NOTIFICATION

Shimla-2, the 30th May, 2020

No. TPT-F(10)-5/2020.—The Government of Himachal Pradesh Vide notification No. TPT-F(10)-5/2020, dated 20-03-2020 curtailed the transport services by 50% on 20th March to prevent the spread the COVID-19 pandemic and ultimately entire transport services came to 28-राजपत्र/2020-06-06-2020 (469)470 राजपत्र, हिमाचल प्रदेश, 06 जून, 2020/16 ज्येष्ठ, 1942 complete halt on 22nd March when the country observed "Junta Curfew" on the Clarian call of Hon'ble Prime Minister. Subsequently transport services remained suspended due Lockdown announced by NDMA/MHA in view of containing the spread of COVID-19.

In pursuance of this order and in exercise of the powers under section 38 of Disaster Management Act, 2005, it is hereby directed that Stage Carriage buses shall be allowed to operate within the boundaries of the State from 7.00 AM to 7.00 PM subject to the following conditions:—

A. GENERAL CONDITIONS:

1. The District Magistrate and Superintendent of Police shall provide adequate police force for crowd management and law & order maintenance at all bus stands.

2. All Stage Carriage buses (except AC buses) shall operate on their respective routes 3. To maintain social distancing and avoid overcrowding in above said buses, the occupancy shall be maintained at no more than 60%.

4. All passengers shall wear masks from the time of boarding till alighting from the bus 5. Driver, conductor and passengers should undergo self-monitoring for flu-like symptoms and in case any symptom appears, then she/ he shall report the same to the nearest health institutions.

6. The buses shall be sanitized completely in the late evening hours or early morning before plying on their routes. The critical areas/touch points in the bus must be sanitized, periodically during the day.

7 All safety protocols of Health Department shall be followed by driver, conductor and passengers.

8. No standing passengers shall be allowed in the buses during journey

9. No e-pass shall be required for inter and intra district movement. However, for inter- state journey passengers must have e-pass issued by the District Magistrate.

10. The Gram Panchayat/Municipal Committee shall render all possible assistance to the private operators and HRTC for boarding and lodging arrangement as and when demanded.

B. PROTOCOL FOR BUS STAND, BUSES AND STAFF:

(a) At Bus Stand :

1. The entry/exit points shall be managed jointly by the team of District Administration, Health and Police department to ensure health check-up, screening and maintenance of Law & Order.

2. Aarogya Setu App status would be checked preferably (for compatible device only) to ensure that passenger is free of COVID-19 symptoms. Passenger with "Red" status in Aarogya Setu App would not be permitted to travel.

4. Every toilet shall be sanitized and must have soap dispenser

5. The Regional Manager, HRTC shall ensure availability of masks, hand sanitizers, soaps etc. on every bus stand, rates for which shall be regulated by the Bus Stand Management and Development Authority.

6. Bus Stand Management and Development Authority shall ensure adequate signages to guide the passengers.

7. Public announcement system at bus stand shall regularly disseminate information about the precautions to be followed during travel.

8. Physical distance of atleast one meter shall be ensured while boarding and de- boarding.

9. Proper queue system should be followed during boarding and at the ticket counter 10. Anyone moving inside the bus stand shall mandatorily wear the face cover

11. Adequate bins shall be placed for disposal of used material like masks etc. All such waste to be handled and disposed as per the prescribed procedures.

12. HRTC shall ensure that person sitting at cash counters be provided with adequate safety protective gears like gloves, masks, face cover, face shields, hand sanitizers etc.

(b) Inside the bus (passenger protocol) :

1. All passengers shall wear mask/face cover throughout the journey and ensure that co– passenger shall also wear masks.

2. Passengers must use hand sanitizers regularly during their journey for their own safety 3. It shall be ensured that only 60% seats are occupied and seats marked as "Not to be used" are left vacant.

4. Avoid unnecessary touching of common contact points

5. Avoid travelling in case of any illness. In case of emergency and illness, inform to the conductor for maintaining physical distancing during journey.

6. In case of any symptoms of illness of co-passenger, information shall be provided to crew members of the bus.

(c) Bus protocol :

1. Boarding and de-boarding in the bus shall be from the rear and front door respectively 2. A sticker shall be pasted on seats marked as "Not to be used"

3. Every alternate seat shall be left unoccupied i.e. in case of three seats, middle seats, shall be left unoccupied and in case of two seats, only window seat shall be occupied.

5. Passenger must assist driver/conductor to maintain 60% occupancy

6. Proper ventilation must be maintained during journey by opening the window glasses 7. Buses shall be stopped for boarding and de-boarding on the designated bus stands/stops only.

8. Stage Carriage buses can pass through containment zones; however boarding and de- boarding of passenger(s) shall be strictly prohibited within containment zones.

9. Regional Manager, HRTC shall ensure that the proper hygiene and cleanliness is maintained at authorized Dhabas for passenger's safety, which are to be notified by the District Magistrate.

(d) Conductor :

1. He shall wear mask/face cover, gloves and face shield throughout the journey 2. While issuing tickets, he/she shall ensure physical distancing from the passengers 3. He shall not allow passenger(s) to be seated on the seat marked as "Not to be used" 4. He shall educate passenger(s) about protocol to be followed during journey and ensure that all safety precautions are adhered to by the all concerned.

5. He shall ensure proper ventilation in the bus.

(e) Driver :

1. HRTC/Private operators shall ensure proper segregation of separate cabin for driver 2. He shall ensure minimum contact with the passengers and the public

3. He shall use protective gears like masks/face cover hand sanitizers etc.

(f) Way Side Amenities protocol :

1. Proper sanitization and cleanliness must be ensured in dining area, kitchen and toilets at Dhabas/restaurants.

2. Every Dhaba/restaurant must have sanitizer for public use

3. Soap dispenser must be available in toilet and each wash basin

4. Seating arrangement in dining area must be such that proper physical distancing be maintained.

C. ADVISORY FOR GENERAL PUBLIC :

Advisory (in Hindi) for the welfare of general public be read as part of the notification473 राजपत्र, हिमाचल प्रदेश, 06 जून, 2020/16 ज्येष्ठ, 1942 These orders shall be applicable in the State of Himachal only. All guidelines, protocols advisories and orders in relation to management of COVID-19 issued from time to time under the Epidemic Diseases Act, 1897 and Disaster Management Act, 2005 shall be complied. Any violation of these orders shall be subject to prosecution under relevant provisions of the National Disaster Management Act, 2005, the Motor Vehicle Act, 1988 and such other laws as may applicable.

No. TPT-F(10)-5/2020.—In continuation to this Department Notification of even number dated 30-05-2020, regarding operation of Stage Carriage buses within the boundaries of the State, it is hereby further directed that motor cabs, maxi cabs, auto-rickshaws and e-rickshaws shall also be allowed to operate with effect from 01-06-2020 within the State from 7.00 AM to 7.00 PM, subject to the following conditions:

GENERAL CONDITIONS:

1. To maintain social distancing and avoid over crowding in above said vehicles the occupancy needs to be maintained as per permissible seating capacity given below.

2. All passengers shall wear masks from the time of boarding till alighting from the vehicle.

3. Driver as well as passengers should undergo self-monitoring for flu-like symptoms and in case any symptom appears then she/ he shall report the same to the nearest health institutions.

6. Car-pooling / sharing by the aggregators shall not be permitted

स्ांख्या इन्ड-ए(ए) 1-3/2017.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश उद्योग विभाग में अतिरिक्त निदेशक, वर्ग-I (राजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध ''क'' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उद्योग विभाग, अतिरिक्त निदेशक, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2020 है।475 राजपत्र, हिमाचल प्रदेश, 06 जून, 2020/16 ज्येष्ठ, 1942 (2) ये नियम राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे आदेश द्वारा, हस्ताक्षरित/- अति0 मुख्य सचिव (उद्योग)।

उपाबन्ध-'क' हिमाचल प्रदेश, उद्योग विभाग में अतिरिक्त निदेशक, वर्ग-I (राजपत्रित ) के पद के लिए भर्ती और प्रोन्नति नियम

1. पद का नाम.--अतिरिक्त निदेशक

2. पद (पदों) की संख्या.--01 (एक)

10. भर्ती की पद्धतिः भर्ती सीधी होगी या प्रोन्नति या सैकण्डमैंट या स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शत-प्रतिशत प्रोन्नति द्वारा।

11. प्रोन्नति, सैकण्डमैंट या स्थानान्तरण द्वारा भर्ती की दशा में, श्रेणियां (गे्रड) जिनसे प्रोन्नति, सैकण्डमैंट, स्थानान्तरण किया जाएगा.--संयुक्त निदेशक (ंनिदेशकों) में से प्रोन्नति द्वारा जिनका तीन वर्ष का नियमित सेवाकाल या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर संयुक्त निदेशक (ंनिदेशकाें) में से प्रोन्नति द्वारा जिनका संयुक्त निदेशक और महाप्रबंधक जिला उद्योग केन्द्र (डी आई सी)/उप-निदेशक उद्योग के रूप में संयुक्ततः छह वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके छह वर्ष का नियमित सेवाकाल हो, जिसमें संयुक्त निदेशक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी। 476 राजपत्र, हिमाचल प्रदेश, 06 जून, 2020/16 ज्येष्ठ, 1942 (1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व, सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमाें में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः

परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बंधी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.-अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है, जो आपतकाल की अवधि के दौरान सशस्त्र बलाें में शामिल हुए हैं और जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन आफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धाें के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन आफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हाें।

(2) इसी प्रकार स्थायीकरण के सभी मामलाें में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवा काल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी :

परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो, तो उसकी संरचना.--जैसी सरकार द्वारा समय समय पर गठित की जाए।

13. भर्ती करने में, जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--लागू नहीं

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--लागू नहीं

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए सेवाओं में आरक्षण की बाबत जारी किए गए अनुदेशों के अधीन होगी।

No. Ind.-A(A)1-3/2017.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Additional Director, Class-I (Gazetted) in the Department of Industries, H.P. as per Annexure-"A" attached to this Notification, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Department of Industries, Additional Director, Class-I (Gazetted) Recruitment and Promotion Rules, 2020.

(2) These rules shall come into force from the date of publication in the Rajpatra(e- Gazette), Himachal Pradesh.

ANNEXURE-"A" RECRUITMENT AND PROMOTION RULES FOR THE POST OF ADDITIONAL DIRECTOR CLASS-I (GAZETTED), IN THE DEPARTMENT OF INDUSTRIES, HIMACHAL PRADESH 1. Name of the Post : Additional Director

2. Number of Post (Posts) : 01 (One)

3. Classification : Class-I (Gazetted)

4. Scale of Pay : Rs. 15600—39100+ Rs. 7600 Grade Pay

5. Whether "Selection" post or "Non-Selection" post.—Selection

7. Minimum Educational and other qualifications required for direct recruit(s) : (a) Essential Qualifications: Not applicable.

(b) Desirable Qualification(s): Not applicable

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age : Not applicable.

Educational Qualification : Not applicable

9. Period of Probation, if any.—Two years subject to such further extension for a period not exceeding one year as may be ordered by the Competent Authority in special circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by

promotion/secondment/ transfer and the percentage of post(s) to be filled in by various

methods.—100% by promotion.

11. In case of recruitment by promotion/ secondment/ transfer, grade(s) from which promotion/ secondment/ transfer is to be made.—By promotion from amongst the Joint Director(s) having three years regular service or regular combined with continuous adhoc service rendered, if any, in the grade, failing which by promotion from amongst the Joint Director(s) having Six years regular service or regular combined with continuous adhoc service rendered, if any, combined as Joint Director & General Manager, DIC/Deputy Director of Industries which shall also include essential service of two years as joint Director.

(I) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of atleast three years' or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible persons happened to be ex- servicemen who have joined Armed Forces during the period of emergency and recruited under the provisions of rule-3 of Demobilized Armed Forces Personnel479 राजपत्र, हिमाचल प्रदेश, 06 जून, 2020/16 ज्येष्ठ, 1942 (Reservation of Vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(II) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any, prior to the regular appointment against such posts, shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition.—As may be constituted by the Government from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission (HPPSC) is to be consulted in making recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—Not applicable

15. Selection for appointment to post by direct recruitment.—Not applicable 16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the Himachal Pradesh Departmental Examination Rules, 1997, as amended from time to time. 18. Powers to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these rules with respect to any class or category of person(s) or post(s).

संख्या श्रम (बी) 10-6/2018 (स्था).--हिमाचल प्रदेश के राज्याल, इस विभाग की अधिसूचना संख्या श्रम (बी) 1-1/2010 (स्था), तारीख 17 जून, 2015 के क्रम में और दिव्यांगजन अधिकार अधिनियम, 2016 (2016 का अधिनियम संख्यांक 49) की धारा 33 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, श्रम एवं रोजगार विभाग में संदर्भित दिवांःजनों के लिए सीधी भर्ती में चार प्रतिशत आरक्षण के प्रयोजन के लिए उपाबन्ध-क के अनुसार वर्ग-III और IV प्रवर्ग के पदों को लोकहित में तत्काल प्रभाव से पुनःपहचान करते हैं। 480 राजपत्र, हिमाचल प्रदेश, 06 जून, 2020/16 ज्येष्ठ, 1942 यह अधिसूचना सामाजिक न्याय एवं अधिकारिता विभाग, हिमाचल प्रदेश सरकार के पत्र संख्या एसजे ई-बी-बी (2)-2/2019-I, तारीख 6 मार्च, 2020 द्वारा प्राप्त पूर्वानुमोदन से जारी की जा रही है।

NOTIFICATION

Shimla-2, the 26th May, 2020

No. Shram(B)10-6/2018(Estt.).—In continuation of this Department's notification No.Shram(B)1-1/2010(Estt.), dated 17th June, 2015 and in exercise of the powers conferred by sub section (1) of section 33 of the Rights of Persons with Disabilities Act, 2016 (No.49 of 2016), the Governor, Himachal Pradesh is pleased to re-identify posts of Class-III and IV category for the purpose of 4% reservation in direct recruitment for Persons with Benchmark Disabilities in the Labour and Employment Department, as per Annexure-"A" in the public interest, with immediate effect.

This notification is being issued with the prior approval of SJ&E Department, Government of Himachal Pradesh obtained vide their letter No. SJE-B-B(2)-2/2019-I, dated 6th March, 2020.
