शिमला-2, 21 दिसम्बर, 2018

सं0पी0बी0डब्ल्यू0(बी0)एफ(5) 67/2017.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव वर्मा पापड़ी, तहसील नाहन, जिला सिरमौर, हिमाचल प्रदेश में माजरी बरमा पापड़ी-मीरपुर कोटला सड़क के निर्माण हेतु भूमि 195-राजपत्र/2018-29-12-2018 (7197) 7198 राजपत्र, हिमाचल प्रदेश, 29 दिसम्बर, 2018/08 पौष, 1940 अर्जित करनी अपेक्षित है, अतएव एतद्‌ द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश, इस समय इस उपक्रम में कार्यरत सभी अधिकारियों, उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप धारा द्वारा अपेक्षित अथवा अनुमत अन्य सभी कार्यों को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति, जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हा,े तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रुप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, विन्टर फिल्ड शिमला (हि0 प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

NOTIFICATION

Shimla, the 19th December, 2018

No. HHC/GAZ/14-53/74-VI.—In the interest of administration, following transfers and postings of the members of H.P. Judicial Service in the cadre(s) of District Judges/Additional District Judges, Senior Civil Judges and Civil Judges are hereby ordered with immediate effect:—

1. Sh. Sushil Kukreja, Presiding Officer, Labour Court-cum-Industrial Tribunal, Shimla on being recalled is transferred and posted as Registrar, Lokayukta, Himachal Pradesh. His name is recommended to the State Government for notifying him as Special Judge in addition to his own duties, within the jurisdiction of Civil and Sessions Division, Shimla to try the cases under the Scheduled Castes and Scheduled Tribes (Prevention7199 राजपत्र, हिमाचल प्रदेश, 29 दिसम्बर, 2018/08 पौष, 1940 of Atrocities) Act and the Prevention of Corruption Act. He shall also try the cases registered under IPC in terms of the provisions contained under Section 9(3) of the Code of Criminal Procedure.

2. Services of Sh. Virender Singh, District and Sessions Judge, Shimla are placed at the disposal of Hon'ble the Chief Justice for further posting.

3. Services of Sh. Chirag Bhanu Singh, Director, H.P. Judicial Academy, Shimla are placed at the disposal of the State Government for being posted as Presiding Officer, Labour Court-cum-Industrial Tribunal, Shimla.

4. Sh. Rajeev Bhardwaj, Registrar General, High Court of Himachal Pradesh is transferred and posted as District and Sessions Judge, Shimla.

5. Sh. Arvind Malhotra, Registrar (Vigilance), High Court of Himachal Pradesh is transferred and posted as District and Sessions Judge (Forests), Shimla.

6. Sh. Rakesh Kainthla, District and Sessions Judge (Leave/Training Reserve), High Court of Himachal Pradesh is transferred and posted as District and Sessions Judge, Hamirpur.

7. Sh. Jitender Kumar Sharma, Registrar (Judicial), High Court of Himachal Pradesh is transferred and posted as District and Sessions Judge, Kangra at Dharamshala.

8. Sh. Purender Vaidya, District and Sessions Judge, Kangra at Dharamshala is transferred and posted as District and Sessions Judge, Kullu.

9. Sh. Virender Sharma, District and Sessions Judge (Forests), Shimla is transferred and posted as Director, H.P. Judicial Academy, Ghandal, Shimla.

10. Services of Dr. Baldev Singh, Registrar, Lokayukta, Himachal Pradesh are placed at the disposal of Hon'ble the Chief Justice for being posted as one of the Registrars.

11. Sh. R.K. Chaudhary, District and Sessions Judge, Kullu is transferred and posted as District and Sessions Judge, Bilaspur.

12. The services of Sh. K.K. Sharma, Presiding Officer, Labour Court-cum-Industrial Tribunal, Kangra at Dharamshala on being recalled are placed at the disposal of the State Government for being posted as Chairman, WAQF Tribunal, Kangra at Dharamshala.

His name is recommended to the State Government for notifying him as Special Judge in addition to his own duties, within the jurisdiction of Civil and Sessions Division, Kangra at Dharamshala to try the cases under the Protection of Children from Sexual Offences Act (POCSO) and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. उपरोक्त मुकद्दमा उनवान वाला में Sh. Sanjeev Kumar s/o Late Sh. Bhagat Ram Saini, r/o Vill. & P.O. Teuri, Tehsil & Distt. Una (H.P.) ने इस न्यायालय में प्रार्थना-पत्र प्रस्तुत किया है कि उसका विवाह दिनांक 14-05-2016 को Ms. Manju Kumari d/o Sh. Rattan Dass, r/o Vill. Nigani, Tehsil Nichar, District Kinnaur (H.P.) के साथ हुआ है लेकिन अज्ञानता के कारण अपने विवाह का इन्द्राज स्थानीय रजिस्ट्रार, विवाह पंजीकरण, ग्राम पंचायत त्यूड़ी, तहसील ऊना, जिला ऊना (हि0 प्र0) में न करवा सका।

अतः इस सन्दर्भ में आम जनता को सूचित किया जाता है कि उपरोक्त वर्णित के विवाह का इन्द्राज रजिस्ट्रार विवाह, स्थानीय पंजीकरण, ग्राम पंचायत त्यूड़ी, तहसील ऊना, जिला ऊना (हि0 प्र0) में दर्ज करवाने बारे किसी को एतराज हो तो वह दिनांक 10-01-2019 को इस न्यायालय में उपस्थित होकर प्रस्तुत कर सकता है अन्यथा इसके बाद उक्त वर्णित विवाह पंजीकरण हेतु आगामी कार्यवाही अमल में लाई जायेगी। इसके बाद कोई भी एतराज काबिले समायत न होगा।

आज दिनांक 10-12-2018 को मेेरे हस्ताक्षर व न्यायालय की मोहर द्वारा जारी हुआ।

श्री राम नाथ पुत्र उधो राम, वासी वढेड़ा, तहसील हरोली, जिला ऊना ने इस कार्यालय में प्रार्थना-पत्र प्रस्तुत करके निवेदन किया है कि उसकीे माता श्रीमती सुहाग देवी की मृत्यु दिनांक 26-08-2006 को गांव वढेड़ा, तहसील हरोली, जिला ऊना में हुई है लेकिन उसकी मृत्यु की तिथि ग्राम पंचायत रिकार्ड में दर्ज नहीं है।

अतः सर्वसाधारण को इस इश्तहार के माध्यम से सूचित किया जाता है कि उक्त मृत्यु तिथि ग्राम पंचायत में दर्ज करने बारे अगर किसी व्यक्ति को कोई उजर या एतराज हो तो वह दिनांक 07-01-2019 को प्रातः 10 बजे अधोहस्ताक्षरी के कार्यालय में उपस्थित होकर उजर/एतराज प्रस्तुत कर सकता है। यदि उपरोक्त वर्णित तिथि को किसी भी व्यक्ति का कोई उजर/एतराज इस कार्यालय में प्राप्त नहीं होता है तो इस न्यायालय द्वारा मृत्यु तिथि दर्ज करने हेतु सम्बंधित पंचायत को आदेश दे दिये जायेंगे। आज दिनांक 17-12-2018 को मेरे हस्ताक्षर एवं कार्यालय मोहर से जारी हुआ

अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि उक्त शादी पंजीकरण बारे किसी भी व्यक्ति को कोई एतराज/उजर हो तो वह निर्धारित तारीख पेशी दिनांक 07-01-2019 तक असालतन या वकालतन इस न्यायालय में पेश कर सकता है, निर्धारित तारीख पेशी तक कोई भी उजर/एतराज प्राप्त ना होने के उपरान्त एकतरफा कार्यवाही अमल में लाई जाकर मुकद्दमा का निपटारा/फैसला नियमानुसार कर दिया जायेगा ।

उपरोक्त मुकद्दमा उनवान वाला में हंस राज पुत्र श्री चरण दास, वासी कुठार खुर्द, तहसील व जिला ऊना (हि0 प्र0) ने इस न्यायालय में प्रार्थना-पत्र प्रस्तुत किया है कि उसकी दादी श्रीमती करतारी देवी की मृत्यु गांव कुठार खुर्द में दिनांक 15-10-2013 को हुई थी लेकिन अज्ञानता के कारण मुत्यु का इन्द्राज स्थानीय रजिस्ट्रार, जन्म व मृत्यु पंजीकरण, ग्राम पंचायत कुठार खुर्द, तहसील व जिला ऊना (हि0 प्र0) में दर्ज न करवा सका है।

अतः इस सन्दर्भ में आम जनता को सूचित किया जाता है कि यदि उपरोक्त वर्णित मृत्यु का इन्द्राज स्थानीय रजिस्ट्रार, जन्म व मृत्यु पंजीकरण, ग्राम पंचायत कुठार खुर्द, तहसील व जिला ऊना (हि0 प्र0) में7207 राजपत्र, हिमाचल प्रदेश, 29 दिसम्बर, 2018/08 पौष, 1940 दर्ज करवाने बारे किसी को कोई उजर या एतराज हो तो वह दिनांक 17-01-2019 को अथवा उससे पूर्व न्यायालय हजा में उपस्थित होकर प्रस्तुत कर सकता है अन्यथा उसके बाद उक्त वर्णित मृत्यु के पंजीकरण हेतु आगामी कार्यवाही अमल में लाई जायेगी। इसके बाद कोई भी एतराज काबिले समायत न होगा। आज दिनांक 17-12-2018 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ।
