सं0 पी0बी0डब्ल्यू0(बी0)एफ(5)16/2011.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः मुहाल फाटी नसोगी, तहसील मनाली, जिला कुल्ल, हि0 प्र0 में मनाली-कन्याल सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है। 168-राजपत्र/2018-22-11-2018 (6185) 6186 राजपत्र, हिमाचल प्रदेश, 22 नबम्बर, 2018/01 मार्गशीर्ष, 1940 अतएव एतद्‌ द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा 11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों, उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उस धारा द्वारा अपेक्षित अथवा अनुमत अन्य सभी कार्याें को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति, जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपाि हो, तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रुप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी (हि0 प्र0) के समक्ष अपनी आपाि दायर कर सकता है।

No. STE-E(3)-29/2018.—In compliance to the orders passed by the Hon'ble National Green Tribunal, Principal Bench at Delhi on 20-9-2018 in Original Application No. 673 of 2018 in the matter of News Item Published in 'The Hindu' authored by Shri. Jacob Koshy titled "More river stretches are now critically polluted: CPCB", the Governor, Himachal Pradesh is pleased to constitute the River Rejuvenation Committee and Special Environment Surveillance Task Force for 7 river stretches of Himachal Pradesh as under :—

River Rejuvenation Committee (RRC)

1. The 'River Rejuvenation Committee' shall prepare action plans within two months for bringing all the polluted river stretches to be fit at least for bathing purposes (i.e BOD (cid:31) 3 mg/L and FC (cid:31) 500 MPN/100 ml) within six months from the date of finalisation of the action plans of the 7 river stretches as tabulated below:—

The action plan will include components like identification of polluting sources including functioning/status of STPs/ETPs/CETP and solid waste management and processing facilities, quantification and characterisation of solid waste, trade and sewage generated in the catchment area of polluted river stretch. The action plan will address issues relating to ground water extraction, adopting good irrigation practices, protection and management of Flood Plain Zones (FPZ), rain water harvesting, ground water charging, maintaining minimum environmental flow of river and plantation on both sides of the river. Setting up of biodiversity parks on flood plains by removing encroachment shall also be considered as an important component for river rejuvenation. The action plan should focus on proper interception and diversion of sewage carrying drains to the Sewage Treatment Plant (STP) and emphasis should be on utilization of treated sewage so as to minimize extraction of ground or surface water. The action plan should have speedy, definite or specific timelines for execution of steps. Provision shall be made to pool the resources, utilizing funds from State budgets, local bodies, State Pollution Control Board/ Committee and out of Central Schemes. The Action Plan will include components like identification of source and its apportionment considering sectors like vehicular pollution, industrial pollution, dust pollution, construction activities, garbage burning, agricultural pollution including pollution caused by burning of crop residue, residential and indoor pollution etc.

3. The Action Plans shall be subjected to a random scrutiny by a task team of the CPCB.

4. The RRC will have a website inviting public participation from educational institutions, religious institutions and commercial establishments. The Committee shall consider suitably rewarding those contributing significantly to the success of the project.

5. The RRCs will have the authority to recover the cost of rejuvenation in Polluter Pays Principle from those who shall be responsible for the pollution, to the extent found necessary. In this regard, principle laid down by this Tribunal in order dated 13.07.2017 in O.A No. 200 of 2014, M.C. Mehta Vs. U.O.I will apply. Voluntary donations, CSR contribution, voluntary services and private participation may be considered in consultation with the RRC.

6. The RRCs will send progress reports by e-mail at [email protected] on or before 15-12-2018.

The Terms of reference of the Special Environment Surveillance Task Force

The Task Force will ensure that no illegal mining takes place in river beds of such polluted stretches.

No. STE-E(3)-22/2018.—In compliance to the order passed by the Hon'ble National Green Tribunal, Principal Bench at Delhi on 08-10-2018 in the matter of Original Application No. 681 of 2018, the Governor, Himachal Pradesh is pleased to constitute the Air Quality Monitoring Committee (AQMC) related to air pollution in non-attainment cities which do not meet the National Ambient Air Quality Standards. The Committee shall comprise of the following officers:—

The Terms of reference of the Air Quality Monitoring Committee

1. The Air Quality Monitoring Committee (AQMC) shall prepare an action plan within two months aimed at bringing the standards of air quality as per prescribed norms within six months from date of finalization of the action plan of the seven non-attainment cities of the H.P. State i.e. Baddi, Damtal, Kala Amb, Nalagarh, Poanta Sahib, Parwanoo and Sundernagar.

2. The Action Plan shall have the following components:—

(a) The Action Plans may take into account the Graded Response Action Plan (GRAP), the Comprehensive Action Plan (CAP) and the action plan prepared by CPCB as well as all other relevant factors. The Action Plan shall be forwarded to the CPCB by 31- 12-2018.

(b) The Action Plan will include components like identification of source and its apportionment considering sectors like vehicular pollution, industrial pollution, dust pollution, construction activities, garbage burning, agricultural pollution including pollution caused by burning of crop residue, residential and indoor pollution etc. (c) The action plan shall also consider measures for strengthening of Ambient Air Quality (AAQ) monitoring and steps for public awareness including issuing of advisory to public for prevention and control of air pollution and involvement of schools, colleges and other academic institutions and awareness programmes.

(d) The Action Plan will indicate steps to be taken to check different sources of pollution having speedy, definite and specific timelines for execution.

(e) The Action Plan should be consistent with the carrying capacity assessment of the non- attainment cities in terms of vehicular pollution, industrial emissions and population density, extent of construction and construction activities etc. The carrying capacity assessment shall also lay emphasis on agricultural and indoor pollution in rural areas.

Depending upon assessed carrying capacity and source apportionment, the authorities concerned may consider the need for regulating number of vehicles and their parking and plying, population density, extent of construction and construction activities etc. Guidelines may accordingly be framed to regulate vehicles and industries in non- attainment cities in terms of carrying capacity assessment and source apportionment.

No. GAD(CC)5-2/71.—In exercise of the powers conferred by clause (3) of Article 166 of the Constitution of India, the Governor, Himachal Pradesh is pleased to make the following rules6195 राजपत्र, हिमाचल प्रदेश, 22 नबम्बर, 2018/01 मार्गशीर्ष, 1940 further to amend the Business of the Government of Himachal Pradesh (Allocation) Rules, 1971 notified vide Notification No. 5-2/71-GAD(CC), dated 25th January, 1971, namely:—

1. Short title and commencement.—(1) These rules may be called the Business of the Government of Himachal Pradesh (Allocation) (153rd Amendment) Rules, 2018.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of the SCHEDULE.—In the Business of the Government of Himachal Pradesh (Allocation) Rules, 1971, in the SCHEDULE,—

(a) in heading "PLANNING DEPARTMENT", under Sub-heading "(a) PLANNING", the item No. 27 shall be omitted; and

(b) in heading "TECHNICAL EDUCATION, VOCATIONAL AND INDUSTRIAL TRAINING DEPARTMENT" after the item No.6 , the following new item shall be inserted, namely:—

"7. Technical Education, Vocational and Industrial Training Department to

function as Administrative Department for coordination of Skill Development

No.Fin-2-C-(12)-3/2018.—Government of Himachal Pradesh hereby notifies the sale of Himachal Pradesh Government Stock (securities) of 10-year tenure for an aggregate amount of ` 500.00 crore (Nominal). The sale will be subject to the terms and conditions spelt out in this notification (called Specific Notification) as also the terms and conditions specified in the General Notification No.Fin-2-C(12)-11/2003 dated July 20, 2007 of Government of Himachal Pradesh.

Object of the loan :

1. (i) The proceeds of the State Government Securities will be utilized for the development programme of the Government of Himachal Pradesh.

(ii) Consent of Central Government has been obtained to the floatation of this loan as required by Article 293 (3) of the Constitution of India.

Method of Issue :

2. Government Stock will be sold through the Reserve Bank of India, Mumbai Office (PDO) Fort, Mumbai-400 001 by auction in the manner as prescribed in paragraph 6.1 of the General Notification No.Fin-2-C(12)- 11/2003, dated July 20, 2007 at a coupon rate to be determined by the Reserve Bank of India at the yield based auction under multiple price formats.

Allotment to Non-Competitive Bidders :

The Government Stock upto 10% of the notified amount of the sale will be allotted to eligible individuals and institutions subject to a maximum limit of 1% of the notified amount for a single bid as per the Revised Scheme for Non-Competitive Bidding Facility in the Auctions of State Government Securities of the General Notification (Annexure-II).

Place and Date of Auction :

4. The auction will be conducted by the Reserve Bank of India, at its Mumbai Office, Fort, Mumbai- 400 001 on November 27, 2018. Bids for the auction should be submitted in electronic format on the Reserve Bank of India Core Banking Solution (E-Kuber) System as stated below on November 27, 2018.

(a) The competitive bids shall be submitted electronically on the Reserve Bank of India Core Banking Solution (E-Kuber) System between 10.30 AM and 12.00 PM.

(b) The non-competitive bids shall be submitted electronically on the Reserve Bank of India Core Banking Solution (E-Kuber) System between 10.30 AM and 11.30 AM.

Result of the Auction :

5. The result of the auction shall be displayed by the Reserve Bank of India on its website on the same day. The payment by successful bidders will be on November 28, 2018. Method of Payment :

6. Successful bidders will make payments on November 28, 2018 before close of banking hours by means of cash, bankers' cheque/pay order, demand draft payable at Reserve Bank of India Mumbai/New Delhi or a cheque drawn on their account with Reserve Bank of India, Mumbai(Fort)/New Delhi.

संख्याः ई0डी0एन0-ए-ख(1)-29/2018.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्याः ई0डी0एन0-ए-ख(15)-7/2001 तारीख 09-11-2006 द्वारा अधिसूचित हिमाचल प्रदेश उच्चतर शिक्षा निदेशालय में निजी सचिव वर्ग-I (राजपत्रित) के पद के लिए भर्ती और प्रोन्नति नियम 2006 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उच्चतर शिक्षा निदेशालय निजी सचिव वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम 2018 है।

(2) यह नियम राजपत्र हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे।

2. उपबन्ध "क" का संशोधन.--(1) हिमाचल प्रदेश उच्चतर शिक्षा निदेशालय निजी सचिव वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2006 के स्तंभ संख्या 11, के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

"निजी सहायकों में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का संयुक्त नियमित सेवाकाल हो, ऐसा न होने पर निजी सहायकों में से प्रोन्नति द्वारा जिनका निजी सहायक और वरिष्ठ वेतनमान आशुलिपिक के रूप में संयुक्ततः चौदह वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौदह वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप में दो वर्ष की सेवा भी अनिवार्य होगी। उपरोक्त दोनों के न होने पर निजी सहायकाें में से प्रोन्नति द्वारा, जिनका निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक और कनिष्ठ वेतनमान आशुलिपिक के रुप में संयुक्ततः उन्नीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके उन्नीस वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप में दो वर्ष की सेवा भी अनिवार्य होगी। उपरोक्त समस्त के न होने पर निजी सहायकों में से प्रोन्नति द्वारा, जिनका निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक, कनिष्ठ वेतनमान आशुलिपिक और आशुटंकण के रूप में संयुक्ततः चौबीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौबीस वर्ष का नियमित सेवाकाल, जिसमें निजी सहायक के रूप में दो वर्ष की सेवा भी अनिवार्य होगी "।

(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरण (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन गणना में की जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी :

परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष न्यूनतम अर्हता सेवा या पद के लिए भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जायेंगे।

स्पष्टीकरणः--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसे डिमोबिलाईजड आर्मड फोर्सिज परसोनल (रिजर्वेशन ऑफ वेकेन्सीज इन हिमाचल स्टेट नान टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दि हिमाचल प्रदेश टैक्निकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवा काल के लिए गणना में ली जाएगी। यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थाईकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी "।

No. EDN-A-Ka(1)-29/2018.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P. Public Service Commission, is pleased to make the following Rules further to amend the Himachal Pradesh, Directorate of Higher Education, Private Secretary, Class-I (Gazetted) Recruitment and Promotion Rules 2006 notified vide this Department's Notification No. EDN-A-Kha(15)-7/2001 dated 9-11-06, namely: —

1. Short title and commencement.—(i) These rules may be called the Himachal Pradesh Directorate of Higher Education Department, Private Secretary Class-I (Gazetted), Recruitment and Promotion (First Amendment) Rules, 2018.

(ii) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment at Annexure "A".—In the Himachal Pradesh, Directorate of Higher Education, Private Secretary Class-I (Gazetted), Recruitment and Promotion Rules 2006, for the existing provision against Column-11 the following shall be substituted, namely:—

"By promotion from amongst the Personal Assistant(s) possessing 05 (five) years' regular service or regular combined with continuous adhoc service, if any, in the grade, failing which by promotion from amongst the Personal Assistant(s) possessing 14 (fourteen) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant & Senior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, failing both by promotion from amongst the Personal Assistant(s) possessing 19 (nineteen) years' regular service or regular combined with continuous adhoc service, if any as Personal Assistant, Senior Scale Stenographer & Junior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, failing all by promotion from amongst the Personal Assistant(s) possessing 24 (twenty four) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant, Senior Scale Stenographer, Junior Scale Stenographer & Steno Typist combined which shall also include 02 (two) years essential service as Personal Assistant." (1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the R&P Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion, if the senior ineligible person(s) happened to be Ex-Serviceman recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of Vacancies in the Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of the Ex-Serviceman (Reservation of Vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(2) Similarly, in all cases of confirmation adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R&P Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged."
