No. NPT/(Trade Bye-laws)/- 1411.—In exercise of the powers conferred under Section 125,126,127,128 read with Sections 202 and 214 of the Himachal Pradesh Municipal Act, 1994, I, 243-राजपत्र/2021-17-03-2021 (9265)9266 राजपत्र, हिमाचल प्रदेश, 17 मार्च, 2021/26 फाल्गुन, 1942 Parkash Chand Sharma, Secretary, Nagar Panchayat Talai, Himachal Pradesh hereby notify the following Bye-laws:—

1. Short title, extent and commencement.—(i) These Bye-Laws may be called the Himachal Pradesh Municipality, (Grant of License for Use of Premises and Storage of Articles in Premises) Bye-Laws 2020.

(ii) These shall come into force from the date of their publication in the Official Gazette.

(iii) They Bye Laws shall apply to all shops/premises falling within the Municipal limits which may not be used without license for the purpose specified in Sections 125,126,127,128 read with Section 202 and 214 of the Himachal Pradesh Municipal Act, 1994 as per Annexure I and Annexure II for storage of any Article within the municipal limits.

2. Definitions.—in these Bye-Laws, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Act.1994, (Act No 12 of 1994).

(b) "Authorized Officer" means Secretary or any other Officer duly authorized by the Secretary.

(c) "Inspector" means Sanitary Inspector or any other Official of the Municipal Council/ Nagar Panchayat duly authorized by the Secretary.

(d) "License" means a written permission granted by the Secretary or any other official /Officer duly authorized by the Secretary in favour of the person, owner & occupier for sale/storage of articles specified in Annexure I & Annexure II of these Bye-laws.

(e) "Licensing Officer" means Secretary or any other officer duly authorized by the Secretary to grant/ renew License under the provisions of these Bye-Laws.

(f) "premises" means any shop/store/place where the articles specified in Annexure I & II are kept for sale/ storage in the godown/ premises.

(g) "Small Scale Business/ Trade" means premises covering maximum area of 100 sq. ft. " Medium Scale Business Trade" means premises covering area of 100 Sq. ft. to 500 sq. ft. and " large scale business/ trade" means premises covering area of more than 500.

(h) "Shopkeeper" means any person running and managing the affairs of the shop/premises/place including its owner/occupier.

(i) The words and expression not defined under these Bye-Laws shall have the same meaning or sense as are defined in Himachal Pradesh Municipal Act, 1994.

3. Procedure for obtaining License.—(a) Any person who wants to operate/ run any business/ trade as specified in Annexure I and/or store any article as specified in Annexure II within the areas of the Nagar Panchayat shall apply for license on prescribed Form A online to Secretary of the Nagar Panchayat Talai.

(b) Period of License:- (1) The License shall be issued for a period maximum upto fifteen years at a time and the License shall automatically come to an end after completion of such period.

4. Renewal of License.—(i) The License shall be renewed automatically after expiry of the period of the license on deposit of requisite/ prescribed license fee by the applicant. The license shall be renewed without any late fee and extra document within one month after expiry of license. The license shall be renewed with penalty of 50% of license fee within next one month and after that period the license shall not be renewed. In that case a fresh Trade License shall be required to be issued.

(ii) No document is required to be submitted for renewal of License.

5. Transfer of License.—(i) The License issued under the Bye-Laws shall not be transferred in the name of any person except in case of the death of original licensee wherein it shall be made/ transferred in the name of the legal heirs only for the validity period of license on production of supporting documents and shall be decided by Secretary keeping in view of the circumstances of the case.

(ii) The licensee shall provide online information to the Secretary for winding up of his business under such license;

6. License Fee.— (i) The license fee for grant of license shall be decided by the Secretary from time to time. However, the fee will be calculated on annual license fee rate multiplied by number of years the license is requested by the applicant. The fee shall be charged in the following manner:—

In the fairs fee shall be charged on following rates:—

(a) Small shop Rs. 25 per day

(b) Medium shop Rs. 50 per day

(c) Large shop Rs. 100 per day

Explanation:—A shop covering an area upto 6 square meters shall be deemed to be a small shop.

(ii) Fee structure for permission for shooting of films/ documentaries in MCs/ NPs.

7. Conditions for grant of license.—(i) The License shall not be valid for any other purpose, except for the items/ articles for which it is granted under these Bye Laws.

NP. limits, subject to such conditions as may be imposed by the Secretary.

(iii) The owner/occupier of the premises shall have to produce the license before the Inspector or the licensing officer at any point of time as may be ordered by them.

(iv) The Secretary shall have a right to impose or alter any of conditions in the license as may be deemed fit by the Secretary under the provisions of Section 214 of the Himachal Pradesh Municipal Act, 1994.

(v) The applicant shall submit a self declaration regarding information submitted by him/ her about the premises to be used for business/ trade viz type of business, area, approval of map and nature of property i.e. commercial and domestic etc. to be true to the best of his knowledge and belief.

(vi) The licensee shall maintain proper record of the articles kept for sale or storage in the premises as may be required by the Licensing Officer. Further the licensee shall comply with all the directions and instructions issued to him by the Secretary or the Licensing Officer from time to time.

(vii) The licensee will ensure timely payment of Municipal dues.

(viii) Time period for issue of License:—The license shall be issued as per the time lines notified/ specified for this service under Public Service Guarantee Act, 2011.

8. Denial of license.—(1) The license shall not be granted.—(a) to a person suffering from any loathsome infections or contagious diseases:

(b) to a person convicted for unlawful sale or storage of any articles mentioned in Sections 125,126,127,128 read with Sections 202 and 214 of the Himachal Pradesh Municipal Act, 1994,

(c) to a person who has been found to have habitually committed the breach of these Bye- Laws or the terms of the license.

(d) to a person not below the age of 18 years.

(2) (a) Subject to Bye-Laws 9 (1), license to any person, who applies online to the Secretary or Licensing Officer in this behalf and tenders the prescribed fee shall be granted by that officer, unless for reasons to be recorded in writing by him.

(b) The Licensee shall be liable to pay transfer charges @ 200/- per license at the time of effecting transfer of License.

(c) The licensee shall abide by the terms and conditions of the license and the license shall be displayed at the convenient/ conspicuous place/reception of the premises.

(d) The Inspector or inspecting staff concerned shall have a right to enter and inspect the premises and the licensee shall provide necessary assistance to the inspecting staff at the time of inspection of licensed premises.

(e) The licensee shall not make any encroachment/ overhanging projection on public streets and Municipal drains in any manner.

9. Offences and penalties.—(i) In addition to the penalty as provided under Himachal Pradesh Municipal Act, 1994 any person in possession of the premises found violating any of the provisions of these Bye-Laws shall in the first instance be liable for suspension of license for a period of one week and for repetition of the same violation within two years be liable for penalty of Rs. 1000/- only.

(ii) If the information submitted by the applicant under self declaration is found to be false, he/she shall be liable for the penalty of ten times of the license fee and his/ her license will be cancelled.

(iii) In case of repeated violation the concerned person, owner or occupier, as the case may be shall be liable for cancellation/withdrawal of License which can only be restored on receiving written undertaking accompanied by surety from the person violating these Byelaws subject to the satisfaction of the Secretary.

No. Home(A)B(1)-1/2018.—Whereas, the proposal of upgradation of Police Post Sainj as Police Station has been approved by the Cabinet on dated 19-01-2019;

And whereas, the Government of Himachal Pradesh vide letter No. Home(A)B(1)- 1/2018, dated 31-01-2019 had conveyed the approval to the Director General of Police for up gradation of Police Post Sainj to full-fledged Police Station in District Kullu;

And whereas, the Police Station Sainj has started functioning w.e.f. 13-02-2019 and FIRs have been registered in Police Station Sainj, District Kullu after 13-02-2019; and

No. HHC/Admn.6 (20)/77-XX.—It is hereby notified for general information that the High Court of Himachal Pradesh shall remain closed for the Winter Vacation from January 11, 2021 to February 20, 2021 and for Summer Vacation from June 07, 2021 to June 11, 2021. The High Court will resume its sitting from Monday the 22nd February, 2021 and Monday the 14th June, 2021, after observing winter and summer vacations/ holidays.

The Office of the High Court will remain open during the Winter as well as Summer Vacations & High Court Holidays i.e. 12th March, 12th April and 16th April, 2021 and will receive from parties and persons such petitions and other documents as they may choose to present. All petitions and applications falling under the civil jurisdiction of the Court, which are not of an urgent nature, will be listed after re-opening of the Court.

Urgent Criminal and Civil matters shall continue to be heard during the Vacations by the Vacation Judges.

Limitation will be regulated as per Section 4 of the Limitation Act, 1963 during the vacations / holidays.

भारत गणराज्य के बहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध (संशोधन) अधिनियम, 2021 है।

"परन्तु वित्तीय वर्ष 2019-20 में राजकोषीय घाटा 3 प्रतिशत स्तर से अधिक हो सकेगा किन्तु यह प्राक्कलित राज्य सकल घरेलू उत्पाद के 5 प्रतिशत से अधिक नहीं होगा;"।

उद्देश्यों और कारणों का कथन

वर्ष 2005 में हिमाचल प्रदेश राजकोषीय उारदायित्व और बजट प्रबन्ध अधिनियम अधिनियमित किया गया था। वर्ष 2019-20 के दौरान केन्द्रीय करों की वास्तविक प्राप्तियों में कमी आई है जिसके फलस्वरूप राज्यों का भाग (हिस्सा) भी प्रभावित हुआ। भारत सरकार ने 26 फरवरी, 2020 को केन्द्रीय करों के निम्नतर अवक्रमण के लिए राज्यों को क्षतिपूर्ति करने हेतु अतिरिक्त उधार लेने के लिए, राजकोषीय उत्तरदायित्व और बजट प्रबन्ध विधियों में संशोधन करने के अध्यधीन, एक बार विशेष व्यवस्था करना अनुज्ञात किया है। इसके अतिरिक्त हिमाचल प्रदेश राज्य को संघ सरकार से लोक लेखों में जमा क्षतिपूरक वनीकरण कोष प्रबन्धन एवम्‌ योजना प्राधिकरण (कैम्पा) के इसके भाग (हिस्से) की बाबत एक मुश्त प्राप्तियां प्राप्त हुई हैं जो राज्य के लोक ऋण में सम्मिलित हैं।

लोकहित और विकास की गति को बनाए रखने के लिए अतिरिक्त उधार लेने हेतु राज्य सरकार को समर्थ बनाने के लिए वित्तीय वर्ष 2019-20 में वित्तीय घाटा प्राक्कलित सकल राज्य घरेलू उत्पाद के 3 प्रतिशत के स्तर पर अनुरक्षित नहीं किया जा सका। इसलिए, हिमाचल प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध अधिनियम, 2005 को प्रथम जनवरी, 2020 से उपयुक्त रूप से संशोधित करना आवश्यक हो गया है।

यह विधयेक उपर्युक्त उद्देश्यों की पूर्ति के लिए है।

further to amend the Himachal Pradesh Fiscal Responsibility and Budget Management Act,

2005 (Act No. 14 of 2005).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-second Year of the Republic of India as follows:—

1. Short title and commencement.—(1) This Act may be called the Himachal Pradesh Fiscal Responsibility and Budget Management (Amendment) Act, 2021.

(2) It shall be deemed to have come into force with effect from the1st January, 2020.

2. Amendment of section 5.—In section 5 of the Himachal Pradesh Fiscal Responsibility and Budget Management Act, 2005, in sub-section (1), in clause (ii), in the end for the sign '';'', the sign '':'' shall be substituted and thereafter, the following proviso shall be inserted, namely:—

"Provided that the fiscal deficit may exceed the level of 3 per cent but shall not exceed 5 per cent of the estimated Gross State Domestic Product in the Financial Year 2019-20;".

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh Fiscal Responsibility and Budget Management Act was enacted in the year 2005. The actual receipts of Central taxes declined during 2019-20 due to which share of States also got affected. The Government of India has allowed one time special dispensation for additional borrowing to compensate States for lower devolution of Central taxes on 26th February, 2020 subject to amendment in the Fiscal Responsibility and Budget Management Laws. In addition, the State of Himachal Pradesh received one time receipts from the Union Government on account of its share of Compensatory Afforstation Fund Management and Planning Authority (CAMPA) Fund credited in the Public Account, which is included in the public debt of the State.

To enable the State Government to avail additional borrowing in public interest and to maintain the pace of development, the fiscal deficit could not be maintained at the level of 3 per cent of the estimated Gross State Domestic Product in the financial year 2019-20. Therefore, it has become necessary to amend the Himachal Pradesh Fiscal Responsibility and Budget Management Act, 2005 suitably from 1st January, 2020.

प्रार्थना-पत्र शादी पंजीकरण प्रार्थी श्री वनीत ठाकुर पुत्र मिलखी राम, वासी महाल वडवार, मौजा कलोहा, तहसील रक्कड़, जिला कांगड़ा (हि0प्र0) बाबत दिये जाने आदेश रजिस्ट्रेशन शादी ग्राम पंचायत पूनणी, तहसील रक्कड़, जिला कांगड़ा (हि0प्र0) ने इस अदालत में एक प्रार्थना-पत्र दायर किया है कि उनकी शादी हिन्दू रीति-रिवाज के अनुसार दिनांक 10-11-2019 को श्रीमती सपना ठाकुर पुत्री जरनैल पाल, गांव भनेड़, डाकघर स्यूल, तहसील डाडा सिवा, हाल पत्नी वनीत ठाकुर, वासी महाल वडवार, मौजा कलोहा, तहसील रक्कड़, जिला कांगड़ा (हि0 प्र0) से हुई है। परन्तु यह शादी सहवन गलती के कारण ग्राम पंचायत पूनणी के रजिस्टर में दर्ज न करवाई गई है, उन्होंने इस शादी को ग्राम पंचायत पूनणी में दर्ज करने के लिए अनुरोध किया है। प्रार्थी ने अपनी शादी की पुष्टि में आधार कार्ड प्रार्थीगण, शपथ-पत्र प्रार्थीगण, तलवाना, राशन, वकालतनामा, शपथ-पत्र गवाहान तथा अन्य दस्तावेज प्रार्थना-पत्र के साथ दायर करके आवेदन किया है।

अतः इशतहार राजपत्र हिमाचल प्रदेश मुश्त्री मुनादी व चस्पांगी के माध्यम से आम जनता तथा सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि अगर किसी को उपरोक्त विवाह पंजीकरण बारे कोई उजर व एतराज हो तो वह तारीख पेशी 08-04-2021 को सुबह 10.00 बजे इस न्यायालय में असालतन या वकालतन अपना एतराज अधोहस्ताक्षरी के न्यायालय में उपस्थित होकर पेश कर सकता है अन्यथा एकतरफा कार्यवाही अमल में लाई जाएगी। अतः उपरोक्त विवाह पंजीकरण करने के आदेश दे दिये जाएंगे। उसके उपरान्त कोई उजर/एतराज काबिले समायत न होगा।9301 राजपत्र, हिमाचल प्रदेश, 17 मार्च, 2021/26 फाल्गुन, 1942 आज दिनांक 02-03-2021 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ।
