संख्याः ई.एक्स.एन.-एफ(10)-5/2019.---हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) (जिसे इस अधिसूचना में इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 148 तथा धारा 168 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राज्यपाल, हिमाचल प्रदेश, परिषद्‌ की सिफारिशों पर ऐसे रजिस्ट्रीकृत व्यक्तियों को जिनका पूर्ववर्ती वित्तीय वर्ष या चालू वित्तीय वर्ष में 1.5 करोड़ रुपए तक संकलित 264-राजपत्र/2019-29-03-2019 (9583) ⁹⁵⁸⁴ राजपत्र, हिमाचल प्रदेश, 29 मार्च, 2019/8 चैत्र, 1941 आवर्त है, ऐसे रजिस्ट्रीकृत व्यक्तियों के वर्ग के रूप में अधिसूचित करते हैं, जो माल या सेवाओं या दोनों के जावक प्रदाय के ब्यौरे देने के लिए नीचे यथा वर्णित विशेष प्रक्रिया का अनुसरण करेंगे।

2. उक्त रजिस्ट्रीकृत व्यक्ति, माल या सेवाओं या दोनों के जावक प्रदाय के ब्यौरे, हिमाचल प्रदेश माल और सेवा कर नियम, 2017 के अधीन ऐसे प्ररू्ररूप जीएसटीआर-1 में देंगे, जो नीचे दी गई सारणी के स्तंभ (2) में यथाविनिर्दिष्ट तिमाही के दौरान उक्त सारणी के स्तंभ (3) में की तत्स्थानी प्रविष्टि में यथा विनिर्दिष्ट समयावधि तक प्रस्तुत करने हैं, अर्थात्‌ः--

Shimla-2, the 28th March, 2019

No. EXN-F(10)-5/2019.—In exercise of the powers conferred by section 148 and 168 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereafter in this notification referred to as the said Act), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to notify that the registered persons having aggregate turnover of up to 1.5 crore rupees in the preceding financial year or the current financial year, as the class of registered persons, who shall follow the special procedure as mentioned below for furnishing the details of outward supply of goods or services or both.

2. The said registered persons shall furnish the details of outward supply of goods or services or both in FORM GSTR-1 under the Himachal Pradesh Goods and Services Tax Rules, 2017, effected during the quarter as specified in column (2) of the Table below till the time period as specified in the corresponding entry in column (3) of the said Table, namely:—

3. The time limit for furnishing the details or return, as the case may be, under sub section (2) of section 38 and sub-section (1) of section 39 of the said Act, for the months of July, 2017 to June, 2019 shall be subsequently notified in the Official Gazette.

संख्याः ई.एक्स.एन.-एफ.(10)-5/2019.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) (जिसे इस अधिसूचना में इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 168 के साथ पठित धारा 37 की उपधारा (1) के दूसरे परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आयुक्त, परिषद की सिफारिशों पर रजिस्ट्रीकृत व्यक्तियों के ऐसे वर्ग के द्वारा, जिनका पूर्ववर्ती वित्तीय वर्ष या चालू वित्तीय वर्ष में संकलित आवर्त 1.5 करोड़ रूपयों से अधिक है, अप्रैल, 2019 से जून, 2019 तक प्रत्येक मास के लिए उस मास के उत्तरवर्ती मास के 11 वें दिन तक हिमाचल प्रदेश माल और सेवा कर नियम, 2017 के अधीन प्ररूप जीएसटीआर-1 में जावक प्रदायों के ब्यौरे देने की समय सीमा को विस्तारित करते हैं।

2. उक्त अधिनियम की धारा 38 की उपधारा (2) और धारा 39 की उपधारा (1) के अधीन जुलाई, 2017 से जून, 2019 मास के लिए यथास्थिति, ब्यौरे या विवरणी देने के लिए समय सीमा को तत्पश्चात्‌ राजपत्र में अधिसूचित किया जाएगा।

⁹⁵⁸⁶ राजपत्र, हिमाचल प्रदेश, 29 मार्च, 2019/8 चैत्र, 1941 No. EXN-F(10)-5/2019.—In exercise of the powers conferred by the second proviso to sub section (1) of section 37 read with section 168 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereafter in this notification referred to as the said Act), the Commissioner, on the recommendations of the Council, hereby extends the time limit for furnishing the details of outward supplies in FORM GSTR-1 under the Himachal Pradesh Goods and Services Tax Rules, 2017, by such class of registered persons having aggregate turnover of more than 1.5 crore rupees in the preceding financial year or the current financial year, for each of the months from April, 2019 to June, 2019 till the eleventh day of the month succeeding such month.

2. The time limit for furnishing the details or return, as the case may be, under subsection (2) of section 38 and sub-section (1) of section 39 of the said Act, for the months of July, 2017 to June, 2019 shall be subsequently notified in the Official Gazette.

संख्याः ई.एक्स.एन.-एफ.(10)-5/2019.--हिमाचल प्रदेश माल और सेवा कर नियम, 2017 (जिसे इस अधिसूचना में इसके पश्चात्‌ "उक्त नियम" कहा गया है) के नियम 61 के उप-नियम (5) के साथ पठित हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) (जिसे इस अधिसूचना में इसके पश्चात्‌ "उक्त अधिनियम" कहा गया है) की धारा 168 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आयुक्त, परिषद की सिफारिशों पर, एतद्‌द्वारा विनिर्दिष्ट करते हैं कि अप्रैल, 2019 से जून 2019 तक प्रत्येक मास के लिए उक्त नियम के प्ररूप जीएसटीआर-3ख में विवरणी ऐसे मास के उत्तरवर्ती मास के बीसवें दिन को या उससे पूर्व सामान्य पोर्टल के माध्यम से इलेक्ट्रॉनिक रूप से दी जाएगी।

2. प्ररूप जीएसटीआर-3ख के अनुसुसार कर दायित्व के निर्वहन के लिए कर का संदायः--उक्त नियमों के प्ररूप जीएसटीआर-3ख में विवरणी देने वाला प्रत्येक रजिस्ट्रीकृत व्यक्ति, उक्त अधिनियम की धारा 49 के उपबंधों के अध्यधीन, कर, ब्याज, शास्ति, फीस या उक्त अधिनियम के अधीन संदेय किसी अन्य रकम का प्रथम पैरा में यथाविनिर्दिष्ट अंतिम तारीख के अपश्चात्‌ जिसको उससे उक्त विवरणी अपेक्षित है, यथास्थिति, इलेक्ट्रॅानिक नकद खाते या इलेक्ट्रॉनिक जमा खाते में विकलन द्वारा अपने कर का उन्मोचन करेगा।

NOTIFICATION No. 13/2019-State Tax

No. EXN-F(10)-5/2019.—In exercise of the powers conferred by section 168 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereafter in this notification referred to as the said Act) read with sub-rule (5) of rule 61 of the Himachal Pradesh Goods and Services Tax Rules, 2017 (hereafter in this notification referred to as the said rules), the Commissioner, on the recommendations of the Council, hereby specifies that the return in FORM GSTR-3B of the said rules for each of the months from April, 2019 to June, 2019, shall be furnished electronically through the common portal, on or before the twentieth day of the month succeeding such month.

2. Payment of taxes for discharge of tax liability as per FORM GSTR-3B.—Every registered person furnishing the return in FORM GSTR-3B of the said rules shall, subject to the provisions of section 49 of the said Act, discharge his liability towards tax, interest, penalty, fees or any other amount payable under the said Act by debiting the electronic cash ledger or electronic credit ledger, as the case may be, not later than the last date, as specified in the first paragraph, on which he is required to furnish the said return.

संख्याः ई.एक्स.एन.-एफ.(10)-5/2019.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) (जिसे इस अधिसूचना में इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 10 की उपधारा (1) के परंतुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश, हिमाचल प्रदेश के राजपत्र में संख्याः ई.एक्स.एन.-एफ.(10)-14/2017-लूज द्वारा तारीख 30 जून, 2017 को प्रकाशित अधिसूचना संख्या 8/2017-राज्य कर, तारीख 30 जून, 2017 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया था या करने का लोप किया गया था, परिषद्‌ की सिफारिशों पर यह विनिर्दिष्ट करते हैं कि ऐसा कोई पात्र रजिस्ट्रीकृत व्यक्ति, जिसका पूर्ववर्ती वित्तीय वर्ष में संकलित आवर्त एक करोड़ पचास लाख रुपए से अधिक नहीं है, उक्त अधिनियम की धारा 9 की उपधारा (1) के अधीन उसके द्वारा संदेय कर के बदले में, हिमाचल प्रदेश माल और सेवा कर नियम, 2017 के नियम 7 के अधीन यथा विहित कर की रकम का विकल्प ले सकेगाः

परन्तु पूर्ववर्ती वित्तीय वर्ष में उक्त संकलित आवर्त निम्नलिखित किन्हीं राज्यों में, उक्त अधिनियम की धारा 25 के अधीन रजिस्ट्रीकृत, पात्र रजिस्ट्रीकृत व्यक्ति की दशा में पचहत्तर लाख रुपए होगा, अर्थात्‌ः- (i) अरूणाचल प्रदेश,

(ii) मणिपुर

(iii) मेघालय,⁹⁵⁸⁸ राजपत्र, हिमाचल प्रदेश, 29 मार्च, 2019/8 चैत्र, 1941 (iv) मिजोरम, (v) नागालैंड,

(vi) सिक्किम,

(vii) त्रिपुरा,

(viii) उत्तराखंडः

परन्तु यह और कि रजिस्ट्रीकृत व्यक्ति, उक्त अधिनियम, की धारा 10 की उपधारा (1) के अधीन संयुक्त उदग्रहण का विकल्प लेने के लिए पात्र नहीं होगा, यदि ऐसा व्यक्ति ऐसे माल का विनिर्माता है, जिसका विवरण नीचे की सारणी के स्तंभ (3) में विनिर्दिष्ट है और उक्त सारणी के स्तंभ (2) में की तत्स्थानी प्रविष्टि में यथाविनिर्दिष्ट, यथास्थिति, टैरिफ मद, उपशीर्ष, शीर्ष या अध्याय के अंतर्गत आता हैः--

स्पष्टीकरण.--

(i) इस सारणी में, "टैरिफ मद", "उपशीर्ष", "शीर्ष" और "अध्याय" से सीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की पहली अनुसूची में यथाविनिर्दिष्ट क्रमशः टैरिफ मद, उपशीर्ष, शीर्ष और अध्याय अभिप्रेत होगा।

(ii) उक्त सीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की पहली अनुसूची, जिसके अंतर्गत पहली अनुसूची के अनुभाग और अध्याय टिप्पण तथा साधारण स्पष्टीकारक टिप्पण भी हैं, के निर्वचन के लिए नियम, जहां तक हो सके, इस अधिसूचना के निर्वचन को लागू होंगे। 2. यह अधिसूचना 1 अप्रैल, 2019 को प्रवृत होगी।

NOTIFICATION No. 14/2019-State Tax

Shimla-2, the 28th March, 2019

No. EXN-F(10)-5/2019.—In exercise of the powers conferred under the proviso to sub- section (1) of section 10 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereinafter referred to as the said Act), and in supersession of the notification No. 8/2017- State Tax, dated the 30th June, 2017, published in the Gazette of Himachal Pradesh vide number EXN F(10)-14/2017-Loose, dated the 30th June, 2017, except as things done or omitted to be done before such supersession, the Governor of Himachal Pradesh, on the recommendations of the Council, hereby specifies that an eligible registered person, whose aggregate turnover in the preceding financial year did not exceed one crore and fifty lakh rupees, may opt to pay, in lieu of the tax payable by him under sub-section (1) of section 9 of the said Act, an amount of tax as prescribed under rule 7 of the Himachal Pradesh Goods and Services Tax Rules, 2017:

Provided that the said aggregate turnover in the preceding financial year shall be seventy- five lakh rupees in the case of an eligible registered person, registered under section 25 of the said Act, in any of the following States, namely: –

(i) Arunachal Pradesh

(ii) Manipur

(iii) Meghalaya

(iv) Mizoram

(v) Nagaland

(vi) Sikkim

(vii) Tripura

(viii) Uttarakhand:

Provided further that the registered person shall not be eligible to opt for composition levy under sub-section (1) of section 10 of the said Act if such person is a manufacturer of the goods, the description of which is specified in column (3) of the Table below and falling under the tariff item, sub-heading, heading or Chapter, as the case may be, as specified in the corresponding entry in column (2) of the said Table, namely:—

(i) In this Table, "tariff item", "sub-heading", "heading" and "chapter" shall mean respectively a tariff item, sub-heading, heading and chapters as specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975).

(ii) The rules for the interpretation of the First Schedule to the said Customs Tariff Act, 1975 (51 of 1975), including the Section and Chapter Notes and the General Explanatory Notes of the First Schedule shall, so far as may be, apply to the interpretation of this notification.

2. This notification shall come into force on the 1st day of April, 2019.

हिमाचल प्रदेश विनियोग अधिनियम (निरसन) अधिनियम, 2019

कतिपय विनियोग अधिनियमों का निरसन करने के लिए अधिनियम।

भारत गणराज्य के सत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम.-इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विनियोग अधिनियम (निरसन) अधिनियम, 2019 है।

2. कतिपय विनियोग अधिनियमों का निरसन.-अनुसूची में विनिर्दिष्ट विनियोग अधिनियमों का एतद्‌द्वारा निरसन किया जाता है।

3. व्यावृत्तियां.-इस अधिनियम द्वारा किसी भी अधिनियमिति,-

(क) का निरसन किसी अन्य ऐसी अधिनियमितियों को प्रभावित नहीं करेगा जिसमें निरसित अधिनियमिति को लागू , सम्मिलित या निर्दिष्ट किया गया है; या

(ख) के निरसन से पहले की गई या हुई किसी बात या पहले से अर्जित या उपगत किसी अधिकार, हक, बाध्यता या दायित्व अथवा उसके विषय में किसी उपचार या कार्यवाही या किसी ऋण, शास्ति, बाध्यता, दायित्व, दावे या मांग से कोई निर्माेचन या उन्मोचन या पहले ही अनुदत्त किसी क्षतिपूर्ति या किसी पूर्व कार्य या बात के सबूत की विधिमान्यता, अविधिमान्यता, उसके प्रभाव या परिणामों पर प्रभाव नहीं पड़ेगा; या

(ग) के निरसन का प्रभाव विधि के किसी सिद्धान्त या नियम या स्थापित अधिकारिता, अभिवचन के प्ररूप या अनुक्रम, पद्धति या प्रक्रिया या विद्यमान विशेषाधिकार, निर्बन्धन, छूट, पद या नियुक्ति पर नहीं पड़ेगा, भले ही वह, यथास्थिति, इसके द्वारा निरसित किसी अधिनियमिति द्वारा उसमें या उससे किसी रीति से पुष्ट, मान्य या व्युतपन्न क्यों न हो; या

(घ) के निरसन का प्रभाव संपरीक्षा, परीक्षण, लेखा, अन्वेषण, जांच या उससे सम्बन्धित किसी प्राधिकारी द्वारा की गई या की जाने वाली किसी अन्य कार्रवाई पर नहीं पड़ेगा और ऐसी संपरीक्षा, परीक्षण, लेखा, अन्वेषण, जांच या कार्रवाई की जा सकती है, और, या जारी रखी जा सकती है, मानो उक्त अधिनियमितियां इस अधिनियम द्वारा निरसित ही न की गई हों।

THE HIMACHAL PRADESH APPROPRIATION ACTS (REPEAL) ACT, 2019

to repeal certain Appropriation Acts.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventieth Year of the Republic of India as follows: —

1. Short title.—This Act may be called the Himachal Pradesh Appropriation Acts (Repeal) Act, 2019.

2. Repeal of certain Appropriation Acts.—The Appropriation Acts specified in THE SCHEDULE are hereby repealed.

3. Savings.—The repeal by this Act of any enactment shall not,—

(a) affect any other enactment in which the repealed enactment has been applied, incorporated or referred to; or

(b) affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing; or

;माननीय राज्यपाल महोदय द्वारा तारीख 26 मार्च, 2019 को यथाअनुमोदितद्ध

वित्तीय वर्ष 2019-2020 के लिए हिमाचल प्रदेश राज्य की संचित निध् ि में से सेवाओं के लिए कतिपय धनराशियों के संदाय को प्राध्कृित करने और उनका विनियोग करने के लिए अध्निियम।

भारत गणराज्य के सत्तरवें वर्ष में हिमाचल प्रदेश विधन सभा द्वारा निम्नलिखित रूप में यह अध्निियमित हो :-

1 . सक्षिप्त नाम और प्रारम्भ.-;1द्ध इस अध्निियम का सक्षिप्त नाम हिमाचल प्रदेश विनियोग ;संख्यांक 2द्ध अध्निियम, 2019 है ।

;2द्ध यह प्रथम अप्रैल, 2019 को लागू होगा ।

2. हिमाचल प्रदेश राज्य की संचित निध् ि में से वित्तीय वर्ष 2019-2020 के लिए `4,69,71,11,98,000 की राशि जारी करना.-हिमाचल प्रदेश राज्य की संचित निध् ि में से अनुसूची के तृतीय स्तम्भ में विनिर्दिष्ट से अनध्कि ध्नराशियां, जिनका योग केवल ` 4,69,71,11,98,000 ;छियालीस हजार नौ सौ इकहत्तर करोड़, ग्यारह लाख और अठानवे हजार रुपएद्ध है, संदत्त और उपयोजित की जाएं, जिनका वित्तीय वर्ष 2019-2020 की अवध् िमें अनुसूची के द्वितीय स्तम्भ में विनिर्दिष्ट सेवाओं और प्रयोजनों से सम्बन्ध्ति विभिन्न प्रभारों के संदाय को चुकाने के लिए उपयोग किया जाएगा ।

3. विनियोग.—इस अध्निियम द्वारा हिमाचल प्रदेश राज्य की संचित निध् िमें से संदत्त और उपयोजित करने के लिए प्राध्कृित ध्नराशियों का उक्त वर्ष के सम्बन्ध् में अनुसूची में अभिव्यक्त सेवाओं और प्रयोजनों के लिए विनियोग किया जाएगा।

THE HIMACHAL PRADESH APPROPRIATION (NUMBER 2) ACT, 2019

(AS ASSENTED TO BY THE HON'BLE GOVERNOR ON 26TH MARCH, 2019)

AN

ACT

to authorise payment and appropriation of certain sums from and out of the Consolidated

Fund of the State of Himachal Pradesh for the services for the financial year 2019-2020.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventieth Year of the Republic of India as follows:—

1. Short title and commencement.—(1) This Act may be called the Himachal Pradesh Appropriation (Number 2) Act, 2019.

(2) It shall come into force on the first day of April, 2019.

2. Issue of a sum of `4,69,71,11,98,000 out of the Consolidated Fund of the State of Himachal Pradesh for the financial year 2019-2020.—From and out of the Consolidated Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those specified in column (3) of THE SCHEDULE amounting in the aggregate to a sum of ` 4,69,71,11,98,000 (Rupees forty six thousand nine hundred seventy one crore, eleven lakh and ninety eight thousand) only towards defraying the several charges which will come in course of payment during the financial year 2019-2020 in respect of the services and purposes specified in column (2) of THE SCHEDULE.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be appropriated for the services and purposes expressed in THE SCHEDULE in relation to the said year.

4. Repeal and Savings.—The Himachal Pradesh Appropriation (No. 2) Act, 2018 (Act No. 2 of 2018) is hereby repealed:

Provided that such repeal shall not,—

(a) affect, any other enactment in which the repealed enactment has been applied, incorporated or referred to; or

(b) affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or indemnity already granted, or the proof of any past act or thing; or

(c) affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognized or derived by, in or from any enactment thereby repealed; or9609 राजपत्र, हिमाचल प्रदेश, 29 मार्च, 2019/8 चैत्र, 1941 (d) affect the audit, examination, accounting, investigation, inquiry or any other action taken or to be taken in relation thereto by any authority and such audit, examination, accounting, investigation, inquiry or action could be taken, and, or continued as if the said enactments are not repealed by this Act.
