संख्या टी0पी0टी0-ए(3)-6/2020.--हिमाचल प्रदेश के राज्यपाल, मोटर यान अधिनियम, 1988 (1988 का अधिनियम संख्यांक 59) की धारा 212 के साथ पठित धारा 211 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः 5-24/88-टी पी टी-III तारीख 12 जुलाई, 1999 द्वारा 83-राजपत्र/2020-19-08-2020 (2723) 2724 राजपत्र, हिमाचल प्रदेश, 19 अगस्त, 2020/28 श्रावण, 1942 राजपत्र (असाधारण), हिमाचल प्रदेश में तारीख 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटर यान नियम, 1999 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं, और उन्हें जनसाधारण की सूचना के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

इन प्रारूप नियमों से संभाव्यतः प्रभावित होने वाले यदि किसी व्यक्ति/व्यक्तियों के इन प्रारूप नियमों की बाबत कोई आक्षेप या सुझाव है/हैं; तो वह उक्त प्रारूप नियमों के राजपत्र ई-गजट, हिमाचल प्रदेश में प्रकाशन की तारीख से इक्कीस दिन की अवधि के भीतर प्रधान सचिव, परिवहन, हिमाचल प्रदेश सरकार, शिमला-2 को लिखित आक्षेप या सुझाव भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आपेक्ष या सुझाव, यदि कोई है/हैं, पर उक्त प्रारुप नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा; अर्थात्‌ः-

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटर यान द्वितीय संशोधन नियम, 2020 है।

(2) ये नियम राजपत्र ई-गजट, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत होंगे।

2. नियम 69-क का प्रतिस्थापन.--हिमाचल प्रदेश मोटर यान नियम, 1999 के नियम 69-क के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ः-

''69-क. अखिल भारतीय अनुज्ञापत्रों के लिए कम्पोजिट फीस.--पर्यटन यान, जिन्हें मोटरयान अधिनियम, 1988 की धारा 88 की उपधारा 9 के अधीन किसी अन्य राज्य या संघ राज्य क्षेत्र के किसी राज्य परिवहन प्राधिकरण द्वारा प्रदान किए गए अखिल भारतीय अनुज्ञापत्र के अधीन हिमाचल प्रदेश राज्य में चलाना प्राधिकृत है, की बाबत कम्पोजिट फीस निम्नलिखित दरों पर उदगृहित, प्रभारित और राज्य सरकार को संदत्त की जाएगी'', अर्थात्‌ः-

संचालन के दिनों पर विनिश्चय अनुज्ञापत्र से जुड़े दौरे के कार्यक्रम के आधार पर किया जाएगा, किन्तु यदि यान को राज्य में कम्पोजिट फीस को जमा किए बिना चलाया जाता है, तो व्यतिक्रमी, यान की प्रत्येक श्रेणी को देय, फीस की पांच गुणा शास्ति से दण्डनीय होगा।".

NOTIFICATION

Shimla-2, 17th August, 2020

No. TPT-A (3)-6/2020.—In exercise of the powers conferred by section 211 read with section 212 of the Motor Vehicles Act, 1988 (Act. No 59 of 1988), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Motor Vehicles Rules, 1999, published in Rajpatra (Extra- ordinary), Himachal Pradesh, dated 27th July, 1999 vide this department notification No. 5-24/88-TPT-III dated 12th July, 1999 and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for information of the general public;

If any person(s), likely to be affected by these draft rules, has any objections(s) or suggestions(s) with regard to these draft rules, he/she may send the written objection(s) or suggestion(s) to the Principal Secretary (Transport) to the Government of Himachal Pradesh, Shimla-2 within a period of twenty one days from the date of publication of the said draft rules in the Rajpatra (e-Gazette), Himachal Pradesh;

The objection(s) or suggestion(s), if any, received within the above stipulated period, shall be taken into consideration by the State Government before finalizing the said draft rules, namely:—

Draft Rules

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Motor Vehicles (Second Amendment) Rules, 2020.

(2) They shall come into force from the date of Publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Substitution of Rule 69-A.—For rule 69-A of the Himachal Pradesh Motor Vehicles Rules, 1999, the following shall be substituted, namely:—

"69-A. Composite fee for All India Permits.—There shall be levied, charged and paid to the State Government, a composite fee at the following rates, in respect of tourist vehicles which are authorized to ply in the State of Himachal Pradesh under All India Permits2726 राजपत्र, हिमाचल प्रदेश, 19 अगस्त, 2020/28 श्रावण, 1942 granted by any State Transport Authority of other State or Union Territory under sub- section (9) of section 88 of the Motor Vehicles Act, 1988", namely:—

Decision on days of operation will be taken on the basis of the tour programme associated with the permit, but if the vehicle plied in the State without depositing the Composite Fee, then the defaulter will be punishable with a penalty of five times fee due in each category of vehicle.

संख्याःजे0एस0-बी(एच)1-6/2020-सोलन.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव खिलियां, तहसील नालागढ,़ जिला सोलन, हिमाचल प्रदेश में पम्प हाऊस के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतदद्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वाेक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस उपक्रम में कार्यरत सभी अधिकारियों, कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्याें को करने के लिए सहर्ष प्राधिकार देते हैं। 4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो, तो वह इस अधिसूचना के प्रकाशित होने के 60 (साठ) दिन की अवधि के भीतर लिखित रूप में कलेक्टर/समाहर्ता (लो0नि0वि0 विन्टर फिल्ड, शिमला-3) के समक्ष अपनी आपत्ति दायर कर सकता है।
