संख्या पर (एपी)-सी-सी (17)-2/2018.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग, शिमला, हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर के कार्यक्षेत्र के अन्तर्गत या के बाहर वर्ग-III तथा वर्ग-IV के पदों पर नियुक्ति के लिए पात्रता निर्धारित करने लिए निम्नलिखित नियम बनाते हैंः--

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम "हिमाचल प्रदेश वर्ग-III व वर्ग-IV के पदों पर भर्ती हेतु पात्रता, नियम, 2019" है।

2. प्रारम्भ व प्रभाव.--(1) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे।

(2) इन नियमों को सरकार के किसी भी विभाग में भारत के संविधान के अनुच्छेद 309 के अन्तर्गत बनाए गए वर्ग-III और वर्ग-IV के पदों के भर्ती और प्रोन्नति नियमों के खण्ड 7 के साथ पढ़ा जाए। (3) ये नियम अन्य सरकारी उपक्रमों/निगमों/बोर्डों/स्वायत्त निकायों इत्यादि पर इन्हेंं अंगीकृत करने पर लागू होंगे।

3. परिभाषाएं.--इन नियमों म,ें जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :--

(क) ''संविधान'' से भारत का संविधान अभिप्रेत है;

(ख) ''राज्यपाल'' से हिमाचल प्रदेश का राज्यपाल अभिप्रेत है;

(ग) ''सरकार'' से हिमाचल प्रदेश की सरकार अभिप्रेत है;

4. भर्ती के लिए पात्रता.--(i) अभ्यर्थी, वर्ग-III के पद (पदों) पर नियुक्ति के लिए तभी पात्र होगा/होगी, यदि उसने हिमाचल प्रदेश में अवस्थित किसी स्कूल/संस्थान से दसवीं और 102 कीे परीक्षा उत्तीर्ण की हो; और वर्ग-IV के पद (पदों) पर नियुक्ति के लिए तभी पात्र होगा/होगी यदि उसने हिमाचल प्रदेश में अवस्थित किसी स्कूल/संस्थान से आठवीं या दसवीं की परीक्षा उत्तीर्ण की हो :

परन्तु यह शर्त हिमाचल प्रदेश के स्थायी निवासियों को लागू नहीं होगी।

No. Per (AP)-C-C (17)-2/2018.— In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor of Himachal Pradesh is pleased to frame the following Rules to determine the eligibility for appointment to Class-III and Class IV posts within or outside the purview of the Himachal Pradesh Public Service Commission, Shimla, Himachal Pradesh Staff Selection Commission, Hamirpur, as under:—

1. Short title.—These rules may be called "The Himachal Pradesh Eligibility for Appointment to Class-III and Class-IV Posts, Rules, 2019."

2. Commencement and Effect.—(1) These rules shall come into force with effect from the date of publication in the official Gazette (E-Gazette) H.P.

(2) These rules may be read with Clause 7 of the Recruitment and Promotion Rules framed under Article 309 of the Constitution of India in any Government Department for any Class-III and Class-IV posts.

(3) These Rules shall also apply to other Government undertakings/Corporations/ Board/Autonomous Bodies etc. subject to adoption thereof.

3. Definitions.—In these Rules, unless the context otherwise requires:—

(a) "Constitution" means the Constitution of India;

(c) "Government" means the Government of Himachal Pradesh;

(d) "Bonafide Himachali" means a person, who has been defined as such by the Government of Himachal Pradesh from time to time.

4. Eligibility for recruitment.— A candidate shall be eligible for appointment to Class- III post(s), if he/she has passed Matriculation and 10+2 and for Class-IV post(s), if he/she has passed Middle or Matriculation from any School/Institution situated within Himachal Pradesh:

Provided this condition shall not apply to Bonafide Himachalis.

अदालत हजा में श्री देव राज पुत्र मेद राम, निवासी गांव धान्दो, डाकघर सायरी, उप-तहसील ममलीग, तहसील कण्डाघाट, जिला सोलन, हि0 प्र0 ने दिनांक 11-09-2019 को अपनी जाति दुरुस्ती हेतु प्रार्थना-पत्र प्रस्तुत किया है। प्रार्थी ने व्यक्त किया है कि उसकी पैतृक जाति वर्ष 1915 के अनुसार शजरा नस्व में जाति भाट बलेसर है, परन्तु राजस्व रिकार्ड पटवार वृत्त सायरी में उसकी जाति वर्ष 1971-72 के शजरा नस्व में भाट वलीमर दर्ज की गई है जोकि गलत है को दुरूस्त किया जाये।

अतः सर्वसाधारण को इश्तहार द्वारा सूचित किया जाता है कि श्री देव राज पुत्र मेद राम, निवासी गांव धान्दो, डाकघर सायरी, उप-तहसील ममलीग, तहसील कण्डाघाट, जिला सोलन, हि0 प्र0 सव्य व पैतृक जाति भाट बलेसर है को दुरुस्त करने बारे किसी को उजर/एतराज हो तो इस इश्तहार के जारी होने के 30 दिन के भीतर लिखित/मौखिक असालतन/वकालतन अधोहस्ताक्षरी की अदालत में प्रस्तुत कर सकता है। यदि उक्त समय अवधि के भीतर कोई एतराज प्राप्त नहीं होता है तो राजस्व रिकार्ड में प्रार्थी की जाति भाट वलीमर के स्थान पर भाट बलेसर दर्ज करने बारे आदेश जारी किये जाएंगे।8058 राजपत्र, हिमाचल प्रदेश, 20 नवम्बर, 2019/29 कार्तिक, 1941 आज दिनांक 07-10-2019 को हमारे हस्ताक्षर व मोहर अदालत हजा द्वारा जारी किया गया। मोहर।
