संख्या एफ0एफ0ई0-बी0-एफ0(14)-14/2019.--भारतीय वन अधिनियम, 1927 (1927 का अधिनियम संख्यांक 16) की धारा 29 की उप-धारा (3) के अधीन यथा अपेक्षित के अनुसार इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट वन भूमि या बंंजर भूमि में या उस पर सरकार तथा प्राइवेट व्यक्तियों के अधिकारों के स्वरूप और विस्तार की जांच कर ली गई है और उन्हें अभिलिखित कर लिया गया है;

100-राजपत्र/2019-06-08-2019 (4399) 4400 राजपत्र, हिमाचल प्रदेश, 06 अगस्त, 2019/15 श्रावण, 1941 और उक्त अनुसूची में दर्शित वन भूमि या बंजर भूमि, सरकार की सम्पत्ति है, या जिस पर सरकार के सांपत्तिक अधिकार हैं या सरकार उसकी वन उपज के सम्पूर्ण या किसी भाग की हकदार है;

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वाेक्त अधिनियम की धारा 29 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करते हैं कि उक्त अधिनियम के अध्याय-4 के उपबन्ध उक्त वन भूमि या बंजर भूमि को लागू होंगे और जो इसमें इसके पश्चात्‌ पूर्वाेक्त अधिनियम की धारा 29 की उप-धारा (2) के उपबन्धों के अधीन ''संरक्षित वन'' कहलाएगी।

Shimla-2, the 4th July, 2019

No. FFE-B-F-(14)-14/2019.—WHEREAS the nature and extent of the rights of the Government and of the Private Persons in or over the forest land or waste land specified in the SCHEDULE appended to this Notification have been enquired into and recorded, as required under sub-section (3) of section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

AND WHEREAS the forest land or waste land shown in the said SCHEDULE is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the forest produce therein;

NOW THEREFORE in exercise of the powers conferred by sub-section (1) of section-29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the said Act shall apply to the said forest land or waste land and shall hereafter be called as "protected forests" under the provisions of sub-section (2) of section-29 of the Act ibid.

प्रार्थी श्री राकेश कुमार पुत्र गुरवचन सिंह, वासी महाल वडवार, डाकघर अलोह, तहसील रक्कड़, जिला कांगड़ा (हि0प्र0) ने इस अदालत में प्रार्थना-पत्र दायर किया है कि उसके भाई महिन्द्र सिंह की मृत्यु दिनांक 18-04-2016 को महाल वडवार में हुई है लेकिन अनभिज्ञता के कारण ग्राम पंचायत के रिकार्ड में मृत्यु4413 राजपत्र, हिमाचल प्रदेश, 06 अगस्त, 2019/15 श्रावण, 1941 पंजीकरण नहीं करवाया जा सका, अब पंजीकरण करने के आदेश दे दिए जाएं। अतः ग्राम पंचायत पूनणी को उसका मृत्यु पंजीकरण करने के आदेश पारित हो। प्रार्थना-पत्र के समर्थन में शपथ-पत्र प्रार्थी, ग्राम पंचायत मृत्यु तिथि प्रमाण-पत्र, शपथ-पत्र गवाहान संलग्न है।

एक दरख्वास्त दरुस्ती इन्द्राज कब्जा काश्त बलवन्त सिंह पुत्र रणवीर सिंह, निवासी मान्दली, तहसील चढ़गांव, जिला शिमला, हि0 प्र0 ने इस अदालत में गुजारी है जिसके मुताबिक भूमि खाता खतौनी नं0 26 मिन, ता 69 मिन, मोहाल मान्दली खसरा नं0 221, 222 राजस्व कागजात में खाना काश्त में इलमदीन पुत्र नवीया का कब्जा दर्शाया गया है जबकि प्रार्थी का कहना है इलमदीन पुत्र नवीया की कई वर्ष पहले मृत्यु हो चुकी है। अपने दावे की पुष्टि हेतु प्रार्थी ने ग्राम पंचायत सुन्धा भौंडा की रिर्पोट संलग्न की है। ग्राम पंचायत सुन्धा के रिर्पोट के मुताबिक इलमदीन पुत्र नवीया की 02-04-1998 को मृत्यु हो चुकी है और उसका कोई जायज वारसान नहीं है। इसके अलावा प्रार्थी का कहना है कि उक्त भूमि में वह स्वयं अन्य हिस्सेदारों के साथ मालिक दर्ज है तथा कई वर्षों से मौका पर भी उक्त भूमि उनके कब्जे में है।

अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि इस बारे यदि किसी व्यक्ति या रिश्तेदार को कोई उजर व एतराज हो तो वह अपना एतराज दिनांक 25-08-2019 को प्रातः 10 बजे अदालत मेंं हाजिर आकर पेश कर सकता है। अन्यथा एकतरफा कार्यवाही अमल में लाई जा कर उपरोक्त भूमि में खाना काश्त से इलमदीन पुत्र नवीया के नाम को हटाने के आदेश पारित किए जायेंगे।
