No. Agr-B-C(5)-39/2020.—With a view to provide financial support to the eligible Farmer's Producer Organizations (FPOs) in the State of Himachal Pradesh to make the farming a profitable venture through collectivization, the State Government has created a Krishi Kosh of Rupees 20 Crores as announced in annual Budget Speech 2020-21 by Hon'ble Chief Minister, Himachal Pradesh.

The Governor of Himachal Pradesh is, therefore, pleased to notify a new scheme of incentives, concessions and facilities for eligible Farmer's Producer Organizations (FPOs) of Himachal Pradesh. The new scheme will be implemented by the Department of Agriculture.

1. Short title.—This Scheme may be called "Mukhya Mantri Krishi Kosh Scheme for Farmer's Producer Organizations (FPOs)—2020".

2. Commencement and duration of the Scheme.—The Scheme will come into force from date of publication and shall remain in the official Gazette.

3. Definitions.—(i) "Bonafide Himachali" means a resident of the State of Himachal Pradesh as defined by the state Government from time to time;

(ii) "Department" means Department of Agriculture, The Government of Himachal Pradesh or any other Government Department, as specifically mentioned in this scheme;

(iii) "Director" means the Director of Agriculture, The Government of Himachal Pradesh;

(iv) "Eligible Farmer's Producer Organization" means Farmer's Producer Organizations (FPOs) promoted by the National Bank for Agriculture and Rural Development (NABARD), National Co-operative Development Corporation (NCDC), Small Farmers Agri- Consortium (SFAC), any other Government Agency, NGO or directly by the farmers, registered as Farmer's Producer Organization under the provisions of section 581 (C) of the Companies9226 राजपत्र, हिमाचल प्रदेश, 16 मार्च, 2021/25 फाल्गुन, 1942 Act, 1956, as amended by the Companies Act, 2013, registered as Farmers producer Company or under the provisions of the section 9 of Himachal Pradesh State Co-operative Societies Act, 1968, registered as Co-operative Society located within the State of Himachal Pradesh, having all Bonafide Himachalies as members, with a minimum strength of 100 share holder members and verified eligible by the Director of Agriculture or any other officer authorized by him to do so;

(v) "Financial Institution" means—

(a) Public Sector Banks

(b) All Regional Rural Banks

(c) Co-operative Banks

(d) Private Sector Scheduled Commercial Banks

(e) Small Industries Development Bank of India

(f) NABKISAN

(g) RBI approved Non Banking Finance Corporations;

(vi) "Government" means the Government of Himachal Pradesh;

(vii) "Plant and Machinery" means plant and machinery/equipment at site only. Further Explanatory note is at Annexure-I;

(viii) "State" means State of Himachal Pradesh;

(ix) "Technical Civil Works" means all expenditure on account of civil works that are related to production or grading or packing or processing (value addition) only and will not include compound wall, approach road, administrative office building, toilets, labour rest room, quarters for workers, sanitation room, security room or enclosure; and

(x) "Viable Project" means a project whose viability has been assessed and declared so by the notified team comprising of district level officer from Agriculture Department, concerned department, NABARD, Financial Institution, and any other officer as desired by the Project Implementation Agency (PIA) or any empanelled agency or institution by the PIA to assess and declare viability of any project;

4. Financial Support.—Following financial incentives can be availed by the eligible Farmer's Producer Organizations (FPOs) for a viable project from the Krishi Kosh:

(i) Seed Money (Loan from NABARD under AMIF).—Eligible FPOs can avail seed money up to 30% of the total project cost with a maximum ceiling of Rs 6.00 lakh or one and a half times of equity raised by the FPOs, whichever is less. The purchase of land /lease rentals towards land will not be reckoned towards project cost.

The seed money can be utilized for undertaking following activities:—

(a) Collection center (b) Grading and sorting center (c) Bulk milk chiller (d) Primary processing center9227 राजपत्र, हिमाचल प्रदेश, 16 मार्च, 2021/25 फाल्गुन, 1942 (e) Storage structure/cooling chamber (f) Milk Pasteurization unit

(g) Custom hiring centers to be operated by FPO

(h) Any other common infrastructure facility relevant for the functioning of FPO as decided by sanctioning authority.

(ii) Credit Guarantee Cover for Bank Loan.—Eligible FPOs can avail collateral free loan from any of the financial institution upto 50% of the total project cost with a maximum ceiling of loan amount of Rs 7.50 lakh by Finance Institution. The purchase of land / lease rentals towards land will not be reckoned towards project cost.

(iii) Interest subsidy.—Interest subsidy on loan (up to 50% of the project cost or Rs.7.50 lakh whichever is less) obtained from the financial institution will be admissible as under:—

(a) Interest subsidy @ 5% p.a. for first 3 years subject to timely repayments.

(b) Interest subsidy @ 3% p.a. for next 2 years subject to timely repayments.

(c) Repayment schedule may range between 5 to 7 years as may be prescribed by the concerned financial institution.

(d) No additional charges or fee will be charged by the financial institution for any early loan repayments done by the FPOs.

5. FPO's Contribution (Margin Money).—The FPOs will have to contribute a minimum of 20% of project cost (excluding the seed money) as margin money. The purchase of land / lease rentals towards land will not be reckoned towards margin money.

6. How to apply (Procedure for application for availing seed money).—(i) To avail Seed Money assistance, the eligible FPO shall first apply to the Financial Institution alongwith loan application as prescribed by the Financial Institution and Detailed Project Report (DPR) for appraisal and sanction of loan.

(ii) As the project gets appraised and sanctioned by the financial institution, the eligible FPO shall then apply to the concerned Deputy Director of Agriculture, in the prescribed form (Annexure - II) duly supported with revenue record i.e. Jamabandi and Tatima of land on which the technical civil works are to be done alongwith appraisal report and sanction letter issued by the Financial Institution. If the land is leased then a copy of lease deed is also to be attached.

(iii) The viable project proposals, where loan is not involved may be submitted directly to the Deputy Director of Agriculture alongwith above mentioned documents and an appraisal report from a financial institution or any agency appointed by the Director of Agriculture, Himachal Pradesh.

(iv) The FPO shall have to give an undertaking in the shape of an affidavit Annexure- III, that in the event of departure from the above undertakings, it will not be eligible for any financial incentive from the Krishi Kosh and shall be liable to refund the whole or part of the financial assistance availed, to the Department of Agriculture, Himachal Pradesh. The affidavit would be on a judicial paper and must be attested by the Notary.

7. How to apply (Procedure for application for availing credit guarantee).—(i) The financial institution shall apply to the Nodal Agency as per Annexure- IV, if it wants to be incorporated under credit guarantee scheme.

(ii) The financial institution shall apply to the Nodal agency as per Annexure-V for revocation as per credit guarantee scheme.

(iii) Credit guarantee can only be availed once and it shall be ensured that the project is not covered under any other credit guarantee scheme.

(iv) A guarantee fee as decided mutually by the Director of Agriculture & the agency holding the credit guarantee trust fund will be payable by the bank.

8. How to apply: (Procedure for application for availing interest subsidy).—(i) The financial institution shall apply to the Deputy Director of Agriculture as per Annexure-VI for claiming interest subsidy from the Krishi Kosh.

(ii) The FPO shall apply to the financial institution as per Annexure-VII for credit of interest subsidy.

9. Implementation.—Directorate of Agriculture shall be the Nodal Department–cum– Project Implementing Agency (PIA) for providing financial support to the eligible FPOs from the Krishi Kosh.

(ii) All line Departments such as Horticulture, Fisheries, Animal Husbandry, Rural Development, Industries etc. will appoint one Nodal Officer at the State and one Nodal Officer at the District Level for implementation of this Scheme.

(iii) National Bank for Agriculture and Rural Development (NABARD), Small Farmer's Agribusiness Consortium (SFAC), Non Governmental Organization (NGO) and any other Government agency such as State Rural Livelihood Mission (SRLM) promoting FPOs shall be the agency responsible for promotion of FPOs through their channel partners. These agencies shall utilize Central Government or their own funds for promotion of FPOs. These agencies can identify Producer Organization Promoting Institutions (POPIs) or Cluster Based Business Organizations (CBBOs) for promoting and funding various activities viz. Baseline Assessment, Registration, Development of Business and Development Plan, Training of CEO and BoDs of the FPOs.

(iv) The Deputy Director of Agriculture would scrutinize the proposal and prepare the agenda for meeting of the District Level Committee (DLC) headed by the Deputy Commissioner. The DLC will examine the proposals in detail and assess the feasibility/ viability of the project.

(v) If needed, the DLC may get the viability of the project proposals reassessed through a separate team comprising of district level officers from Agriculture Department, concerned department, NABARD, Financial Institution, and any other officer as desired by it (DLC) or through an empanelled agency/institution before issuing sanction for financial assistance.

(vi) After issuance of the administrative approval and financial sanctions the Deputy Director of Agriculture will ensure that the copy of the approved proposal is sent along with an authorization letter to the concerned FPO and the Financial Institution (if any).

(vii) Periodic inspections of the progress will be done by the Deputy Director of Agriculture and /or the Officer deployed by the DLC.

(viii) Project shall be completed within the planned and approved timeline mentioned in the DPR, otherwise extension should have to be sought from the DLC on valid grounds, failing which the FPO will be liable to refund the financial assistance obtained from the Krishi Kosh.

(ix) After the completion of the project, the FPO will submit the Project Completion Report to the Deputy Director of Agriculture within 30 days.

(x) Development of online web portal for marketing of produce will be done.

(xi) A robust monitoring mechanism with periodic evaluation will be done.

(xii) The Districts will maintain beneficiary FPO–wise record and will put the same on the departmental web site.

10. Disbursement of financial incentives— (i) Seed Money.—The seed money will be released in two equal installments as under:—

(a) 50% of seed money will be released on disbursement of loan by the financial institution and submission of claim in Annexure-VIII along with an account statement indicating disbursement of loan. In case of non loanee FPO, the first installment of seed money will be released after spending margin money of minimum 10 percent duly certified by Civil/Mechanical Engineer and Chartered Accountant Certificate.

(b) Balance 50% will be released after full loan is released/ work is completed up to 75%, whichever is earlier. The FPO will apply for second installment in the format given in Annexure-IX along with financial statement of full disbursement or Chartered Accountant Certificate.

(c) The project assistance shall be released through RTGS to the account of FPO. However, the financial institution will ensure third party payment to all contractors/ suppliers.

(d) The non loanee FPOs shall route all payments through banking channels by opening a project specific account in any of the banks mentioned under Section 3 (v) of these guidelines.

(ii) Interest Subsidy.—Financial institution will claim interest subsidy annually in the format prescribed as per Annexure-VI and the same will be released to it (financial institution) to adjust the same for repayment of loan.

11. Plant and machinery for which payment has been made in cash would not be eligible for consideration of any assistance from Krishi Kosh. Expenditure on second hand plant and machinery will not be allowed.

12. FPO can avail financial assistance for the same Project only from a single source, either from Central Government or from State Government. A FPO seeking financial assistance should self certify that it has not obtained or applied for financial assistance for the same9230 राजपत्र, हिमाचल प्रदेश, 16 मार्च, 2021/25 फाल्गुन, 1942 purpose or activity from any other Ministry or Department of the Government of India or the State Government. In case of fraud Section 13 of these guidelines will be applied.

13. If the State Government or the Financial Institution concerned is satisfied that the financial assistance by the FPO has been obtained by misrepresenting an essential fact, furnishing false information or if the FPO goes out of commercial production / operation within three years after commencement of commercial production the FPO would be liable to refund all the financial assistances obtained after giving an opportunity of being heard, failing which recovery will be made. Decision of the Secretary (Agriculture) to the Government of Himachal Pradesh will be final in this regard.

14. No FPO after receiving a part or the whole of the financial assistance will be allowed to change the location of the whole or any part of the unit or effect any substantial contraction or disposal of a substantial part of its total fixed capital investment within a period of 10 years after going into commercial production/ operation without taking prior approval of the Director of Agriculture, Himachal Pradesh.

15. After receiving financial assistance the FPO will submit Chartered Accountant report to the Director of Agriculture, regularly.

16. Power to amend and/or relax/repeal any provisions of the scheme:

(i) Notwithstanding anything contained in any of the provisions of this scheme, the State Government may at anytime,

(a) make any amendment to this scheme or repeal it;

(b) make any relaxation in applying the provisions of this scheme on merits of each case, as the State Government may consider necessary and appropriate;

(c) impose any condition in addition to the provisions of this Scheme on merits of each case, as the State Government may consider necessary and appropriate.

(ii) In case there is any issue of interpretation/implementation of this scheme, th Secretary (Agriculture) to the Government of Himachal Pradesh is authorized to resolve the issue. If, any dispute arises regarding interpretation of the scheme, the matter will be referred to the Secretary (Agriculture) to the Government of Himachal Pradesh, whose decision shall be final and binding on all. In any special case(s), the Government may set up a committee and refer any particular dispute to it for final decision.

(i) Cost of Industrial Plant & Machinery including taxes and duties i.e. cost of mother production equipment used for carrying out manufacturing activities.

(ii) Miscellaneous fixed assets such as DG sets, excavation, handling equipments, electrical components other than those mentioned at A (iii) above.

(iii) Working capital including raw material and other consumable stores.

(iv) Commissioning cost

(v) Captive power plants.

(vi) Erection and installation charges.

(vii) Additional transformers.

हरगाह खास व आम को बजरिया नोटिस सूचित किया जाता है कि श्रीमती कलावती पुत्री तिखु पुत्र मदन लाल, निवासी ग्राम शकरोड़ी, परगना बड़ाबल, तहसील सुन्नी, जिला शिमला (हि0 प्र0) ने इस न्यायालय में प्रार्थना-पत्र प्रस्तुत कर अभिव्यक्त किया है कि प्रार्थी का नाम राजस्व रिकार्ड में कलादेवी पुत्री तिखु दर्ज है जो कि गलत है परन्तु पंचायत रिकार्ड व अन्य प्रमाण-पत्र में प्रार्थी का नाम कलावती पुत्री तिखु दर्ज है जो कि सही व सत्य है। उन्होंने उसे ठीक करने के लिए प्रार्थना-पत्र प्रस्तुत किया है।

अतः इस प्रार्थना-पत्र बारे आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को प्रार्थी का नाम दुरुस्त करने में कोई आपत्ति हो तो वह अपनी आपत्ति लिखित रूप में दिनांक 05-04-2021 अथवा इससे पूर्व इस न्यायालय को प्रस्तुत करे। तदोपरान्त कोई आपत्ति मान्य नहीं होगी।
