संख्याः एफ.एफ.ई.-बी-एफ(13)-5/2017-I.—हिमाचल प्रदेश भू-परिरक्षण अधिनियम, 1978 (1978 का अधिनियम संख्यांक 28) की धारा 4 के अधीन जारी आदेश संख्याः एफ.एफ.ई.-बी-ए(3)-4/99, तारीख 10-09-2002, जिसे तारीख 04 अक्तूबर, 2002 को राजपत्र, हिमाचल प्रदेश (असाधारण) में प्रकाशित किया 260-राजपत्र/2020-02-03-2020 (11039) 11040 राजपत्र, हिमाचल प्रदेश, 02 मार्च, 2020/12 फाल्गुन, 1941 गया है, द्वारा राज्य के कतिपय क्षेत्रों में प्राइवेट भूमि से वृक्षों के कटान (गिरान) को अस्थायी रूप से विनियमित, निर्बन्धित और प्रतिषिद्ध किया गया है;

और राज्य सरकार का, पूर्वोक्त अधिनियम की धारा 7 के अधीन सम्यक्‌ रूप से जांच करने के पश्चात्‌, समाधान हो गया है कि उक्त अधिनियम के उपबन्धों को कार्यान्वित करने के प्रयोजन के लिए उक्त आदेश का और संशोधन किया जाना आवश्यक और समीचीन है;

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वोक्त अधिनियम की धारा 4 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त आदेश में निम्नलिखित संशोधन करने के आदेश देते हैं, अर्थात्‌ः-

संशोधन

1. पैरा-1 का संशोधन.-आदेश संख्याः एफ.एफ.ई.-बी-ए(3)-4/99, तारीख 10-09-2002 (जिसे इसमें इसके पश्चात्‌ "उक्त आदेश" कहा गया है) के पैरा 1 के पाँचवें परन्तुक के अन्त में चिन्ह "।" के स्थान पर "ः" चिन्ह रखा जाएगा और तत्पश्चात्‌ निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा; अर्थात्‌ः- "परन्तु यह और कि पैरा 7(iii) के अन्तर्गत यथावर्णित प्रयोजन के लिए काटे (गिराए) गए वृक्षों के बदले में लगाए गए वृक्षों का सम्बद्ध वन वृत्त के मुख्य अरण्यपाल/अरण्यपाल द्वारा निरीक्षण किया जाएगा।"।

2. पैरा 7 का संशोधन.-उक्त आदेश के पैरा 7 के उप-पैरा (iii) के स्थान पर निम्नलिखित रखा जाएगा; अर्थात्‌ः-

"(iii) जहां सरकारी/प्राइवेट भूमि लोक प्रयोजन, जैसे कि अवसंरचना प्रसुविधाओं के सृजन, आवासीय परियोजनाएं, आवासीय परिसर या सिंचाई और जलापूर्ति लाईनों या पारेषण लाईनों अथवा कोई अन्य प्रवहण पद्धति बिछाना या उद्योग, हाइड्रो पावर प्रॉजेक्ट (जल विद्युत्‌ परियोजनाएं), सौर ऊर्जा परियोजनाएं, पर्यटन इकाई या शैक्षणिक संस्थाएं अथवा कोई अन्य प्रसुविधाएं, जो लोक हित में हैं, स्थापित करने के लिए अर्जित की गई या पट्‌टे पर दी गई है या क्रय की गई है या अन्तरित की गई है"।

ORDER

Shimla-2, the 27th February, 2020

No. FFE-B-F(13)-5/2017-I.—WHEREAS, vide Order No. FFE-B-A(3)-4/99, dated 10-09-2002, issued under section 4 of the Himachal Pradesh Land Preservation Act, 1978 (Act No. 28 of 1978) and published in the Rajpatra Himachal Pradesh (Extra Ordinary) on 4th of October, 2002, felling of trees from the private land were temporarily regulated, restricted and prohibited in certain areas of the State;

AND WHEREAS, the State Government is satisfied, after due enquiry under section 7 of the Act ibid, it is necessary and expedient further to amend the said order for the purpose of giving effect to the provisions of the said Act;

NOW, THEREFORE, in exercise of the powers conferred by Section 4 of the Act ibid, the Governor, Himachal Pradesh is pleased to make the following amendments in the said Order, namely:—

AMENDMENTS

1. Amendment of Para-1.— In para 1 of Order No. FFE-B-A(3)-4/99, dated 10-09-2002 (hereinafter referred to as the "said order"), in the end of fifth proviso for the sign '.', the sign ':' shall be substituted and thereafter the following proviso shall be inserted, namel:—

"Provided further that trees to be planted in lieu of trees to be felled for the purposes as mentioned under para-7 (iii) shall be inspected by the Chief Conservator of Forests/Conservator of Forests of the concerned Forest Circle.".

2. Amendment of para-7.— In para 7 of the said order, for sub-para (iii), the following shall be substituted, namely:—

"(iii) where Government/private land has been acquired or leased or purchased or transferred for a public purpose such as creation of infrastructure facilities, housing projects, residential complex or laying of irrigation and water supply lines or transmission lines or any other conveyance systems or setting up industries, hydro-power projects, solar power projects, tourism units or educational institutions or any other facilities which are in the public interest".

संख्या रैव0स्टाम्प(एफ)6-1/2009-IV.—हिमाचल प्रदेश के राज्यपाल, भारतीय स्टाम्प अधिनियम, 1899 (1899 का 2) की धारा 47-अ के साथ पठित धारा 75 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सरकार की अधिसूचना संख्या रैव-1-2 (स्टाम्प) 1/87-वौल-I, तारीख 26-06-1992 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 20 जुलाई, 1992 को प्रकाशित हिमाचल प्रदेश स्टाम्प (लिखत न्यून मूल्यांकन निवारण) नियम, 1992 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः- 1. सक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश स्टाम्प (लिखत न्यून मूल्यांकन निवारण) संशोधन नियम, 2020 है। 11042 राजपत्र, हिमाचल प्रदेश, 02 मार्च, 2020/12 फाल्गुन, 1941 (2) ये नियम, राजपत्र (ई-गजट), हिमाचल प्रदेश में इस अधिसूचना के प्रकाशन की तारीख से प्रवृत्त होंगे।

2. नियम 4 का संशोधन.--हिमाचल प्रदेश स्टाम्प (लिखत न्यून मूल्यांकन निवारण) नियम, 1992 के नियम 4 के खण्ड (ग) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"(ग) इमारतों की दशा में.-

(i) संरचना का प्रकार ; (ii) जिस परिक्षेत्र में संनिर्माण किया गया ; (iii) कुर्सा क्षेत्र ; (iv) संनिर्माण-वर्ष ; (v) प्रयुक्त माल की किस्म ; (vi) अवमूल्यन की दर ; (vii) दरों में उतार-चढ़ाव ; (viii) मूल्य से सम्बन्धित कोई अन्य खास बात ; (ix) ऐसी इमारत पर लगाये जाने वाले स्थानीय दरें, नगरपालिका या अन्य कर और सम्बन्धित स्थानीय प्राधिकरण के कराधान-अभिलेख के संदर्भ में इमारत का मूल्यांकन ;

(x) उद्‌देश्य जिसके लिए इमारत प्रयोग की जा रही है और इमारत से किराए द्वारा प्राप्त की जा रही आय, यदि कोई हो ; और

(xi) पक्षकारों द्वारा अभ्यावेदित मामले के प्रति कोई खास बात।"।

No. Rev. Stamp (F)6-1/2009-IV.—In exercise of the powers conferred by Section 75 read with Section 47-A of the Indian Stamp Act, 1899 (Act No. 2 of 1899), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Stamp (Prevention of Undervaluation of Instruments) Rules, 1992, notified vide Government notification No. Rev.1- 2(Stamp)1/87-Vol-I, dated 26-06-1992, published in the Rajpatra, Himachal Pradesh on 20-07-1992, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Stamp (Prevention of Undervaluation of Instruments) Amendment Rules, 2020.

(2) These rules shall come into force from the date of their publication of this notification in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 4.—In rule 4 of the Himachal Pradesh Stamp (Prevention of Undervaluation of Instruments) Rules, 1992, for clause (c) the following shall be substituted, namely:—

"(c). In the case of buildings.—

(i) type of structure; (ii) locality in which constructed; (iii) plinth area; (iv) year of construction; (v) kind of material used; (vi) rate of depreciation; (vii) fluctuation in rates; (viii) any other features that have a bearing on the value; (ix) local rates, municipal or other taxes to which such building may be subject and valuation of building with reference to taxation records of local authority concerned;

(x) the purpose for which the building is being used and the income, if any, by way of rent per annum secured on the building; and

(xi) any special feature of the case represented by the parties."
