File No. AHY-F(4)-1/97-L.—The Governor, Himachal Pradesh is pleased to re- constitute the State Animal Welfare Board for taking appropriate decisions on the steps required to Prevent infliction to Cruelty to the Animals. The composition of the Board will be as under:—

2. The functions of the State Animal Welfare Board:

1. To ensure that the provisions for the Prevention of Cruelty to Animals as in force in India are implemented by the Government properly giving special emphasis8415 राजपत्र, हिमाचल प्रदेश, 21 फरवरी, 2019/2 फाल्गुन, 1940 to amended provisions under sub-section (1) of Section 38 of the Prevention of Cruelty to Animal Act, 1960 and to undertake study of problems, if any, faced for effective implementation of such law from time to time.

2. To advise the Central Government in framing rules under the Prevention to Cruelty to Animals Act, 1960 (59 of 1960), with a view to prevent unnecessary pain or suffering to animals generally and more particularly when they are being transported from one place to another or when they are used as performing animals or when they are used in captivity or confinement.

3. To advise the Government or any local authority or other person on improvement in the design of vehicles so as to lessen burden on draught animals.

4. To take all such steps as the Board may think fit, for amelioration of animals by encouraging or providing for construction of sheds, water troughs and the like and by providing for veterinary assistance to animals.

5. To advise the Government or any local authority or other person in the design of slaughter houses or in connection with slaughter of animals so that unnecessary pain and suffering, whether physical or mental, is eliminated in the pre-slaughter stages as far as possible and animals are killed, wherever necessary, in as humane manner as possible.

6. To take all such steps as the Board may think fit to ensure that unwanted animals are destroyed by local authorities, wherever it is necessary to do so, either instantaneously or after being rendered insensible to pain or suffering.

7. To encourage, by the grant of financial assistance or otherwise, the formation of gosadans, rescue homes, animal shelters, sanctuaries and like where animals and birds may find a shelter when they become old and useless or when they need protection.

8. To cooperate with and coordinate the work of associations or bodies established for the purpose of preventing unnecessary pain or suffering to animals or for the protection of animals and birds.

9. To give financial and other assistance to animal welfare organizations functioning in any local area or to encourage the formation of animal welfare organizations in any local area which shall work under the general supervision and guidance of the Board.

10. To advise the Government on the matters relating to the medical care and attention which may be provided in animal hospitals whenever the Board thinks it necessary to do so.

11. To impart education in relation to the humane treatment to the animals and to encourage formation of public opinion against the infliction of unnecessary pain and suffering to animals and for promotion of animal welfare using books, posters, lectures, exhibitions, workshops and likes.

12. To advise the Government on any matter connected with animals welfare or prevention of infliction of unnecessary pain and suffering to animals.

1. The office of the Board shall be located in the Directorate of Animal Husbandry, Pashudhan Bhawan, Boileauganj, H.P. Shimla-5.

2. The term of Board shall be three years from the date of its constitution or shall be at the discretion of the State Government, whichever is earlier.

3. The term of office of the ex-officio members shall continue so long as he holds the office by virtue of which he is such a member.

4. The Government may, at any time, remove a member from office without giving his/her opportunity of show cause against proposed removal and any vacancy caused by such removal shall be treated as casual vacancy for the purpose.

5. The terms and condition regarding TA/DA of the official/non-official members will be the same as circulated by Finance Department from time to time.

Shimla, the 2nd February, 2019

No. FFE-B-F(14)-56/2013.—Whereas the nature and extent of the rights of the Government and of private persons in or over the Forest Land/Waste Land specified in the schedule inserted to this Notification have been enquired into and recorded as required under sub-section (3) of Section 29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/Waste Land shown in the said schedule is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the Forest Produce therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the Act shall apply to the said Forest Land/Waste Land and shall hereafter be called as "Protected Forests" under the provisions of sub-section (2) of Section 29 of the Act ibid.

2019 का विधेयक संख्यांक 4 हिमाचल प्रदेश राजभाषा (संशोधन) विधेयक, 2019

(विधान सभा में पुरःस्थापित रूप में)

हिमाचल प्रदेश राजभाषा अधिनियम, 1975 (1975 का अधिनियम संख्यांक 1) का संशोधन करने के लिए विधेयक। 8422 राजपत्र, हिमाचल प्रदेश, 21 फरवरी, 2019/2 फाल्गुन, 1940 भारत गणराज्य के सत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :--

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश राजभाषा (संशोधन) अधिनियम, 2019 है।

2. धारा 2 का प्रतिस्थापन.--हिमाचल प्रदेश राजभाषा अधिनियिम, 1975 (1975 का 1) (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 2 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-- ''2. परिभाषाएं.--इस अधिनियम में, जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,--

(क) "सरकार" या "राज्य सरकार" से, हिमाचल प्रदेश सरकार अभिप्रेत है;

(ख) ''हिन्दीे'' से, देवनागरी लिपि में हिन्दी भाषा अभिप्रेत है;

(ग) ''अधिसूचना'' से, राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित अधिसूचना अभिप्रेत है;

और

(घ) ''संस्कृत'' से, देवनागरी लिपि में संस्कृत भाषा अभिप्रेत है। ''।

3. धारा 3-क का अंतःस्थापन.--मूल अधिनियम की धारा 3 के पश्चात्‌ निम्नलिखित धारा अंतःस्थापित की जाएगी, अर्थात्‌ :--

''3-क.-संस्कृत का द्वितीय राजभाषा होना.--हिमाचल प्रदेश राज्य की द्वितीय राजभाषा संस्कृत होगी।''।

4. धारा 4-क का अंतःस्थापन.--मूल अधिनियम की धारा 4 के पश्चात्‌ निम्नलिखित धारा अंतःस्थापित की जाएगी, अर्थात्‌ :-

''4-क.-प्रयोजन जिसके लिए संस्कृत का प्रयोग किया जाएगा.-द्वितीय राजभाषा के रूप में संस्कृत का ऐसे प्रयोजनों के लिए और ऐसी तारीख से प्रयोग किया जाएगा, जैसी राज्य सरकार अधिसूचना द्वारा विनिर्दिष्ट करे। ''।

उद्देश्यों और कारणों का कथन

संस्कृत अधिकतर भारतीय भाषाओं का मूल है। भारत में आम जनता और बुद्धिजीवी वर्ग द्वारा संस्कृत के व्यापक प्रयोग का इतिहास साक्षी है। इसके व्याकरण की वैज्ञानिक शुद्धता के कारण अधिकतर भारतीय भाषाएं संस्कृत से उत्पन्न हुई। यहां तक कि आज भी संस्कृत कम्प्यूट्रीकरण में सुगमतापूर्वक अनुकूलनीय है। विभिन्न प्राचीन शास्त्रों, विज्ञानों, साहित्य रस-विधा, रूपक-नाटकों, गणित, आयुर्विज्ञान, योग आदि में प्रतिष्ठापित हमारी सांस्कृतिक विरासत को पढ़ने हेतु यह एक उपयोगी साधन है। समस्त सरकारी पाठशालाओं में आठवीं कक्षा तक विद्यार्थियों को संस्कृत एक अनिवार्य विषय के रूप में पढ़ाई जाती है। राज्य में सरकार संस्कृत के प्रयोग में वृद्धि करने का आशय रखती है। भारत के संविधान के अनुच्छेद 345 के उपबन्ध के अधीन किसी राज्य की विधान सभा संविधान की आठवीं अनुसूची में उपदर्श्ाित किसी भाषा को अपनी राजभाषा के रूप में अंगीकृत कर सकती है। संस्कृत भाषा के स्तर और प्रसुविधाओं को ध्यान में रखते हुए, इसे राज्य8423 राजपत्र, हिमाचल प्रदेश, 21 फरवरी, 2019/2 फाल्गुन, 1940 की द्वितीय राजभाषा के रूप में अंगीकृत करने का विनिश्चय किया गया है। अतः हिमाचल प्रदेश राजभाषा अधिनियम, 1975 (1975 का अधिनियम संख्यांक 1) में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्देश्यों की पूर्ति के लिए है।

Bill No. 4 of 2019

THE HIMACHAL PRADESH OFFICIAL LANGUAGE (AMENDMENT) BILL, 2019

(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

A

BILL

to amend the Himachal Pradesh Official Language Act, 1975 (Act No. 1 of 1975).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventieth Year of the Republic of India as follows :—

1. Short title.—This Act may be called the Himachal Pradesh Official Language (Amendment) Act, 2019.

2. Substitution of section 2.—For section 2 of the Himachal Pradesh Official Language Act, 1975 (1 of 1975) (hereinafter referred to as the "principal Act"), the following shall be substituted, namely :—

"2. Definitions.—In this Act, unless the context otherwise requires,—

(a) "Government" or "State Government" means the Government of Himachal Pradesh;

(b) "Hindi" means Hindi language in Devanagari script;

(c) "Notification" means a notification published in the Rajpatra (e-Gazette), Himachal Pradesh; and

(d) "Sanskrit" means Sanskrit language in Devanagari script.".

3. Insertion of section 3-A.—After section 3 of the principal Act, the following section shall be inserted, namely:—

"3-A. Sanskrit to be the second official language.—The second official language of the State of Himachal Pradesh shall be Sanskrit.".

4. Insertion of section 4-A.—After section 4 of the principal Act, the following section shall be inserted, namely :—

"4-A. Purposes for which Sanskrit shall be used.—Sanskrit as second official language shall be used for such purposes and from such date, as the Government may, specify by notification.".

STATEMENT OF OBJECTS AND REASONS

The Sanskrit is the origin of most of the Indian languages. History bears testimony to the widespread use of Sanskrit by the general populace and the intelligentsia in India. Due to the scientific precision of its grammar most Indian languages originated from the Sanskrit. Even today Sanskrit is easily adaptable to computerization. It is a useful tool for deciphering our cultural legacy enshrined in various ancient scriptures, sciences, literature alchemy, allegorical plays, mathematics, medicine, yoga etc. Students in all Government schools upto the 8th standard are taught Sanskrit as a compulsory subject. The Government intends to increase the uses of Sanskrit in the State. Under the provision of article 345 of the Constitution of India, the Legislative Assembly of any State may adopt any language indicated in the Eighth Schedule of the Constitution as its official language. Keeping in view the status and benefits of the Sanskrit Language it has been decided to adopt it as a second official language of the State. Thus, it has necessitated amendments in the Himachal Pradesh Official Language Act, 1975 (Act No. 1 of 1975).

This Bill seeks to achieve the aforesaid objectives.

भारत गणराज्य के सारवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :--

1. संक्षिप्त नाम.—इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय (संशोधन) अधिनियम, 2019 है।

2. नाम का संशोधन.—हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय अधिनियम, 2017 (जिसे इसमें इसके पश्चात्‌ "मूल अधिनियम" कहा गया है) के नाम में "हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय" शब्दों के स्थान पर "अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश" शब्द और चिन्ह रखे जाएंगे। 3. वृहत्‌ नाम का संशोधन.—मूल अधिनियम के वृहत्‌ नाम में, "हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय" शब्दों के स्थान पर "अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश" शब्द और चिन्ह रखे जाएंगे।

4. धारा 1 का संशोधन.—मूल अधिनियम की धारा 1 की उपधारा (1) में, "हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय" शब्दों के स्थान पर "अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश" शब्द और चिन्ह रखे जाएंगे।

5. धारा 2 का संशोधन.—मूल अधिनियम की धारा 2 के खण्ड (भ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"(भ) "विश्वविद्यालय" से, इस अधिनियम की धारा 3 के अधीन स्थापित अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश अभिप्रेत है;"।

6. धारा 3 का संशोधन.—मूल अधिनियम की धारा 3 की उपधारा (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"(1) " अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश" के नाम से हिमाचल प्रदेश राज्य में अधिकारिता रखने वाला एक विश्वविद्यालय होगा।"।

7. धारा 14 का संशोधन.—मूल अधिनियम की धारा 14 की उपधारा (4) में "पैंसठ वर्ष" शब्दों के स्थान पर "सत्तर वर्ष" शब्द रखे जाएंगे। 8426 राजपत्र, हिमाचल प्रदेश, 21 फरवरी, 2019/2 फाल्गुन, 1940 8. धारा 60 का संशोधन.—मूल अधिनियम की धारा 60 के खण्ड (ख) में "हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय" शब्दों के स्थान पर "अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश" शब्द और चिह्‌न रखे जाएंगे।

उद्देश्यों और कारणों का कथन

हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय अधिनियम, 2017 (2017 का अधिनियम संख्यांक 11) "हिमाचल प्रदेश स्वास्थ्य विज्ञान विश्वविद्यालय" के नाम से विश्वविद्यालय स्थापित करने के लिए अधिनियमित किया गया था। राज्य सरकार ने अब विनिश्चय किया है कि विश्वविद्यालय का नाम "अटल आयुर्विज्ञान और अनुसंधान विश्वविद्यालय, हिमाचल प्रदेश" के रूप में परिवर्तित किया जाए। इसलिए अधिनियम की कुछ धाराओं में संशोधन किया जाना अपेक्षित है।

इसके अतिरिक्त, पूर्वोक्त अधिनियम के उपबंधों के अनुसार कुलपति, कुलाधिपति के प्रसादानुसार, तीन वर्ष की अवधि के लिए पद धारण करेगा और सरकार के परामर्श पर वह पुनर्नियुक्ति के लिए पात्र होगा, किन्तु पैंसठ वर्ष की आयु पूर्ण करने के पश्चात्‌ नहीं। इंदिरा गांधी आयुर्विज्ञान महाविद्यालय, शिमला और डॉक्टर राजेन्द्र प्रसाद राजकीय आयुर्विज्ञान महाविद्यालय, कांगड़ा स्थित टांडा में संकाय-सदस्यों की बावत सेवानिवृत्ति आयु 62 वर्ष है और चम्बा, नाहन, हमीरपुर और नेरचौक में नए आयुर्विज्ञान महाविद्यालयों को सुचारू रूप से चलाने के आशय से इन आयुर्विज्ञान महाविद्यालयों में सेवानिवृत्ति आयु 65 वर्ष तक बढ़ा दी गई है तथा इन महाविद्यालयों में पुनर्नियुक्ति 70 वर्ष तक अनुज्ञात है। विद्यमान उपबंध के दृष्टिगत, कुलपति के रूप में ऐसे संकाय-सदस्य की नियुक्ति हो सकती है, जो राज्य में कार्यरत अधिकतर संकाय-सदस्यों से कनिष्ठ हैं। इस प्रकार कुलपति के रूप में नियुक्ति के लिए विचार-क्षेत्र को विस्तारित करने हेतु ऊपरी आयु सीमा में वृद्धि करना समीचीन हो गया है। इसलिए पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है। यह विधेयक उपर्युक्त उद्देश्यों की पूर्ति के लिए है।

(AMENDMENT) BILL, 2019

BILL

to amend the Himachal Pradesh University of Health Sciences Act, 2017 (Act No. 11 of

2017).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventieth Year of the Republic of India as follows :—

1. Short title.—This Act may be called the Himachal Pradesh University of Health Sciences (Amendment) Act, 2019.

2. Amendment of title.—In the title of the Himachal Pradesh University of Health Sciences Act, 2017 (hereinafter referred to as the "principal Act") for the words "HIMACHAL PRADESH UNIVERSITY OF HEALTH SCIENCES", the words and sign "ATAL MEDICAL AND RESEARCH UNIVERSITY, HIMACHAL PRADESH" shall be substituted.

3. Amendment of long title.—In the long title of the principal Act for the words "Himachal Pradesh University of Health Sciences", the words and sign "Atal Medical and Research University, Himachal Pradesh" shall be substituted.

4. Amendment of section 1.—In section 1 of the principal Act, in sub-section (1), for the words "Himachal Pradesh University of Health Sciences", the words and sign "Atal Medical and Research University, Himachal Pradesh" shall be substituted.

5. Amendment of section 2.—In section 2 of the principal Act, for clause (x), the following shall be substituted, namely :—

"(x) "University" means the Atal Medical and Research University, Himachal Pradesh established under section 3 of this Act;".

6. Amendment of section 3.—In section 3 of the principal Act, for sub-section (1), the following shall be substituted, namely :—

"(1) There shall be a University by the name "The Atal Medical and Research University, Himachal Pradesh" having jurisdiction within the State of Himachal Pradesh.".

7. Amendment of section 14.—In section 14 of the principal Act, in sub-section (4), for the words and sign "sixty-five years", the words "seventy years" shall be substituted.

8. Amendment of section 60.—In section 60 of the principal Act, in clause (b), for the words "Himachal Pradesh University of Health Sciences", the words and sign "Atal Medical and Research University, Himachal Pradesh" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh University of Health Sciences Act, 2017 (Act No. 11 of 2017) was enacted to establish an University with the name "The Himachal Pradesh University of Health Sciences". The State Government has now decided that the name of the University may be changed as "The Atal Medical and Research University, Himachal Pradesh". Therefore, amendments are required to be carried out in some sections of the Act.

Further, as per the provisions of the Act ibid. the Vice-Chancellor shall hold office for a term of three years at the pleasure of the Chancellor and shall be eligible for re-appointment on the advice of the Government, but not beyond the age of sixty-five years. The retirement age in respect8428 राजपत्र, हिमाचल प्रदेश, 21 फरवरी, 2019/2 फाल्गुन, 1940 of faculty members at IGMC, Shimla and Dr. RPGMC Kangra at Tanda is 62 years and in order to run the new medical colleges at Chamba, Nahan, Hamirpur and Ner Chowk smoothly, the retirement age in these medical colleges has been enhanced upto 65 years and re-employment is allowed upto 70 years in these colleges. The existing provision may lead to appointment of faculty member as Vice-Chancellor who is junior to most of the faculty members working in the State. Thus, it has become expedient to increase the upper age limit for appointment as Vice-Chancellor to expand the zone of consideration. This has necessitated amendments in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.
