No. HMB (B) 2-25/98-V.—In pursuant to the decision of the Service Committee obtained vide Finance Department(IF) letter No. FIN-IF( C )-34-2/91-III-I dated 5th Jan., 2021 and adoption thereto as per the BoM resolution No. 36 and 37 dated 30-6-2014, the Himachal Pradesh State Agricultural Marketing Board amends its "Recruitment and Conditions of Service of Officers and Staff, Regulations, 2006", further to notify it under sub section (c) of section 85 of the Himachal Pradesh Agricultural and Horticultural Produce Marketing (Development and Regulation) Act, 2005, namely:—

1. Short title and Commencement.—(i) These regulations may be called the Himachal Pradesh State Agricultural Marketing Board (Recruitment and Conditions of Service of Officers and Staff) (Amendment-I) Regulations, 2021.

(ii) These shall come into force from the date of publication in the e-Rajpatra, Himachal Pradesh.

6696 राजपत्र, हिमाचल प्रदेश, 14 जनवरी, 2021/24 पौष, 1942 2. Amendment of schedule I and II.—"……………….

(i) In the schedule-II appended to the said Regulations,2006 containing the Recruitment and Promotion Rules for the post of Senior Marketing Officer ; GRADE "A"for existing column Nos. 5 and 11 following shall be substituted, namely;

(ii) Column:

5. Whether Selection or Non-selection post.—Selection post.

(iii) 11. In case of recruitment by promotion, deputation, transfer, grades from which promotion/deputation/transfer is to be made.—By promotion amongst Marketing Officer and Secretaries of the Committees having 5 years regular service in the grade, failing which on secondment from State Agriculture/Horticulture Departments/Public Undertakings/Autonomous bodies amongst the incumbents holding the equivalent post in the identical pay scale or on contract amongst the persons possessing essential qualification prescribed for direct recruitment.

(iv) In the schedule-II appended to the said Regulations,2006 containing the Recruitment and Promotion Rules for the post of Secretary ; GRADE "A" for existing column Nos. 7, 10 and 11 following shall be substituted, namely;

(v) 7. Minimum Educational and other qualification required for direct recruits.—(a) Essential Qualification : (i) M.Sc. (Agr/Hort.) or B.Sc.(Agr./Hort.) followed by MBA preferably in Agr. Business from any recognized University / Institution.

(b) Desirable Qualification : (i) Possessing 5 years experience on Agricultural Produce mainly in Govt./Public Undertakings/ Autonomous bodies.

(ii) Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

(vi) 10. Method of recruitment whether by direct recruitment or by promotion/deputation, transfer and the percentage of vacancies to be filled in by various methods.—80 % by direct recruitment on contract basis and 20 % by promotion amongst feeder category of Assistant Secretaries; failing which on secondment basis amongst the category of Distt. Agriculture Officer or equivalent of the Department of Agr./Horticulture preferably, but not below the rank of ADO/HDO having experience in Agri./Hort. Marketing and trained as Secretary of Market Committees.

(vii) 11. In case of recruitment by promotion, deputation, transfer, grades from which promotion/deputation/transfer is to be made.—By promotion amongst feeder category of Assistant Secretaries having 5 years regular service in the grade, in the manner as prescribed under column 10.

(viii)In the schedule-II appended to the said Regulations, 2006 containing the Recruitment and Promotion Rules for the post of Assistant Secretary; GRADE "B" for existing column Nos. 7, 10 and 11 following shall be substituted, namely;

(ix) 7. Minimum Educational and other qualification required for direct recruits.—(a) Essential Qualification : (i) B.Sc. (Agriculture/Horticulture) from recognized University/Institution with one year Diploma in Marketing Management from the recognized University/ Institution.

(b) Desirable Qualification : (i) Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

(x) 10.Method of recruitment whether by direct recruitment or by promotion/deputation, transfer and the percentage of vacancies to be filled in by various methods.—20 % by direct recruitment on contract basis and 80 % by promotion amongst the category of Market Supervisor.

(xi) 11. In case of recruitment by promotion, deputation, transfer, grades from which promotion/ deputation/transfer is to be made.—For the existing provisions following shall be substituted to the extent ;—

"By promotion amongst feeder category of Market Supervisor having 7 years regular service in the grade in the manner as prescribed under column 10 above.

(1) In all cases of promotion…………………………

(2) Similarly…………………adhoc service shall remain unchanged."

(xii) In the schedule-II appended to the said Regulations,2006 containing the Recruitment and Promotion Rules for the post of Market Supervisor; GRADE "C" for existing column Nos. 2, 7 and 10 following shall be substituted, namely;

(xiii)2. Number of posts.—22 Nos.

(xiv) 7. Minimum Educational and other qualification required for direct recruits.—(a) Essential Qualification : (i) B.Sc. (Agriculture/ Horticulture) with atleast 50% score/marks from recognized University/ Institution.

(b) Desirable Qualification : (i) Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

(xv) 10. Method of recruitment whether by direct recruitment or by promotion/deputation, transfer and the percentage of vacancies to be filled in by various methods.—50 % by direct recruitment on contract basis and 50 % by promotion amongst Auction Recorders.

(xvi) In the schedule-II appended to the said Regulations,2006 containing the Recruitment and Promotion Rules for the post of Auction Recorder ; GRADE "C" for existing column Nos. 2, 10 and 11 following shall be substituted, namely;

(xvii) 2. Number of posts.—24 Nos.

(xviii)10. Method of recruitment whether by direct recruitment or by promotion/deputation, transfer and the percentage of vacancies to be filled in by various methods.—50 % by direct recruitment on contract basis and 50 % by promotion amongst the category of Assistant Auction Recorder.

(xix) 11. In case of recruitment by promotion, deputation, transfer, grades from which promotion/deputation/transfer is to be made.—(i) for the existing provisions following shall be substituted to the extent ;—

" By promotion amongst feeder category of Assistant Auction Recorder with 7 years regular service in the grade, in the manner as prescribed under column 10 above.

6698 राजपत्र, हिमाचल प्रदेश, 14 जनवरी, 2021/24 पौष, 1942 (ii) That in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis in feeder post in view of the provisions referred to above, all persons senior to him in the respective category/ post/ cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment and Promotion Rules for the post, whichever is less:

Provided further where a Person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion of the senior ineligible persons happened to be exservicemen recruited under the provision of Rule-2 of Demobilized Armed Forces Personnel (Reservation of vacancies in H.P. State non-Technical Services) Rules, 1972 and having been given the benefit of seniority there- under or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority there-under.

(iii) Similarly, in all cases of confirmation adhoc service rendered on the feeder post if any, prior to the regular appointment against such post shall be taken into account towards the length of service:

Provided that inter-se-seniority as a result of confirmation after taking into account adhoc service shall remain unchanged.

(xx) In the schedule-II appended to the said Regulations, 2006 containing the Recruitment and Promotion Rules for the post of Superintendent; GRADE "B" for existing column No. 2 following shall be substituted with revised cadre strength, namely;

(xxi) 2. Number of posts.—7 Nos.

(xxii) For existing rules, it further adopts the Recruitment and Promotion rules for the post of Superintendent. Grade-II, which is framed, circulated, amended and notified by the State Government from time to time for all intents and purposes.

(xxiii) In the schedule-II appended to the said Regulations, 2006the existing Recruitment and Promotion Rules for the post of Statistical Assistant; GRADE "C"repealed and substituted with the adoption of the Recruitment and Promotion Rules for common cadre of Statistical Assistant in Government Departments, which is framed, circulated, amended and notified by the State Government from time to time for all intents and purposes. However, Junior Office Assistant possessing the essential qualification as prescribed for direct recruitment under column No. 7 under the said rules with minimum 10 years' experience of working shall also be the feeder category for promotion to this post.

(xxiv) In the schedule-II appended to the said Regulations,2006 containing the Recruitment and Promotion Rules for the post of Senior Assistant; GRADE "C" for existing column No. 2 following shall be substituted with revised cadre strength, namely;

(xxv) 2. Number of posts.—13 Nos.

(xxvi) In the schedule-II appended to the said Regulations, 2006 for the post of clerks, which is now declared as dying cadre for all intents and purposes, the vacant posts of Clerks shall, henceforth, be converted into Junior Office Assistant (IT) Grade "C" in the Board. The existing cadre strength of Junior Office Assistant (IT) in Board shall be increased accordingly. It further adopts the Recruitment and Promotion Rules for common cadre of Junior Office Assistant (IT) in Government Departments, which is framed, circulated, amended and notified by the State Government from time to time for all intents and purposes.

(xxvii) In Technical Staff of the Board for filling up of existing 2 posts of Assistant Engineer (Civil) by promotion amongst feeder category of Junior Engineer (Civil) out of sanctioned strength of three posts (ex-cadre); it adopts the existing Recruitment and Promotion Rules for the post of Assistant Engineer (Civil)in Public Works Department of the Government, which is framed, circulated, amended and notified by the State Government from time to time for all intents and purposes."

No. HMB (B) 2-25/98-V.—In pursuant to the decision of the Service Committee obtained vide Finance Department(IF) letter No. FIN-IF( C )-34-2/91-III-I dated 5th Jan., 2021 and adoption thereto as per the BoM resolution No. 36 and 37 dated 30-6-2014, the Himachal Pradesh State Agricultural Marketing Board further to amend its "Recruitment and Conditions of Service of Officers and Staff, Regulations, 2006",and notifies it under sub section ( c) of section 85 of the Himachal Pradesh Agricultural and Horticultural Produce Marketing (Development and Regulation) Act, 2005, namely;

1. Short title and Commencement.—(i) These regulations may be called the Himachal Pradesh State Agricultural Marketing Board (Recruitment and Conditions of Service of Officers and Staff) (Amendment-II) Regulations, 2021.

(ii) These shall come into force from the date of publication in the e-Rajpatra, Himachal Pradesh.

2. Amendment of schedule I.—"……………….

(i) In the schedule-I appended to the said Regulations, 2006 containing sanctioned strength of posts, the sanctioned strength of the post of Superintendent, Grade-II (B) and Senior Assistant Grade-C; have been revised to seven and thirteen Nos. respectively;

(ii) For column (i) above; one post of Superintendent, Grade-II (B) each is created in the office of the Himachal Pradesh State Agricultural Marketing Board, Vipnan Bhawan, Khalini, 6700 राजपत्र, हिमाचल प्रदेश, 14 जनवरी, 2021/24 पौष, 1942 Shimla-171002 and in the office of the Agricultural Produce Market Committee, Una respectively. As many as five posts of Senior Assistant have also been created each in the office of Agricultural Produce Market Committees Solan, Mandi and APMC Kangra respectively and 2 Nos. in Agricultural Produce Market Committees(Shimla and Kinnaur) at Dhalli
