राज्य में छह वर्ष की आयु से कम के बालकों के लिए प्रारंभिक बाल्यावस्था देख-रेख और शिक्षा केन्द्रों (ईसीसीई) के रजिस्ट्रीकरण और विनियमन तथा उससे सम्बद्ध या उसके आनुषंगिक विषयों का उपबन्ध करने के लिए अधिनियम।
भारत के संविधान के अनुच्छेद 39 (च) और 45 राज्यों को सशक्त करते हैं कि बालकों को स्वतन्त्र और गरिमामय वातावरण में विकास के अवसर और सुविधाएं दी जाएं और बालकों और अल्पवय व्यक्तियों की शोषण से तथा नैतिक और आर्थिक परित्याग से रक्षा की जाए और राज्य, सभी बालकों के लिए छह वर्ष की आयु पूरी करने तक, प्रारंभिक बाल्यावस्था देख-रेख और शिक्षा देने के लिए उपबन्ध करने का प्रयास करेगा;
शिक्षा का अधिकार अधिनियम, 2009 की धारा 11 उपबंधित करती है कि ''प्राथमिक शिक्षा के लिए तीन वर्ष से अधिक आयु के बालकों को तैयार करने तथा सभी बालकों के लिए जब तक कि वे छह वर्ष की आयु पूरी नहीं कर लेते हैं; आरंभिक बाल्यकाल देख-रेख और शिक्षा की व्यवस्था करने की दृष्टि से समुचित सरकार, ऐसे बालकों के लिए निःशुल्क विद्यालय पूर्व शिक्षा उपलब्ध कराने के लिए आवश्यक व्यवस्था कर सकेगी'';
भारत सरकार, महिला एवं शिशु विकास मंत्रालय ने राष्ट्रीय प्रारंभिक बाल्यावस्था देख-रेख और शिक्षा (ईसीसीई) नीति, 2013 को, निरन्तरता के साथ, प्रसवपूर्व अवधि से छह वर्ष की आयु तक के समस्त बालकों के एक समान विकास हेतु एकीकृत सेवाएं प्रदान करने के उद्देश्य के साथ बनाया था ताकि उनकी उत्तरजीविता, वृद्धि और विकास के लिए एक विकसित आधार स्थापित हो सके। यह नीति, संगठित और6613 राजपत्र, हिमाचल प्रदेश, 13 दिसम्बर, 2018/22 मार्गशीर्ष, 1940 असंगठित दोनों क्षेत्रों, जैसे कि गैर-सरकारी चैनलों, जो वृहत् रूप से न्यासों, सोसाइटियों, धार्मिक समूहों या अन्तर्राष्ट्रीय निधि अभिकरणों द्वारा समर्थित हैं, तथा जो साम्यापूर्ण अभिगम, विषम गुण और बढ़ते साम्राज्यवाद के मुद्दों से ग्रस्त हैं, को अन्तर्वलित करते हुए समस्त बालकों को विद्यालय पूर्व की शिक्षा प्रदान करने के लिए अनिवार्य व्यवस्था प्रबन्ध करने पर केन्द्रित है;
और, हिमाचल प्रदेश राज्य में प्रारंभिक बाल्यावस्था देख-रेख और शिक्षा केन्द्रों को विनियमित करने हेतु कोई भी विधान प्रवृत्त नहीं है;
अतः छह वर्ष से कम की आयु के बालकों की गुणवत्ता पूर्ण विद्यालय पूर्व शिक्षा प्रदान करना सुनिश्चित करने के लिए एक विधान लाना आवश्यक और समीचीन समझा गया है।
