संख्याः इण्ड-ए(ईन्व0 सैल)ए(3)-1/2019.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश सूक्ष्म, लघु और मध्यम उद्यम (स्थापना और प्रचालन का सरलीकरण) अधिनियम, 2019 (2020 का अधिनियम संख्यांक 1) की धारा 13 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

35-राजपत्र/2020-17-06-2020 (601) 602 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सूक्ष्म, लघु और मध्यम उद्यम (स्थापना और प्रचालन का सरलीकरण) नियम, 2020 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. परिभाषाएं.--(1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से, हिमाचल प्रदेश सूक्ष्म, लघु और मध्यम उद्यम (स्थापना और प्रचालन का सरलीकरण) अधिनियम, 2019 (2020 का अधिनियम संख्यांक 1) अभिप्रेत है;

(ख) ''वाणिज्यिक प्रचालन का प्रारम्भ'' से, वह तारीख अभिप्रेत है, जिस से उद्यम इन नियमों के अधीन दिए गए आशय की घोषणा से, संबंधित विनिर्मित वस्तुओं के विक्रय या आपूर्ति या बीजक या कर बीजक का या दी गई सेवाओं का पहला बिल जारी करता है;

(ग) ''आशय की घोषणा'' से, अधिनियम की धारा 5 के अधीन उद्यम द्वारा सूचना प्रस्तुत करने के लिए, इलेक्ट्रॉनिक प्रपत्र में इन नियमों से संलग्न ''प्ररूप-I'' में एक दस्तावेज अभिप्रेत है; और (घ) ''धारा'' से, अधिनियम की धारा अभिप्रेत है।

(2) उन शब्दों और पदों के जो इन नियमों में प्रयुक्त हैं, और परिभाषित नहीं हैं, परन्तु अधिनियम में परिभाषित किए गए हैं, के वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैं।

3. 'आशय की घोषणा' प्रस्तुत करने की प्रक्रिया.--(1) अधिनियम के अधीन अभिस्वीकृति प्रमाण-पत्र चाहने वाला प्रत्येक उद्यम पोर्टल पर इलेक्ट्रॉनिक रूप में नोडल एजेंसी को इन नियमों से संलग्न 'प्ररूप-I' में सम्यक्‌ रूप से भरी गई 'आशय की घोषणा' प्रस्तुत करेगा।

(2) उद्यम 'आशय की घोषणा' के साथ हिमाचल प्रदेश नगर एवं ग्राम योजना विभाग, के साथ रजिस्ट्रीकृत वास्तुकार द्वारा प्रमाणित प्रस्तावित भवन का एक नक्शा अपलोड करेगा।

(3) 'आशय की घोषणा' निम्नलिखित द्वारा प्रस्तुत की जा सकेगी,-

(क) स्वामी के अधीन उद्यम की दशा में, स्वत्वधारी;

(ख) भागीदारी उद्यम की दशा मेें, प्राधिकृत भागीदार; और

(ग) उद्यमों या कंपनी के अन्य रूपों की दशा में, प्राधिकृत व्यक्ति।

स्पष्टीकरण.--इन नियमों के प्रयोजन के लिए, किसी उद्यम में वे उद्यम सम्मिलित होंगे, जहां क्षमता या आधुनिकीकरण या विचलन के विस्तार के प्रयोजन के लिए संयंत्र और मशीनरी के मूल्य में 25 प्रतिशत से अन्यून की वृद्धि नहीं की जाती है और जिसे विभाग द्वारा अभिलेख में लिया गया हो।

4. अभिस्वी—ति प्रमाण-पत्र प्रदान करने की प्रक्रिया.--सर्वथा सम्पूर्ण 'आशय की घोषणा' की प्राप्ति पर 'अभिस्वीकृति प्रमाण-पत्र' इन नियमों से संलग्न ''प्ररूप-2'' में नोडल एजेंसी द्वारा इलेक्ट्रॉनिक प्रपत्र में प्रदान किया जाएगा, जिसमें 'आशय की घोषणा' की प्राप्ति की तारीख और अभिस्वीकृति प्रमाण-पत्र की विधि मान्यता की अवधि दर्शायी गई हो।

5. नोडल एजेंसी के —त्य.--(1) नोडल एजेंसी, अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए समन्वय और कार्यान्वयन एजेंसी के रूप में कार्य करेगी।

(2) निदेशक, इन नियमों के अधीन उद्यमों की शिकायतों और प्रश्नों को प्राप्त करेंगे और उनका निवारण भी करेंगे और यदि आवश्यकता हो तो सक्षम प्राधिकारी के साथ उनके विवाद्यकों को भी सरल बनाएंगे।603 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 (3) निदेशक, अधिनियम के प्रयोजनाें को कार्यान्वित करने के लिए इलेक्ट्रॉनिक पोर्टल का अनुरक्षण करेगा और आशय की घोषणा और अभिस्वीकृति प्रमाण-पत्र का अभिलेख रखेगा।

(4) नोडल एजेंसी, अभिस्वीकृति प्रमाण-पत्र जारी करने पर आशय की घोषणा और उद्यम का अभिस्वीकृति प्रमाण-पत्र सक्षम प्राधिकारी को अग्रेषित करेगी।

(ii) मेरे द्वारा हिमाचल प्रदेश सूक्ष्म, लघु और मध्यम उद्यम (स्थापना और प्रचालन का सरलीकरण) अधिनियम, 2019 और तद्‌धीन बनाए गए नियमों को पढ़ लिया गया है और मैं उनका पालन करने का वचन देता हूं। उपरोक्त विवरण में परिवर्तन की दशा में, शीघ्रातिशीघ्र नोडल एजेंसी को सूचित किया जाएगा।

(iii) मैं उद्यम जो एक नव उद्यम है के लिए आशय की घोषणा प्रस्तुत कर रहा हूं।

(iv) मैंने आशय की घोषणा में उद्यम के विनिर्माण/सेवा कार्यकलाप की अवस्थित यथावर्णित भूमि या भवन या परिसर के लिए अभिस्वीकृति प्रमाण-पत्र का पूर्व में उपयोग नहीं किया है। (v) मैं यह वचन देता हूं कि उद्यम स्थापित करने के लिए भवन/संरचना की प्रस्तुत भवन योजना, नगर एवं ग्राम योजना विभाग, हिमाचल प्रदेश के साथ रजिस्ट्रीकृत वास्तुकार द्वारा तैयार की गई है और यह हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 और तद्‌धीन बनाए गए नियमों के अनुसार है।

(vi) मैं कर्मकारों या कर्मचारियों की सुरक्षा और स्वास्थ्य सुनिश्चित करने हेतु उद्यम के प्रचालन में सुरक्षा मानकों का अनुरक्षण करूंगा।

(vii) मैं ऐसी किसी भी विनिर्माण या सेवा कार्यकलाप में शामिल नहीं होऊंगा जो किसी भी विधि के अधीन निषिद्ध है या जो सार्वजनिक स्वास्थ्य या कानून और व्यवस्था के लिए गंभीर खतरा पैदा कर सकता हो।

(viii) मैं राज्य में उद्यम स्थापित करने हेतु प्रवृा विद्यमान अधिनियमों/नियमों/आदेशों/ अनुदेशों के उपबन्धों से भली भान्ति अवगत हूं और इन समस्त लागू अधिनियमों/नियमों/आदेशों/अनुदेशों का पालन करूंगा।

NOTIFICATION

Shimla-2, the 11th June, 2020

No. Ind-A(Inv.Cell)A(3)-1/2019.—In exercise of the powers conferred by Section 13 of the Himachal Pradesh Micro, Small and Medium Enterprises (Facilitation of Establishment and Operation) Act, 2019 (Act No.1 of 2020), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Micro, Small and Medium Enterprises (Facilitation of Establishment and Operation) Rules, 2020.

(2) They shall come into force from the date of their publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Definitions.—(l) In these rules, unless the context otherwise requires,— (a) "Act" means the Himachal Pradesh Micro, Small and Medium Enterprises (Facilitation of Establishment and Operation) Act, 2019 (Act No. 1 of 2020);

(b) "Commencement of Commercial Operation" means the date on which the enterprise issues the first bill of sale or supply or invoice or tax invoice, of the goods manufactured or services rendered relating to Declaration of Intent furnished under these rules;

(c) "Declaration of Intent" means a document in "Form-I", appended to these rules in electronic format, for furnishing the information by the enterprise under section 5 of the Act; and

(d) "section" means section of the Act.

(2) Words or expressions used in these rules and not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Procedure for furnishing 'Declaration of Intent'.—(1) Every enterprise seeking Acknowledgment Certificate under the Act shall furnish a duly filled 'Declaration of Intent' to the Nodal Agency in "Form-I" appended to these rules, electronically on the portal.

(2) The enterprise shall upload a map of the proposed building certified by an architect registered with the Town and Country Planning Department, Himachal Pradesh, alongwith the 'Declaration of Intent'.

(3) The 'Declaration of Intent' may be submitted by,—

(a) the Proprietor, in case of proprietary enterprise;

(b) the authorized partner in case of partnership enterprise; and607 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 (c) the authorized person in case of other forms of enterprises or company. Explanation.—For the purpose of these rules, an enterprise shall include the enterprises, where an increase by not less than twenty five percent is done in the value of the plant and machinery for the purpose of expansion of capacity or modernization or diversification and taken on record by the department.

4. Procedure for grant of Acknowledgement Certificate.—On the receipt of 'Declaration of Intent' complete in all respects, the 'Acknowledgment Certificate' shall be granted in electronic format by the Nodal Agency in "Form-II" appended to these rules, stating the date of receipt of 'Declaration of Intent' and the period of validity of Acknowledgment Certificate.

5. Functions of the Nodal Agency.—(1) The Nodal Agency shall act as the coordinating and implementing agency for carrying out the purposes of the Act.

(2) The Director shall receive and address the grievances and queries of enterprises under these rules, including facilitation of their issues with the Competent Authority, in case needed.

(3) The Director shall maintain the electronic portal for carrying out the purposes of the Act and keep record of Declaration of Intent and the Acknowledgment Certificate.

(4) The Nodal Agency shall, on issuance of Acknowledgment Certificate, forward the Declaration of Intent and the Acknowledgment Certificate of enterprise to the Competent Authority.

(iv) I have not previously availed the Acknowledgement Certificate for the land or building or premises as mentioned in 'Location of Manufacturing/Service Activity of Enterprise' in Declaration of Intent.

(v) I undertake that the submitted building plan of the building/structure for establishing the enterprise has been prepared by an architect registered with the Town and Country Planning Department, Himachal Pradesh and the same is as per the Himachal Pradesh Town and Country Planning Act, 1977 and rules framed thereunder.

(vi) I will maintain the safety standards in operation of the enterprise to ensure safety and health of the workers or employees.

(vii) I will not engage in any manufacturing or service activity which is prohibited under any law or which may pose serious threat to public health or law and order.

(viii) I am well aware of provisions of existing Acts/Rules/Orders/Instructions in force for setting up of an enterprise in the State and will abide by all these applicable Acts/Rules/Orders/Instructions.

(ix) I will obtain all requisite clearances/approvals within three years from the date of issuance of Acknowledgement Certificate or before the commencement of commercial production/operation, whichever is earlier.

(x) I further declare that in case the enterprise fails to adhere to any of the requirements of the Act, action as required by or under the relevant Law may be initiated against the enterprise.

No. PBW-A-A(3)-8/2018.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules, further to amend the Himachal Pradesh, Public Works Department, Private Secretary, Class-I (Gazetted), Recruitment and Promotion Rules, 2004 notified vide this department notification No.PBW-A-A(3)-1/2001, dated 25-10-2004, namely:—

1. Short title and Commencement.—(i) These rules may be called the Himachal Pradesh Public Works Department, Private Secretary, Class-I (Gazetted), Recruitment and Promotion (2nd Amendment) Rules, 2020.

(ii) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure-"A" to the Himachal Pradesh Public Works Department, Private Secretary, Class-I (Gazetted), Recruitment and Promotion, Rules, 200,—

(a) For the existing provisions against column No.4, the following shall be substituted, namely:—

"Pay band ` 15600—39100+ ` 5400/- Grade Pay "

(b) For the existing provision against Column No. 5, the following shall be substituted, namely—

"Non- Selection "

(c) For the existing provision against Column No. 11, the following shall be substituted, namely:—

"By promotion from amongst the Personal Assistant (s) possessing 05 (Five) years' regular service or regular combined wrth continuous adhoc service, rf any, in the grade, failing which by promotion from amongst the Personal Assistant (s) possessing 14 (Fourteen) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant and Senior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, failing both by promotion from amongst the Personal Assistant (s) possessing 19 (nineteen) years' regular service or regular combined with continuous adhoc service, if any as Personal Assistant, Senior Scale Stenographer & Junior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, failing all by promotion from amongst the Personal Assistant (s) possessing 24 (twenty four) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant, Senior Scale Stenographer, Junior Scale Stenographer & Steno Typist combined which shall also include 02 (two) years essential service as Personal Assistant":

(l) Provided that for the purpose of promotion every employee shall have to serve at least one term in the Tribar/Difficult/Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (1) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation except posting/transfer in remote/rural area. However, this condition of five years shall not be applicable in cases of Promotion:

Provided further that Offrcer(s)/Officials(s) who have not served atleast one tenure in Tribal/Difflcult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her senrority in the respective cadre.

Explanation I.—For the purpose of proviso 1 supra the "term" in Tribal/Difficult/Hard areas and remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrattve exigencies/convenience.

Explanation II.—For the purpose of proviso (l) supra the Tribal/Difficult Areas shall be as under.—

Explanation III.— For the purpose of proviso (1) supra the Remote/Rural Area shall be as under:—

(i) All stations beyond the radius of 20 Kms. from Sub-Division/Tehsil Headquarter (ii) All stations beyond the radius of 15 Kms. from State Headquarter and District Headquarters where bus service is not available and on f'oot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms.

(ll) ln all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (includrng the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provision referred to above all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided further that all incumbents to be considered for promotion shall possess the minimum qualifying service of atleast three years or that prescribed in the R&P Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the proceeding proviso, the person(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex- serviceman who have joined Armed Forces during the period of ermergency and recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Service),613 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of rule-3 of the Ex-serviceman (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority there under.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion, against such post, shall be taken into account towards the length of service; if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R&P Rules:

Provrded that inter-se seniorrty as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

(d) For the existing provision against the Column No. 12, the following shall be substituted, namely: —

"Departmental Promotion Committee Department Confirmation Committee as may be constituted by the Government from time to time.".

(e) For the existing provision against the Column No." 17, the following shall be substituted, namely:—

"Every member of the service shall pass a Departmental Examination as prescribed in the H. P. Departmental Examination Rules, 1997 as amended from time to time.".

संख्याः पी0बी0डब्ल्यू0-ए-ए-(3)-8/2018.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या पी0बी0डब्ल्यू0-ए-ए-(3)-1/2001, तारीख 25-10-2004 द्वारा अधिसूचित हिमाचल प्रदेश लोक निर्माण विभाग, निजी सचिव, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2004 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम, हिमाचल प्रदेश लोक निर्माण विभाग, निजी सचिव, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति (द्वितीय संशोधन) नियम, 2020 है।

2. ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृा होंगे। 614 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 2. उपाबन्ध ''क'' का संशोधन.--हिमाचल प्रदेश लोक निर्माण विभाग, निजी सचिव, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2004 के उपाबन्ध ''क'' में,--

(क) सतम्भ संख्या 4 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''पे बैण्ड ` 15600-39100 जमा ` 5400/- ग्रेड पे''।

(ख) सतम्भ संख्या 5 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''अचयन''।

(ग) सतम्भ संख्या 11 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा; अर्थात्‌ :-

''निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर निजी सहायक (सहायकों) में से प्रोननति द्वारा जिनका निजी सहायक और वरिष्ठ वेतनमान आशूलिपिक के रूप में संयुक्ततः चोदह वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौदह वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी दोनों के न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक और कनिष्ठ वेतनमान आशुलिपिक के रूप में संयुक्ततः उन्नीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके उन्नीस वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप मेंं दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी, उपरोक्त समस्त के न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक , कनिष्ठ वेतनमान आशुलिपिक और आशुटंकक के रूप में संयुक्ततः चौबीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौबीस वर्ष का नियमित सेवाकाल हो जिसमें निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी :

(I) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु दूरस्थ/ग्रामीण क्षेत्र में तैनाती/स्थानांतरण के सिवाय उपर्युक्त परन्तुक (1), उन कर्मचारियों के मामले में लागू नहीं होगा जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो। तथापि पांच वर्ष की यह शर्त प्रोन्नति के मामलों में लागू नहीं होगीः

परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिन्होंने जनजातीय/कठिन/दुर्गम और दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा।

स्पष्टीकरण I.-- उपरोक्त परन्तुक (1) के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में ''कार्यकाल'' से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान रखते हुए साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण II.--उपरोक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगे :-

1. जिला लाहौल एवं स्पिति 2. चम्बा जिला का पांगी और भरमौर उप-मण्डल615 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 3. रोहड़ू उप-मण्डल का डोडरा क्वार क्षेत्र 4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनिश दरकाली और काशापाट 5. कुल्लू जिला का पन्द्रह परगना 6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र 7. जिला किन्नौर 8. सिरमौर जिला में उप-तहसील कमरऊ के काठवाड़ और कोरगा पटवार वृा, रेणुकाजी तहसील के भलाड़ भलौना और सांगना पटवार वृा और शिलाई तहसील का कोटा पाब पटवार वृा।

9. मण्डी जिला में करसोग तहसील का खन्योल-वागडा पटवार वृा, बाली चौकी उप-तहसील के गाडा गोसाई, मठयानी धनयाड, थाची बागी, सोमगाड और खोलानाल पटवार वृा, पद्धर तहसील के झारवाड़, कुटगढ़, ग्रामन, देवगढ़, ट्रैला, रोपा, कथोग, सिल्ह-भड़वानी, हस्तपुर, घमरेड़ और भटेढ़ पटवार वृा, भुनाग तहसील के चियूणी, कालीपार, मानगढ़, थाच-बगड़ा उारी मगरू और दक्षिण मगरू पटवार वृा और सुन्दरनगर तहसील का बटवाड़ा पटवार वृा।

स्पष्टीकरण III.--उपरोक्त परन्तुक (1) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगे :-

(i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का उसके प्रवर्ग को ध्यान में लाए बिना, अपने गृह नगर या गृह नगर क्षेत्र के साथ के साथ लगता 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्मरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी :

(i) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्यक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे :

परन्तु यह और कि उन सभी परधारियों की जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए आपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसने आपातकाल के दौरान सशस्त्र बल में कार्यग्रहण किया है और जिसे डिमोबीलाइज्ड आगर्ड फोर्सिज परसोलन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज़, 1972 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज)रूल्ज़, 1985 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों। 616 राजपत्र, हिमाचल प्रदेश, 17 जून, 2020/27 ज्येष्ठ, 1942 (ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

(घ) स्तम्भ संख्याः 12 के सामने विद्यमान अपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''विभागीय प्रोन्नति समिति/विभागीय स्थायीकरण समिति, जैसी सरकार द्वारा समय-समय पर गठित की जाए।''

(ङ) स्तन्भ संख्याः 17 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, आर्थात्‌ः- ''सेवा के प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 यथा विहित विभागीय परीक्षा उतीर्ण करनी होगी।''।

Shimla-2, the 11th June, 2020

No. PBW-A-A(3)-6/2018.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules, further to amend the Himachal Pradesh, Public Works Department, Assistant Engineer (Electrical), Class-I (Gazetted), Recruitment and Promotion Rules, 1996, notified vide this department notification No.PBW(A)- B(13)-39/94, dated 21-01-1997, namely:—

1. Short title and Commencement.—(i) These rules may be called the Himachal Pradesh Public Works Department, Assistant Engineer (Electrical), Class-I (Gazetted), Recruitment and Promotion (5th Amendment) Rules, 2020.

(ii) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure-"A" to the Himachal Pradesh Public Works Department, Assistant Engineer (Electrical), Class-I (Gazetted), Recruitment and Promotion, Rules, 1996 for the existing provisions against column No. 7, the following shall be substituted, namely:—

"(a) ESSENTIAL QUALIFICATION(S).—Must possess regular full time degree in Electrical Engineering or Electrical and Electronics Engineering from an Institute/University duly approved/recognized by the AICTE/UGC or AMIE enrolled upto on or before 31-5-2013 from Institute of Engineers (India) Calcutta.

(b) DESIREABLE QUALIFICATION(S).—Knowledge of costoms, manners and dialects of Himachal Pradesh and suitability for appointments in peculiar conditions prevailing in the Pradesh".
