No. FDS-A(6)-1/2016.—In continuation of this department notification No. FDS-A(3)3/90- I, dated 18-04-1997 and corrigendum dated 21-04-1997 and in compliance to S.O. No. 3776(E) dated 23-10-2020 issued by the Ministry of Consumer Affairs, Food and Public Distribution 174-राजपत्र/2020-15-12-2020 (5733)5734 राजपत्र, हिमाचल प्रदेश, 15 दिसम्बर, 2020/24 मार्गशीर्ष, 1942 (Department of Consumer Affairs), Government of India and published in the Extra-Ordinary Gazette of India dated 23-10-2020 and in exercise of the powers conferred by first proviso of clause 3(1) of the Himachal Pradesh Trade Articles (Licensing and Control) Order, 1981, the Governor, Himachal Pradesh is pleased to impose the following stock limits for onion (Trade Articles) for which no license shall be required by a dealer to sell, transport, distribute, dispose, acquire, use or consume any quantity at any one time, namely:—

Onion: Wholesaler 25MT

Retailer 2 MT

Provided that an importer, being a wholesaler or retailer or dealer shall be exempted for the imported stock of onions.

No. FDS-A(6)-1/2016.—In exercise of the powers conferred by clause 18 of the Himachal Pradesh Trade Articles (Licensing and Control) Order, 1981 read with S.O. No. 3776(E) dated 23-10-2020 issued by the Ministry of Consumer Affairs, Food and Public Distribution (Department of Consumer Affairs), Government of India, the Governor, Himachal Pradesh is pleased to make the following order to amend the Schedule-I appended to the Himachal Pradesh Trade Articles (Licensing and Control) Order, 1981, namely :—

1. Short title and Commencement.—(1) Himachal Pradesh Trade Articles (Licensing and Control) Amendment Order, 2020.

(2) It shall come into force from the date of its publication in the Rajpatra, Himachal Pradesh and shall remain in force till 31-12-2020 or till any further orders issued by the Govt. of India in this behalf, whichever is earlier.

2. Amendment of Schedule-I.—(3) In Schedule-I appended to the Himachal Pradesh Trade Articles (Licensing and Control) Order, 1981 under Part "E" (OTHER ARTICLES) the following items shall be added at serial No. 3, namely:—

संख्याः टी0सी0पी0-ए (3)-3/2020.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः टी0सी0पी-ए (3)-1/2014-I, तारीख 1 दिसम्बर, 2014 द्वारा अधिसूचित और राजपत्र (ई-गजट), हिमाचल प्रदेश में 1 दिसम्बर, 2014 को प्रकाशित हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते है; जिन्हें जनसाधारण की सूचना के लिए एतद्‌ द्वारा राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया जाता है;

इन प्रारूप नियमाें से संभाव्य प्रभावित होने वाले यदि किसी व्यक्ति के इन प्रारूप नियमाें के बारे में कोई आक्षेप या सुझाव है/है तो वह उक्त प्रारूप नियमाें के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर लिखित आक्षेप या सुझाव सचिव (नगर एवं ग्राम योजना) हिमाचल प्रदेश सरकार को भजे सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप/सुझाव यदि कोई है, पर राज्य सरकार द्वारा इन नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(i) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर और ग्राम योजना (सातवां संशोधन) नियम, 2020 है।

(ii) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. परिशिष्ट-1 का संशोधन.--हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 से संलग्न परिशिष्ट-1 में साधारण विनियमों की क्रम संख्या 28 के उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"28. सरकारी परियोजनाआें की दशा में लोकहित में सैट बैक्स, मंजिलाें और भवन आदि की ऊंचाई में छूट अनुज्ञात की जा सकेगी। प्राइवेट सन्निर्माण/परियोजनाआें की दशा में, सैट बैक्स, मंजिलों और भवन आदि की ऊंचाई में छूट पर स्थल की परिस्थितियों के दृष्टिगत सक्षम प्राधिकारी द्वारा विचार किया जाएगा। तथापि, एक हैक्टेयर से अधिक क्षेत्र वाली प्राइवेट परियोजनाआें में, केवल राज्य सरकार द्वारा छूट अनुज्ञात की जाएगी।"।

TOWN AND COUNTRY PLANNING DEPARTMENT

NOTIFICATION

No. TCP-A (3)-3/2020.—In exercise of the powers conferred by section 87 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh proposes to make the following rules to further amend the Himachal Pradesh Town and Country Planning Rules, 2014 notified vide this Department Notification No. TCP-A (3)-1/2014-I dated 1st December, 2014 and published in the Rajpatra (e-Gazette), Himachal Pradesh on 1st December, 2014, which are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for the information of the general public;

If any person, likely to be affected by these draft rules has any objection(s) or suggestion(s) against these draft rules, he/she may send the written objection(s) or suggestion(s) to the Secretary (TCP) to the Government of Himachal Pradesh, Shimla within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-Gazette), Himachal Pradesh;

Objection(s) or suggestion(s), if any, received within the above stipulated period shall be taken into consideration by the State Government, before finalizing these draft rules, namely :—

1. Short title and commencement.—(i) These rules may be called the Himachal Pradesh Town and Country Planning (Seventh Amendment) Rules, 2020.

(ii) They shall come into effect from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Appendix-1.—In Appendix-1 appended to the Himachal Pradesh Town and Country Planning Rules, 2014, for the provision against Sr. No. 28 of the General Regulations, shall be substituted, namely:—

"28. Relaxation in set backs, height of floors and building etc. may be allowed in Government projects in the public interest. In case of private construction/projects relaxation in set backs, height of floors and building etc. may be considered by the Competent Authority keeping in view the site conditions. However, in private projects having plot area of more than one hectare, relaxation shall be allowed by the State Government only. ".
