No. Ind-A(F)4-1/2019.—In supersession of this Department Notification No. Ind. A(F) 19-6/2013 dated 03-06-2015, the Governor of Himachal Pradesh is pleased to re-constitute a State 88-राजपत्र/2019-23-07-2019 (3929)3930 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2019/01 श्रावण, 1941 Level Single Window Clearance & Monitoring Authority consisting of the following Members with immediate effect:—

2. Besides, the following shall be Special Invitees to the Authority as and when required, when a specific item of their interest comes up for discussion:—

3. The Terms of Reference of the above Authority will be as under:—

(i) To act as the Apex Body for channelizing, facilitating and guiding investment in Investible Projects of all Sectors i.e. projects exceeding investment of Rs. 5.00 (Five) Crore or above in Plant & Machinery/equipments/buildings/technical civil works or as may be notified by the State Government from time to time, proposed to be set up in a transparent, objective and time bound manner.

(ii) To discuss and solve all contentious and inter departmental issues, monitor and review the progress of such units already approved, being set up and expedite approvals (administrative and statutory) by each concerned Department necessary for the establishment of such units in the State.

➢ Proposals received for setting up of Investible Projects or their expansion as defined above.

➢ Proposals received which are listed as Negative Industries by the State Government under its applicable Industrial Policy as notified from time to time.

➢ Forest produce based industry.

(iv) The State Level Single Window Clearance and Monitoring Authority shall examine the applications for giving clearances, special concessions, exemptions or relaxations under the provisions of law, after taking into consideration the comments of the Department, if any, and make the recommendations to the Government.

(v) Such other matters as the Govt. may refer or delegate to the Authority from time to time.

4. For speedy disposal of the cases, the following procedure for clearance of proposals by the State Level Single Window Clearance & Monitoring Authority for setting up of investible project in the State within 45 working days is laid, subject to the following conditions:—

(i) All applicants shall apply through online on Common Application Form (CAF) alongwith Detailed Project Report to Director of Industries.

(ii) All e-applications of Industrial Projects, complete in all respects, received by the State Single Window Nodal Officer will be initially examined by him and thereafter be forwarded electronically to the Departmental Nodal Officer of concerned Regulatory Department i.e. HPSEBL, HPPCB, I&PH, Forest, Excise & Taxation, Labour & Employment etc. The concerned Departments will furnish necessary clearance/preregulatory establishment approvals/comments within 7 working days from the date of its circulation.

(iii) All e-applications of other Sectors will be submitted to concerned Department for further processing and obtaining comments/approval of regulatory departments. The concerned Departments will furnish necessary clearance/pre-regulatory establishment approvals/comments within 7 working days from the date of its circulation. After obtaining comments/approval, the concerned Departmental Nodal Officer will send the proposals to the State Single Window Nodal Officer for placing the same before the State Level Single Window Clearance & Monitoring Authority.

(iv) After receipt of comments/pre-setting approval from the concerned Departments, the Sub-Committee under the Chairmanship of the Director/Commissioner Industries and consisting of the Director, Town & Country Planning, H.P., Engineer-in-Chief (IPH), Chief Engineer(Commercial), HPSEBL, Member Secretary, H.P. State Pollution Control Board and other concerned Head of3932 राजपत्र, हिमाचल प्रदेश, 23 जुलाई, 2019/01 श्रावण, 1941 Departments as Members will examine and to recommend the proposals to the SLSWC&MA alongwith comments received from various Departments for final clearance/decision within the stipulated time of 15 days.

(v) Even, if no comments are received from the concerned Departments within stipulated period the proposal will be included in the agenda of the State Level Single Window Clearance & Monitoring Authority and the Department concerned will explain their position before the Authority, which will decide the case accordingly.

TRANSPORT DEPARTMENT

No. TPT-F(9)-3/2016-III.—The Governor of Himachal Pradesh is pleased to create/set up the Lead Agency/Road Safety Cell in the directorate of Transport to be headed by the Director/ Commissioner of Transport, Himachal Pradesh. The functions of the Lead Agency/Road Safety Cell shall be as follow:—

(i) To work as a secretariat for the State Road Safety Council, arrange meetings of the Council issue it's Minutes and monitor the implementation of the decisions of the Council by the concerned Department of the State.

(ii) To co-ordinate with the concerned Departments of the State Govt. to ensure implementation of the directions issued from time to time by Supreme Court Committee on Road Safety and furnish Compliance Report in a time bound manner.

(iii) To ensure implementation of the directions given by the Central/State Govt. from time to time.

(iv) To notify annual targets for reduction of accidents and fatalities as fixed by the State and draw up an Annual Action Plan to achieve the targets and monitor its implementation.

(v) To collate on a regular basis data on road accidents and analyse the data to identify areas/road stretches and categories of accident victims who should be focused upon.

(vi) To manage the Road Safety Fund and ensure that the Fund is effectively utilized.

(vii) Any other task related to road safety assigned by the Government from time-to-time.

2. The Governor, Himachal Pradesh is further pleased to create the following posts of various categories in the Lead Agency/Road Safety Cell, with immediate effect, in public interest:—

Resultant vacancy in respective department of the officers joining Lead Agency/Road Safety Cell on secondment basis can be filled up in relaxation of the instructions of the Finance (Regulations) Department No. Fin(C)B(12)4/96 dated 3rd December, 2002 as per the approval accorded by the Cabinet.

4. This issue with the prior approval of the Cabinet and concurrence of Finance Department obtained vide their UO. 54662461-Fin-E/2019, dated 02-05-2019.

स्ांख्या टी0एस0एम0-ए(3)-3/2018.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) की धारा 64 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या टी0एस0एम0-ए(3)-1/2008, तारीख 17-8-2012 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 22-8-2012 को प्रकाशित हिमाचल प्रदेश पर्यटन विकास और पर्यटन व्यवसाय रजिस्ट्रीकरण नियम, 2012 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और उन्हें जनसाधारण की सूचना के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

इन नियमों से संभाव्यतः प्रभावित होने वाले किसी व्यक्ति के यदि इन नियमों की बाबत कोई आक्षेप/ सुझाव हैं तो वह उन्हें, उक्त प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर अतिरिक्त मुख्य सचिव (पर्यटन और नागरिक उड्‌डयन) हिमाचल प्रदेश सरकार और निदेशक, पर्यटन और नागरिक उड्‌डयन, हिमाचल प्रदेश, शिमला-9 को भेज सकेगा।

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप(पों) या सुझाव(वों), यदि कोई हैं पर राज्य सरकार द्वारा इन नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ :-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पर्यटन विकास और पर्यटन व्यवसाय रजिस्ट्रीकरण (संशोधन) नियम, 2019 है।

2. नियम 13 का संशोधन.--हिमाचल प्रदेश पर्यटन विकास और पर्यटन व्यवसाय रजिस्ट्रीकरण नियम, 2012 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 13 में खण्ड (ङ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा; अर्थात्‌ः-

''(ङ) आगमन समय (चैक इन टाईम) 2.00 बजे और प्रस्थान समय (चैक आउट टाईम) 12.00 बजे'' 3. नियम 21 का संशोधन.--उक्त नियमोें के नियम 21 में खण्ड (क), (ख) और (ग) के स्थान पर निम्नलिखित खण्ड रखे जाएंगे; अर्थात्‌ :-

(क) पहुंचने (आगमन) की तारीख और समय से अग्रिम रकम का दस प्रतिशत 15 दिन के भीतर रद्‌दकरण।

(ख) पहुंचने (आगमन) की तारीख और समय से अग्रिम रकम का पच्चीस प्रतिशत 7 दिन के भीतर रद्‌दकरण।

(ग) पहुंचने (आगमन) की तारीख और समय से अग्रिम रकम का पचास प्रतिशत 48 घण्टों के भीतर रद्‌दकरण।

(घ) पहुंचने (आगमन) की तारीख और समय से अग्रिम रकम का साठ प्रतिशत 24 घण्टों के भीतर रद्‌दकरण।

TOURISM AND CIVIL AVIATION DEPARTMENT

NOTIFICATION

Shimla-2, the 12th July, 2019

No. TSM-A (3)-3/2018.—In exercise of the powers conferred by section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Tourism Development and Registration of Tourism Trade Rules, 2012 notified vide this department Notification No. TSM-A(3)-1/2008, dated 17-08-2012 and published in the Rajpatra, Himachal Pradesh on dated 22-08-2012, and the same are hereby published in the Rajpatra (e-gazette) Himachal Pradesh for the information of general public;

If any person, likely to be affected by these rules has any objection(s)/suggestion(s) with regard to these rules, he may send the same to the Additional Chief Secretary (Tourism and Civil Aviation) to the Government of Himachal Pradesh and the Director, Tourism and Civil Aviation, Himachal Pradesh, Shimla-9 within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-gazette) Himachal Pradesh;

The objection(s) or suggestion(s), if any, received within the period specified above shall be taken into consideration by the State Government, before finalizing these rules, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Tourism Development and Registration of Tourism Trade (Amendment) Rules, 2019.

2. Amendment of rule 13.—In rule 13 of the Himachal Pradesh Tourism Development and Registration of Tourism Trade Rules, 2012 (hereinafter referred to as the said rules) for clause (e) the following clause shall be substituted, namely:—

"(e) Check- in time 14.00 hours and checkout time 12.00 hours".

3. Amendment of rule 21.—In rule 21 of said rules, for clause (a), (b) and (c), the following clauses shall be substituted, namely:—

(a) Cancellation within 15 days 10% of the advance amount from the date and

time of arrival.

(b) Cancellation within 07 days 25% of the advance amount from the date and

time of arrival.

(c) Cancellation within 48 hours 50% of the advance amount from the date and

time of arrival.

(d) Cancellation within 24 hours 60% of the advance amount from the date and

time of arrival.

उपरोक्त मुकद्दमा बारे प्रार्थी ने इस न्यायालय में प्रार्थना-पत्र गुजारा है जिसमें लिखा है कि उसका सही नाम गोपाल पुत्र श्री रोशन लाल है जबकि उप-महाल रायेंसरी उपरली के राजस्व अभिलेख में उसका नाम मेघ नाथ पुत्र रोशन लाल दर्ज है जो कि गलत इन्द्राज हुआ है प्रार्थी उक्त नाम को दुरुस्त करके मेघ नाथ उपनाम गोपाल पुत्र रोशन लाल दर्ज करवाना चाहता है।

अतः उक्त प्रार्थना-पत्र के सन्दर्भ में उपरोक्त नाम की दुरुस्ती बारे किसी को कोई उजर या एतराज हो तो वह असालतन या वकालतन इस न्यायालय में दिनांक 05-08-2019 को सुबह 10.00 बजे हाजिर आ सकता है हाजिर न आने की स्थिति में एकतरफा कार्यवाही अमल में लाई जाकर आगामी आदेश पारित कर दिये जाएंगे। इसके बाद कोई भी उजर या एतराज काबिले समायत न होगा।
