ANNEXURE-A

Strategy for

Management of Non-Biodegradable Waste/Plastic Waste in Himachal Pradesh

1. Keeping in view the ill effects of use of plastics, non-biodegradable material the State Government of Himachal Pradesh enacted H.P. Non-biodegradable Garbage (Control) Act, 1995 and H.P. Non-biodegradable Garbage (Control) Rules, 1996 to regulate the use of non- biodegradable materials in the State of Himachal Pradesh.

The Himachal Pradesh is the first State of Country to prohibit the traders, retailers and vendors in the State of H.P. from using coloured polythene carry-bags manufactured from recycled plastic, for packaging the goods traded/ sold by them, w.e.f. 1st Jan., 1999 under sub-section (1) of section 3-A of the H.P. Non-biodegradable Garbage (Control) Act, 1995. Thereafter, as a step forward, the State Government imposed prohibition on the stockists, traders, retailers and vendors for using carry bags made of non-biodegradable material with specification viz; plastic carry bags having thickness less than 70 microns and size less than 12" × 18" w.e.f. 14th June, 2004 vide Notification dated 04-06-2004. Further in order to preserve the pristine environment and to protect the natural beauty of the hilly State, the Government of Himachal Pradesh issued notification imposing complete ban on littering and use of polythene/ plastic carry-bags (irrespective of their sizes and thickness) and non-biodegradable material w.e.f. 2nd October, 2009 and complete ban on the use of plastic cups, plates and glasses in the State w.e.f. 2nd October, 2011 respectively.

Now, recently the Government imposed complete ban on use of thermocol cutlery i.e. cups, plates, glasses, spoons or any other item used for serving and consuming food in any form manufactured from non-biodegradable material in the State of Himachal Pradesh w.e.f. 06-07-2018. The State Government has institutionalized the entire process since 2009 for eradication of the plastic wastes and to save the sensitive ecosystems of the State be it soil, water, forests or rivulets, animals, etc. The awareness campaigns, trainings, cleanliness campaigns are regular features of process with reviews of implementation of regulatory obligations.

2. The regulatory powers have been delegated to various officers/officials in order to effectively check use of polythene carry bags and littering of plastic waste in the State and compound the violations. Following officers have been authorised vide Notification dated: 07-07- 2009, 20-08-2010, 4-11-2010 and 15-3-2011 for entry and inspection under H.P. Non- biodegradable Garbage (Control) Act, 1995:

1. All the District Magistrate, Addl. Dy. Commissioners, Addl. District Magistrates and Sub-Divisional Magistrates in Himachal Pradesh.

2. All the Superintendents of Police, Additional Superintendents of Police and Sub Divisional Police Officers/Deputy Superintendents of Police.

4. All the Chief Medical Officers in H.P.

5. All the Deputy/Assistant Excise & Taxation Commissioners and Excise and Taxation Officers in H.P.

6. All the Territorial Divisional Forest Officers, Range Officers and Deputy Range Officers in H.P.

7. All the Tehsildars and Naib Tehsildars in H.P.

8. All the Environmental Engineers and Assistant Environmental Engineers of H.P. State Pollution Control Board.

9. All the District and Assistant Tourism Development Officers in H.P. posted in the Districts.

10. All the District Food & supplies Controllers in H.P.

11. All the Executive Officers of Municipal Councils and Secretaries of Nagar Panchayats in Himachal Pradesh.

12. All the SHOs (Station House Officers)

13. All the Block Medical Officers

14. Health Officers, Municipal Corporation, Shimla

15. All the Excise & Taxation Officers

16. All the Block Development Officers

17. All the Sr. Environmental Engineers, Pr. Scientific Officers, Sr. Project Consultant, Sr. Scientific Officers, Jr. Scientific Officers, Jr. Environmental Engineers of H.P. State Pollution Control Board.

3. The designated officers/ competent authorities are checking illegal use of polythene in the State and the violations are being compounded under provisions of H.P. Non-biodegradable Garbage (Control) Act, 1995. Since 2008, till date (As on 31-12-2018) about 6956 challans have been carried out by these officers and an amount of Rs. 48,11,050 /- has been collected as compounding fee. The year wise detail of same is at Annexure-A.

4. There is proper institutional mechanism devised for reporting, monitoring of implementation of various provisions as notified through different notifications from time to time.

For this purpose, Department of Environment, Science & Technology, Himachal Pradesh is the Nodal Department.

5. The Department of Environment, Science & Technology is compiling District wise/ Department wise details of status of compliances, w.r.t. Challans under H.P. Non-Biodegradable Garbage (Control) Act, 1995 received from various authorities, department and districts. The details of such compilation for period January 2018 to December 2018 has been annexed. From the reports one can observe that only few departments and authorized officers/ officials of such Departments are furnishing their reports to the nodal department. District/ Department wise detail of status of compliance of different departments is at Annexure-B. Departments such as Health, Excise & Taxation, MCs, Forest, Tourism, ULBs, Transport, BBNDA etc. have not submitted any reports or information till date to nodal department. The departments/ authorities are:—

1. Department of Health & FW

2. Municipal Corporation/ Councils

3. Excise & Taxation Department

4. Department of Forests

5. Tehsildars, BDOs of Revenue and RD Department respectively

6. Department of Tourism & Civil Aviation

7. All AE, JE, Chief Sanitary Inspector, Sanitary Inspectors of ULBs

8. Department of Transport

9. BBNDA

10. Temple Officers

It is desirable that all the Stakeholder Departments also contribute to Polythene free Himachal.

6. The State Government has not only banned the use of polythene carry bags but also mechanized to safely dispose of the plastic waste, which is being generated from packaging, etc. One of such successful way is use of such plastic waste in construction of roads. The Public Works Department, Himachal Pradesh is using plastic wastes in road construction. As per reports submitted by HPPWD in four different zones viz; Shimla Zone, Mandi Zone, Hamirpur Zone and Kangra Zone plastic has been used for road construction. Till date total 144.54 MTs plastic waste has been used in constructing 175.018 KMs of roads. Detail of road construction by plastic waste is at Annexure-C. But again after 2015 the H. P. Public Works Department has not reported anything w.r.t. using plastic wastes for road construction in the State. The H.P. Public Works Department has installed 14 No. of shredders for safe process of plastic waste and for preparing granules of plastics. At present these shredders are lying idle and are not in use. Detail of shredders is at Annexure-D.

7. The H.P. Public Works Department informed during discussions that they are not getting requisite plastic waste for road construction as per standards and since 2015 hardly any progress has been made in this direction. One can see from the detail of challans on use of9107 राजपत्र, हिमाचल प्रदेश, 15 मार्च, 2019/24 फाल्गुन, 1940 polythene carry bags and littering of plastic waste that plastic is being used and waste is being generated in the State which needs to be managed. There is clear cut lack of synergy among various departments w.r.t. collection and disposal of non-biodegradable waste including plastics. Urban Development Department has notified designated places for plastic waste collection and list is at Annexure-E but it appears that plastic waste is either not collected at these designated places also not being handedover to Public Works Department and there is evident lack in coordination. All authorised officers/ departments are required to work in coordination with each other for collecting and handingover of the plastic waste for safe disposal.

8. It is matter of serious concern that littering has increased over the years. Daily news paper reports are appearing regarding plastic waste littering and inactions. Two news articles of dated 18-09-2017 and 26-11-2018 are annexed at Annexure- F which shows that use of plastic packaging and dumping of such plastic waste in forest areas is a cause of concern. Plastic is also seen scattered/ littered alongwith the roads. This problem is more pronounced in major tourist roads.

9. It is observed that over the period the implementation of ban on polythene and disposal of plastic wastes has slowed down mainly due to lack of coordination among various stakeholder departments that are involved in collecting, handingover the plastic waste for further use in either road construction or in waste to energy plants. The matter has been deliberated upon in various meetings, Video Conferences with district authorities. The Department of Environment, Science & Technology is also in touch with Central Road Research Institute (CRRI), New Delhi for transfer of technology for use of plastic waste in road construction. This could help in eradication of plastic waste to a great extent.

10. In order to strictly enforce ban on polythene, reduce littering and ensure maximum disposal of plastic action plan will be as follows:—

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सहकारिता विभाग निरीक्षक/निरीक्षक (संपरीक्षा) सहकारी सभाएं (वर्ग-III, अराजपत्रित) भर्ती एवं प्रोन्नति (तृतीय संशोधन) नियम, 2019 है ।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किये जाने की तारीख से प्रवृत्त होंगे । 2. उपाबन्ध "क" और "ख" का संशोधन.--हिमाचल प्रदेश सहकारिता विभाग निरीक्षक/निरीक्षक (संपरीक्षा) सहकारी सभाएं (वर्ग-III, अराजपत्रित) भर्ती एवं प्रोन्नति नियम, 2007 में-

(क) उपाबन्ध-"क" में स्तम्भ संख्या 15-क (VII) (ख) एवं उपाबन्ध "ख" में क्रम संख्या 3 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

"संविदा नियुक्ति की सेवा विशुद्ध रूप से अस्थाई आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है तो नियुक्ति समाप्त किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति, नियुक्ति प्राधिकारी द्वारा जारी नियुक्ति समाप्त किए जाने के आदेशों से संतुष्ट नहीं है तो, वह समाप्ति आदेशों की प्रति प्राप्त होने की तिथि से 45 दिनाें के भीतर अपीलीय प्राधिकारी जोकि नियुक्ति प्राधिकारी से उच्चतर होगा, के समक्ष अपील कर सकता है।"

(ख) उपाबन्ध-"क" में स्तम्भ संख्या 15-क (VII) (च) एवं उपाबन्ध "ख" में क्रम संख्या 7 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

"चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी के मामले में मेडिकल बोर्ड द्वारा व अराजपत्रित कर्मचारी के मामले में सरकारी चिकित्सा अधिकारी द्वारा जारी आरोग्य प्रमाण पत्र प्रस्तुत करना होगा। महिला अभ्यर्थी के मामले में, जिन्हें संकटजनक प्रकृति के कर्तव्य वहन करने वाले पदाें पर नियुक्त किया जाना है, और यदि उन्हें सेवा की शर्त के अनुसार प्रशिक्षण की अवधि पूरी करनी है, ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या उससे अधिक समय की गर्भवती पाई जाती है, वह अस्थाई रूप से नियुक्ति के लिए अनुपयुक्त घोषित की जाएगी एवं उसकी नियुक्ति प्रसव होने तक, निलंबित रखी जाएगी। ऐसी महिला अभ्यर्थी का प्रसूति के छह सप्ताह उपरान्त, उपयुक्तता हेतु पुनः परीक्षण किया जाएगा व यदि वह उपरोक्त निर्दिष्ट प्राधिकारी द्वारा जारी आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है, उसे उसके लिए आरक्षित पद पर नियुक्ति दी जायेगी।

NOTIFICATION

No. Coop-A(3)-1/2014.—In exercise of the powers conferred by proviso to Article 309 of the constitution of India, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Co-operation Department Inspector/Inspector (Audit) Cooperative Societies Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2007 notified vide notification No. Coop-B(1)-2/99, dated 15-01-2008, namely:—

1. Short Title and Commencement.—These rules may be called the Himachal Pradesh Co-operation Department Inspector/Inspector (Audit) Cooperative Societies (Class-III, Non- Gazetted) Recruitment and Promotion (3rd Amendment) Rules, 2019.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure- "A" & Annexure-"B".—In Annexure-A and Annexure- B to the Himachal Pradesh Co-operation Department Inspector/Inspector (Audit) Cooperative Societies (Class-III, Non-Gazetted) Recruitment and Promotion Rules, 2007—

(a) For the existing provisions against Col. No. 15-A(VII)(b) of Annexure-"A" and Sl. No.

3 of Annexure-"B", the following shall be substituted, namely:—

"The Service of contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date on which a copy of termination orders is delivered to him/her."

(b) For the existing provisions against Col. No.15-A(VII)(f) of Annexure-"A" and Sl. No.

7 of Annexure-"B", the following shall be substituted, namely:—

"Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in the case of a Gazetted Government servant and by Government Medical Officer in the case of a Non-Gazetted Government servant. In case of women candidates who are to be appointed against posts carrying hazardous nature of duties, and in case they have to complete a period of training as a condition of service, such woman candidate, who as a result of tests is found to be pregnant of twelve weeks' standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such woman candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her."

No. EXN-F(10)-5/2019.—Whereas, clause (c) of sub-section (3) of Section 31 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereinafter referred to as the "said Act"), provides that a registered person supplying exempted goods or services or both or paying tax under the provisions of Section 10 shall issue, instead of a tax invoice, a bill of supply and therefore any person not covered by the said clause has to issue a tax invoice;

Now, therefore, in exercise of the powers conferred by Section 172 of the said Act, the State Government, on recommendations of the Council, hereby makes the following Order, to remove the difficulties, namely:—

1. Short title.—This order may be called the Himachal Pradesh Goods and Services Tax (Third Removal of Difficulties) Order, 2019.

2. For the removal of difficulties, it is hereby clarified that provisions of clause (c) of sub-section (3) of Section 31 of the said Act shall apply to a person paying tax under Notification No.2/2019- State Tax (Rate) dated 07-03-2019 published in the Gazette of Himachal Pradesh vide Number EXN-F(10)-5/2019 on 8th March, 2019.

उनवान मुकद्दमा.--दरख्वास्त जेर धारा 13(3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 के अन्तर्गत। इस कार्यालय में श्रीमती भन्तो पत्नी प्रकाश, गांव कुठेहड, डाकघर लिहल, उप-तहसील, धरवाला, जिला चम्बा, हिमाचल प्रदेश ने प्रार्थना-पत्र गुजार कर निवेदन किया है कि उसकी पुत्री रिंकी का जन्म 01-06-2014 को घर पर ही हुआ है परन्तु अज्ञानतावश उसका नाम व जन्म तिथि ग्राम पंचायत किलोड के जन्म रजिस्टर में आज तक पंजीकृत नहीं किया गया है तथा उसके नाम व जन्म तिथि को दर्ज करने के आदेश ग्राम पंचायत किलोड को दिये जावें।

श्री शशी पाल पुत्र मणि राम, वासी गांव सपौरी, तहसील अम्ब, जिला ऊना (हि0 प्र0) ने एक दरख्वास्त प्रस्तुत की है जिसमें उसने लिखा है कि उसकी शादी श्रीमती उषा कुमारी पुत्री श्री गुरदास राम, वासी गांव गढ़, तहसील देहरा, जिला कांगड़ा, हि0 प्र0 में दिनांक 19-10-2013 को हुई है का पंजीकरण किया जाकर उसे शादी प्रमाण-पत्र दिया जावे।

अतः इस नोटिस के माध्यम से समस्त जनता तथा सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को शादी पंजीकरण बारे कोई एतराज/आपत्ति हो तो वह दिनांक 22-03-2019 को प्रातः 10.00 बजे या उससे पहले असालतन या वकालतन हाजिर अदालत होकर अपनी स्थिति/एतराज प्रस्तुत कर सकता है। निश्चित तिथि पर कोई एतराज प्राप्त न होने की सूरत में प्रार्थी को शादी पंजीकरण प्रमाण-पत्र जारी कर दिया जायेगा। अतः बाद में कोई उजर काबिले समायत न होगा।
