संख्याः गृह-सी(ए)3-4/2019.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा, शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश, गृह विभाग, न्यायालयिक सेवाएं निदेशालय में सहायक निदेशक (प्रलेख एवं छाया चित्रण), वर्ग-I (राजपत्रित) के पद के लिए इस अधिसूचना से सलंग्न उपाबन्ध-"क" के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश, गृह विभाग, न्यायालयिक सेवाएं निदेशालय, सहायक निदेशक (प्रलेख एवं छाया चित्रण), वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृा होंगे। 2. निरसन और व्यावृाियां.--(1) अधिसूचना संख्या गृह-सी(ए)3-7/2006-II तारीख 20-09-2007 द्वारा अधिसूचित हिमाचल प्रदेश राज्य न्यायालयिक प्रयोग शाला, गृह विभाग, सहायक निदेशक (प्रलेख एवं छाया चित्रण), वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2007 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपर्युक्त नियम 2 (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

1. पद का नाम.--सहायक निदेशक (प्रलेख एवं छाया चित्रण)

2. पद (पदों) की संख्या.--02 (दो)

3. वर्गीकरण.--वर्ग-I (राजपत्रित)

4. वेतनमान (विस्तृत रूप में दिया जाए).--(i) नियमित पदधारी (पदधारियों) के लिए पे बैंड : ` 15600-39100 जमा ` 6600/- ग्रेड पे।

(ii) संविदा पर नियुक्त कर्मचारी (कर्मचारियों) के लिए उपलब्धियां ंः स्तम्भ संख्या 15-क में दिए गए ब्योरे के अनुसार ` 22,200/- प्रतिमास । 5. "चयन पद" अथवा "अचयन" पद.--चयन

6. सीधी भर्ती के लिए आयु.--18 से 45 वर्ष :

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगी :

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगाः

परन्तु यह और कि ऊपरी आयु सीमा में अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए, उस विस्तार तक शिथिलीकरण किया जाएगा जितना कि हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशांं) के अधीन अनुज्ञेय है :

परन्तु यह और भी कि समस्त पब्लिक सेक्टर निगमों तथा स्वायत्त निकायों के कर्मचारियों को, जो ऐसे पब्लिक सेक्टर निगमोें/स्वायत्त निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर निगमों/ स्वायत्त निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात की जाएगी, जैसी सरकारी कर्मचारियों को अनुज्ञेय है, ऐसी रियायत, तथापि पब्लिक सेक्टर निगमों/स्वायत्त निकायों के ऐसे कर्मचारिवृन्द को अनुज्ञेय नहीं होगी जो तत्पश्चात्‌ ऐसे निगमों/स्वायत्त निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत्त निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत्त निकायों की सेवा में अंतिम रूप से आमेलित किए गए हैं/किए गए थे।

टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमें कि पद (पदों) को, आवेदन आमंत्रित करने के लिए यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

7. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं.--(क) अनिवार्य अर्हताएं : (i) किसी मान्यता प्राप्त विश्वविद्यालय से न्यायालयिक विज्ञान भौतिकी/रसायन विज्ञान/गणित में कम से कम द्वितीय श्रेणी में स्नातकोतर की उपाधि।

(ii) उपर्युक्त (i) में निर्दिष्ट अर्हता अर्जित करने के पश्चात्‌ किसी मान्यता प्राप्त प्रयोगशाला/संस्थान/विश्वविद्यालय से फिंगर पिं्रट इत्यादि सहित प्रलेख विश्लेषण/फोटोग्राफी/माइक्रो8423 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 फोटोग्राफी/अल्ट्रा वायलेट फोटोग्राफी में सात वर्ष का अनुभव (पी. एच. डी. डिग्री करने के लिए उपरोक्त विषयों/क्षेत्रों में किए गए अनुसंधान कार्य की गणना कुल अनुभव में की जाएगी)।

(ख) वांछनीय अर्हता : हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित आयु और शैक्षिक अहर्ताएं प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू होंगी या नहीं.--आयु : लागू नहीं।

शैक्षिक अर्हता (एं) : हां, जैसी उपरोक्त स्तंभ संख्या 7 (क) (i) के सामने विहित की गई है। 9. परिवीक्षा की अवधि, यदि कोई हो.--(i) सीधी भर्ती की दशा में : (क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दे।

(ख) संविदा के आधार पर सेवाधृति के आधार पर नियुक्ति पर, अधिवर्षिता के पश्चात्‌ पुनर्नियोजन पर और आमेलन पर कोई परिवीक्षा नहीं होगी।

(ii) प्रोन्नति की दशा में : कोई परिवीक्षा अवधि नहीं होगी।

10. भर्ती की पद्धति - भर्ती सीधी होगी या प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--(i) पचास प्रतिशत सीधी भर्ती द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा।

(ii) पचास प्रतिशत प्रोन्नति द्वारा, ऐसा न होने पर सैकण्डमैण्ट आधार पर दोनों के न होने पर सीधी भर्ती द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा।

11. प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/ सैकण्डमैण्ट/स्थानान्तरण किया जाएगा.--विशिष्ट खण्ड (प्रभाग) के वैज्ञानिक अधिकारियों में से प्रोन्नति द्वारा उपरोक्त स्तम्भ संख्या 7 (क) (i) में सीधी भर्ती के लिए विहित शैक्षणिक अर्हता धारण करने के अध्यधीन जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर भारत में केन्द्रीय/अन्य राज्य न्यायालयिक प्रयोग शालाओं में इस पद के समरूप वेतनमान में कार्यरत पदधारियों में से सैकण्डमैण्ट के आधार पर।

(1) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जन जातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो। तथापि ऐसे पदधारियों को प्रोन्नति पर दूरस्थ/ग्रामीण क्षेत्रों में तैनात/स्थानांतरित किया जा सकेगा :

परन्तु यह और भी कि उन अधिकारियों/ कर्मचारियों को, जिन्होंने जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ ग्रामीण क्षेत्रों में कम से कम एक कार्यालय तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा।

स्पष्टीकरण I.--उपरोक्त परन्तुक (1) के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में "कार्यकाल" से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों मे तैनाती की इससे कम अवधि अभिप्रेत होगी।8424 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 स्पष्टीकरण II.--उपरोक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगेः- 1. जिला लाहौल एवं स्पिति। 2. चम्बा जिला का पांगी और भरमौर उप-मण्डल। 3. रोहडू उप-मण्डल का डोडरा क्वार क्षेत्र। 4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनिश दरकाली और काशापाट। 5. कुल्लू जिला का पन्द्रह बीस परगना। 6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र। 7. जिला किन्नौर। 8. सिरमौर जिला में उप तहसील कमरउ के काठवाड़ और कोरगा पटवार वृा, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृा और शिलाई तहसील का कोटा पाब पटवार वृा। 9. मण्डी जिला के करसोग तहसील का खन्योल-बगड़ा पटवार वृा, बाली चौकी उप-तहसील के गाडा गोसार्इं, मठयानी, घनयाड,़ थाची, बागी, सोमगाड़ और खोलानाल पटवार वृा, पद्धर तहसील के झारवाड़ कुटगढ,़ ग्रामन, देवगढ़, ट्रैला, रोपा, कथोग, सिल्ह-भड़वानी, हस्तपुर, घमरेड़ और भटढे़ पटवार वृा, थुनाग तहसील के चियूणी, कालीपार, मानगढ़, थाच-बगड़ा उारी मगरू और दक्षिणी मगरू पटवार वृा और सुन्दरनगर तहसील का बटवाड़ा पटवार वृा।

स्पष्टीकरण III.--उपर्युक्त परन्तुक (1) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगे :-

(i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे से समस्त स्थान। (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है। (iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना, अपने गृहनगर या गृहनगर क्षेत्र के साथ लगता 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व, सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः

परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और भी की जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि विरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसने आपातकाल की अवधि के दौरान सशस्त्र बलों में कार्य ग्रहण किया था और जिसे डिमोबिलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज,8425 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(i) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति/स्थायीकरण समिति विद्यमान हो तो उसकी संरचना.--(क) विभागीय प्रोन्नति समिति : विभागीय प्रोन्नति समिति की अध्यक्षता अध्यक्ष, हिमाचल प्रदेश लोक सेवा आयोग या उसके द्वारा नामनिर्दिष्ट आयोग के सदस्य द्वारा की जाएगी।

(ख) विभागीय स्थायीकरण समिति : जैसी सरकार द्वारा समय-समय पर गठित की जाए। 13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/व्यक्तित्व परीक्षण से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या लिखित परीक्षा या व्यावहारिक परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।

15-क. संविदा नियुक्ति, द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएगीः-

(I) संकल्पना :

(क) इस पॉलिसी के अधीन हिमाचल प्रदेश गृह विभाग, न्यायालयिक सेवाएं (फॉरेंसिक्स सर्विसीज) निदेशालय में सहायक निदेशक (प्रलेख एवं छाया चित्रण) को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगा।

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। (ख) पद का हिमाचल प्रदेश लोक सेवा आयोग के कार्यक्षेत्र में आना : सचिव (गृह) हिमाचल प्रदेश सरकार रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग के समक्ष रखेगा।

(ग) चयन इन भर्ती और प्रोन्नति नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा।8426 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 (II) संविदात्मक उपलब्धियां : संविदा के आधार पर नियुक्त सहायक निदेशक (प्रलेख एवं छाया चित्रण) को ` 22,200/- की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रडे पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष (वर्षाें), के लिए संविदात्मक उपलब्धियों में ` 666/- की रकम (पद के पे बैण्ड के न्यूनतम जमा गे्रड पे का तीन प्रतिशत) वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी।

(III) नियुक्ति/अनुशासन प्राधिकारी :

सचिव (गृह) हिमाचल प्रदेश सरकार नियुक्ति और अनुशासन प्राधिकारी होगा।

(IV) चयन प्रक्रिया :

संविदा भर्ती के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि, ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/व्यक्तित्व परीक्षण से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या लिखित परीक्षा या व्यावहारिक परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समिति :

जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा समय-समय पर गठित की जाए।

(VI) करार :

अभ्यर्थी को चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध-"ख" के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्तें :

(क) संविदा के आधार पर नियुक्त व्यक्ति को ` 22,200/- की दर से नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा गे्रड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढा़ए गए वर्ष/वर्षों के लिए संविदात्मक रकम में ` 666/- (पद के पे बैण्ड के न्यूनतम जमा गेड पे का तीन प्रतिशत) की रकम की वार्षिक वृद्धि का हकदार होगा और अन्य कोई सहबद्ध प्रसुविधाएं जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा। (ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुिक्त पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से संतुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालिस दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्च्तर पंक्ति का होगा, को अपील कर सकेगा।

(ग) संविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी 8427 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत सरकारी चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालिस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगा ।

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। (घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर र्काव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हाें तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हें परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदों के विरुद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा-शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थाई रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

(छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय र्काव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों जैसे एफ0आर0-एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा स्कीम के साथ-साथ ई.पी.एफ./जी.पी.एफ. भी लागू नहीं होगा। 16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/ अनुसूचित जन जातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी। 8428 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 17. विभागीय परीक्षा.--सेवा में प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा पास करनी होगी।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रर्वग या पद (पदों) की बाबत, शिथिल कर सकेगी।

द्वितीय पक्षकार ने उपरोक्त प्रथम पक्षकार को लगाया है और प्रथम पक्षकार ने सहायक निदेशक (प्रलेख एवं छाया चित्रण) के रूप में संविदा आधार पर निम्नलिखित निबन्धन और शर्तों पर सेवा करने के लिए सहमति दी है :-

1. यह कि प्रथम पक्षकार सहायक निदेशक (प्रलेख एवं छाया चित्रण) के रूप में … ………………से प्रारम्भ होने और……………… को समाप्त होने वाले दिन तक एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विनिर्दिष्ट रूप से उल्लिखित किया गया है और दोनों पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस्‌ अर्थात्‌.....................................को स्वयंमेव ही पर्यवसित (समाप्त) हो जाएगी तथा सूचना नोटिस आवश्यक नहीं होगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। 2. प्रथम पक्षकार की संविदात्मक रकम ` 22,200/- प्रतिमास होगी।

No. Home-C(A)3-4/2019.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Assistant Director (Document & Photography), Class-I (Gazetted) in the Directorate of Forensics Services, Home Department, Himachal Pradesh, as per Annexure-"A" attached to this notification, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Directorate of Forensics Services, Home Department, Assistant Director (Document & Photography), Class-I (Gazetted) Recruitment and Promotion Rules, 2021.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e- Gazette) Himachal Pradesh.

2. Repeal and saving.—(1) The Himachal Pradesh, State Forensic Science Laboratory, Home Department, Assistant Director (Document & Photography), Class-I (Gazetted) Recruitment and Promotion Rules, 2007 notified vide Notification No. Home-C(A)3-7/2006-II dated 20.09.2007 are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the Rules, so repealed under Rule 2(1) supra shall be deemed to have been validly made, done or taken under these Rules.

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/Other Backward Classes and Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government;

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servants before absorption in Public Sector Corporations/Autonomous Bodies at the time of initial constitution of such Corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government Servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/Autonomous Bodies who were/are subsequently appointed by such Corporations/ Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Corporations/ Autonomous Bodies.

Note.—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting applications or notified to the employment exchanges or as the case may be.

7. Minimum educational and other qualifications required for direct recruit(s).—(a) Essential Qualification(s) : (I) At least 2nd class Master's Degree in Forensic Science /Physics/ Chemistry/ Mathematics from any recognized University.

(II) Seven years experience in Documents Examination/Photography/Microphotography/ Ultra Violet photography including finger prints etc. from a recognized Lab./ Institute/ University after acquiring qualification specified at (i) above. (Research work done for doing Ph.D. Degree shall be counted in total experience).

(b) Desirable qualification (s) : Knowledge of custom, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age & educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age : Not applicable.

9. Period of Probation, if any.—(i) Direct Recruitment/Promotion : (a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in case of appointment on contract basis, tenure basis, re-employment after superannuation and absorption.

(ii) Promotion : No probation

10. Method(s) of recruitment whether by direct recruitment or by promotion/secondment/transfer and the percentage of post(s) to be filled in by various methods.—(i) 50% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be.

(ii) 50% by promotion failing which on secondment basis failing both by direct recruitment on regular basis or recruitment on contract basis, as the case may be.

11. In case of recruitment by Promotion/secondment/transfer, grade(s)from whic hpromotion/secondment/transfer is to be made.—By promotion from amongst the Scientific Officers of the particular division subject to possessing of educational qualification prescribed for direct recruitment against column No. 7 (a) (i) above with five years regular service or regular combined with continuous adhoc service rendered, if any, in the grade failing which on secondment basis from the incumbents of this post working in the identical pay scale from Central/ other State Forensic Science Laboratories in India.

1. Provided that for the purpose of promotion every employee shall have to serve atleast one term in the Tribal/Difficult/ Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such incumbent may be posted/transferred to remote/rural areas in their promotion:

Provided further that Officers/Officials who have not served atleast one tenure in Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/ convenience.

Explanation II.—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

1. District Lahaul & Spiti. 2. Pangi and Bharmour Sub Division of Chamba District. 3. Dodra Kawar Area of Rohru Sub-Division. 4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District. 6. Bara Bhangal Areas of Baijnath Sub Division of Kangra District. 7. District Kinnaur. 8. Kathwar and Korga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil in Sirmaur District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada-Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sunder Nagar Tehsil in Mandi District.

Explanation III.—For the purpose of proviso (I) supra the Remote/ Rural Areas shall be as under:

(i) All stations beyond the radius of 20 Kms. from Sub Division/Tehsil headquarter. (ii) All stations beyond the radius of 15 Kms. from State Headquarter and District head quarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

(II) In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration :

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less: Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be Exservicemen who have joined Armed Forces during the period of emergency and recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any, prior to the regular appointment against such posts shall be taken into account towards8434 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion/ Confirmation Committee exists, what is its composition.—(a) Department Promotion Committee : D.P.C. to be presided over by the Chairman, H.P. Public Service Commission or a member thereof to be nominated by him.

(b) Departments Confirmation Committee.—As may be constituted by the Government from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission is

to be consulted in making recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of interview/personality test or if the Himachal Pradesh Public Service Commission or other recruiting agency/authority as the case may be, so consider necessary or expedient on the basis of Interview/Personality test preceded by a Screening test (objective type)/Written test or Practical test or Physical test, the standard/syllabus, etc. of which, will be determined by the Commission/other recruiting agency/authority as the case may be.

15-A. Selection for appointment to the post by Contract appointment.—Notwithstanding anything contained in these Rules, contract appointments to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT:

(a) Under this policy, the Assistant Director (Document & Photography) in the Directorate of Forensics Services, Home Department, Himachal Pradesh, will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/ renewal of contract period on year to year basis the concerned HOD shall issue a certificate that service and conduct of the contract appointee is satisfactory during the year and only than his/her period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPPSC : The Secretary (Home), to the Government of Himachal Pradesh after obtaining the approval of the Government to fill up the vacant posts on contract basis will place the requisition with the concerned recruiting agency i.e. Himachal Pradesh, Public Service Commission.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these R & P Rules.

(II) CONTRACTUAL EMOLUMENTS:

The Assistant Director (Document & Photography) appointed on contract basis will be paid consolidated fixed contractual amount @ ` 22,200/-P.M.(which shall be equal to minimum8435 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 of pay band+Grade pay). An amount of @ ` 666/- (3% of the minimum of pay band + grade pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed, if contract is extended beyond one year.

(III) APPOINTING AND DISCIPLINARY AUTHORITY:

The Secretary (Home), to the Government of Himachal Pradesh will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of Contract Appointment shall be made on the basis of interview/personality test or if considered necessary or expedient on the basis of interview/personality test preceded by a screening test (objective type)/written test or practical test or physical test, the standard/syllabus etc. of which will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS:

As may be constituted by the concerned recruiting agency i.e. the Himachal Pradesh Public Service Commission, from time to time.

(VI) AGREEMENT:

After selection of a candidate, he/she shall sign an agreement as per Annexure–"B" appended to these Rules.

(VII) TERMS AND CONDITIONS:

(a) The contractual appointee will be paid fixed contractual amount @ ` 22,200/-Per Month (which shall be equal to minimum of the pay band + grade pay). The Contract Appointee will be entitled for increase in contractual amount @ ` 666/- (3% minimum of the Pay Band + Grade Pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date on which a copy of termination order is delivered to him/her.

(c) The contract appointee will be entitled for one day's casual leave after putting one month's service, 10 day's Medical Leave and 5 day's special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days'. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days' (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed Casual Leave, Medical Leave and Special Leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty.

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in the case of a Gazetted Government servant and by Government Medical Officer in the case of a Non-Gazetted Government Servant. In case of woman candidates who are to be appointed against posts carrying hazardous nature of duties, and in case they have to complete a period of training as a condition of service, such woman candidate, who as a result of tests is found to be pregnant of twelve weeks' standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such woman candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart official at the minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. The Employees Group Insurance Scheme as well as EPF/GPF will also not be applicable to contract appointee(s).

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/Other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the Himachal Pradesh Departmental Examination Rules, 1997, as amended from time to time.

18. Powers to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission, relax any of the provision(s) of these Rules with respect to any class or category of person(s) or post(s).

Form of contract/agreement to be executed between the Assistant Director(Document

संख्या श्रम (ए) 2-1/2019-लूज.--हिमाचल प्रदेश के राज्यपाल, भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) अधिनियम, 1996 की धारा 62 द्वारा प्रदा शक्तियों का प्रयोग करते हुए, विशेषज्ञता समिति से परामर्श के पश्चात्‌, इस विभाग की अधिसूचना संख्या श्रम (ए) 4-6/2007-बी.ओ.सी. डब्ल्यू तारीख 4 दिसम्बर, 2008 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 8 दिसम्बर, 2008 को प्रकाशित हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तेंं विनियमन) नियम, 2008 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) संशोधन नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. नियम 283(ख) का प्रतिस्थापन.--हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) नियम, 2008 (जिन्हें इस में इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 283(ख) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

''283(ख) हिताधिकारी के लिए साईकिल या सिलाई मशीन.--हिताधिकारी को, सदस्यता के दो मास पूर्ण करने के पश्चात्‌, बोर्ड द्वारा केवल एक बार हिताधिकारी के विकल्प के अनुसार एक साईकिल या सिलाई मशीन प्रदान की जा सकेगी और यह सहायता कुटुम्ब में एक ही हिताधिकारी को प्रदान की जाएगी, ऐसे हिताधिकारी जिन्होंने उपरोक्त प्रसुविधाओं के बदले में 3000/- रुपए (केवल तीन हजार रुपए) की सहायता पहले ही प्राप्त कर ली है वे साईकिल या सिलाई मशीन की प्रसुविधा प्राप्त करने के लिए पात्र नहीं होंगे। हिताधिकारी द्वारा इस सहायता के लिए आवेदन अपेक्षित दस्तावेजों सहित प्रारुप 48 में सचिव या प्राधिकृत अधिकारी को प्रस्तुत किया जाएगा।''।

3. नियम 283(छ),(ज) और (झ) का अन्तःस्थापन.--'उक्त नियमों के नियम 283(च) के पश्चात्‌ निम्नलिखित नियम अन्तःस्थापित किए जाएंगे, अर्थात्‌ :-

''283(छ) समस्त हिताधिकारियों के लिए सुरक्षा किट.--बोर्ड के समस्त हिताधिकारियों को विशेषज्ञता समिति द्वारा यथा अनुमोदित सुरक्षा किट बोर्ड प्रदान कर सकेगा। 283(ज) बढर्इ़, राजमिस्त्री, प्लम्बर और इलेक्ट्रीशियन के लिए टूलकिट ़-

बोर्ड बढ़ई, राजमिस्त्री, प्लम्बर और इलेक्ट्रीशियन को विशेषज्ञता समिति द्वारा यथा अनुमोदित टूलकिट प्रदान कर सकेगा।

283(झ) उपापन प्रक्रिया.--बोर्ड, नियन्त्रक भण्डार या कुछ अन्य सरकारी प्राधिकृत अभिकरण से समस्त वस्तुएं/सामग्री का निम्न के माध्यम से उपापन करेगा;-

1. नियन्त्रक भण्डार, हिमाचल प्रदेश या ई-निविदा (विज्ञापित निविदा) द्वारा परिनिश्चित संविदा दर ; या

2. हिमाचल प्रदेश वित्त नियम, 2009; के नियम 94-अ के अनुसार गवर्नमेन्ट-ई मार्किट प्लेस (जी.ई. एम.); या

No. Shram(A)2-1/2019-Loose.—In exercise of powers conferred by section 62 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Governor, Himachal Pradesh, after consultation with the expert committee, is pleased to make the following rules further to amend the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008, notified vide this Department's notification No. Shram(A)4-6/2007-BOCW, dated 4th December, 2008 and published in the Rajpatra, Himachal Pradesh, dated 8th December, 2008, namely:—

1. Short-title and commencement.—(1) These rules may be called the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Amendment Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Substitution of rule 283(B).—For rule 283(B) of the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008 (thereinafter referred to as the 'said rules') the following shall be substituted, namely:—

"283(B) Bicycle or Sewing machine to beneficiary.—The beneficiary after completion of two months of the membership may be provided a bicycle or sewing machine as per option of the beneficiary only once by the Board and this assistance will be provided to one of the beneficiary in the family. Those beneficiaries who have already availed assistance of ` 3,000/- (Rupees three thousand only) in lieu of the above benefits shall not be eligible for getting the benefits of bicycle or sewing machine. The application for this assistance shall be submitted by the beneficiary to the Secretary or authorized officer in Form No. XLVIII alongwith requisite documents.".

3. Insertion of rules 283(G), (H) and (I).—After rule 283(F) of the 'said rules' the following rules shall be inserted, namely:—

"283(G) Safety kit to all beneficiaries.—The Board may provide safety kit as approved by the expert committee to all the beneficiaries of the Board.

283(H) Toolkit to carpenters, masons, plumbers and electricians.—The Board may provide toolkit to carpenters, masons, plumbers and electricians as approved by the expert committee.

283(I) Procurement Procedure.—The Board shall procure all the articles/ items from Controller of Stores or some other government authorized agency through ,—

1. Rate contract finalised by the Controller of Stores, Himachal Pradesh or E-tendering (Advertised Tender); or

2. Government e-Market Place (GeM) as per rule 94-A of Himachal Pradesh Financial Rules, 2009; or8441 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 3. Boards and Corporations where the rates have been finalized by the respective Board and Corporations through transparent competitive bids as per Finance Department instructions issued vide letter No. Fin-F(A)-(11)-11/2004, dated 16-1-2017.".

Annexure-A Information Technology Department – Right of Way Policy

CHAPTER-1

OBJECTIVES

Objective.—The objective of Right of Way Policy 2021 is to provide an enabling regulatory framework to facilitate provisioning of over ground and underground telecom infrastructure network in the State of Himachal Pradesh. The policy also seeks to provide a transparent and efficient mechanism for promoting investment and setting up infrastructure in the telecom sector. Further, the policy aims to provide improved telecom services through wireless and optical fibre network throughout the towns and villages in Himachal Pradesh.

Background.—The Telecom sector has witnessed phenomenal growth and mobile telephony in particular has revolutionized over the past decade. Getting better Telecom/High Speed Internet connectivity in Himachal Pradesh is imperative for the allround development of the state. Mobile Towers are integral to provide better connectivity whereas Underground/Overhead Optical Fibre Cable is equally required to connect these Towers with Cellular Network. The absence of the required infrastructure leads to the degradation quality of services, slow internet speed and call drops. The formation of a Policy having guidelines shall ease the implementation of telecom infrastructure establishment in the State and make the process of application, approval and installation of the infrastructure across the State simpler. There is a need to reduce license and regulatory compliance requirements keeping in view best international practices by simplifying all existing technical systems and online systems applicable for grant of approvals, clearances, permissions. Government of Himachal Pradesh wants to promote Telecommunication Infrastructure so as to generate business opportunities and employment in the State.

In view of the aforementioned objective and background of the policy, the Government of Himachal Pradesh is pleased to notify the Right of Way Policy 2021 for setting up Telecom Infrastructure in the State to regulate underground infrastructure (optical fibre) as well as over- ground infrastructure (mobile towers) in supersession of this Department notification of even8447 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 number dated 21st June, 2017. The said Policy covers laying of Optical Fibre Cable and installation of Mobile Tower by any Licensees/infrastructure

Providers operating in the state of Himachal Pradesh for facilitating better connectivity subject to the satisfaction of certain conditions detailed hereunder:

1. Short Title and Commencement.—This Policy may be called the Himachal Pradesh Right of Way Policy, 2021 (HPROW-21). This shall come into force on the date of its publication in the official Gazette. This Policy will supersede all previous Policies related to Right of way and Mobile Towers.

2. Definitions.—A. In this Policy, unless the context otherwise requiresa:—

(a) "Act" means the Indian Telegraph Act 1885 (13 of 1885).

(b) "Appropriate Authority" means the State Government, local authority or such authority, body, company or institution incorporated or established by the State Government, including the various Development authorities, Industrial development authorities, other Statutory Authorities, PWD, HPSEBL, Revenue, I&PH, Urban Development, Rural Development and also the local bodies including Urban Local Bodies/ Town and Country Planning Department/ Special Area Development Authority, Gram Panchayats, Zila Parishad/Panchayat, Urban and Rural Local Bodies etc. constituted by the State Legislature, in respect of property, under, over, along, across, in or upon which underground or over ground telegraph infrastructure, is to be established or maintained, vested in, or under, the control or management of such Appropriate Authority.

(c) "State Government" means the Government of Himachal Pradesh.

(d) District Nodal Officer (DNO) shall be the Deputy Commissioner of the concerned district, in respect of which, any application for seeking right of way for telecom infrastructure is being made.

(e) "DoT" means the Department of Telecommunication, Government of India.

(f) "TERM Cell" means Telecom Enforcement, Resource and Monitoring Cell of the Department of Telecommunication (DoT), Government of India which is competent agency to tender advise on Electro Magnetic Field (EMF) Radiation related matters of Telecom Infrastructure.

(g) Licensee under this policy means any person holding a license issued under sub- section (1) of Section 4 of the Act or an Infrastructure Provider—

1 registration issued by Department of Telecommunication.

(h) "Overground telegraph infrastructure" means a telegraph or a telegraph line established over the ground and includes posts or other above ground contrivances, appliances and apparatus for the purpose of establishment or maintenance of the telegraph or the telegraph line.

(i) "underground telegraph infrastructure" means a telegraph line laid under the ground and includes manholes, marker stones, appliances and apparatus for the purposes of establishment or maintenance of the telegraph line.

Television Antennas or Dish Antennas installed for domestic purpose.

C. Words and expressions used and not defined herein but defined in the Act shall have the meaning assigned to them in the Act.

3. Applicability.—The Appropriate Authority, on whom the powers of the telegraph authority have been conferred by notification under section 19B of the Act, shall exercise the powers under this policy on an application for establishment and maintenance of underground or overground telegraph infrastructure by any licensee subject to any conditions and restrictions as may be imposed in such notification. This Policy shall be applicable to all Appropriate Authorities within the state of Himachal Pradesh.

In case of National Highways, norms as per Policy Guidelines of accommodation of public and industrial utility services along and across National Highways circulated by Ministry of road transport & Highways No. RW/NH-33044/29/2015/S&R (R) dated 22-11-2016, as amended from time to time, shall also be applicable.

In case of forest land, the regulatory procedure as outlined in Forest (Conservation) Act, 1980 (FCA) shall also be applicable.

4. Nodal officers.—A. The District Nodal Officer or the Deputy Commissioner (DC) of the district shall be the single contact person for according approvals and clearances. The designated nodal officer(s) of the appropriate authorities will be responsible for processing the approvals/clearances for their respective departments and shall report to the concerned DC, who will be single point of contact.

B. All applications will be received in the office of District Nodal Officer (DNO) of the concerned District through online portal.

C. Every appropriate authority shall designate a "Nodal officer" for the purposes of this Policy. The Role of the nodal shall be, but not limited to, the following:

• Responsible for day to day activities & communication with the applicants. • Coordinate for timely approvals/NOCs with the District Nodal Officer. • Monitoring of the infrastructure being raised in authorities' jurisdiction. • Follow up on issues/Grievances.

CHAPTER -2

TERMS AND CONDITIONS FOR ESTABLISHMENT AND MAINTENANCE OF

TELEGRAPH INFRASTRUCTURE

5. Terms and Conditions for granting permission to lay underground telegraph

infrastructure(OFC) :

A. The licensee shall obtain necessary permission for laying optical fiber cable(OFC) network/underground telegraph infrastructure and taking fiber to home under roads and overhead from the nodal officer of the concerned appropriate authority through District Nodal Officer.

C. Damages of the roads and filling up of the pits caused during the laying of underground telegraph infrastructure and taking fiber to home may be repaired by the concerned local body/ appropriate authority and the entire expenses, for restoration of damaged road portion may be charged by the local body from the licensee. Charges for such expenses shall be fixed by state government from time to time, on the basis of applicable schedule of rates for works for similar nature. The guidelines issued by the PWD shall be followed for calculating the restoration charges. Such charges(100%) shall be deposited in advance within a period of 30 days from the grant of permission and prior to the commencement of work of laying the underground telegraph infrastructure. It is the endeavor of State government to rationalize rates in consultation with TSPs/IPs:

Provided that no other charges, (except above mentioned restoration charges and relevant administrative charges prescribed) shall be levied on the licensee.

D. Laying OFC through micro trenching method shall be allowed during monsoons, provided that the applicant takes all security measures and makes arrangements for immediate restoration of the damage caused.

E. Only pits of approximate size not more than 1.2 meter in width and depth not less than 1.5 meter or as per the requirement at site shall be excavated in the roads where optical fiber cables are to be laid, at the distance of not less than 100 meter at a time. The pits shall be refilled only with granular material and shall be compacted as per the specifications. The pits/trenches shall be reinstated within 48 hours, after the work at that location is over, failing which, penalty as applicable shall be levied besides the cancellation of permission etc. For digging of ULBs road/ land the licensees should take proper covering of the area alongside the walkways so that there is no inconvenience to the general public.

F. Number of ducts under the roads for which permission will be granted shall be as per requirement of the licensee.

G. The licensee shall ensure provision of positional intelligence, through appropriate technology, of all underground telegraph infrastructure to enable the appropriate authority to obtain real time information on its location.

H. The licensee will carry out ground penetrating radar (GPR) survey wherever necessary along the route where the ducts will be laid for detection of existing utilities. The data of utilities collected by the licensee through GPR survey should be unconditionally shared with the local body or appropriate authority, free of cost.

I. No damage shall be caused to any underground utilities while laying the ducts using Horizontal Directional Drilling (HDD) methodology. In case any utility is damaged, the damage so caused to the utilities, shall be rectified by the licensee at his own cost.

J. Ducts shall be laid approximately 1.65 meters below the road crust.

K. The cost of shifting conduits/OFC, wherever required, shall be borne by the licensee and instruction of appropriate authority in this respect shall be complied within the time frame fixed by the concerned appropriate authority.

L. Local body shall not be responsible for any damage to OFC and resultant losses, if any, due to any act of employee of Govt. or appropriate authority, while performing official duties. However, prior written information will be given by the appropriate authority to the licensee.

M. The licensee shall make proper arrangement for access control of the chambers to avoid misuse/illegal use of ducts and the chambers.

NOTE:

(i) The Licensee shall not have to pay any fees or rent towards the manhole installed by them while laying the OFC. Licensee would not require a fresh permission for supervision of further work done by them through these manholes and they may carry out the further work by giving a 10 days prior Notice to the concerned authority in writing.

(ii) STRUCTURED AERlAL.—In difficult terrain or rocky and hilly areas where underground laying of OFC is not possible, the Licensee shall be granted permission for Structured Aerial Cabling in such areas by installing poles within an area of 1 meter X 1 meter upon an application submitted by them in this regard to appropriate authority for use of existing poles or installation of new Poles by Licensee. The maximum height of these poles will not be greater than 5 meters and the inter distance from one pole to another must not be less than 30 meters (or as per situation).Licensee shall either use the existing Poles of appropriate authority by moving application or may also apply for installation of new poles. For use of existing pole structures of the HPSEBL, wherever feasible for laying overhead OFC in some locations, the rates will be Rs. 58.16 per pole per month (Rs. 697.92 per pole per year) exclusive of GST/ any other tax applicable for hiring of LT Poles for laying OFC. There will be an increase of 10% in pole rent on 1st April of financial year to counter the impact of inflation and the initial pole rent for new poles to be hired in the succeeding period shall be without escalation of 10% i.e. Rs. 697.92 per pole per year.

These rates shall be reviewed by HPSEBL from time to time.

The rates may be revised by HPSEBL or other concerned competent authority from time to time. The Applicant/Licensee will also have the option of depositing the lease charges for these Poles collectively for a period of five years and in such case the Licensee shall be exempted from paying any rental thereafter. These Lease Charges shall be payable on Poles owned by Appropriate Authority and also if the Licensee moves an application to install new poles. However, no 'one time Permission fees' shall be payable for installation of such type of Poles.

(iii) Regarding laying of Optical Fiber Cable in Non Protected Forest Areas, the Licensee shall file application for consolidated area (which may be more than one hectare) through HDD/Open Trenching or Micro Trenching methodology on basis of submission of bank guarantee, further the permission shall be granted in view of the guidelines already established for Non Protected Forest Areas and the permission shall be granted by concerned District Forest Officer.

6. Terms and Conditions for granting permission to establish overground telegraph

infrastructure (Mobile Towers etc.) :

A. The radiation norms fixed by the DoT have to be strictly followed by the licensee. Any citizen can submit/raise an online complaint with regard to any grievance relating to Mobile Towers at https://tarangsanchar.gov.in/emfportal and approach TERM cell with regard to grievance.

B. Sign boards and Warning Signs ("Danger", "Warning", "Caution", etc.) as per guidelines of DoT shall be provided at towers and antenna sites which are clearly visible and identifiable.

C. The applicant shall be permitted to erect/install telegraph infrastructure on open land including private lands and buildings of Government or Government owned/controlled Statutory or Non-Statutory institutions/ bodies or at other public/private locations including roads, parks, playground, hospital schools, land earmarked for public utilities.

D. In the Walled City area or in the area of Heritage importance the pole/mast shall be designed keeping in view the Heritage character of the area.

E. The licensee shall be granted permission to install micro cells/Wi-Fi access points and other required services on street light poles/bus shelters/ government buildings.

F. The licensee shall fix the equipment which cause minimum noise and environmental pollution.

G. The permission shall not be granted unless outstanding urban development tax or any other dues payable upon the land and building applied for installation of telegraph infrastructure are cleared. However, the nodal officer shall communicate such tax or dues to the licensee and the Owner of the land or building and if an undertaking is submitted by the Owner for depositing the outstanding urban development tax or any other dues, as the case may be, within 3 months, the nodal officer shall grant the required permission.

H. Mobile Towers/posts being a temporary structure and essential service in nature can be installed on any type of land/building regardless of its specified land use and will not require change of land use under any law/act and provisions of section 118 under the HP Tenancy and Land Reforms Act, 1972. However, the erection of a Tower/ Telecom Infrastructure is not to be construed as a transfer of Land in favour of Telecommunication Companies.

I. Mobile Communication Towers/mast/poles being a critical infrastructure, Power & Electricity department will accord priority in providing electrical power connection to Mobile Towers and Telecom Equipment. The electricity connection to Mobile towers and telecom equipments will be released as per "Duty of Licensee to Supply Electricity" defined in HPERC Supply Code.

J. CELL ON WHEELS- "Cell on Wheels Mobile Towers, usually referred to as COW, is a mobile cell site that consists of a cellular antenna tower and electronic radio transceiver equipment on a vehicle or trailer, designed to be part of a cellular network. COWs are used to provide expanded cellular network coverage and/or capacity at special events such as major events, major conventions, or in disaster areas where cellular coverage either was never present or was compromised by the disaster. Formal clearance or permit will not be required for installation of COW for such specific temporary needs subject to prior formal intimation to the Deputy Commissioner, Superintendent of Police of the concerned district and the concerned Officer-in- Charge of the Police Station. Maximum duration for COW would be 90 days which may be further extended after taking prior approval from concerned Deputy Commissioner".

APPLICATION FOR AND GRANT OF PERMISSION FOR ESTABLISHMENT AND

MAINTENANCE OF TELEGRAPH INFRASTRUCTURE

7. Application by a licensee :

A. A licensee shall, for the purposes of establishment of telegraph infrastructure under any immovable property vested in or under the control or management of any appropriate authority, make an application, supported by such documents as specified by State/Central Government from time to time, to concerned District Nodal Officer (DNO) through online portal in such form and manner as may be specified by each appropriate authority. The application will be automatically forwarded to the concerned nodal officer(s) of the concerned appropriate authority(s) through the online portal forthwith¹. The form will be designed after finalization of policy.

B. The information along with supporting documents to be provided by the Licensee for underground telecom infrastructure in the application made under sub-clause (A) shall includea:—

(a) A copy of License/ registration certificate granted by the Central Government; (b) The location map showing the proposed underground telegraph infrastructure including route planned, exact latitude and longitude, nature of land;

(c) The details of underground telegraph Infrastructure proposed to be laid along with proper Diagram;

(d) The mode and time duration for, execution of the work; (e) The time of the day when the work is expected to be done in case the Licensee expects the work to be done during specific time of the day;

(f) The details of expenses that such Appropriate Authority will necessarily be put in consequence of the work proposed to be undertaken by the Licensee;

(g) The inconvenience that is likely to be caused to the public and the specific measures proposed to be taken to mitigate such inconvenience;

(h) The specific measures proposed to be taken to ensure public safety during the execution of the work;

(i) Any other matter relevant, in the opinion of the licensee, connected with or relative to the work proposed to be undertaken; and

(j) Any other matter connected with or related to the work as may be specified, through a general or special order, by the Central Government or State Government or appropriate local authority:

Provided that the licensee shall, while making the application, give a specific commitment on whether he undertakes to discharge the responsibility for restoration, to the extent reasonable and prudent, of the damage that the appropriate authority shall necessarily be put in consequence of the work proposed to be undertaken.

C. Every application under sub-clause (A) for establishment of underground telegraph infrastructure shall be accompanied with a non-refundable fee of INR 1000/kilometer to meet administrative expenses for evaluation of the application and the proposed work.

D. The information along with supporting documents to be provided by the Licensee in the application for the purposes of establishment of overground telegraph infrastructure made under sub-clause (A) shall include—

(a) A copy of License granted by the Central Government; (b) The nature and location, including exact latitude and longitude, of post or other above ground contrivances proposed to be established;

(c) The extent of land required for establishment of the overground telegraph infrastructure;

(d) The details of the building or structure, where the establishment of the overground telegraph infrastructure, is proposed;

(e) Copy of sanctioned roof plan, if the tower is to be erected on an existing building; (f) Copy of the approved completion plan clearly depicting that the completion of top floor alongwith roof of the building has been approved by the Competent Authority. In case of some buildings completed before a cut-off date, there is no need of building completion plan. In such cases structural safety certificate will suffice;

(g) Acknowledgement receipt issued by TERM Cell of the self-certificate submitted by the Licensee in respect of mobile tower/Base Transceiver Station (BTS) (BTS- ground based/roof top/Pole/wall mounted) in the format as prescribed by Telecommunication Engineering Centre (TEC), DoT, establishing/ certifying that all general public areas around the tower will be within safe Electro Magnetic Radiation (EMR) exposure limit as per peak traffic measurement after the antennas starts radiating.

{Note.—It can be submitted within 90 days after the tower starts radiating}

(h) Copy of the type test certificate issued by automotive Research Association of India (ARAI) to the manufacturers of the Diesel Generator (DG) Sets. (In case the capacity of the DG is above 1 MVA applicant shall put up a canopy on its DG Set, provide a stack of adequate height as per norms prescribed by the Board and ensure that ambient noise levels comply with the Noise Pollution (Regulation and Control) Rules, 2000);

(i) Copy of Standing Advisory Committee on Radio Frequency Allocation (SACFA) clearance/copy of Standing Advisory Committee on Radio Frequency Allocation (SACFA) application for the said location submitted to Wireless Planning Coordination (WPC) wing of DoT with registration number as Wireless Planning Coordination (WPC) acknowledgement alongwith undertaking that in case of any objection/ rejection, Telecom Service Providers (TSPs)/Infrastructure Providers (IPs) will take corrective actions / remove the tower;

(j) The Nodal Officer/Local Body may also seek the copy of No Objection Certificate (NOC) from building owners/entities having roof top rights in case of roof based tower or from land owner in case of ground based tower, including proof of ownership;

(k) Copy of Clearance from Fire Safety Department only in case for high rise building where fire Clearance is mandatory as per the National Building Code of India.

(l) For the installation of mobile towers on notified heritage buildings the specific clearance from the concerned authority;

(m) The mode and time duration for, execution of the work; (n) The inconvenience that is likely to be caused to the public and the specific measures proposed to be taken to mitigate such inconvenience;

(o) The specific measures proposed to be taken to ensure public safety during the execution of the work;

(p) The detailed technical design and drawings of the post or other above ground contrivances;

(q) Certification of Structural safety from a graduate structural engineer as per section 243 of the Himachal Pradesh Municipal Corporation Act, 1994 or Graduate Structural Engineer who is a member of the Institution of Engineers (www.ieindia.org) or Authorised Chartered Structural Engineer of the State/ Local Bodies or from any Indian Institute of Technologies (IITs) or Any National Institute of Technologies (NITs) or Central Building Research Institute (CBRI), Roorkee or Rail India Technical and Economic Service (RITES), Gurgaon or Structural Engineering Research Centre (SERC), Chennai or other agency authorized from time to time by the State Government;

(r) The names and contact details of the employees of the licensee for the purposes of communication in regard to the application made;

(s) Any other matter relevant, in the opinion of the licensee, connected with or relative to the work proposed to be undertaken; and

(t) Any other matter connected with or related to the work as may be specified, through a general or special order, by the Central Government or State Government or appropriate local authority.

E. Every application for the establishment of overground telegraph infrastructure under sub-clause (A) shall be accompanied with a non-refundable fee of INR 1,000 to meet administrative expenses for evaluation of the application and the proposed work.

In Case of Government Land, Annual Rent for the space allocated for installation of Mobile tower shall be 10% of the market value of the land on 'per square meter basis'. Market value of the land will be the Circle Rate as notified by the District Collector. Provided, that the rental per month for Mobile Tower shall not exceed INR 10,000 per month which can be amended by the Government of Himachal Pradesh from time to time. The Applicant will also have the option of depositing the rental charges upfront on lump-sum basis collectively for a period of five years calculated at the rates determined initially without any escalation.

The Mobile Communication Infrastructure created by the TSP/IP may be let out with prior intimation to the appropriate authority, which has granted the original permission.

Where the establishment of the overground telegraph infrastructure renders the immoveable property, vested in the control or management of any appropriate authority over which such overground telegraph infrastructure is established, unlikely to be used for any other purpose, the appropriate authority shall be entitled to compensation for the value of the immoveable property, either once or annually, assessed on such rates as provided above.

8. Grant of permission:

A. The Nodal Officer(s) of the concerned Appropriate Authority(s) shall examine the application with respect to the following parameters but not limited to them:

(a) The Route planned for the proposed underground telegraph infrastructure and the possible interference either in the establishment or maintenance of such telegraph infrastructure, with any other public infrastructure that may have been laid along the proposed route along with revenue papers of the land;

(b) The mode of execution; (c) The time duration for execution of the work and the time of the day that the work is proposed to be executed;

(d) The estimation of expenses that the Appropriate Authority shall necessarily be put in consequence of the work proposed to be undertaken;

(e) The responsibility of restoration of any damage and payment of restoration charge in consequence of the work proposed to be undertaken;

(f) Assessment of measures to ensure public safety and inconvenience that the public is likely to be put to in consequence of the work proposed and the measures to mitigate such inconvenience indicated by the licensee; and

(g) Any other matter, consistent with the Act and this Policy, connected with or relative to the establishment or maintenance of underground telegraph infrastructure, through a general or specific order, by the central Government, State Government or the appropriate local authority.

(ii) For Underground Telegraph Infrastructure:

(a) The extent of land required along with revenue papers for the overground telegraph infrastructure;

(b) The location proposed; (c) The approval issued by the duly authorised officer of the Central Government for location of the above ground contrivances proposed to be used for transmission of Radio waves or Hertzian waves;

(d) The mode of and time duration for execution of the work; (e) The estimation of expenses that the Appropriate Authority shall necessarily be put in consequence of the work proposed to be undertaken;

(f) Assessment of the inconvenience that the public is likely to be put to in consequence of the establishment or maintenance of the overground telegraph infrastructure, and the measures to mitigate such inconvenience indicated by the licensee;

(g) Certification of the technical design by a structural engineer attesting to the structural safety of the overground telegraph infrastructure;

(h) certification, by a structural engineer, of the structural safety of the building on which the post or other above ground contrivances is proposed to be established; and

(i) Any other matter, consistent with the Act and this Policy, connected with or relative to the establishment or maintenance of overground telegraph infrastructure, through a general or specific order, by the central Government, State Government or the appropriate local authority.

B. Each application shall be duly scrutinized by the concerned designated nodal officer(s) of the concerned Appropriate Authority(s) concurrently and not sequentially who may seek such additional information from the "applicant" as may be considered necessary for scrutiny of the application. The concerned nodal officer(s) shall submit his remarks (approval or rejection with reasons) to the concerned District Nodal Officer within a period not exceeding forty five (45) days from the date of receipt of application8456 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 received from the District Nodal Officer. Once the concerned nodal officer(s) conveys approval/rejection, the District Nodal Officer shall—

(a) Grant permission on the portal on such conditions including, but not limited to, the time, mode of execution, measures to mitigate public inconvenience or enhance public safety and payment of restoration charge in form of Bank Guarantee, as may be specified, subject to the provisions of this Policy, or Reject the application on the portal for reasons to be recorded in writing:

Provided that no application shall be rejected unless the applicant Licensee has been given an opportunity of being heard on the reasons for such rejection:

Provided further that the concerned District Nodal Officer shall communicate acceptance or rejection of the application to the applicant within 10 days of receiving of report from the concerned Nodal Officer(s).

(b) Any applicant aggrieved by an order passed on their application or if the timelines described above are not met, may within 15 days of the communication of the order to him or expiry of timeline, prefer an appeal under dispute resolution as mentioned in Chapter-6 of this policy.

C. Where the appropriate authority accepts the undertaking by the licensee to discharge the responsibility to restore the damage that such appropriate authority shall necessarily be put in consequence of the work, the appropriate authority, while granting permission, may seek a bank guarantee for an amount in lieu of expenses for restoration of such damage, as security for performance in the discharge of the responsibility.

D. The appropriate authority shall not charge any fee other than those prescribed under sub-clauses (C and E) of clause 7 and the charges for structured aerial as defined in this policy from the licensee for establishing telegraph infrastructure.

9. Obligations of licensee in undertaking work :

(i) For underground telegraph infrastructure:

A. The licensee shall make the payment of expenses or submit the bank guarantee as determined by the appropriate authority within a period of thirty days from the date of grant of permission and prior to the commencement of work of laying the underground telegraph infrastructure:

Provided that the appropriate authority may, at its discretion, extend the said period for payment of expenses or submission of bank guarantee on an application made by the licensee seeking such extension.

B. The licensee shall ensure that –

(a) prior to the commencement of work of laying the underground telegraph infrastructure and at all times during the execution of work, the measures to mitigate public inconvenience and provide for public safety are implemented; and (b) the work of laying underground telegraph infrastructure is carried out in accordance with the conditions specified in the grant of permission by the appropriate authority.

C. If any damage is caused to any person or property because of the work undertaking by the operator or any of the operators' equipment/ staff, the operator shall be solely responsible for paying all kinds of compensations and damages to the concerned and will be liable to face any civil or criminal proceedings unless waived or reasonably justified or beyond the reasonable control of the Applicant.

D. The licensee shall ensure provision of positional intelligence, through appropriate technology, of all underground telegraph infrastructures to enable the appropriate authority to obtain real time information on its location.

(ii) For overground telegraph infrastructure:

A. The licensee shall ensure that –

(a) Prior to the commencement of establishment and maintenance of overground telegraph infrastructure and at all times, the measures to mitigate public inconvenience and ensure public safety, including structural safety of such overground telegraph infrastructure are implemented;

B. The work of establishment and maintenance of overground telegraph infrastructure is carried out in accordance with the conditions specified in the grant of permission by the appropriate authority.

C. If any damage is caused to any person or property because of the tower, machine room, battery equipment etc., erected by the operator, the operator shall be solely responsible for paying all kinds of compensations and damages to the concerned and will be liable to face any civil or criminal proceedings unless waived or reasonably justified or beyond the reasonable control of the Applicant.

D. In case of violation of any statutory requirement, a show cause notice of 30 days will be issued to the Licensee on which Licensee has to revert with the clarification. In case the clarification is not satisfactory the tower shall be removed/sealed forthwith besides imposing of penalty.

10. Powers of appropriate authority to supervise the work :

A. The appropriate authority may supervise the execution of work to ascertain if the conditions imposed in the grant of permission are observed by the licensee.

B. The appropriate authority may, on the basis of such supervision, impose such other reasonable conditions as it may think fit.

C. If the appropriate authority comes to the conclusion that the licensee has violated any of the conditions for grant of permission, it may, through District Nodal Officer,(i) forfeit, in full or in part, the bank guarantee submitted by the licensee and withdraw the permission granted to the licensee, for reasons to be recorded in writing, or (ii)withdraw, for reasons to be recorded in writing, the permission granted to the licensee.

Provided that no action shall be taken under this sub-clause unless the licensee has been given an opportunity of being heard.

D. District Administration, Officials of the State Government shall have the right to inspect the site at all times without any prior notice.

RIGHT OF APPROPRIATE AUTHORITY TO SEEK REMOVAL OF TELEGRAPH

INFRASTRUCTURE

11. Right of appropriate authority to seek removal, etc :

A. Where the appropriate authority, having regard to circumstances which have arisen since the establishment of any telegraph infrastructure under, over, along, across, in or upon, any immoveable property vested in or under the control or management of that appropriate authority, considers that it is necessary and expedient to remove or alter such telegraph infrastructure, it shall issue a notice to the licensee, being the owner of such telegraph infrastructure, to remove or alter its location providing the detailed reasons, for such removal or shifting, in writing.

B. On receipt of the notice under sub-clause (A), the licensee shall, forthwith and within a period of thirty days, proceed to submit, to the appropriate authority, a detailed plan for removal or alteration of such telegraph infrastructure.

C. The appropriate authority shall, after examination of the detailed plan submitted by the licensee under sub-clause (B), pass such orders as it deems fit:

Provided that the appropriate authority shall, having regard to emergent and expedient circumstances requiring the removal or alteration of such telegraph infrastructure, give a reasonable time of not less than ninety days to the licensee for removal or alteration of such telegraph infrastructure:

Provided further that the responsibility and liability, including the cost thereof, for removal or alteration of such telegraph infrastructure shall be borne by the licensee.

CHAPTER – 5

REGULARIZATION OF EXISTING MOBILE TOWERS etc.

12. Procedure for regularization of existing mobile towers:

A. Wherever permission has already been granted under erstwhile policy/orders, the same shall hold good and no fresh permission will be required under this Policy.

B. However, all the existing mobile towers etc. wherein formal permission has not been issued by the concerned Nodal Officers of Appropriate Authorities, may be regularized upon the submission of application along with information and documents as specified in this Policy and after the payment of prescribed fee/charges under this Policy subject to it being in conformity of prevailing regulations of the Acts/Rules/Policies of the Central Government or State Government. Such application shall be submitted within six months of issue of this Policy, after which the said mobile towers etc., shall be deemed as unauthorized. Earlier fees paid if any, by the licensee shall be adjusted. Once the application is submitted within due time, the operation of the Mobile Tower shall not be discontinued till disposal of the application by the Nodal Officer.

C. In cases where applications for permission have been submitted under erstwhile policy(ies) but no fee has been paid or documents as per erstwhile policy(ies) were not8459 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 submitted and/or permission(s) have not been issued, then in such cases, documents as per this Policy and/or fees to meet administrative expenses (if not paid earlier) may be submitted & permission shall be issued in accordance with this Policy.

13. Safety and Security of Telecom Infrastructure:

Telecom Installations are a critical infrastructure in mobile communication. In order to avoid disruption in mobile communication, an essential service:

A. Sealing or disconnection of electricity of existing and operational Base Transceiver Station Towers may not be resorted to without the consent of the respective TERM Cell in respect of the EMF radiation related issues.

B. Strict legal action under relevant sections of the Act and Indian Penal Code by the law enforcement authorities to be initiated against any willful or negligent damage to the telecom infrastructure facility and causing interruption to the network connectivity.

CHAPTER – 6

DISPUTE RESOLUTION

14. Disputes between licensee and appropriate authority :

A. Any dispute arising between a licensee and the appropriate authority in consequence of this Policy, shall be referred to the Mechanism of Dispute Resolution set up by the State Government.

B. The officers designated by the State Government shall determine the disputes referred to in sub-clause (A) within a period not exceeding sixty days in such manner as may be specified by the State/Central Government from time to time.

15. Public Grievance Redressal and Coordination Mechanism:

A. State Government Assistance : (a) A Joint Coordination Committee having following members will be constituted at the District level for review of all Telecommunication Infrastructure related matters, like adherence to the timelines for granting approval, issues pertaining to appropriate authority (Local Bodies/ Town and country Planning Department/ Rural Development/SADA etc.) or TSP/ IP:

(i) Deputy Commissioner (as Chairperson); (ii) Representatives of Telecom Service Providers/ Infrastructure Provider; (iii) Representatives from rural wing TERM Cell HP LSA; (iv) Representatives of Concerned Departments and (v) Representatives of appropriate authority (Local Bodies/ Town and country Planning Department/ Rural Development/ SADA etc).

(b) Similarly, a State level Coordination Committee headed by the Director (IT) shall be constituted to monitor issues pertaining to Telecom Infrastructure (Overground, Underground) in the State. The proposed State level Coordination8460 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 Committee would consists of officers from TERM Cells, State/District Administration, representatives of Controller of Communication Accounts, representatives of concerned Departments, representatives of concerned Telecom Service Provider(s)/ Infrastructure Provider(s), eminent public persons.

B. Any complaint concerning illegal installation of Mobile Communication Tower on ground or on any building or any query of any nature regarding the installation of Telecommunication Infrastructure shall be addressed to the appropriate authority (Local Bodies/ Town and country Planning Department/ Rural Development/ SADA etc) with a copy to the Joint Coordination Committee headed by concerned Deputy Commissioner and Director (IT).

The appropriate authority (Local Bodies/ Town and country Planning Department/ Rural Development/ SADA etc) shall take a final decision in the matter after inquiring into it and direct action considered appropriate to be taken by the concerned Telecom Service Provider within such period as may be prescribed by the appropriate authority (Local Bodies/Town and country Planning Department/ Rural Development/ SADA etc).Any applicant aggrieved by an order passed on their application may, within 15 days of the communication of the order to him, prefer an appeal under dispute resolution as mentioned in Sub-clause (A) above,

ONLINE PORTAL

16. Department of Information Technology shall develop an electronic application process within a period of six months from the date of commencement of this Policy for submission of applications.

All online applications shall be routed to the District Nodal Officer for requisite approval through this portal.

A. All the approving agencies i.e. Nodal Officer(s) of Appropriate authority(s) shall have access to the portal.

B. Every application shall have a unique reference number which shall be valid for all the communications related to it.

C. The Portal shall have the information pertaining to Grievance Redressal Mechanism, Indian Government Websites (GIGW) guidelines, dedicated helpline number, Government orders etc.

D. MIS reports from the Portal shall be used to measure the progress of the Applications.

E. Other features of the portal shall include:

(a) Submission of applications for permission of RoW across the State of Himachal Pradesh.

(b) Workflow for approval process (c) Every application submitted shall have its Unique Reference Number8461 राजपत्र, हिमाचल प्रदेश, 24 फरवरी, 2021/05 फाल्गुन, 1942 (d) All the supporting documents relating to the application shall be uploaded by the applicant online.

(e) SMS/email alerts regarding the status of the application (f) Any financial arrangement such as payment gateway etc. for submission of required fee shall be integrated with the portal.
