शिमला-2, 2 मार्च, 2020

संख्या श्रम(ए)4-8/2019.--इसमें उल्लिखित विभिन्न श्रम संबंधी विधियों की अपेक्षाओं के सुगम, और समीचीन अनुपालन हेतु तथा ऐसी समस्त विधियों के लिए संयुक्त रजिस्टर रखने के प्रयोजनार्थ, उक्त प्रयोजन के लिए पृथक नियम बनाना आवश्यक हो गया है;

272-राजपत्र/2020-18-03-2020 (11345) 11346 राजपत्र, हिमाचल प्रदेश, 18 मार्च, 2020/28 फाल्गुन, 1941 और ऐसे संयुक्त रजिस्टर को उपलब्ध कराने का आशय उक्त श्रम संबंधी विधियों और तदधीन बनाए गए नियमों के प्रयोजनों का अधिक विनिर्दिष्ट रूप से इलेक्ट्रॉनिक रूप में, जिसमें ऐसे रजिस्टरों के अनुरक्षण हेतु उपबंध किए गए है, हित साधन करना है;

और प्रस्तावित नियमों के अधीन उपबंधित संयुक्त रजिस्टर अनुपालन, रखरखाव और निरीक्षण की सुगमता को सुकर बनाएंगे तथा तदधीन उपलब्ध कराई गई जानकारी को भी इलेक्ट्रॉनिक साधनों के माध्यम से जनता तक सहज पंहुच-योग्य बनाएंगे जिसका परिणाम पारदर्शिता लाना होगा;

और पूर्वोक्त प्रयोजन के लिए पृथक्‌ नियम बनाए जाने से विभिन्न श्रम संबंधी विधियों के अधीन उपबंधित रजिस्टरों के संदर्भो को बनाने में फायदा होगा जिससे लोक प्रयोजन की बेहतर ढंग से पूर्ति होगी;

और पूर्वोक्त प्रयोजनों की प्राप्ति के लिए हिमाचल प्रदेश के राज्यपालः-.

(1) भवन एवं अन्य सन्निर्माण कर्मकार (नियोजन का विनियमन और सेवा शर्तें) अधिनियम, 1996 (1996 का 27) की धारा 62;

(2) ठेका श्रम (विनियमन और उत्सादन) अधिनियम, 1970 (1970 का 37) की धारा 35;

(3) अंतर-राज्यिक प्रवासी कर्मकार (नियोजन का विनियमन और सेवा शर्तें) अधिनियम, 1979(1979 का 30) की धारा 35;

(4) न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11) की धारा 30 और;

(5) मजदूरी संदाय अधिनियम, 1936 (1936 का 4) की धारा 26;

द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विभिन्न श्रम संबंधी विधियों की अपेक्षाओं के सुगम और समीचीन अनुपालन हेतु नए नियम अर्थात हिमाचल प्रदेश विभिन्न श्रम विधियाें के अधीन रजिस्टरों के रख- रखाव के अनुपालन की सुगमता नियम, 2019 को बनाने का प्रस्ताव करते हैं तथा उन्हे, एतदद्वारा जन साधारण की जानकारी हेतु राजपत्र, हिमाचल प्रदेश में प्रकाशित किया जाता है;

कोई हितबद्ध व्यक्ति जिसे इन नियमों से सम्बन्धित कोई आक्षेप (पों) या सुझाव (वोंं) है/हैं तो वह उन्हें उक्त प्रारूप नियमों के राजपत्र (ई-गज़ट) हिमाचल प्रदेश में प्रकाशन की तारीख से 30 दिन की अवधि के भीतर श्रम आयुक्त, हिमाचल प्रदेश, हिमरस भवन, शिमला-1 को भेज सकेगा;

ऊपर विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप या सुझाव, यदि कोई हो, पर राज्य सरकार द्वारा उक्त प्रारूप नियमों को अंतिम रूप देने से पूर्व विचार किया जाएगा, अर्थातः-

संक्षिप्त नाम और प्रारम्भ.--(i) इन नियमों का संक्षिप्त नाम विभिन्न श्रम विधियों के अधीन रजिस्टरों के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 है।

(ii) ये नियम राजपत्र (ई-गज़ट) हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

1. कतिपय श्रम संबंधी विधियों के अधीन रजिस्टरों का रख-रखाव.-(1) निम्नलिखित के अधीन बनाए गए किसी नियम में अंतर्विष्ट किसी बात के होते हुए भीः-

(i) भवन एवं अन्य सन्निर्माण कर्मकार (नियोजन का विनियमन एवं सेवा शर्तों) अधिनियम, 1996 (1996 का 27);

(ii) ठेका श्रम (विनियमन और उत्सादन) अधिनियम, 1970 (1970 का 37);

(iii) अंतर-राज्यिक प्रवासी कर्मकार (नियोजन का विनियमन और सेवा शर्तें) अधिनियम, 1979 (1979 का 30);

(iv) न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11) और;

(v) मजदूरी संदाय अधिनियम, 1936 (1936 का 4);

इन नियमों में विनिर्दिष्ट प्रपत्रों में संयुक्त रजिस्टर या तो इलैक्ट्रानिक रूप में या अन्यथा बनाए जाएंगे तथा इनके अधीन बनाएंगे पूर्वोक्त अधिनियमितियों और नियमाें जो इसमें निर्दिष्ट हैं, के प्रयोजनों के लिए प्रयोग में लाए जाएंगे।

(2) यदि उप-नियम (1) में निर्दिष्ट संयुक्त रजिस्टर उक्त उप-नियम में निर्दिष्ट अधिनियमितियों मे से किसी अधिनियमिति के अधीन नियुक्त संबंधित निरीक्षक द्वारा निरीक्षण के लिए आपेक्षित होता है; यथास्थिति संबंधित व्यक्ति सूचना को सुगम बनाने के प्रयोजनों के लिए आवश्यक संयुक्त रजिस्टर उपलब्ध कराएगा या आवश्यक विशिष्टियों का उपबंध करेगा।

(3) जहांॅ उप-नियम (1) में निर्दिष्ट कोई रजिस्टर इलैक्ट्रानिक प्ररूप में बनाया जाता है, वहां रजिस्टर के विन्यास और प्रस्तुति को रजिस्टर के स्तंभों की अक्षतता, क्रम संख्यांक और अंतर्वस्तु में परिवर्तन किए बिना, किंतु अन्यथा नहीं, समायोजित किया जा सकेगा।

2. कतिपय नियमों का संशोधन.-निम्नलिखित नियमों में उन बातों के सिवाय जिन्हें ऐसे संशोधन से पहले किया गया है या किए जाने का लोप किया गया है नीचे विनिर्दिष्ट रीति में संशोधन किया जाएगा अर्थात्‌ः-

(i) भवन और अन्य सन्निर्माण कर्मकार (नियोजन का विनियमन एंव सेवा शर्तें) हिमाचल प्रदेश नियम, 2008 मेंः-

(अ) नियम 240 में, "इन नियमों से संलग्न प्ररूप 15" शब्दों और अंको के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टरों के रखरखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में विनिर्दिष्ट प्रारूप क" शब्द और अंक रखें जाएगें;

(आ) नियम 241 के उप-नियम (1) में

(क) खण्ड (क) में, "इन नियमों से संलग्न क्रमशः प्ररूप 16 और प्ररूप 17 में क्रमशः एक मस्टर रोल और एक रजिस्टर" शब्दों और अंको के स्थान पर विभिन्न श्रम विधियों के अधीन रजिस्टरों के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में विनिर्दिष्ट क्रमशः प्ररूप ख" और प्ररूप घ में मजदूरी रजिस्टर और मस्टर रोल'' शब्द, अक्षर और अंक रखे जाएगें;

(ख) खण्ड (क) के परंतुक का लोप किया जाएगा;

(ग) खण्ड (ख) में, "इन नियमों से संलग्न प्ररूप 19, प्ररूप 20 और प्ररूप 21 में क्रमशः शब्दों, अंको और चिन्हों के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टराें के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश चिन्ह और नियम, 2019 की अनुसूची में विनिर्दिष्ट प्ररूप ग" में" शब्द अक्षर और अंक रखें जायेंगे;

(घ) खण्ड ग में, "इन नियमों से संलग्न प्ररूप 22,में शब्दों, चिन्हों और अंको के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टराें के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में विनिर्दिष्ट प्ररूप ख" में" शब्द अंक और अक्षर रखें जाएंगे; और 11348 राजपत्र, हिमाचल प्रदेश, 18 मार्च, 2020/28 फाल्गुन, 1941 (2) कन्टै्रक्ट लेबर (रेगुलेशन एंड एबोलिशॅन) हिमाचल प्रदेश रूल्स 1974 में, -

(अ) नियम 75 में, (In form XIII) शब्द और रोमन अंक के स्थान पर In form A Specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" के अधीन रजिस्टरों के रख-रखाव के अनुपालन की सुगमता नियम, 2019 की अनुसूची में शब्द, अक्षर और अंक रखे जाएंगे;

(आ) रूल 78 में-

(i) सब-रूल (1)

(क) क्लॉज (a) में "Muster-Roll" शब्दों के स्थान पर "फॉम D" शब्द और अक्षर रखे जाएंगे;

(ख) क्लॉज (b) में "Register of wages" शब्दों के स्थान पर "फॉम D" शब्द और अक्षर रखे जाएंगे;

(ग) क्लॉज (c) में "Register of deductions" शब्दों के स्थान पर "फॉम C" शब्द और अक्षर रखें जाएंगे;

(घ) क्लॉज (d) में "Register of overtime" शब्दों के स्थान पर "फॉम B" शब्द और अक्षर रखें जाएंगे;

(ङ) क्लॉज (e) में "Register of fine's" शब्दों के स्थान पर "फॉम C" शब्द और अक्षर रखें जाएंगे;

(च़) क्लॉज (f) में "Register of advance" शब्दों के स्थान पर "फॉम C" शब्द और अक्षर रखें जाएंगे;

(ii) सब-रूल-2 में,-

(क) क्लॉज (a) में "In form xvi and form xvii respectively" शब्दों और रोमन अंको के स्थान पर "in form D and form B respectively, specified in the schedule to the Himachal Pradesh Ease of compliance to maintain registers under various Labour Laws Rules, 2019" शब्द, अक्षर, चिन्ह और अंक रखे जाएंगे।

(ख) क्लॉज (a) के Proviso का लोप किया जाएगा;

(ग) क्लॉज (C) में "Register of wages & wages-cum-muster roll" शब्दों के स्थान पर "पद form D and form B respectively" शब्द और अक्षर रखे जाएंगेय

(घ) क्लॉज (D) esa "in form xx form xxi and form xxii respectively" शब्दों और रोमन अंको के स्थान पर "in form C specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules 2019" शब्द, और अंक रखे जाएंगे।

(ङ) क्लॉज (E) में "in form xxiii" शब्दों और रोमन अंक के स्थान पर "in form B specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules 2019" शब्द, और अंक रखे जाएंगे।11349 राजपत्र, हिमाचल प्रदेश, 18 मार्च, 2020/28 फाल्गुन, 1941 (3) हिमाचल प्रदेश अन्तर्राज्य

प्रवासी कर्मकार (नियोजन का विनियमन और सेवा की शेर्तें) नियम 1983 में'-

(अ) नियम 49 में "प्रपत्र xii पर" शब्दों और रोमन अंको के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टरों के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में विनिर्दिष्ट प्रपत्र क" में" शब्द, अंक और अक्षर रखे जायेंगे;

(आ) नियम 52 (i) उप-नियम (i) में.-

(क) खंड (क) में "हाजिरी रजिस्टर" शब्दों के स्थान पर "प्रपत्र घ" शब्द और अक्षर रखे जाएंगे;

(ख) खंड ख में "मजदूरी रजिस्टर" शब्दों के स्थान पर "प्रपत्र ख" शब्द और अक्षर रखे जाएंगे;

(ग) खंड ग में "कटौती रजिस्टर" शब्दों के स्थान पर "प्रपत्र ग" शब्द और अक्षर रखे जाएंगे;

(घ) खंड (घ) में "जुर्माना रजिस्टर" शब्दों के स्थान पर "प्रपत्र ग" शब्द और अक्षर रखे जाएंगे;

(ङ) खंड (ङ) में "अतिकालिक कार्य रजिस्टर" शब्दों के स्थान पर "प्रपत्र ख" शब्द और अक्षर रखे जाएंगे;

(च़) ख्ांड (च़) में "अग्रिम रजिस्टर" शब्दों के स्थान पर "प्रपत्र ग" शब्द और अक्षर रखे जाएंगे;

(ii) उप-नियम (2) में-

(क) खंड (क) में, "क्रमशः प्रपत्र गअपप और गअपपप में" शब्दों और रोमन अंकों के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टराें के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में क्रमशः विनिर्दिष्ट प्रपत्र क और प्रपत्र ख में शब्द, अंक और अक्षर रखें जाएंगे;

(ख) खंड (ख) में, "मजदूरी रजिस्टर पर" शब्दों के स्थान पर प्रपत्र ख" में" शब्द, अंक और अक्षर रखें जाएंगे;

(ग) खंड (ग) में क्रमशः x, xix, xx, और xxi पर" शब्दाऐं चिन्हों और रोमन अंकों के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टरों के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में विनिर्दिष्ट प्रपत्र ग में " शब्द, अंक और अक्षर रखे जाएंगे;

(घ) खंड (घ) में "प्रपत्र xxiii पर" शब्दों और रोमन अंकाें के स्थान पर "विभिन्न श्रम विधियों के अधीन रजिस्टरों के रख-रखाव के अनुपालन की सुगमता हिमाचल प्रदेश नियम, 2019 की अनुसूची में विनिर्दिष्ट प्रपत्र ख में " शब्द, अंक और अक्षर रखे जाएंगे; और 3. हिमाचल प्रदेश मिनिमम वेजिज रूल्ज, 1978 में,-

(अ) रूल 22 के सब रूल (4) में, "In form I and II respectively" शब्दों, और रोमन अंको के स्थान पर "in form C of specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" शब्द, अक्षर और अंक रखे जाएंगे;

11350 राजपत्र, हिमाचल प्रदेश, 18 मार्च, 2020/28 फाल्गुन, 1941 (आ) रूल 23 में "In form iv" शब्दों, और रोमन अंकाें के स्थान पर "in form B of specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" शब्द, अक्षर और अंक रखे जाएंगे;

(इ) रूल 27 के सब रूल (3) में "In form v" शब्दों, और रोमन अंक के स्थान पर "in form B specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" शब्द, अक्षर और अंक रखे जाएंगे; और

(ई) रूल 31 के सब रूल (1) में " In form viii, ix or x" as the case may be शब्दों, रोमन अंकाें और चिन्हों के स्थान पर "in form B specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" शब्द, अक्षर और अंक रखे जाएंगे;

4. दी हिमाचल प्रदेश पेमैंट ऑफ वेजिज रूल्ज़, 1979 में,-

(अ) रूल 3 के सब रूल (1) में, "In form I" शब्दों, और रोमन अंक के स्थान पर "in form C specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" शब्द, अक्षर और अंक रखे जाएंगे;

(आ) रूल 4 में, "In form II" शब्दों, और रोमन अंकों के स्थान पर "in form C specified in the schedule to the Himachal Pradesh Ease of compliance to maintain Registers under various Labour Laws Rules, 2019" शब्द, अक्षर और अंक रखे जाएंगे; और

NOTIFICATION

Shimla-2, the 2nd March, 2020

No. Shram (A)4-8/2019.—Whereas for the ease of, and for the expedient compliance of the requirements of the various labour related laws referred to herein and for the purpose of maintaining combined registers for all such laws, it has become essential to frame separate rules for the said purpose;

And whereas the intention to provide such combined register is to sub-serve the purposes, more specifically electronically, of the said labour related laws and the rules made there under, wherein provisions have been made for maintenance of such registers;

And whereas combined registers provided under the proposed rules will facilitate ease of compliance, maintenance and inspection, and will also make the information provided there under easily accessible to the public through electronic means thereby increasing transparency;

And whereas making separate rules for the aforementioned purpose will benefit making references of registers provided under different labour related laws simple, which will serve public purpose in a better way;

And whereas to achieve the aforementioned proposes, the Governor of Himachal Pradesh purposes to make the new rules i.e. the Himachal Pradesh Ease of Compliance to Maintain Registers under Various Labour Laws/Rules, 2019 for the ease of and for the expedient compliance of the requirements of the various labour related laws, in exercise of the powers conferred by:—

(1) Section 62 of the Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Act, 1996 (27 of 1996);

(2) Section 35 of the Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970);

(3) Section 35 of the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 (30 of 1979);

(5) Section 26 of the Payment of Wages Act, 1936 (4 of 1936), and the same are hereby published in the Rajpatra, Himachal Pradesh for the information of General Public;

Any interested persons who has any Objection(s) or suggestion(s) with regard to these rules, may send the same to the Labour Commissioner, Himachal Pradesh, Himrus Bhawan, Shimla-1 within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-Gazette) Himachal Pradesh;

The Objection(s) or suggestion(s) if any, received within the period specified above shall be taken into consideration by the State Government before finalizing the said draft rules, namely:-

Short title and commencement.—(1) These rules may be called the Himachal Pradesh Ease of Compliance to Maintain Registers under various Labour Laws Rules, 2019.

(2) They shall come into force from the date of their publication in the Rajpatra (e- Gazette), Himachal Pradesh.

1. Maintenance of registers under certain labour related laws.—(1) Notwithstanding anything contained in any rules made under the,—

(i) The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (27 of 1996);

(ii) The Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970);

(iii) The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 (30 of 1979);

(iv) The Minimum Wages Act, 1948 (11 of 1948);

(v) The Payment of Wages Act, 1936 (4 of 1936);

The combined registers in the Forms specified in the Schedule to these rules shall be maintained either electronically or otherwise and used for the purposes, of the aforesaid enactments and the rules made there under, as specified therein.

(2) If the combined register referred to in sub-rule (1) is required for inspection by the concerned Inspector appointed under any of the enactments referred to in the said sub-rule, the concerned persons shall make available the combined registers or provide the necessary particulars for the purposes of accessing the information, as the case may be.

(3) Where any register referred to in sub-rule (1) is maintained in electronic form, then, layout and presentation of the register may be adjusted without changing the integrity, serial number and contents of the columns of the register, but not otherwise.

2. Amendment of certain rules.—The following rules shall be amended, except as respects things done or omitted to be done before such amendment, in the manner specified below, namely:—

(1) in the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008,—

(A) in rule 240, for the words and figures "Form XV, annexed to these rules", the words, letter and figures "Form A specified in the Schedule to the Himachal Pradesh Ease of Compliance to Maintain Registers under various Labour Laws Rules, 2019 " shall be substituted;

(B) in rule 241, in sub-rule (1),—

No. GAD-B(B)15-2/2019-I.—Consequent upon receipt of Circular No.13 from the Registrar General of India, Ministry of Home Affairs, Government of India, the Governor, Himachal Pradesh, in exercise of powers conferred under Rule 8(ii) of The Census Rules, 1990, is pleased to direct the public to co-operate in furnishing accurate and unambiguous information in respect of the questions that may be put to them through census during the Census of India, 2021.The utility of the Census data and penalties under Section 11 of the Census of India Act, 1948 are described as under:—

(i) The Census is the only source of providing the basic benchmark data on housing condition, facilities available to the households and the state of human resources at various administrative levels up to the villages in rural areas and towns/wards in urban areas. It is widely used for planning and formulation of policies and effective Public Administration by the Central/State/UT Governments. Apart from this, Census data are used for delimitation and reservation of Constituencies for Parliamentary, Assembly, Panchayats and other Local Bodies. Thus, the public are to co-operate in census taking and provide the correct information. Some of the important provisions in the Census Act, 1948 are reproduced below for information of the public.

(ii) Section 8: (1) A census-officer may ask all such questions of all persons within the limits of the local area for which he is appointed as, by instructions issued in this behalf by the Central Government and published in the Official Gazette, he may be directed to ask.

(2) Every person of whom any question is asked under sub-section (1) shall be legally bound to answer such question to the best of his knowledge or belief:

Provided that no person shall be bound to state the name of any female member of his household and no woman shall be bound to state the name of her husband or deceased husband or of any other person whose name she is forbidden by custom to mention.

(iii) Section 9: Every person occupying any house, enclosure, vessel or other place shall allow census-officer such access thereto as they may require for the purposes of the census and as, having regard to the customs of the country, may be reasonable, and shall allow them to paint on, or affix to, the place such letters, marks or numbers as may be necessary for the purpose of the census.

(iv) Section 10: (1) Subject to such orders as the Census Commissioner may issue in this behalf, a census-officer may, within the local area for which he is appointed, leave or cause to be left a schedule at any dwelling-house or with the manager or any officer of any commercial or industrial establishment, for the purpose of its being filled up by the occupier of such house or of any specified part thereof or by such manager or officer with such particulars as the Census Commissioner may direct regarding the inmates of such house or part thereof, or the persons employed under such manager or officer, as the case may be, at the time of the taking of the census.

(2) When such schedule has been so left, the said occupier, manager or officer, as the case may be, shall fill it up or cause it to be filled up to the best of his knowledge or belief so far as regards the inmates of such house or part thereof or the persons employed under him, as the case may be, at the time aforesaid, and shall sign his name thereto and, when so required, shall deliver the schedule so filled up and signed to the census-officer or to such person as the census-officer may direct.

(v) Section 11: (1) – (a)Any census-officer or any person lawfully required to give assistance towards the taking of census who refuses to perform any duty imposed upon him by this Act or any rule made thereunder, or any person who hinders or obstructs another person in performing any such duty, or

(aa) any census-officer or any person lawfully required to give assistance towards the taking of a census who neglects to use reasonable diligence in performing any duty imposed upon him or in obeying any order issued to him in accordance with this Act or any rule made thereunder, or any person who hinders or obstructs another person in performing any such duty or obeying any such order, or;

(d) any person who intentionally gives a false answer to, or refuses to answer to the best of his knowledge or belief, any question asked of him by a census-officer which he is legally bound by section 8 to answer, or

(e) any person occupying any house, enclosure, vessel or other place who refuses to allow a census-officer such reasonable access thereto as he is required by section 9 to allow, or (f) any person who removes, obliterates, alters, or damages any letters, marks or numbers which have been painted or affixed for the purposes of the census, or

(g) any person who, having been required under section 10 to fill up a schedule, knowingly and without sufficient cause fails to comply with the provisions of that section, or makes any false return thereunder, or

(h) any person who trespasses into a census office, shall be punishable with fine which may extend to one thousand rupees and in case of a conviction under part (a) shall also be punishable with imprisonment which may extend to three years.

(2) Whoever abets any offence under sub-section (1) shall be punishable with fine which may extend to one thousand rupees.

(vi) Section 15: No person shall have a right to inspect any book, register or record made by a census-officer in the discharge of his duty as such, or any schedule delivered under section 10, and not withstanding anything to the contrary in the Indian Evidence Act, 1872 (1 of 1872), no entry in any such book, register, record or schedule shall be admissible as evidence in any civil proceeding whatsoever or in any criminal proceeding other than a prosecution under this Act or any other law for any act or omission which constitutes and offence this Act.

And whereas, they have also stated that they were not aware of the laws of the registration of marriages with the Registrar of Marriages and now, therefore necessary orders for the registration of their marriage be passed so that their marriage is registered by the concerned authority.

Now, therefore, objections are invited from the general public that if anyone has any objection regarding the registration of the marriage of the above named applicants, then they should appear before the court of undersigned on 23-03-2020 at Tehsil Office Dharamshala at 2.00 P.M. either personally or through their authorized agent.

उपरोक्त प्रार्थना-पत्र श्री राजेश पुत्र श्री लायक राम, निवासी टिपरी, तहसील ददाहू, जिला सिरमौर, हि0 प्र0 ने अधीन धारा 13(3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 के अन्तर्गत प्रस्तुत करके प्रार्थना की है कि वह अपनी जन्म तिथि 15-02-1993 जो ग्राम पंचायत कोटी धीमान के रिकार्ड में दर्ज नहीं है जिसे प्रार्थी अब दर्ज करवाना चाहता है।
