संख्याः एफ.एफ.ई.-बी.-एफ(4)3/2018.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश सरकार की अधिसूचना संख्या एफ.एफ.ई.-बी.-एफ(4)1/2015, तारीख 2 दिसंबर, 2016 और 27 मई, 2017 की विधिमान्यता की समाप्ति के परिणामस्वरूप, भारत के संविधान से संलग्न पाँचवीं अनुसूची के खण्ड 5 के उप-खण्ड (1) के अधीन प्रदा शक्तियों का प्रयोग करते हुए निदेश देते हैं कि वन (संरक्षण) अधिनियम, 233-राजपत्र/2019-16-02-2019 (8367) 8368 राजपत्र, हिमाचल प्रदेश, 16 फरवरी, 2019/27 माघ, 1940 1980, हिमाचल प्रदेश नौतोड रूल्ज, 1968 के कार्यान्वयन के सीमित प्रयोजन और अनिवार्य विकास क्रियाकलापों के कार्यान्वयन के लिए हिमाचल प्रदेश राज्य के अनुसूचित क्षेत्रों को, निम्नलिखित शर्तों की पूर्ति के अध्यधीन, एक वर्ष की अवधि के लिए लागू नहीं होगा,-

1. क्षेत्र राष्ट्रीय पार्क/अभ्यारण्य/आरक्षित संरक्षण/आरक्षित समुदाय/आरक्षित वन/सीमांकित संरक्षित वन में नहीं आता हो।

2. नौतोड़ के रूप में अनुज्ञात की जाने वाली प्रस्तावित भूमि पर खड़े वृक्षों की संख्या दो से अधिक नहीं होनी चाहिए।

3. जहां-कहीं इस अधिसूचना के जारी होने की तारीख तक सक्षम प्राधिकारी द्वारा नौतोड़ भूमि पहले ही मंजूर कर दी गई है, परन्तु पट्टे प्रदान नहीं किए जा सके थे, पट्टे अब उसी स्थान के लिए प्रदान किए जा सकेंगे जहां के लिए मंजूरी प्रदान की गई थी। असीमांकित संरक्षित वनों (यू पी एफज) में नौतोड़ की नई मंजूरियों के लिए, भूमि के टुकड़े ऐसी रीति में चिन्हित किए जाएं, कि सामान्य वन और क्षेत्र की पारिस्थितिकी अस्त-व्यस्त न हों। इसलिए वनों में नौतोड़ के अलग-अलग आबंटन के परिवर्जन के आशय से भूमि के टुकड़ों की पहचान राजस्व और वन अधिकारियों द्वारा संयुक्त रूप से की जाए। संबन्धित वन मण्डल अधिकारी को असीमांकित संरक्षित वन क्षेत्रों में नौतोड़ के आबंटन के लिए एसे े समय तक जब तक कि अनुसूचित क्षेत्रों में वन (संरक्षण) अधिनियम, 1980 लागू नहीं हो जाता है, निराक्षेप प्रमाण-पत्र जारी करने के लिए प्राधिकृत किया जाएगा।

4. इस प्र्रकार प्र्रदा नौैतोेड़़ का उपयोेग केेवल वास्तविक घरेेलूू प्र्रयोेजन केे लिए किया जाएगा औैर यह किसी वाणिज्यिक क्रियाकलाप केे लिए उपयोेग नहींं किया जाएगा।

5. नौतोड़ किसी ऐसे व्यक्ति को प्र्र्र्र्रदान नहींंंंं की जाएगी, जोेेेे वन भूूूूूमि पर अतिक्रमण सहित किसी प्र्र्र्र्र्रकार केेेेेे वन अपराध मेेेेेेंंंंंं सम्मिलित होेेेेे।

6. कोेेेेेई वन भूूूूूूमि, किसी ऐसे प्र्र्र्र्र्रयोजन के लिए प्र्र्र्र्र्रदान नहींंंंंं की जाएगी, जिसमंंंंंेंेेेेे प्र्र्र्र्र्राकृतिक जल संंंंंंसाधनोेेेेेंंंंंं का उपयोेेेेेग स्थानीय निवासियोेेेेेंंंंंं द्वारा किया जाता है।

7. कोेेेेेई वन भूूूूूूमि, जिसमेेेेेेंंंंंं रास्ते औैैैैैर सड़़़़़़केेेेेेंंंंंं विद्यमान हैं, जोेेेेे स्थानीय निवासियांंंंंेंेेेेे द्वारा उपयोेेेेेग किए जा रहेेेेेे हैं, किसी भी प्र्र्र्र्र्रयोेेेेेजन केेेेेे लिए प्र्र्र्र्र्रदान नहींंंंंं की जाएगी।

8. सरकार द्वारा व्यवस्थित करवाए जानेेेेेेेे वाले आवश्यक विकासात्मक क्रियाकलापांंंंंंंेंेेेेेेे के अन्तर्गत (1) स्कूल, (2) औैैैैैैैषधालय/अस्पताल, (3) विद्युुुुुुुुत औैैैैैैैर दूूूूूूूूरसंंंंंंंंचार लाइनेेेेेेेेंंंंंंंं, (4) पेेेेेेेेयजल परियोेेेेेेेजनाएंंंंंंंं, (5) जल/वर्र्र्र्षा जल संंंंंंंंग्र्र्र्र्र्र्र्रहण अवसंंंंंंंंरचना, (6) लघुुुुुुुु सिंंंंंंंंचाई नहरेेेेेेेेंंंंंंंं, (7) नवीकरणीय ऊर्र्र्र्जा स्त्रोेेेेेेेत, (8) कौैैैैैैैशल उन्नयन व्यावसायिक प्र्र्र्र्र्र्र्रशिक्षण केेेेेेेेन्द्र्र्र्र्र्र्र्र, (9) विद्युुुुुुुुत सब-स्टेेेेेेेेशन, (10) संंंंंंंंचार चौकियांंंंंंंं, (11) सड़़़़़़़़क किनारे स्थापनों के पहुुुुुुुुंंंंंंंंच-मार्गों सहित, सड़़़़़़़़कों का सन्निर्र्र्र्माण/चौड़़़़़़़़ा करना (12) सीमा सड़़़़़़़़क संंंंंंंंगठन (बी.आर.ओ.) द्वारा विद्यमान पुुुुुुुुलोेेेेेेेंंंंंंंं का उन्नयन/सुुुुुुुुदृृृृृृृृढ़़़़़़़़ीकरण/चौैैैैैैैड़़़़़़़़ा करना, (13) गृृृृृृृृह मंंंंंंंंत्रालय द्वारा पहचान किए गए संंंंंंंंवेेेेेेेेदनशील क्षेेेेेेेेत्रोेेेेेेेंंंंंंंं मेेेेेेेेंंंंंंंं पुुुुुुुुलिस स्थापनाएंंंंंंंं जैसेे कि पुुुुुुुुलिस स्टेशन/आउटपोस्ट/सीमा आउटपोस्ट/निगरानी टावर। इन क्रियाकलापाें के लिए अनुज्ञा वन विभाग, हिमाचल प्रदेश सरकार द्वारा अलग-अलग मामलाें के आधार पर हिमाचल प्रदेश सरकार के पत्र संख्या एफ.एफ.ई.-बी.-एफ(4)1/2015, तारीख 31 दिसम्बर, 2016 द्वारा पहले ही विरचित विनियम के अनुसार अनुज्ञा प्रदान करने हेतु प्रक्रिया और प्राधिकारियों को विनिर्दिष्ट करते हुए, प्रदान की जाएगी।

NOTIFICATION

Shimla-2, the 13th February, 2019

No. FFE-B-F(4)-3/2018.—Consequent upon expiry of validity of the Government of Himachal Pradesh Notification No. FFE-B-F(4)1/2015, dated 2nd December, 2016 and 27th May, 2017, the Governor, Himachal Pradesh, in exercise of the powers conferred under sub-clause (1) of clause 5 of FIFTH SCHEDULE appended to the Constitution of India, is pleased to direct that the Forest (Conservation) Act, 1980 shall not apply to the Scheduled Areas of the State of Himachal Pradesh for the limited purpose of implementation of the Himachal Pradesh Nautor Rules, 1968 and carrying essential development activities, for a period of one year, subject to fulfilment of the following conditions,—

1. The area does not fall in National Park/Sanctuary/Conservation Reserve/ Community Reserve/Reserve Forest/Demarcated Protected Forest.

2. The number of trees standing over the land proposed to be allowed as Nautor should not exceed two.

3. Where ever Nautor land has already been sanctioned by competent authority till the date of issue of the this Notification but pattas could not be granted, pattas may now be granted at the same location for which sanction was issued. For new sanctions of Nautor in Un-demarcated Protected Forests (UPFs), land parcels be selected in such a manner that the general forests and ecology of the area is not disturbed. Land chunks be therefore identified jointly by Revenue and Forest officers in order to avoid scattered allotment of Nautor in the Forests. Divisional Forest Officer concerned shall be authorized to issue No Objection Certificate for allotment of Nautor in Un- demarcated Protected Forests areas till such time as Forest (Conservation) Act, 1980 does not apply in the Scheduled Areas.

4. The Nautor so granted is utilized only for bonafide domestic purpose and is not utilized for any commercial activity.

5. The Nautor is not granted to any such person who is involved in any kind of forest offence including encroachment on forest land.

6. No forest land shall be granted for any purpose in which natural water resources are utilized by the local inhabitants.

7. No forest land will be granted for any purpose where paths and roads exist which are used by the local inhabitants.

8. The essential developmental activities to be provided by the Government shall include (1) Schools, (2) Dispensaries/Hospitals, (3) Electric and Telecommunication lines, (4) Drinking water projects, (5) Water/Rain Water Harvesting Structures, (6) Minor Irrigation Canals, (7) Renewable Sources of Energy, (8) Skill Up- gradation/Vocational Training Centres, (9) Power sub-stations, (10) Communication8370 राजपत्र, हिमाचल प्रदेश, 16 फरवरी, 2019/27 माघ, 1940 posts, (11) Construction/Widening of roads including approach roads to road side establishments, (12) Upgradation/ Strengthening/Widening of existing bridges by the Border Roads Organization (BRO), (13) Police Establishments like Police Stations/ Outposts/Border Outposts/watch towers in sensitive areas identified by the Ministry of Home Affairs. Permission for these activities shall be granted by the Forest Department, Government of Himachal Pradesh, on case to case basis as per the regulation already framed by the Government of Himachal Pradesh vide Government of Himachal Pradesh letter No. FFE-B-F(4)-1/2015, dated 31st December, 2016, specifying procedure and authorities for granting the permission.

सं0पी0बी0डब्ल्यू0(बी0)एफ(5)7/2018.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः महाल पुईद, तहसील व जिला कुल्लू, हि0 प्र0 में रामशिला बिजली महादेव सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों, उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यों को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपाि हो तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी (हि0 प्र0) के समक्ष अपनी आपाि दायर कर सकता है।

श्रीमती ओमां देवी पत्नी मदन लाल, वासी महाल कस्बा, महाल जखधार, तहसील डाडा सीबा, जिला कांगड़ा, हि0 प्र0 ने इस आशय से न्यायालय में प्रार्थना-पत्र दिया है कि उसका सही नाम मुताबिक पंचायत अभिलेख व आधार कार्ड व महाल कस्बा के राजस्व अभिलेख में ओमां देवी पत्नी मदन लाल दर्ज है जो कि सही है परन्तु महाल उग्राहला उपरला, तहसील डाडा सीबा के राजस्व अभिलेख में प्रार्थिया का नाम उषा देवी पत्नी मदन लाल दर्ज है जो कि सही न है। प्रार्थिया ने उक्त नाम की दरुस्ती बारे अनुरोध किया है। अतः इस इश्तहार राजपत्र द्वारा आम जनता को सूचित किया जाता है कि यदि उक्त नाम दरुस्ती बारे कोई एतराज हो तो वह उक्त मुकद्दमा की पैरवी बारे दिनांक 28-02-2019 को प्रातः 10.00 बजे अदालत हजा में व्यक्तिगत रूप से अथवा किसी अधिकृत एजैन्ट के माध्यम से या किसी अधिवक्ता के माध्यम से इस न्यायालय में उपस्थित आवें अन्यथा गैर-हाजिरी की सूरत में नाम दरुस्ती के आदेश पारित कर दिये जायेंगे। बाद मियाद तारीख पेशी कोई उजर या एतराज काबिले गौर न होगा।

Arun and Kajal Kapoor have filed an application alongwith affidavit in the court of undersigned under section 15 of Special Marriage Act, 1954 that they have solemnized their marriage on 16-11-2018 according to Hindu custom and rites and they are living together as husband and wife since then, hence, their marriage may be registered under Special Marriage Act, 1954.

Therefore, the general public is hereby informed through this notice that if any person who has any objection regarding this marriage can file the objection personally or in writing before this court on or before 28-02-2019 after that no objection will be entertained and marriage will be registered.

And, whereas, both these applicants have submitted in their applications and in their affidavits that both were unmarried at the time of solemnization of their marriage and were major in age and having no prohibited relations to each other debarring them to marry each other. Both the applicants have requested for registration of their marriage.

Therefore, by this notice the public in General is informed that if any one has any objection regarding registration of this marriage, he may present before this court on or before 30-03-20198378 राजपत्र, हिमाचल प्रदेश, 16 फरवरी, 2019/27 माघ, 1940 for hearing of objections if any. श्री जोगिन्द्र सिंह पुत्र श्री ईशर दास, निवासी गांव पोलियांबीत, डाकघर पोलियांबीत, सब-तहसील दुलैहड़, जिला ऊना द्वारा इस अदालत में आवेदन-पत्र प्रस्तुत किया है कि उसकीे माता श्रीमती विशो देवी की मृत्यु गांव व डाकघर पोलियांबीत में दिनांक 23-06-2000 को हुई थी परन्तु इस बारे पंचायत अभिलेख में अज्ञानता के कारण उनकी मृत्यु का पंजीकरण नहीं करवाया जा सका। अब पंजीकरण करने की नियमानुसार कार्यवाही की जानी है।

अतः इस नोटिस के माध्यम से सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त मृत्यु पंजीकरण होने बारे कोई उजर/एतराज हो तो वह स्वयं दिनांक 22-02-2019 को प्रातः दस बजे से सायं 5.00 बजे तक अधोहस्ताक्षरी के न्यायालय में असालतन/वकालतन हाजिर होकर अपना उजर पेश कर सकता है। निर्धारित तिथि के उपरान्त किसी भी प्रकार का उजर/एतराज मान्य न होगा तथा उपरोक्त मृत्यु पंजीकरण करने के आदेश नियमानुसार पारित कर दिए जाएंगे।
