NOTIFICATION
Shimla-2, the 6th April, 2020
No. Health-C-A(3)-4/2020.—WHEREAS, regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011 prohibits the use of tobacco and nicotine as ingredients in any food products; AND WHEREAS, Tobacco, containing Gutka or 03-राजपत्र/2020-11-04-2020 (63)64 राजपत्र, हिमाचल प्रदेश, 11 अप्रैल, 2020/22 चैत्र, 1942 Pan Masala, Scented/Chewing Pan Masala or Supari, Khaini, Masheri, Zarda, etc. known by any names are injurious to health;
AND WHEREAS, Gutka is an article of food which contains Pan Masala and now-a-days contains Tobacco, Nicotine and Magnesium Carbonate as ingredients, and thus contravenes Regulation 2.3.4 of Food Safety and Standards (Prohibition and Restriction on Sales) Regulations, 2011 as well as Regulation 3.1.7 of Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011;
AND WHEREAS, Pan Masala is an article of food which contains Magnesium Carbonate as an ingredient and thus contravenes Regulation 3.1.7 of Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011;
AND WHEREAS, it is expedient to prohibit the manufacture, storage, sale, distribution of products i.e. Gutka, Pan Masala, Scented/Chewing Supari, Khaini, Masheri, Zarda etc. as final products containing Tobacco or Nicotine or Magnesium Carbonate as ingredients;
AND WHEREAS, it has been observed that to circumvent the ban on sale of Gutka, the manufacturers are selling Pan Masala (without tobacco) with flavoured chewing tobacco in separate sachets but often conjoint and sold together by the same vendors from the same premises, so that consumers can buy the Pan Masala and flavoured chewing tobacco and mix them both and consume the same. Hence instead of the earlier "ready to consume mixes", chewing tobacco companies are selling Gutka in twin packs to be mixed as one;
AND WHEREAS, I, the Food Safety Commissioner, Himachal Pradesh, in exercise of the powers conferred under clause (a) of sub-section 2 of Section 30 of the Act read with Regulation 2.3.4 and 3.1.7 of the aforesaid Regulations, prohibit the manufacture, storage, distribution, sale of Gutka or Pan Masala, Scented/Chewing Pan Masala or Khaini, Masheri, Zarda or any other products marketed separately to constitute a Gutka or Pan Masala a final product (containing tobacco or nicotine), by whatsoever name called whether packaged or un packaged and sold as one product, or though packaged in separate products, sold or distributed in the whole of Himachal Pradesh for a period of one year from the date of publication of this notification in the Rajpatra, Himachal Pradesh and further order that if the said products are manufactured, stored, sold/distributed in the State of Himachal Pradesh, the persons doing so, will be proceeded/ penalized against as per the provisions of the Act ibid.

2020 का हिमाचल प्रदेश अध्यादेश, संख्यांक-1 हिमाचल प्रदेश कतिपय अत्यावश्यकताओं में विभिन्न प्रवर्गों के वेतन और भत्तों का विनियमन अध्यादेश, 2020
भारत गणराज्य के इकहत्तरवें वर्ष में हिमाचल प्रदेश के राज्यपाल द्वारा प्रख्यापित।
कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी के कारण उत्पन्न हुई कतिपय अत्यावश्यकताओं में विभिन्न प्रवर्गों के वेतन के विनियमन के लिए अध्यादेश।
शेष विश्व के साथ ही राज्य कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से जूझ रहा है, जिससे देश के लोगों का स्वास्थ्य गम्भीर हो गया है और आर्थिकी भी प्रभावित हो रही है।
कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से तत्काल राहत और सहायता की महत्वता आवश्यक हो गई है और इसलिए उक्त सर्वव्यापी महामारी को फैलने से रोकने और उसको नियन्त्रित करने हेतु कतिपय अत्यावश्यक उपायों का किया जाना समीचीन हो गया है;
तेजी से बढ़ती परिस्थिति को प्रबन्धित करने और उसको नियन्त्रित करने के आशय से मन्त्रियों, अध्यक्ष, उपाध्यक्ष, मुख्य सचेतक, विधान सभा सदस्यों और राज्य में अन्य उच्चपदस्थों के वेतन और भत्तों को कम करके साधन सृजित करना आवश्यक हो गया है;
क्योंकि हिमाचल प्रदेश विधान सभा सत्र में नहीं हैं और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं जिनके कारण उनके लिए तत्काल कार्रवाई करना आवश्यक हो गया है;
अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित अध्यादेश प्रख्यापित करते हैं :-
| अध्याय-1 प्रारम्भिक | ||
| स् ांक्षिप्त नाम और प्रारम्भ। | 1. | (1) इस अध्यादेश का संक्षिप्त नाम हिमाचल प्रदेश कतिपय अत्यावश्यकताओं में विभिन्न प्रवर्गों के वेतन और भत्तों का विनियमन अध्यादेश, 2020 है। ( 2) यह तत्काल प्रभाव से प्रवृत्त होगा। |
| अध्याय-2 मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 का संशोधन | ||
| ध् ाारा 3 का संशोधन। | 2. | मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (जिसे इसमें इसके पश्चात् इस अध्याय में ''मूल अधिनियम'' कहा गया है) की धारा 3 की उपधारा (1) के पश्चात् निम्नलिखित उपधारा अन्तःस्थापित की जाएगी, अर्थात्ः- ' '(1क) उपधारा (1) मे ं अन्तर्विष्ट किसी बात के होते हुए भी, उपधारा (1) के अधीन किसी मन्त्री को संदेय वेतन को, प्रथम अप्रैल, 2020 से प्रारम्भ होने वाली एक वर्ष की अवधि के लिए, कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से उत्पन्न अत्यावश्यकताओं की पूर्ति हेतु, तीस प्रतिशत तक कम किया जाएगा ।''। |
| धारा 4 का संशोधन। | 3. | मूल अधिनियम की धारा 4 के उपबन्ध को उपधारा (1) के रूप में संख्यांकित किया जाएगा और तत्पश्चात् निम्नलिखित उपधारा अन्तःस्थापित की जाएगी, अर्थात्ः- ' '(2) उपधारा (1) में किसी बात के होते हुए भी, उपधारा (1) के अधीन किसी मन्त्री को संदेय सत्कार भत्ते को, प्रथम अप्रैल, 2020 से प्रारम्भ होने वाली एक वर्ष की अवधि के लिए, कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से उत्पन्न अत्यावश्यकताओं की पूर्ति हेतु, तीस प्रतिशत तक कम किया जाएगा ।''। |
| अध्याय-3 हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 का संशोधन | ||
| ध् ाारा 3 का संशोधन। | 4. | हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 (जिसे इसमें इसके पश्चात् इस अध्याय में ''मूल अधिनियम'' कहा गया है) की धारा 3 की उपधारा (1-अअ) को (1-आ) के रूप मे पुनःसंख्यांकित किया ं जाएगा और तत्पश्चात् निम्नलिखित उपधारा अंतःस्थापित की जाएगी, अर्थात्ः- ' '(1-इ) उपधारा (1) और (1-आ) में अन्तर्विष्ट किसी बात के होते हुए भी, उपधारा-(1) और (1-आ) के अधीन अध्यक्ष को संदेय वेतन और सत्कार भत्ते को, प्रथम अप्रैल, 2020 से प्रारम्भ होने वाली एक वर्ष की अवधि के लिए, कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से उत्पन्न अत्यावश्यकताओं की पूर्ति हेतु, तीस प्रतिशत तक कम किया जाएगा ।''। |

| अध्याय-4 हिमाचल प्रदेश विधान सभा मुख्य सचेतक और उप मुख्य सचेतक का वेतन, भत्ते और अन्य प्रसुविधाएं अधिनियम, 2018 का संशोधन | ||
| धारा 3 का संशोधन। | 6. | हिमाचल प्रदेश विधान सभा मुख्य सचेतक और उप मुख्य सचेतक के वेतन, भत्ते और अन्य प्रसुविधाएं अधिनियम, 2018 की धारा 3 की उपधारा (2) के पश्चात् निम्नलिखित उपधारा अन्तःस्थापित की जाएगी, अर्थात्ः- ' '(3) उपधारा (1) या उपधारा (2) में अन्तर्विष्ट किसी बात के होते हुए भी, यथास्थिति, किसी मुख्य सचेतक या उप मुख्य सचेतक को संदेय वेतन और सत्कार भत्ते को, प्रथम अप्रैल, 2020 से प्रारम्भ होने वाली एक वर्ष की अवधि के लिए, कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से उत्पन्न अत्यावश्यकताओं की पूर्ति हेतु, तीस प्रतिशत तक कम किया जाएगा ।''। |
| अध्याय-5 हिमाचल प्रदेश विधान सभा (सदस्यो के भत्ते और पेन्शन) अधिनियम, 1971 ं का संशोधन | ||
| ध् ाारा 3 का संशोधन | 7. | हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेन्शन) अधिनियम, 1971 (जिसे इसमें इसके पश्चात् इस अध्याय में ''मूल अधिनियम'' कहा गया है) की धारा 3 की उपधारा (1) के पश्चात् निम्नलिखित उपधारा अन्तःस्थापित की जाएगी, अर्थात्ः- ' '(1क) उपधारा (1) में अन्तर्विष्ट किसी बात के होते हुए भी, उपधारा (1) के अधीन किसी सदस्य को संदेय वेतन को, प्रथम अप्रैल, 2020 से प्रारम्भ होने वाली एक वर्ष की अवधि के लिए, कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से उत्पन्न अत्यावश्यकताओं की पूर्ति हेतु, तीस प्रतिशत तक कम किया जाएगा ।''। |

| अध्यक्ष, उपाध्यक्ष और राजनैतिक नियुक्तिधारियों | 9. | (1) तत्समय प्रवृत्त किसी अन्य विधि मे ं अन्तर्विष्ट किसी बात के होते हुए भी अध्यक्ष, उपाध्यक्ष या किसी अन्य राजनैतिक नियुक्तिधारी को संदेय वेतन आदि को, प्रथम अप्रैल, 2020 से प्रारम्भ होने वाली एक वर्ष की अवधि के |
| आदि के वेतन का कम किया जाना। | लिए, कोरोना वायरस (कोविड-19) सर्वव्यापी महामारी से उत्पन्न अत्यावश्यकताओं की पूर्ति हेतु, तीस प्रतिशत तक कम किया जाएगाः- परन्तु सरकार, आदेश द्वारा या अवसर की अपेक्षानुसार, जहां तक हो सके, ऐसी कोई बात जो इस अधिनियम के उपबन्धों से संगत हो, कर सकेगी जो इस कठिनाई को दूर करने के प्रयोजन के लिए आवश्यक या समीचीन प्रतीत होती हो। प्रत्येक ऐसा आदेश इस प्रकार प्रभावी होगा मानो ऐसी कार्रवाई इस अध्यादेश के अधीन की गई हो। ( 2) इस अध्यादेश के अधीन किए गए समस्त आदेश इनके किए जाने के पश्चात् यथाशक्यशीघ्र विधानसभा के समक्ष रखें जाएंगें। | |
| अध्यादेश का अध्यारोही प्रभाव होना। | 10. | इस अध्यादेश के उपबन्ध त्तत्समय प्रवृत्त किसी अन्य विधि में या इस अध्यादेश से अन्यथा किसी विधि के फलस्वरूप प्रभाव डालने वाली किसी लिखत मे ं अन्तर्विष्ट उनसे असंगत ऐसी किसी बात के होते हुए भी प्रभावशील होंगे। |

H.P. ORDINANCE NO. 1 OF 2020 THE HIMACHAL PRADESH REGULATION OF SALARIES AND ALLOWANCES OF DIFFERENT CATEGORIES IN CERTAIN EXIGENCIES ORDINANCE, 2020 Promulgated by the Governor of Himachal Pradesh in the Seventy- first Year of the Republic of India.
AN ORDINANCE to regulate the salaries of different categories in certain exigencies arising out of Corona Virus (COVID-19) pandemic.
WHEREAS, the State, as rest of the World, is grappling with Corona Virus (COVID-19) pandemic which has severe health and economic ramifications for the people of the country;
AND WHEREAS, the Corona Virus (COVID-19) pandemic has necessitated the importance of expeditious relief and assistance and therefore, it is expedient to take certain emergent measures to prevent and contain the spread of said pandemic;
AND WHEREAS, in order to manage and control burgeoning situation, it has become necessary to raise resources by reduction of salaries and allowances etc. of Ministers, Speaker, Deputy Speaker, Chief Whip, Members of the Legislative Assembly and other dignitaries in the State;
AND WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the Governor of Himachal Pradesh is satisfied that the circumstances exist which render it necessary for him to take immediate action;
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Governor of Himachal Pradesh is pleased to promulgate the following Ordinance:—

| Short title and commencement. | 1. | be called the Himachal Pradesh (1) This Ordinance may Regulation of Salaries and Allowances of difference categories in Certain Exigencies Ordinance, 2020. ( 2) It shall come into force at once. |
| CHAPTER – II AMENDMENT TO THE SALARIES AND ALLOWANCES OF MINISTERS (HIMACHAL PRADESH) ACT, 2000 | ||
| Amendment of section 3. | 2. | In the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 (hereinafter in this chapter referred to as the "principal Act"), in section 3, after sub-section (1), the following sub-section shall be inserted, namely:— " (1A) Notwithstanding anything contained in sub- section (1), the salary payable to a Minister under sub-section (1), shall be reduced by thirty per cent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.". |
| Amendment of section 4. | 3. | In the principal Act, the provision in section 4, shall be numbered as sub-section (1) and thereafter, the following sub-section shall be inserted, namely:— "(2) Notwithstanding anything contained in sub- section (1), the sumptuary allowance payable to a Minister under sub-section (1), shall be reduced by thirty per cent. for a period of one year April, 2020, to meet the exigencies commencing from the 1st arising out of Corona Virus (COVID-19) pandemic.". |
| CHAPTER – III AMENDMENT TO THE HIMACHAL PRADESH LEGISLATIVE ASSEMBLY SPEAKER'S AND DEPUTY SPEAKER'S SALARIES ACT, 1971 | ||
| Amendment of section 3. | 4. | In the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971 (hereinafter in this chapter referred to as the "principal Act"), in section 3, the sub-section (1-AA) shall be renumbered as (1-B) and thereafter, the following sub- section shall be inserted, namely: — " (1C) Notwithstanding anything contained in sub- section (1) and (1B), the salary and sumptuary allowance payable to the Speaker under sub-section (1) and (1B), shall be reduced by thirty per cent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.". |

| CHAPTER – IV AMENDMENT TO THE SALARIES, ALLOWANCES AND OTHER BENEFITS OF THE CHIEF WHIP AND THE DEPUTY CHIEF WHIP IN THE LEGISLATIVEASSEMBLY OF HIMACHAL PRADESH ACT, 2018 | ||
| Amendment of section 3. | 6. | In the Salaries, Allowances and other Benefits of the Chief Whip and the Deputy Chief Whip in the Legislative Assembly of Himachal Pradesh Act, 2018, in section 3, after sub-section (2), the following sub-section shall be inserted, namely:— "(3) Notwithstanding anything contained in sub- section (1) or sub-section (2), the salary and sumptuary allowance payable to a Chief Whip or a Deputy Chief Whip, as the case may be, shall be reduced by thirty per cent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.". |
| CHAPTER – V AMENDMENT TO THE HIMACHAL PRADESH LEGISLATIVE ASSEMBLY (ALLOWANCES AND PENSION OF MEMBERS) ACT, 1971 | ||
| Amendment of section 3. | 7. | In the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 (hereinafter in this chapter referred to as the "principal Act"), in section 3, after sub-section (1), the following sub-section shall be inserted, namely:— |
| "(1A) Notwithstanding anything contained in sub- section (1), the salary payable to a Member under sub-section (1), shall be reduced by thirty per cent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.". | ||
| Amendment of section 4B. | 8. | In the principal Act, in section 4B, after sub-section (1), the following sub-section shall be inserted, namely:— " (1A) Notwithstanding anything contained in sub- section (1), the constituency allowance payable to a Member under sub-section (1), shall be reduced by thirty per cent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.". |
| CHAPTER – VI MISCELLANEOUS | ||
| Reduction of salaries of Chairmen, Vice- Chairmen and political appointees etc. | 9. | (1) Notwithstanding, anything contained in any other law for the time being in force, the salary etc. payable to a Chairman, Vice- Chairman or any other political appointee shall be reduced by thirty per cent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID- 19) pandemic: P rovided that the Government may, by order or as occasion requires, do anything consistent, so far as may be, with the provisions of this Act, which appear to it to be necessary or expedient for the purpose of removing the difficulty. Every such order shall have effect as if such action had been taken under this Ordinance. ( 2) All orders made under this Ordinance shall be laid before the Legislative Assembly as soon as may be after they are made. |
| Ordinance to have overriding effect. | 10. | The provisions of this Ordinance shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any law other than this Ordinance. |
