''मान्यता प्राप्त विश्वविद्यालय से खाद्य प्रौद्योगिकी या दूध प्रौद्योगिकी या जैव प्रौद्योगिकी या तले प्रौद्योगिकी या कृषि विज्ञान या पशु चिकित्सा विज्ञान या जैव रसायन विज्ञान या सूक्ष्म जीव विज्ञान में उपाधि या रसायन विज्ञान में स्नातकोत्तर उपाधि या चिकित्सा विज्ञान में उपाधि; या''।

संख्या आई0 पी0 एच0-ए-ए(3)-2/2016.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या आई0 पी0 एच0-ए-ए(3)-2/2016, तारीख 19-06-2017 द्वारा अधिसूचित हिमाचल प्रदेश सिंचाई एवं जन स्वास्थ्य विभाग, सहायक रसायनज्ञ, वर्ग-III (अराजपत्रित), भर्ती और प्रोन्नति नियम, 2017 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सिंचाई एवं जन स्वास्थ्य विभाग, सहायक रसायनज्ञ, वर्ग-III (अराजपत्रित), भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2019 है। (2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध-''क'' का संशोधन.--(1) हिमाचल प्रदेश सिंचाई और जन स्वास्थ्य विभाग, सहायक रसायनज्ञ, वर्ग-III (अराजपत्रित), भर्ती और प्रोन्नति नियम, 2017 के उपाबन्ध-'क' में, -

(क) स्तम्भ सख्ंया 3 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"वर्ग-III (अराजपत्रित), अलिपिक वर्गीय वृत्त स्तर का संवर्ग।"।

(ख) स्तम्भ संख्या 11 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित स्पष्टीकरण रखा जाएगा, अर्थात्‌ः-

"अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा/समझे जाएंगे, यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है/हैं जो आपात्‌काल की अवधि के दौरान सशस्त्र बलों में शामिल हुए हैं और जिसे/जिन्हें डिमोबिलाईज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे/जिन्हें एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।"।5479 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 (ग) स्तम्भ सख्ंया 15 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, लिखित परीक्षा के गुणागुण तथा इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण/ प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो लिखित परीक्षा के गुणागुण और इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन तथा पूर्व में ली गई छटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यवहारिक परीक्षा या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थ्तिि, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।"।

(घ) स्तम्भ संख्या 15-क (III) के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"अधीक्षण अभियन्ता, सिंचाई एवं जन स्वास्थ्य विभाग, नियुक्ति और अनुशासन प्राधिकारी होगा ।"।

(ङ) स्तम्भ संख्या 15-क (IV) के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"संविदा पर नियुक्ति के मामले में पद पर नियुक्ति के लिए चयन, लिखित परीक्षा के गुणागुण तथा इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन के आधार पर किया जाएगा या यदि, ऐसा करना आवश्यक या समीचीन समझा जाए तो लिखित परीक्षा के गुणागुण और इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन तथा पूर्व में ली गई छटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यवहारिक परीक्षा या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर द्वारा अवधारित किया जाएगा। "।

(च) स्तम्भ संख्या 15-क (VII) (ग) के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"संविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0 टी0 सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगा। अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा ।"। 3. उपाबन्ध-ख का संशोधन.--(1) उक्त नियमों के उपाबन्ध-"ख" को "परिशिष्ट-II" के रूप में पढ़ा जाएगा। 5480 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 (2) उपाबन्ध-"ख" के क्रम संख्या 4 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

IRRIGATION & PUBLIC HEALTH DEPARTMENT

NOTIFICATION

Shimla-171002, the 29th August, 2019

No. IPH-A-A(3)-2/2016.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Irrigation and Public Health Department, Assistant Chemist, Class- III (Non-Gazetted) Recruitment and Promotion Rules, 2017, notified vide this Department notification number No. IPH-A-A(3)-2/2016, dated 19-06-2017, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Irrigation & Public Health Department, Assistant Chemist, Class-III (Non Gazetted) Recruitment and Promotion (1st Amendment) Rules, 2019.

(2) These rules shall come into force from the date of the publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure-"A".—(1) In Annexure-"A" to the Himachal Pradesh, Irrigation and Public Health Department, Assistant Chemist, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2017;

namely:—

"Class-III (Non Gazetted) (Non-Ministerial) Circle Level Cadre.".

(b) "For the existing provision against Column No. 11, the following Explanation shall be

substituted, namely:—

"The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-serviceman who have joined Armed forces during the period of emergency and recruited under the provision of Rule-3 of Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Services) Rules,1972 and having been given the benefit of seniority thereunder or recruited under the provision of Rule-3 of Ex-serviceman (Reservation of Vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.".

(c) For the existing provision against Column No. 15, the following shall be substituted,

namely:—

"Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if the Himachal Pradesh Public Service Commission or other recruiting agency/authority, as the case may be, so considers necessary or expedient on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these Rules, preceded by a screening test (objective type) or practical test or skill test or physical test, the standard/syllabus, etc. of which, will be determined by the Himachal Pradesh Public Service Commission/ other recruiting agency/authority, as the case may be.".

(d) For the existing provision against Column No. 15-A (III), the following shall be

substituted, namely:—

"The Superintending Engineer will be the Appointing/Disciplinary Authority.".

(e) For the existing provision against Column No. 15-A (IV), the following shall be

substituted, namely:—

"Selection for appointment to the post in the case of contract appointment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if considered necessary or expedient on the basis of merit of written examination followed by evaluation as specified in appendix-I appended to these Rules, preceded by a screening test (objective type) or practical test or skill test, the standard/syllabus, etc. of which, will be determined by the concerned recruiting agency i.e. Himachal Pradesh Staff Selection Commission Hamirpur.".

(f) For the existing provision against Column No. 15-A (VII) (c), the following shall be

substituted, namely:—

"The Contract appointee will be entitled for one day's casual leave after putting one month's service, 10 days' medical leave and 5 days' special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted5483 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 maternity leave for 180 days'. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed casual leave, medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

3. Amendment of Annexure-"B".—(1) The Annexure-"B" of the said rules shall be read as "Appendix-II"

(2) For the existing provision against S. No. 4 of Annexure-"B", the following shall be

substituted, namely:—

"The Contract appointee will be entitled for one day's casual leave after putting one month's service, 10 days' medical leave and 5 days' special leave, in a calendar year. संख्या टी0सी0पी0-ए(2)-2/2016.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 77 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या टी0सी0पी0-ए(2)-1/2001 तारीख 05-03-2002 द्वारा निदेशक, उद्योग विभाग हिमाचल प्रदेश को निर्यात प्रोत्साहत औद्योगिक पार्क (ई0पी0आई0पी0) फेज-I बद्‌दी, जिला सोलन, हिमाचल प्रदेश की बाबत प्रत्यायोजित शक्तियों को तुरन्त प्रभाव से प्रत्याहृत करते हैं। इसके अतिरिक्त हिमाचल प्रदेश के राज्यपाल, पूर्वोक्त अधिनियम की धारा 77 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए आदेश देते हैं की पूर्वोक्त अधिनियम की धारा 16, 28, 29, 30, 31, 34, 39, 39-क, 39-ख, 39-ग, 79, 81 और 83-क के अधीन निदेशक, नगर और ग्राम योजना विभाग, हिमाचल प्रदेश की शक्तियां अब बद्‌दी-बरोटीवाला-नालागढ़ विशेष क्षेत्र में आने वाले क्षेत्रों, जो हिमाचल प्रदेश राज्य5485 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 औद्योगिक विकास निगम (एच0पी0एस0आई0सी0) हिमाचल प्रदेश आवास और शहरी विकास प्राधिकरण (हिमुडा) और जिला औद्योगिक केन्द्र (डी0आई0सी0) सोलन की अधिकारिता के भीतर आते हैं, मुख्य कार्यकारी अधिकारी बद्‌दी-बरोटीवाला-नालागढ़ विकास प्राधिकरण (बी0बी0एन0डी0ए0) द्वारा प्रयुक्त की जाएगी, तथापि, ऐसी शक्तियां, नगरपालिका परिषद्‌ नालागढ़ और नगरपालिका परिषद्‌ बद्‌दी की बाबत, तुरन्त प्रभाव से प्रयोक्तव्य नहीं होंगी।

TOWN AND COUNTRY PLANNING DEPARTMENT

NOTIFICATION

Shimla-2, the 20th July, 2019

No.TCP-A(2)-2/2016.—In exercise of the powers conferred by sub-section (1) of section 77 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh is pleased to withdraw with immediate effect, the powers delegated, vide this Department Notification No. TCP-A(2)-1/2001 dated 05-03-2002, to the Director, Industries Department, Himachal Pradesh with respect to the Export Promotion Industrial Park (EPIP) Phase-I at Baddi, District Solan, Himachal Pradesh.

Further, the Governor, Himachal Pradesh, in exercise of the powers conferred by sub- section (1) of section 77 of the Act ibid, is pleased to order that the powers of the Director, Town and Country Planning Department, Himachal Pradesh under sections 16, 28, 29, 30, 31, 34, 38, 39, 39-A, 39-B, 39-C, 79, 81 and 83-A of the Act ibid shall now be exercised by the Chief Executive Officer, Baddi-Barotiwala-Nalagarh Development Authority (BBNDA), in the areas falling in the Baddi-Barotiwala-Nalagarh Special Area which are under the jurisdiction of the Himachal Pradesh State Industrial Development Corporation (HPSIDC), Himachal Pradesh, the Housing and Urban Development Authority (HIMUDA) and the District Industries Centre (DIC) Solan. Such powers, however, shall not be exercisable in respect of Municipal Council, Nalagarh and Municipal Council, Baddi, with immediate effect.

संख्या टी0सी0पी0-एफ0(5)-1/2017.--अधिसूचना संख्या टी0सी0पी0-एफ0(5)-1/2017 तारीख 27 जनवरी, 2018 द्वारा अधिसूचना मण्डी योजना क्षत्रे के लिए विकास योजना में संशोधनों के प्रारूप को हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 के 5486 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 नियम 11 के साथ पठित हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का 12) की धारा 19 की उपधारा (1) के अधीन निदेशक, नगर एवं ग्राम योजना विभाग, हिमाचल प्रदेश द्वारा तारीख 17 नवम्बर, 2018 को राजप़त्र (ई-गज़ट), हिमाचल प्रदेश में नोटिस संख्याः हिम/टी.पी./पी.जे.टी./ए.जैड.आर.-मण्डी/2013/वॉल-।।/7732-52, तारीख 13-11-2018 द्वारा आक्षेप और सुझाव आमंत्रित करने के लिए प्रकाशित किया गया था;

और नियत अवधि के भीतर, निदेशक को केवल दो आक्षेप/सुझाव प्राप्त हुए जिन पर उन द्वारा सम्यक्‌ रूप से विचार किया गया और जहां अपेक्षित था, उपान्तरण किए गए और उक्त विकास योजना में संशोधनों के प्रारूप को सरकार को अनुमोदन के लिए प्रस्तुत किया गया;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का 12) की धारा 20 की उपधारा (1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिना किसी उपान्तरण के मण्डी योजना क्षेत्र के लिए विकास योजना में निम्नलिखित संशोधन अनुमोदित करते हैं, अर्थात्‌ः--

चैप्टर-19, titled Zoning and Sub-Division Regulations of Development Plan for Mandi Development Planning Area, में निम्नलिखित संशाध्े ान किए जाते है:-

1. 19.4.7. Agriculture zone and water bodies zone निम्न प्रकार से रखे जाएंगे :---

"(a) PERMITTED USES.—Residential/group housing, agriculture, horticulture, dairy, poultry farms, stables for animals rearing and breeding, processing and sale of farm produce, petrol and other fuel filling stations, school, libraries, religious buildings, public utility buildings, etc.

(b) RESTRICTED USES THAT MAY BE PERMITTED ON SPECIAL GROUNDS BY DIRECTOR: Quarrying of gravel, sand, clay or stone, lime kilns, brick kilns, show room workshops for servicing and repair of farm machinery and service stations on fixed tenure basis, cold storage, godowns for food, seeds, fertilizer, agriculture/horticulture equipments, tourist accommodation, transit visitor's camps on non-permanent basis, bus/taxi stand and parking places etc. (a) PROHIBITED USES.—All other uses not specifically permitted herein. The Regulations as applicable to the particular proposed use would normally apply to permitted uses under clause (a) and (b) above."

Shimla-2, the 29th August, 2019

No.TCP-F(5)-1/2017.—WHEREAS, the draft amendments in the Development Plan for Mandi Planning Area, notified vide Notification No. TCP-F(5)-9/2004 dated 27th December, 2004 were published by the Director, Town and Country Planning Department, Himachal Pradesh, under sub-section (1) of section 19 of the Himachal Pradesh Town and Country Planning Act, 1977 (12 of 1977) read with rule 11 of the Himachal Pradesh Town and Country Planning Rules, 2014 vide Notice No. HIM/TP/PJT/AZR-Mandi/2013/Vol-II/7732-52 dated 13-11-2018, in the official Gazette (e-Gazette) Himachal Pradesh on 17th November, 2018 for inviting objection(s) and suggestion(s).

AND WHEREAS, only two objections/suggestions were received by the Director, within the stipulated period, which were duly considered by him and modifications were made where required and the draft amendments in the said Development Plan were submitted to the Government for approval.

NOW THEREFORE, in exercise of the powers conferred under sub-section (1) of section 20 of the Himachal Pradesh Town and Country Planning Act, 1977 (12 of 1977), the Governor, Himachal Pradesh is pleased to approve the following amendments in the Development Plan for Mandi Planning Area, without modifications, namely:—

Amendments in Chapter-19

In Chapter-19, titled Zoning and Sub-Division Regulations of Development Plan for Mandi Development Planning Area, following amendments are carried out:—

अमैण्डमैण्ट्‌स इन चैप्टर-13

चैप्टर-13, titled Zoning and Sub-Division Regulations of Development Plan for Sundernager Development Planning Area, में निम्नलिखित संशोधन कार्यान्वित किए जाते हैं :-

"1. Regulation 6 of 13.15 Sub-Division of Land Regulation निम्न प्रकार से रखा जाएगाः- "Any yard or plot existing at the time of coming into force of these Regulations shall not be reduced in dimension or size below the minimum requirement set forth herein. The yards or plots created after the effective date of these Regulations shall meet at least the minimum requirements established by these Regulations. "Primary Activity can be sub divided into :

1. Agriculture: PA 1

2. Plantation: PA 2

3. Forestland/ Govt. Land: PA 3

The activities Permitted, Restricted and Prohibited in Primary Activity zone shall be as given below:

(a) Activities Permitted Residential/group housing, agriculture, horticulture, dairy, poultry farms, stables for animals rearing and breeding, processing and sale of farm produce, petrol and other fuel filling stations, school, libraries, religious buildings, public utility buildings etc. (b) Activities Restricted–That may be permitted on special grounds by Director Quarrying of gravel, sand, clay or stone, lime kilns, brick kilns, show room workshops for servicing and repair of farm machinery and service stations on fixed tenure basis, cold storage, godowns for food, seeds, fertilizer, agriculture/horticulture equipments, tourist accommodation, transit visitor's camps on non-permanent basis, bus/taxi stand and parking places etc.

(c) Activities Prohibited

All other uses not specifically used under clause (a) and (b) above."

संख्याः टी0सी0पी0-ए-(3)1/2016.--भू-संपदा (विनियमन और विकास) अधिनियम, 2016 (2016 का अधिनियम संख्यांक 16) की धारा 20 की उपधारा (1) उपबन्ध करती है कि समुचित सरकार, अधिसूचना द्वारा, उक्त अधिनियम के अधीन उसे प्रदा शक्तियाें का प्रयोग करने तथा उसको समनुदेशित कृत्याें का पालन करने के लिए भू-संपदा विनियामक, प्राधिकरण नामक एक प्राधिकरण की स्थापना करेगी;

No.TCP-A(3)-1/2016.—Whereas, sub-section (1) of Section 20 of the Real Estate (Regulation and Development) Act, 2016 (No. 16 of 2016) provides that appropriate Government shall, by notification, establish an Authority to be known as the Real Estate Regulatory Authority to exercise the powers, conferred on it and to perform the functions assigned to it under the said Act; And Whereas, third proviso to sub-section (1) of Section 20 of the Act ibid. provides that until the establishment of a Regulatory Authority under this section, the appropriate Government shall, by order, designate any regulatory Authority or any officer preferably the Secretary of the department dealing with Housing, as the Regulatory Authority for the purposes under this Act; Now, therefore, in exercise of the powers conferred by the third proviso to sub-section (1) of section 20 of the Act ibid. the Governor, Himachal Pradesh, is pleased to designate the Addl. Chief Secretary (Housing) to the Government of Himachal Pradesh as Real Estate Regulatory Authority, until the establishment of a Regulatory Authority under this section for carrying out the purposes under the said Act.

संख्याः टी0सी0पी0-ए(3)-2/2018.--प्रारुप हिमाचल प्रदेश नगर और ग्राम योजना (चतुर्थ संशोधन) नियम, 2018 को हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12)5493 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 की धारा 87 की उपधारा (1) के अधीन यथाअपेक्षानुसार एतदद्वारा संभाव्य प्रभावित होने वाले (व्यक्तियों) से आक्षेप और सुझाव आमंत्रित करने के लिए इस विभाग की समसंख्यक अधिसूचना, तारीख 02-01-2019 द्वारा राजपत्र (ई-गज़ट), हिमाचल प्रदेश में तारीख 15-01-2019 को प्रकाशित किया गया था;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 87 द्वारा प्रदत्त शक्तियाें का प्रयोग करते हुए इस विभाग की अधिसूचना संख्या टी0सी0पी0-ए(3)-1/2014-1, तारीख 01-12-2014 द्वारा अधिसूचित और राजपत्र (ई-गजट), हिमाचल प्रदेश में तारीख 01-12-2014 को प्रकाशित, हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

No. TCP-A(3)-2/2018.—Whereas, the draft Himachal Pradesh Town and Country Planning (Fourth Amendment) Rules, 2019 were published in the Rajpatra (e-Gazette), Himachal Pradesh on5494 राजपत्र, हिमाचल प्रदेश, 04 सितम्बर, 2019/13 भाद्रपद, 1941 15-01-2019, vide this department notification of even number dated 02-01-2019, for inviting objection(s) and suggestion(s) from the person likely to affected thereby, as required under sub- section (1) of Section 87 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977);
