No. FFE-B-F(5)-4/2018.—The Governor of Himachal Pradesh is pleased to promulgate the following rules regulating payment of Grant-in-Aid to the Community User Groups under the Van Smaridhi Jan Smaridhi (VSJS) Scheme operative in Himachal Pradesh:—

258-राजपत्र/2020-28-02-2020 (10955)10956 राजपत्र, हिमाचल प्रदेश, 28 फरवरी, 2020/9 फाल्गुन, 1941 1. Short Title and Extent: (i) These Rules may be called "Rules Regulating the Grant-in-Aid to the Community User Groups under the Van Smaridhi Jan Smaridhi scheme in Himachal Pradesh.

(ii) These Rules shall come into force immediately.

2. Definitions.—In these Rules, unless there is any thing repugnant in the subject or context:—

(i) 'Department' means the Himachal Pradesh Forest Department.

(ii) 'Govt.' means the Government of Himachal Pradesh.

(iii) 'Secretary' means the Secretary to the Govt. of Himachal Pradesh in the Himachal Pradesh Forest Department.

(iv) 'PCCF (HoFF)' means the Principal Chief Conservator of Forests (Head of Forest Force) in the Himachal Pradesh Forest Department.

(v) 'HPSFDCL' means the HP State Forest Development Corporation Ltd; which shall be the Nodal Agency for procurement of NTFPs under the Scheme?

(vi) 'State Nodal Officer' means the Additional Principal Chief Conservator of Forests (Research & training), who shall be the Nodal Officer for implementation of the VSJS Scheme Himachal Pradesh Forest Department.

(vii) 'CF' means the Conservator of Forests of the Circle concerned.

(viii) 'DFO' means the Divisional Forest Officer of the Division concerned.

(ix) 'NTFP' means the Non timber Forest produce as applicable to Department. (x) 'Revenue' means the revenue administered by Himachal Pradesh Govt. (xi) 'VSJS' means Van Smaridhi Jan Smaridhi Scheme.

(xii) 'BMC' means the Biodiversity Management Committee constituted under the ambit of HP State Biodiversity Board under Biological Diversity Act, 2002.

(xiii) 'CUG' mean the Community User Groups formed under the Van Smaridhi Jan Smaridhi (VSJS) Scheme.

(xiv) 'Cluster' means the group of CUGs formed under the Van Smaridhi Jan Smaridhi (VSJS) Scheme.

(xv) 'Forest Guard' means the Beat incharge who shall also be the Secretary of BMC.

(xvi) 'Head' means the member of CUG elected so by CUG who shall also jointly operate the Bank account of CUG as envisaged in VSJS Scheme.

(xvii) 'Treasurer' means the member of CUG elected so by CUG who shall also jointly operate the Bank account of CUG as envisaged in VSJS Scheme.

3. Purpose of the Grant-in-Aid.—The purpose of Grant-in-aid is for the furtherance of objectives of Van Smaridhi Jan Smaridhi Scheme (VSJS) and its implementation through the Community User Groups formed under BMCs. The assistance in the shape of Grant-in-Aid would be meant for expenditure on Creation & organizing of CUGs; Seed Money to CUGs to meet miscellaneous expenses for carrying out Plantation and their maintenance; Creation of Revolving Fund for procurement by HPSFDCL; Seed money for private entrepreneurs, NGOs/Societies for procurement and Branding; Subsidy for setting up of Processing units; Training and workshops and Miscellaneous Expenses etc. to the availability of funds, and based on such norms, and for such other purposes, as may be decided by the Govt. from time to time. All Grant-in- Aid disbursal will be guided by transparent norms, framed in advance, to govern not merely the unit of cost of different activities, but to also specify maximum costing for amounts for different activities that individual Groups would be entitled to.

4. Mode of Payment.—The concerned DFO will prepare Annual Plan of operation (APO) along with requirement of funds for each year in consultation with respective BMC/Community User Group and will submit it to the State Nodal Officer-cum- Additional Principal Chief Conservator of Forests (Research & Training) through concerned Conservator of Forests who shall further submit it to the Pr.CCF (HoFF) for the sanction of Budget for a Financial Year. The proposal for a financial year will be submitted by the end of December of previous year so that appropriate budget provisions are made in advance for the Scheme in its budgetary projections. The Pr.CCF (HoFF) will convey the approved APO and allocation of budget to the concerned Conservators/DFOs. The budget shall be spent by the DFOs as per the approved APO. Preferably, the members of CUG shall be engaged by the department for carrying out various activities such as setting up of nurseries under the scheme. The budget such as seed money meant for the CUG as per the approved APO will be released by the concerned DFO and deposited into the account of concerned CUG in the shape of Grant –in-Aid. The Bank account of the CUG will be operated with joint signatures of the Head of CUG and Treasurer. The CUG will get the works of plantation and maintenance executed at its level preferably by the willing members of the CUG or engaging other labour. The plantation and maintenance in the allocated land banks will be monitored by concerned Forest Guard who is Secretary of the BMC. CUG shall initially maintain the seed money of Rs. 10,000 as its revolving fund and it will be enhanced gradually to an amount of Rs. 50,000 from subsequent grant from the department, sale amount of NTFPs & medicinal plants. Based on performance of CUGs and proper utilization of seed money, the department shall consider release of grant upto Rs.10,000 each year from second year onwards till it reaches Rs. 50,000. The CUG will submit a completion report and utilization Certificate (UC) for the funds received as Grant-in-Aid to DFO concerned for record.

5. Conditions for Grant-in-Aid.—The sanction of the Grant -in-Aid shall be subject to following conditions:—

(i) That the DFO shall have right to check the accounts of the BMCs/CUGs, to satisfy himself that the Grant-in-Aid has been spent for the purpose for which it has been sanctioned. In case it is found that the Grant-in-Aid has been mis-10958 राजपत्र, हिमाचल प्रदेश, 28 फरवरी, 2020/9 फाल्गुन, 1941 utilized, it will be open to the DFO to recover the aid from the BMCs/CUGs, and to stop further payment.

(ii) The assets acquired wholly or substantially out of Govt. grants would not, without the prior sanction of the Govt., be disposed of, encumbered or utilized for purposes other than those for which grants are sanctioned. The BMCs/CUGs shall maintain a register in respect of the permanent and semi- permanent assets acquired wholly or mainly out of Govt. grant. This register should be maintained by the BMCs/CUGs separately in respect of each sanctioning authority to whom a copy thereof will be furnished annually for permanent record. The assets would be taken to means all immovable and movable property of capital nature where the value exceeds Rs. 10000/-. Library books and articles of furniture will not, however, be included in it.

6. Maintenance of Accounts:

1. The CUGs shall maintain its accounts and records and the same will be open to inspection by the nominee(s) so deputed by the Government.

2. An un-audited utilization certificate will be furnished by the CUGs in respect of Grant-in-Aid released to the CUGs during a particular year by 15th April of next year to the sanctioning authority, who will furnish the same to the Accountant General H.P. The account in respect of the Grant-in-Aid released to the CUGs for various activities under APO during a particular year, under VSJS Scheme, will be furnished by the DFO to the Accountant General (Audit) H.P. by the end of September of the next/ following year of sanction of Grant-in-Aid. The VSJS account of the CUGs will be audited by a qualified Accountant, or any other agency approved by the Government, before December next, in order to ensure proper utilization of the amount of the Grant-in-Aid released by the Department to the CUGs. Thereafter the CUGs will submit one copy of the audited utilization certificate in respect of each activity to the DFO. The installment in respect of the Grant-in-Aid for a particular year will be released by the DFO on the basis of audited utilization certificate furnished by the CUGs.

7. Miscellaneous.—In order to ascertain the utilization of funds released to CUGs by DFOs under various activities, the Conservators shall furnish a Progress report to the Addl. PCCF (R&T) who is State Nodal officer under the VSJS Scheme and who shall submit it further to PCCF (HoFF) H.P. and/or Secretary (Forests) to the H.P. Govt., as and when desired by him.

8. Head of Account.—The expenditure on account of payment of Grant-in-Aid is to be charged under Head 2406-01-800-10-SOON and Major Head 2406-01-796-35-SOON Van Samaridhi Jan Samaridhi or any other Budget Head under which funds provided to the beneficiaries for the purpose.

31 मार्च, 2020 को समाप्त होने वाले वित्तीय वर्ष के लिए हिमाचल प्रदेश राज्य की संचित निधि में से सेवाओं के लिए कतिपय और धनराशियों के संदाय को प्राधि—त करने और उनका विनियोग करने के लिए विधेयक।

भारत गणराज्य के इकहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विनियोग अधिनियम, 2020 है। 2. हिमाचल प्रदेश राज्य की संचित निधि में से वित्तीय वर्ष 2019-2020 के लिए ` 67,36,56,39,392 की और राशि जारी करना.--हिमाचल प्रदेश राज्य की संचित निधि में से अनुसूची के तृतीय स्तम्भ में 10960 राजपत्र, हिमाचल प्रदेश, 28 फरवरी, 2020/9 फाल्गुन, 1941 विनिर्दिष्ट से अनधिक धनराशियां, जिनका योग केवल ` 67,36,56,39,392 (छह हजार सात सौ छत्तीस करोड,़ छप्पन लाख, उनतालीस हजार, तीन सौ बानवे रुपए) हैं, संदत्त और उपयोजित की जाए, जिनका वित्तीय वर्ष 2019-2020 की अवधि में अनुसूची के द्वितीय स्तम्भ में विनिर्दिष्ट सेवाओं और प्रयोजनों से सम्बन्धित विभिन्न प्रभारों को चुकाने के लिए उपयोग किया जाएगा।

यह विधेयक, भारत के संविधान के अनुच्छेद 205 के साथ पठित अनुच्छेद 204 के खण्ड (1) के अनुसरण में हिमाचल प्रदेश राज्य की संचित निधि में से वित्तीय वर्ष 2019-2020 के लिए हिमाचल प्रदेश सरकार के अनुमानित व्ययों के सम्बन्ध में संचित निधि पर प्रभारित व्ययों और विधान सभा द्वारा यथा दत्तमत अन्य व्ययों को पूरा करने के लिए हिमाचल प्रदेश राज्य की संचित निधि में से अपेक्षित और धन के विनियोजन का उपबंध करने के लिए पुरःस्थापित है।

BILL

to authorise payment and appropriation of certain further sums from and out of the

Consolidated Fund of the State of Himachal Pradesh for the services for the financial year ending

on 31st day of March, 2020.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy first Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Appropriation Act, 2020.

2. Issue of a further sum of ` 67,36,56,39,392 out of the Consolidated Fund of the State of Himachal Pradesh for the financial year 2019-2020.—From and out of the Consolidated Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those specified in column (3) of THE SCHEDULE amounting in the aggregate to a sum of ` 67,36,56,39,392 (Rupees six thousand seven hundred thirty six crores, fifty six lakh, thirty nine thousand, three hundred ninety two) only towards defraying the several charges which will come in course of payment during the financial year 2019-2020 in respect of the services and purposes specified in column (2) of THE SCHEDULE.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be further appropriated for the services and purposes expressed in THE SCHEDULE in relation to the period specified under section 2 of this Act.

"Whether termination of services of Shri Sanjay Kaundal s/o Shri S.R. Kaundal, Village Jamog, P.O. Juni, Tehsil Sunni, District Shimla, H.P. vide termination notice dated 2-3-2016 by (i) The Director SRL Ltd., G.P. 26 Maruti Industrial Estate Udyog Vihar, Sector 18, Gurgaon Haryana (ii) Rahul Singh, Senior Manager, Human Resources SRL Ltd. G.P. 26 Maruti Industrial Estate Udyog Vihar, Sector 18, Gurgaon Haryana (iii) Dr. Selja Lab Head, SRL Diagnostic, IGMC Hospital, Shimla, H.P. without complying with the provisions of the industrial Disputes Act, 1947 is legal and justified? If not what relief including reinstatement, amount of back-wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employers ?"

2. It is averred in the statement of claim that the petitioner came to be appointed as a Scientific Officer in SRL Diagnostic, IGMC, Shimla on 24.9.2014 after appearing in an interview. The salary of the petitioner had been fixed at Rs. 15,075/- per month. The employee code of the petitioner was 6617. The petitioner had maintained absolute integrity while in service.

3. Unfortunately, a show cause notice had been issued to the petitioner just to harass and humiliate him on 19.2.2016, which was however delivered to him only on 3.3.2016. The petitioner had replied to the same through registered post on 11.3.2016, which is annexed along-with the statement of claim.

4. The allegations leveled against the petitioner that he had manipulated the report as well as prescription from OPD in IGMC Hospital, Shimla, was false and just to harass and humiliate the petitioner. The allegation was leveled at the instance of respondent No. 3 with whom the petitioner did not enjoy good relations.

5. On the contrary, it is the case of the petitioner that he was suffering from acute jaundice as such was on leave from 16.2.2016 till 2.3.2016. After having recovered from illness when he went to join on 3.3.2016, the respondent No. 3 did not allow him to join his duties. He was however informed that his services had been dispensed with orally.

6. The services of the petitioner were terminated orally. The said oral termination is stated to be voilative of the provisions of section 25-F, 25-G and 25-H of the Industrial Disputes Act, 1947 (hereinafter referred to be as the Act). The order of termination is further stated to be10969 राजपत्र, हिमाचल प्रदेश, 28 फरवरी, 2020/9 फाल्गुन, 1941 arbitrary, malafide and issued in violation of the provisions of Article 14 & 16 of Constitution of India and even against the basic principles of natural justice. The petitioner is still stated to be unemployed.

7. The petitioner thus prays that his termination be set aside and quashed and he be ordered to be reinstated with all consequential benefits including seniority and back-wages.

8. While contesting the claim the respondents have raised preliminary objections vis-a- vis maintainability as the petitioner does not fall within the definition of "workman" as defined in Section 2 (s) of the Act. The petition is also stated to be bad on account of the acts, deeds, conduct and acquiescence of the petitioner. The petitioner is stated to have not only concealed true and material facts from this Court, but, he is further estopped from filing the petition as he had allegedly manipulated reports to create a false medical prescription. The test reports of the petitioner dated 8.2.2016 were finalized at 6.00 P.M. whereas the OPD in IGMC Hospital is open till 4.00 P.M. The petitioner thus fabricated a false report to procure leave from his duty. The petitioners is stated to have remained absent from his duties from 12.2.2016 and he never joined till his termination. The petition is thus liable to be dismissed out rightly as per the respondents. The petitioner is also stated to have tarnished the image of the respondents, which happens to be a pioneer diagnostic company of the country. The claim is also stated to be not maintainable as the petitioner is gainfully employed somewhere else.

9. The respondents also pray that they may be allowed to lead fresh evidence to prove the misconduct of the petitioner in case they are not able to prove the misconduct so alleged in the reply.

10. On merits, the contentions are retreated that the petitioner had fabricated false test reports and thereupon remained absent from his duties w.e.f. 12.2.2016 till his termination. The petitioner is stated to have been effectually terminated w.e.f. 3.3.2016 itself. It is further averred by the respondents that the respondent No. 2 had issued a show cause notice to the petitioner even on 19.2.2016. The petitioner had not replied to the same and even did not resume his service. Eventually, the respondent No.2 had issued a letter of termination to the petitioner on 2.3.2016, which had been duly received and acknowledged by the petitioner. The rest of the contents of the claim petition are denied.

11. While filing rejoinder, the petitioner controverted the averments in the reply filed by respondents and further reiterated those in the statement of claim.

12. I notice that on 4.9.2018, the following issues came to be framed by my Learned Predecessor:

(1) Whether the termination of the services of the petitioner by the respondents vide termination notice dated 2.3.2016, without complying with the provisions of Industrial ..OPP. Disputes Act, 1947 is illegal and unjustified?

(2) If issue No.1 is proved in affirmative, to what relief of service benefits the petitioner is ..OPP.

entitled to?

(3) Whether the claim petition is not maintainable as alleged?

..OPR.

(4) Whether the petitioner is not a workman, as alleged?

..OPR.

(5) Relief10970 राजपत्र, हिमाचल प्रदेश, 28 फरवरी, 2020/9 फाल्गुन, 1941 13. Having considered the pleadings, evidence and other attendant material placed on record, my findings on the issues framed are thus:—

Issue No. 1 : Yes.

Issue No. 2 : Entitled to reinstatement with seniority and continuity but without back-wages.

Issue No. 3 : No

Issue No. 4 : No

Relief : Reference is answered partly in favour of the petitioner and against the respondents per operative part of award.

REASONS FOR FINDINGS

Issue No. 4:

14. The respondents have raised a preliminary objection vis-a-vis maintainability of the reference which was also vociferously urged by the learned counsel for the respondents that the present reference is not maintainable as the petitioner was working as a Scientific Officer in SRL Diagnostic and was earning more than Rs. 15,000/- per month.

15. Admittedly, the petitioner was working as a Scientific Officer and initially the salary of the petitioner was fixed at Rs. 15075/ per month, as is clear from the statement of claim itself, the affidavit filed by the petitioner in his evidence Ex. PW-1/A and the letter of appointment Ex. PW- 1/B.

16. The provisions of Section 2(s) which defines "workman" does carve out a proviso that a person who is employed in a supervisory capacity and draws wages exceeding Rs. 10,000/- per month or exercises either by the nature of duties attached to the office or by reason of the powers vested in him, functions mainly of a managerial nature, he would not fall within the definition of "workman".

17. In the case in hand admittedly the petitioner was drawing salary more than Rs. 10,000/- , however, nothing has been placed or proved on record that the petitioner was working in a supervisory capacity or his functions were mainly managerial in nature, while being posted as a Scientific Officer. Neither the appointment letter Ex. PW-1/B show that the petitioner was working in a supervisory capacity nor the RW-1 Dr. Shailja and one Shri Anil Sharma, (RW-2), Manager HR of the respondent company has anywhere stated in their affidavits that the petitioner was performing supervisory functions while working as a Scientific Officer.

18. A bald statement has been made by RW-2 that the petitioner was appointed as a Scientific Officer at SRL, IGMC Shimla and as such he does not come under the ambit of a "workman" as defined in section 2(s) of the Act. Apart from the above there is nothing to remotely suggest that while working as a Scientific Officer, the petitioner was indeed exercising some supervisory or managerial control. The respondents had to atleast prove that the petitioner was only performing supervisory work and as such since he was drawing salary more than Rs. 10,000/- in month, he would not fall within the definition of "workman". The appointment letter Ex. PW-1/B, also does not show that the petitioner had a supervisory job. The profile of the job has not been mentioned in the letter too. I am thus constrained but to hold that the petitioner fall within the definition of a "workman" and the issue thus is decided against the respondents.

19. All these issues being correlated and intermingled are being taken up together for decision.

20. The petitioner admittedly came to be terminated vide a letter dated 2.3.2016 (Mark R-2 on record). Shri Anil Sharma, RW-2, Manager HR of SRL Diagnostic, Chandigarh has also stated so in his affidavit Ex. RW-2/A, though, the termination letter has not been proved or placed on record by the respondents. The letter, however, was put to the petitioner in his cross-examination.

21. The case set out by the respondents, however, is that the petitioner had fabricated and manipulated test reports to create a false medical prescription with an ulterior motive and design. It is also averred by the respondents that the said test report of the petitioner dated 8.2.2016 was finalized at 6.00 P.M. whereas the OPD in IGMC Hospital is open till 4.00 P.M. The petitioner is thus further stated to have remained absent from 12.2.2016 till his termination, and that too without any authorization.

22. Both the witnesses of the respondents have deposed that the petitioner was primarily terminated for having fabricated his own test report by changing its value. Both the witnesses further deposed that the petitioner had even been issued a show cause notice dated 19.2.2016. The same was not replied by the petitioner and hence the respondent No.2 had issued termination letter dated 2.3.2016 which was to take effect from 3.3.2016. The show cause notice is Mark R-1 on record.

23. The show cause also does talk about the manipulation of the test reports. As per the petitioner he had replied to the same on 8.3.2016 as is clear from Ex. PW-1/C and mark P-3 on record. But, by then the petitioner had already been terminated.

24. The show cause notice mark R-1 and the stand taken by the respondents in the reply and the testimony of RW-1 & RW-2, however, does go to show that the termination of the petitioner was actually based for some act and conduct of the petitioner which could be termed as misconduct and indeed had punitive ramifications. In this behalf even a show cause notice was issued to the petitioner on 19.2.2016 vide Mark R-1.

25. Admittedly, beyond the show cause notice no further steps were taken by the respondents to conduct an enquiry against the petitioner for alleged misconduct. Both RW-1 & RW-2 admitted that no enquiry was conducted before terminating his services. Given the nature of allegations and the conduct resorted to by the petitioner, the least which was required was that some enquiry worth the name should have been conducted. The petitioner should not have been condemned unheard. Since, the termination was based on the certain set of allegations made against the petitioner, he should have been heard or should have been given a chance to explain the circumstances arising against him on record. The respondents though issued a show cause Mark R- 2, but, for the reasons best known to them thereafter immediately proceeded to terminate the services of the petitioner. Since, a misconduct had been attributed to the petitioner some sought of departmental proceedings had to be initiated to bring home the guilt, necessitating the termination of the petitioner.

26. The learned counsel for the respondents would thus however contend that even if no enquiry has been held by the employer, the Tribunal in order to satisfy itself about the legality and validity of the order can afford opportunity to the employer and the employee to adduce evidence before it. In this behalf he seeks support from the judgment of the Hon'ble Supreme Court titled as M/s Amrit Vanaspati Co. Ltd. Vs. Khem Chand and another, Appeal (Civil) 6677 of 200410972 राजपत्र, हिमाचल प्रदेश, 28 फरवरी, 2020/9 फाल्गुन, 1941 decided on 12.7.2006. Based on the aforesaid, the learned counsel for the respondents contend that the documentary evidence placed by him on record is sufficient to hold the petitioner guilty of his misconduct. The electronic record placed by him in admissible in evidence as per the judgment of the Hon'ble Supreme Court in Anwar P.V. Vs. P.K Basheer & Ors. 2014 (4) Civil Court Case 535 (S.C.). I am afraid, both the judgments relied hereinabove supra, do not come to the rescue of the respondents. Even in Amrit Vanaspati's case referred hereinabove a proper chargesheet for misconduct had been issued and an enquiry had been conducted against the delinquent. The proposition of law discussed in the judgment arises in a case where a preliminary issues is framed vis-a-vis legality and validity of the enquiry proceedings and in case the Court comes to a conclusion that proper opportunity has not been afforded to the delinquent and the enquiry is quashed and set aside for a procedural lapse, the Court has to provide ample opportunity to the employer and employee to prove the misconduct. That being so the documents placed on record by the respondents in the present proceedings cannot be ex-facie looked into to hold the petitioner guilty of misconduct. Resultantly, the ratio of the aforesaid judgments, detailed hereinabove also does not auger to the benefit of the respondents. In the present case admittedly no enquiry had been conducted.

27. By now it is fairly well settled that if an employer wants to punish an employee on the ground of any misconduct, he can do so only inconformity with the principles of natural justice. Even, where no procedure or Rules are envisaged, the concerned authority would at least have to furnish the charges leveled against the employee and offer him some opportunity of hearing. Where the employer is not governed by any set of Rules, Regulations or statutory provisions, the only obligation to be observed is that the principles of natural justice have to be complied with. The Rules of audi-alteram-partem atleast has to be followed. Thus, a distinction is carved out between "no opportunity" and "no adequate opportunity". In the case of "no opportunity" the orders passed would undoubtedly be in valid in the eyes of law.

28. The basic requirements thus is that there must be fair play in action and the decision arrived at must be just and objective, having regard to the relevance of the material against the delinquent and the reasons thereof. In the sphere of public employment, it is again well settled that any action taken by the employer against an employee must be fair, just and reasonable. The conferment of absolute power to terminate the services of an employee is anti thesis to the true, fair, just and reasonable treatment. The object underlying the Rule of natural justice " is to prevent miscarriage of justice" and secure "fair play in action". The principles of natural justice are thus fundamental rules, the breach of which will prevent justice from being seems to be done. The non- holding of enquiry thus has undoubtedly prejudiced the cause of the petitioner. He could not have been condemned unheard and thereafter visited with civil consequences entailing his termination. The action of the respondent thus is held to be bad in the eyes of law. In such a case, however, liberty will be reserved for the authority to take proceedings afresh according to law i.e. keeping in view of rules of audi-alteram-partem (without hearing the other side).

29. Since, the respondents had not conducted any enquiry whatsoever before terminating the services of the petitioner for the alleged misconduct, the maintainability of the claim on account of the acts, deeds and conduct of the petitioner will not be of much relevance and as such it cannot be said that the reference itself will not be maintainable.

30. As a sequel to the discussion held hereinabove the termination of the petitioner w.e.f. 2.3.2016 is held to be bad in the eyes of law and is set aside and quashed. The respondents are directed to reinstate the petitioner at the same post and place. However, seeking to the nature of allegations and the misconduct attributed to the petitioner he shall not be entitled to back-wages for the aforesaid period. The respondents shall also be at liberty to take proceedings afresh against the petitioner, if so advised, but, according to law. All the three issues are decided accordingly.

For the foregoing reasons discussed hereinabove supra, the reference is partly allowed. The termination of the petitioner w.e.f. 2.3.2016 is held to be bad in the eyes of law and is consequently set aside and quashed. The respondents are directed to reinstate the petitioner at the same post and place. However, seeking to the nature of allegations and the misconduct attributed to the petitioner he shall not be entitled to back-wages for the aforesaid period. The respondents shall also be at liberty to take proceedings afresh against the petitioner, if so advised, but, according to law. Let a copy of this award be sent to the appropriate government for publication in the official gazette. File, after completion, be consigned to records.

दिनेश रावत पुत्र स्व0 रणवीर सिंह, गांव खौणी, डाकघर हाटकोटी, उप-तहसील सरस्वती नगर, जिला शिमला (हि0प्र0) ने इस न्यायालय में एक प्रार्थना-पत्र गुजारा है कि उसका भाई श्री राकेश कुमार पुत्र स्व0 रणवीर सिंह, गांव खौणी, डाकघर हाटकोटी, उप-तहसील सरस्वती नगर, जिला शिमला (हि0प्र0) पिछले 18-19 वर्षों से लापता है जो उप-महाल सरस्वती नगर के कागजात माल में मालिक अराजी दर्ज है लेकिन उक्त राकेश कुमार 18-19 वर्षों से लापता है इसलिए उसका इन्तकाल बरास्त बराए मकफूद-उल-खबरी प्रकाशित करके तस्दीक किया जाए।

अतः आम जनता को इस इश्तहार/नोटिस द्वारा सूचित किया जाता है कि यदि इस बारा किसी को कोई उजर या एतराज हो तो वह असालतन या वकालतन दिनांक 26-03-2020 को प्रातः 10.00 बजे उस अदालत में हाज़िर आकर अपनी आपाि दर्ज़ करवा सकता है। कोई एतराज न होने की सूरत में इन्तकाल बरास्त तस्दीक करने के आदेश जारी कर दिए जाएंगे।
