना क्षेत्र में भू-उपयोग में परिवर्तन या उस पर किसी निर्माण संक्रिया से सतह या किसी भूमि या मिटटी पर हानिकारक अवरोध होने की सम्भावना है या मिटटी के संरक्षण, भूमि के खिसकने से रोकथाम करने या कटाव से संरक्षण हेतु हानिकारक समझा गया है या पूर्वोक्त अधिनियम के उपबन्धोंं के अनुसार उक्त क्षेत्र की योजना बनाना और विकास करना कठिन होने की सम्भावना है।

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 15-क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ''बन्जार योजना क्षेत्र'' के विद्यमान भू-उपयोग मानचित्र (नक्शे) पर इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए रोक लगाते हैं।

No. TCP-F (5)-4/2017.—WHEREAS, "Banjar Planning Area" has been constituted under sub-section (1) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notification No. TCP-F(5)-4/2017 dated 13-09-2018;

AND WHEREAS, existing land use map of the said planning area has not yet been published under sub-section (1) of section 15 of the aforesaid Act;

AND WHEREAS, the Governor of Himachal Pradesh is satisfied that in the aforesaid Planning Area, the change of the land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips, or protection against erosion, or is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act.

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing land use map of the "Banjar Planning Area" for a period of five years from the date of publication of this notification in the Official Gazette of Himachal Pradesh.

No. TCP-F (5)-4/2017.—WHEREAS, "Sunni Planning Area" has been constituted under sub-section (1) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notification No. TCP-F (5)-4/2017 dated 13-09-2018;

AND WHEREAS, existing land use map of the said planning area has not yet been published under sub-section (1) of Section 15 of the aforesaid Act;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 15-क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए "कांगडा योजना क्षेत्र'' के विद्यमान भू-उपयोग मानचित्र (नक्शे) पर इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए रोक लगाते है।

AND WHEREAS the Governor of Himachal Pradesh is satisfied that in the aforesaid planning area, the change of land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act.

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 15- A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing land use map of the "Kangra Planning Area" for a period of Five years from the date of publication of this Notification in the Official Gazette of Himachal Pradesh.
