231-राजपत्र/2019-14-02-2019 (8309) 8310 राजपत्र, हिमाचल प्रदेश, 14 फरवरी, 2019/25 माघ, 1940 2. केन्द्रीय सरकार ने अधिसूचना संख्याः एस0ओ0 3967 (ई) तारीख 13 अगस्त, 2018 द्वारा 30 सितम्बर, 2018 को ऐसा दिन नियत किया है जिसको उक्त अधिनियम के उपबन्ध प्रवृा होंगे;

3. प्रतिकरात्मक वनरोपण निधि अधिनियम, 2016 (2016 का 38) की धारा 10 की उप-धारा (1) उपबन्धित करती है किः-

''उस तारीख से, जो केन्द्रीय सरकार राजपत्र मेें अधिसूचना द्वारा इस निमिा नियत करे, प्रत्येक राज्य में ''हिमाचल प्रदेश राज्य प्रतिकरात्मक वनरोपण निधि प्रबंधन और योजना प्राधिकरण'' के नाम से ज्ञात एक राज्य प्राधिकरण का गठन किया जाएगा'';

4. केन्द्रीय सरकार ने अधिसूचना संख्याः का.आ. 4856 (अ) तारीख 14-09-2018 द्वारा ''हिमाचल प्रदेश राज्य प्रतिकरात्मक वनरोपण निधि प्रबन्धन और योजना प्राधिकरण'' के नाम से ज्ञात राज्य प्राधिकरण के गठन की तारीख 30 सितम्बर, 2018 नियत की है।

5. अतः हिमाचल प्रदेश के राज्यपाल, प्रतिकरात्मक वनरोपण निधि अधिनियम, 2016 (2016 का 38) की धारा 10 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस अधिनियम के प्रयोजनों के लिए, राजपत्र में इसके प्रकाशन की तारीख से हिमाचल प्रदेश राज्य में "हिमाचल प्रदेश राज्य प्रतिकरात्मक वनरोपण निधि प्रबन्धन और योजना प्राधिकरण'' (जिसे इसमें इसके पश्चात्‌ 'राज्य पा्र धिकरण' कहा गया है) का गठन करते हैं।

6. राज्य मेें गठित राज्य प्राधिकरण प्रतिकरात्मक वनरोपण निधि अधिनियम, 2016 के प्रबन्धन और प्रतिकरात्मक वनरोपण निधि नियम, 2018 के उपबन्धों के अनुसार हिमाचल प्रदेश राज्य प्रतिकरात्मक वनरोपण निधि (रा0प्र0व0नि0) इसके उपयोग के लिए दायी होगा।

7. राज्य प्राधिकरण शासी निकाय से गठित होगा और विषय निर्वाचन समिति तथा कार्यपालक समिति द्वारा इसकी सहायता की जाएगी।

8. राज्य प्राधिकरण का शासी निकाय निम्नलिखित से गठित होगा, अर्थात्‌ः-

(i) राष्ट्रीय प्राधिकरण की सिफारिशों पर केन्द्रीय सरकार द्वारा अधिसूचित मूलभूत पद्धति (ढांचे)े के भीतर राज्य प्राधिकरण के कार्यकरण के लिए व्यापक नीति मूलभूत पद्धति (ढांचा) अधिकथित करेगा;

(ii) राज्य प्राधिकरण की कार्यप्रणाली का समय-समय पर पुनर्विलोकन करेगा।

10. राज्य प्राधिकरण का शासी निकाय कम से कम छह मास में एक बार बैठक करेगा।

11. राज्य प्राधिकरण के शासी निकाय की अधिनियम के अधीन इसके कृत्याें और शक्तियों के पालन में विषय निर्वाचन समिति तथा कार्यपालक समिति द्वारा सहायता की जाएगी।

12. राज्य प्राधिकरण का शासी निकाय, विषय निर्वाचन समिति तथा कार्यपालक समिति को इसके कृत्यों के पालन में सहायता करने के लिए राज्य सरकार की पूर्व सहमति से राज्य प्राधिकरण में सहायक अरण्यपाल और अन्य कर्मचारियों के स्तर पर पदों का सृजन कर सकेगा।

13. राज्य प्राधिकरण की विषय निर्वाचन समिति निम्नलिखित से गठित होगी, अर्थात्‌ः-

(i) राज्य प्राधिकरण की कार्यपालक समिति द्वारा तैयार की गई संक्रियाआें की वार्षिक योजना की संवीक्षा और ऐसे संशोधनों के साथ, जिन्हें वह ठीक और उचित समझती है, अनुमोदन करेगी और उसे अन्तिम अनुमोदन के लिए राष्ट्रीय प्राधिकरण की कार्यपालक समिति को भेजेगी;

(ii) राज्य निधि से जारी की गई निधियों के उपयोग की प्रगति को मॉनीटर करेगी;

(iii) कार्यपालक समिति द्वारा किए गए विनिश्चयों सम्बन्धी रिपोर्टों का पुनर्विलोकन करेगी;

(iv) राज्य प्राधिकरण में पदों के सृजन के लिए कार्यपालक समिति द्वारा निश्चित किए गए प्रस्तावों का राज्य सरकार की पूर्व सहमति के अध्यधीन अनुमोदन करेगी;

(v) राज्य प्राधिकरण की वार्षिक रिपोर्ट का अनुमोदन करेगी और उसे प्रतिवर्ष राज्य विधान मण्डल के प्रत्येक सदन के समक्ष रखने के लिए राज्य सरकार को भेजेगी;

(vi) अन्तर-विभागीय समन्वय सुनिश्चित करेगी।

15. राज्य प्राधिकरण की विषय निर्वाचन समिति प्रत्येक तीन मास में कम से कम एक बार बैठक करेगी।

(i) राज्य प्राधिकरण की विषय निर्वाचन समिति की सहमति अभिप्राप्त करने के लिए संक्रियाओं की वार्षिक योजना तैयार करेगी और उसे राज्य प्राधिकरण को प्रस्तुत करेगी;

(ii) राज्य निधि में उपलब्ध रकम से कार्यान्वित किए जा रहे कार्याें की गुणात्मक और परिमाणात्मक पर्यवेक्षण, मॉनिटरिंग और मूल्यांकन करेगी;

(iii) लेखा बहियां और अन्य अभिलेख अनुरक्षित करेगी;

(iv) राज्य प्राधिकरण की विषय निर्वाचन समिति को रिपोर्ट प्रस्तुत करेगी;

(v) राज्य प्राधिकरण की वार्षिक रिपोर्ट तैयार करेगी;

(vi) राज्य प्राधिकरण में पदों पर संविदा के आधार पर या प्रतिनियुक्ति पर कर्मचारी अभिनियोजित करेगी;

(vii) राज्य प्राधिकरण में पदों के सृजन के लिए प्रस्ताव तैयार करेगी;

(viii) वित्तीय या प्रशासनिक शक्तियों के प्रत्यायोजन के लिए उत्तरदायी होगी;

(ix) राज्य प्राधिकरण के सम्बन्ध में दिन-प्रतिदिन के कार्यकरण के लिए उत्तरदायी होगी;

(x) राज्य प्राधिकरण की जन सूचना प्रणाली बनाए रखेगी और उसे अद्यतन करेगी और लोकाधिकारी क्षेत्र उसके संव्यवहार से सम्बन्धित सभी सूचनाएं प्रस्तुत करेगी;

(xi) ऐसे कोई अन्य कार्य करेगी, जो राज्य प्राधिकरण के शासी निकाय या विषय निर्वाचन समिति या राज्य सरकार द्वारा समय-समय पर सौंपे जाएं।

18. राज्य प्राधिकरण की विषय निर्वाचन समिति प्रत्येक तीन मास मेें कम से कम एक बार बैठक करेगी।

19. राज्य प्राधिकरण, राज्य पा्र धिकरण की प्राक्कलित प्राप्तियोें और व्यय को दर्शाते हुए आगामी वित्तीय वर्ष के लिए बजट तैयार करेगा और उसे प्रत्येक वित्तीय वर्ष में 31 दिसम्बर तक राज्य सरकार और केन्द्रीय सरकार को अग्रेषित करेगा।

20. राज्य सरकार किसी अधिकारी, जो मुख्य अरण्यपाल की पंक्ति से नीचे का न हो, को राज्य प्राधिकरण का मुख्य कार्यपालक अधिकारी नियुक्त करेगी।

21. राज्य प्राधिकरण अधिनियम के अधीन इसके कृत्यों के पालन में विषय निर्वाचन समिति तथा कार्यपालक समिति की सहायता के लिए पांच वर्ष से अनधिक अवधि के लिए निम्नलिखित अधिकारियों की नियुक्ति कर सकेगी, अर्थात्‌ः-

(i) संयुक्त मुख्य कार्यपालक अधिकारी, जो अरण्यपाल की पंक्ति से नीचे का न हो;

(iii) उप मुख्य कार्यपालक अधिकारी, जो उप अरण्यपाल की पंक्ति से नीचे का न हो।

NOTIFICATION

Shimla-171 002, the 4th February, 2019

No. FFE-B.F(2)8/2017(I).—Whereas "The COMPENSATORY AFFORESTATAION FUND ACT, 2016 (38 of 2016)", passed by the Parliament, has been published by the Government of India in the Gazette of India, Extraordinary on 3rd August, 2016.

2. AND whereas the Central Government vide notification No. S.O. 3967(E) dated 13th August 2018, has appointed the 30th day of September 2018 as the date on which the provisions of the said Act shall come into force.

3. AND whereas sub-section (1) of Section 10 of the Compensatory Afforestation Fund Act 2016 (38 of 2016) provides that:—

"With effect from such date as the Central Government may, by notification in the Official Gazette, appoint in this behalf, there shall be constituted a State Authority to be called the 'State Compensatory Afforestation Fund Management and Planning Authority' in each State;"

4. AND whereas the Central Government, vide notification No. S.O. 4856(E) dated 14-09-2018, has appointed the 30th day of September 2018 as the date of constitution of the State Authority to be called "The Himachal Pradesh Compensatory Afforestation Fund Management and Planning Authority".

5. Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 10 of the Compensatory Afforestation Fund Act, 2016 (38 of 2016), the Governor, Himachal Pradesh is pleased to constitute "The Himachal Pradesh Compensatory Afforestation Fund Management and Planning Authority" (hereinafter refer to as the 'State Authority') in the State of Himachal Pradesh, for the purposes of this Act, with effect from the date of its publication in the official gazette.

6. The State Authority constituted in the State shall be responsible for the management of the State Compensatory Afforestation Fund (SCAF) of Himachal Pradesh and its utilisation as per the provisions of the Compensatory Afforestation Fund Act, 2016 and the Compensatory Afforestation Fund Rules, 2018.

7. The State Authority shall consist of a Governing Body and shall be assisted by a Steering Committee and an Executive Committee.

8. The Governing Body of the State Authority shall consist of the following, namely:—

(i) Chief Minister of the State . . Chairperson, ex officio;

(ii) Minister of Forests . . Member, ex officio;

(iii) Chief Secretary . . Member, ex officio;

(iv) Principal Secretary (Environment)

. . Member, ex officio;

9. The Governing Body of the State Authority shall :—

(i) lay down the broad policy framework for the functioning of the State Authority within the overall framework notified by the Central Government on the recommendations of the National Authority;

(ii) Review the working of the State Authority from time to time.

10. The Governing Body of the State Authority shall meet atleast once in six months.

11. The Governing Body of the State Authority shall, in performance of its functions and powers under the Act, be assisted by the Steering Committee and the Executive Committee.

12. The Governing Body of the State Authority may with the prior concurrence of the State Government create posts in the State Authority at the level of Assistant Conservator of Forests and other officials to assist the Steering Committee and Executive Committee in performance of its functions.

13. The Steering Committee of the State Authority shall consist of the following, namely:—

(i) Chief Secretary

14. The Steering Committee of the State Authority shall :—

(i) Scrutinise and approve with such amendments as it may deem fit and proper, the annual plan of operations prepared by the Executive Committee of the State Authority and send the same to the Executive Committee of the National Authority for final approval;

(ii) Monitor the progress of utilisation of funds released from the State Fund;

(iii) Review reports on decision taken by the Executive Committee;

(iv) Approve, subject to prior concurrence of the State Government, proposals formulated by the Executive Committee for creation of posts in the State Authority;

(v) Approve annual report of the State Authority and send the same to the State Government to lay it, each year, in each House of the State Legislature;

(vi) Ensure inter-departmental coordination.

15. The Steering Committee of the State Authority shall meet atleast once in every three months.

16. The Executive Committee of the State Authority shall consist of the following, namely: —

(i) Formulate and submit annual plan of operations to the Steering Committee of the State Authority for its concurrence;

(ii) Undertake qualitative and quantitative supervision, monitoring and evaluation of the works being implemented from the amounts available in the State Fund;

(iii) Maintain books of account and other records;

(iv) Submit reports to the Steering Committee of the State Authority;

(v) Prepare annual report of the State Authority;

(vi) Deploy staff on contractual basis or on deputation on the posts in the State Authority;

(vii) Formulate proposals for creation of posts in the State Authority;

(viii) Be responsible for delegation of financial or administrative powers;

(ix) Be responsible for other day-to-day working in respect of the State Authority;

(x) Maintain and update public information system on the State Authority and present all information on its transaction in the public domain;

(xi) Undertake any other work as may be assigned by the Governing Body or Steering Committee of the State Authority or the State Government, from time to time.

18. The Executive Committee of the State Authority shall meet at least once in every three months.

19. The State Authority shall prepare its budget for the next financial year, showing the estimated receipts and expenditure of the State Authority and forward the same to the State Government and the Central Government in each financial year by 31st December.

20. The State Government shall appoint an officer not below the rank of a Chief Conservator of Forests as the Chief Executive Officer of the State Authority.

21. The State Authority may appoint the following officers for a period not exceeding five years, to assist the Steering Committee and Executive Committee in performance of its functions under the Act, namely:—

(i) Joint Chief Executive Officer not below the rank of a Conservator of Forests;

Secretary in the State Government;

No. EXN-F(10)-33/2018.—In the notifications of the Government of Himachal Pradesh, published in the Gazette of Himachal Pradesh, vide number EXN-F(10)-33/2018, dated the 31st December, 2018 :

1. in the notification No. 24/2018-State Tax (Rate), dated the 31st December, 2018 at page 7230, in line 10, for "383A" read "383".

ORDER/ No. 1/2019-State Tax

Shimla-2 the 13th February, 2019

No. EXN-F(10)-33/2018.—WHEREAS, sub-section (1) of Section 10 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereafter in this Order referred to as the said Act) provides that—

(i) a registered person engaged in the supply of services, other than supply of service referred to in clause (b) of paragraph 6 of Schedule II to the said Act, may opt for the scheme under the said sub-section;

(ii) a person who opts for the said scheme may supply services (other than those referred to in clause (b) of paragraph 6 of Schedule II to the said Act), of value not exceeding ten8324 राजपत्र, हिमाचल प्रदेश, 14 फरवरी, 2019/25 माघ, 1940 percent. of turnover in the State in the preceding financial year or five lakh rupees, whichever is higher;

AND WHEREAS, clause (a) of sub-section (2) of Section 10 of the said Act provides that the registered person shall be eligible to opt under sub-section (1), if, save as otherwise provided in sub-section(1), he is not engaged in the supply of services;

AND WHEREAS, rendering of services as part of the savings and investment practice of business, by way of extending deposits, loans or advances, in so far as the consideration is represented by way of interest or discount, is resulting in their ineligibility for the aforesaid scheme, causing hardships to a lot of small businesses and because of that, certain difficulties have arisen in giving effect to the provisions of Section 10;

NOW, THEREFORE, in exercise of the powers conferred by Section 172 of the Himachal Pradesh Goods and Services Tax Act, 2017 and in supersession of the Himachal Pradesh Goods and Services Tax (Removal of Difficulties) Order, 2017, No. 01/2017-State Tax, dated the 15th November, 2017, published in the Gazette of Himachal Pradesh, vide No. EXN-F(10)- 39/2017, dated the 18th November, 2017, except as respects things done or omitted to be done before such supersession, the State Government, on recommendations of the Council, hereby makes the following Order, namely: ––

1. Short title.––This Order may be called the Himachal Pradesh Goods and Services Tax (Removal of Difficulties) Order, 2019.

2. For the removal of difficulties, it is hereby clarified that the value of supply of exempt services by way of extending deposits, loans or advances in so far as the consideration is represented by way of interest or discount, shall not be taken into account—

(i) for determining the eligibility for composition scheme under second proviso to sub- section (1) of Section 10;

(ii) in computing aggregate turnover in order to determine eligibility for composition scheme.
