No. Rev.B.A(3)-3/2014-IV.— In exercise of the powers conferred upon him under rule 7 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, 2015, the Governor of Himachal Pradesh is pleased to notify the 125-राजपत्र/2020-12-10-2020 (4109)4110 राजपत्र, हिमाचल प्रदेश, 12 अक्तूबर, 2020/20 आश्विन, 1942 constitution of the Expert Group, for the process of acquisition of land for 400 KV single circuit transmission line on double circuit tower from PGCIL Sub-Station Reru Majra (Nalagarh) to Kunihar with provision of 400/220 KV 1X315 MVA Sub Station at Kunihar in District Solan.

The aforesaid Expert Group will act as an independent multi-disciplinary group to evaluate the Social Impact Assessment report submitted by the Social Impact Assessment Unit for carrying out the purposes of the Act ibid for the Project i.e "400 KV single circuit transmission line on double circuit tower from PGCIL Sub Station Reru Majra (Nalagarh) to Kunihar with provision of 400/220 KV 1X315 MVA Sub Station at Kunihar in District Solan". The Expert Group shall make a recommendation within Two Months from the date of its constitution to the Government as provided under sub-section (6) of section 7 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The Requiring Body (HPSEB) shall bear the TA/DA and sitting expenses of the members.

सं0 ई.एक्स.एन.-एफ.(10)-17/2020.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) (इसके पश्चात इस अधिसूचना में संदर्भित किया गया है), की धारा 148 के साथ पठित धारा 128 में प्रदत्त शक्तियों का प्रयोग करते हुए, राज्यपाल, हिमाचल प्रदेश, परिषद की संस्तुति पर, हिमाचल प्रदेश की अधिसूचना संख्या ई.एक्स.एन.-एफ.(10)-44/2017 दिनांक 16-01-2018 को प्रकाशित किया गया है के 4112 राजपत्र, हिमाचल प्रदेश, 12 अक्तूबर, 2020/20 आश्विन, 1942 अन्तर्गत प्रकाशित अधिसूचना संख्या 73/2017-राज्य कर में सहर्ष निम्नलिखित और संशोधन करते हैं, अर्थातः-

उक्त अधिसूचना में दूसरे परन्तुक के पश्चात्‌्‌ निम्न परन्तुक स्थापित किया जाएगा, अर्थात्‌ः- ''परन्तु यह भी कि उन रजिस्ट्रीकृत व्यक्तियों के लिए जो कि जुलाई, 2017 से मार्च, 2019 तक की तिमाहियों से सम्बंधित प्ररूप जीएसटीआर-4 में नियत तारीख तक विवरणी प्रस्तुत नहीं कर पाए थे, लेकिन उक्त विवरणी को समयावधि सितंबर, 2019 के 22वें दिन से अक्टूबर, 2020 के 31वें दिन तक प्रस्तुत करते हैं, उक्त अधिनियम की धारा 47 के प्रावधानों के अधीन देय विलंब फीस को दो सौ पचास रुपये से अधिक अधित्यजन किया जाता है, और उन करदाताओं के लिए देय विलंब फीस को पूर्ण रूप से अधित्यजन किया जाता है जिनके लिए कुल देय राज्य कर की राशि शून्य है।"

NOTIFICATION No. 67/2020-State Tax

Shimla-2, the 6th October, 2020

No. EXN-F(10)-17/2020.—In exercise of the powers conferred by Section 128 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereafter in this notification referred to as the said Act), read with Section 148 of the said Act, the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to make the following further amendments in the notification of the Government of Himachal Pradesh No. 73/2017-State Tax, dated the 16th January, 2018, published in the Gazette of Himachal Pradesh vide number EXN- F(10)-44/2017, dated the 20th January, 2018, namely :–

In the said notification, after the second proviso, the following proviso shall be inserted, namely: –

"Provided also that late fee payable under section 47 of the said Act, shall stand waived which is in excess of two hundred and fifty rupees and shall stand fully waived where the total amount of state tax payable in the said return is nil, for the registered persons who failed to furnish the return in FORM GSTR-4 for the quarters from July, 2017 to March, 2019 by the due date but furnishes the said return between the period from 22nd day of September, 2019 to 31st day of October, 2020.".

Shimla-2, the 6th October, 2020

No. EXN-F(10)-17/2020.—In exercise of the powers conferred by section 128 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) (hereafter in this notification referred to as the said Act), the Governor of Himachal Pradesh, on the recommendations of the Council, is please to waive the amount of late fee payable under section 47 of the said Act which is in excess of two hundred and fifty rupees, for the registered persons who fail to furnish the return in FORM GSTR-10 by the due date but furnishes the said return between the period from 22nd day of September, 2020 to 31st day of December, 2020.".

No. EXN-F(10)-4/2020-Vol-I.—In exercise of the powers conferred by section 164 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) read with rule 3 of the Himachal Pradesh Goods and Services Tax (fifth Amendment) Rules, 2020 (hereinafter referred to as the rules), made vide notification No. 38/2020-State Tax, dated the 26th September, 2020, published in the Gazette of Himachal Pradesh, vide number EXN-F( 10)-4/2020, dated the 26th September 2020, the Governor of Himachal Pradesh is pleased to appoint the 8th day of June, 2020, as the date from which the said provisions of the rules, shall come into force.

सं0 ई.एक्स.एन.-एफ.(10)-14/2020-वाल-1.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) की धारा 164 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राज्यपाल, हिमाचल सरकार परिषद की सिफारिशाें पर, हिमाचल प्रदेश माल और सेवा कर नियम, 2017 का और संशोधन करने के लिए निम्नलिखित नियम, 2020 बनाते हैं, अर्थात्‌ः-

1. (1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश माल और सेवा कर (छठा संशोधन) नियम, 2020 है।4115 राजपत्र, हिमाचल प्रदेश, 12 अक्तूबर, 2020/20 आश्विन, 1942 2. हिमाचल प्रदेश माल और सेवा कर नियम, 2017 (जिसे इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 26 के उपनियम (1) में, दूसरे परन्तुक के स्थान पर निम्नलिखित परन्तुकों को प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"परंतु यह और कि किसी भी रजिस्ट्रीकृत व्यक्ति को, जो कि कम्पनी अधिनियम, 2013 (2013 का 18) के उपबंधों के अधीन रजिस्ट्रीकृत हो, को 21 अप्रैल 2020 से 30 सितंबर, 2020 तक की अवधि के दौरान, धारा 39 के तहत प्ररूप जीएसटीआर-3ख में प्रस्तुत की जाने वाली विवरणी को इलैक्ट्रानिक सत्यापन कोड (ईवीसी) के माध्यम से सत्यापित करने की भी अनुमति हैः-

"परंतु यह भी कि किसी भी रजिस्ट्रीकृत व्यक्ति को, जो कि कम्पनी अनिनियम, 2013 (2013 का 18) के उपबंधों के अधीन रजिस्ट्रीकृत हो, को 27 मई, 2020 से 30 सितंबर, 2020 तक की अवधि के दौरान, धारा 37 के तहत प्ररूप जीएसटीआर-1 में प्रस्तुत किए जाने वाले जावक प्रदायों के ब्योरे को इलेक्ट्रानिक सत्यापन कोड (ईवीसी) के माध्यम से सत्यापित करने की भी अनुमति है।''

NOTIFICATION No. 48/2020-State Tax

No. EXN-F(10)-14/2020-Vol-I.—In exercise of the powers conferred by section 164 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to make the following rules further to amend the Central Goods and Services Tax Rules, 2017, namely:—

1. (1) These rules may be called the Central Goods and Services Tax (Sixth Amendment) Rules, 2020.

(2) They shall come into force on 27th day of May, 2020.

2. In the Himachal Pradesh Goods and Services Tax Rules, 2017 (hereinafter referred to as the said rules), in rule 26 in sub-rule (1), for the second proviso, following provisos shall be substituted, namely:—

"Provided further that a registered person registered under the provisions of the Companies Act, 2013 (18 of 2013) shall, during the period from the 21st day of April, 2020 to the 30th day of September, 2020, also be allowed to furnish the return under Section 39 in FORM GSTR-3B verified through electronic verification code (EVC).

Provided also that a registered person registered under the provisions of the Companies Act, 2013 (18 of 2013) shall, during the period from the 27th day of May, 2020 to the 30th day4116 राजपत्र, हिमाचल प्रदेश, 12 अक्तूबर, 2020/20 आश्विन, 1942 of September, 2020, also be allowed to furnish the details of outward supplies under section 37 in FORM GSTR-1 verified through electronic verification code (EVC).".

No. EXN-F(10)-14/2020.—In exercise of the powers conferred by section 148 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to make the following further amendment in the notification of the Government of Himachal Pradesh, No. 21/2019-State Tax, dated the 30th May, 2019, published in the Gazette of Himachal Pradesh vide number EXN-F(10)- 4/2019, dated the 3rd June, 2019, namely:—

In the said notification, in the third paragraph, in the first proviso, for the figures, letters and words "15th day of July, 2020", the figures, letters and words "31st day of October, 2020" shall be substituted.

नरेश कुमार पुत्र श्री छोपेल, गांव व डाकघर यूरनाथ, तहसील लाहौल, जिला लाहौल एवं स्पिति (हि0 प्र0) ने एक आवेदन-पत्र शपथ-पत्र सहित वराए नाम दुरुस्ती इस अदालत में प्रस्तुत किया है जिसमें उसने उल्लेख किया है कि उसका नाम आधार कार्ड में नरेश कुमार दर्ज है तथा परिवार रजिस्टर नकल में ज्ञालछन उर्फ नरेश कुमार दर्ज है। लेकिन पटवार वृत्त गुमरंग, तहसील लाहौल, जिला लाहौल एवं स्पिति में ज्ञालछन दर्ज है। जिस कारण उन्हें भारी मानसिक परेशानी का सामना करना पड़ रहा है। अब प्रार्थी राजस्व अभिलेख पटवार वृत्त गुमरंग, तहसील लाहौल, जिला लाहौल एवं स्पिति में अपना नाम दुरुस्त करवाना चाहता है। इस सन्दर्भ में क्षेत्रीय अभिकरण की रिपोर्ट अनुसार व वाशिन्दगान देह के ब्यान अनुसार राजस्व अभिलेख 4128 राजपत्र, हिमाचल प्रदेश, 12 अक्तूबर, 2020/20 आश्विन, 1942 पटवार वृत्त गुमरंग में ज्ञालछन के स्थान पर ज्ञालछन उर्फ नरेश कुमार का इन्द्राज करने बारे सहमति जताई है।

अतः इस नोटिस द्वारा आम जनता एवं सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को पटवार वृत्त गुमरंग में मौजूद राजस्व अभिलेख में ज्ञालछन के स्थान पर ज्ञालछन उर्फ नरेश कुमार दर्ज करने में कोई उजर व एतराज हो तो इस अदालत में दिनांक 24-10-2020 तक असालतन या वकालतन हाजिर आकर अपना एतराज पेश कर सकता है। अन्यथा मुताबिक क्षेत्रीय अभिकरण की रिपोर्ट, शपथ-पत्र तथा परिवार रजिस्टर के आधार पर प्रार्थी का नाम पटवार वृत्त गुमरंग में राजस्व अभिलेख में ज्ञालछन के स्थान पर ज्ञालछन उर्फ नरेश कुमार दर्ज करने के आदेश पारित कर दिए जायेंगे।
