The Governor, Himachal Pradesh is further pleased to notify the newly constructed Make shift Hospital as Dedicated Hospital for COVID and machinery, staff; outsourced staff deployed through service providers at Dr. RPGMC, Tanda, District Kangra, H.P. for COVID related duties shall be deployed at 'Make Shift Hospital' at Dr. RPGMC, Tanda, District Kangra till 31-3-2021 in the public interest.

नस्ति सं0 ई0 डी0एन0-ए-क(4)-1/2020.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश प्राइवेट शिक्षा संस्था (विनियामक आयोग) अधिनियम, 2010 (2011 का अधिनियम संख्यांक 15) की धारा 18 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, माननीय उच्चतम न्यायालय के समक्ष लंबित न्यायनिर्णयन सिविल अपील नम्बर 11290/2013 के अन्तिम परिणाम के अध्यधीन, इस विभाग की अधिसूचना संख्या ई0 डी0 एन0-ए-क (3)-1/2011, द्वारा तारीख 27 जुलाई, 2011 को राजपत्र, हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश प्राइवेट शिक्षा संस्था (विनियामक आयोग) नियम, 2011 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश प्राइवेट शिक्षा संस्था (विनियामक आयोग) संशोधन नियम, 2021 है।

(2) ये नियम, राजपत्र (ई-गजट) हिमाचल प्रदेश मेें प्रकाशन की तारीख से प्रवृत्त हाेंगे। 2. नियम 3 का संशोधन.-हिमाचल प्रदेश प्राइवेट शिक्षा संस्था (विनियामक आयोग) नियम, 2011 के नियम 3 के उपनियम (3), (4), (5) और (6) के स्थान पर निम्नलिखित रखे जाएंगे, अर्थात्‌ः-

"(3) अध्यक्ष और सदस्य, आयोग के मुख्यालयों पर, ऐसी सरकारी वास सुविधा के आबंटन को विनियमित करने वाले नियमों के अधीन उनकी पात्रता के अनुसार आवासीय वास सुविधा, यदि सामान्य पूल में उपलब्ध है, के हकदार होंगे।

(4) अध्यक्ष और सदस्य मकान किराया भत्ता प्रदान करने से सम्बन्धित सरकार द्वारा समय- समय पर जारी नियमों/अनुदेशों के अधीन उनकी पात्रता के अनुसार मकान किराया भत्ता (एच0 आर0 ए0) के हकदार होेंगे। दूरभाष सुविधाएं राज्य सरकार के, ऐसी प्रसुविधाओं को प्रदान करने से सम्बन्धित, समय-समय पर जारी आदेशों के अधीन उनकी पात्रता के अनुसार ही अनुज्ञेय होंगी। 8697 राजपत्र, हिमाचल प्रदेश, 03 मार्च, 2021/12 फाल्गुन, 1942 (5) अध्यक्ष और सदस्य ऐसे यात्रा भत्ता/दैनिक भत्ता के पात्र होंगे जैसे सरकार के यात्रा भत्ता/दैनिक भत्ता प्रदान करने से सम्बन्धित आदेशों के अधीन यथा विनिर्दिष्ट राज्य सरकार के ग्रेड-I के अधिकारियों को अनुज्ञेय हैं।

(6) अध्यक्ष और सदस्य सरकार के सुसंगत नियमों/अनुदेशों के अधीन उनकी पात्रता के अनुसार चिकित्सा प्रसुविधाओं, छुट्‌टी और अवकाश यात्रा प्रसुविधा (एल0 टी0 सी0) के हकदार होंगे"।

No. EDN-A-Ka(4)-1/2020.—In exercise of the powers conferred by section 18 of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010 (Act No. 15 of 2011), the Governor, Himachal Pradesh is pleased to make the following Rules further to amend the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Rules, 2011, published in the Rajptra, Himachal Pradesh dated 27th July, 2011 vide this department notification number EDN-A-Ka(3)-1/2011, subject to the final outcome of the Civil Appeal No. 11290/ 2013 pending adjudication before the Hon'ble Supreme Court, namely:—

1. Short title and commencement.—(1) These Rules may be called the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Amendment Rules, 2021.

(2) These Rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Rule 3.—In Rule 3 of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Rules, 2011, for sub Rules (3), (4), (5) and (6), the following shall be substituted, namely:—

"(3) The Chairperson and members shall be entitled to the residential accommodation at the headquarters of the Commission, if available in general pool, as per their entitlement under the Rules governing allotment of such Government accommodation.

(4) The Chairperson and members shall be entitled to House Rent Allowance (HRA) as per their entitlement under the rules/instructions issued by the government from time to time relating to the grant of HRA. The telephone facilities will also be admissible as per their entitlement under the orders of the State Government issued from time to time relating to grant of such facilities.

(5) The Chairperson and the members shall be entitled to such Travelling allowance and Daily Allowance as are admissible to the Grade-I Officers of the State Government as specified under the orders of the Government relating to the grant of TA/DA.

(6) The Chairperson and the members shall be entitled to the medical benefits, leave and LTC facility as per their entitlement under the relevant rules/instructions of the Government."

to authorise payment and appropriation of certain further sums from and out of the

Consolidated Fund of the State of Himachal Pradesh for the services for the financial year ending

on 31st day of March, 2021.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy Second Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Appropriation Act, 2021.

2. Issue of a further sum of `91,25,11,89,458 out of the Consolidated Fund of the State of Himachal Pradesh for the financial year 2020-2021.—From and out of the Consolidated Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those specified in column (3) of THE SCHEDULE amounting in the aggregate to a sum of ` 91,25,11,89,458 (Rupees Nine thousand one hundred twenty five crore, eleven lakh, eighty nine8707 राजपत्र, हिमाचल प्रदेश, 03 मार्च, 2021/12 फाल्गुन, 1942 thousand, four hundred, fifty eight) only towards defraying the several charges which will come in course of payment during the financial year 2020-2021 in respect of the services and purposes specified in column (2) of THE SCHEDULE.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be further appropriated for the services and purposes expressed in THE SCHEDULE in relation to the period specified under section 2 of this Act.

STATEMENT OF OBJECTS AND REASONS

This Bill is introduced in pursuance of clause (1) of article 204 read with article 205 of the Constitution of India to provide for the appropriation from and out of the Consolidated Fund of the State of Himachal Pradesh of the moneys further required to meet the expenditure charged on the Consolidated Fund and other expenditure as voted by the Legislative Assembly in respect of the estimated expenditure of the Government of Himachal Pradesh for the financial year 2020-2021.
