No. SEC(F)1-3/2019-I-4072-4364.—Whereas the State Election Commission vide its letter No. SEC (F)1-3-I-3487-3498 dated 21st October, 2020 had fixed a schedule for identification of households, mapping of electors in the respective wards of the Panchayats, newly created or affected by re-organisation process and a preview copy of the electoral roll was to be generated and placed before the Panchayats on 05th November, 2020, to check the accuracy of the draft electoral roll;

And whereas this exercise has been completed and stage of the electoral rolls has been shifted from working to the draft in the ERMS software;

Therefore, the State Election Commission in exercise of the powers vested in it under Article 243K and 243ZA of the Constitution of India, Section 160 of the H.P. Panchayati Raj Act, 1994, Section 281 of the H.P. Municipal Act, 1994, Rule 12 of the H.P. Panchayati Raj (Election) Rules,1994 and Rule 14 of H.P. Municipal Election Rules, 2015 do hereby issue the following schedule for updation of electoral rolls in the newly created/ re-organised Panchayats and Municipal Councils of Rampur and Theog of District Shimla: —

Further the State Election Commission hereby decides that the qualifying date as required under Rule 14(e) of the H.P. Panchayati Raj Election Rules, 1994 and Rule 17 (a) of the H.P. Municipal Election Rules, 2015 for determining the eligibility of an elector to be enrolled in the electoral roll shall be 1st December, 2020 as notified earlier vide Notification No. SEC(F)1-3/19- I-3100 dated 07th October, 2020.

In addition, the State Election Commission hereby directs that all the Supplementary Electoral Rolls prepared since 2015 may also be added to the hard copy of the Draft Electoral Rolls and published alongwith it, if not inserted into the main electoral roll earlier.

The Claims and Objections will have to be filed by the person individually or sent by registered post or by a person authorised by him in writing in this behalf. After the claims/objections and appeals received during the period have been decided, the District Election Officer (Panchayat)/ Electoral Roll Registration Officer, as the case may be, shall cause the Draft Electoral Rolls to be corrected through ERMS software in accordance with the orders passed by the Revising/ Appellant Authorities.

While correcting the Draft Electoral Rolls, it may also be ensured that the electors appearing in the previous supplementary lists have also been inserted to the soft copy of the Draft Electoral Rolls through ERMS Software before shifting its stage to final. If any Elector appearing in the Supplementary list has already been included in the main Electoral Roll through subsequent updations of the Electoral Roll after 2015, such Electors need not to be added to the Draft Electoral Roll again.

Thereafter, the District Election Officer (Panchayats)/ Electoral Registration Officer, as the case may be, shall issue notice of final publication of Electoral Rolls as per programme notified by the Commission.

As soon as the notice of final publication is issued by the District Election Officer (P)/ Electoral Roll Registration Officer, as the case may be, the intimation of the same may be sent to the Commission immediately through E-mail followed by confirmation by post. Thereafter the final electoral roll shall be sent to the Printer designated by the Controller Printing and Stationery Department to get twenty copies of the electoral roll printed in respect of each ward. The Address and contact No. of the Printer already stand conveyed to you vide letter No. SEC(F)1-3/2019-I-3744-55 dated 03-11.-2020. In accordance with relevant rules, the soft copy of finalized electoral roll should be kept in the record alongwith one hard copy. One copy of the electoral roll of entire District in soft copy (CD) form will also be provided to the State Election Commission for its record.

After the printing of required number of copies two responsible officials will be deputed by the Districts to collect the copies of electoral rolls for the entire district from the premises of the Printing Press. Before receiving delivery of the electoral roll the officials will ensure that these rolls are printed properly, all the copies are legible, the numbers of copies are correct and the sets of the electoral roll in respect of every Panchayat is accurate.

The relevant provisions of Rules ibid for preparation of the said electoral rolls and the timelines stipulated to be adhered to strictly.

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृतियां.-(1) अधिसूचना संख्याः जी0ए0डी0(डी)ए(1)/95 तारीख 31-01-1996 द्वारा अधिसूचित हिमाचल प्रदेश, सम्पदा निदेशालय, अधीक्षक ग्रेड-I, वर्ग-II (राजपत्रित) (लिपिक वर्गीय) भर्ती और प्रोन्नति नियम, 1996 का एतद्‌ द्वारा निरसन किया जाता है।

9. परिवीक्षा की अवधि, यदि कोई हो.-(क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दें।

10. भर्ती की पद्धतिः भर्ती सीधी होगी या प्रोन्नति/सैंकेण्डमैंट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.-शतप्रतिशत प्रोन्नति द्वारा।

11. प्रोन्नति/सैंकेण्डमैंट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/ सैंकेण्डमैंट/स्थानान्तरण किया जाएगा.-(i) अधीक्षक ग्रेड-II में से प्रोन्नति द्वारा, जिनका तीन वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा यदि कोई हो को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल हो; ऐसा न होने पर अधीक्षक ग्रे़-II में से प्रोन्नति द्वारा जिनका अधीक्षक ग्रेड़-II और वरिष्ठ सहायक के रूप मे संयुक्ततः नौ साल का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके नौ वर्ष का नियमित सेवाकाल हो, जिसमे अधीक्षक ग्रेड-II के रूप में दो वर्ष अनिवार्य सेवाकाल भी सम्मिलित होगा।

(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.-अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है, जो आपातकाल की अवधि के दौरान सेना में शामिल हुए हों, जिसे डिमोबीलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ बैकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैंन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश नॉन टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तगर्त वरीयता लाभ दिए गए हाें।

(2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः5137 राजपत्र, हिमाचल प्रदेश, 10 नवम्बर, 2020/19 कार्तिक, 1942 परन्तु की गई उपरोक्त यथानिर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो तो उसकी संरचना.-जैसी सरकार द्वारा समय-समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.-जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.-लागू नहीं

15. सीधी भर्ती किए जाने वाले व्यक्तियों के लिए अनिवार्य अपेक्षा.-लागू नहीं

16. आरक्षण.-सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.- सेवा के प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा उतीर्ण करनी होगी।

18. शिथिल करने की शक्ति.- जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदाें) की बाबत, शिथिल कर सकेगी।

No. GAD-D (A) 2-1/2018.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment & Promotion Rules, for the post of Superintendent Grade-I, Class-I (Gazetted) of Directorate of Estates, Himachal Pradesh, as per Annexure-"A" attached to this notification, namely:—

1. Short title and Commencement.— (1) These rules may be called the Himachal Pradesh Directorate of Estates, Superintendent Grade-I, Class-I (Gazetted) Recruitment & Promotion Rules, 2019.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Repeal & savings.— (1) The Himachal Pradesh General Administration (Directorate of Estates) Superintendent Grade-I (Class-II Gazetted) Recruitment & Promotion Rules, 1996 notified vide notification No. GAD (D) A(1)95, dated 31-01-1996 are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule 2(1) supra shall be deemed to have been validly made or done or taken under these rules.

ANNEXURE "A" RECRUITMENT AND PROMOTION RULES FOR THE POST OF SUPERINTENDENT GRADE-1 (GAZETTED) CLASS-I, IN THE DIRECTORATE OF ESTATES (GENERAL ADMINISTRATION DEPAREMENT), HIMACHAL PRADESH

1. Name of post.— Superintendent Grade-I

2. Number of post.— 01 (One)

3. Classification.— Class-I (Gazetted)

4. Scale of Pay.— Pay band ` 15600-39100+`5400/- Grade Pay

5. Whether "Selection" post or "Non-Selection" post.—Non-Selection

6. Age for direct recruitment.— Not applicable

7. Minimum Educational and other qualifications required for direct recruit(s).—(a) Essential Qualification(s).— Not applicable

In case of recruitment by promotion/secondment/transfer, grade from which promotion/secondment/transfer is to be made.—By promotion from mongst the Superintendent(s) Grade-II having atleast 03 (three) years regular or regular combined with continuous adhoc service, if any, in the grade, failing which by promotion from amongst the5139 राजपत्र, हिमाचल प्रदेश, 10 नवम्बर, 2020/19 कार्तिक, 1942 Superintendent(s) Grade-II with 09 (nine) years regular or regular combined with continuous adhoc service, if any, as Superintendent Grade-II and Senior Assistant combined which shall also include two years essential service as Superintendent Grade-II.

(I) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment /promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of atleast three years' or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion.

Explanation.— The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen who have joined Armed Forces during the period of emergency and recruited under the provisions of rule-3 of the Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Service) Rules, 1972 and having been given the benefit of seniority there under or recruited under the provisions of Rule-3 of the Ex-Serviceman (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment of Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion/Conformation Committee exists, what is its composition?.—As may be constituted by the Government from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission

(H.P.P.S.C.) is to be consulted in making recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—Not applicable

15. Selection for appointment to post by direct recruitment.—Not applicable

16. Reservation.— The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the Himachal Pradesh Departmental Examination Rules, 1997, as amended from time to time.

18. Powers to relax.— Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s).

हिमाचल प्रदेश साहूकारों का रजिस्ट्रीकरण अधिनियम, 1976 (1976 का अधिनियम संख्यांक 19) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के इकहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :--

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश साहूकारों का रजिस्ट्रीकरण (संशोधन) अधिनियम, 2020 है।

2. धारा 5क का अंतःस्थापन.--हिमाचल प्रदेश साहूकारों का रजिस्ट्रीकरण अधिनियम, 1976 (1976 का 19) की धारा 5 के पश्चात्‌्‌ निम्नलिखित धारा अंतःस्थापित की जाएगी, अर्थात्‌ :--

''5 क. संव्यवहारों का ढंग.--इस अधिनियम की धारा 4 के अधीन रजिस्ट्रीकृत कोई साहूकार किसी भी व्यक्ति को, पाने वाले के खाते में देय चैक या पाने वाले के खाते में देय बैंक ड्राफ्ट 5141 राजपत्र, हिमाचल प्रदेश, 10 नवम्बर, 2020/19 कार्तिक, 1942 द्वारा या किसी बैंक खाते के माध्यम से इलैक्ट्रानिक निकासी प्रणाली के उपयोग से अन्यथा, कोई ऋण अग्रिम नहीं देगा या उससे ऋण के किसी प्रतिदाय को नहीं लेगा या उसे स्वीकार नहीं करेगा यदि अग्रिम ऋण की रकम या स्वीकृत प्रतिदाय की रकम बीस हजार रुपए या इससे अधिक है।''।

THE HIMACHAL PRADESH REGISTRATION OF MONEY-LENDERS'

(AMENDMENT) ACT, 2020

(As ASSENTED TO BY THE GOVERNOR ON 05TH NOVEMBER, 2020)

ACT

further to amend the Himachal Pradesh Registration of Money- Lenders' Act, 1976 (Act

No. 19 of 1976).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-first Year of the Republic of India as follows :—

1. Short title.—This Act may be called as the Himachal Pradesh Registration of Money- Lenders' (Amendment) Act, 2020.

2. Insertion of section 5A.—After Section 5 of the Himachal Pradesh Registration of Money-Lenders' Act, 1976 (19 of 1976) the following section shall be inserted, namely :—

"5A. Mode of Transactions.—No money lender registered under section 4 of this Act, shall advance any loan or take or accept any refund of loan from any person, otherwise than by an account payee cheque or account payee bank draft or use of electronic clearing system through a bank account, if, the amount of loan advanced or the amount of refund accepted, is twenty thousand rupees or more.".

उपरोक्त अदालत हजा में श्री जीत सिंह पुत्र गोरखा राम, गांव पाईसा खास, मौजा पाईसा, तहसील देहरा, जिला कांगड़ा (हि0 प्र0) ने दुरुस्ती नाम की दरख्वास्त दायर कर रखी है। इसलिए समस्त आम जनता को इस मुश्त्री मुनादी द्वारा सूचित किया जाता है कि श्री अजीत सिंह पुत्र गोरखा राम, गांव पाईसा खास, 5142 राजपत्र, हिमाचल प्रदेश, 10 नवम्बर, 2020/19 कार्तिक, 1942 मौजा पाईसा, तहसील देहरा के बजाए श्री जीत सिंह पुत्र गोरखा राम, गांव पाईसा खास, मौजा पाईसा, तहसील देहरा दर्ज किया जाए तो इस बारे किसी को भी आपत्ति/एतराज हो तो वह बराए पैरवी मुकद्दमा उपरोक्त अदालत हजा में दिनांक 10-11-2020 प्रातः 10.00 बजे असालतन या वकालतन हाजिर आवे, हाजिर न आने की सूरत में नियमानुसार उपरोक्त मुकद्दमा में आपके खिलाफ कार्यवाही अमल में लाई जाएगी। आज दिनांक 25-09-2020 को मेरे हस्ताक्षर व मोहर न्यायालय द्वारा जारी हुआ।

नोट.--पटवारी हल्का अम्ब को भेजकर लिखा जाता है कि बजरिया चौकीदार के माध्यम से मुश्त्री मुनादी मौका पर ढोल पिटवाकर कार्यवाही करवाई जाए तथा रोजनामचा रपट डाले (रोजनामचा रपट) की कापी साथ संलग्न करें।

माया देवी पुत्री जैसी राम, गांव नगल, डाकघर बीहण, तहसील देहरा, जिला कांगड़ा, (हि0 प्र0) ने इस अदालत में दरख्वास्त दी है कि उसका नाम पंचायत रजिस्टर में गलती से दर्ज नहीं करवाया गया है। अब दर्ज किया जाए। उसकी जन्म तिथि 20-05-1959 तथा उसका जन्म गांव नगल में हुआ है।

अतः इस नोटिस द्वारा समस्त जनता तथा सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को उसका नाम दर्ज करने बारे में आपत्ति या उजर हो तो वह दिनांक 28-11-2020 समय 10.00 बजे प्रातः स्वयं अथवा किसी वान्छित के माध्यम से हमारे समक्ष अदालत में हाजिर होकर पेश करें। अन्यथा एकतरफा कार्यवाही अमल में लाई जाएगी।

आज दिनांक 12-10-2020 को हमारे हस्ताक्षर व मोहर अदालत से जारी हुआ।
