संख्याः जी0ए0डी0-डी-7(जी)1-12/81-IV--हिमाचल प्रदेश के राज्यपाल, फण्डामैण्टल रूल्ज के नियम 45 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः जी0ए0डी0-7 (जी) 1-12/81, तारीख 1 जून, 1994 द्वारा अधिसूचित और राजपत्र असाधारण, हिमाचल प्रदेश में 18 जुलाई, 1994 को प्रकाशित हिमाचल प्रदेश सरकारी आवास आबंटन (सामान्य पूल) नियम 1994 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सरकारी आवास आबंटन ( सामान्य पूल) बारहवां संशोधन नियम, 2020 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 5 का संशोधन.-हिमाचल प्रदेश सरकारी आवास आबंटन (सामान्य पूल) नियम, 1994 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 5 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

आवासों का वर्गीकरणः-

इन नियमों द्वारा यथा उपबन्धित के सिवाय, अधिकारी/कर्मचारी निम्न सारणी में दर्शाए गए ग्रेड पे या मूल वेतन या वेतन सांचे (पे मेट्रिक्स) में प्रतिमान के आधार पर, जो भी लागू हो, विभिन्न वर्गों के आवासों के आबंटन के लिए पात्र हाेंगेंः-

सारणी- I

स्पष्टीकरण.-यदि कोई अधिकारी जो निलबंनाधीन है, तो, उस आबंटन वर्ष जिसमें उसे निलंबित किया गया था के प्रथम दिन को उस द्वारा आहरित ग्रेड पे या यदि उसको आबंटन वर्ष के प्रथम दिन निलंबित किया6345 राजपत्र, हिमाचल प्रदेश, 06 जनवरी, 2021/16 पौष, 1942 गया था, उससे ( निलम्बन) से ठीक पूर्व उसके द्वारा आहरित ग्रेड पे को विचार में लिया जाएगा। निलंबित अधिकारियाें/कर्मचारियों को निवास स्थान का आबंटन नियम 7 के अधीन किया जाएगा, मानो निलम्बन हुआ ही न हो।

इन नियमों के अधीन कोई आवेदक (अखिल भारतीय सेवाओं के अधिकारी) निम्न सारणी में तत्स्थानी स्तम्भ(3) में विनिर्दिष्ट वेतन सांचे (पे मेट्रिक्स) के प्रतिमान के अनुसार स्तम्भ (1) में दर्शाए गए वर्ग (टाईप) के सरकारी आवास के आबंटन के लिए पात्र होगाः-

स्पष्टीकरण.-शंकाओं को दूर करने के लिए, एतद्‌द्वारा, यह स्पष्ट किया जाता है किः-

(क) सरकारी आवास के लिए किसी कर्मचारी की पात्रता, राज्य सरकार में वर्तमान में कर्मचारी द्वारा धारित उसके/उसकी पद के ग्रेड पे/मूल वेतन/वेतन सांचे (पे मेट्रिक्स) के प्रतिमान के अनुसार अवधारित की जाएगी। 6346 राजपत्र, हिमाचल प्रदेश, 06 जनवरी, 2021/16 पौष, 1942 (ख) वर्ग-I से वर्ग-III के आवासों की बाबत पूर्विकता की तारीख राज्य सरकार के अधीन सेवा में कार्यग्रहण की तारीख से होगी। यदि कार्यग्रहण की तारीख एक ही (वही) हो तो पुर्विकता निम्न प्रकार से अवधारित की जाएगीः-

(i) उच्चर वेतन वाला कर्मचारी पूर्विकता सूची में वरिष्ठ होगा।

(ii) यदि वेतन बराबर है तो पूर्वतर सेवानिवृत्त होने वाले कर्मचारी को उच्चतर पूर्विकता प्रदान की जाएगी।

(ग) वर्ग-IV से ऊपर के आवासों के लिए पारस्परिक वरिष्ठता पर निम्नलिखित कारकों के आधार पर विचार किया जाएगाः-

(i) अधिकारी की ग्रेड पे/मूल वेतन सांचे (पे मेट्रिक्स) में प्रतिमान।

(ii) यदि एक ही ग्रेड पे/मूल वेतन सांचे (पे मेट्रिक्स) में प्रतिमान में किसी आवेदक की पूर्विकता की तारीख, उस तारीख से होगी जिसको आवेदक लगातार ऐसी ग्रेड पे/मूल वेतन सांचे (पे मेट्रिक्स) में प्रतिमान का आहरण कर रहा है।

(iii) जहां दो या दो से अधिक अधिकारियों की पूर्विकता की तारीख एक ही हो, तो अधिकारियों की पारस्परिक वरिष्ठता उनके मूल वेतन अर्थात्‌ अधिकारी जिनका उच्चतर वेतन है, प्रतीक्षा सूची में वरिष्ठ होंगे।

(iv) जहां दो या दो से अधिक अधिकारियों की पूर्विकता की तारीख और मूल वेतन एक समान है तो राज्य सरकार की सेवा में कार्यग्रहण की पूर्वतर तारीख पारस्परिक वरिष्ठता का अगला अवधारण सिद्धान्त होगा।

(v) जहां राज्य सरकार की सेवा में दो या दो से अधिक अधिकारियों की पूर्विकता की तारीख और मूल वेतन और कार्य ग्रहण की तारीख एक ही हो तो पूर्वतर सेवानिवृत्त होने वाले अधिकारियों को बाद में सेवानिवृत्त होने वाले अधिकारियों के ऊपर उच्चतर पूर्विकता प्रदान की जा सकेगी।

(घ) वर्ग-IV और इससे ऊपर के वर्ग के आवासों के लिए हकदार अधिकारी अपनी हकदारी से निम्न आवास के लिए, इस शर्त के अध्यधीन कि ऐसा आवास वर्ग-IV से निम्न न हो, का भी आवेदन कर सकेंगे।

(ङ) समरूप सेवा के कनिष्ठ बैच के किसी भी अधिकारी को उसी सेवा के वरिष्ठ बैच के अधिकारी से ऊपर पूर्विकता नहीं मिलेगी।

3. नियम 6 का संशोधन.-उक्त नियमों के नियम 6 के उप-नियम(2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(2) कैलेण्डर वर्ष के दौरान प्राप्त आवेदनों पर उस कैलेण्डर वर्ष के लिए निदेशक सम्पदा, हिमाचल प्रदेश द्वारा आवेदन की प्राप्ति के पश्चात्‌ विचार किया जाएगा और उस वर्ष के 31 दिसम्बर तक विधिमान्य होगा। आवेदक "पूर्विकता आधार" और "बिना बारी के आधार पर", जिसके लिए वह इन नियमों के अधीन पात्र या हकदार है, आवास के आबंटन के लिए निहित प्ररूप में निदेशक, सम्पदा को ऑनलाइन या अपने कार्यालय के माध्यम से मैन्युली आवेदन करेगा। विहित प्ररूप में नहीं प्रस्तुत आवेदनों को किसी प्रकार के आबंटन हेतु विधिमान्य नहीं समझा जाएगा।"

4. नियम 10 का संशोधन.-उक्त नियमों के नियम 10 के उपनियम (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

किसी अधिकारी को आबंटन आवास, उप-नियम (3) के अध्यधीन, निम्न सारणी के स्तम्भ-1 में विनिर्दिष्ट किसी घटना के होने पर इसके स्तम्भ 2 में तत्स्थानी प्रविष्टि में विनिर्दिष्ट अवधि के लिए प्रतिधारित किया जा सकेगा; परंतु यह तब जब कि आवास अधिकारी या उसके कुटुम्ब के सदस्यों के वास्तविक उपयोग के लिए अपेक्षित होः-

स्पष्टीकरण-1 मद (iii), (vi) और (vii) के सामने वर्णित स्थानान्तारण पर अनुज्ञेय अवधि की गणना, प्रभार छोड़ने की तारीख सहित नए कार्यालय में कार्य ग्रहण करने से पूर्व अधिकारी/कर्मचारी को स्वीकृत की गई या उसके द्वारा प्राप्त की गई छुट्‌टी की अवधि, यदि कोई हो, से की जाएगी।

स्पष्टीकरण-2 जहां कोई अधिकारी/कर्मचारी वेतन या भत्ते के बिना चिकित्सा छुट्‌टी पर है, तो वह उप-नियम (2) के नीचे सारणी की मद (xiv) के अधीन रियायत के कारण अपने आवास को प्रतिधारित कर सकेगा, परंतु यह तब जबकि वह ऐसे आवास के लिए प्रतिमाह नकद में लाइसैंस फीस का परिहार करता हो और यदि वह दो मास से अधिक के लिए ऐसी लाइसैंस फीस का परिहार करने में असफल रहता है, तो आबंटन रद्‌द हो जाएगा।

स्पष्टीकरण-3 जहां कोई आवास उप-नियम (2) के अधीन प्रतिधारित किया जाता है, तो आबंटन अनुज्ञेय रियायती अवधियों के अवसान पर रद्‌द समझा जाएगा।

स्पष्टीकरण-4 कोई अधिकारी जिसने उपरोक्त उप-नियम (2) के नीचे सारणी की मद (i) और (ii) के अधीन रियायत के कारण आवास प्रतिधारित किया है, तो वह उक्त सारणी में विनिर्दिष्ट अवधि के भीतर 6348 राजपत्र, हिमाचल प्रदेश, 06 जनवरी, 2021/16 पौष, 1942 किसी पात्र पद पर पूर्णनियोजन पर इन नियमों के अधीन इस आवास को प्रतिधारित करने का हकदार होगा; किन्तु यदि ऐसे पुनः नियोजन पर अधिकारी की उपलब्धियां उसे, उस द्वारा अधिभोग में लिए गए आवास के वर्ग का हकदार नहीं बनाती है तो उसे पुनः नियोजन के निबन्धनों और शर्तों के अनुसार आवास का वर्ग आबंटित किया जा सकेगाः

परन्तु यह कि उप-नियम (2) के अधीन अनुज्ञेय अवधि से परे विशेष मामले में और प्रतिधारण निम्न प्रकार से अनुज्ञात किया जा सकेगा।

परन्तु विस्तारण के लिए आवेदन प्राधिकृत अवधि के अवसान से एक मास पूर्व दिया जाएगाः

परन्तु यह और कि विस्तारण पत्र केवल कुल किराए की अग्रिम में प्राप्ति के पश्चात्‌ जारी किया जाएगा। तथापि, सेवारत सरकारी कर्मचारी को विस्तारण की दशा में किराए के संदाय की कटौती उसके वेतन से की जाएगी। कुल किराया जमा करने में असफलता की दशा में बेदखली की कार्यवाहियां तुरन्त प्रारम्भ की जाएंगी जो तीन मास में पूर्ण की जाएगीः

परन्तु यह और कि यदि कोई आबंटिती शैक्षणिक सत्र के दौरान स्थानान्तरित या सेवानिवृत्त हो जाता है और उसका/उसके बच्चे, यथास्थिति,/स्कूल/महाविद्यालय में अध्ययनरत हैं, तो आबंटिती को प्रत्येक मामले के गुण-अवगुण के आधार पर सचिव द्वारा इस प्रभाव का सम्बद्ध संस्थान से प्रमाण पत्र प्रस्तुत करने के अध्यधीन कि चालू शैक्षणिक वर्ष/सत्र पूर्ण होने तक आवास का प्रतिधारण अनुज्ञात किया जा सकेगा। ऐसे मामलों मे लाईसैंस फीस, यथास्थिति, सेवानिवृत्ति या स्थानान्तरण की दशा में नियमों के अधीन अनुज्ञात रियायत की अवधि से अधिक की अवधि के लिए मानक लाईसैंस फीस का चार गुणा प्रभार्य होगीः

परन्तु यह और कि किसी अधिकारी/कर्मचारी, जो भारत से बाहर विदेश सेवा या प्रतिनियुक्ति पर भारत या विदेश में अध्ययन अवकाश पर जाता है तो ऐसे किसी अधिकारी/कर्मचारी का सम्बन्धित विभाग द्वारा सरकार के सामान्य प्रशासन विभाग के पूर्व अनुमोदन से ऐसे आदेशों के निबन्धन और शर्तों में उपबन्ध करना अपेक्षित होगा कि वह ऐसे नियमों के उपबन्धों के अनुसार केवल उसके कुटुम्ब के वास्तविक प्रयोजन के लिए आबंटित सरकारी आवास, यदि कोई हो, को प्रतिधारित कर सकेगाः

परन्तु यह और कि उपरोक्त वर्णित घटनाओं की दशा में अधिकारियों/कर्मचारियों को यह शपथ-पत्र प्रस्तुत करना होगा कि उसे आबंटित सरकारी आवास का उपयोग केवल उसके कुटुम्ब के वास्तविक प्रयोजन के लिए ही किया जाएगा और यदि किसी मामले में यह पाया जाता है कि आवास का उपयोग उसके कुटुम्ब के वास्तविक प्रयोजन के लिए नहीं किया जा रहा है तो सरकार, किसी अन्य अनुशासनिक कार्यवाही, जो उसके विरुद्ध की जा सकेगी, पर प्रतिकूल प्रभाव डाले बिना आवास का आबंटन रद्‌द कर सकेगी।

NOTIFICATION

Shimla-2, the 1st January, 2021

No. GAD-D-7(G)1-12/81-IV.—In exercise of the powers conferred under rule-45 of the Fundamental Rules, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Allotment of Government Residences (General Pool) Rules, 1994, notified vide this Department notification No. GAD-7(G)1-12/81, dated 1st June, 1994 and published in Rajpatra, (Extra Ordinary) Himachal Pradesh on 18th July, 1994, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Allotment of Government Residences (General Pool) 12th Amendment Rules, 2020.

(2) They shall come into force from the date of their publication in the Rejpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule-5.—For rule-5 of the Himachal Pradesh Allotment of Government Residences (General Pool) Rules, 1994 (hereinafter referred to as the said rules), the following shall be substituted, namely:—

"Classification of Residences:-

Save as otherwise provided in these rules, the officers/official shall be eligible for allotment of different types of residences on the basis of Grade Pay or Basic Pay or level in the pay matrix, whichever is applicable, shown in the tables below:—

Explanation.—In case of officer who is under suspension the Grade Pay drawn by him on the first day of the allotment year in which he is placed under suspension or if6350 राजपत्र, हिमाचल प्रदेश, 06 जनवरी, 2021/16 पौष, 1942 he is placed under suspension on the first day of allotment year, the grade pay drawn by him immediately before that shall be taken into consideration. Allotment of residential accommodation to the officers/officials under suspension shall be made under rule-7 as if the suspension has not taken place.

Under these rules an applicant (AIS) shall be eligible for allotment of

Government residential accommodation of the type as shown in the column (1)

as per the level in the pay matrix specified in the corresponding column(3), in

the table below:—

Explanation:- For the removal of doubts it is hereby clarified that:—

(a) The eligibility of an employee for Govt. accommodation shall be determined as per the Grade Pay/ Basic pay/ level in pay matrix of the employee in his/her present post held in the State Government.

(b) The date of priority in respect of houses from Type-I to Type-III shall be the date of joining in the services under State Government. If the date of joining is the same then the priority will be determined as under:—

(i) The official having higher pay shall be senior in the priority list.

(ii) If the pay is the same, the official retiring earlier will be accorded higher priority.

(c ) The inter-se-seniority for the houses Type-IV onwards shall be considered on the basis of the following factors:—

(i) The Grade pay/Basic pay /level in pay matrix of the officer.

(ii) The priority date of an applicant, within the same Grade Pay/Basic pay/level in pay matrix, shall be the date from which the applicant is continuously drawing his such grade pay/basic pay/level in pay matrix.

(iii) Where the priority date of two or more officers is the same, the inter se-seniority of the officers shall be determined on the basis of the basic pay i.e. the officers who have a higher pay shall be senior in the waiting list.

(iv) Where the priority date and the basic pay of two or more officers are the same, the earlier date of joining in the service of State Government shall be next determining principle of inter-se-seniority.

(v) Where the priority date, basic pay and date of joining in the service of the State Government of two or more officers are the same, the officers retiring earlier may be accorded higher priority over the officers retiring later.

(d) Officers entitled for Type-IV and above houses shall also be eligible to apply for accommodation below their entitlement subject to the condition that such accommodation shall not be below Type-IV.

(e) No junior batch employee of the same service shall got priority over the senior batch officer of same service.

3. Amendment of rule-6.— For sub-rule (2) of rule -6 of the said rules, the following shall be substituted namely:—

"(2) The applications received during the calendar year shall be considered after receipt of the application form by Director of Estates, H.P. for that calendar year and shall be valid upto 31st December of that year.

The applicant shall make an application online or manually through his office to the Director of Estates in the prescribed form for allotment of accommodation on 'priority basis' and on 'out of turn basis' to which, he is eligible or entitled under these Rules. Applications not made on the prescribed form shall not be considered valid for any kind of allotment".

4. Amendment of rule-10.—For sub-rule(2) of rule-10 of the said rules, the following shall be substituted namely:—

A residence allotted to an officer may, subject to sub-rule (3) be retained on the happening of any of the events specified in column 1 of the table below for the period specified in the corresponding entry in column 2 thereof:

Provided that the residence is required for the bonafide use of the officer or members of his family:-

Explanation-1.—The period permissible on transfer mentioned against items(iii), (vi) and (vii) shall be counted from the date of relinquishing charge plus the period of leave if any sanctioned to and availed of by the officer/official before joining duty in new office.

Explanation-2.—Where an officer/official is on medical leave without pay and allowances he may retain his residence by virtue of the concession under item (xiv) of the table below sub-rule (2), provided he remits the license fee for such residence in cash every month and where he fails to remit such license fee for more than two months, the allotment shall stand cancelled.

Explanation-3.—Where a residence is retained under subrule(2) the allotment shall be deemed to be cancelled on the expiry of the admissible concessional periods.

Explanation-4.—An officer who has retained the residence by virtue of the concession under items (i) and (ii) of the above below sub-rule (2) shall, on re- employment in an eligible office within a period specified in the said table be entitled to retain that residence under these rules, provided if the emoluments of the officer on such re-employment do not entitle him to the type of residence occupied by him, he may be allotted a residence of the type as per the terms and conditions of re- employment:

Provided further that the further retention in a special case beyond the permissible period under sub-rule(2), may be allowed as under:—

Provided further that the application for extension shall be given one month before the expiry of the authorized period:

Provided further that the extension letter shall be issued only after receipt of total rent in advance. However, in case of grant of extension to a serving Government servant payment of rent shall be deducted from his salary. In case of failure to deposit the total rent, eviction proceedings shall be initiated immediately which shall be completed within three months.

Provided further that if any allottee is transferred or retires in the mid-academic session and his/her children are studying in School/College, as the case may be, at the place of present posting, the allottee may be allowed by the Secretary on the basis of merits of each case to retain the accommodation till that current academic year/semester is completed subject to production of certificate from the concerned institution to this effect. License fee chargeable in such case shall be Four times of the pooled standard license fee for the period beyond the concessional period permitted under the rules in cases of retirement or transfer, as the case may be.

Provided further that in case of officer/official who proceeds on foreign service abroad or on deputation out side India, study leave in India or abroad, the department concerned of any officer/official is required to make the provision in terms and conditions of such orders with prior approval of the Government in General Administration Department that he/she can retain the Government residential accommodation, if any allotted only for the bonafide purpose of his/her family as per provisions of the rules:

Provided further that officers/officials in the events mentioned above shall furnish an affidavit that the Government accommodation allotted to him/her shall be used only for the bonafide purpose of his/her family and in case it is found at any time that the accommodation is not used for the bonafide purpose of his/her family, the Government may, without prejudice to any other disciplinary action that may be taken against him/her, cancel the allotment of residence.
