संख्याः एच.एस.जी-ए(3)-6/2020.--हिमाचल प्रदेश के राज्यपाल भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 (2016 का अधिनियम संख्यांक 16) की धारा 84 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नगर एवं ग्राम योजना विभाग की अधिसूचना संख्याः टी.सी.पी.-ए (3)-1/2016 लूज तारीख 161-राजपत्र/2020-27-11-2020 (5473) 5474 राजपत्र, हिमाचल प्रदेश, 27 नवम्बर, 2020/06 मार्गशीर्ष, 1942 28-09-2017 द्वारा अधिसूचित और तारीख 7-10-2017 को राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश भू-सम्पदा (विकास और विनियम) नियम, 2017 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भू-सम्पदा (विकास और विनियम) संशोधन नियम, 2020 है।

(2) ये नियम-राजपत्र (ई-गजट) हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 22 का प्रतिस्थापन.--हिमाचल प्रदेश भू-सम्पदा (विकास और विनियम) नियम, 2017 के नियम 22 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

''22. ब्याज, शास्ति और प्रतिकर की वसूली और न्यायनिर्णयन अधिकारी या प्राधिकरण या अपीलीय अधिकरण के आदेश, निदेश या विनिश्चय का प्रवर्तन-(1) देय रकम की वसूली जैसे ब्याज, शास्ति या प्रतिकर लागू स्थानीय विधियों के अधीन उपबन्धित रीति में भू-राजस्व के बकाया के रूप में वसूल की जाएगी।

(2) भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 या तद्‌धीन बनाए गए नियमों और विनियमों के अधीन, यथास्थिति, न्यायनिर्णयन अधिकारी, प्राधिकरण या अपीलीय अधिकरण द्वारा पारित प्रत्येक आदेश किया गया प्रत्येक निदेश या किया गया प्रत्येक विनिश्चय, न्यायनिर्णयन अधिकारी या प्राधिकरण या अपीलीय अधिकरण द्वारा उसी रीति में प्रवर्तित किया जाएगा और यह, यथास्थिति, न्यायनिर्णयन अधिकारी या प्राधिकरण या अपीलीय अधिकरण को ऐसे आदेश, निदेश या विनिश्चय को निष्पादित करने में असफलता की दशा में ऐसे आदेश, निदेश या विनिश्चय को सिविल न्यायालय, जिसकी स्थानीय अधिकारिता में भू-सम्पदा परियोजना अवस्थित है या उस सिविल न्यायालय को, जिसकी स्थानीय अधिकारिता में वह व्यक्ति वास्तविक रूप से या स्वैच्छया निवास करता है या कारवार कर रहा है या लाभ के लिए व्यक्तिगत रूप से कार्य कर रहा है, जिसके विरुद्ध आदेश पारित किया जाना है, निदेश दिया जाना है या विनिश्चय किया जाना है, को, ऐसा आदेश, निदेश या विनिश्चय भेजना विधिपूर्ण होगा। ''।

मानों कि यह किसी सिविल न्यायालय में लम्बित किसी वाद में पारित की गई कोई डिक्री किया गया कोई आदेश, दिया गया कोई निदेश या दिया गया कोई विनिश्यच था।

Shimla-171002, the 25th November, 2020

No. HSG-A (3)-6/2020.—In exercise of the powers conferred by section 84 of the Real Estate (Regulation and Development) Act, 2016 (Act No. 16 of 2016), the Governor, Himachal5475 राजपत्र, हिमाचल प्रदेश, 27 नवम्बर, 2020/06 मार्गशीर्ष, 1942 Pradesh is pleased to make the following rules to amend the Himachal Pradesh Real Estate (Regulation and Development) Rules, 2017 notified vide Town and Country Planning Department Notification No. TCP-A(3)-1/2016- loose dated 28-9-2017 and published in the Official Gazette of Himachal Pradesh on 07-10-2017, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Real Estate (Regulation and Development) Amendment Rules, 2020.

(2) These rules shall come into force from the date of its publication in the Rajpatra (e-Gazette) of Himachal Pradesh.

2. Substitution of rule 22.—(1) For rule 22 of the Himachal Pradesh Real Estate (Regulation and Development) Rules, 2017, the following shall be substituted, namely:—

"22. Recovery of interest, penalty and compensation and enforcement of order, direction or decision of Adjudicating Officer or the Authority or the Appellate Tribunal." (1) The recovery of the amounts due such as interest, penalty or compensation shall be recovered as arrears of land revenue in the manner provided under applicable local laws.

(2) Every order, direction or decision passed/made by the Adjudicating Officer or the Authority or the Appellate Tribunal, as the case may be, under the Real Estate (Regulation and Development) Act, 2016 or rules and regulations made there under, shall be enforced by the Adjudicating Officer or the Authority or the Appellate Tribunal in the same manner as if it were a decree or an order, direction or decision passed/made by a Civil Court in a suit pending therein, and it shall be lawful for the Adjudicating Officer or the Authority or the Appellate Tribunal, as the case may be, in the event of its inability to execute the order, direction or decision, to send such order, direction or decision to the Civil Court within the local limits of whose jurisdiction the real estate project is located to execute such order, direction or decision or to the Civil Court within the local limits of whose jurisdiction the person against whom the order, direction or decision is being issued, actually or voluntarily resides or carries on business or personally works for gain".

संख्याः पी.बी.डब्ल्लयू(बी)एफ(5) 90/2010-1.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव आंजी तहसील व जिला सोलन हिमाचल प्रदेश में राजगढ़ सोलन बाईपास सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌ द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है। 5476 राजपत्र, हिमाचल प्रदेश, 27 नवम्बर, 2020/06 मार्गशीर्ष, 1942 2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम मेंं कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप-धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्याें को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपाि हो तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रुप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, विन्टर फील्ड शिमला, जिला शिमला (हि0 प्र0) के समक्ष अपनी आपाि दायर कर सकता है।

साहब सिंह पुत्र श्री रूसला, गांव खोपरा, महाल हमल, परगना धुन्धी, जिला चम्बा, हिमाचल प्रदेश ने एक आवेदन-पत्र व ब्यान हल्फी पेश किया है कि मेरा नाम परिवार रजिस्टर नकल, आधार कार्ड, राशन कार्ड में साहब सिंह पुत्र श्री रूसला दर्ज है जो बिल्कुल सही व दुरुस्त है परन्तु राजस्व अभिलेख पटवार वृत्त दुलाहर, उप-तहसील पुखरी में मेरा नाम साहवणू दर्ज है जो कि गलत है।

अतः प्रार्थी का आवेदन-पत्र व ब्यान हल्फी स्वीकार करते हुए इस इश्तहार/मुस्त्री मुनादी व चस्पांगी द्वारा आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को प्रार्थी के नाम का इन्द्राज करने बारा किसी प्रकार का कोई उजर एवं एतराज हो तो वह असालतन व वकालतन इस इश्तहार के प्रकाशन की तिथि उपरान्त एक माह के भीतर अपना उजर एवं एतराज पेश कर सकते हैं। बाद तारीख किसी किस्म का उजर एवं एतराज नहीं सुना जाएगा व उक्त प्रार्थी का नाम साहवणू उर्फ साहब सिंह दर्ज करने के आदेश पटवारी, पटवार वृत्त दुलाहर को पारित कर दिए जाएंगे।
