अधिसूचना

शिमला-9, 4 सितम्बर, 2019

संख्याः पीसीएच-एचए(1)6/2014-52775-913.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के साथ पठित धारा 135 की उपधारा (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए पूर्वोक्त अधिनियम के प्रयोजनों को कार्यान्वित करने 127-राजपत्र/2019-12-09-2019 (5823) 5824 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इनका जनसाधारण की सूचना के लिए राजपत्र (ई-गजट) हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशन किया जाता है;

इन प्रारूप नियमों से संभाव्य प्रभावित होने वाले यदि किसी व्यक्ति को उक्त नियमों को बनाए जाने की बाबत कोई आक्षेप या सुझाव है/हैं तो वह उसे /उन्हें प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर निदेशक, पंचायती राज, हिमाचल प्रदेश, एसडीए कम्पलैक्स, ब्लॉक नं0 27, कसुम्पटी, शिमला-171 009 को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त हुए आक्षेप(पों) या सुझाव(वों) यदि कोई हो (होेंं) पर राज्य सरकार द्वारा इन नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थातः-

प्रारूप नियम

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में कनिष्ठ लेखाकार की नियुक्ति एवं सेवा शर्तें) नियम, 2019 है।

2. परिभाषाएं.--1 इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,--

(क) श्अधिनियमश् से, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 अभिप्रेत है; और

(ख) श्प्ररूपश् से, इन नियमों से संलग्न प्ररूप अभिपे्रत है।

(2) उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, वही अर्थ होंगे जो क्रमशः अधिनियम में उनके हैं।

3. पदों की संख्या.--प्रत्येक जिला परिषद्‌ में कनिष्ठ लेखाकार के पदों की संख्या ऐसी होेगी, जैसी सरकार द्वारा मंजूर की गई है और जैसी समय-समय पर मन्जूर की जाए।

4. वेतनमान.--कनिष्ठ लेखाकार के पद के लिए वेतनमान निम्न प्रकार से होगा;

(क) नियमित आधार पर नियुक्त कर्मचारियों के लिए पे बैण्ड मु0 5910-202001900 ग्रेड पे (ख) संविदा के आधार पर नियुक्त कर्मचारियों के लिए उपलब्धियां नियम 13 में दिए गए ब्यौरे के अनुसार मु0 59101900त्र7810/- प्रतिमास; और

(ग) कनिष्ठ लेखाकार को राज्य सरकार द्वारा उपलब्ध करवाए गए सहायता अनुदान में से मासिक पारिश्रमिक दिया जाएगा।

5. पद का प्रकार (चयन या अचयन पद).--कनिष्ठ लेखाकार का पद अचयन होगा

6. सीधी भर्ती के लिए आयु.--कनिष्ठ लेखाकार के रूप में नियुक्त किया जाने वाला कोई व्यक्ति तभी पात्र होगा यदि वह 18 से 45 वर्ष की आयु का होः

परन्तु सीधी भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी सीमा, तदर्थ या संविदा के अधार पर नियुक्त व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगीः

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगाः5825 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 परन्तु यह और कि ऊपरी आयु सीमा में, अनुसूचित जातियों/अनूसूचित जनजातियों/अन्य पिछड़ा वर्गो और व्यक्तियों के अन्य प्रवर्गों के लिए उस विस्तार तक शिथिलीकरण किया जाएगा जितना की हिमाचल प्रदेश सरकार के असाधारण या विशेष आदेश (आदेशों )के अधीन अनुज्ञेय हैः

परन्तु यह और कि समस्त पब्लिक सेक्टर नियमों तथा स्वायत निकायों के कर्मचारियों को, जो ऐसे पब्लिक सेक्टर निगमों तथा स्वायत निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर निगमों/स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी रियायत अनुज्ञात की जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है। ऐसी रियायत, तथापि पब्लिक सेक्टर निगमों/स्वायत निकायों के ऐसे कर्मचारिवृन्द को अनुज्ञेय नहीं होगी जो तत्पश्चात्‌ ऐसे निगमों /स्वायत निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सैक्टर निगमों /स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे नियमों /स्वायत निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे।

(1) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमें पद (पदों) को, यथास्थिति, आवेदन आमन्त्रित करने के लिए विज्ञापित किया गया है या नियोजनालायों को अधिसूचित किया गया है।

(2) अन्यथा सुअर्हित अभ्यर्थियों की दशा में सीधी भर्ती के लिए आयु सीमा और अनुभव, राज्य सरकार के विवेकानुसार शिथिल किया जा सकेगा।

7. सीधी नियुक्ति के लिए अपेक्षित न्यूनतम शैक्षणिक अर्हताएं.--1. हिमाचल प्रदेश विश्वविद्यालय या हिमाचल प्रदेश सरकार द्वारा मान्यता प्राप्त किसी अन्य संस्थान से कम से कम पचास प्रतिशत अंकों (अनुसूचित जाति/अनुसूचित जनजाति की दशा में पैतालीस प्रतिशत अंकों) सहित वाणिज्य या कला में (अर्थशास्त्र या गणित या लेखांकन के एक विषय सहित) स्नातक की उपाधि।

2. उन अभ्यर्थियों को अधिमान दिया जाएगा, जो हिमाचल प्रदेश की रूढियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता रखते हों।

8. परिवीक्षा की अवधि.--नियमित आधार पर नियुक्त कर्मचारी एक वर्ष से अनधिक किसी और अवधि के विस्तारण के अध्यधीन, जैसा जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी विशेष परिस्थितियों में कारणों के लिखित में अभिलिखित करके आदेश दे, दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा। 9. नियुक्ति की पद्धति.--अभ्यर्थी को सीधी भर्ती द्वारा, यथास्थिति या तो नियमित आधार पर या संविदा के आधार पर नियुक्त किया जाएगा।

10. सीधी/संविदा नियुक्ति के लिए अनिवार्य अपेक्षा.--कनिष्ठ लेखाकार के रूप में नियुक्त किया जाने वाला अभ्यर्थी हि0 प्र0 का स्थाई निवासी होना चाहिए।

11. नियुक्ति के लिए चयन.--यथास्थिति, सीधी या संविदात्मक नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन नियम 13(पअ) में दिए गए ब्यौरे के अनुसार चयन समिति द्वारा किया जाएगा।

12. नियमित आधार पर नियुक्त व्यक्तियों के लिए सेवा की शर्तें.--संविदा कर्मचारियों का नियमितीकरण राज्य सरकार के संविदा कर्मचारियों की नियमितीकरण नीति के अनुसार किया जाएगा। जिला परिषद्‌ काडर के अधीन नियमित किया गया कनिष्ठ लेखाकार अधिसूचना तारीख 27 सितम्बर, 2017 द्वारा यथाअधिसूचित राष्ट्रीय पैंशन योजना (एनपीएस) की सुविधा प्राप्त करने के लिए हकदार होगा। नियमित आधार पर नियुक्त व्यक्तियों की दशा में सेवा की अन्य शर्तें यथावश्यक परिवर्तन सहित ऐसे लागू होंगी जैसी राज्य सरकार के कनिष्ठ लेखाकारों की दशा में लागू हैं।

13. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए 5826 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 भी पद पर संविदा नियुक्तियां, नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

(i) संकल्पनाः

(क) इन नियमों के अधीन जिला परिषद्‌ में कनिष्ठ लेखाकार को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध मुख्य कार्यकारी अधिकारी यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, वर्ष के दौरान संतोषजनक पाया गया है और केवल निदेशक, पंचायती राज का पूर्व अनुमोदन प्राप्त करने के पश्चात्‌ ही उसकी संविदा अवधि नवीकृत/विस्तारित की जाएगी।

(ख) पद का हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर के कार्यक्षेत्र में आनाः

सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर को भेजेगा।

(ग) चयन, इन नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा।

(ii) संविदात्मक उपलब्धियांः

संविदा के आधार पर नियुक्त कनिष्ठ लेखाकार को 7810/-रुपए की समेकित नियत संविदात्मक रकम (जो पे बैंड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है, तो पश्चात्‌वर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों में 235/- रु0 की रकम पद के पे बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) वार्षिक वृद्धि के रूप में अनुज्ञात किया जाएगा।

(iii) नियुक्ति/अनुशासन प्राधिकारीः

सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, नियुक्ति और अनुशासन प्राधिकारी होगा। (iv) चयन प्रक्रियाः

संविदा नियुक्ति के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि आवश्यक या समीचीन समझा जाए, तो पूर्व में ली गई छंंटनी परीक्षा (वस्तुनिष्ठ प्रकार की)/लिखित परीक्षा या व्यावहारिक परीक्षा या शारीरिक परीक्षण के अनुसार साक्षात्कार/व्यक्तित्व परीक्षण के अनुसार साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, सम्बद्ध भर्ती अभिकरण अर्थात हिमाचल प्रदेश कर्मचारी चयन आयोग हमीरपुर द्वारा अवधारित किया जाएगा। (v) नियुक्ति और करारः

चयन के पश्चात्‌ अभ्यर्थी को प्ररूप-प् में नियुक्ति पत्र दिया जाएगा और उसे इन नियमों से संलग्न प्ररूप-II के अनुसार करार हस्ताक्षरित करना होगा।

(vi) निबन्धन और शर्तेंः

(क) संविदा के आधार पर नियुक्त व्यक्ति को 7810/- रुपए की दर से नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति5827 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक रकम में वृद्धि अर्थात पद के पे-बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत का हकदार होगा और अन्य कोई प्रसुविधाएं, जैसे वरिष्ठ/चयन वेतनमान आदि नहीं किया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है, तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी।

(ग) संविदा पर नियुक्त व्यक्ति एक कैलेंडर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूती अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः परन्तु अनुभयुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कैलेण्डर वर्ष तक संचित किया जा सकेगा और आगामी कैलेण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) जिला परिषद्‌ के मुख्य कार्यकारी अधिकारी के अनुमोदन के बिना सेवा से र्काव्य से अनधिकृत अनुपस्थिति से, स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर र्काव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति नियुक्त के नियन्त्रण से बाहर हों तो उसके नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रण अधिकारी को सूचित करना होगा तथापि संविदा पर नियुक्त व्यक्ति र्काव्य (ड्‌यूटी) से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी आरोग्य प्रमाण पत्र को प्रस्तुत करना होगा।

(ङ) संविदा पर नियुक्त पदधारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, स्थानांतरण के लिए पात्र होगा, जहां प्रशासनिक आधारों पर अपेक्षित हो।

(च) चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना अरोग्य प्रमाण पत्र प्रस्तुत करना होगा। महिला अभ्यर्थियों की दशा में, जिनकी नियुक्ति परिसंकटमय प्रकृति की डि्‌यूटी के विरूद्ध की जाती है और यदि उन्हें सेवा शर्त के रूप में प्रशिक्षण की अवधि पूर्ण करनी होगी तो ऐसी महिला अभ्यर्थी, जो परिक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थाई रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा और यदि वह उपरोक्त यथाविनिर्दिष्ट प्राधिकारी से आरोग्य प्रमाण पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय र्काव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी। 5828 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 (ज) नियमित कर्मचारियों की दशा में यथालागू सेवा नियमों के उपबन्ध जैसे एफ0 आर0 एस0 आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे। 14. नियुक्ति प्राधिकारी.--(1) सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी नियुक्ति प्राधिकारी होगा और नियुक्ति-पत्र जिला परिषद्‌ के मुख्य कार्यकारी अधिकारी द्वारा जारी किया जाएगा।

(2) सम्बद्ध जिला परिषद्‌ का सचिव प्रवास (दौरे) कार्यक्रम, छुट्‌टी आदि के लिए नियंत्रण अधिकारी होगा।

15. कनिष्ठ लेखापाल की वरिष्ठता.--नियमित कनिष्ठ लेखाकार की वरिष्ठता भर्ती अभिकरण द्वारा विरचित मैरिट सूची (गुणागुण) के अनुसार अवधारित की जाएगी या स्कीम के अधीन नियुक्त पूर्वार कनिष्ठ लेखाकारों के मामले में कार्यग्रहण की तारीख से अवधारित की जाएगी और निदेशालय स्तर पर समेकित तथा अनुरक्षित की जाएगी।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी। 17. जॉब चार्ट.--कनिष्ठ लेखाकार के लिए जॉब चार्ट ऐसा होगा, जैसा समय-समय पर जिला परिषद्‌ के मुख्य कार्यकारी अधिकारी द्वारा विनिर्दिष्ट किया जाए।

18. प्रशिक्षण और परीक्षा.--सेवा के सदस्यों को परीक्षा उर्तीण करनी होगी या प्रशिक्षण के लिए ऐसे कोर्स करने होंगे, जैसे जिला परिषद्‌ के मुख्य कार्यकारी अधिकारी द्वारा सरकार के अनुमोदन से समय-सयम पर विनिर्दिष्ट किए जाएंः

परन्तु उसे ऐसी परीक्षा को अर्हित करने के लिए पांच वर्ष में तीन अवसर प्रदान किए जाएंगे और सम्बद्ध कर्मचारी द्वारा परीक्षा अर्हित न करने की दशा में, ऐसा कर्मचारी पदच्युत किए जाने के लिए दायी होगा। 19. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को, किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

20. निरसन और व्यावृत्तियां.--(1) इन नियमों के प्रवृत्त होने की तारीख को और पंचायत समितियों द्वारा अधिसूचना संख्या पी0सी0एच0-एच0बी0 (1) 43/01, तारीख 20 अगस्त, 2001 द्वारा संविदा के आधार पर कनिष्ठ लेखाकार को नियुक्त करने के लिए अधिसूचित स्कीम निरसित हो जाएगी।

(2) ऐसे निरसन के होते हुए भी, इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

6. नियुक्ति, पद पर कार्यग्रहण करने से पूर्व, सम्बद्ध जिला के मुख्य चिकित्सा अधिकारी द्वारा जारी चिकित्सक दृष्टया योग्यता (स्वस्थतता) प्रमाण पत्र प्रस्तुत करने के अध्यधीन होगी; और 7. यथास्थिति, शैक्षिक अर्हताओं, जाति, स्थायी निवासी, शारीरिक अक्षमता, गरीबी रेखा से नीचे से संबन्धित सदस्य या पूर्व अनुभव की बाबत, मूल प्रमाण-पत्रों की अनुप्रमाणित प्रतियां कार्यग्रहण रिपोर्ट के साथ प्रस्तुत की जाएगी।

2. प्रथम पक्षकार को संविदात्मक रकम 7810/- रुपए प्रतिमास होगी।

3. प्रथम पक्षकार की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) की जाने के लिए दायी होगी।

4. संविदा पर नियुक्त व्यक्ति एक कैलेण्डर वर्ष में एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिनके चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी प्रमाण पत्र प्रस्तुत करने पर पैंतालीस दिन के अनधिक प्रसूति अवकाश (जिवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाए अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा;

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कैलेण्डर वर्ष तक संचित किया जा सकेगा और आगामी कैलेण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। 5. नियन्त्रक अधिकारी के अनुमोदन के बिना र्काव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर र्काव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियंत्रण से बाहर हो तो उसके नियमितिकरण के मामलें में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा तथापि संविदा पर नियुक्त व्यक्ति र्काव्य (ड्‌यूटी) से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा;

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण पत्र को प्रस्तुत करना होगा।5831 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 6. संविदा पर नियुक्त व्यक्ति जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधारों पर अपेक्षित हों।

7. चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में चिकित्सा बोर्ड और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा अपना आरोग्य प्रमाण पत्र जारी करना होगा। महिला अभ्यर्थियों की दशा में, जिनकी नियुक्ति परिसंकटमय प्रकृति की ड्‌यूटी के विरूद्ध की जाती है और यदि उन्हें सेवा शर्त के रूप में प्रशिक्षण की अवधि पूर्ण करनी होगी तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थाई रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख के छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा और यदि वह उपरोक्त यथाविनिर्दिष्ट प्राधिकारी आरोग्य प्रमाण पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय र्काव्यों के संबन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/ दैनिक भत्ते का हकदार होगा/होगी।

9. संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामुहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0एफ0 भी लागू नहीं होगा।

NOTIFICATION

Shimla-171 009, the 4 September, 2019

NO. PCH-HA-(1) 6/2014-52775-913.—In exercise of the powers conferred under sub- section (2) of section 135 read with Section 186 of the Himachal Pradesh Panchayati Raj Act, 1994(Act No. 4 of 1994), the Governor, Himachal Pradesh, proposes to make the following rules for carrying out the purposes of the Act ibid and the same are hereby published in the Rajpatra (e- Gazette), Himachal Pradesh, for the information of the general public;

If any person, likely to be affected by these draft rules has any objection(s) or suggestions(s) to make with regard to the said rules, he may send the same to the Director of Panchayati Raj, Himachal Pradesh, SDA Complex, Block No. 27, Kasumpti, Shimla-171009, within a period of thirty days from the date of publication of the draft rules in the Rajpatra (e-Gazette), Himachal Pradesh;

The objections(s) or suggestions(s), if any, received within the period specified above shall be taken into consideration by the State Government, before finalizing these rules, namely:—

DRAFT RULES

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Junior Accountant in Zila Parishads) Rules, 2019.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Panchayati Raj Act, 1994; and (b) "Form" means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of posts.—There shall be such number of posts of Junior Accountant as sanctioned and may be sanctioned by the State Government from time to time in the respective Zila Parishads.

4. Scale of Pay.—The scale of pay for the post of Junior Accountant shall be as under:—

(a) Pay band for regular appointees: PB-Rs. 5910—20200 + 1900 Grade Pay.

(b) Emoluments for contractual appointees: Rs. 5910+1900=7810/- per month as per details given in rule 13; and

(c) The monthly remuneration shall be provided to the Junior Accountant out of the Grant- in-Aid provided by the State Government.

5. Type of post (whether selection or non Selection post).—The post of the Junior Accountant shall be non-selection.

6. Age for direct appointment.—A person to be appointed as Junior Accountant shall be eligible if he is having the age between 18 and 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on ad-hoc or on contract basis:

Provided further that if a candidate appointed on ad-hoc basis or on contract basis had become overage on the date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age limit by virtue of his such ad-hoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/ Other Categories of persons to the extent permissible under the General or Special Order (s) of the State Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servant before absorption in Public Sector Corporations/ Autonomous Bodies at the time of initial constitution of such Corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the Post(s) is/ are advertised for inviting applications or notified to the Employment Exchanges, as the case may be.

(2) Age and experience, in the case of direct appointment, are relaxable at the discretion of the State Government in case the candidate is otherwise well qualified.

7. Minimum educational qualifications required for direct appointment.—(1) Bachelor's Degree in Commerce or Arts with (Economics or Maths or Accounting as one of the subjects) with not less than 50% marks. (45% marks in the case of Scheduled Castes/Scheduled Tribes) from Himachal Pradesh University or any other institute recognized by the Himachal Pradesh Government.

(2) Preference shall be given to those candidates who have knowledge of customs, manners and dialect of Himachal Pradesh and suitability for appointment in the peculiar condition prevailing in the Pradesh.

8. Period of Probation.—The regular appointee shall remain under probation for a period of two years subject to such further extension for a period of not exceeding one year, as may be ordered by the Chief Executive Officer of Zila Parishad in special circumstances and reasons thereof to be recorded in writing.

9. Method of appointment.—The candidate shall be appointed by direct recruitment either on regular basis or on contract basis, as the case may be.

10. Essential requirement for direct/contract appointment.—The candidate to be appointed as Junior Accountant must be a bonafide resident of Himachal Pradesh.

11. Selection for appointment.—The selection to the post, in case of direct or contractual appointment, as the case may be, shall be made by the Selection Committee as per details given in Rule 13 (IV).

12. Conditions of Service for regular appointees.—The regularization of the contract employees shall be made in accordance with the policy of regularization of the contract employees of the State Government. The Junior Accountant so regularized under the Zila Parishad Cadre shall be entitled for availing the facility of National Pension Scheme (NPS) as has been notified vide notification dated 27th September, 2017. The other conditions of service in the case of regular appointees shall apply mutatis-mutandis as are applicable in case of State Government Junior Accountants.

13. Selection for appointment to the post by contract appointment.—Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT:

(a) Under these rules the Junior Accountant in Zila Parishad will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis the concerned Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract will be renewed/ extended after taking prior approval of the Director, Panchayati Raj.

(b) Post Falls Within The Purview of The Himachal Pradesh Staff Selection Commission : The Chief Executive Officer of the concerned Zila Parishad after obtaining the approval of the Government to fill up the vacant posts on contract basis shall send requisition to the Himachal Pradesh Staff Selection Commission Hamirpur.

(c) The Selection will be made in accordance with eligibility conditions prescribed in these rules.

(II) CONTRACTUAL EMOLUMENTS:

The Junior Accountant appointed on contract basis will be paid consolidated fixed contractual amount @ 7810/-P.M. (which shall be equal to minimum of the pay band+ Grade pay). An amount of Rs. 235/- (3% of the minimum of pay band + grade pay of the post) as annual increase in contractual emoluments for the subsequent years(s) will be allowed if contract is extended beyond one year.

(III) APPOINTING/DISCIPLINARY AUTHORITY:

The Chief Executive Officer of the concerned Zila Parishad will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS:

Selection for appointment to the post, in case of Contract Appointment will be made on the basis of interview/personality test or if considered necessary or expedient by a interview/personality test preceded by a screening rest (objective type)/ written test or practical test or physical test, the standard/syllabus etc. of which will be determined by the concerned recruiting agency i.e. Himachal Pradesh Staff Selection Commission Hamirpur.

After selection of a candidate, an appointment letter will be issued to him in Form-I and he/she shall sign an agreement as per Form-II appended to these rules.

(VI) TERMS AND CONDTIONS:

(a) The contractual appointee will be paid fixed contractual amount @ 7810/- P.M. (which shall be equal to initial of the pay in pay band+ grade pay). The contract appointee will be entitled for increase in contractual amount i.e. 3% of minimum of the pay band+ grade pay of the post for further extended year(s) and no other allied benefits such as senior selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) The contract appointee will be entitled for one day causal leave after putting one month service, 10 days medical leave and 5 days special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical reimbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee :

Provided that un-availed casual leave, medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from the duty without the approval of the Chief Executive Officer, Zila Parishad shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty :

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on administrative grounds.

(f) The selected candidate, in case of a gazetted Government Servant, by the medical board and in the case of non-gazetted Government servant by the Government medical Officer, must submit a certificate of his/her fitness. In case of women candidates, who are to be appointed against posts carrying hazardous nature of duty and if they have to complete the term of the training as condition of service, such female candidates, who found to be pregnant for 12 weeks or more will stand temporarily unfit and his appointment will be deferred till the end of confinement. Such women candidates will be re-examined for medical suitability after six weeks from the date of confinement and if it is found suitable by submission of fitness certificate from the above mentioned authority, then it shall be appointed for the post reserved for it.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

(h) Provisions of service rules like FR/SR, Leave Rules, GPF Rules, Pension Rules and Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled to the emoluments as defined in this column.

14. Appointing Authority.—(1) The Chief Executive Officer of concerned Zila Prishad shall be the appointing authority and letter of appointment shall be issued by the Chief Executive Officer, Zila Parishad.

(2) The Secretary of the concerned Zila Parishad shall be the controlling officer for tour programme, leave etc.

15. Seniority of Junior Accountant.—The seniority of the regular Junior Accountant shall be determined as the merit list formulated by the recruiting agency or in case of the Junior Accountants earlier appointed under the Scheme shall be determined from the date of joining and consolidated and maintained at Directorate level.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/ Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

17. Job Chart.—The job chart for the Junior Accountant shall be such as may be specified by the Chief Executive Officer of Zila Parishad from time to time.

18. Training and Examination.—The members of the service shall have to qualify examination or to undergo such courses for training as may be specified by the Chief Executive Officer of Zila Parishad with the approval of the Government, from time to time:

Provided that three chances shall be provided to qualify such examination within five years and in the event of not qualifying the examination by the concerned employee, the services of such employee shall be liable to be terminated.

19. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post (s). 20. Repeal and Savings.—(1) On and from the date of commencement of these rules, the Scheme notified for the appointment of Junior Accountant on contract basis by Panchayat Samitis vide notification No. PCH-HB (1) 43/01, dated 20th August, 2001 shall stand repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken, under the scheme so repealed, shall be deemed to have been validly made, done or taken under these rules.

2. that no other allowance, whatsoever admissible to the employees of State Government from time to time shall be paid to him/her;

3. that the appointment shall be on contract basis initially for a period of one year from the date of joining which may be extended as per the provisions of the rules;

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as a Junior Accountant on contract basis on the following terms and conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a Junior Accountant for a period of 1 (one) year commencing on day of___________ and ending on the day of______________ It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on__________________and information notice shall not be necessary:

Provided that for further extension/renewal of contract period the Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then the period of contract is to be renewed/extended.

2. The contractual amount of the FIRST PARTY will be Rs. 7810/- per month.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

4. The contract appointee will be entitled for one day causal leave after putting one month service. 10 days medical leave and 5 days special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical reimbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee;

Provided that un-availed casual leave, medical leave and special leave can be accumulated upto the calander year and will not be carried forward for the next calendar year.

5. Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

6. An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

7. The selected candidate, in case of a gazetted Government Servant, by the medical board and in the case of non-gazetted Government servant by the Government medical Officer, must submit a certificate of his/her fitness. In case of women candidates, who are to be appointed against posts carrying hazardous nature of duty and if they have to complete the term of the training as condition of service, such female candidates, who found to be pregnant for 12 weeks or more will stand temporarily unfit and his appointment will be deferred till the end of confinement. Such women candidates will be re-examined for medical suitability after six weeks from the date of confinement and if it is found suitable by submission of fitness certificate from the above mentioned authority, then it shall be appointed for the post reserved for it.

8. Contract appointee shall be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

9. The Employees Group Insurance Scheme as well as EPF/GPF will not be applicable to contractual appointee(s).

No.VS-Legn.-Rules Comm./1-30/2014.—The Rules Committee in its Second Report (Thirteenth Vidhan Sabha) 2019- 20, recommended certain amendments to the Rules of Procedure and Conduct of Business of Himachal Pradesh Legislative Assembly, 1973. The Report was laid on the table of the House on 20-08-2019. Within seven days, no notice of amendment under rule 261(3) was received. Thus in accordance with the provisions of Rule 261(3), these recommendations are deemed to have been approved by the House. Consequently, the Hon'ble Speaker is pleased to order that these amendments be incorporated in the Rules as per annexure 'A' appended to this notification.

विषय.--पंचायत अभिलेख में जन्म तिथि दर्ज करने बारे।

हर खास व आम जनता को बजरिया इश्तहार के माध्यम से सूचित किया जाता है कि Sh. Maya Bhagat Negi ने अधोहस्ताक्षरी के न्यायालय में एक प्रार्थना-पत्र मय शपथ-पत्र प्रस्तुत किया है कि उसकीे पुत्री Miss Aarzoo Negi का जन्म दिनांक 03-12-1994 को हुआ है तथा अज्ञानतावश प्रार्थी ने उसका पंजीकरण ग्राम पंचायत छितकुल के जन्म पंजीकरण रजिस्टर में दर्ज नहीं करवाया है, अब प्रार्थी उपरोक्त नाम व जन्म तिथि ग्राम पंचायत छितकुल के जन्म पंजीकरण रजिस्टर में दर्ज करवाना चाहता है, इस बारे आदेश जारी करने का अनुरोध किया है।

अतः आम जनता ग्राम पंचायत छितकुल, तहसील सांगला, जिला किन्नौर को बजरिया इश्तहार के माध्यम से सूचित किया जाता है कि यदि Sh. Maya Bhagat Negi की पुत्री Miss Aarzoo Negi का जन्म दिनांक 03-12-1994 का पंंजीकरण ग्राम पंचायत छितकुल के जन्म पंजीकरण रजिस्टर में दर्ज करने बारे कोई आपत्ति हो तो वह दिनांक 03-10-2019 या इससे पूर्व अदालत हजा में हाजिर आकर अपना एतराज पेश कर सकता है अन्यथा आवेदन-पत्र पर जन्म पंजीकरण आदेश पारित कर सचिव ग्राम पंचायत छितकुल को आगामी कार्यवाही हेतु भेज दिया जायेगा।

आज दिनांक 02-09-2019 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी कर दिया गया। मोहर।

Khanag, Tehsil Anni, District Kullu, H.P. has moved an application in the office of the undersigned accompanying with an5851 राजपत्र, हिमाचल प्रदेश, 12 सितम्बर, 2019/21 भाद्रपद, 1941 affidavit stating that the birth event of his daughter Miss Shivani d/o Hem Raj born on 31-07-2016 has not been entered in the record of Gram Panchayat Khanag.

Hence, the general public is hereby made aware through this notice that if any person or relative have any objection regarding entering birth event of daughter of the applicant born on 31-07-2016 in the Panchayat record of Gram Panchayat Khanag, he/she/they may file his /her/their objections on or before 25-09-2019 before this court. In case of non-filing of any objection, the ex-parte order will be passed.

Darshan Lal, r/o H.No. 305/11 Katcha Tank Nahan, District Sirmaur, H.P. and Smt. Santosh d/o Sh. Jai Pal, r/o H. N0. 148 Govindpura, District Yamunanagar (HR) have filed an application for the registration of their marriage, which was solemnized on 26-06-2019 and they have been living as husband and wife ever since then.

Notices are given to all concerned and general public to this effect that if any body has got any objection regarding the registration of marriage duly solemnized between above said Shri Raman s/o Shri Mohan Lal, r/o H. Jai Pal, r/o H. N0. 148 Govindpura, District Yamunanagar (HR) they should file their written objections and should appear personally or through their authorized agents before me within a period of thirty days from the date of issue of this notice. After expiry of the said period, the marriage certificate would be issued to the applicants by this court and later on no objection will be heard and accepted.
