Shimla, the 31st May, 2019

No. HIM/TP/PJT/AZR-Solan/2011/Vol-I/2248-68.—In exercise of the powers vested under sub-section (1) of section 19 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the amendments are proposed to be carried out in Development Plan 51-राजपत्र/2019-04-06-2019 (2481) 2482 राजपत्र, हिमाचल प्रदेश, 04 जून, 2019/14 ज्येष्ठ, 1941 for Solan Planning Area notified vide Notification No. TCP-F(5)-9/2004 dated 27-12-2004, as per Annexure-A, which are hereby published and Notice is given that a copy of the said proposed amendments is available for inspection during the office hours in the following offices:—

1. The Director,

Town and Country Planning Department, Block No. 32-A, SDA Complex, Kasumpati, Shimla, Himachal Pradesh-171 009.

2. The Town and Country Planner,

Divisional Town Planning Office, Solan, Himachal Pradesh.

If any person, likely to be affected by the provisions of the aforesaid proposed amendments has any objection or suggestion with respect to the provisions of the aforesaid proposed amendments, he may send the same in writing to the Director, Town and Country Planning Department, Block No. 32-A, SDA Complex, Kasumpati, Shimla, Himachal Pradesh-171 009 or the Town and Country Planner, Divisional Town Planning Office, Solan, Himachal Pradesh or the Executive Officer, Municipal Council, Solan, Himachal Pradesh within a period of 30 days from the date of publication of this Notice in the Official Gazette of Himachal Pradesh.

Objections or suggestions, if any, received within the period as specified above, shall be taken into consideration before finalizing the provisions of the aforesaid proposed amendments.

ANNEXURE-A

AMENDMENTS IN CHAPTER-11

In Chapter-11, titled Zoning and Sub-Division Regulations of the Development Plan for Solan Planning Area following amendments are proposed to be carry out namely:—

1. Regulation (vi) of 11.3 General Regulations shall be substituted, namely:—

"In the public interest and in the interest of town design or any other material consideration the Director may relax minimum size/area of plot, plot coverage, set backs, and floor area ratio (F.A.R.) etc. as well as change of land use."

2. Regulation (xix) of 11.3 General Regulations shall be substituted, namely:—

"Height of plinth level shall be 2.00 metres. Minor adjustments can be permitted keeping in view technical requirements of site." 2483 राजपत्र, हिमाचल प्रदेश, 04 जून, 2019/14 ज्येष्ठ, 1941

3. Regulation (xxv) of 11.3 General Regulations shall be substituted, namely:—

"One parking floor shall be mandatory wherever feasible. Maximum height of parking floor shall be 3.00 mtrs for all uses. Shear was shall be constructed on all the 3 sides of parking floor, so that it does not become a soft storey. Parking floor shall be exempted from floor area ratio (FAR), subject to the height of building restriction and structure stability. Fee for parking floor shall have to be payable in all cases. A toilet shall be permissible in parking floor."

4. Regulation (xxviii) of 11.3 General Regulations shall be substituted, namely:—

"Sloping roofs with slates/C.G.I. sheets/RCC slab with tile topping painted in maroon or green colour. Height of sloping roof zero at eaves and maximum 2.75 mtr at centre shall be maintained. The Dormer at suitable distance on either side of the roof shall be permissible in proportionate to equal width of Dormer and equal distance of Dormer to Dormer, subject to the condition that the ridge of Dormer shall be below the ridge line of main roof."

5. Regulation (v) of clause 2 of 11.3 General Regulations shall be substituted, namely:—

"The minimum width of path/road abutting one side of plot shall be 3.00 mtrs. In case of dead ends cul-de-sacs shall be provided. Every plot should abut with a path having 3.00 mtrs. width. Minimum width of path/road to smaller cluster of plots not exceeding 5 in number shall be 3.00 mtrs. Minimum width of vehicular access, if number of plots are above 5 and upto 20 plots shall be 5.00mtrs. Minimum width of vehicular access, if number of plots are above 20 shall be 7.00 mtrs."

6. In SEMI BUILT UP AREA of 11.5 zoning regulation after word exceed of the second last line of the para number and word "2.30 M" shall be substituted with "3.00 M" .

7. Regulation (iv) in OTHER AREA of 11.5 zoning regulation shall be substituted, namely:—

"One parking floor shall be mandatory wherever feasible. Maximum height of parking floor shall be 3.00 mtrs. for all uses. Shear was shall be constructed on all the 3 sides of parking floor, so that it does not become a soft storey. In case, space as per requirement for parking is available in open, over and above the setbacks, condition of parking floor shall not be insisted. However, parking floor shall be exempted from floor area ratio (FAR), subject to the height of building."

Annexure-A

AMENDMENTS IN CHAPTER-14

In Chapter-14, titled Zoning Regulations of the Development Plan for Dharamshala Planning Area following amendments are proposed to be carried out namely:—

1. In Table 14-2 Zoning Matrix at serial number 1 after Group Housing line new line shall be inserted in matrix table , namely.

2. In Table 14-2 Zoning Matrix at serial number 2 after Cinema/ Multiplex line new line shall be inserted in matrix table , namely.

3. Regulation iii of General Regulations 14.10 fourth new point shall be inserted, namely "For path more than 5.00 M. = 21.00 Metres"

4. Regulation viii of General Regulations 14.10 the words "except private land proposed under these uses" shall be inserted in the second line after the word, "recreation".

5. Regulation xvi of General Regulations 14.10 shall be substituted namely:— "In case of Smaller size of plots relaxation in set backs shall be given by Competent Authority in order to achieve minimum 5.00 m buildable width".

6. Regulation xxii of General Regulations 14.10 shall be substituted, namely:— "In open area of permissible set backs (other than controlled width) small temple, porch, garage, swimming pools, septic tanks, would be permissible"

7. Bullet 7 of Regulation xxx of General Regulations 14.10 shall be substituted, namely:—

"Fire Staircase(s)/Exists".

8. Bullet 8 of Regulation xxx of General Regulations 14.10 shall be substituted, namely:—

"Service floor wherever proposed for installation of plumbing and other services and to maintain the hygiene of habitable area in case of Commercial/Shipping complex and Tourism unit. Service floor, wherever proposed shall have height restriction of 2.10 m. and this floor shall not be counted in the FAR. However, the overall height restriction of building will remain applicable as permissible".

9. New Regulation (xlviii) of 14.10 General Regulations shall be inserted, namely:—

"In organized projects, the provision to use 10% area of the Parking Floor for the purpose of reception/conveniences in the Tourism Unit/Hotel/Guest house shall be considered subject to the condition that :—

(i) The area under reception/conveniences does not exceed 10% of the area under parking floor.

(ii) Parking provision as per the Development Plan remains intact."

10. In Regulation 14.12.1 of Residential Zone the word "Maximum" in clause i of the Notes shall be substituted with "Minimum".

11. In Regulation 14.12.2 of Commercial Zone the foot note shall be substituted, namely:—

"*Note. The Maximum height of building further be dictated by Regulation iii of General Regulations 14.10 respectively".

12. In Regulation 14.12.2 of Commercial Zone the word "Maximum" in clause 4 of the regulations of Hotels/Guest Houses shall be substituted with "Minimum".

संख्याः टीपीटी-एफ (9)-1/2001-1.--हिमाचल प्रदेश यात्री अनुग्रहपूर्वक अनुदान (प्रथम संशोधन) प्रारूप स्कीम, 2018 को हिमाचल प्रदेश मोटरयान कराधान अधिनियम, 1992 की धारा 21 के अधीन यथा अपेक्षित के अनुसार तद्‌द्वारा संभाव्य प्रभावित होने वाले व्यक्ति(यों) से अधिसूचना के प्रकाशन की तारीख से 15 2487 राजपत्र, हिमाचल प्रदेश, 04 जून, 2019/14 ज्येष्ठ, 1941

(पंद्रह) दिन की अवधि के भीतर आक्षेप और सुझाव आमंत्रित करने के लिए राजपत्र, हिमाचल प्रदेश में तारीख 18-9-2018 को प्रकाशित किया गया था;

उक्त प्रारूप स्कीम के सम्बन्ध में जन साधारण से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं। अतः, हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश मोटरयान कराधान अधिनियम, 1972 (1972 का अधिनियम संख्यांक 4) की धारा 21 के साथ पठित धारा 3ख की उप-धारा (2) द्वारा प्रदा शक्तियों का प्रयोग करते हुए इस विभाग की अधिसूचना संख्याः टीपीटी-एफ (9)-1/2001 तारीख 31दिसम्बर, 2004 द्वारा अधिसूचित हिमाचल प्रदेश यात्री अनुग्रहपूर्वक अनुदान स्कीम, 2004 का और संशोधन करने के लिए निम्नलिखित स्कीम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम.--इस स्कीम का संक्षिप्त नाम हिमाचल प्रदेश यात्री अनुग्रहपूर्वक अनुदान (प्रथम संशोधन) स्कीम, 2019 है।

2. पैरा 7 का प्रतिस्थापन.--हिमाचल प्रदेश यात्री अनुग्रहपूर्वक अनुदान स्कीम, 2004 के पैरा 7 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"किसी यात्री की मृत्यु की दशा में, अनुग्रहपूर्वक अनुदान की रकम ऐसी होगी जैसी सरकार द्वारा समय-समय पर निर्धारित की जाए।"।

No. TPT-F (9)-1/2001-I.—WHEREAS the draft Himachal Pradesh Passenger Ex-Gratia Grant (1st amendment) Scheme, 2018 was published in the Rajpatra, Himachal Pradesh dated 18-09-2018 for inviting objection(s) and suggestion(s) from person(s) likely to be affected thereby, within a period of fifteen (15) days from the date of publication, as required under section 21 of the Himachal Pradesh Motor Vehicles Taxation Act, 1972;

AND WHEREAS no objection(s) or suggestions(s) have been received from general public on the said draft Scheme.

NOW THEREFORE, in exercise of the powers conferred by sub-section (2) of section 3B read with section 21 of the Himachal Pradesh Motor Vehicles Taxation Act, 1972 (Act No. 4 of 1972), the Governor of Himachal Pradesh is pleased to make the following scheme, further to amend the Himachal Pradesh Passenger Ex-gratia Grant Scheme, 2004 notified vide this Department notification No. TPT-F (9)1/2001, dated 31st December, 2004, namely:—

1. Short title.— This scheme may be called The Himachal Pradesh Passenger Ex-Gratia Grant (1st Amendment) Scheme, 2019.

No. FFE-A(B)2-17/2015-II.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Forest Department, Himachal Pradesh Forest Service (HPFS) (Assistant Conservator of Forests), Class-I (Gazetted) Recruitment and Promotion Rules, 2016 notified vide this Department Notification No. FFE-A(B)2-17/2015 dated 22nd November, 2016, namely:—

1. Short title and commencement.— (1) These rules may be called the Himachal Pradesh, Forest Department, Himachal Pradesh Forest Service (HPFS) (Assistant Conservator of Forests), Class-I (Gazetted) Recruitment and Promotion (Second Amendment), Rules 2018.

(2) These rules shall come into force from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Appendix-"A".—In Appendix-"A" appended to the Himachal Pradesh, Forest Department, Himachal Pradesh Forest Service (HPFS) (Assistant Conservator of Forests), Class-I (Gazetted) Recruitment and Promotion Rules, 2016, below clause 1(c) the following note shall be added, namely:—

उतमेश कुमार पुत्र श्री दितू राम, गांव कुट, महाल दुलाहर, डा0 मसरुंड, उप-तहसील पुखरी, जिला चम्बा, हिमाचल प्रदेश ने इस अदालत में आवेदन-पत्र व ब्यान हल्फी पेश किया है कि मेरी बेटी का नाम आधार कार्ड, परिवार रजिस्टर व शिक्षा प्रमाण-पत्र में नन्दनी कुमारी दर्ज है जो सही व दुरुस्त है परन्तु 2492 राजपत्र, हिमाचल प्रदेश, 04 जून, 2019/14 ज्येष्ठ, 1941 पटवार वृत्त दुलाहर के राजस्व अभिलेख में मेरी बेटी का नाम कुमारी चीन्की दर्ज हुआ है जो कि गलत है तथा आवेदन किया है कि मेरी बेटी का नाम पटवार वृत्त दुलाहर के महाल दुलाहर के राजस्व अभिलेख में कुमारी चीन्की उर्फ नन्दनी कुमारी दर्ज करने के आदेश जारी किये जायें।

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि कुमारी चीन्की उर्फ नन्दनी कुमारी का नाम पटवार वृत्त दुलाहर के राजस्व अभिलेख में दरूस्त किया जाना है। इस बारा में आम जनता को कोई आपत्ति हो तो इस इश्तहार के प्रकाशन की तिथि से एक माह के भीतर इस सम्बन्ध में अपना उजर एवं एतराज पेश कर सकते हैं। इसके पश्चात्‌ कोई भी उजर एतराज मान्य न होगा तथा उपरोक्त कुमारी चीन्की उर्फ नन्दनी कुमारी पुत्र श्री दितु राम, गांव कुट का नाम दरूस्त करने के आदेश पारित कर दिये जायेंगे। यह इश्तहार हमारे हस्ताक्षर व मोहर अदालत से आज दिनांक 17-05-2019 को जारी हुआ। मोहर।

मोहिन्द्र सिंह पुत्र श्री नाथो राम, गांव व डाकघर राजनगर, उप-तहसील पुखरी, जिला चम्बा, हिमाचल प्रदेश ने इस अदालत में आवेदन-पत्र व ब्यान हल्फी पेश किया है कि मेरा नाम परिवार रजिस्टर नकल, आधार कार्ड, व शिक्षा प्रमाण-पत्र में मोहिन्द्र सिंह दर्ज है जो बिल्कुल सही व दुरुस्त है परन्तु राजस्व अभिलेख पटवार वृत्त राजनगर में प्रार्थी का नाम भिन्द्र दर्ज है जो कि गलत है। प्रार्थी इस न्यायालय के माध्यम से अपना नाम राजस्व अभिलेख पटवार वृत्त राजनगर में भिन्द्र उर्फ मोहिन्द्र सिंह दर्ज करने के आदेश क्षेत्रीय कानुनगो राजनगर को जारी करवाना चाहता है।

अतः प्रार्थी का ब्यान हल्फी स्वीकार करते हुए इस इश्तहार राजपत्र द्वारा आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को प्रार्थी का नाम पटवार वृत्त राजनगर में दर्ज करने हेतु किसी प्रकार का कोई उजर एवं एतराज हो तो वह असालतन या वकालतन इस इश्तहार के प्रकाशन की तिथि उपरान्त एक माह के भीतर अपना उजर एवं एतराज पेश कर सकते हैं। बाद तारीख किसी किस्म का उजर एवं एतराज नहीं सुना जाएगा व उक्त प्रार्थी का नाम राजस्व अभिलेख पटवार वृत्त राजनगर में भिन्द्र उर्फ मोहिन्द्र सिंह दर्ज करने के आदेश पारित कर दिये जायेंगे।
