2019 का विधेयक संख्यांक 16 हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन (संशोधन) विधेयक, 2019

हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 (1971 का अधिनियम संख्यांक 4) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के सत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. स्ांक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन (संशोधन) अधिनियम, 2019 है।

2. धारा 10-क का प्रतिस्थापन.--हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 की धारा 10-क के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

''10-क. रेलमार्ग द्वारा या वायुमार्ग द्वारा या टैक्सी द्वारा निःशुल्क यात्रा.-(1) अध्यक्ष या उपाध्यक्ष अपनी पदावधि के दौरान अपने कुटुम्ब के साथ या यात्रा के दौरान उसकी देखभाल और सहायता करने के लिए उसके साथ यात्रा करने वाले किसी व्यक्ति के साथ किसी भी समय किसी भी श्रेणी में रेलमार्ग द्वारा या वायु मार्ग द्वारा देश के भीतर या बाहर या टैक्सी द्वारा राज्य के बाहर और देश के भीतर यात्रा करने का हकदार होगा और वह प्रत्येक वित्तीय वर्ष में चार लाख रुपए की अधिकतम राशि के अध्यधीन, इस प्रकार उपगत वास्तविक व्यय की प्रतिपूर्ति का हकदार, ऐसी की गई यात्रा की टिकटों या बिलों के प्रस्तुत करने पर, होगाः

परन्तु टैक्सी द्वारा की गई यात्रा पर व्यय चार लाख रुपए की अधिकतम राशि के दस प्रतिशत से अधिक नहीं होगीः5439 राजपत्र, हिमाचल प्रदेश, 02 सितम्बर, 2019/11 भाद्रपद, 1941 परन्तु यह और कि किसी भी वित्तीय वर्ष में रेल मार्ग द्वारा या वायु मार्ग द्वारा या टैक्सी द्वारा की गई यात्रा के लिए संदेय कुल रकम चार लाख रुपए से अधिक नहीं होगी। स्पष्टीकरण.-इस उपधारा के प्रयोजन के लिए पद ''कुटुम्ब'' से पति-पत्नी, उनके अविवाहित दत्तक पुत्र और पुत्री सहित अविवाहित पुत्र और पुत्री (पुत्रियां) अभिप्रेत होगा/होगी।

(2) यथास्थिति, अध्यक्ष और उपाध्यक्ष के अनुरोध पर, ऐसी यात्रा करने के लिए पच्चीस हजार रुपए से अनधिक अग्रिम का हकदार होगा तथा ऐसा संदत्त अग्रिम वित्तीय वर्ष की समाप्ति से पूर्व समायोजित किया जाएगा, ऐसा न होने पर पूर्ण अग्रिम, उसके वेतन और भत्ते से एकमुश्त राशि में वसूल किया जाएगा। स्पष्टीकरण.-इस धारा के अधीन कुल रकम का अवधारण करने के लिए मंत्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (2000 का 11) की धारा 7 या हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेन्शन) अधिनियम, 1971 (1971 का 8) की धारा 6 के अधीन, उसी वित्तीय वर्ष मेें रेलमार्ग द्वारा या वायुमार्ग द्वारा या टैक्सी द्वारा की गई यात्रा में इस प्रकार उपगत की गई रकम को हिसाब में लिया जाएगा।''।

उद्‌देश्यों और कारणों का कथन

हिमाचल प्रदेश विधान सभा की सुख-सुविधा समिति ने राज्य से बाहर और देश के भीतर टैक्सी द्वारा यात्रा का प्रावधान करने सहित विधान सभा के सदस्यों के मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए विद्यमान सीमा में बढ़ौतरी करने की सिफारिश की है। उक्त समिति द्वारा की गई सिफारिशों को सम्यक्‌ रूप से स्वीकार कर लिया गया है। अतः सदस्यों, अध्यक्ष और उपाध्यक्ष के बीच एकरूपता बनाए रखने के लिए और हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 के उपबन्धों को भी हिमाचल प्रदेश विधान सभा (सदस्यों के भो और पेन्शन) अधिनियम, 1971 के उपबन्धों के अनुरूप लाने के आशय से, अध्यक्ष या उपाध्यक्ष द्वारा मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति की विद्यमान सीमा को दो लाख पचास हजार रुपए से बढ़ाकर चार लाख रुपए तक करने का विनिश्चय किया गया है। इसलिए पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है।

DEPUTY SPEAKER'S SALARIES (AMENDMENT) BILL, 2019

further to amend the Himachal Pradesh Legislative Assembly Speaker's and Deputy

Speaker's Salaries Act, 1971 (Act No. 4 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventieth Year of the Republic of India as follows:—

1. Short title—This Act may be called the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries (Amendment) Act, 2019.

2. Substitution section 10-A.—For section 10-A of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971, the following shall be substituted, namely:-—

"10-A. Free transit by railway or by air or by taxi.-(1) The Speaker and the Deputy Speaker during the term of their office shall be entitled to travel at any time by railway or by air by any class within or outside the Country or by taxi outside the State and within the Country alongwith his family or any person accompanying him to look after and assist him during travel and shall be entitled for the reimbursement of actual expenses so incurred on production of tickets or bills of such journey performed, subject to a maximum amount of four lac rupees in each financial year :

Provided that the expenses on journey by taxi shall not be more than ten percent of the maximum amount of four lac rupees :

Provided further that the aggregate amount payable for the journey performed by railway or by air or by taxi in a financial year shall not exceed four lac rupees.

Explanation.—For the purpose of this sub-section, the expression "family" shall mean the spouse, their unmarried son(s) and daughter(s) including unmarried adopted son and daughter.

(2) The Speaker and Deputy Speaker, as the case may be, shall be entitled for an advance not exceeding rupees twenty five thousand on his request to undertake such journey and the advance so paid shall be adjusted before the closing of financial year, failing which the entire advance shall be recovered from his salary and allowances in lump-sum.

Explanation.—For determining the aggregate amount under this section, the amount so incurred in the same financial year on journey by railway or by air or by taxi under section 7 of the Salaries and Allowance of Ministers (Himachal Pradesh) Act, 2000 (11 of 2000) or under section 6 of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 (8 of 1971) shall be taken into account.".

The Members Amenities Committee of Himachal Pradesh Vidhan Sabha has recommended to enhance the existing limit for reimbursement of expenses incurred on account of free transit facility to Member (s) of Legislative Assembly alongwith making provision of taxi outside the State and within the Country. The recommendations made by the said Committee have duly been accepted. Thus, in order to maintain parity amongst the Members, Speaker and Deputy Speaker and also to bring the provisions of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries, Act, 1971 in conformity with the provisions of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971, it has been decided to enhance the existing limit of reimbursement of expenses incurred on account of free transit facility from rupees two lac fifty thousand to rupees four lac to the Speaker and Deputy Speaker. This has necessitated amendments in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेन्शन) अधिनियम, 1971 (1971 का अधिनियम संख्यांक 8) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के सारवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम, हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेन्शन) संशोधन अधिनियम, 2019 है ।

2. धारा 6 का प्रतिस्थापन.--हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेन्शन) अधिनियम, 1971 (जिसे इसमें इसके पश्चात ''मूल अधिनियम'' कहा गया है) की धारा 6 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''6. रेलमार्ग द्वारा या वायुमार्ग द्वारा या राज्य परिवहन उपक्रम द्वारा या टैक्सी द्वारा निःशुल्क यात्रा.--(1) प्रत्येक सदस्य अपनी पदावधि के दौरान अपने कुटुम्ब के साथ या यात्रा के दौरान उसकी देखभाल या सहायता के लिए उसके साथ यात्रा करने वाले किसी व्यक्ति के साथ किसी भी समय किसी भी श्रेणी में रेलमार्ग द्वारा या वायुमार्ग द्वारा या राज्य परिवहन उपक्रम द्वारा देश के भीतर या बाहर या टैक्सी द्वारा राज्य के बाहर और देश के भीतर यात्रा करने का हकदार होगा और वह प्रत्येक वित्तीय वर्ष में चार लाख रुपए की अधिकतम राशि के अध्यधीन, इस प्रकार उपगत वास्तविक व्यय की प्रतिपूर्ति का हकदार, ऐसी की गई यात्रा की टिकटों या बिलों को प्रस्तुत करने पर, होगाः परन्तु सदस्य जब सरकारी प्रवास पर हो तो वह वायुमार्ग या रेलमार्ग या लोक परिवहन या टैक्सी द्वारा यात्रा के दौरान उसके कुटुम्ब द्वारा या उसकी देखभाल और सहायता करने के लिए उसके साथ यात्रा करने वाले किसी अन्य व्यक्ति द्वारा की गई यात्रा में उपगत वास्तविक व्यय की प्रतिपूर्ति का हकदार, ऐसी की गई यात्रा की टिकटों या बिलों को प्रस्तुत करने पर होगाः परन्तु यह और कि टैक्सी द्वारा की गई यात्रा पर व्यय चार लाख रुपए की अधिकतम राशि के दस प्रतिशत से अधिक नहीं होगीः 5444 राजपत्र, हिमाचल प्रदेश, 02 सितम्बर, 2019/11 भाद्रपद, 1941 परन्तु यह और कि रेलमार्ग या वायुमार्ग या लोक परिवहन या टैक्सी द्वारा की गई यात्रा के लिए संदेय कुल रकम वित्तीय वर्ष में चार लाख रुपए से अधिक नहीं होगी।

स्पष्टीकरण.--इस उपधारा के प्रयोजन के लिए पद ''कुटुम्ब'' से पति या पत्नी, उनके अविवाहित दाक पुत्र और पुत्री सहित अविवाहित पुत्र और पुत्री (पुत्रियां) अभिप्रेत होगा/होगी। (2) प्रत्येक सदस्य उसके अपने अनुरोध पर, ऐसी यात्रा करने के लिए पच्चीस हज़ार रुपए से अनधिक अग्रिम का हकदार होगा और ऐसा संदा अग्रिम वित्तीय वर्ष की समाप्ति से पूर्व समायोजित किया जाएगा, ऐसा न होने पर पूर्ण अग्रिम उसके वेतन और भत्ते से एकमुश्त राशि में वसूल किया जाएगा। स्पष्टीकरण.--इस धारा के अधीन, कुल रकम का अवधारण कराने के लिए मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (2000 का 11) की धारा 7 या हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 (1971 का 4) की धारा 10-क के अधीन उसी वित्तीय वर्ष में रेलमार्ग द्वारा या वायुमार्ग द्वारा या टैक्सी द्वारा की गई यात्रा में इस प्रकार उपगत रकम को हिसाब में लिया जाएगा।

(3) प्रत्येक सदस्य को दो निःशुल्क अनन्तरणीय पास प्रदान किए जाएंगे जो उसको और उसकी पत्नी या यात्रा के दौरान उसकी देख-भाल और सहायता के लिए उसके साथ किसी अन्य व्यक्ति को किसी भी समय हिमाचल प्रदेश पथ परिवहन निगम के किसी लोक सेवा यान में किराया और उस पर यात्री कर का संदाय किए बिना यात्रा करने का हकदार बनाएगा।

(4) उप-धारा (1) के अधीन सदस्य को जारी किए गए निःशुल्क पास उसकी पदावधि के लिए विधिमान्य होंगे और ऐसी अवधि के अवसान पर वे उसके द्वारा सचिव, हिमाचल प्रदेश विधान सभा को अभ्यर्पित कर दिए जाएंगे।

(5) इस धारा की किसी बात का ऐसा अर्थ नहीं लगाया जाएगा जिससे कोई सदस्य किसी ऐसे यात्रा भत्ते का हकदार न रहे जिसका वह अन्यथा इस अधिनियम या तद्‌धीन बनाए गए नियमों के उपबन्धों के अधीन हकदार है।''।

3. धारा 6-क का प्रतिस्थापन.--मूल अधिनियम की धारा 6-क के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''6-क. भूतपूर्व सदस्यों को रेलमार्ग द्वारा या वायुमार्ग द्वारा या राज्य परिवहन उपक्रम द्वारा या टैक्सी द्वारा मुफ्त यात्रा (फ्री ट्रांज़िट) सुविधा.--किसी भूतपूर्व सदस्य को अपने कुटुम्ब के साथ या यात्रा के दौरान उसकी देखभाल या सहायता करने के लिए उसके साथ यात्रा करने वाले किसी व्यक्ति के साथ किसी भी समय किसी भी श्रेणी में रेलमार्ग द्वारा या वायुमार्ग द्वारा या राज्य परिवहन उपक्रम द्वारा भारत के भीतर या टैक्सी द्वारा राज्य के बाहर और देश के भीतर यात्रा करने का हकदार होगा और वह प्रत्येक वित्तीय वर्ष में दो लाख रुपए की अधिकतम राशि के अध्ययीन इस प्रकार उपगत वास्तविक व्यय की प्रतिपूर्ति का हकदार, ऐसी की गई यात्रा की टिकटों या बिलों को प्रस्तुत करने पर होगाः

परन्तु टैक्सी द्वारा की गई यात्रा पर व्यय दो लाख रुपए की अधिकतम राशि के दस प्रतिशत से अधिक नहीं होगाः

परन्तु यह और कि किसी भी वित्तीय वर्ष में रेलमार्ग द्वारा या वायुमार्ग द्वारा या लोक परिवहन उपक्रम द्वारा या टैक्सी द्वारा की गई यात्रा के लिए संदेय कुल रकम दो लाख रुपए से अधिक नहीं होगी।''।5445 राजपत्र, हिमाचल प्रदेश, 02 सितम्बर, 2019/11 भाद्रपद, 1941 उद्‌देश्यों और कारणों का कथन यात्रा व्यय, जो राज्य विधान सभा के माननीय सदस्यों को लोक प्रतिनिधि के रूप में सार्वजनिक जीवन की विभिन्न मांगों के कारण उपगत करने पड़ते हैं, में तीव्र वृद्धि के कारण निःशुल्क यात्रा भत्ता में संशोधन करने के साथ-साथ राज्य के बाहर और देश के भीतर टैक्सी द्वारा यात्रा का प्रावधान करने की आवश्यकता हो गई है। विधान सभा सुख-सुविधा समिति द्वारा यात्रा व्यय में बढ़ौतरी करने की भी सिफारिश की गई है। इसलिए, सदस्य सुख-सुविधा समिति कीे सिफारिशों को स्वीकार करने सहित मुफ्त यात्रा (फ्री ट्रांज़िट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए विद्यमान सीमा को दो लाख पचास हजार रुपए से बढ़ाकर चार लाख रुपए करने का विनिश्चय किया गया है। भूतपूर्व सदस्यों की दशा में, मुफ्त यात्रा (फ्री ट्रांज़िट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए सीमा अब एक लाख पच्चीस हजार रुपए के बजाय दो लाख रुपए होगी। इसलिए हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है ।

further to amend the Himachal Pradesh Legislative Assembly (Allowances and Pension of

Members) Act, 1971 (Act No. 8 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventieth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Amendment Act, 2019.

2. Amendment of section 6.—For section 6 of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 (hereinafter referred to as the "principal Act"), the following shall be substituted, namely:—

"6. Free transit by railway or by air or by State Transport Undertaking or by taxi.— (1) Each member during the term of his office shall be entitled to travel at any time, by railway or by air or by State Transport Undertaking by any class within or outside the Country or by taxi outside the State and within the Country alongwith his family or any person accompanying him to look after and assist him during travel and shall be entitled for the reimbursement of actual expenses so incurred on production of tickets or bills of such journey performed, subject to maximum amount of four lac rupees in each financial year:

Provided that the member while on official tour shall also be entitled for the reimbursement of actual expenses so incurred by his family or any other person accompanying him to look after and assist him during travel by air or by rail or by public transport or by taxi on production of tickets or bills for such journey performed:

Provided further that the expenses on journey by taxi shall not be more than ten percent of the maximum amount of four lac rupees:

Provided further that the aggregate amount payable for the journey performed by railway or by air or by public transport or by taxi in a financial year shall not exceed four lac rupees.

Explanation.—For the purpose of this sub-section, expression "family" shall mean the spouse, their unmarried son(s) and daughter(s) including unmarried adopted son and daughter.

(2) Each member shall be entitled for an advance not exceeding rupees twenty five thousand on his request to undertake such journey and the advance so paid shall be adjusted before the closing of financial year, failing which the entire advance shall be recovered from his salary and allowances in lump-sum.

Explanation.—For determining the aggregate amount so incurred on such journey under this section, the amount so incurred in the same financial year by journey performed by railway or by air or by taxi under section 7 of the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 (11 of 2000) or under section 10-A of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971 (4 of 1971) shall be taken into account.

(3) Each member shall be provided with two free non-transferable passes which shall entitle him and his wife or any other person accompanying him to look after and assist him during travel at any time without payment or fare and passenger tax thereon by any public service vehicle of the Himachal Road Transport Corporation.

(4) The free passes issued to a member under sub-section (1) shall be valid for the terms of his office and on the expiration of such term these shall be surrendered by him to the Secretary of the Himachal Pradesh Legislative Assembly.

(5) Nothing in this section shall be construed as disentitling a member to any travelling allowances to which he is otherwise entitled under the provisions of this Act or rules made thereunder.".

3. Substitution of section 6-A.—For section 6-A of the principal Act, the following shall be substituted, namely:—

"6-A. Free transit facility by railway or by air or by State Transport Undertaking or by taxi to ex-members.—An ex-member shall be entitled to travel at any time by railway or by air or by State Transport Undertaking by any class within India or by taxi outside the State and within the Country alongwith his spouse or any person accompanying him to look after and assist him during travel and shall be entitled for the reimbursement of actual expenses so incurred on production of tickets or bills of such journey performed, subject to maximum amount of two lac rupees in each financial year:

Provided that the expenses on journey by taxi shall not be more than ten percent of maximum amount of two lac rupees:

Provided further that the aggregate amount payable for the journey performed by railway or by air or by State Transport Undertaking or by taxi in a financial year shall not exceed two lac rupees.".

STATEMENT OF OBJECTS AND REASONS

Due to sharp increase in the travel expenses which the Hon'ble Members of the State Legislative Assembly as a public representatives has to incur on account of various demands of the public life, there has arisen a need to revise their free travelling allowance alongwith making provisions of taxi outside the State and within the Country. Increase in the travel expenses has also been recommended by the Vidhan Sabha Members Amenities Committee. As such, it has been decided to accept the recommendations of the Members Amenities Committee with respect to enhancement of the existing limit for reimbursement of expenses incurred on account of free transit facility from rupees two lac fifty thousand to rupees four lac to the Member(s) of Legislative Assembly. In case of ex-members, now the limit for reimbursement of expenses incurred on account of free transit facility shall be rupees two lac instead of rupees one lac twenty five thousand. This has necessitated amendments in the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971.

This Bill seeks to achieve the aforesaid objectives.

विषय.--जन्म पंजीकरण अधिनियम, 1969 की धारा 13(3) के तहत जन्म पंजीकरण हेतु प्रार्थना-पत्र। सुशील कुमार पुत्र श्री किरपा राम, गांव भन्डार, डाकघर राजनगर, उप-तहसील पुखरी, जिला चम्बा, हिमाचल प्रदेश ने इस अदालत में एक ब्यान हल्फी पेश किया है कि मेरे बेटे नामक स्पर्श शर्मा का जन्म दिनांक 17-12-2009 व समर्थ शर्मा का जन्म दिनांक 02-01-2013 को गांव भन्डार पंचायत राजनगर में हुआ है परन्तु किसी कारणवश मेरे दोनों बेटों के जन्म पंजीकरण का इन्दाज ग्राम पंचायत राजनगर में नहीं करवाया गया है। प्रार्थी इस न्यायालय के माध्यम से अपने बेटों के जन्म पंजीकरण/इन्द्राज करने के आदेश ग्राम पंचायत राजनगर को जारी करवाना चाहता है।

अतः प्रार्थी का ब्यान हल्फी स्वीकार करते हुये इस इश्तहार/मुस्त्री मुनादी व चस्पांगी द्वारा आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को प्रार्थी के बेटों का जन्म पंचायत में पंजीकरण करने हेतु किसी प्रकार का कोई उजर/एतराज हो तो वह असालतन या वकालतन में इस इश्तहार के प्रकाशन की तिथि उपरान्त एक माह के भीतर अपना उजर एवं एतराज पेश कर सकते हैं बाद तारीख किसी किस्म का उजर एवं एतराज नहीं सुना जायेगा व उक्त प्रार्थी के बेटों का जन्म पंजीकरण करने के आदेश सचिव, ग्राम पंचायत राजनगर को पारित कर दिये जायेंगे।

श्री श्याम लाल पुत्र श्री हिरा नन्द, निवासी ग्राम रूनपू, डाकघर किन्नू, तहसील रामपुर बुशैहर, जिला शिमला, हि0 प्र0 ने शपथ-पत्र मय अन्य सम्बन्धित कागजात सहित इस अदालत में प्रार्थना-पत्र गुजारा है जिसमें प्रार्थी ने वर्णन किया है कि उसकीे जन्म तिथि 02-09-1970 है किन्तु प्रार्थी के माता पिता अज्ञानता के कारण जन्म तिथि का पंजीकरण सम्बन्धित रिकार्ड में पंजीकृत नहीं करवा सके। इसलिए प्रार्थी ग्राम पंचायत किन्नू के जन्म व मृत्यु पंजीकरण रजिस्टर/रिकार्ड में अपनी जन्म तिथि पंजीकृत करवाना चाहता है। अतः इस इश्तहार द्वारा सर्वसाधारण/आम जनता को सूचित किया जाता है कि यदि किसी को उपरोक्त जन्म पंजीकरण ग्राम पंचायत किन्नू में पंजीकृत करने बारे कोई उजर व एतराज हो तो वह असालतन/वकालतन दिनांक 21-09-2019 को प्रातः 10.00 बजे इस अदालत में हाजिर होकर अपनी आपत्ति प्रस्तुत करें बाद गुजरने मियाद कोई भी उजर/एतराज स्वीकार नहीं होगा तथा नियमानुसार सम्बन्धित ग्राम पंचायत को जन्म पंजीकरण दर्ज करने बारे यथोचित आदेश पारित कर दिये जाएंगे।

यह दरख्वास्त श्री पदम दास पुत्र स्व0 श्री शाडू राम, निवासी ग्राम चदाली, डाकघर करतोट, तहसील रामपुर बुशैहर, जिला शिमला (हि0 प्र0) ने इस गुजारिश के साथ प्रस्तुत किया है कि प्रार्थी का नाम राजस्व रिकार्ड के वाका चक चदाली के खाना मालिक व काश्तकार में परमा दर्ज है जो गलत है। वादी का सही नाम पदम दास है जिसकी पुष्टि हेतु वादी ने छायाप्रति नकल परिवार रजिस्टर व आधार कार्ड की प्रति आवेदन-पत्र के साथ संलग्न किया है। जिसमें वादी का नाम पदम दास होना सही पाया गया है। वादी अपना नाम उपरोक्त वाका चक के राजस्व रिकार्ड में परमा के स्थान पर पदम दास दुरुस्त/दर्ज करवाना चाहता है। अतः इस इश्तहार के द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी को उपरोक्त वादी का नाम वाका चक चदाली पटवार वृत्त गोपालपुर के माल कागजात में श्री परमा के स्थान पर पदम दास दरुस्त/दर्ज करने बारे कोई आपत्ति हो तो वह दिनांक 21-09-2019 को प्रातः 10.00 बजे इस अदालत में असालतन या वकालतन हाजिर आकर अपना उजर व एतराज पेश कर सकते हैं बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार वादी का नाम दुरुस्त करने के आदेश पारित किए जाएंगे।

यह दरख्वास्त श्री चमन लाल पुत्र श्री चेपा राम, निवासी ग्राम व डाकघर मशनू, तहसील रामपुर, जिला शिमला (हि0 प्र0) ने इस गुजारिश के साथ प्रस्तुत किया है कि प्रार्थी का नाम राजस्व रिकार्ड के वाका5455 राजपत्र, हिमाचल प्रदेश, 02 सितम्बर, 2019/11 भाद्रपद, 1941 चक मशनु के खाना मालिक व काश्तकार में चादी राम पुत्र श्री चेपा राम दर्ज है जो गलत है। वादी का सही नाम चमन लाल है जिसकी पुष्टि हेतु वादी ने मुख्य अध्यापक मशनु द्वारा जारी प्रमाण-पत्र, नकल परिवार रजिस्टर, आधार कार्ड व निर्वाचन आयोग पहचान-पत्र की छायाप्रति आवेदन-पत्र के साथ संलग्न की है। जिसमें वादी का नाम चमन लाल होना सही पाया गया है। वादी अपना नाम उपरोक्त वाका चक के राजस्व रिकार्ड में चादी राम के स्थान पर चमन लाल दरुस्त/दर्ज करवाना चाहता है।
