संख्या इण्ड-II (एफ)10-7/2018.--हिमाचल प्रदेश के राज्यपाल, खान और खनिज (विकास और विनियमन) अधिनियम, 1957 (1957 का 67) की धारा 9 ख, और 15 क के साथ पठित धारा 15 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः इण्ड-बी-एफ-(6)-31/2016, तारीख 22-8-2016 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 27-8-2016 को प्रकाशित हिमाचल 142-राजपत्र/2020-03-11-2020 (4769) 4770 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942 प्रदेश जिला खनिज संस्थान न्यास नियम, 2016 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश जिला खनिज संस्थान न्यास (संशोधन) नियम, 2020 है।

(2) ये नियम इनके राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृृत्त होंगे। 2. नियम 2 का संशोधन.-हिमाचल प्रदेश जिला खनिज संस्थान न्यास नियम, 2016 (जिसे इसमें इसके पश्चात्‌्‌ 'उक्त नियम' कहा गया है) के नियम 2 में,-

(क) उप-नियम (1) में खण्ड (ख) के नीचे स्पष्टीकरण में उप खण्ड (i) और (ii) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌्‌ः-

(i) ''प्रत्यक्षतः प्रभावित क्षेत्र''से, ऐसे क्षेत्र अभिप्रेत है जहां प्रत्यक्ष खनन से संबन्धित प्रचालन जैसे उत्खनन, खनन, विस्फोटन, सज्जीकरण और अपशिष्ट निपटान (अतिभार क्षेपण भूमि, टेलिंग तालाब, परिवहन कॉरिडोर आदि) अवस्थित हैं और इसमें निम्नलिखित भी सम्मिलित होगा/होंगेः-

(क) गांव और ग्राम पंचायतें जहां खाने स्थित और संक्रियात्मक हैं। ऐसी खानों के क्षेत्रों का विस्तार समीपवर्ती गांव, खण्ड और जिला तक हो सकेगा;

(ख) हिमाचल प्रदेश में सम्बद्ध जिला सीमाओं को विचार में लाए बिना किसी खान या खानों के समूह (क्लस्टर) से पांच किलोमीटर की परिधि के भीतर का कोई क्षेत्र;

(ग) वे गांव, जहां सम्बद्ध खनन परियोजना प्राधिकरणों द्वारा विस्थापित कुटुम्बों को पुनर्वासित किया गया है; और

(घ) वे गांव जो अपनी आर्थिक आवश्यकताओं को पूरा करने के लिए खनन क्षेत्रों पर निर्भर करते हैं और परियोजना क्षेत्र पर फलोपभोग और पारंपरिक अधिकार, जैसे-चराई, लघु वन उपज आदि का संग्रहण है, के संग्रहण को भी प्रत्यक्षतः प्रभावित क्षेत्र के रूप में समझा जाएगा।

(ii) ''अप्रत्यक्षः प्रभावित क्षेत्र'' स,े हिमाचल प्रदेश के सम्बद्ध जिला की सीमाओं को विचार में लाए बिना, किसी खान या खानों के समूह से, पांच किलोमीटर से 15 किलोमीटर की परिधि के भीतर के ऐसे क्षेत्र अभिप्रेत हैं, जहां कि स्थानीय जनसंख्या की खनन सम्बधी संक्रियाओं के कारण आर्थिक, सामाजिक और पर्यावरणीय परिणामों के कारण प्रतिकूलतः प्रभावित होती है। खनन के प्रमुख नकारात्मक प्रभाव, जल प्रदूषण, मृृदा और वायु की गुणवता का अपकर्षण, नदियों के बहाव में कमी और भूगर्भ जल का कम होना और खनन संक्रियाओं के कारण जमाव और प्रदूषण, खनिजों का परिवहन, विद्यमान अवसंरचना और संसाधनों पर वर्धित भार है; और (ख) उप- नियम (1) के खण्ड (ण) के पश्चात्‌्‌ निम्नलिखित नया खण्ड (त) अन्तःस्थापित किया जाएगा, अर्थात्‌्‌ः-

''(त) ''पी0एम0 के0 के0 के0 वाई0'' स,े प्रधान मन्त्री खनिज क्षेत्र कल्याण योजना अभिप्रेत है।''। 3. नियम 15 का संशोधन.-क्त नियमों के नियम 15 के उपनियम (2) में,-

(क) खण्ड (ख) और (ग) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌्‌ः-4771 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942 ''(ख) न्यास के प्रशासनिक व्ययों के लिए दस प्रतिशत से अनधिक;

(ग) मार्गदर्शक सिद्धान्तों के अनुसार प्रधान मन्त्री खनिज क्षेत्र कल्याण योजना (जिसे पी0 एम0 के0 के0 के0 वाई0 किया गया है) के अधीन जिला खनिज संस्थान न्यास में कुल वार्षिक प्राप्ति का अस्सी प्रतिशत व्यय किया जाएगा। इसके अतिरिक्त, अस्सी प्रतिशत में से साठ प्रतिशत निम्नलिखित स्कीमों के अन्तर्गत उच्च प्राथमिकता वाले क्षेत्रों के लिए उपयोजित किया जाएगाः-

(i) पेयजल प्रदाय.-केन्द्रीयकृृत शोधन प्रणालियों, जल संयन्त्रों, स्थायी/अस्थायी जल संवितरण नेटवर्क, जिसके अन्तर्गत पेयजल हेतु स्वचलित सुविधाएं, नालियां बिछाकर पेयजल प्रदाय प्रणाली भी है।

(ii) पर्यावरण परिरक्षण और प्रदूषण नियन्त्रण उपाय.-बहिःस़्त्राव उपचार संयन्त्र, क्षेत्र में नदी, झीलों, तालाबों, भ्ूाजल, अन्य जल स्त्रोतों के प्रदूषण का नियंत्रण, जिसके अंतर्गत बाढ संरक्षण कार्य खनन संक्रियाओं और, डम्प द्वारा कारित वायु और धूल प्रदूषण नियन्त्रण हेतु उपाय, खनन जल निकास प्रणाली, खनन प्रदूषण नियंत्रण प्रौद्योगिकियां, और परित्यक्त खानों पर कार्य करने हेतु उपाय और पर्यावरण हितैषी तथा धारणीय खनन विकास के लिए अपेक्षित अन्य वायु, जल तथा धरातल प्रदूषण नियंत्रण क्रियाविधियां भी हैं।

(iii) स्वास्थ्य देखभाल.-प्रभावित क्षेत्रों में प्राथमिक/गौण स्वास्थ्य देखभाल सुविधाओं का सृृजन करने पर ध्यान देना होगा। केवल स्वास्थ्य देखभाल अवसंरचना पर ही नहीं,अपितु ऐसी सुविधाओं को प्रभावी बनाने हेतु अपेक्षित आवश्यक कर्मचारी नियुक्त करने, उपस्कर और प्रदायों पर भी बल दिया जाएगा। उस विस्तार तक प्रयास करना कि स्थानीय निकायों, राज्य और केन्द्रीय सरकार के विद्यमान स्वास्थ्य देखभाल केन्द्र के साथ पूरक हों और अभिसार के कार्य करें। खनन संबंधित बीमारियों और रोगों की देखभाल करने के लिए आवश्यक विशेष अवसंरचना की अभिकल्पना के लिए राष्ट्रीय खनिक संस्थान के पास उपलब्ध विशेषज्ञता भी ग्रहण की जा सकेगी। स्वास्थ्य देखभाल के लिए खनन प्रभावित व्यक्तियों के लिए सामूहिक बीमा स्कीम कार्यान्वित की जा सकेगी।

(iv) शिक्षा.-स्कूल भवनों, अतिरिक्त कक्षों, प्रयोगशालाओं, पुस्तकालयों, कला और शिल्प कक्ष, प्रसाधन ब्लॉक, पेयजल व्यवस्था, दूरस्थ क्षेत्रों में छात्रों/शिक्षकों के लिए आवासीय छात्रावास, खेल अवसंरचना, शिक्षकाें/अन्य सहायक कर्मचारिवृृन्द की नियुक्ति ई-लर्निंग सैटअप, परिवहन सुविधाओं की अन्य व्यवस्थाए (बस, साइकिलें/ रिक्शा आदि) और पोषण से संबन्धित कार्यक्रम।

(v) महिलाओं और बालकों का कल्याण.-मातृृ और बाल-स्वास्थ्य की समस्याओं, कुपोषण, संक्रामक रोगों आदि के समाधान के लिए पी0 एम0 के0 के0 के0 वाई0 के अन्तर्गत विशेष कार्यक्रम किए जा सकेंगे।

(vi) वृृद्धों और निःशक्तजनों का कल्याण.-वृृद्धों और निःशक्तजनों के कल्याण के लिए विश्ेाष कार्यक्रम।

(vii) दक्षता विकास.-स्थानीय पात्र व्यक्तियों के लिए जीविका सहायता, आय सृृजन और आर्थिक क्रियाकलाप हेतु दक्षता विकास। परियोजनाओं/स्कीमों के अंतर्गत प्रशिक्षण, दक्षता विकास केन्द्र का विकास, स्वरोजगार स्कीमें, स्वयं सहायता समूह की सहायता और ऐसी स्वरोजगार आर्थिक कार्यकलापों हेतु अग्र और पश्च संयोजन की व्यवस्था भी है। 4772 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942 (viii) स्वच्छता.-अपशिष्ट का संग्रहण, परिवहन और निपटान, सार्वजनिक स्थानों की सफाई, समुचित निकास नाली और मल उपचार संयन्त्र, मल (विष्ठा) गंदगी के निपटान की व्यवस्था प्रसाधन और अन्य सम्बन्धित कार्यकलापों की व्यवस्था। ग-(1) अस्सी प्रतिशत का चालीस प्रतिशत निम्नानुसार स्कीमों के अन्तर्गत अन्य प्राथमिकताओं वाले क्षेत्रों के लिए उपयोजित किया जाएगाः-

(i) भौतिक अवसरंचना.-अपेक्षित भौतिक अवसरंचना के साथ-साथ सड़क, पुलों, रेलवे और जलमार्ग परियोजनाओं की व्यवस्था करना।

(ii) सिंचाई.- सिंचाई के वैकल्पिक स्त्रोत का विकास करना, सिंचाई की उपयुक्त और समुन्नत तकनीकों को अंगीकृृत करना।

(iii) ऊर्जा और जल विभाजक विकास.-वैकल्पिक ऊर्जा स्त्रोत (सूूक्ष्म हाइडल सहित) और वर्षा जल संग्रहण प्रणाली का विकास। फलोद्यानों, एकीकृृत खेती, मितव्ययी वानिकी का विकास और जल संग्रहण क्षेत्रों का पुनरूद्धार।

(iv) सम्बन्धित जिला के खनन क्षेत्रों में पर्यावरण गुणवत्ता बढ़ाने के लिए कोई अन्य उपाय। (v) धारणीय जीविका की व्यवस्था उपलब्ध करने के लिए विन्यास निधि के रूप में वार्षिक प्राप्तियों की युक्तियुक्त रकम रखी जाएगी'';

(ख) खण्ड (घ) का लोप किया जाएगा; और

(ग) उप नियम (3) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात;-

''(3) अनुसूचित क्षेत्र के लिए विशेष उपबंध.-अनुसूचित क्षेत्र में पी0 एम0 के0 के0 के0 वाई0 निधियों के उपयोजन के लिए अपनाई जाने वाली प्रक्रिया अनुसूचित क्षेत्रों और जनजातीय क्षेत्रों के प्रशासन से सम्बन्धित संविधान की पांचवीं और छटी अनुसूची के साथ पठित अनुच्छेद 244 में अन्तर्विष्ट उपबन्धों और पंचायत उपबन्ध (अनुसूचित क्षेत्रों पर विस्तार) अधिनियम, 1996 और अनुसूचित जनजाति और अन्य परंपरागत वन निवासी (वन अधिकारों की मान्यता) अधिनियम, 2006 के उपबन्धों द्वारा मार्गदर्शित होगी।

अनुसूचित क्षेत्रों के भीतर स्थित खनन द्वारा प्रभावित ग्रामों की बाबत;

(i) ग्राम सभा का अनुमोदन अपेक्षित होगाः-

(क) पी0 एम0 के0 के0 के0 वाई0 के अन्तर्गत बनाई जाने वाली समस्त योजनाएं, प्रोग्राम और परियोजनाएं;

(ख) सरकार के विद्यमान मार्गदर्शी सिद्धान्तों के अधीन हिताधिकारियों की पहचान के लिए। (ii) सम्बन्धित गांव में पी0 एम0 के0 के0 के0 वाई0 के अधीन किए गए कार्यों पर रिपोर्ट प्रत्येक वित्तीय वर्ष की समाप्ति के पश्चात्‌्‌ ग्राम सभा को प्रस्तुत की जाएगी।

{ग्राम सभा का वही अर्थ होगा जो उसका पंचायत उपबंध (अनुसूचित क्षेत्रों पर विस्तार) अधिनियम, 1996 (1996 का अधिनियम संख्यांक 40) के लिए उपबंधों के कार्यान्वयन के प्रयोजन के लिए है}।''।4773 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942 4. नियम 24 का जोड़ा जाना.-उक्त नियमों के नियम 23 के पश्चात्‌्‌ निम्नलिखित नया नियम अन्तःस्थापित किया जाएगा, अर्थात्‌्‌ः-

''24. पारदर्शिता का अनुपालन.-प्रत्येक संस्थान जिला बैवसाइट तैयार करेगा और उसका अनुरक्षण करेगा जिसमें, अन्य बातों के साथ-साथ, निम्नलिखित सूचना पोषित की जाएगी और नियमित रूप में अद्यतन रखी जाएगीः-

(क) जिला खनिज संस्थान न्यास के गठन के ब्यौरे।

(ख) खनन द्वारा प्रभावित क्षेत्रों और लोगों की सूची।

(ग) पट्‌्‌टादारों से प्राप्त समस्त अभिदायों का मासिक ब्यौरा।

(घ) समस्त बैठकों की कार्यसूचियाँ, कार्यवृत और जिला खनिज संस्थान न्यास द्वारा, की गई कार्रवाई रिपोर्ट (ए टी आरज़)।

(ङ) व् ाार्षिक योजना और बजट, संकर्म आदेश और वार्षिक रिपोर्ट।

(च) जारी कार्यों की ऑनलाइन प्रास्थिति.-समस्त परियोजनाओं/किए जा रहे कार्यक्रमों की कार्यान्वयन प्रास्थिति/प्रगति वेबसाइट पर उपलब्ध कराई जानी चाहिए, जिसके अंतर्गत कार्य के विवरण, हिताधिकारियों के ब्यौरे, अनुमानित लागत, कार्यान्वित करने वाले अभिकरणों के नाम, कार्य के प्रारंभ होने और पूर्ण होने की प्रत्याशित तारीख अंतिम तिमाही तक वित्तीय और भौतिक प्रगति भी है।

(छ) विभिन्न कल्याणकारी कार्यक्रमों के अधीन हिताधिकारियों की सूची।

(ज) सूचना का अधिकार अधिनियम, 2005 के अधीन स्वैच्छिक प्रकटीकरण।''।

NOTIFICATION

Shimla-2, the 28th October, 2020

No. Ind-II (F)10-7/2018.—In exercise of powers conferred by section 15 read with sections 9B and 15 A of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Governor Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh District Mineral Foundation Trust Rules, 2016 notified vide this4774 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942 department notification No. Ind-B-F(6)-31/2016, dated 22-8-2016 and published in the Rajpatra, Himachal Pradesh dated 27-8-2016, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh District Mineral Foundation Trust (Amendment) Rules, 2020.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e-gazette), Himachal Pradesh.

2. Amedment of rule 2 (a).— In rule 2 of the Himachal Pradesh District Mineral Foundation Trust Rules 2016 (hereinafter referred to as the 'said Rules') for sub- clauses (i) and (ii) of Explanation below clause (b) of sub-rule (1), the following shall be substituted, namely:—

"(i) Directly affected areas' means where direct mining related operations such as excavation, mining, blasting, beneficiation and waste disposal (overburdened dumps, tailing ponds, transport corridors etc.) are located and shall also include the following:—

(a) Village and Gram Panchayats within which the mines are situated and are operational. Such mining areas may extend to neighbouring village, block and districts;

(b) An area within the radius of 5 Kilometres in the Himachal Pradesh from a mine or cluster of mines, irrespective of Districts boundaries concerned;

(c) Villages in which displaced families have been rehabilitated by the concerned mining project authorities; and

(d) Villages that significantly depend on the mining areas for meeting their economic needs and have usufruct and traditional rights over the project areas such as for grazing, collection of minor forest produce etc. shall be considered as directly affected areas.

(ii) 'Indirectly affected areas' means those areas of the Himachal Pradesh within 5 KM to 15 KM of radius from a mine or cluster of mines irrespective of Districts boundaries concerned, where the local population is adversely affected on account of economic, social and environmental consequences due to mining related operations. The major negative impact of mining can be by the way of water pollution, deterioration of soil and air quality, reduction in stream flows and depleting of ground water, congestion and pollution due to mining operations, transportation of minerals, increased burden on existing infrastructure and resources" and

(b) after clause (o) of sub-rule (1), the following new clause (p) shall be

inserted namely:—

"(p) PMKKKY means the Pradhan Mantri Khanij Kashetra Kalyan Yojna."4775 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942

3. Amendment of rule 15.— In rule 15 of the said rules-(a) for clauses (b) and (c) of

sub–rule of (2) the following shall be substituted, namely:—

"(b) not more than 10 % for administrative expenses of the trust."

(c) 80 % of the total annual receipt in the District Mineral Foundation Trust shall be spent under Pradhan Mantri Khanij Kashetra Kalyan Yojna (hereinafter referred to as "PMKKKY") as per the guidelines. Further 60% out of 80 % shall be utilized for high priority areas under schemes as follows:—

(i) Drinking Water Supply.—Centralized purification systems, water treatment plants, permanent/temporary water distribution network including standalone facilities for drinking water, laying of piped water supply system.

(ii) Environment Preservation and Pollution Control Measures.— Effluent treatment plants, prevention of pollution of stream, lakes, ponds, ground water, other water resources in the region including flood protction works, measure for controlling air and dust pollution caused by mining operations and dumps, mine drainage system, mine pollution prevention technologies, and measures for working on abandoned mines and other air, water & surface pollution control mechanisms required for environment-friendly and sustainable mine development.

(iii) Health Care.—The focus must be on creation of primary/secondary health care facilities in the affected areas. The emphasis should not be only on the creation of the health care infrastructure, but also on provision of necessary staffing, equipment and supplies required for making such facilities effective. To that extent, the effort should be supplement and work in convergence with the existing health care infrastructure of the local bodies, state and Central government. The expertise available with the National Institute of Miners' Health may also be drawn upon to design special infrastructure needed to take care of mining related illnesses and diseases. Group Insurance Scheme for health care may be implemented for mining affected persons.

(iv) Education.—Construction of school building, Additional class rooms, Laboratories, Libraries, Art and crafts room, Toilet blocks, drinking water provisions, Residential Hostels for students/ teachers in remote areas, sports infrastructure, engagement of teachers/other supporting staff, e-learning setup, other arrangement of transport facilities (bus/ van/cycles/rickshaws/etc.) and nutrition related programs.

(v) Welfare of Women and Children.—Special program for addressing problems of maternal and child health, malnutrition, infectious diseases, etc. can be taken up under the PMKKKY.

(vi) Welfare of Aged and Disable People.—Special program for welfare of aged and disabled people.

(vii) Skill Development.—Skill development for livelihood support, income generation and economic activities for local eligible persons. The4776 राजपत्र, हिमाचल प्रदेश, 03 नवम्बर, 2020/12 कार्तिक, 1942 projects/schemes may include training, development of skill develop- ment centre, self-employment schemes, support to Self Help Groups and provision of forward and backward linkages for such self-employment economic activities.

(viii) Sanitation.—Collection, transportation & disposal of waste, cleaning of public places, provision of proper drainage & Sewage Treatment Plant, provision for disposal of faecal sludge, provision of toilets and other related activities.

C (1) 40% out of 80% shall be utilized for other priority areas under

schemes as follows:—

(i) Physical infrastructure—to provide required physical infrastructure viz- a-viz road, bridges, railways and waterways projects.

(ii) Irrigation.—Developing alternate sources of irrigation, adoption of suitable and advance irrigation techniques.

(iii) Energy and Watershed Development.—Development of alternate source of energy (including micro-hydel) and rainwater harvesting system. Development of orchards, integrated farming, economic forestry and restoration of catchments.

(iv) Any other measures for enhancing the environment quality in mining areas of respective district.

(v) A reasonable sum of annual receipts should be kept as endowment fund for providing sustainable livelihood";

(b) Clause (d) shall be omitted; and

(c) for sub-rule (3), the following shall be substituted, namely :—

"(3)Special Provision for scheduled area.—The process to be adopted for utilization of PMKKKY funds in the scheduled areas shall be guided by the provisions contained in the Article 244 read with Schedule V and Schedule VI to the Constitution relating to administration of the scheduled areas and tribal areas and the provisions of the Panchayats (Extension to the Schedule Areas) Act, 1996 and the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of the Forest Rights) Act, 2006." In respect of villages affected by mining situated within the Scheduled areas;

(i) approval of Gram Sabha shall be required:—

(a) for all plans, programs and projects to be taken up under PMKKKY;

(b) for identification of beneficiaries under the existing guidelines of the Government.

(ii) report on the works undertaken under PMKKKY in the respective village shall be furnished to the Gram Sabha after completion of every financial year.

[Gram Sabha will have same meaning as assigned to it for the purpose of implementation of the Provisions for the Panchayats (Extension to the Schedules Area) Act, 1996 (Act 40 of 1996)]."

4. Addition of rule 24 After rule 23 of the said rules, the following new rule 24 shall

be inserted, namely:—

"24. Compliance of Transparency.—Each Foundation will prepare and maintain district website on which, inter-alia, following information shall be hosted and kept updated regularly:—

a. Detail of composition of the District Mineral Foundation Trust.

b. List of Areas and people affected by mining.

c. Monthly detail of all contributions received from the lessees.

d. All meeting agenda, minutes and action taken reports (ATRs) of the District Mineral Foundation Trust.

e. Annual Plan and Budgets, Work Orders and Annual report.

f. The composition of District Level Monitoring Committee is as under:—

The District Level Monitoring Committee will be the first line of implementation and monitoring system with in overall framework. It will identify the beneficiaries to ensure viability of the project and prepare viable project reports to support the beneficiaries in collaboration with PMU. It will also examine the proposal and recommend to State level Monitoring Committee for consideration. District level Monitoring Committee will set targets in consultation with State Level Monitoring Committee as per Output and Outcome Monitoring Framework (OOMF) format and monitor the progress closely with the support of PMU. District level Monitoring Committee will also maintain the Dashboard in collaboration with PMU. It will be responsible for the smooth implementation of the scheme and resolve any issues at the district level. In the process of sorting out implementation issues the Committee would be supported by the district administration wherever required.

The Chairman can nominate any other Officer/person as member as per requirement. If the Chairman is busy, meeting will be Chaired by the Vice Chairman.

मोहम्मद इमरान पुत्र सलामुदीन, निवासी लोहगढ़, तहसील पांवटा साहिब, जिला सिरमौर, (हि0 प्र0) ने एक प्रार्थना-पत्र प्रस्तुत करके निवेदन किया है कि आवेदक किन्हीं कारणों से अपनी पुत्री मिशबा की जन्म तिथि 23-12-2015 का इन्द्राज निर्धारित अवधि के अन्दर सम्बन्धित ग्राम पंचायत में दर्ज नहीं करवा पाया है। इस बारे आवेदक द्वारा एक ब्यान हल्फी भी पेश किया गया है तथा इस सम्बन्ध में दो गवाहों के शपथ-पत्र भी आवेदक ने अपने प्रार्थना-पत्र के साथ संलग्न किये हैं। आवेदक ने ग्राम पंचायत हरिपुर खोल में अपनी ऊपर वर्णित पुत्री की जन्म तिथि 23-12-2015 को दर्ज करने का अनुरोध किया है।

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी भी व्यक्ति को मिशबा की जन्म तिथि ग्राम पंचायत हरिपुर खोल, तहसील पांवटा साहिब में दर्ज करने बारे कोई एतराज हो तो वह मिति 14-11-2020 को या इससे पूर्व हमारे न्यायालय में हाजिर होकर लिखित अथवा मौखिक एतराज पेश कर सकता है। उक्त निश्चित तिथि के बाद कोई भी एतराज मान्य नहीं होगा और समझा जायेगा कि उक्त मिशबा की जन्म तिथि को सम्बन्धित ग्राम पंचायत में दर्ज करने बारे किसी को कोई एतराज नहीं है तथा नियमानुसार जन्म तिथि पंजीकरण के आदेश जारी कर दिये जायेंगे।
