संख्या ः पीसीएच-एसएमए(देवठी)/2018-19932.--यह कि खण्ड विकास अधिकारी विकास खण्ड रामपुर, जिला शिमला के कार्यालय पत्र संख्या आर0वी0/6585 दिनांक 10-10-2018 के माध्यम से प्राप्त प्रारम्भिक जांच रिपोर्ट अनुसार श्रीमती इन्दुबाला, प्रधान, ग्राम पंचायत देवठी, विकास खण्ड रामपुर, जिला शिमला के विरुद्ध प्रथम दृष्टय आरोपों में सलिप्त होने के कारण उन्हें हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 145 (1) (ग) के अन्तर्गत इस कार्यालय द्वारा कारण बताओ नोटिस संख्या पीसीएच-एसएमएल(देवठी)/2018-8963 दिनांक 29-01-2019 जारी किया गया था जिसका उत्तर अधोहस्ताक्षरी के कार्यालय में दिनांक 11-02-2019 को प्राप्त हुआ था। उक्त प्रधान द्वारा दिए गए उत्तर की गहनता से जांच की गई और पाया गया कि उत्तर संतोषजनक नहीं है तथा आरोपों की नियमित जांच की जानी आवश्यक है।

यह कि नियमित जांच हेतु मामला इस कार्यालय के आदेश संख्या पीसीएस-एसएमएल (देवठी)/2018-10221-27 दिनांक 14-03-2019 के द्वारा उप-निदेशक एवं परियोजना अधिकारी, जिला ग्रामीण विकास अभिकरण, जिला शिमला को प्रेषित किया गया तथा उप-निदेशक एवं परियोजना अधिकारी जिला ग्रामीण विकास अभिकरण, जिला शिमला द्वारा उनके कार्यालय पत्र संख्या डीआरडीए(एस)-जांच देवठी-2018-1831 दिनांक 17-03-2020 के द्वारा नियमित जांच रिपोर्ट इस कार्यालय को प्रेषित की गई है। उप-निदेशक एवं परियोजना अधिकारी, जिला ग्रामीण विकास अभिकरण, जिला शिमला द्वारा प्रधान के विरुद्ध लगाए गए आरोप संख्या 1 से 3 की जांच की गई तथा आरोप संख्या 1 से 3 जांच अधिकारी द्वारा सिद्ध पाए गए। जांच रिपोर्ट में यह प्रमाणित हुआ है किः--

यह कि ग्राम पंचायत द्वारा 14वां वित्तायोग के अन्तर्गत निष्पादित कार्य मुरम्मत रास्ता केवल राम के खेत से सड़क तक के संधारित मस्ट्रोल संख्या 17651 में श्रीमती पवन कुमारी पत्नी श्री ईशान सिंह, गांव सूम, डाकघर देवठी (जो प्रधान श्रीमती इन्दुबाला की बहू है तथा उपायुक्त किन्नौर के कार्यालय में एनआईसी शाखा में आउटसोर्स पर कार्यरत है) व श्री यशवन्त सिंह पुत्र श्री रोशन लाल गांव सूम, डाकघर देवठी की फर्जी उपस्थिति दर्ज कर उनको मु0 3800-3800/- रुपये की अदायगी की गई है। उक्त मस्ट्रोल प्रधान श्रीमती इन्दुबाला द्वारा प्रमाणित व हस्ताक्षरित किया गया है जबकि श्रीमती पवन कुमारी व श्री यशवंत सिंह (उपरोक्त) के ब्यानानुसार उन द्वारा उक्त मस्ट्रोल में कार्य नहीं किया गया है। श्री देवी सिंह, पंचायत सचिव, ग्राम पंचायत देवठी के ब्यानानुसार उक्त कार्य के लिए श्री यशवन्त सिंह से मु0 3800/-रु0 रसीद संख्या 171335 दिनांक 30-07-2019 को तथा श्रीमती पवन कुमारी मस्ट्रोल संख्या 17651 से मु0 3800 रु0 रसीद संख्या 17133 दिनांक 21-07-2018/15-4-2019/20 को ग्राम पंचायत देवठी को वापिस प्राप्त हुए हैं। यह कि उप-निदेशक एवं परियोजना अधिकारी जिला ग्रामीण विकास अभिकरण, जिला शिमला द्वारा प्रस्तुत जांच रिपोर्ट को उक्त प्रधान को इस आशय सहित प्रेषित किया गया था कि इस सम्बन्ध में लिखित टिप्पणियां अधोहस्ताक्षरी के कार्यालय का प्रस्तुत करें। उक्त प्रधान का लिखित उत्तर इस कार्यालय में दिनांक 27-6-2020 को प्राप्त हुआ है। प्रधान द्वारा अपने उत्तर में दो व्यक्तियों की फर्जी उपस्थिति दर्ज करने तथा उनको मु0 3800-3800/- रु0 की अदायगी करने के आरोप को नकारा गया है क्योंकि शिकायतकर्ता इन आरोपों के सम्बन्ध में कोई ठोस प्रमाण पेश नहीं कर सका, जबकि जांच रिपोर्ट अनुसार फर्जी उपस्थिति दर्ज कर झूठे अभिलेख प्रस्तुत करना, उन्हें सत्यापित करना तथा मु0 3800-3800/-रु0 की अदायगी करने के आरोप समुचित साक्ष्यों प्रमाणों तथा गवाहिओं के आधार पर प्रमाणित हुए हैं। इस तरह उक्त प्रधान का यह कथन तर्कसंगत प्रतीत नहीं होता कि शिकायतकर्ता इन आरोपों के सम्बन्ध में कोई ठोस प्रमाण पेश नहीं कर सका।

यह कि मैंने उप-निदेशक एवं परियोजना अधिकारी जिला ग्रामीण विकास अभिकरण शिमला द्वारा प्रस्तुत जांच रिपोर्ट व प्रधान, ग्राम पंचायत देवठी, विकास खण्ड रामपुर द्वारा दिए गए उत्तर का अवलोकन कर2267 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2020/08 श्रावण, 1942 लिया है। उक्त प्रधान से प्राप्त उत्तर तथ्यों पर आधारित व संतोषजनक नहीं पाया गया है। उक्त मस्ट्रोल संख्या 17651 में श्रीमती पवन कुमारी पत्नी श्री ईशान सिंह, गांव सूम, डाकघर देवठी व श्री यशवन्त सिंह पुत्र श्री रोशन लाल, गांव सूम, डाकघर देवठी की फर्जी उपस्थिति दर्ज की गई है तथा उक्त दोनों को मु0 3800-3800/-(कुल 7600/-रु0) की अदायगी की गई है जबकि उन दोनों द्वारा कार्य नहीं किया गया है जिससे इस सम्बन्ध में झूठे अभिलेखों को तैयार/सत्यापित करना एवं धन का दुरुप्योग व छलहरण प्रमाणित होता है।

अतः जांच रिपोर्ट व प्रधान द्वारा प्रस्तुत उार पर गहनता से विचार करने के उपरान्त मैं सन्तुष्ट हूं कि उक्त प्रधान द्वारा अपने र्काव्य के निर्वहन में गम्भीर अनियमितता की है तथा पद का दुरुपयोग किया है। वह ग्राम पंचायत में झूठे अभिलेख प्रमाणित व प्रस्तुत करने की दोषी पाई गई हैं। इस प्रकार वे हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 146 के अन्तर्गत अपने र्काव्य निर्वहन के अवचार में दोषी है तथा प्रधान जैसे गरिमामय पद पर बने रहने के योग्य नहीं है।

अतः उपरोक्त तथ्यों के दृष्टिगत, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 146 के अन्तर्गत श्रीमती इन्दुबाला, प्रधान, ग्राम पंचायत देवठी, विकास खण्ड रामपुर, जिला शिमला को तत्काल प्रभाव से प्रधान पद से निष्कासित किया जाता है तथा हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 146(2) के अन्तर्गत इस आदेश के जारी होने के छः वर्ष की कालावधि के लिए पंचायत निर्वाचन हेतु निरर्हित किया जाता है। यह भी आदेश दिए जाते हैं यदि उनके पास ग्राम पंचायत की कोई चल, अचल सम्पाि, मोहर, रिकार्ड व नकदी के रूप में है, तो उसे तुरन्त पंचायत सचिव को सौपना सुनिश्चित करे।

No. FDS-34-690/77-XII-3750-96.—In supersession of all previous notifications and vide Department's Notification No. FDS-A(3)7/2016 dated 30-06-2020 vide which H.P. Hoarding and Profiteering Prevention Order,1977 and Himachal Pradesh Commodities Price Marking and Display Order,1977 has been evoked, and in exercise of the powers conferred upon me under clause 3(1)(d) of the H.P. Hoarding and Profiteering Prevention Order, 1977, I, Dr. Raj Krishan Pruthi, I.A.S. District Magistrate, Sirmaur do hereby fix the retail prices including all taxes and other incidental charges in respect of the following essential commodities that may be charged by the dealers or a retailer in Sirmaur district with immediate effect. These rates will be applicable till 30th September, 2020 in District Sirmaur.

Note:—Every dealer/shopkeeper will issue cash memo to each consumer and keep copy of the same for inspection please.

The dealer /shopkeeper shall display the price list of these commodities at the entrance of the business premises which will be signed and dated by the Owner/Partner/Manager.

सं0 पी0बी0डब्ल्यू0(बी0)एफ(5) 7/2020.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव कावगड़ी, तहसील सोलन,2269 राजपत्र, हिमाचल प्रदेश, 30 जुलाई, 2020/08 श्रावण, 1942 जिला सोलन, हिमाचल प्रदेश में सोलन बाईपास सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप-धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यों को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, विन्टर फिल्ड शिमला (हि0 प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

No. GAD-C(CC)1(A)1/2017-L.—In pursuance of Article 164 (1) of the Constitution of India, the Governor, Himachal Pradesh has been pleased to appoint, on the advice of the Chief Minister the following Members of the Himachal Pradesh Legislative Assembly as Cabinet Ministers for the State of Himachal Pradesh:—
