संख्याः टीपीटी-ए(7)-1/2018.--इस विभाग की समसंख्यक अधिसूचना तारीख 25-09-2018 द्वारा हिमाचल प्रदेश मोटरयान (प्रथम संशोधन) प्रारूप नियम, 2018 को मोटरयान अधिनियम, 1988 (1988 का केन्द्रीय अधिनियम संख्या 59) की धारा 212 की उपधारा (1) के अधीन यथाअपेक्षित के अनुसार इससे 150-राजपत्र/2018-23-10-2018 (5675) 5676 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 संभाव्यतः प्रभावित होने वाले व्यक्तियों से आक्षेप(पों) और सुझाव(वों) राजपत्र (ई-गजट) हिमाचल प्रदेश में तारीख 25 सितम्बर, 2018 को आमंत्रित करने के लिए प्रकाशित किया गया था; इस निमित विनिर्दिष्ट अवधि के भीतर कोई सुझाव/आक्षेप प्राप्त नहीं हुआ/हुए हैं।

अतः हिमाचल प्रदेश के राज्यपाल, मोटर यान अधिनियम, 1988 (1988 का केन्द्रीय अधिनियम संख्या 59) की धारा 212 के साथ पठित धारा 96 की उपधारा (2) के खण्ड (xxxiii) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इस विभाग की अधिसूचना संख्याः 5-14/48-परि-3, तारीख 12 जुलाई, 1999 द्वारा प्रकाशित और राजपत्र (ई-गजट), हिमाचल प्रदेश में तारीख 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटरयान नियम, 1999 और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-

1. संक्षिप्त नाम.-- इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटर यान (प्रथम संशोधन) नियम, 2018 है।

2. नियम 73-क, का अन्तःस्थापन.--हिमाचल प्रदेश मोटर यान नियम, 1999 के नियम 73 के पश्चात्‌ निम्नलिखित नियम अन्तःस्थापित किया जाएगा, अर्थात्‌ः-

'' 73-क. शर्तें, जो स्कूलों/शैक्षणिक संस्थानों के स्वामित्वाधीन या उससे/उनसे सहबद्ध बसों/यानों से सम्बन्धित अनुज्ञापत्र में अन्तर्लिखित की जा सकेंगी.--

क्षेत्रीय परिवहन अधिकारी किसी स्कूल/शैक्षणिक संस्थान के स्वामित्वाधीन या उससे/उनसे सहबद्ध स्कूल बसों/यानों से सम्बन्धित अनुज्ञापत्र में, यथास्थिति, धारा 72 की उपधारा (2) धारा 73, 74, 76 में यथा विनिर्दिष्ट शर्तों के अतिरिक्त निम्नलिखित शर्तें अन्तर्लिखित कर सकेगा, अर्थात्‌ :-- (1) परिवहन सम्बन्धित स्कूल सुरक्षा शर्तेंः वर्तमानतः, राज्य में स्कूली बच्चों को परिवहन प्रसुविधाएं प्रदान करने के लिए यानों के निम्नलिखित प्रवर्गों का प्रयोग किया जा रहा है :-

(क) स्कूलों द्वारा स्वयं प्रचालित बसें;

(ख) स्कूलों द्वारा पट्‌टा आधार पर ली गई प्राईवेट संविदा वाहन/हिमाचल पथ परिवहन निगम की बसें; और

(ग) स्कूली बच्चों को परिवहन सुविधाएं प्रदान करने हेतु प्रयुक्त मोटर कैब/मैक्सी कैब यान। यानों की उपरोक्त तीनों प्रवर्गों (श्रेणियों) के लिए साधारण और वर्गवार दिशा-निर्देश तथा जब कभी स्कूल प्रबन्धन द्वारा किसी भी बस का संचालन, संविदा और प्रयोग किया जाता है, तो उसे/उन्हें इन शर्तों का कड़ाई से पालन करना होगा :--

(क) समस्त प्रवर्गों के लिए लागू साधारण शर्तें.--(i) स्कूल द्वारा स्व-परिचालित बसें और पूर्णकालिक संविदा के आधार पर व्यवस्थित बसों को गहरे पीले रंग से पेंट किया जाएगा और बसों पर दोनाें तरफ स्कूल का नाम स्पष्टतया लिखा हो ताकि इसे आसानी से पहचाना जा सके। यान के पीछे और सामने 400 एम एम X 300 एमएम के आकार में ''स्कूल बस'' लिखा हो। यदि यह पट्टे पर ली गई बस/यान है, तो इस पर ''ऑन स्कूल ड्‌यूटी'' स्पष्टतया लिखा हो। स्कूल बस/यान में प्राथमिक चिकित्सा सहायता बाक्स और पीने का पानी हो।

(ii) बस के भीतर चालक का ब्यौरा (नाम, फोटो, अनुज्ञप्ति नम्बर और दूरभाष नम्बर) प्रदर्शित किया जाएगा और स्कूल का नाम या बस के स्वामी का नाम, बालक सहायता नम्बर 1098, आवश्यक आपात नम्बर (पुलिस, अस्पताल) तथा यान रजिस्ट्रीकरण नम्बर को बस के बाहरी भाग में महत्वपूर्ण स्थानों पर प्रतिदीप्त रंगों में प्रदर्शित हो। यह सूचना बस के सभी यात्रियों और लोगों को स्पष्टतया दिखाई देनी चाहिए, ताकि आवश्यकता पड़ने पर स्कूल प्रबन्धन/पुलिस या अन्य अधिकारियों को सूचित किया जा सके।5677 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 (iii) यदि छात्रों की आयु 12 वर्ष से कम है तो यान/बस में छात्रों की संख्या यान की विहित क्षमता से डेढ़ गुना से अधिक नहीं होगी। 12 वर्ष की आयु से ऊपर के छात्र को एक व्यक्ति के रूप में समझा जाएगा।

(iv) छात्रों की सुरक्षा के लिए स्कूल बस/यान की सीटें मानकों सहित पंक्ति में होनी चाहिए। (v) स्कूल बस/यान में पर्याप्त रोशनी हो और शीशों पर कोई पर्दा और किसी प्रकार की फिल्म चढ़ी नहीं हो ताकि आन्तरिक गतिविधियां बाहर से स्पष्टतया दिखाई दे सकें। इसके अतिरिक्त बस/यान में किसी भी प्रकार का संगीत उपकरण न हो।

(vi) किन्हीं भी परिस्थितियों में, किसी भी अनधिकृत व्यक्ति का बस/यान में बैठना अनुज्ञात नहीं किया जाएगा, न ही कोई आक्षेपठीय पदार्थ जैसे कि गैस सिलेण्डर, मिट्‌टी का तेल, तेजाब, शराब आदि रखना अनुज्ञात किया जाएगा।

(vii) स्कूल बस/यान बच्चों को चढ़ाने और उतारने के दौरान खड़ी रहे।

(viii) बस/यान और इनमें बैठे यात्रियों का मोटर यान अधिनियम, 1988 में अन्तर्विष्ट उपबन्धों के अन्तर्गत विधिमान्य बीमा हो।

(ix) स्कूल बस/यान की नियमित रूप से और नियत अन्तराल पर मुरम्मत/निरीक्षण किया गया हो तथा मोटर यान अधिनियम, 1988 के उपबन्धों के अधीन उपयुक्तता प्रमाण-पत्र प्राप्त करना अनिवार्य होगा। (x) प्रत्येक स्कूल बस/यान के रूट और ठहराव स्थल का क्षेत्रीय परिवहन प्राधिकारी या स्कूल प्रबंधन द्वारा अनुमोदित किया जाना अपेक्षित होगा और इस सम्बंध में सूचना परिवहन विभाग और स्थानीय प्रशासन को देनी आवश्यक होगी।

( xi) स्कूल को परिवहन सुविधाएं प्रदान करने वाले यान 15 वर्ष से पुराने नहीं होंगे।

(xii) प्रत्येक स्कूल बस/यान में ग्लोबल पोजिशनिंग सिस्टम (जी0पी0एस0) का प्रतिष्ठापन करना अनिवार्य होगा। स्कूल प्रबन्धन और यान के स्वामी को यह सुनिश्चित करना होगा कि यह प्रणाली हर समय सुचारू रूप से कार्य कर रही हो तथा इसके अभिलेख की नियमित रूप से जांच हो रही हो और यदि अपेक्षित हो, तो वह उपलब्ध हो।

( xiii) स्कूल बस/यान के चालक के पास विधि मान्य चालन अनुज्ञप्ति हो।

( xiv) चालक की आयु 60 वर्ष से अधिक न हो।

(xv) बस/यान के चालक की आंखों के परीक्षण सहित शारीरिक आरोग्यता की जांच हर वर्ष होनी चाहिए और स्कूल प्रबंधन चालक को स्वास्थ्य कार्ड उपलब्ध करवाएगा। स्कूल प्रबंधन यह भी सुनिश्चित करेगा कि चालक को मोटरयान अधिनियम, 1988 के अधीन सुरक्षा मानकों के अनुसार सक्षम प्राधिकारी द्वारा आरोग्यता प्रमाण-पत्र जारी किया गया हो ।

(xvi) कोई भी स्कूल प्रबंधन, यदि मोटर यान अधिनियम, 1988 या तद्‌धीन बनाए गए नियमों के उपबंधों और राज्य सरकार या माननीय न्यायालय द्वारा जारी निदेशों का उल्लंघन करता हुआ पाया जाता है तो उसे नियमानुसार दण्डित किया जाएगा।

(xvii)यान चलाते समय स्कूल बस/यान चालक द्वारा मोबाईल फोन का उपयोग करना सर्वथा प्रतिषिद्ध होगा। 5678 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 (xviii) स्कूल प्रबंधन/यान का स्वामी बसों/यानों में छेड़छाड़ रोधी स्पीड गवर्नर, जिनकी अधिकतम गति सीमा 40 किलोमीटर प्रति घंटा होगी, लगवाना सुनिश्चित करेगा।

(xix) दिव्यांगों/छात्रों की सुविधा के लिए यानों/बसों में नियमानुसार आवश्यक और समुचित व्यवस्था करनी अनिवार्य होगी।

(xx) यह सुनिश्चित किया जाए कि स्कूल बस में आई0एस0आई0 मानक वाले पांच किलोग्राम क्षमता के दो अग्निशमन यंत्र स्थापित हों, जिनमें से एक चालक के केबिन में हो और दूसरा आपात निकास द्वार के निकट रखा हो। चालक, परिचालक और महिला गार्ड/परिचर अग्निशमन-यंत्र को संचालित करने में प्रशिक्षित हों। स्कूल प्रबंधन उनकी नियमित जांच भी सुनिश्चित करें ताकि ये हर समय चालू हालत में रहें। इसके अतिरिक्त मोटर/मैक्सी कैब में भी अग्निशमन यंत्र रखना अनिवार्य होगा और उसे हर समय चालू हालत में रखा जाए।

(ख) वर्ग-वार शर्तें.--1. स्कूलों द्वारा स्व-संचालित बस/यान :

(i) स्कूल बस/यान गहरे पीले रंग से पेंट किए जाएंगे और इनके दोनों ओर स्कूल का नाम स्पष्टतः लिखा जाए ताकि इनकी पहचान आसानी से हो सके।

(ii) स्कूल बस/यान के आगे और पीछे ''स्कूल बस/यान" लिखा हो।

(iii) बस की खिड़कियों में ग्रिल/जाली लगाई जाए।

(iv) स्कूल प्रबंधन यह सुनिश्चित करेगा कि प्रत्येक स्कूल बस में आपात द्वार और चालक के लिए पारदर्शी केबिन हो।

(v) प्रत्येक स्कूल बस/यान में सीसीटीवी कैमरा प्रतिष्ठापित करना अनिवार्य होगा। स्कूल प्रबंधन सुनिश्चित करे कि यह प्रणाली हर समय सुचारू रूप से कार्य कर रही है और इसके अभिलेख की जांच नियमित रूप से हो रही है तथा यदि अपेक्षित हो, तो वह उपलब्ध हो ।

(vi) स्कूल बस चालक के पास भारी यान चलाने का कम से कम पांच वर्ष का अनुभव हो। (vii) स्कूल बस में चालक के अतिरिक्त एक परिचालक भी हो, जिसके पास हिमाचल प्रदेश मोटरयान नियम, 1999 के नियम 22 (3) के उपबंधों के अधीन विधिमान्य अनुज्ञप्ति और विहित अर्हता भी हो।

(viii) स्कूल प्रबन्धन, प्रत्येक स्कूल बस में कम से कम एक प्रशिक्षित महिला गार्ड/परिचर की व्यवस्था भी सुनिश्चित करेगा, जो बस में यात्रा करने वाले छात्रों की देखभाल करेगी तथा यात्रा के दौरान उनकी सुरक्षा सुनिश्चित करेगी और छात्रों को बस में चढ़ने और उतरने में भी सहायता करेगी। (ix) स्कूल बैग को सुरक्षित रखने हेतु सीटों के नीचे या बस में सुविधाजनक स्थान की उपलब्धता सुनिश्चित हो।

(x) स्कूल प्रबन्धन को यथासंभव स्वेच्छानुसार ऐसी व्यवस्था करने का भी निर्देश दिया जाए कि प्रत्येक स्कूल बस में माता या पिता में से कम से कम एक उपस्थित हो, जो यात्रा के दौरान बस चालक तथा अन्य कर्मचारिवृन्द के व्यवहार पर निगरानी रखे, जिससे यह सुनिश्चित हो सके कि बच्चों की सुरक्षा संबंधी नियमों का पालन किया जा रहा है और चालक द्वारा बस सावधानीपूर्वक चलाई जा रही है।5679 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 (xi) स्कूल बसों में अलारम तथा सायरन की व्यवस्था हो ताकि किसी भी आपात स्थिति में सभी को सतर्क किया जा सके।

(xii) बस चालक और परिचालक ग्रे रंग की वर्दी और काले रंग के जूते पहनेंगे। वर्दी पर उनके नाम की पट्टी स्पष्टतः प्रदर्शित हो।

(xiii) स्कूल बस के परिचालक के पास सदैव यात्रा कर रहे विद्यार्थियों के नाम, कक्षा, आवासीय पता, दूरभाष सम्पर्क नम्बर, ब्लड ग्रुप, बस ठहराव का नाम, रूट प्लान आदि से सम्बन्धित सूचना हो। (xiv) बस चालकों की चालन और व्यवहारिक कुशलता में सुधार लाने के लिए उन्हें प्रत्येक वर्ष पुनश्चर्या प्रशिक्षण पाठ्‌यक्रम करवाया जाए। इस प्रकार का पुनश्चर्या प्रशिक्षण पाठ्‌यक्रम परिवहन विभाग द्वारा आयोजित किया जाए।

(xv) स्कूल प्रबन्धन प्रत्येक स्कूल बस में एक मोबाईल फोन उपलब्ध करवाए ताकि किसी भी आपात स्थिति में स्कूल बस से सम्पर्क किया जा सके या स्कूल बस चालक/परिचालक/पुलिस, स्कूल प्रबन्धन या प्रशासन से सम्पर्क किया जा सके।

2. स्कूलों द्वारा पट्टे पर लिए गए निजी संविदा वाहन/हिमाचल पथ परिवहन निगम की बसें :

(i) स्कूलों द्वारा पट्टे पर ली गई बसों की संविदा स्कूल के साथ होगी और उस बस का चालक सदैव संविदा की प्रति अपने पास रखेगा।

(ii) ऐसी बसों के संबंध में, स्कूल प्रबंधन के लिए चालक का नाम और यान का विवरण निकट के पुलिस थानों और जिला यातायात पुलिस को देना अनिवार्य होगा।

(iii) प्रत्येक स्कूल बस/यान में सीसीटीवी कैमरा स्थापित करना अनिवार्य होगा। स्कूल प्रबंधन और यान का स्वामी यह सुनिश्चित करेगा कि यह प्रणाली हर समय सुचारू रूप से कार्य कर रही है और इसके अभिलेख की जांच नियमित रूप से हो रही है तथा यदि अपेक्षित हो तो, वह उपलब्ध है।

(iv) स्कूल बस के चालक के पास भारी वाहन चलाने का कम से कम पांच वर्ष का अनुभव हो। (v) स्कूल बस में चालक के अतिरिक्त एक परिचालक भी हो जिसके पास हिमाचल प्रदेश मोटर यान नियम, 1999 के नियम 22 (3) के उपबन्धों के अधीन विधिमान्य अनुज्ञप्ति तथा विहित अर्हता भी हो।

(vi) चालक और परिचालक के लिए वर्दी पहनना अनिवार्य होगा। हिमाचल पथ परिवहन निगम की बस की दशा में निगम प्रबंधन द्वारा विनिश्चित वर्दी तथा जूते पहनना अनिवार्य होगा अन्यथा उन्हें नीले रंग की वर्दी तथा काले रंग के जूते पहनना अनिवार्य होगा। वर्दी पर उनकी नाम पटि्‌टका स्पष्टतः प्रदर्शित हो।

3. स्कूली बच्चों को परिवहन सुविधाएं उपलब्ध करवाने हेतु प्रयुक्त मोटर कैब/मैक्सी कैब यान :

(i) मोटर कैब/मैक्सी कैब के आगे व पीछे ''स्कूल ड्‌यूटी पर'' स्पष्टतः लिखा हो।

(ii) ऐसी मोटर/मैक्सी कैब के सम्बन्ध में स्कूल प्रबंधन को निकट के पुलिस थाना तथा जिला यातायात पुलिस को चालक का नाम और यान का विवरण देना अनिवार्य होगा।

(iii) यान को चलाते समय, चालक के पास विधिमान्य चालन अनुज्ञप्ति हो। 5680 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 (iv) पांच वर्ष से कम आयु के बच्चों को यान की सामने वाली सीट पर बैठना अनुज्ञात नहीं होगा। (v) यान के चालक को नीले रंग की वर्दी तथा काले रंग के जूते पहनना अनिवार्य होगा। वर्दी पर उसकी नाम पटि्‌टका स्पष्टतः प्रदर्शित हो।

NOTIFICATION

Shimla-2, the 12th October, 2018

No. TPT-A(7)-1/2018.-WHEREAS the draft Himachal Pradesh Motor Vehicles (First Amendment) Rules, 2018 were published in the Rajpatra (e-Gazette), Himachal Pradesh, vide this Department Notification of even number dated 25-09-2018 for inviting objection(s) and suggestion(s) from the persons likely to be effected thereby, as required under sub-section (1) of section 212 of the Motor Vehicle Act, 1988 (Central Act No. 59 of 1988).

AND WHEREAS, no objection(s)/suggestion(s), in this behalf has been received within the specified period.

NOW, THEREFORE, in exercise of the powers conferred by clause (xxxiii) of sub-section (2) of section 96 read with section 212 of Motor Vehicles Act, 1988 (Central Act No. 59 of 1988), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Motor Vehicle Rules, 1999 notified vide this Department Notification No. 5- 14/88-TPT-III, Dated 12th July, 1999 published in the Rajpatra (e-Gazette), Himachal Pradesh on 27th July, 1999, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Motor Vehicles (First Amendment) Rules, 2018.

2. Insertion of Rule 73-A.—In the Himachal Pradesh Motor Vehicles Rules, 1999 after rule 73 the following shall be inserted namely:—

"73-A. Conditions that may be inscribed in the permit relating to Buses/vehicles owned or attached with School/Educational Institutions.

A Regional Transport Authority may inscribe in the permit belonging to the School buses/vehicles owned or attached with a School/Educational Institution, the following5681 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 conditions in addition to those as specified in sub-section (2) of section 72,73,74,76 as the case may be namely:—

(1) Transport related school safety Conditions.—Currently, following categories of vehicles are being used to provide transport facilities for school children in the state :—

(a) Buses, self operated by schools;

(b) Buses of private contract carriage/Himachal Road Transport Corporation taken on lease basis by schools; and

The general and class-wise guidelines for the above three categories of vehicles and whenever the school management operates, contracts and uses any bus, they shall strictly adhere to these conditions: ---

A. General conditions applicable to all categories.—(i) The buses self-operated by the school and buses arranged on the basis of whole time contract shall be painted in dark yellow colour and the name of the school shall be written clearly on both sides so that it can be easily identified. "School Bus" shall be written in the size of 400mm x 300mm on the back and front of the vehicle. If it is a leased bus/vehicle, then "On School Duty" shall be clearly written on it. There should be a first aid box and drinking water in the school bus/vehicle.

(ii) Details of the driver (name, photo, license number and telephone number) shall be displayed inside the bus and the name of the school or name of the owner of the bus, Child Helpline No. 1098, important emergency numbers (Police, Hospital) and vehicle registration number will be displayed in fluorescent colours at prominent places outside the bus. This information should be clearly visible to all passengers of the bus and people so that the school management/police or other officers can be informed when required.

(iii) If the age of the students is less than 12 years then the number of students in the vehicle/bus will not exceed 1½ times the prescribed capacity of the vehicle. Student over 12 years of age will be considered as a person.

(iv) School bus/vehicle seats should be in line with standards for students safety.

(v) There should be sufficient lighting in the school bus/vehicle and there should be no curtain and any type of film on glasses, so that the inside activities will be clearly visible from the outside. Apart from this, the bus/vehicle will not have any kind of music device.

(vi) Under any circumstances, no unauthorized person shall be allowed to sit in the bus/vehicle, nor will it be allowed to place any objectionable materials like gas cylinders, kerosene, acids, liquor etc.

(vii) School bus/vehicle must be stationary during boarding and de-boarding of the children.

(viii)In bus/vehicle, passenger and vehicle should have valid insurance under provisions contained in the Motor Vehicles Act, 1988.

(ix) The School bus/vehicle shall be repaired/inspected at regular and fixed intervals and it will be mandatory to get a fitness certificate under the provisions of the Motor Vehicles Act, 1988.

(x) Route and stoppage of each school bus/vehicle will be required to be approved by Regional Transport Authority or School Management and it will be necessary to give information in this regard to the Transport Department and local administration.

(xi) Vehicles providing transportation facilities to schools will not be more than 15 years old.

(xii) It shall be mandatory to install Global Positioning System (GPS) in each school bus/vehicle. The school management and vehicle owner must ensure that this system is functioning smoothly at all times and its record is regularly checked and available, if required.

(xiii) The driver of the school bus/vehicle should have a valid driving license.

(xiv) The driver's age should not be more than 60 years.

(xv) The physical fitness of the bus/vehicle driver, including eye examination, should be done every year and the school management will provide the health card to the driver. School management will also ensure that the driver has been issued a fitness certificate by the competent authority according to safety standards under the Motor Vehicles Act, 1988.

(xvi) Any school management, if found violating the provisions of the Motor Vehicles Act, 1988 or the rules made thereunder and the directions issued by the State Government or Hon'ble Court, will be punished as per the rules.

(xvii) While driving, the use of mobile phone by the school bus/vehicle driver will be strictly prohibited.

(xviii) School Management/Vehicle Owner will ensure fitting of tamper-proof Speed Governors in buses/vehicles with maximum speed limit of 40 KM per hour.

(xix) For the convenience of divyangs/students, necessary and appropriate provisions will be mandatory in vehicles/buses as per the rules.

(xx) It will be ensured that school bus should have two ISI standard fire extinguishers of 5 Kg. capacity installed in the bus, of which one should be placed in the driver's cabin and the other should be placed near the emergency exit gate. Drivers, conductor and female guard/attendant should be trained to operate fire fighting equipment. School management will also ensure regular inspection of them so that they are in working condition at all times. Apart from this, it will be mandatory to have a fire extinguisher in the motor/maxi Cab and it will be kept in working condition at all times.

B. Category-wise conditions.—1. Self-operated buses/ vehicles by schools :

(i) School buses/vehicles will be painted in dark yellow and the name of the school will be written clearly on its both sides so that it can be easily identified.

(ii) School bus/vehicle will be written on the back and front of the school bus/vehicle.

iii) The bus's windows will be fitted with the grills/lattice.

cabin for the driver in each school bus.

(v) The CCTV camera must be installed in each school bus/vehicle. School management will ensure that this system is functioning smoothly at all times and its record is regularly checked and available, if required.

(vi) The driver of the school bus should have a minimum five years experience of driving a heavy vehicle.

(vii) In addition to the driver, there will also be a conductor in the school bus who possesses a valid license and the prescribed qualification under the provisions of Rule 22 (3) of the Himachal Pradesh Motor Vehicle Rules, 1999.

(viii)The school management will also ensure the arrangement for atleast one trained female guard/attendant in each school bus, who will take care of the students traveling on the bus and ensure their safety during the journey and also assist students in boarding and de-boarding the bus.

(ix) To keep the school bag safely, the availability of convenient place under the seats or in the bus will be ensured.

(x) School management shall also directed to make such arrangements as voluntary as possible that atleast one parent is present in every school bus, who shall keep an eye on behavior of the bus driver and other staff during the journey, it will ensure that the rules of children's safety are adhered to and the bus is driven carefully by the driver.

(xi) School buses should have arrangement for alarm and sirens so that everyone can be alerted in case of any emergency.

(xii) The bus driver and conductor will wear grey colour uniform and a pair of black shoes.

Their name plates will be clearly displayed on the uniform.

(xiii)The conductor of school bus should always have information regarding travelling students name, class, residential address, telephone contact number, blood group, bus stops name, route plan etc.

(xiv) To improve the driving and behavioral skills of bus drivers, they should undergo the refresher training course every year. This type of refresher training course will be organized by the transport department.

(xv) School Management will provide a mobile phone in each school bus, so that in case of any emergency the school bus can be contacted or the school bus driver/conductor/ police, school management or administration can be contacted.

2. Private contract carriage/Himachal Road Transport Corporation buses taken on

lease by schools :—

(i) The buses which have been taken on lease by the schools will have a contract with the school and the driver of that bus will always keep the copy of the contract.

(ii) In relation to such buses, it shall be mandatory for school management to give the details of the driver's name and vehicle to the nearest Police Stations and District Traffic Police.

(iii) It will be mandatory to install CCTV cameras in each school bus/vehicle. The school management and vehicle owner will ensure that this system is functioning smoothly at all times and its record is regularly checked and available, if required.

(iv) The driver of the school bus should have minimum five years experience of driving a heavy vehicle.

(v) In addition to the driver, there will also be a conductor in the school bus having valid license and the prescribed qualification under the provisions of rule 22 (3) of the Himachal Pradesh Motor Vehicle Rules, 1999.

(vi) It will be mandatory to wear uniform for driver and conductor. In case of Himachal Road Transport Corporation bus it will be mandatory to wear uniforms and shoes decided by the corporation management, otherwise it will be mandatory to wear blue uniforms and black shoes. The name plate will be clearly displayed on the uniform.

3. Motor cab/Maxi Cab vehicle used to provide transportation facilities to school

children :

(i) "On School Duty" should be clearly written on the back and front of the Motor cab/ Maxi cab.

(ii) In relation to such a motor/maxi cab, it shall be mandatory for the school management to give the name of the driver and the description of the vehicle in the nearest police station and the district traffic police.

(iii) The driver must possess a valid driving license while driving the vehicle.

(iv) Children below the age of five years will not be allowed to sit in the front seat of the vehicle.

(v) It will be mandatory for the driver to wear blue uniform and a pair of black shoes. His name plate will be clearly displayed on the uniform.

(2) ये नियम राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. अनैक्सचर-1 का संशोधन.--हिमाचल प्रदेश चिकित्सा शिक्षा सेवा नियम, 1999 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के अनैक्सचर-1 के क्रम संख्या 3 में स्तम्भ संख्या 11 के विद्यमान उपबन्धों के पश्चात निम्नलिखित परन्तुक जोडे़ जाएंगे, अर्थातः--5686 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 "परन्तु प्रारम्भिक संवर्ग के गठन के आशय से यदि अस्पताल प्रशासन/प्रबन्धन में विहित अध्यापन अनुभव रखने वाले पदधारी उपलब्ध नहीं हैं, तो स्नाकोत्तर की उपाधि के पश्चात्‌ सरकारी चिकित्सा महाविद्यालयों में अस्पताल प्रशासक/उप चिकित्सा अधीक्षक के रूप में तीन वर्ष के प्रशासनिक अनुभव को अस्पताल प्रशासन/प्रबन्धन में सहायक आचार्य के रूप में प्रोन्नति/चयन के लिए, अध्यापन अनुभव के समान समझा जाएगा :

परन्तु यह और कि उपरोक्त परन्तुक सहायक आचार्य (अस्पताल प्रशासन) के नए सृजित पदों को भरने के पश्चात प्रवर्तन में नहीं रहेगा ।"

3. अपैंडिक्स-बी का संशोधन.--उक्त नियमों के अपैंडिक्स-बी में क्रम संख्या 3 के पश्चात क्रम संख्या (iii) के अधीन अनिवार्य अर्हता से सम्बन्धित विद्यमान उपबन्धों के पश्चात्‌ निम्नलिखित परन्तुक जोड़े जाएंगे, अर्थात्‌ :--

"परन्तु प्रारम्भिक संवर्ग के गठन के आशय से यदि अस्पताल प्रशासन/प्रबन्धन में विहित अध्यापन अनुभव रखने वाले पदधारी उपलब्ध नहीं हैं, तो स्नाकोत्तर की उपाधि के पश्चात्‌ सरकारी चिकित्सा महाविद्यालयों में अस्पताल प्रशासक/उप चिकित्सा अधीक्षक के रूप में तीन वर्ष के प्रशासनिक अनुभव को अस्पताल प्रशासन/प्रबन्धन में सहायक आचार्य के रूप में प्रोन्नति/चयन के लिए, अध्यापन अनुभव के समान समझा जाएगा :

4. अनैक्सचर-II का संशोधन.--उक्त नियमों से संलग्न अनैक्सचर-II में, प्रविष्टि संख्या 43 के पश्चात्‌ निम्नलिखित प्रविष्टि संख्या 44 अन्तःस्थापित की जाएगी, अर्थात्‌ :--

"44. अस्पताल प्रशासन.--किसी मान्यता प्राप्त चिकित्सा महाविद्यालय/शिक्षा संस्थान से एम. डी. (अस्पताल प्रशासन/प्रबंधन) या एम. डी. (स्वास्थ्य प्रशासन) पूर्णकालिक पाठ्‌यक्रम या इसके समतुल्य। टिप्पण.--पत्राचार के माध्यम से प्राप्त की गई उपर वर्णित अर्हता को सहायक आचार्य (अस्पताल प्रशासन) के पद हेतु प्रोन्नति/चयन के लिए विचार में नहीं लाया जाएगा"।

Shimla-2, the 15th October, 2018

No. HFW-B(B)1-1/2016.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Medical Education Service Rules, 1999, notified in the Rajpatra, Himachal Pradesh vide this department notification No. Health-A(A)3-6/98, dated 02-12-1999, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Medical Education Service (10th Amendment) Rules, 2018.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure-I.—In Sl. No. 3 of Annexure-I to the Himachal Pradesh Medical Education Service Rules, 1999 (hereinafter referred to as the "said rules"), after the existing provisions of Column No. 11, the following provisos shall be added, namely:—

"Provided that, in order to form initial cadre, in case the incumbents with prescribed teaching experience in Hospital Administration/Management are not available, three years administrative experience as Hospital Administrator/Deputy Medical Superintendent in Government Medical Colleges after post graduation degree shall be considered at par with teaching experience for promotion/selection as Assistant Professor in Hospital Administration/Management:

Provided further that above proviso shall cease to be in operation after filling up of newly created posts of Assistant Professor (Hospital Administration)."

3. Amendment in Appendix-B.—In Sl. No. 3 of Appendix-B to the said rules, after the existing provisions relating to Essential Qualification under Sl. No. (iii), the following provisos shall be added, namely:—

"Provided that, in order to form initial cadre, in case the incumbents with prescribed teaching experience in Hospital Administration/Management are not available, three years administrative experience as Hospital Administrator/Deputy Medical Superintendent in the Government Medical Colleges after post graduation degree shall be considered at par with teaching experience for promotion/selection as Assistant Professor in Hospital Administration/Management:

Provided further that above proviso shall cease to be in operation after filling up of newly created posts of Assistant Professor (Hospital Administration).".

4. Amendment of Annexure-II.—In Annexure-II appended to the said rules, after entry No. 43, the following entry No. 44 shall be inserted, namely:—

"44. Hospital Administration.—MD (Hospital Administration/Management) or MD (Health Administration) (full time course) or equivalent from a recognized Medical College/ Teaching Institution.

Note.—The above mentioned qualification through correspondence shall not be considered for promotion/selection to the post of Assistant Professor (Hospital Administration).".

संख्या एच0 एफ0 डब्ल्यू-बी0 (एफ0) 2-1/2018.--हिमाचल प्रदेश के राज्यपाल, प्रदेश में सभी सरकारी/निजी स्कूलों में प्रथम श्रेणी में प्रवेश के समय टीकाकरण प्रमाण-पत्र की प्रस्तुति बारे नीति को लागू 5688 राजपत्र, हिमाचल प्रदेश, 23 अक्तूबर, 2018/01 कार्तिक, 1940 करने के सहर्ष आदेश जारी करते हैं। इस नीति से सुनिश्चित होगा कि हिमाचल प्रदेश के हर बच्चे का पहली कक्षा में दाखिला लेने से पहले 5 वर्ष की आयु तक टीकाकरण कार्यक्रम पूरा हो चुका है। बच्चे के निवास क्षेत्र के स्वास्थ्य कार्यकर्ता यह प्रमाण-पत्र देंगे कि उसका उपयुक्त टीकाकरण हो चुका है। इस नीति से यूनिवर्सल टीकाकरण कार्यक्रम के तहत 100 % कवरेज हासिल करना अपेक्षित होगा।

यह नीति निम्न प्रकार से कार्यान्वित की जाएगी :--

1. बच्चे के निवास क्षेत्र के स्वास्थ्य कार्यकर्ता यह प्रमाण-पत्र देंगे कि उसका उपयुक्त टीकाकरण हो चुका है। पूर्ण टीकाकरण प्रमाण-पत्र स्वास्थ्य उप-केन्द्र या शहरी MCH केन्द्रों के स्तर पर Health Supervisor अथवा Health Worker द्वारा जारी किया जाएगा। मानक प्रतिरक्षण प्रमाण-पत्र की प्रति संलग्न है। हिमाचल प्रदेश में लगभग 5 प्रतिशत बच्चों को निजी सुविधाओं से टीकाकरण मिलता है और ऐसे मामले में निजी डॉक्टर द्वारा जारी किए गए प्रमाण-पत्र को वैध माना जाएगा।

2. यह प्रमाण-पत्र सभी सरकारी/निजी स्कूलों जो कि CBSE, ICSE, HPBOSE के तहत आते हैं, इन सभी में प्रस्तुत करना आवश्यक होगा। यह स्थिति KG कक्षाओं पर लागू नहीं होगी बल्कि केवल पहली कक्षा में प्रवेश करने वाले बच्चों के लिए लागू होगी।

3. पूर्ण टीकाकरण प्रमाण-पत्र प्रस्तुत करने में विफल रहने की स्थिति में किसी भी बच्चे को स्कूल प्रवेश से वंचित नहीं किया जाएगा। पूर्ण टीकाकरण या आंशिक रूप से टीकाकरण हुए बच्चों की सूची स्कूल के सम्बन्धित नोडल शिक्षक या प्रिंसिपल द्वारा तैयार की जाएगी और सम्बन्धित खण्ड चिकित्सा अधिकारी (बीएमओ) को जमा की जाएगी तथा वह बच्चे को टीकाकरण के लिए उस क्षेत्र के ए0एन0एम0/आशा वर्कर को सूचित करेंगे। यदि कोई बच्चा पूर्ण टीकाकरण से वंचित पाया जाता है या जिनका टीकाकरण कार्यक्रम पूरा नहीं हुआ है तो इस स्थिति में उसका टीकाकरण 3 महीने के भीतर कर दिया जाएगा।
