NOTICE

Shimla-171002, the 15th November, 2018

No. PWD(C)A(3)-1/2017.—The Himachal Pradesh Aerial Ropeways Act, 1968 (7 of 1969) provides for construction and regulation of Aerial ropeways in the State of Himachal Pradesh. The Act was basically aimed for regulation of transportation by ropeways in remote areas 165-राजपत्र/2018-19-11-2018 (6111) 6112 राजपत्र, हिमाचल प्रदेश, 19 नबम्बर, 2018/28 कार्तिक, 1940 in the State, in view of limited road connectivity at that time. With the passage of time, Himachal Pradesh has emerged as big tourist destination and the Government has taken various initiatives in this direction and invited private sector to set up passenger ropeways under Public Private Partnership and Built Operate and Transfer mode on an annual license fee basis.

In order to remove technical problems and to simplify the process for setting up ropeway projects, the Government of Himachal Pradesh is proposed to amend the following provisions of the Himachal Pradesh Aerial Ropeways Act, 1968 (7 of 1969):—

Publication of proposed order authorizing construction and contents of such order.— (4) The draft of proposed order may specify:— (xiii-a) The minimum head way of 10 meters between the rooftop of the houses or buildings and base of the cabin in the case of ropeway projects to be build under Public Private Partnership (PPP) Mode.	6 (4) (xiii-a) omitted.
Amendment 2 9. Further order:— (2) An application for a further order shall be made in the same manner, and subject to the same conditions, as an application for an order. ( 3) If the State Government grants the application it shall make the further order in the same manner as an order, except that the rights, powers and authorities asked for in the said application shall not be increased, modified or restricted by the further order without the consent in writing of the promoter.	9 . Further Order :— (2) An application for a further order "other than extension of time" shall be made in the same manner, and subject to the same conditions, as an application for an order. ( 3) If the State Government grants the application it shall make the further order "other than extension of time" in the same manner as an order, except that the rights, powers and authorities asked for in the said application shall not be increased, modified or restricted by the further order without the consent in writing of the promoter. (4) The Promoter may submit a simple application to the State Government for extension of time giving detailed reasons. The State Government after due consideration, if satisfied may grant extension of time.
Amendment 3 18. Promoter may fix rates.—The promoter shall, for the purpose of working an aerial ropeway, and subject to such maximum 14[XXX] rates as may be prescribed or ordered, have power from time to time, to fix the rates for the carriage of passengers, animals or goods on the aerial ropeway.	1 8. 18-A Fixation of fare rates of Public Private Partnership and Built Operate and Transfer Ropeway Projects. (1) The State Government, on the recommendations of the Expert Committee, shall fix and notify the maximum limit of the fare rates for the Ropeway Projects build under Public Private Partnership (PPP) and Built Operate and Transfer (BOT) mode. ( 2) Every application made under this section for fixation of fare rates shall be decided within a period of 90 days from the date of receipt of such application, failing which the application shall be deemed to have been accepted for fixation of fare rates.	18-A. Amendment 4 27(2). Such bye-laws may provide that any person who contravenes the provisions of any of them shall be liable to fine which may extend to any sum not exceeding fifty rupees and that, in the case of a breach of a bye-law made under clause (c) of sub-section (1), the promoter's servant responsible for the same shall forfeit a sum not exceeding one month's pay, which sum may be deducted by the promoter from his pay.	2 7(2). Amendment 5 33. Failure of promoter to comply with Act.—If a promoter— (k) contravenes the provisions of any rule made under section 32; h e shall, without prejudice to the enforcement of specific performance of the requirements of this Act, or of any other remedy which may be obtained against him, be punishable with fine which may extend to 20[five thousand] rupees and in the case of a continuing offence, to a further fine which may extend 21[five hundred] rupees for every day after the date of the first conviction during which the offender is proved to have persisted in the offence.	33. Failure of promoter to comply with Act.—If a promoter— (k) contravenes the provisions of any rule made under section 32; he shall, without prejudice to the enforcement of specific performance of the requirements of this Act, or of any other remedy which may be obtained against him, be punishable with fine as prescribed from time to time and in the case of a continuing offence, to a further fine as prescribed from time to time for every day after the date of the first conviction during which the offender is proved to have persisted in the offence.

Now, therefore, the State Government hereby invites objection(s)/suggestion(s), if any, with respect to the proposed amendments of the Act ibid from the general public. The objection(s)/suggestion(s) should be addressed to the Additional Chief Secretary (PW) to the Government of Himachal Pradesh and should reach within 15 days from the date of publication of this notice in the Rajpatra, Himachal Pradesh. Any objection(s)/suggestion(s) with respect to the proposed amendments received by the Additional Chief Secretary (PW) to the Government of Himachal Pradesh/State Government on or before the date specified above, shall be taken into consideration by the State Government before the amendment of the Act ibid.
