No. GAD-B(A) 4-2/2018-I.—In exercise of powers conferred by sub-section 4 of the Section 4 of the Census Act, 1948 (Act No. 37 of 1948) as amended in 1974 & 1993, the Government of Himachal Pradesh has decided to postpone the conduct of field work of phase-I of the Census 2021 and updation of NPR due to outbreak of Covid-19 pandemic till further orders. 07-राजपत्र/2020-05-05-2020 (93)94 राजपत्र, हिमाचल प्रदेश, 5 मई, 2020/15 वैशाख, 1942 The notification is issued as per the directions of the Registrar General and Census Commissioner of India, Ministry of Home Affairs, Government of India, New Delhi.

संख्या ई.एक्स.एन.-एफ.(10)-3/2020.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) की धारा 164 के साथ पठित हिमाचल प्रदेश माल और सेवा कर (चतुर्थ संशोधन) नियम, 2019 (जिसे इसके पश्चात्‌ नियम कहा गया है), के नियम 9 के खंड (ग) और नियम 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, जो अधिसूचना संख्यांक 31/2019-राज्य कर, तारीख 17 जुलाई, 2019 द्वारा बनाया गया था और हिमाचल प्रदेश के राजपत्र (ई-गज़ट) में संख्या ई.एक्स.एन.-एफ. (10)-15/2019 के तहत 25 जुलाई, 2019 को प्रकाशित किए गए थे, 21 अप्रैल, 2020 को उस तारीख के रूप में जिसको नियम के उक्त उपबंध प्रवृत्त होंगेे, नियत करते हैं।

No. EXN-F(10)-3/2020.—In exercise of the powers conferred by Section 164 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) read with clause(c) of rule 9 of rule 25 of the Himachal Pradesh Goods and Services Tax (Fourth Amendment) Rules, 2019 (hereinafter referred to as the rules), made vide notification No. 31/2019-State Tax, dated the 17th July, 2019, published in the Gazette of Himachal Paradesh vide number EXN-F(10)-15/2019, dated the 25th July, 2019, the Governor of Himachal Pradesh, is pleased to appoint the 21st day of April, 2020, as the date from which the said provisions of the rules, shall come into force.

No. HHC/Rules/Vol.V./97-I.—In exercise of the powers conferred by Section 23 of the State of Himachal Pradesh Act, 1970 read with Section 129 of the Code of Civil Procedure, 1908, Article 225 of the Constitution of India and all other powers enabling in this behalf High Court of Himachal Pradesh is pleased to make following amendments in High Court of Himachal Pradesh (Original Side) Rules, 1997, as under:—

1. SHORT TITLE.— These Rules shall be called the High Court of Himachal Pradesh (Original Side) (12th Amendment 2020) Rules-1997.

2. COMMENCEMENT.—These Rules shall come into force with immediate effect.

3. AMENDMENT(S).—(A) In Chapter–III (FORM OF PLEADINGS), Clause (c) of Rule 1. (PLEADINGS HOW WRITTEN), after the words "Parentage" and before comma(,) the words "including age of first party" shall be inserted. Consequently the amended provision shall read as follows:—

"(c) Names etc. of Parties.—Full name and parentage including age of first party, description of each party and address and if such is the case the fact that a party sues or is sued in a representative character, shall also be set out at the beginning of the plaint, petition or application and need not be repeated in the subsequent proceedings in the same suit or matter."

No. HHC/Rules/Vol.V./1997-I.—In exercise of the powers vested in it under Section 23 of the State of Himachal Pradesh Act, 1970, Section 129 of the Code of Civil Procedure, 1908,as amended upto date, Section 477 of the Code of Criminal Procedure, Article 225 of the Constitution of India and all other powers enabling hereunto, the High Court of Himachal Pradesh is pleased to make following amendments in Himachal Pradesh High Court (Scrutiny, Maintenance of Judicial Records, Administrative and Executive Business) Rules, 1997, as under:—

1. SHORT TITLE.—These Rules shall be called Himachal Pradesh High Court (Scrutiny, Maintenance of Judicial Records, Administrative and Executive Business) 5th amendment Rules, 2020.

2. COMMENCEMENT.—These Rules shall come into force with immediate effect.

3. AMENDMENT.—In Chapter-2 (Scrutiny of Papers), Clause (f) of Rule 3, after word "addresses" and before full stop(.) the words "including age of first party" shall be inserted. Consequently, the amended provision shall be read as follows:—

"(f) Whether memorandum of parties is complete regarding name, parentage and addresses including age of first party."

संख्या गृह-बी-बी(2)4/2004-IV.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश न्यायिक अधिकारी (वेतन, भत्ते और सेवा की शर्तें) अधिनियम, 2003 (2003 का अधिनियम संख्यांक 10) की धारा 4 की उपधारा(1) के साथ पठित भारत के संविधान के अनुच्छेद 233 और 234 द्वारा प्रदत्त शक्तियाें और इस निमित्त उन्हें समर्थ बनाने वाली समस्त अन्य शक्तियों को प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के परामर्श से, इस विभाग की अधिसूचना संख्या गृह-बी-(बी)2-4/2004 तारीख 16 मार्च, 2004 द्वारा अधिसूचित और तारीख 20 मार्च 2004 को राजपत्र (असाधारण), हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश न्यायिक सेवा नियम, 2004 और अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियाें और इस निमित्त उन्हें समर्थ बनाने वाली समस्त अन्य शक्तियों का प्रयोग करते हुए इस विभाग की अधिसूचना संख्या गृह-बी-(बी)-2-4/2002 तारीख 16 मार्च, 2004 द्वारा अधिसूचित और तारीख 20 मार्च, 2004 को राजपत्र (असाधारण), हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश न्यायिक सेवा नियम, 2004 का और संशोधन करने के लिए एतद्‌द्वारा निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश न्यायिक सेवा (तृतीय संशोधन) नियम, 2020 है।

2. नियम 5 का संशोधन.--हिमाचल प्रदेश न्यायिक सेवा नियम, 2004 (जिसे इसमें इसके पश्चात "उक्त नियम" कहा गया है) के नियम 5 के अधीन तालिका में क्रम संख्या 1 में स्तम्भ संख्या (IV) के अधीन उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"(IV) आवेदनों की प्राप्ति के लिए अंतिम विहित तारीख को 35 (पैंतीस) वर्ष आयु प्राप्त कर ली हो और सामान्य प्रवर्ग के अभ्यर्थियाें की दशा में 45 (पैंतालीस) वर्ष और अनुसूचित जाति/अनुसूचित जनजाति और अन्य पिछड़ा वर्ग से संबंधित अभ्यर्थियों की दशा में 48 (अड़तालीस) वर्ष की आयु न प्राप्त की हो।" ।

3. नियम 20 का प्रतिस्थापन.--उक्त नियमों के नियम 20 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"20. शिथिल करने की शक्ति.़--जहां कारणों को लिखित में अभिलिखित करके सरकार का उच्च न्यायालय के परामर्श से समाधान हो जाता है कि सेवा की शर्त के सम्बन्ध में इन नियमाें के किसी विशेष उपबंध के प्रवर्तन, किसी विशेष मामले या मामलाें के वर्ग में असम्यक्‌ कष्ट98 राजपत्र, हिमाचल प्रदेश, 5 मई, 2020/15 वैशाख, 1942 कारित कर रहा है या इसके कारित होने की संभावना है तो सरकार लिखित में आदेश द्वारा, नियमों के ऐसे उपबन्धों को या ऐसे उपबन्धों से पैदा होने वाली किसी अपेक्षा का, ऐसे विस्तार तक और ऐसी रीति में, जैसी सरकार उचित, न्यायसंगत या साम्यपूर्ण समझे, अभिमोचन या शिथिलीकरण कर सकेगीः

परन्तु सिविल न्यायाधीशों की सेवा शर्तों के संबंध में, इस नियम में निर्दिष्ट परामर्श उच्च न्यायालय, हिमाचल प्रदेश और हिमाचल प्रदेश लोक सेवा आयोग से किया जाएगा।" ।

Shimla-2, the 3rd April, 2020

No. Home-B-B(2)4/2004-IV.—In exercise of the powers conferred by Articles 233 and 234 of the Constitution of India read with sub-section (1) of Section 4 of the Himachal Pradesh Judicial Officers (Pay, Allowances and Conditions of Service) Act, 2003 (Act No. 10 of 2003) and all other powers enabling him in this behalf, the Governor, Himachal Pradesh, in consultation with the High Court of Himachal Pradesh, hereby makes the following rules further to amend the Himachal Pradesh Judicial Service Rules, 2004, notified vide this Department notification No. Home-B(B)2- 4/2002 dated 16th March, 2004 and published in Extraordinary Gazette, Himachal Pradesh dated 20th March, 2004, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Judicial Service (3rd Amendment) Rules, 2020.

2. Amendment of Column No. 4 of the Table under Rule-5.— In the Himachal Pradesh Judicial Service Rules, 2004, hereinafter called as in the table under rule 5 at serial number 1 for the provision under column No. (iv) the following shall be substituted namely:—

"(IV) Must have attained the age of 35(thirty five) years and must not have attained the age of 45 (forty five) years in the case of General Category candidates and 48 years in the case of candidates belonging to Scheduled Castes/Scheduled Tribes and other Backward Classes as on the last date prescribed for receipt of applications"

3. Power to relax.—In the said rule for Rule-20, the following shall be substituted, namely:—

"Where, for reasons to be recorded in writing, the Government in consultation with the High Court, is satisfied that operation of any particular provision of these Rules with respect to conditions of service, causes or is likely to cause undue hardship in any particular case of class of cases, it may, by order in writing, dispense with or relax such99 राजपत्र, हिमाचल प्रदेश, 5 मई, 2020/15 वैशाख, 1942 provisions of the Rules or any such requirement as originating from such provisions to such extent and in such a manner as it may deem proper, just or equitable:

Provided that, in respect of conditions of service of the Civil Judges, the consultation referred to in this Rule shall be made both with the High Court of Himachal Pradesh and the Himachal Pradesh Public Service Commission.
