संख्याः एफ0एफ0ई0-बी0-एफ0(14)-16/2020.--भारतीय वन अधिनियम, 1927 (1927 का अधिनियम संख्यांक 16) की धारा 29 की उप-धारा (3) के अधीन यथा अपेक्षित के अनुसार इस अधिसूचना से 53-राजपत्र/2020-09-07-2020 (1397) 1398 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2020/18 आषाढ़, 1942 संलग्न अनुसूची में विनिर्दिष्ट वन भूमि या बंंजर भूमि में या उस पर सरकार तथा प्राइवेट व्यक्तियों के अधिकारों के स्वरूप और विस्तार की जांच कर ली गई है और उन्हें अभिलिखित कर लिया गया है;

और उक्त अनुसूची में दर्शित वन भूमि या बंजर भूमि, सरकार की सम्पत्ति है, या जिस पर सरकार के सांपत्तिक अधिकार हैं या सरकार उसकी वन उपज के सम्पूर्ण या किसी भाग की हकदार है;

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वाेक्त अधिनियम की धारा 29 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करते हैं कि उक्त अधिनियम के अध्याय-4 के उपबन्ध उक्त वन भूमि या बंजर भूमि को लागू होंगे और जो इसके पश्चात्‌ पूर्वाेक्त अधिनियम की धारा 29 की उप-धारा (2) के उपबन्धों के अधीन ''संरक्षित वन'' कहलाएगी।

Shimla-2, the 4th June, 2020

No. FFE-B-F(14)-16/2020.—WHEREAS, the nature and extent of the rights of the Government and of the Private Persons in or over the forest land or waste land specified in the SCHEDULE appended to this Notification have been enquired into and recorded, as required under sub-section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

AND WHEREAS, the forest land or waste land shown in the said SCHEDULE is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the forest produce therein;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the said Act shall apply to the said forest land or waste land and shall hereafter be called as "protected forests" under the provisions of sub-section (2) of section-29 of the Act ibid.

No. FFE-B-F(14)-17/2020.—WHEREAS, the nature and extent of the rights of the Government and of the Private Persons in or over the forest land or waste land specified in the SCHEDULE appended to this Notification have been enquired into and recorded, as required under sub-section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

Shimla-2, the 8th June, 2020

No. FFE-B-F(14)-23/2020.—WHEREAS, the nature and extent of the rights of the Government and of the Private Persons in or over the forest land or waste land specified in the SCHEDULE appended to this Notification have been enquired into and recorded, as required under sub-section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of1411 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2020/18 आषाढ़, 1942 Chapter-IV of the said Act shall apply to the said forest land or waste land and shall hereafter be called as "protected forests" under the provisions of sub-section (2) of section-29 of the Act ibid.

संख्या —षि-बी-एफ(10)-14/2019.--इस विभाग की समसंख्यक अधिसूचना दिनांक 24-9-2019 के क्रम को जारी रखते हुए हिमाचल प्रदेश के राज्यपाल, श्री रमेश शर्मा, सलाहकार (उपाध्यक्ष समतुल्य), हिमाचल प्रदेश राज्य —षि विपणन बोर्ड को निम्नलिखित सुविधायें एवं सेवा शर्तें प्रदान करने का सहर्ष आदेश देते हैं :-

1. सलाहकार को प्रवास पर दैनिक भाा मु0 250/-रु0 प्रतिदिन राज्य के भीतर तथा मु0 400/- रु0 प्रतिदिन राज्य से बाहर (Category-A cities only) प्रतिदिन की दर से देय होगा।

2. बोर्ड के आवास की उपलब्धता की स्थिति में सलाहकार को अर्ध सुसज्जित आवास उपलब्ध करवाया जायेगा जिसके लिए उन्हें सरकार की दरों के अनुसार से किराया अदा करना होगा। बोर्ड का आवास उपलब्ध न होने की स्थिति में उन्हें मु0 7200/- रु0 प्रतिमास की दर से मकान किराया भाा देय होगा। यदि उनकी सेवाएं समाप्त की जाती है या सरकार को दनकी सेवाओं की और आगे आवश्यकता न हो तो उन्हें उपलब्ध करवाई गई बोर्ड की रिहायशी आवास सुविधा, सेवा समाप्ति आदेशों के 15 दिनों के अन्दर खाली करने होगी। आवास के बदले किराया भाा की अदायगी की स्थिति में सलाहकार को फर्नीचर चार्जिज देय नहीं होंगे।

3. आवास में बिजली और पानी के वास्तविक खर्चे का वहन पूर्व की भान्ति हिमाचल प्रदेश —षि विपणन बोर्ड द्वारा किया जायेगा।

4. सलाहकार को कार्यालय एवं वाहन की सुविधा उपलब्ध करवाई जाएगी जिसका खर्च हिमाचल प्रदेश —षि विपणन बोर्ड द्वारा वहन किया जायेगा। सलाहकार को मु0 3100/- रु0 प्रतिमास की दर से आतिथ्य सत्कार भाा देय होगा।

5. सलाहकार को कार्यालय में सम्बन्धित बोर्ड द्वारा दूरभाष की सुविधा उपलब्ध करवाई जायेगी।1425 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2020/18 आषाढ़, 1942 आवास के दूरभाष/मोबाइल खर्चे की प्रतिपूर्ति हेतु उन्हें मु0 3800/- fixed राशि द्विमासिक देय होगी।

6. (क) बोर्ड के सलाहकार उसी निशुल्क चिकित्सा सुविधा के पात्र होंगे जिसके लिए बोर्ड के प्रबन्ध निदेशक पात्र है।

(ख) सलाहकार यात्रा दैनिक भाा बिलों को प्रतिहस्ताक्षरित करने के लिए सक्षम होंगे तथा प्रवास कार्यक्रम को अनुमोदन करने के लिए स्वयं ही नियन्त्रण अधिकारी होंगे। (ग) इनके बिलों का आहरण बोर्ड द्वारा किया जायेगा।

7. सलाहकार को मु0 30000/- रु0 प्रतिमास के दर से पारिश्रमिक देय होगा।

8. सलाहकार को पहाड़ी तथा मैदानी क्षेत्रों में पूर्व की भान्ति मु0 8.00 (आठ रुपये) प्रति कि0 मी0 की दर से मील भाा (रोड माईलेज) देय होगा, यदि वे निजी वाहन द्वारा बोर्ड के कार्य से प्रवास पर जाते हैं।

उपरोक्त सभी सुविधायें एवं सेवा शर्तें विा विभाग के दैनिकी संख्या 55048086-विा (सी)बी(15)-4/2016, दिनांक 26-6-2020 द्वारा जारी संस्तुति व विधि विभाग द्वारा जारी अध्यादेश के अनुसार एक वर्ष की अवधि के लिए उपाध्यक्ष के 30% वेतन आदि को कम करने की शर्त के अधीन जारी की जाती है।

2020 का हिमाचल प्रदेश अध्यादेश संख्यांक 3 ठेका श्रम (विनियमन और उत्सादन) हिमाचल प्रदेश संशोधन अध्यादेश, 2020

भारत गणराज्य के इकहत्तरवें वर्ष में हिमाचल प्रदेश के राज्यपाल द्वारा प्रख्यापित 1426 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2020/18 आषाढ़, 1942 हिमाचल प्रदेश राज्य को यथा लागू ठेका श्रम (विनियमन और उत्सादन) अधिनियम,1970 (1970 का अधिनियम संख्यांक 37) का संशोधन करने के लिए अध्यादेश।

क्योंकि हिमाचल प्रदेश विधान सभा सत्र में नहीं है और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं जिनके कारण उनके लिए तुरन्त कार्रवाई करना आवश्यक हो गया है;

अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 213 के खण्ड (1) द्वार प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अध्यादेश प्रख्यापित करते हैंः-

1. संक्षिप्त नाम.--इस अध्यादेश का संक्षिप्त नाम ठेका श्रम (विनियमन और उत्सादन) हिमाचल प्रदेश संशोधन अध्यादेश, 2020 है।

2. धारा 1 का संशोधन.--हिमाचल प्रदेश राज्य को यथा लागू ठेका श्रम (विनियमन और उत्सादन) अधिनियम, 1970 ( 1970 का अधिनियम संख्यांक 37) की धारा 1 की उपधारा (4) मेें शब्द ''बीस'' जहाँ-जहाँ आता है के स्थान पर ''तीस'' शब्द रखा जाएगा।

Promulgated by the Governor of Himachal Pradesh in the Seventy-first Year of the

Republic of India.

AN ORDINANCE, to amend the Contract Labour (Regulation and Abolition) Act, 1970 (Act No. 37 of 1970) in its application to the State of Himachal Pradesh.

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the Governor of the State of Himachal Pradesh is satisfied that the circumstances exists which render it necessary for him to take immediate action;

2. Amendment of Section 1.—In Section 1 of the Contract Labour (Regulation and Abolition) Act, 1970 (Act No. 37 of 1970), in its application to the State of Himachal Pradesh, in sub- section 4, for the word "twenty" wherever occurs, the word "thirty" shall be substituted.

हिमाचल प्रदेश राज्य को यथा लागू औद्योगिक विवाद अधिनियम, 1947 (1947 का अधिनियम संख्यांक 14) का संशोधन करने के लिए अध्यादेश।

अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अध्यादेश प्रख्यापित करते हैंः- 1. संक्षिप्त नाम.--इस अध्यादेश का संक्षिप्त नाम औद्योगिक विवाद (हिमाचल प्रदेश संशोधन) अध्यादेश, 2020 है।

2. धारा 22 का संशोधन.- हिमाचल प्रदेश राज्य को यथा लागू औद्योगिक विवाद अधिनियम, 1947 (जिसे इसमें इसके पश्चात्‌्‌्‌ ''मूल अधिनियम'' कहा गया है) की धारा 22 की उपधारा (1) और उपधारा (2) में ''लोक उपयोगी सेवा'' शब्दों के पश्चात्‌ ''और गैर-लोक उपयोगी सेवा'' शब्द अन्तःस्थापित किए जाएंगे। 3. धारा 25 च का संशोधन.- मूल अधिनियम की धारा 25 के खण्ड (ख) में शब्दों '' पन्द्रह दिन'' के स्थान पर ''साठ दिन'' शब्द रखे जाएंगे।

4. धारा 25 ट का संशोधन :- मूल अधिनियम की धारा 25 ट की उपधारा (1) में शब्दों ''एक सौ'' के स्थान पर ''दो सौ'' शब्द रखे जाएंगे ।

Amendment of Section 22.—In Section 22 of the Industrial Disputes Act, 1947, in its application to the State of Himachal Pradesh (hereinafter referred to as the "principal Act"), in sub- sections (1) and (2), after the words "public utility service", the words "and non-public utility service" shall be inserted.

3. Amendment of Section 25F.—In Section 25 F of the principal Act, in clause (b), for the words "fifteen days", the words "sixty days" shall be substituted.

4. Amendment of section 25K.—In Section 25 K of the principal Act, in sub-section (1), for the words "one hundred", the words "two hundred" shall be substituted.

2020 का हिमाचल प्रदेश अध्यादेश संख्यांक 5 कारखाना (हिमाचल प्रदेश संशोधन) अध्यादेश, 2020

हिमाचल प्रदेश राज्य को यथा लागू कारखाना अधिनियम, 1948 (1948 का अधिनियम संख्यांक 63) का संशोधन करने के लिए अध्यादेश।

अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अध्यादेश प्रख्यापित करते हैंः-

1. संक्षिप्त नाम.--इस अध्यादेश का संक्षिप्त नाम कारखाना (हिमाचल प्रदेश संशोधन) अध्यादेश, 2020 है।

2. धारा 2 का संशोधन.--हिमाचल प्रदेश राज्य को यथा लागू कारखाना अधिनियम, 1948 (जिसे इसमें इसके पश्चात्‌्‌्‌ ''मूल अधिनियम'' कहा गया है) की धारा 2 के खण्ड (ड) में,-1431 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2020/18 आषाढ़, 1942 (क) उप खण्ड (i) में शब्द ''दस'' के स्थान पर ''बीस'' शब्द रखा जाएगा; और

(ख) उप खण्ड (ii) में शब्द ''बीस'' के स्थान पर ''चालीस'' शब्द रखा जाएगा।

3. धारा 65 का संशोधन.--मूल अधिनियम की धारा 65 की उपधारा (3) के खण्ड (iv) में शब्दों ''पचहत्तर से अधिक नहीं होगी'' के स्थान पर'', इस शर्त के अध्यधीन कि अतिकाल के लिए साधारण मजदूरी की दर का दो गुणा संदत्त किया जाएगा, वर्ष की किसी भी तिमाही में एक सौ पन्द्रह से अधिक नहीं होगाी'', चिह्न और शब्द रखे जाएंगे।

4. धारा 85 का संशोधन.--मूल अधिनियम की धारा 85 की उपधारा (1) के खण्ड (i) में शब्दों ''दस'' और ''बीस'' के स्थान पर क्रमशः ''बीस'' और ''चालीस'' शब्द रखे जाएंगे।

5. धारा 106 ख का अंतःस्थापन.--मूल अधिनियम की धारा 106 क के पश्चात्‌्‌ निम्नलिखित धारा अंतःस्थापित की जाएगी, अर्थात्‌्‌ः-

''106 ख. अपराधों का शमन.-मुख्य निरीक्षक, राज्य सरकार के किसी साधारण या विशेष आदेश के अध्यधीन, इस अधिनियम के अधीन केवल जुर्माने से दण्डनीय और प्रथम बार किए गए किसी अपराध का, अभियोजन को संस्थित करने से पूर्व या उसके पश्चात्‌्‌ प्रशमन फीस की ऐसी रकम, जैसी वह उचित समझे, किन्तु अपराध के लिए नियत जुर्माने की अधिकतम रकम से अनधिक वसूली पर किसी अपराध का शमन कर सकेगा; और जहां अपराध का शमन,-

(क) अभियोजन संस्थित करने के पूर्व किया जाता है, तो अपराधी ऐसे अपराध के लिए अभियोजन हेतु दायी नहीं होगा और यदि वह अभिरक्षा में है, तो उसे मुक्त कर दिया जाएगा; और

(ख) अभियोजन संस्थित करने के पश्चात्‌ किया जाता है, तो शमन से उस अपराधी की दोषमुक्ति प्रभावी होगी, जिससे अपराध का शमन हुआ है।

Himachal Pradesh Ordinance No. 5 of 2020 THE FACTORIES (HIMACHAL PRADESH AMENDMENT)

ORDINANCE, 2020

Promulgated by the Governor of Himachal Pradesh in the Seventy-first Year of the

Republic of India.

1432 राजपत्र, हिमाचल प्रदेश, 09 जुलाई, 2020/18 आषाढ़, 1942 AN ORDINANCE to amend the Factories Act, 1948 (Act No. 63 of 1948) in its application to the State of Himachal Pradesh.

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Governor of Himachal Pradesh is pleased to promulgate the following Ordinance:—

1. Short title.—This Ordinance may be called the Factories (Himachal Pradesh Amendment) Ordinance, 2020.

2. Amendment of section 2.—In section 2 of the Factories Act, 1948, in its application to the State of Himachal Pradesh (hereinafter referred to as the "principal Act"), in clause (m),—

(a) in sub-clause (i), for the word "ten", the word " twenty" shall be substituted; and (b) in sub-clause (ii), for the word "twenty", the word "forty" shall be substituted.

3. Amendment of section 65.—In section 65 of the principal Act, in sub- section (3), in clause (iv), for the words "seventy-five", the words "one hundred and fifteen subject to the condition that overtime shall have to be paid twice the rate of ordinary wages" shall be substituted.

4. Amendment of section 85.—In section of the principal Act, in sub-section (1), in clause (i), for the words "ten" and "twenty", the words "twenty" and "forty" shall be substituted respectively.

5. Insertion of section 106 B.—After section 106 A of the principal Act, the following section shall be inserted, namely:—

"106 B. Compounding of offences.- Any offence punishable under this Act with fine only and committed for the first time, may subject to any general or special order of the State Government, be compounded by the Chief Inspector, either before or after the institution of the prosecution, on realization of such amount of composition fee as he thinks fit, but not exceeding the maximum amount of fine fixed for the offence; and where the offence is compounded,—

(a) before the institution of prosecution, the offender shall not be liable to prosecution, for such offence and shall, if in custody, be set at liberty; and (b) after the institution of the prosecution, the composition shall have the effect of an acquittal of the accused with whom the offence has been compounded.".

No. 154, Kotwali Bazar Dharamshala,Tehsil Dharamshala, District Kangra (H.P.) ने इस अदालत में शपथ-पत्र सहित मुकद्दमा दायर किया है कि उसके पुत्र का जन्म दिनांक 14-08-2011 को हुआ है परन्तु एम0सी0 Dharamshala/ग्राम पंचायत में जन्म पंजीकृत न है। अतः इसे पंजीकृत किये जाने के आदेश दिये जायें। इस नोटिस के द्वारा समस्त जनता को तथा सम्बन्धित सम्बन्धियों को सूचित किया जाता है कि यदि किसी को Gauraansh Shah Singh का जन्म पंजीकृत किये जाने बारे कोई एतराज हो तो वह हमारी अदालत में दिनांक 27-07-2020 को असालतन या वकालतन हाजिर आकर अपना एतराज पेश कर सकता है अन्यथा मुताबिक शपथ-पत्र जन्म तिथि पंजीकृत किये जाने बारे आदेश पारित कर दिये जायेंगे।

श्री सुभाष चन्द पुत्र श्री हरि दास, निवासी महाल सन्हुं, मौजा वन्दाहुं, तहसील थुरल, जिला कांगड़ा, (हि0 प्र0) ने एक प्रार्थना-पत्र मय शपथ-पत्र पीठासीन अधिकारी के समक्ष प्रस्तुत करते हुए अनुरोध किया है कि उसके पिता का नाम पंचायत अभिलेख व अन्य दस्तावेज में हरि दास दर्ज है व उसका विख्यात व सही नाम भी हरि दास ही है परन्तु राजस्व अभिलेख महाल सन्हुं, मौजा वन्दाहुं, तहसील थुरल में उसके पिता का नाम हरिया गलत दर्ज हो गया है। अतः प्रार्थी अब अपने पिता का नाम राजस्व अभिलेख महाल सन्हुं, मौजा वन्दाहुं, तहसील थुरल में दुरुस्ती करवा करके श्री हरिया के बजाए हरिया उपनाम हरि दास पुत्री श्री नौधा दर्ज करवाना चाहता है। अतः प्रार्थी का आवेदन स्वीकार करते हुए इस मुस्त्री मुनादी चस्पांगी व इश्तहार अखबारी के माध्यम से आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को उक्त प्रार्थी के पिता के नाम की राजस्व अभिलेख महाल सन्हुं, मौजा वन्दाहुं, तहसील थुरल में श्री हरिया के बजाए हरिया उपनाम हरि दास पुत्री श्री नौधा दर्ज करवाने बारे किसी किस्म की आपत्ति या उजर हो तो वह तारीख पेशी 30-07-2020 को असालतन या वकालतन हाजिर अदालत होकर अपना उजर पेश कर सकता है अन्यथा बाद तारीख पेशी किसी किस्म का उजर एवं एतराज नहीं सुना जावेगा व नाम दुरुस्ती का आदेश पारित कर दिया जाएगा।
