अधिसूचना

तारीख 19 फरवरी, 2021

संख्याः पर्यटन-एफ (6)-3/2001-IV.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) की धारा 64 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश वायु क्रीड़ा नियम, 2004 को निरसित करने और नए नियम, अर्थात्‌ हिमाचल 12—राजपत्र/2021-20-04-2021 (335) 336 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 प्रदेश वायु क्रीड़ा (एअॅरो स्पोर्टस) नियम, 2021 बनाने का प्रस्ताव करते हैं और उन्हें जनसाधारण की सूचना के लिए एतद्‌द्वारा राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशित किया जाता है;

इन नियमों की बाबत किसी हितबद्ध व्यक्ति को कोई आक्षेप या सुझाव है/हैं तो वह उसे/उन्हें उक्त प्रारूप नियमों के राजपत्र (ई-गज़ट) हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर सचिव (पर्यटन एवं नागरिक उड्‌डयन) हिमाचल प्रदेश सरकार या निदेशक, पर्यटन एवं उड्‌डयन हिमाचल प्रदेश को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप या सुझाव, यदि कोई है/हैं, पर उक्त प्रारूप नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएग़ा, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश वायु क्रीड़ा (एअॅरो स्पोर्टस) नियम 2021 है।

(2) ये नियम राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृा होंगे। 2. परिभाषाएं.--इन नियमों में, जब तक कि कोई बात विषय या सन्दर्भ से विरूद्ध न हो,- (क) ''अधिनियम'' से, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) अभ्रिपेत है ;

(ख) ''एअॅर राफ्ट'' से, वायु वाहित प्रयोग के लिए प्रयोग किया जाने वाला (पैरा ग्लाइडर, हैंग ग्लाइडर, गर्म हवा का गुब्बारा आदि पैरामोटर) कोई उपकरण/विलक्षण यन्त्र अभ्रिपेत है;

(ग) ''संगम'' से, हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968 या हिमाचल प्रदेश सोसाइटी रजिस्ट्रीकरण अधिनियम, 2006 के अन्तर्गत रजिस्ट्रीकृत सोसाइटी अभ्रिपेत है;

(घ) ''कर्मीदल सदस्य'' से, ऐसा व्यक्ति अभिप्रेत है जो वायु क्रीड़ा प्रचालन संचालित करता है, जिसके अंतर्गत प्रचालनों के साथ में टेंडम विमान चालक है;

(ङ) ''हैंग ग्लाईडर'' से, ऐसा एअर राफ्ट अभिप्रेत है, जिसमें तिकोने पंख और कपड़े की एअॅरो फॉइल सहित अल्यूमिनियम विरचना और निवेशन (सन्निवेषण) हो;

(च) ''ऑपरेटर'' से साहसिक क्रीड़ा ऑपरेटर अभिप्रेत है, जो वाणिज्यिक आधार पर वायु क्रीड़ा को कार्यान्वित करने या उसमें लगा हुआ या उसमें लगने हेतु प्रस्थापना करता है अर्थात्‌ प्रशिक्षण, मनोविनोद या क्रीड़ा के प्रयोजन के लिए अधिनियम के अधीन इस रूप में रजिस्ट्रीकृत है;

(छ) ''प्रचालन'' से, इन नियमों के अधीन की जाने वाली या की गई वायु क्रीड़ा यात्रा अभिप्रेत है;

(ज) ''पैराग्लाइडर'' से, कोई एअॅर राफ्ट/ग्लाइडर अभिप्रेत है, जो किसी ठोस प्रबलन के बिना कपड़े की दो परतों के मध्य आर.ए.एम. (रैम) वायु दबाब से जो अपनी एअॅरो फॉइल संरचना प्राप्त करता है;

(झ) ''पैरामोटर'' एक पैराग्लाइडर या ढीली पन्नी के डिज़ाइन सहित, जो छोटे (सब) 350 सी.

सी. इंजन द्वारा ऊर्जायुक्त खुला पैरामोटर पंख है, यदि इसमें घूर्णन बल (टॉर्क) समाप्त करने वाली प्रोद्योगिकी न हो और इसे तिपहिया साइकिल (ट्राइक)/चतुस्कोण (क्वाँर) या पैदल चल कर प्रक्षेपित किया जा सकता है;

(ञ) ''सहभागी'' से, ऐसा व्यक्ति/ऐसे व्यक्ति अभिप्रेत है/हैं जो प्रचालन में भाग लेता है/लेते हैं;

(ट) ''विनियायक समिति'' से, राज्य सरकार द्वारा नियम 8 के अधीन गठित समिति अभिप्रेत है;

(ठ) "सीज़न (मौसम, ऋतु)'' से, इन नियमों के प्रयोजन के लिए वह अवधि होगी जो कि तकनीकी समिति द्वारा मौसम परिस्थितियों को ध्यान में रखते हुए निश्चित की जाएगी तथा समिति द्वारा वह समय-समय पर अधिसूचित की जाएगी, अभिप्रेत है;

(ड) ''स्थल'' से वायु क्रीड़ा क्रियाकलापों का संचालन करने के लिए तकनीकी समिति द्वारा अनुमोदित स्थान अभिप्रेत है;

(ढ) ''अकेला विमानचालक'' से, वह व्यक्ति अभिप्रेत है, जिसने अटल बिहारी वाजपेयी पर्वतारोहण और सहबद्ध खेल संस्थान मनाली से पैराग्लाइडिंग कोर्स किया है या जिसके पास किसी देश/संगम अर्थात्‌ (बी0एच0पी0ए0 (ब्रिटिश हैंग ग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन)/यू0एस0एच0जी0ए0 (यू0एस0 हैंग ग्लाइडिंग एण्ड पैराग्लाइडिंग ऐसोसिएशन)/ एफ0ए0आई0/ए0पी0पी0आई (फेडरल एअॅरोनॉटिकल इण्टरनेशनल/एसोसिएशन ऑफ पैराग्लाइडिंग पाइलेटस एण्ड इन्सट्रक्टरज)़, द्वारा मान्यता प्राप्त विधिमान्य अनुज्ञप्ति हो;

(ण) ''टेन्‌डम'' से, एक एअॅर राफ्ट पर दो लोग (एक विमानचालक और एक यात्री) से अंतर्वलित वायु क्रीड़ा क्रियाकलाप अभिप्रेत है;

(त) ''टेन्‌डम विमान चालक'' से, ऐसा व्यक्ति अभिप्रेत है जिसके पास इन नियमों के अधीन वायु क्रीड़ा के सुरक्षित प्रचालन करने के लिए ''रजिस्ट्रीकरण एवं अनुज्ञप्ति'' प्रमाण पत्र हो;

(थ) ''तकनीकी समिति'' से, राज्य सरकार द्वारा नियम 6 के अधीन गठित समिति अभिप्रेत है;

और

(द) ''विधिमान्य अनुज्ञप्ति'' से किसी देश/संगम अर्थात्‌ बी0 एच0 पी0 ए0 (ब्रिटिश हैंग ग्लाइडिंग एण्ड पैराग्लाइडिंग ऐसोसिएशन)/यू0 एस0 एच0 जी0 ए0 (यू0 एस0 हैंग ग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन)/एफ.ए.आई./ए.पी.पी.आई. (फेडरल एअरोनॉटिकल इण्टरनेशनल/ऐसोसिएशन ऑफ पैराग्लाइडिंग पॉयलेटस एण्ड इन्स्ट्रक्टरज़,) द्वारा जारी अनुज्ञप्ति अभिप्रेत है। जो कोई भी इस अनुज्ञप्ति को जारी करता है, उसके पास उपरोक्त निर्दिष्ट संस्थानों/संस्थाओं से किसी अनुदेशक/मास्टर अनुदेशक होने की अर्हता की अनुज्ञप्ति होनी चाहिए।

उन शब्दों और पदाें के, जो इन नियमों में प्रयुक्त हैं, किन्तु परिभाषित नहीं हैं, वही अर्थ होंगे जो अधिनियम में उनके हैं।

अध्याय-2

रजिस्ट्रीकरण

3. वायु क्रीड़ा प्रचालनों के लिए आवेदन प्रक्रिया.--(1) आगामी सीज़न के दौरान वायु क्रीड़ा प्रचालनों के लिए ऑपरेटरों से, आवेदन प्रत्येक वर्ष क्रमशः प्रथम नवम्बर से प्रथम मार्च और प्रथम जून से 16 अगस्त तक, यथास्थिति, जिला/सहायक पर्यटन विकास अधिकारी के कार्यालय में प्राप्त किए जाएंगे। यथास्थिति, सम्बद्ध जिला पर्यटन विकास अधिकारी या सहायक जिला पर्यटन विकास अधिकारी प्रारंभिकतः इन आवेदनों की संवीक्षा करेगा और इन्हें तकनीकी समिति को प्रस्तुत करेगा जो प्रत्येक वर्ष क्रमशः 15 अप्रैल और 15 सितम्बर से पूर्व बैठक आयोजित करेगी और दस्तावेजों, उपकरणों की संवीक्षा/ निरीक्षण करने के लिए और टेन्‌डम विमान चालकों की व्यावहारिक परीक्षाओं (दोनों मौखिक और उड़ान की) और समस्त ऑपरेटरों को कम से कम पन्द्रह दिन का स्पष्ट नोटिस देकर अंतिम अनुमोदन के लिए तारीख, समय, स्थान नियत करेगी। 338 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (2) किसी भी ऑपरेटर को सीज़न के बीच में वायु क्रीड़ा क्रियाकलापों का प्रचालन अनुज्ञात नहीं किया जाएगा। समस्त ऑपरेटर उप नियम (1) में यथा अधिकथित प्रक्रिया का अनुसरण करेंगे।

(3) यथास्थिति, ऑपरेटर या संगम जिसका/जिनका रजिस्ट्रीकरण से पूर्व स्थानीय कार्यालय है, को पर्यटन विभाग, हिमाचल प्रदेश के पास रजिस्ट्रीकृत किया जाएगा।

4. वायु क्रीड़ा के लिए ऑपरेटर का रजिस्ट्रीकरण और अर्हताएं.--(1) वायु क्रीड़ा का प्रचालन करने की वाँछा रखने वाला ऑपरेटर, यथास्थिति, सम्बद्ध जिला पर्यटन विकास अधिकारी या सहायक जिला पर्यटन विकास अधिकारी के पक्ष में 10,000/-रुपए (दस हजार रुपए) के बैंक मांगदेय ड्राफ्ट सहित, यथास्थिति, सम्बद्ध जिला पर्यटन विकास अधिकारी या सहायक जिला पर्यटन विकास अधिकारी को रजिस्ट्रीकरण के लिए आवेदन करेगा। यथास्थिति, जिला पर्यटन विकास अधिकारी या सहायक जिला पर्यटन विकास अधिकारी सम्बद्ध ऑपरेटर को तकनीकी समिति के अनुमोदन के पश्चात्‌ रजिस्ट्रीकरण का प्रमाण-पत्र जारी करेगा। (2) इस प्रकार जारी किया गया रजिस्ट्रीकरण प्रमाण-पत्र, जारी करने की तारीख से तीन वर्ष की अवधि के लिए विधिमान्य होगा।

(3) वायु क्रीड़ा प्रचालनों को कार्यान्वित करने के लिए रजिस्ट्रीकृत ऑपरेटर से अन्यथा किसी व्यक्ति को किसी प्रचालन का या तो प्रत्यक्षतः अथवा अपने कर्मचारियों के माध्यम से कार्यान्वित करना तब तक अनुज्ञात नहीं किया जाएगा जब तक कि तकनीकी समिति का यह समाधान नहीं हो जाता है कि ऑपरेटर के पास सभी उपकरण हैं और वह इन नियमों के अधीन अन्य अपेक्षाओं को पूर्ण करता है तथा उसका प्रस्ताव उक्त समिति द्वारा सम्यक्‌ रूप से अनुमोदित/मंजूर किया गया है।

(4) किसी भी ऑपरेटर को वायु क्रियाकलाप करवाने की अनुज्ञा तब तक नहीं दी जाएगी, जब तक कि उसके पास इन नियमों में यथा-विनिर्दिष्ट वायु क्रीड़ाओं में अच्छे ट्रेक रिकार्ड सहित, विमान चालक के नाम के साथ डिजिटल लॉग बुक के माध्यम से रिकार्डिड प्रशिक्षित और अर्हित टेन्‌डम विमान चालक न हो। (5) अतिरिक्त अर्हताएंः ऑपरेटर के पास निम्नलिखित अतिरिक्त अर्हताएं होनी चाहिए :-

(क) आवदेक भारतीय नागरिक होना चाहिए

(ख) आवेदक कम से कम दसवीं कक्षा उत्तीर्ण होना चाहिए

(ग) ऑपरेटर ने 21 वर्ष की आयु पूर्ण कर ली होनी चाहिए

(घ) ऑपरेटर सुनिश्चित करेगा कि टेन्‌डम विमान चालक ने प्रमुखतया प्रदर्शित की जाने वाली अनुज्ञप्ति संख्या सहित सम्बन्धित जिला एअॅरो क्लब/जिला पर्यटन विकास अधिकारी (डी. टी.डी.ओ.) द्वारा यथा अनुमोदित पोशाक पहन रखी है। तथापि पोशाक की बनावट संबंधित क्षेत्रों के जिला स्तरीय संगमों से परामर्श के पश्चात्‌ विनिश्चित की जाएगी।

(ङ) आवेदक को वायु क्रीड़ा की उच्च व्यावहारिक/तकनीकी जानकारी होनी चाहिए जिसका परीक्षण ऐसी परीक्षा के माध्यम से किया जा सकेगा जैसी तकनीकी समिति द्वारा अवधारित की जाए।

(च) ऑपरेटर के पास प्रस्तावित वायु क्रीड़ा क्रियाकलापों को कवर करने के लिए दस लाख रूपए का विधिमान्य तृतीय पक्षकार दायित्व बीमा, जिसके अन्तर्गत दोनों विमान चालक और प्रतिभागी का बचाव है।

5. पायलट/टैन्डम पायलट का रजिस्ट्रीकरण और अर्हताएं.--(1) सोलो पायलटों के रूप में विधिमान्य अनुज्ञप्ति रखने वाला कोई व्यक्ति जो वायु क्रीड़ा क्रियाकलापों में भाग लेने की वांछा रखता है,339 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 गतिविधि/क्रियाकलाप के लिए प्रस्तावित तारीख से कम से कम एक मास पूर्व अनुज्ञा के लिए यथास्थिति, सम्बद्ध जिला पर्यटन विकास अधिकारी या सहायक पर्यटन अधिकारी को अनुज्ञा के लिए आवेदन करेगा, जिसे तीन मास की अवधि के लिए जारी किया जाएगा।

(2) वायु क्रीड़ा प्रचालन में टैन्डम पायलट के रूप में भाग लेने के लिए आशयित कोई व्यक्ति, यथास्थिति, जिला पयर्टन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी के पक्ष में संदेय 2000/- रूपए के मांगदेय ड्राफ्ट सहित, यथास्थिति, जिला पर्यटन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी को आवेदन कर सकेगा, जो अपना समाधान होने पर कि रजिस्ट्रीकरण हेतु आवेदन करने वाला व्यक्ति रजिस्ट्रीकरण के लिए अपेक्षित अर्हताओं और स्तरमानों को पूर्ण करता है और तत्पश्चात्‌ तकनीकी समिति के अनुमोदन से तीन वर्ष की अवधि के लिए रजिस्ट्रीकरण प्रमाण पत्र जारी करेगा।

(3) टैन्‌डम पायलट की अतिरिक्त अर्हताः टैन्‌डम पायलट के पास निम्नलिखित अतिरिक्त अर्हताएं होनी चाहिएः-

(क) आवेदक भारतीय नागरिक होना चाहिए

(ख) टैन्‌डम पायलट कम से कम बारहवीं पास होना चाहिए

(ग) टैनडम पायलट ने 21 वर्ष की आयु पूर्ण कर ली होनी चाहिए।

(घ) पायलट के पास अटल बिहारी वाजपेयी पर्वतारोहण और सहबद्ध खेल संस्थान (ए.बी.वी.

आई.एम.ए.एस.) या किसी अन्य संगम अर्थात्‌ बी. एच. पी. ए. (ब्रिटिश हैंगग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन)/यू.एस.एच.जी.ए. (यू. एस. हैंगग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन),/एफ.ए.आई./ए.पी.पी.आई. (फेडेरल एअॅरोनॉटिकल इन्टेरनेशनल/ एसोसिएशन ऑफ पायलटस एण्ड इन्सट्रक्टरज,) से सोलो पायलट के रूप में कम से कम पी 4 स्तर का प्रशिक्षण और उसने 100 घंटे की सोलो उड़ान और कम से कम 35 किलोमीटर एक्स सी उड़ान अवश्य की हो।

(ङ) वाणिज्यिक उड़ान में परिवर्तन से पूर्व क्रीड़ा टैन्‌डम पायलट के रूप में 50 गैर-वाणिज्यिक उड़ानें।

(च) टैन्‌डम पायलट प्रथम उपचार/ हृदय फुफ्फुसश्वासी पुनरूज्जीवन (सी.पी. आर.) प्रमाणित होना चाहिए।

(छ) टैन्‌डम पायलट द्वारा प्रस्तुत रिकार्ड नाम सहित डिजीटल लॉगबुक सबूत के आधार पर होना चाहिए।

(ज) टैन्‌डम पायलट के पास क्रीड़ा की उच्च व्यावहारिक/तकनीकी जानकारी होनी चाहिए जिसका परीक्षण ऐसी परीक्षा के माध्यम से किया जा सकेगा जैसी तकनीकी समिति द्वारा अवधारित की जाए।

(झ) टैन्‌डम पायलट चिकित्सक दृष्टया उपयुक्त होना चाहिए (जो सरकारी रजिस्ट्रीकृत चिकित्सा संस्थान से वार्षिक चिकित्सा जाँच भी करवाएगा) और समुचित चिकित्सा प्रमाण पत्र और वायु क्रीड़ा क्रियाकलाप कवर करने के लिए उसका पाँच लाख रूपए का विधिमान्य बीमा हो।

(ञ) टैन्‌डम पायलट को टैन्‌डम अनुज्ञप्ति के लिए आवेदन करने से पूर्व एस. आई.वी. (फ्लाइटस के दौरान अनुकरण पैराग्लाइडिंग सुरक्षा कोर्स पूर्ण करना होगा। तथापि, पर्यटन विभाग के साथ पहले से ही रजिस्ट्रीकृत टैण्डम पायलटों को इन नियमों के प्रवृत्त होने की तारीख से दो वर्ष के भीतर एस.आई.वी. प्रशिक्षण पूर्ण करना होगा)। 340 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (ट) तकनीकी समिति, पायलटों के अर्हित करने के अधिकार को उनकी अन्तर्राष्ट्रीय अनुज्ञप्ति के आधार पर आरक्षित रखेगी, जिन्हें वो प्रमाणित कर सकेगी। केवल किसी देश/संगम (बी. एच.पी.ए. (ब्रिटिश हैंगग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन)/यू.एस.एच.जी.ए. (यू.एस. हैंगग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन)/एफ.ए.आई./ए.पी.पी.आई. (फेडरल एअरोनॉटिकल इनटरनेशनल)/एसोसिएशन ऑफ पैराग्लाइडिंग पायलटस एण्ड इन्स्ट्रक्टर,) द्वारा मान्यता प्राप्त अनुज्ञप्तियां विधिमान्य अनुज्ञप्ति के रूप में स्वीकार की जाएगी। (ठ) टैन्‌डम पायलट जो खण्ड (3), (ग, घ एवं ङ) में वर्णित तकनीकी अर्हता के साथ इस क्षेत्र में पहले से ही कार्यरत हैं और खण्ड (3) (ख) के अनुसार अपेक्षित अर्हताएं नहीं रखते हैं, उनके लिए शैक्षिक अर्हता की शर्त आवश्यक नहीं होगी।

(ड) टैन्‌डम पायलट किसी मान्यता प्राप्त राष्ट्रीय स्तरीय संगम/संस्थान द्वारा प्रमाणित होना चाहिए, जिसे तब ऐसी विधिमान्य रजिस्ट्रीकरण करवाने के लिए तकनीकी समिति के समक्ष पेश होना होगा।

6. तकनीकी समिति का गठन.--राज्य सरकार अधिसूचना द्वारा निम्नलिखित सदस्यों से मिलकर बनने वाली एक तकनीकी समिति का गठन करेगी, जिसकी अधिकारिता सम्पूर्ण हिमाचल प्रदेश राज्य पर होगी, अर्थात्‌ः--

1. आयुक्त एवं निदेशक, पर्यटन

अध्यक्ष;

2. निदेशक, अटल बिहारी वाजपेयी पर्वतारोहण और सहबद्ध उपाध्यक्ष; खेल संस्थान (ए.बी.वी.आई.एम.ए.एस.) मनाली।

3. राज्य वायु क्रीड़ा संगम का प्रतिनिधि सदस्य;

4. ए.बी.वी.आई.एम.ए.एस. का प्रतिनिधि, जो उड़ान का अनुदेशक है सदस्य;

5. सम्बद्ध जिला के लिए मुख्य चिकित्सा अधिकारी या उसका प्रतिनिधि सदस्य;

6. सरकार द्वारा जिला स्तरीय संगमों से नामनिर्दिष्ट तीन सदस्य सदस्य;

7. सम्बद्ध क्षेत्र का अरण्यपाल या उसका प्रतिनिधि सदस्य;

8. सरकार द्वारा नामनिर्दिष्ट कोई पांच रजिस्ट्रिीकृत पायलट सदस्य; और 9. सम्बद्ध जिला का जिला पर्यटन विकास अधिकारी/ सदस्य-सचिव। सहायक पर्यटन विकास अधिकारी।

7. तकनीकी समिति के —त्य.--तकनीकी समिति वर्ष में कम से कम दो बार अर्थात्‌ प्रतिवर्ष क्रमशः प्रत्येक वर्ष 15 अप्रैल और 15 सितम्बर से पूर्व बैठक करेगी। समिति निम्नलिखित कृत्यों का पालन करेगी, अर्थात्‌ः-

(क) नियम 3 के अनुसार सुरक्षा की दृष्टि से ऑपरेटर के साथ किसी अन्तर्राष्ट्रीय मान्यता प्राप्त प्रमाणन प्राधिकारी या अन्तर्राष्ट्रीय वैमानिक परिसंघ/ई.एन. (स्तरमानक के लिए यूरोपियन समिति)/एस.एच.वी. (स्वीस हैंगग्लाइडिंग एण्ड पैराग्लाइडिंग एसोसिएशन)/डी.एच.वी. (डियूचर हैंगग्लाइडर वरबन्द)/ए.एफ.एन.ओ.आर. (फ्रेंच एसोसिएशन ऑफ नार्मलाइजेशन) द्वारा विनिर्मित और पुष्टिकृत उपस्करों का निरीक्षण और प्रमाणन।341 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (ख) वायु क्रीड़ा में प्रयुक्त प्रत्येक एअॅर रा़फ्ट का उपस्कर के आयात का समुचित बिल होगा । सैकेंड हैंड एयर राफ्ट की दशा में मूल विनिर्माताओं द्वारा जारी इसके उड़ान-योग्य प्रमाणन, आयात की तारीख से छह मास से अधिक पुराना नहीं होगा।

(ग) पैरामोटर, मोटर, ट्राइक/क्वॉड अच्छी कम्पनी का होना चाहिए।

(घ) ऑपरेटरों/टैन्‌डम विमान चालकों के जीवन-वृत्त (बायोडेटा) की संवीक्षा करना। ऑपरेटर/ टैन्‌डम विमान चालक के रूप मेें रजिस्ट्रीकरण हेतु और ऑपरेटरों/टैन्‌डम विमान चालक को वाणिज्यिक अनुज्ञप्ति जारी करने हेतु उनकी विशेषज्ञता सुनिश्चित करने के आशय से उनके परीक्षण (मौखिक एवं उड़ान के) का संचालन करना। तकनीकी समिति निम्नलिखित का अवलोकन और परीक्षण करेगी :-

(i) वायु क्रीड़ा उड़ान अनुज्ञप्ति प्राप्त करने के लिए समस्त आवेदनों (नए आवेदनों सहित) और उनका ऩवीकरण।

(ii) पैराग्लाइडिंग विमान चालकों का बीमा और ऑपरेटर द्वारा विधिमान्य तृतीय पक्षकार दायित्व बीमा।

(iii) उड़ान-योग्य जांच निम्नलिखित उपस्कर पर पूर्ण की जाएगीः-

(क) पैराग्लाइडर (ग्लाइडरों की संरध्रता जांच और रेखाओं का विस्तार);

(ख) अन्य एअॅर राफ्टस;

(ग) हार्नेस-पायलट और यात्री;

(घ) आरक्षित पैराशूट;

(ङ) अन्तर्राष्ट्रीय मानकों के अनुसार अन्य मानक; और

(च) उक्त नियमों के नियम 9 के अनुसार सुरक्षा उपाय।

(iv) अन्य वायु क्रीड़ा उपस्करों का प्रमाणन।

(v) प्रत्येक आवेदन (डिजीटल लॉग बुक प्रस्तुत करना अपेक्षित है) के लिए नियत न्यूनतम अर्हता मानदण्ड के अनुसार प्रत्येक वाणिज्यिक टैन्‌डम विमान चालक को वायु क्रीड़ा की उड़ान का ज्ञान, सुरक्षा और बचाव कौशल और प्राथमिक उपचार ज्ञान इत्यादि।

(vi) आपातकाल, दुर्घटना इत्यादि की दशा में कि राज्य को बचाव/चिकित्सा व्यय आदि पर उपगत की गई किसी लागत से निर्मुक्त करने के लिए क्षतिपूर्ति बंधपत्र कि ऑपरेटर, टैन्‌डम विमानचालक, सोलो विमानचालक या भागीदार की मृत्यु, गम्भीर और लघु (गौण) क्षति की दशा में भी राज्य उन्हें कोई प्रतिकार देने को दायी नहीं होगा; और

(vii) प्रचालनों की लॉग बुक और ऑपरेटर का कार्यालय।

(ङ) यह सुनिश्चित करना कि ऑपरेटर/टैन्‌डम विमानचालक इन नियमों में विनिर्दिष्ट समस्त सुरक्षा प्रक्रियाओं का अनुसरण करेगा/करेंगे।

(च) तकनीकी समिति प्रत्येक उड़ान स्थलों के लिए वहन क्षमता का अवधारण करेगी। इसके अतिरिक्त, समिति नियम 15 में पहले से वर्णित के अतिरिक्त राज्य में वायु क्रीड़ा के लिए नए स्थलों और क्षेत्रों को परिलक्षित करेगी। 342 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (छ) उड़ान भरने और उतरने के स्थलों सहित सही सीमाएं परिलक्षित करना, जहां प्रचालन सुरक्षित रूप से संचालित किया जा सकता हो।

(ज) विद्यमान दशाओं पर निर्भर करते हुए, किसी स्थल पर प्रचालन को परिवर्तित या रद्‌द करने का अधिकार तकनीकी समिति में निहित होगा।

(झ) ऐसे उत्तरदायित्वों का पालन करना जो आयुक्त एवं निदेशक पर्यटन/राज्य सरकार द्वारा समय-समय पर इसे समनुदेशित किए जाएं।

(ञ) अध्यक्ष या उपाध्यक्ष के साथ उपरोक्त तकनीकी समिति के कम से कम दस सदस्य की उपस्थिति से बैठक की गणपूर्ति होगी। अध्यक्ष अपनी अनुपस्थिति में उपाध्यक्ष को बैठक आयोजित करने के प्राधिकार का प्रत्यायोजन कर सकेगा और सदस्य सचिव का तकनीकी समिति की बैठक को बुलाने का उत्तरदायित्व होगा।

8. विनियामक समिति की स्थापना और इसके —त्य.--(1) राज्य सरकार अधिसूचना द्वारा प्रत्येक वायु क्रीड़ा स्थल के लिए विनियामक समिति गठित करेगी, जिसमें निम्नलिखित सदस्य होंगेः-

(क) सम्बद्ध जिला का उपायुक्त।

अध्यक्ष;

(ख) निदेशक, अटल बिहारी वाजपेयी पर्वतारोहण और उपाध्यक्ष; सहबद्ध खेल संस्थान, मनाली (एबीवीआईएमएएस)।

(ग) सम्बद्ध जिला का पुलिस अधीक्षक या उसका नामनिर्देशिति सदस्य;

(घ) सम्बद्ध उपमण्डल का उपमण्डल अधिकारी, सिविल सदस्य; (नागरिक) या उसका नामनिर्देशिति।

(ङ) सम्बद्ध जिला का खण्ड चिकित्सा अधिकारी या उसका नामनिर्देशिति सदस्य;

(च) सम्बद्ध क्षेत्र का वन मण्डल अधिकारी या उसका प्रतिनिधि सदस्य;

(छ) सम्बद्ध क्षेत्र के जिला वायु क्रीड़ा (एयरोस्पोर्टस) संगम/ सदस्य; और रजिस्ट्री—त वायु क्रीड़ा संगम का प्रतिनिधि।

(ज) सम्बद्ध जिला का जिला पर्यटन विकास अधिकारी/सहायक सदस्य-सचिव। पर्यटन विकास अधिकारी

(2) विनियामक समिति का संगम की सहायता से क्षेत्र में होने वाले प्रचालनों को विनियामित करने हेतु सम्पूर्ण नियन्त्रण होगा।

(3) विनियामक समिति, ऑपरेटर/टेन्डम विमान चालक के विरूद्ध दुव्र्यवहार या कदाचार की शिकायतों की इस प्रयोजन के लिए अध्यक्ष द्वारा गठित तीन सदस्यीय उप-समिति के माध्यम से जांच भी करेगी।

(4) विनियामक समिति, ऑपरेटर द्वारा प्रतिभागियों से प्रभारित की जाने वाली दरों के सम्बन्ध में भी विनिश्चय करेगी, जिन्हें वार्षिक आधार पर पुनरीक्षित किया जा सकेगा।

(5) विनियामक समिति प्रचालन के दौरान यह अभिनिश्चित करने के लिए कि ये नियम समुचित रूप से कार्यान्वित किए जा रहे हैं, आकस्मिक निरीक्षण कर सकेगी।

(6) विनियामक समिति प्रचालित दशाओं (स्थितियों) पर निर्भर करते हुए, किसी भी स्थल पर वायु क्रीड़ा (एअरो स्पोर्टस) के प्रचालन को परिवर्तित करने या रद्‌द करने के लिए तकनीकी समिति को सिफारिश कर सकेगी।343 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (7) विनियामक समिति को सरकार द्वारा वायु क्रीड़ाओं के प्रचालन से सम्बन्धित कोई अन्य कृत्य सौंपा जा सकेगा।

(8) बैठक की गणपूर्ति उपरोक्त विनियामक समिति के अध्यक्ष या उपाध्यक्ष सहित न्यूनतम चार सदस्यों की उपस्थिति से होगी। अध्यक्ष, अपनी अनुपस्थिति में बैठक आयोजित करने हेतु अपना प्राधिकार उपाध्यक्ष को प्रत्यायोजित कर सकेगा और सदस्य-सचिव का यह उत्तरदायित्व होगा कि वह एक वर्ष में कम से कम दो बार विनियामक समिति की बैठकें बुलाए।

अध्याय-3

सुरक्षा उपाय

9. प्रचालन के कार्यान्वयन के लिए अपेक्षित उपस्कर.--प्रत्येक ऑपरेटर को, प्रचालन कार्यान्वित करने को अनुमत करने से पूर्व निम्नलिखित उपस्करों की व्यवस्था करनी होगी। निरीक्षण के समय, तकनीकी समिति प्रत्येक उपस्कर की जांच करेगी और उसे पर्यटन विभाग, हिमाचल प्रदेश के माध्यम से स्टांपित करवाएगी; अर्थातः-

(1) अन्तर्राष्ट्रीय पुष्टिकृत डिजाइन के उड़ान उपस्कर (पैराग्लाइडर/एअर राफ्ट);

(2) दस्ताने (ग्लब्ज), एंकल शूज़, प्रथम उपचार पेटिका एवं रिपेअर किट;

(3) सुरक्षा पैराशूट, हैल्मेट, सीढ़ी-50 मीटर, 8 एम एम के व्यास वाली नायलॉन की रस्सी, कार्बाइनर्ज़-प्रत्येक ग्लाइडर के लिए दो, पुल्ली एवं मास्क सहित ऑक्सीजन सिलिण्ड़र;

(4) द्विपथ (टू वे) रेडियो संचार उपस्कर, उपकरण पेनल (अल्टोमीटर/ वेंरियोमीटर/कम्पास/एअर स्पीड इन्डीकेटर) और ग्लोबल पोजीशनिंग सिस्टम (सोलो एकल) विमान चालकों के लिए;

(5) प्रत्येक स्थल हेतु केन्द्र में अवस्थित ग्राउंड सपोर्ट और रिट्रीवल यान;

(6) समस्त उपस्करों, स्वयं/कर्मीदल/यात्रियों/वायु क्रीड़ाओं में भाग लेने वाले अन्य व्यक्तियों के लिए बीमा (दस लाख व्यापक);

(7) तकनीकी समिति के दिशा निर्देशों के अनुसार अन्य उपस्कर;

(8) ऑपरेटर को यह भी सुनिश्चित करना चाहिए कि उपस्करों और उनके रख-रखाव की लॉगबुक हर समय रखी गयी है, जिसमें समस्त उड़ान क्रियाकलाप, मरम्मत और उपांतरण (यदि कोई गम्भीर उपांतरण किए गए हैं, तो उनके पुनः समुचित घण्टों के परीक्षण से गुजरना अपेक्षित होगा। इन घण्टों को उपान्तरण प्रविष्टि के साथ-साथ उस हेतु कारणों सहित नियत और घोषित किया जाना है) के ब्योरे अंतविर्ष्ट होंगे; और

(9) समस्त प्रमुख भागों के संस्तुत सेवा अन्तराल/अनुरक्षण सारणी को उनकी अनुसूची के अनुसार कार्यान्वित किया जाना है।

10. प्रचालन के दौरान उपलब्ध चिकित्सा सुविधाएं और अन्य सुविधाएं.--(1) ऑपरेटर प्रत्येक प्रचालन के दौरान अपने साथ स्थल पर ट्राइंगुलर बैंडेज़िज, स्टराइल पैडज़, गॉज रोलर बैंडेजिज़, प्रैशर बैंडेज़िज, प्रथम उपचार एडहेसिव टेप, स्पलिंट्‌स, कैंचियां (सिजर्ज़) कम से कम स्टे्‌्रचर के साथ और प्रत्येक उड़ान स्थल में उड़ान भरने तथा उतरने पर स्पाइनल बोर्ड से अन्तर्विष्ट दो सुसज्जित प्रथम उपचार पेटिकाएं (फस्र्ट एड किट) या तकनीकी समिति द्वारा यथाविनिर्दिष्ट अन्य चिकित्सीय उपस्कर ले जाएगा। 344 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (2) प्रत्येक ऑपरेटर किसी अस्पताल के साथ समन्वय भी रखेगा तथा आपातकालीन मामलों की देखभाल के लिए समीप के उपलब्ध चिकित्सक और अस्पताल की सूचना रखेगा।

(3) प्रत्येक उड़ान (उड़ान भरने और उतरने) स्थल पर आपातकालीन निकासी के लिए एम्बुलेंस की सुविधा होगी।

11. ऑपरेटरों के लिए सुरक्षा उपाय.--किसी ऑपरेटर को किसी प्रचालन को प्रचालित करने की तब तक अनुज्ञा नहीं दी जाएगी, जब तक किः-

(1) ऑपरेटर के पास प्रतिभागियों के मार्गदर्शन के लिए कम से कम दो अर्हित वायु क्रीड़ा टेन्डम विमानचालक न हों। वायुयान का प्रचालन करने वाले व्यक्तियों के पास इन नियमों के अधीन विहित अपेक्षित अर्हताएं और अनुभव अवश्य होना चाहिए। प्रत्येक टेन्डम विमानचालक के पास सुरक्षा के लिए उसी तरह के उपस्कर होने चाहिए, जैसे प्रतिभागियों के लिए अपेक्षित हैं;

(2) ऑपरेटर के पास विधिमान्य अनुज्ञप्ति (अर्हता के अनुसार) वाले टेन्डम विमानचालक होने चाहिए, जो वायु क्रीड़ाओं और बचाव तकनीक में सुप्रशिक्षित हों;

(3) टेन्डम विमानचालकों के पास स्थल को प्रभावित करने वाली सूक्ष्म मौसम विज्ञान (माइक्रो मिटिरियोलॉजी) का पूर्ण ज्ञान होना चाहिए। वे प्राथमिक उपचार/कार्डियो पलमोनरी सिससिटेंशन (सी.पी.आर.) में भी अर्हित हो और उन्होंने सरकारी अस्पताल या किसी मान्यता प्राप्त संस्थान से प्राथमिक उपचार में बुनियादी पाठ्‌यक्रम (बेसिक कोर्स) सफलता-पूर्वक पूर्ण किया हो;

(4) ऑपरेटर द्वारा रखे गए टेन्डम विमानचालक तकनीकी समिति द्वारा वर्गीकृत किए गए हों;

(5) उड़ान भरने वाले टेनडम विमानचालक उड़ान के साथ-साथ प्रदर्शन, दोनों, के दौरान हर समय हेलमेट सहित सेफ्टी गियर के साथ सुसज्जित होंगे।

(6) ऑपरेटर, तकनीकी समिति द्वारा वायु क्रीड़ाओं के लिए संस्तुत किए गए अपस्करों और उपसाधनों की सूची प्रदर्शित करेंगे तथा इन्हें हर समय क्रमशः स्थल पर और टेन्डम विमानचालकों को उपलब्ध करवाएंगे;

(7) ऑपरेटर यह सुनिश्चित करेगा कि प्रत्येक यात्रा (ट्रिप) के प्रारम्भ होने से पूर्व प्रतिभागियों को यात्रा के दौरान सुरक्षा ब्यौरे/विवरण दे दिए गए हैं;

(8) ऑपरेटर यह सुनिश्चित करेगा कि समस्त प्रतिभागी उपयुक्त पोषाक में है और भारी वस्त्रों, साड़ियों, कण्ठबन्धों (नेक टाईज़), लम्बी स्कर्टों और थ्री पीस सूटों का उपयोग नहीं किया जाता है तथा वे हेलमेट सहित समुचित सुरक्षा गियर पहनते हैं।

(9) ऑपरेटर को अनिवार्यतः यह भी सुनिश्चित करना होगा कि वायु क्रीड़ा क्रियाकलाप खराब मौसम में कार्यान्वित नहीं किया जाता है;

(10) विनियामक समिति संगम के परामर्श से पाक्षिक आधार पर कर्त्तव्यारूढ़ ऑपरेटर को उपदर्शित करते हुए एक रोस्टर अधिसूचित करेगी और कर्त्तव्यारूढ़ ऑपरेटर स्थल पर उस पाक्षिक (पक्ष) के लिए सुरक्षा मानकों के कड़े पालन को सुनिश्चित करेगा;

(11) प्रत्येक वायु राफ्ट की लॉगबुक में रीति, निरीक्षण, की गई मरम्मत और सुरक्षा उपायों का अभिलेख अन्तर्विष्ट होगा, जिसे स्थानीय वायु क्रीड़ा संगम के कर्त्तव्यारूढ़ सदस्य द्वारा पाक्षिक आधार पर हस्ताक्षरित किया जाएगा। लॉगबुक को भी यात्रा की तारीख को निरीक्षण प्राधिकारी द्वारा प्रतिहस्ताक्षरित किया जाएगा, जिस पर यह अपनी टिप्पणियां अभिलिखित करेगा;

(12) ऑपरेटर उड़ान स्थल पर उपयोग में लाए गए समस्त वायु राफ्टों की क्षमता को प्रदर्शित करेगा और उन्हें प्रयोक्ताओं को इस चेतावनी के साथ दृश्यमान बनाएगा कि ''क्षमता से अधिक व्यक्तियों का वहन खत़रनाक होगा";

(13) जहां सरकार ने हिमाचल प्रदेश में फीस/किराए के आधार पर प्रचालन स्थलों का विकास और आंबटन किया है, वहां उसकी आय स्थानीय संगम को प्रोद्‌भूत होगी; और

(14) ऑपरेटर, नियम 9 (6) के अनुसार वायु क्रीड़ाओं में भाग लेने वाले स्वयं का/कर्मीदल/ यात्रियों/अन्य व्यक्तियों का बीमा सुनिश्चित करवाएगा।

12. ऑपरेटर के कर्त्तव्य.--(1) ऑपरेटर समस्त घटनाओं/दुर्घटनाओं की संगम/जिला प्रशासन/तकनीकी समिति के अध्यक्ष को तुरन्त रिपोर्ट करेगा।

(2) ऑपरेटर यह सुनिश्चित करेगा कि वायु क्रीड़ा प्रचालन सूर्यास्त से एक घण्टा पूर्व या छः बजे अपराह्‌न, जो भी पूर्वत्तर हो, तक समाप्त हो जाए (वी.एफ.आर. और वी.एम.सी. के अनुरूप उड़ाए जाएं);

(3) समस्त ऑपरेटर/अनुज्ञप्तिधारी को अनिवार्यतः यह भी सुनिश्चित करना होगा कि वायु क्रीड़ा क्रियाकलाप खराब मौसम में कार्यान्वित न किए जाएं।

(4) प्रशिक्षु विमानचालकों को प्रशिक्षण अवधि के दौरान अकेले प्रचालन क्रियान्वित करने की अनुज्ञा नहीं दी जाएगी।

(5) सीज़न के लिए प्रचालन आरम्भ करने से पूर्व ऑपरेटर अपने-अपने उप-मण्डलाधिकारी (सिविल)/सम्बद्ध पुलिस थाना/जिला पर्यटन विकास अधिकारी/सहायक पर्यटन विकास अधिकारी को सीज़न के लिए कार्यावधि, समय-सारणी और प्रचालन के स्वरूप के सम्बन्ध में सूचित करेगा।

(6) ऑपरेटर पर्यावरण को स्वच्छ रखेगा। यदि कोई ऑपरेटर या प्रतिभागी, पर्यावरण मार्गदर्शी सिद्धान्तों का पालन न करता हुआ पाया जाता है, तो उसकी अनुज्ञा को निलम्बित कर दिया जाएगा। (7) ऑपरेटर, आगन्तुकों और प्रतिभागियों की जानकारी के लिए स्थल और एॅअर राफ्ट पर लेमिनेटिड अनुज्ञप्ति/अनुज्ञा और सुरक्षा मार्गदर्शकों को उपदर्शित करेगा। उसे किसी प्राधिकारी के मांगने पर उन्हें प्रस्तुत करना होगा।

(8) पर्यटन विभाग/वन विभाग/जिला प्रशासन का कोई प्राधिकृत अधिकारी उड़ान स्थल और वायु क्रीड़ा के लिए प्रयुक्त कैम्प स्थल का निरीक्षण कर सकेगा; और

(9) ऑपरेटर वाणिज्यिक प्रचालनों को प्रारम्भ करने से पूर्व वायु क्रीड़ा के पर्यटकों या प्रतिभागियों से समय-समय पर प्रभारित की जाने वाली दरों के बारे में, यथास्थिति, सम्बद्ध जिला पर्यटन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी का अनुमोदन प्राप्त करेगा। यथास्थिति, ऑपरेटर/संगम द्वारा सभी स्थलों पर दरें जहाँ पर्यटक उन्हें पढ़ सकें, प्रमुखतया प्रदर्शित की जाएंगी।

13. किसी दुर्घटना के कारण दावा.--हिमाचल प्रदेश राज्य सरकार या पर्यटन विभाग का, वायु क्रीड़ा क्रियाकलाप के दौरान किसी दुर्घटना के कारण किसी दावे के लिए प्रतिनिधिक दायित्व नहीं होगा। 14. ऑपरेटर के लिए अन्य सुरक्षा उपाय.--ऑपरेटर सुनिश्चिित करेगा किः-

(1) 12 वर्ष से नीचे या 30 किलोग्राम से कम के बच्चे को वायु क्रीड़ा में भाग लेने की अनुज्ञा नहीं दी जाएगीः

(2) सभी प्रतिभागियों और कर्मी दल सदस्यों को पूर्ण सुरक्षा गीयर (साज सामान) की व्यवस्था की जाएगी;

346 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (3) प्रतिभागियों के साथ कोई भी एयरोबेटिक पैंतरेबाजियां नहीं की जाएगी;

(4) उपकरणों की अतिभराई (ओवरलोडिंग) या न्यनू भराई (अंडरलोडिंग) नहीं होगी;

(5) प्रत्येक प्रचालन के प्रारम्भ पर सभी प्रतिभागियों को पूर्ण सुरक्षा हेतु संक्षिप्त विवरण देना आज्ञापक बनाया जाएगा;

(6) हृदय व्याधियों, मिरगी, फेफड़ा विकार, दमा से ग्रस्त व्यक्तियों और गर्भवती महिलाओं को प्रचालन में भाग लेने के लिए अनुज्ञा नहीं दी जाएगी;

(7) किसी भी विदेशी विमानचालक को तब तक ऐसे किसी प्रचालन में भाग लेने की अनुज्ञा नहीं दी जाएगी जब तक कि उसके पास पर्याप्त अनुभव और उपस्कर न हों और जिला पर्यटन विकास अधिकारी/सहायक पर्यटन विकास अधिकारी द्वारा ऐसा करने के लिए मंजूर न किया गया हो और वह किसी ऑपरेटर के अधीन प्रचालन न करता हो। (8) प्रत्येक प्रतिभागी प्रचालन आरम्भ होने से पूर्व, उपाबंध ''क'' पर एक बचनबंध (अन्डरटेकिंग) देगा;

(9) ऑपरेटर का यह उत्तरदायित्व होगा कि प्रतिभागी इन नियमों में अधिकथित मानकों का कड़ाई से अनुसरण करें;

(10) किसी व्यक्ति, जिसने प्रचालन से कम से कम 8 घण्टे पूर्व किसी भी रूप में या मात्रा में मद्यपान या अवैध मादक द्रव्य का प्रयोग किया हो, को प्रचालन में भाग लेने की अनुमति नहीं दी जाएगी; और यदि वह ऐसा करते हुए पाया जाता है तो ऑपरेटर और विमान चालक की अनुज्ञप्ति रद्‌द की जाएगी।

अध्याय-4

प्रकीर्ण

15. वायु क्रीड़ा के लिए क्षेत्र.--वायु क्रीड़ा क्रियाकलाप तकनीकी समिति द्वारा परिलक्षित और निदेशक पर्यटन द्वारा समय-समय पर अधिसूचित स्थलों तक ही सीमित होंगे।

16. रेपिड ग्रेडिंग का वर्गीकरण.--तकनीकी समिति वायु क्रीड़ा के प्रयोजन के लिए परिलक्षित, यथास्थिति, सभी स्थलों या लॉनचिज का निम्नलिखित रीति में श्रेणीकरण करेगी, अर्थात्‌ः-

(क) वर्ग 1 : मूल स्तर;

(ख) वर्ग 2ः मध्यवर्ती स्तर; और

(ग) वर्ग 3 : ऐडवांस एण्ड क्रास कन्ट्री स्तर लानचिज

17. रजिस्ट्रीकरण फीस और प्रयोक्ता (यूजर) फीस का संग्रहण.--ऑपरेटर प्रचालन आरम्भ करने से पूर्व, सरकार को नकद या मांगदेय ड्राफ्ट द्वारा जो, यथास्थिति, जिला पर्यटन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी के पक्ष में आहरणीय हो, निम्नलिखित फीस संदत्त करेगाः-347 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 1. प्रयोक्ता (यूजर) फीस प्रति वायु राफ्ट 1,500/- रुपए प्रतिवर्ष और प्रति गाइड 500/- रुपए प्रतिवर्ष; प्रयोक्ता (यूजर) फीस और रजिस्ट्रीकरण फीस विनियायक समिति द्वारा समय - समय पर विनिश्चित की जाएगी।

2. अतिरिक्त फीस, ऐसी दर पर जैसी जिला पर्यटन विकास अधिकारी द्वारा संगम के परामर्श से, अवधारित की जाए, प्रभारित की जाएगी, यदि उड़ान भरने और उतरने के स्थानों पर अन्य सुविधाएं सरकारी निधियों से सृजित की गई हैं;

3. उपर्युक्त स्त्रोतों से संगृहीत निधियां जिला वायु क्लब(संगम) के बैंक लेखे में जमा की जाएगी, जिसका प्रचालन संगम और जिला पर्यटन विकास अधिकारी द्वारा संयुक्त रूप में किया जाएगा; और

4. निधियों का प्रयोग केवल वायु क्रीड़ा के उन्नयन, मरम्मत और वायु क्रीड़ा से सम्बद्ध सामान्य सुविधाओं के अनुरक्षण के लिए किया जाएगा।

18. जिला वायु क्रीड़ा क्लब/संगमों का गठन.--राज्य सरकार, राज्य में प्रत्येक जिले के लिए वायु क्रीड़ा के प्रयोजन के लिए जिला पर्यटन विकास अधिकारी की अध्यक्षता के अधीन स्थानीय अर्हित पायलटों/रजिस्ट्रीकृत आपरेटरों में से कम से कम 06 सदस्यों से मिलकर बनने वाला जिला वायु क्रीड़ा क्लब (डी0ए0सी0) के नाम से ज्ञात संगम बनाएगी, जिसमें ऊपर वर्णित सदस्यों के अतिरिक्त कम से कम दो, सरकार के नाम निर्देशित सदस्य (सम्बद्ध क्षेत्र का तहसीलदार और वन परिक्षेत्र अधिकारी) भी सम्मिलित किए जाएंगे।

19. जिला वायु क्रीड़ा क्लब के —त्य.--(1) जिला वायु क्लब, वायु क्रीड़ा के सुरक्षित और सुविधाजनक संचालन को सुनिश्चित करेगा।

(2) जिला वायु क्लब, ऑपरेटर के मांगने पर सहायता दे सकेगा।

(3) जिला वायु क्लब प्रचालन के प्रतिभागियों और कर्मीदल सदस्यों के शिविरों, आवास और भोजन व्यवस्था का प्रबन्ध कर सकेगा।

(4) जिला वायु क्लब प्रचालन का संचालन अपने आप कर सकेगा।

(5) जिला वायु क्लब सरकार द्वारा इसे समनुदेशित किन्हीं अन्य कृत्यों का संचालन करेगा। 20. संगम की अनुशासनात्मक समिति.--(1) जिला वायु क्लब, स्थल पर वायु क्रीड़ा की सुरक्षा और स्वच्छता पहलुओं को विनियमित करने के लिए हिमाचल प्रदेश में राज्य स्तरीय संगम द्वारा अपनाए गए मार्गदर्शनों के अनुसार अनुशासनात्मक समिति बनाएगा जिसमें तीन से पांच तक सदस्य होंगे।

(2) राज्य में देश के भीतर से या विदेश से आए अतिथि विमानचालक, उपस्कर और उड़ान योजना को उसके ठहराव के दौरान के लिए घोषित करते हुए जिले में उड़ान की कालावधि के लिए विहित फीस संदाय करके स्वयं को जिला वायु क्लब से रजिस्ट्री—त करेंगे।

21. राज्य स्तरीय शिखर (एपैक्स) संगम और इसके कृत्य.--सरकार एक शिखर (एपैक्स) संगम (हिमाचल प्रदेश वायु क्रीड़ा क्लब) गठित कर सकेगी जो निम्नलिखित कृत्यों का पालन करेगाः-

(1) राज्य में विभिन्न जिला वायु क्रीड़ा क्लबों के क्रिया कलापों का समन्वय करना;

(2) वायु क्रीड़ा पर राज्य, राष्ट्रीय और अन्तर्राष्ट्रीय समागमों (Meets) प्रतिस्पर्द्धाओं और उत्सवों का आयोजन करना;

348 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 (3) भारत सरकार और अन्य निधिकरण अभिकरणों से प्रयोजन के लिए निधियों का प्रबन्ध करना;

(4) व्यवसाय में गाइडों और ऑपरेटरों को प्रशिक्षित करना और उनके ज्ञान और कौशल का अद्यतन करना;

(5) इन नियमों का क्रियान्वयन सुनिश्चित करना; और

(6) समस्त अनुज्ञप्तिधारकों का डॉटा बेस अनुरक्षित करना, जिसे प्रत्येक वर्ष 15 अप्रैल से पूर्व पर्यटन विभाग से वार्षिक आधार पर सांझा किया जाएगा।

22. निरसन और व्यावृत्तियां.--(1) हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) नियम, 2004 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित नियमों के अधीन की गई कोई या की गई कोई कार्रवाई, जिसके अंतर्गत किया गया कोई आदेश भी है, इन नियमों के उपबंधों से संगत होने के विस्तार तक इन नियमों के अधीन किया गया या की गई समझा/समझी जाएगी।

मुझे सूचित किया गया है और मुझे जानकारी है कि पैरा ग्लाइडिंग खतरनाक हो सकती है और इसमें बहुत से जोखिम और खतरे हैं जो, वायु क्रीड़ा द्वारा यात्रा करने के परिसंकट, दूर-वर्ती स्थानों में दुर्घटना या बीमारी चिकित्सा सुविधाओं के अभाव, प्राकृतिक शक्तियों, दैव —त्यों, अत्यंत कठिन मौसम, शारीरिक परिश्रम जिसके लिए मैं तैयार न हो सकूं तक ही सीमित नहीं है, और निष्क्रमण कठिनाइयों में, यदि मैं घायल या विकलांग हो जाऊं, जिसकी बाबत मुझे सूचित किया गया है और इन अन्य अन्तर्निष्ठ और प्रस्तावित ट्रिप (भ्रमण) के जोखिमों की जानकारी है और मैं अभिस्वीकार करता हूँ कि घर और काम को नियमित सुरक्षा से बाहर साहसिक कार्य का आनन्द इस ट्रिप (भ्रमण) में मेरी भागीदारी के लिए पर्याप्य कारण है।

पूर्ववर्ती की पूर्ण स्वीकृति में और ऑपरेटर (ऑपरेटर का नाम, जो हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 के अधीन रजिस्ट्रीकृत यात्रा अभिकर्ता है) उसके अभिकर्ता सहयोगी, समनुदेशिती, कर्मचारी और गाइड़ों तथा हित उत्तराधिकारी, जिसे इसमें इसके पश्चात्‌ ऑपरेटर के रूप में निर्दिष्ट किया गया है, के तत्वाधान में किसी साहसिक व्यवसाय में मेरी भागीदारी के लिए आरक्षण और स्वीकृति किए जाने के विचार हेतु मैं एतत्‌द्वारा निम्न करार करता हूँः-

मैं, आगे सहमत हूँ कि यदि मैं घायल या बीमार हो जाता हूँ तो ऑपरेटर, मेरी सुरक्षा और भलाई के लिए मेरी ओर से मेरे खर्चें पर, ऐसी सेवाएँ जैसी वह आवश्यक या समुचित समझे, चिकित्सीय उपचार निष्क्रमण या कोई अन्य आपात सेवाओं की व्यवस्था प्रदान कर सकेगा।

मैं सुस्पष्ट रूप से अभिस्वीकार और इकरार करता हूँ कि साहसिक यात्रा जिसमें ऑपरेटर का साहसिक ट्रिप भी सम्मिलित हैं, जिसमें, मैं भाग ले रहा हूँ, खतरनाक हो सकती है और जिसके अंतर्गत गंभीर और अभूतपूर्व शारीरिक चोट, सम्पत्ति हानि और मृत्यु है और मेरा पूर्ववर्ती अधित्याग और ऑपरेटर की युक्ति से, विधि द्वारा यथा-अनुज्ञप्त, यथा-उदार/विस्तृत, सम्मिलित अभिप्राय है, मैं सुरक्षा के विषय में ऑपरेटर के मौखिक या लिखित अभ्यावेदन पर निर्भर नहीं कर रहा हूं, मैं अपनी स्वेच्छा से इस करार को कर रहा हूँ। मैंने पढ़ लिया है और मैं ऑपरेटर की विवरणिका में अन्यत्र सर्व साधारण की जानकारी के लिए यथाकथित रद्‌दकरण और प्रतिदाय पर पॉलिसी, से सहमत हूँ।

मुझे ज्ञात है कि यदि मैं, सर्व साधारण की जानकारी के उप-शीर्ष बीमा के अधीन यथा प्रस्तुत बीमा कवर को न खरीदना चुनता हूँ, तो मैं किसी भी तरह कारित रद्‌दकरण, ट्रिप विलम्ब, सामान का नुकसान या हानि और किसी भी तरह हुई चिकित्सीय आपत्ति की दशा में, समस्त लागत के लिए उत्तरदायी होऊंगा। मैं, आगे सहमत हूँ कि वायु क्रीड़ा में मेरी भागीदारी और या इस करार या अधिमान देने या उसके निर्वचन से संबंधित कोई विवाद या दावा उत्पन्न होता है तो उसे माध्यस्थम और सुलह अधिनियम, 1996 के अनुसार हिमाचल प्रदेश शिमला में आबद्धकर माध्यस्थम द्वारा निपटाया जाएगा।

मैं आगे सहमत हूं कि वायु क्रीड़ा ़ट्रिप में मेरे भाग लेते समय मेरे कब्जे में कोई मद्य या अवैध औषधि नहीं होगी।

मैंने, इस दायित्व के सभी निबंधनों और खतरे की धारणा को पढ़ और समझ लिया है और अपनी स्वेच्छा और बिना संकोच के इससे सहमत हूं।

TOURISM AND CIVIL AVIATION DEPARTMENT

NOTIFICATION

Shimla-2, the 19th February, 2021

No. Tourism-F(6)-3/2001-IV.—In exercise of powers conferred by section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002), the Governor of Himachal Pradesh proposes to repeal the Himachal Pradesh Aero Sports Rules, 2004350 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 and make new rules, viz., Himachal Pradesh Aero Sports Rules, 2021 and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for the information of general public;

Any interested person who has any objection (s) or suggestion(s) with regard to these rules, may send the same to the Secretary (Tourism & CA) to the Government of Himachal Pradesh or Director of Tourism & CA, H.P. within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-gazette), Himachal Pradesh;

The objection (s) or suggestion (s), if any, received within the period specified above shall be taken into consideration by the State Government before finalizing the said draft rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Aero Sports Rules, 2021.

(2) They shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Definitions.—(1) In these rules, unless there is anything repugnant to the subject or context.—

(a) "Act" means the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002) ;

(b) "air raft" means any equipment/ contraption (paraglider, handglider, paramotor etc.) used for being air borne;

(c) "Association" means a society registered under the Himachal Pradesh Cooperative Societies Act, 1968 or the Himachal Pradesh Societies Registration Act, 2006;

(d) "crew member" means the person who conducts the aero sports operation including the tandem pilots accompanying the operations;

(e) "Hang Glider" means an air raft which has delta wings that has a fabric aerofoil with an aluminum frame and inserts;

(f) "operator" means an Adventure Sports Operator who is registered as such under the Act for carrying out or engaged in or offering to engage the Aero Sports on commercial basis i.e. for the purpose of training, recreation or sport;

(g) "operation" means a aero sport trip to be under taken or undertaken under these rules;

(h) "Paraglider" is an air raft/ glider that achieves its aerofoil structure without any solid reinforcement from RAM air pressure between two layers of fabric;

(i) "Paramotor" is a paraglider or dedicated paramotor wing with reflex foil design which is powered by sub 350cc engine unless it has torque cancelling technology and can be launched with trike / quad or on foot;

(j) "Participant" means the person(s) who participates in an operation;

(k) "Regulatory Committee" means committee constituted by State Government under rule 8;

(l) "Season" for the purpose of these rules means the timing will be as decided by the technical committee after considering the weather conditions and they will notify it from time to time;

(m) "Site" means location approved by the Technical Committee for the conduct of Aero Sport activities;

(n) "Solo Pilot" means a person who has done a paragliding course from Atal Bihari Vajpayee Institute of Mountaineering and Allied Sports Manali or has a valid licence recognized by a country /association i.e. (BHPA [British Hang Gliding and Paragliding Association]/ USHGA [US Hang Gliding and Paragliding Association]/ FAI/ APPI [Federal Aeronautical International/ Association of Paragliding Pilots & Instructors]) ;

(o) "Tandem" means Aero Sport activity involving 2 people (one pilot and one passenger) on 1 air raft;

(p) "Tandem pilot" means a person holding 'Certificate of Registration & Licence' under these rules for safe operation of Aero Sport ;

(q) "Technical Committee" means committee constituted by State Government under rule 6; and

(r) "Valid Licence" means a licence issued by a country/ association i.e. (BHPA [British Hang Gliding and Paragliding Association]/ USHGA [US Hang Gliding and Paragliding Association]/ FAI/ APPI [Federal Aeronautical International/ Association of Paragliding Pilots & Instructors]). Whoever issues this license should have a qualification of being an instructor/ master instructor from the institutions referred to above.

(2) words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.

CHAPTER-II

REGISTRATION

3. Procedure for application for Aero Sport Operations.—(1) Applications for Aero Sports Operations during the ensuing season shall be received in the office of District or Assistant Tourism Development Officer, as the case may be, from the operators from 1st November to 1st March and 1st June to 16th August respectively every year. The concerned District Tourism Development Officer/ Assistant Tourism Development Officer, as the case may be, shall scrutinize these applications initially and put up the same before the Technical Committee which shall hold the meeting before 15th of April and 15th of September respectively every year and fix date, time and venue for the scrutiny/inspection of the documents, equipments, conducting practical tests (both viva voce and flying) of Tandem Pilots and final approval by giving at least 15 days clear notice to all the operators.

(2) No Operator shall be permitted to operate aero sports activities in the middle of the season. All operators shall follow the procedure as laid down in sub-rule (1).

(3) The Operator(s) or association(s), as the case may be, who have local office prior to registration, shall be registered with the Tourism Department, Himachal Pradesh.

4. Registration and Qualifications of Operator for Aero Sports.—(1) An Operator intending to operate aero sports shall apply for registration to the concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, along with a bank demand draft of Rs. 10,000/- drawable in favour of concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be. The District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, shall issue a certificate of registration to the concerned operator after the approval of the Technical Committee.

(2) The registration so made shall be valid for a period of three years from the date of issue.

(3) No person other than a operator registered for carrying out the aero sports operations shall be permitted to carry out any operation either directly or through his employees unless the Technical Committee is satisfied that the Operator has all the equipments and he fulfills other requirements under these rules and his proposal has been duly approved/cleared by the said Committee.

(4) No Operator shall be permitted to undertake aero sport activities unless he has trained and qualified Tandem Pilots with experience as specified in these rules, recorded through the Digital Logbook with the name of the pilot in Aero Sports with good track record.

(5) Additional Qualifications: The Operator should have following additional qualifications:—

a. The applicant should be an Indian citizen.

b. The applicant should be minimum 10th Class Pass.

c. The operator should have attained 21 years of age.

d. The Operator shall ensure that the Tandem Pilots are made to wear a dress as approved by the respective District Aero Club/DTDO with Licence Number being displayed prominently. However, the specifications of the dress would be decided after the consultation with associations at the District Level from respective areas.

e. The Applicant should have advanced practical/ technical knowledge of aero sport which may be tested through a test as may be determined by the Technical Committee.

f. The Operator should have a valid third party liability insurance of Rupees Ten Lakh for covering the proposed aero sport activities including rescue for both pilot and the participant.

5. Registration and Qualifications of Pilot/ Tandem Pilot.—(1) Any person who intends to participate in Aero sports activities as Solo Pilot having valid license will apply for permission to concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be at least one month prior to the date proposed for the event/ activity which shall be issued for a period of three months.

(2) A person intending to participate in an aero sports operation as an Tandem Pilot may make an application to the concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, along with a demand draft of Rs. 2000/- payable in favour of District Tourism Development Officer or Assistant Tourism Development Officer, as the353 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 case may be, who, on being satisfied that the person applying for registration fulfills the requisite qualification and standard for registration and thereafter with the approval of Technical Committee, shall issue a certificate of registration for a period of three years.

(3) Additional Qualification of Tandem Pilot.— The Tandem Pilot should have following additional qualifications:—

a. The applicant should be an Indian citizen.

b. The Tandem Pilot should be minimum 12th class pass.

c. The Tandem Pilot should have attained 21 years of age.

d. Pilots must have minimum P4 level training as a Solo Pilot similar from Atal Bihari Vajpayee Institute of Mountaineering and Allied Sports (BVIMAS) or any other association i.e. (BHPA [British Hand Gliding and Paragliding Association]/USHGA [US Hang Gliding and Paragliding Association]/FAI/APPI [Federal Aeronautical International/Association of Paragliding Pilots & Instructors]), achieved 100 hours of Solo Flying and minimum 35 km xc flight.

e. 50 non commercial flights as sports tandem pilot before converting to commercial flying.

f. The Tandem Pilots should be First Aid/ CPR certified.

g. The records submitted by the Tandem Pilot should be on the basis of Digital log book proof with name.

h. The Tandem Pilot should have advanced practical/ technical knowledge of the sport which may be tested through a test as may be determined by the Technical Committee.

i. The Tandem Pilot should have medically fit (who shall also undergo yearly medical checkup in a Government registered medical institution) and have an appropriate medical certificate and valid insurance of Rupees Five Lakh covering aero sport activity.

j. The Tandem Pilot should have completed an SIV (Simulation during Flights- Paragliding Safety Course) before applying for a Tandem license. However, the Tandem Pilots already registered with the Department of Tourism, will have to complete the SIV training within 02 years from the day these rules come into force.

k. Technical Committee shall reserve the right to qualify pilots based on their international licence which may certify them. Only licences recognized by a country/ association (BHPA [British Hang Gliding and Paragliding Association]/ USHGA [US Hang Gliding and Paragliding Association]/ FAI/APPI [Federal Aeronautical International/Association of Paragliding Pilots & Instructors]) shall be accepted as a valid licence.

l. The Tandem Pilots who are already working in this field with technical qualification mentioned in clause (3) (c, d & e) and are not having required354 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 educational qualifications as per clause (3) (b), the condition of educational qualification will not be mandatory for them.

m. The Tandem Pilot should be certified by any recognized National Level Association/ Institution who then will have to appear before the Technical Committee to get a valid registration.

6. Constitution of Technical Committee.—The State Government shall, by notification constitute a Technical Committee having jurisdiction over the whole of the State of Himachal Pradesh consisting of the following members, namely:—

1. Commissioner-cum-Director, Tourism Chairman;

2. Director, Atal Bihari Vajpayee Institute of Vice Chairman; Mountaineering & Allied Sports (ABVIMAS), Manali

3. Representative of State Aero Sports Association Member;

4. Representative of ABVIMAS who is an Instructor in flying Member;

5. Chief Medical Officer or his representative of the Member; concerned District

6. 03 members from the Distt. Level Association to be Member; nominated by the Govt.

7. Conservator of Forests of the concerned Area or Member; his representative.

8. Any 05 registered Pilots nominated by the Govt. Member; and 9. District Tourism Development Officer/Assistant Member -Secretary. Tourism Development Officer of the concerned Districts.

7. Functions of the Technical Committee.—The Technical Committee shall meet at least twice a year i.e. before 15th April and 15th September respectively every year. The committee shall perform the following functions, namely:—

(a) To inspect and certify the equipments manufactured and homologated by an internationally recognized Certification Authority or Federation Aeronotique Internationally/ EN (The European Committee for Standardization)/ SHV (Swiss Hang Gliding and Paragliding Association)/ DHV (Deutscher Hangegleiter Verband)/ AFNOR (French Association of Normalization) with the operator from safety point of view as per Rule 3.

(b) That every air raft used in the aero sports shall have a proper bill of import of equipment. In case of second hand air raft, then the certification of its airworthiness issued by the original manufacturer shall not be older than six months from the date of import.

(c) That for the Paramotor, the motor, trike/ quad should be from a well known company.

(d) To scrutinize the bio-data of the Operators/ Tandem Pilots. To conduct their tests (viva voce & flying) in order to ascertain their expertise for registration as Operator/ Tandem Pilot and for the issuance of commercial licence to the Operator/ Tandem Pilots. The Technical Committee shall see and examine the following :—

(i) All applications (including new application) and their renewals for seeking aero sports flying licence.

(ii) Insurance of the Paragliding Pilots and valid third party liability insurance by Operator.

(iii) Airworthiness checks will be performed on the following equipment:—

a. Paraglider (porosity check and lines stretch of gliders);

b. Other air rafts;

c. Harness–pilot and passenger;

d. Reserve parachute ;

e. Other equipment's in accordance with the international standard; and f. Safety measures as per Rule 9 of the said Rules.

(iv) Certification of other aero sports equipments.

(v) Flying knowledge, safety and rescue skills and first aid knowledge etc. of Aero sports from each commercial Tandem Pilot as per the minimum qualification criteria fixed for each application (Digital log book submission required).

(vi) Indemnity bond for releasing State from any cost incurred on rescue/ medical expenses etc. in case of emergency, accident etc. That the State shall also not be liable to pay any compensation to the Operator, Tandem Pilot, Solo Pilot or the Participant in case of their death, serious and minor injuries; and

(vii) Logbook of operations and office of the Operator.

(e) To ensure that the Operators/Tandem Pilots follow all safety procedures specified in these rules.

(f) Technical Committee shall assess the carrying capacity of each flying sites. In addition to this, the committee shall also identify new sites and areas for Aero Sports in the State apart from those already mentioned in Rule 15.

(g) Identify the exact boundaries including takeoff and landing sites where operation can be conducted safely.

(h) The right to alter or cancel the operation in any site depending on the prevailing conditions shall vest with the Technical Committee.

(i) Perform such responsibilities as may be assigned to it from time to time by Commissioner-cum-Director Tourism/ State Government.

(j) The presence of a minimum of ten members of the Technical Committee similar with either Chairman or Vice Chairman shall form the quorum of the meeting. The Chairman may delegate his authority to Vice Chairman to hold meeting in his absence and it shall be the responsibility of the Member Secretary to call the meetings of Technical Committee.

8. Establishment of the Regulatory Committee and its function.—(1) The State Government shall by notification constitute a Regulatory Committee for each Aero Sport site consisting of the following:—

(a) Deputy Commissioner of the concerned District Chairman;

(b) Director, ABVIMAS , Manali Vice- Chairman;

(c) Superintendent of Police or his nominee Member; of the concerned District

(d) Sub-Divisional Officer (Civil) from Member; concerned Sub-Division or his nominee

(e) Block Medical Officer of the concerned Member; District or his nominee

Member;

(f) Divisional Forest Officer of the concerned Area or his representative

(g) Representative of the District Aero Sports Member; and Association/ Registered Aero Sports Association of the concerned area

(h) District Tourism Development Officer/ Member-Secretary. Assistant Tourism Development Officer of the concerned District

(2) The Regulatory Committee shall have the overall control for regulating the operations taking place in the area with the assistance of the Association.

(3) The Regulatory Committee shall also inquire into the complaints of misbehavior or malpractice against Operator/ Tandem Pilots through a subcommittee of three members constituted by the Chairperson for the purpose.

(4) The Regulatory Committee will also decide about the rates to be charged by the operator from the participants which could be revised on yearly basis.

(5) The Regulatory Committee may conduct surprise inspections during the operation to ascertain that these rules are being implemented properly.

(6) The Regulatory Committee can recommend for altering or cancelling the Aero Sports operation at any site depending on the prevailing conditions to the Technical Committee.

(7) The Regulatory Committee may be entrusted with any other function in relation to Aero Sports operation by the Government.

(8) The presence of a minimum of four members of the above Regulatory Committee with either Chairman or Vice Chairman shall form the quorum of the meeting. The Chairman may delegate his authority to Vice-Chairman to hold meeting in his absence and it shall be the responsibility of the Member Secretary to call the meetings of Regulatory Committee at least twice a year.

SAFETY MEASURES

9. Equipment's required for carrying out operation.—Each Operator shall have to arrange for the following equipments before he is permitted to carry out the operation. At the time of inspection the Technical Committee shall check each equipment and get the same stamped through the Department of Tourism Himachal Pradesh, namely:— 1. Flying equipment (Paraglider/ Air raft) of an Internationally Homologated design;

2. Gloves, Ankle shoes, First Aid Box, and Repair kit;

3. Safety Parachute, Helmet, Ladder, 50 meter Nylon rope of 8 mm diameter, Carabiners–two for each glider, Pulley & Oxygen cylinder with mask;

4. Two way radio communication equipment, instrument panel (Altimeter, Variometer, Compass, Air Speed Indicator) and Global Positioning System (for Solo Pilots);

5. Ground Support and retrieval vehicle centrally located for each location;

6. Insurance for all equipment, Self/ Crew/ Passengers/ Other persons participating in aero sports (Ten Lakh comprehensive).

7. Other equipments as per the directives of Technical Committee;

8. The operator should also ensure that a logbook of equipment and their maintenance is kept all the times, which will contain details of all flying activity, repairs and modifications (If there are any serious modifications, they will be required to undergo appropriate amount of testing hours again. These hours to be stipulated and declared along with modification entry alongwith reasoning for the same); and

9. That the recommended service interval/ maintenance schedule of all major parts to be carried out as per their schedule.

10. Medical facilities and other facilities to be available during operation.—(1) The Operator during each operation shall carry with him on site two well-equipped first aid kits consisting of triangular bandages, sterile pads, gauze roller bandages, pressure bandages, first aid adhesive tape, splints, scissors, as a bare minimum with stretcher and spinal board in every flying site at take off and landing or any other medical equipment as specified by the Technical Committee.

(2) Every Operator shall also keep co-ordination with a hospital and keep information of nearby available doctor and hospital to take care of emergency cases.

(3) Each flying (takeoff and landing) site shall have the facility of an ambulance for emergency evacuations.

11. Safety measures for operators.—No Operator shall be permitted to operate an operation unless:—

1. Operator should have atleast two Aero sports qualified Tandem Pilot for the guidance of participants. The persons operating the air rafts must have requisite qualifications358 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 and experience prescribed under these rules. Each Tandem Pilot should have equipments for the safety on the same lines as are required for participants;

2. Operator should have Tandem Pilots with valid licence (as per qualification), who are well-trained in aero sports and rescue techniques;

3. Tandem Pilots should have thorough knowledge of the Micro Meteorology affecting the site. They must also be qualified in First Aid/ Cardio Pulmonary Resuscitation having successfully completed basic course in first aid from Government Hospital or any Recognized institution;

4. The Tandem Pilots engaged by the Operator should be graded by the Technical Committee;

5. The Tandem Pilots who pilot the trip should be equipped with safety gear including helmet at all times both during the demonstration as well as the flight;

6. The Operator should display list of the equipments and accessories as recommended by the Technical Committee for the Aero Sports and will make it available at all times at the site with the Tandem Pilots respectively;

7. The Operator will ensure that all safety details/ briefing for the trip are given to the participants before start of each trip;

8. The Operator will ensure that all the participants are in suitable attire and bulky clothes, sarees, neck ties, long skirts and three piece suites are not used and they wear proper safely gear including helmet;

9. Operator shall also have to necessarily ensure that Aero Sport activity is not carried out in bad weather;

10. The Regulatory Committee in consultation with the Association shall notify a roster indicating the Operator on duty on fortnightly basis and the Operator on duty shall ensure strict adherence to the safety standards for the fortnight on the site;

11. Log book of each airraft, should contain a record of usage, inspection, repairs and safety measures undertaken, which will be countersigned by the on duty member of the local aero sport association on fortnightly basis. The Log Book shall also be countersigned by the inspecting authority on the date of visit where it will record its remarks;

12. Operator shall display the capacity of all air rafts in use at the flying site and make them visible to the users along with a warning that "to carry more persons than the capacity will be dangerous";

13. Where the Government has developed and allotted the operation sites in Himachal Pradesh on the basis of fee/ rent, the income of the same shall accrue to the local Association; and

14. The Operator shall make sure to have insurance of all equipment, Self/ Crew/ Passengers/ Other persons participating in aero sports as per Rule 9(6).

12. Duties of the Operator.—(1) The Operator shall report all incident/ accident immediately to the Association/ District Administration/ Chairman Technical Committee;

(2) The Operator shall ensure that the aero sports operations shall finish one hour before sunset or 6.00 PM, whichever is earlier (should fly conforming to VFR and VMC);

(3) All Operator/Permit holder shall also have to necessarily ensure that aero sport activity is not carried out in bad weather;

(4) The Trainee Pilots shall not be permitted alone to carry out operations during training period;

(5) Operator shall, before commencing operations for the season inform the respective Sub- Divisional Officer (Civil)/Police Station concerned/District Tourism Development Officer/ Assistant Tourism Development Officer regarding the duration, timings and nature of operations for the season;

(6) The Operator shall keep the environment clean. In case, if any Operator or Participants is found not adhering to the environment guidelines, his permission will be suspended;

(7) The Operator shall display the laminated licence/permit and safety guidelines on the site and also on the air raft for the knowledge of the visitors and participants. He shall have to produce the same when asked by any authority;

(8) The authorized officer of the Department of Tourism/ Forest/ District administration may inspect the flying site and camp site used for aero sports; and

(9) The Operator shall before commencing commercial operations get approval of the concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, about the rates to be charged from the tourists or the participants of the aero sports from time to time. Rates to be displayed prominently at all sites where the tourists can read them by Operator/Association as the case may be.

13. Claim on account of any mishap.—The State Government of Himachal Pradesh or the Tourism Department shall not be vicariously liable for any claims on account of any mishap during the aero sport activity.

14. Other Safety measures for operator.—The operator shall ensure that :—

1. Children below 12 years or less than 30 Kg. shall not be permitted to participate in aero sports.

2. All participants and crew members shall be provided with full safety gear.

3. No aerobatic manoeuvres to be done with participants.

4. No overloading or under loading of equipment.

5. Complete safety briefing to all the participants at the start of each operation shall be mandatorily made.

6. Persons suffering from heart ailments conditions, epilepsy, lung disorder, asthma and pregnant women shall not be allowed to participate in the operations.

7. No foreign pilot shall be permitted to participate as such in an operation unless he/she has adequate experience and equipments and cleared to do so by the District Tourism Development Officer/Assistatnt Tourism Development Officer and operates under an operator.

8. Each participant shall give an undertaking as per Annexure-"A" before the start of the operation.

9. It shall be the responsibility of the operator that the participants shall adhere strictly to the norms laid down in these rules.

10. Any person consuming alcohol in any form or quantity or illicit drugs at least 8 hours prior to the operations shall not be permitted to participate in the operation; and if found to be doing so the licence of operator and Pilot shall be cancelled.

CHAPTER-IV

MISCELLANEOUS

15. Areas for Aero Sports.—Aero Sports Activities shall be confined to the sites as may be identified by the Technical Committee and notified by Director, Tourism from time to time.

16. Classification of rapid grading.—The Technical Committee shall grade all the sites or launches as the case may be, identified for aero sports purpose in following manner:—

(a) Class 1: Basic Level;

(b) Class 2: Intermediate level; and

(c) Class 3: Advance and Cross Country level launches.

17. Collection of Registration Fees and user Fee.—The Operator shall, pay to the Government in cash or demand draft drawable in favour of District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, the following fees before commencing the operations:

1. User Fee Rs. 1,500/- per airraft per year and Rs. 500/- per guide per year; User fee and registration fee to be decided by the Regulatory Committee from time to time.

2. Additional fee shall be charged at such rate as may be determined by District Tourism Development Officer in consultation with the Association in case other facilities have been created out of the Government funds at the take off and landing sites;

3. The funds collected from the above sources shall be deposited in the bank account of the District Aero Club (Association) which shall be operated jointly by the Association and the District Tourism Development Officer; and

4. The funds shall be used only for the promotion of aero sports, repair and maintenance of common facilities connected with the Aero Sports.

18. Formation of District Aero Sports Club Association.—The State Government shall form Associations/Club consisting of atleast 06 members from the local qualified Pilots/registered Operators to be known as the District Aero Club (DAC) for each of the District under the Chairmanship of District Tourism Development Officer in the State for the purpose of Aero Sports in which apart from above stated members atleast two nominees of the Government (Tehsildar and Range Forest Officer of the concerned area) will also be included.

19. Function of the District Aero Sports Club.—(1) The District Aero Club shall ensure in the safe and convenient conduct of the Aero Sports.

(2) The District Aero Club may extend assistance to the operator when asked for.

(3) The District Aero Club may manage the camping lodging and boarding of the participants of the operation and the crew members.

(4) The District Aero Club may conduct the operation on its own.

(5) The District Aero club shall conduct any other functions that may be assigned to it by the Government.

20. Disciplinary Committee of Association.—(1) The District Aero Club shall form a Disciplinary Committee comprising of three to five members to regulate the safety and cleanliness aspects of the sport of Aero Sports on site and as per the guidelines adopted by the State Level Association in Himachal Pradesh.

(2) Visiting pilots to the state from within the country or from a foreign country shall get themselves registered with the District Aero Club for the duration of flying in the District by paying a prescribed fee and declaring the equipment and flying plan during his stay.

21. State Level Apex Association and its Functions.—The Government shall constitute an Apex Association (Himachal Pradesh Aero Sports Club) to perform the following functions :—

1. To co-ordinate the activities of the various District Aero Clubs in the State;

2. To organize State, National and International meets, competitions and festival on aero sports ;

3. To seek funding from Government of India and other funding agencies for the purpose;

4. To train and update the knowledge and skills of the guides and operators in the trade;

5. To ensure the implementation of these rules; and

6. To maintain the data base of all the licence holders which will be yearly shared with the Department of Tourism before 15th April each year.

22. Repeal and savings.—(1) The Himachal Pradesh Aero Sports Rules, 2004 are hereby repealed.

(2) Notwithstanding such repeal, any act done or any action taken including any order made under the rules so repealed shall, to the extent of being consistent with the provisions of these rules, be deemed to have been done or taken under these rules.

I have been informed and I am aware that Aero Sports can be dangerous and includes many risks, and dangers, including but not limited to, the hazards of travelling by air raft accident or illness in remote places, without medical facilities, forces of nature, acts of God, extreme weather conditions, physical exertion for which I may not be prepared and evacuation difficulties, should I be injured or disabled I have been informed and am aware of these and other inherent risks, and of the proposed trip and acknowledge that the enjoyment of adventuring beyond normal safety of home and work is in part the reason for my participation on this trip.

In full recognition of the forgoing and in consideration of being granted a reservation and acceptance for my participation in an adventure vacation under the auspices of (name of operator who is registered travel agent under the Himachal Pradesh Tourism Development and Registration Act, 2002), operator his agents associates, assigns, employees and guides and successors in interest hereinafter referred as "the operator" I hereby agree as follows:—

I hereby release, waive, indemnify and agree not to sue the operator, Government of Himachal Pradesh for all or any liability to me, my personal representatives, heirs, assigns, a next of kin, for any and all losses, damages, or injuries or any claim or demand on account of any injury to my person or property, or on account of my death resulting from any cause, including negligence of operator, or others, while I am participating in adventure. I further agree that I will assume the risk and will release operator of any liability for any injury or damage to my body or property or my death due to any negative failure to obtain or administer appropriate rescue operations in the event of injury or mishap, including failure to obtain adequate medical services, to evacuate or to supply treatment, medicine or trained rescue personal.

I further agree that if I am injured or become ill, operator may at my cost, arrange, or supply medical treatment, evacuation, or any other emergency services on my behalf as operator deems necessary or appropriate for my safety and well being.

I expressly acknowledge and agree that Adventure travel, including the operators adventure trip in which I am participating can be dangerous and involves serious and unprecedented of bodily injury, property, damage and death and I intend the forgoing waiver and release of operator to be as broad and inclusive as permitted by law, that I am not relying on oral or written representations or operator regarding safety, that I am entering this agreement at my own free will.

I have read and agreed to the policy on cancellation and refunds as stated in the general information elsewhere in the operator brochure. I am aware that should I choose not to purchase363 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 insurance cover as put forth under the insurance sub head of general information, I will be liable for all costs in the case of cancellations, trip delays, damage or loss of baggage and medical emergency howsoever caused.

I further agree that any controversy or claim arising out of or relating to my participation in the Aero sports activities and or this agreement or making preference, or interpretation thereof shall be settled by binding arbitration in Shimla, Himachal Pradesh, in accordance with the Arbitration and Conciliation Act,1996.

I further agree that I will have no liquor of illegal drugs in my possession when participating in the Aero Sports trip.

I have read and understand all of the terms of this liability and assumption of risk and agree to it on my own free will and without reservation.

No. UD-F(4)-2/2020.—The Governor, Himachal Pradesh, keeping in view the present scenario of Covid-19 pandemic is pleased to re-notify scheme known as Mukhya Mantri Shahri Ajeevika Guarantee Yojna (MMSAGY) as per guidelines attached to this Notification at Annexure- "A" to enhance livelihood security in urban areas by providing 120 days of guaranteed wage employment to every household in the Financial Year 2021-2022.

ANNEXURE-"A" MUKHYA MANTRI SHAHRI AJEEVIKA GUARANTEE YOJNA (MMSAGY)

1. Objective :

The objective of the Scheme is to enhance livelihood security in urban areas by providing 120 days of guaranteed wage employment to every household in a financial year.

2. Goals:

(a) To ensure livelihood security to urban households by providing a guaranteed employment for 120 days.

(b) To facilitate skill enhancement of persons engaged in waged labour jobs to provide them better livelihood opportunities and to set up their own enterprises by imparting entrepreneurship trainings as well as subsidy linked credit linkages.

(c) To strengthen urban infrastructure and provisioning of quality civic amenities in the Urban Local Bodies (ULBs).

(a) All adult members of the household who register under this scheme will be eligible to work. To register they have to be:

i. local resident of the ULB (meaning thereby they should be residing within the jurisdiction of the ULB either in their own house or on rent).

ii. willing to do unskilled work at projects being executed or in Sanitation Services being provided by the Urban Local Bodies.

(b) Household will comprise of husband, wife and their minor children. However, only adult members of household shall be eligible to work.

(c) The upper age limit for providing work shall be 65 years.

4. Components:

(a) Guaranteed Employment.—It will aim to provide guaranteed 120 days employment to eligible beneficiaries in urban local bodies to ensure livelihood security. The ULBs shall not employ an eligible beneficiary for more than 120 days in any financial year.

(b) Maximum Period for Employment.—The maximum period for which employment will be provided to a household shall be 120 days.

(c) Skill Training.—The eligible beneficiaries under this scheme will also be provided skill training under Deen Dyal Antodaya–National Urban Livelihood Mission (DAY- NULM), to create further opportunities for better livelihood.

(d) Bank Linkage.—The eligible beneficiary so skilled under this scheme will be facilitated to apply for loans under DAY-NULM.

5. Coverage and Duration:

The scheme will be implemented in all the Urban Local Bodies (ULBs) and Cantonment Boards (CBs) in Himachal Pradesh. The scheme shall initially be operational till 31-03-2022.

6. Application Procedure:

(a) Any eligible beneficiary may apply to get registered with the ULB as per Annexure-B.

Application can also be filled online at portal specified for the purpose.

(b) All eligible beneficiaries of a household will be registered through a single application only. No separate applications are required.

(c) The ULBs after due verification will issue a Job Card free of cost as per Annexure-C.

The Job Card will bear the photographs of the registered beneficiaries.

(d) The Job Card will be issued within 7 days of registration.

(e) Employment will be given to the eligible beneficiary within 15 days of registration, failing which an unemployment allowance @ Rs. 100 per day will be paid by the ULBs.

(f) All accounts and records relating to the MMSAGY shall be available for public scrutiny for which these shall be uploaded on the website of the ULB and the Directorate of Urban Development.

7. Permissible Activities:

(a) All eligible beneficiaries will be employed in the following permissible activities in ULBs:

i. In any ongoing or new admissible work under any Govt. of HP/ Govt. of India scheme for which funds are available with ULB.

ii. In any admissible work under 15th Finance Commission or 5th State Finance Commission for which grant-in-aid provided to the ULBs.

iii Sanitation Works/Services as admissible under Solid Waste Management Rules, 2016 and Swach Bharat Mission.

(b) The ULBs shall not start any muster-roll linked work / activity under this scheme and shall get eligible beneficiary employed only in the works specified as per 7 (a) above.

(c) The ULBs shall make enabling provision in all new contracts to be awarded for engaging eligible beneficiaries under MMSAGY as unskilled workers by the implementing agency. For the works already awarded, the ULBs will co-ordinate with implementing agency to whom the work has been awarded for engaging the registered eligible beneficiaries under MMSAGY.

8. Payment of Wages:

(a) Eligible beneficiary under the scheme will be entitled to minimum wage notified by the State Government.

(b) Equal wages are to be paid to both male and female workers.

(c) Wages will be directly deposited in the bank account of eligible beneficiaries by the ULBs on fortnightly basis not later than 7 days after completion of 15 days employment.

(d) The payment of wages as prescribed supra will be made after due verification of the attendance by the Junior Engineer or any other officer /official authorized by the ULB.

(e) The payment made above will be adjusted/deducted from the bills of the implementing agency before making its payment.

9. Skill training under DAY-NULM:

The eligible beneficiary will be provided skill training with entitlement to minimum wage as notified by the government up to a maximum of four weeks only after doing wage employment of 30 days under MMSAGY.

10. Bank Linkage:

The eligible beneficiary provided skill training above, willing to start their own Enterprise will be linked to the banks under Self Employment Programme (SEP) of DAY-NULM.

The State Govt. may review and amend these guidelines at any time for its smooth implementation in the ULBs.

विषय.--उत्तराखण्ड की प्राकृतिक आपदा में गुम हुए व्यक्तियों की मृत्यु की घोषणा बारे ।

जबकि मुख्य सचिव हिमाचल प्रदेश के आदेश संख्या रैव (DMC)(F) 11-18/2018 GLOF दिनांक 26-02-2021 के अनुसार उपरोक्त आश्रितों ने निम्न व्यक्तियों जोकि दिनांक 07-02-2021 को उत्तराखण्ड प्राकृतिक आपदा में आई प्राकृतिक आपदा में गुमशुद्धा हुए हैं को मृत घोषित करने व उनका मृत्यु पंजीकरण करने बारे आवेदन किया था। उपरोक्त आदेशों के अनुसार इस सम्बन्ध में विस्तृत जांच रिपोर्ट अभिहित अधिकारी/उप-जिला अधिकारी, जोशीमठ, उत्तराखण्ड को पहले ही प्रेषित की जा चुकी है जिसमें दिनांक 07-02-2021 को उत्तराखण्ड में आई प्राकृतिक आपदा में गुमशुद्धा/ लापता व्यक्तियों को मृत घोषित करने व उनके आश्रितों को मृत्यु प्रमाण-पत्र जारी करने बारे सिफारिश की गई है । प्राकृतिक आपदा में मरने वालों की सूची निम्न प्रकार से है :-

As per the order of ibid the detailed inquiry report were submitted to the designated Officer- cum- Pargana Adhikari/Sub-Divisional Magistrate, Joshimath Uttrakhand with the recommendation to declare the above named persons as dead in the said natural calamity occurred on 07th February, 2021 and issue death certificate in their favour. Sh. Rattan Chand s/o Late Sh. Prabhu Dyal, r/o Nasheman Cottage, Lower Kaithu, Tehsil and District Shimla (H.P.) has preferred an application to the undersigned for registration of date of birth of him self Mr. Rattan Chand (DOB-01-01-1970) at above address in the record of Municipal Corporation, Shimla.

Therefore through this proclamation, the general public is hereby informed that any person having any objection for entry of date of birth mentioned above, may submit his objection in writing in this court within 30 (Thirty) days from the date of publication of this notice in official Gazette. No objection will be entertained after prescribed period and application will be decided accordingly.

हरगाह आम को सूचित किया जाता है कि श्री प्रदीप कुमार पुत्र ओम दत्त, निवासी चाकली मुंदड,़ डाकघर ठाकुरद्‌वारा, तहसील पच्छाद, जिला सिरमौर, हिमाचल प्रदेश ने इस अदालत में प्रार्थना-पत्र मय शपथ-पत्र जिला रजिस्ट्रार एवं मुख्य चिकित्सा अधिकारी नाहन को इस आशय से प्रस्तुत किया था कि उनके बेटे अर्जुन शर्मा पु़त्र प्रदीप कुमार की जन्म तिथि 31-10-2015 का पंजीकरण ग्राम पंचायत जन्म रजिस्टर में दर्ज नहीं करवाया जा सका था व अनुरोध किया है कि इनका पंजीकरण ग्राम पंचायत में करवाया जावे। उक्त प्रार्थना-पत्र जिला रजिस्ट्रार द्वारा इस न्यायालय को आगामी कार्यवाही हेतु प्रेषित किया है।

अतः इस से पूर्व कि उक्त व्यक्ति का पंजीकरण किया जावे इस इश्तहार द्वारा हर आम व खास को सूचित किया जाता है कि यदि किसी व्यक्ति को उनके नाम व जन्म तिथि पंचायत रिकार्ड में दर्ज करने बारे कोई एतराज हो तो वह तिथि 30-04-2021 को या इससे पूर्व अदालत में हाजिर होकर अपना एतराज पेश कर सकता है अन्यथा सचिव, ग्राम पंचायत को सम्बन्धित उक्त नाम व तिथि दर्ज करने बारे आदेश जारी कर दिए जायेंगे।

श्री दलिप सिंह पुत्र दिवड़ी देवी, निवासी शिम्बल चन्डोग, डाकघर नैना टिक्कर, तहसील पच्छाद, जिला सिरमौर, हिमाचल प्रदेश ने एक प्रार्थना-पत्र मय शपथ-पत्र जिला रजिस्ट्रार एवं मुख्य चिकित्सा 386 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 अधिकारी नाहन को इस आशय से प्रस्तुत किया था कि उसकी बेटी डिम्पल पुत्री दलिप सिंह कि जन्म तिथि 25-12-2010 का पंजीकरण ग्राम पंचायत जन्म रजिस्टर में दर्ज नहीं करवाया जा सका था व अनुरोध किया कि उसका पंजीकरण ग्राम पंचायत में करवाया जावे। उक्त प्रार्थना-पत्र जिला रजिस्ट्रार द्वारा इस न्यायालय को आगामी कार्यवाही हेतु प्रेषित किया है।

श्रीमती रूकमी देवी पत्नी श्री उदय राम निवासी ग्राम शमांह, तहसील कमरऊ, जिला सिरमौर (हि0 प्र0) ने इस अदालत में एक प्रार्थना-पत्र मय अपना ब्यान हल्फी, परिवार नकल ग्राम पंचायत शावगा, अपना आधार कार्ड प्रति, राजस्व अभिलेख नकल जमाबन्दी मौजा बाईला गजौण एक प्रति सहित इस आशय से प्रस्तुत किया है कि प्रार्थिया रूकमी देवी पत्नी श्री उदय राम, अपने स्वयं के नाम को परिवार अभिलेख में मुताबिक राजस्व अभिलेख पटवार वृत्त टटियाना व अपने आधार कार्ड अनुसार कलमी पत्नी उदय राम की जगह सही नाम रूकमी देवी पत्नी उदय राम दर्ज कराना चाहती है ।

उपरोक्त प्रकरण पर छानबीन रिकॉर्ड करवाने हेतु क्षेत्रीय कर्मचारियों को प्रेषित किया गया। छानबीन रिपोर्ट क्षेत्रीय कर्मचारियान अनुसार पाया गया कि पटवार वृत्त टटियाना में उक्त प्रार्थिया का नाम रूकमी देवी पत्नी उदय राम दर्ज है जोकि सही दर्ज है ।

अतः सर्वसाधारण को इस इश्तहार के मार्फत सूचित किया जाता है कि इस बारे यदि किसी को कोई उजर/एतराज हो तो वह दिनांक 30-04-2021 से पूर्व या दिनांक 30-04-2021 को प्रातः 11.00 बजे अदालत हजा स्थित कमरऊ में असालतन या वकालतन हाजिर आकर दर्ज करवा सकता है । अन्यथा उजर/एतराज पेश न होने की सूरत में उक्त नाम दुरुस्ती परिवार अभिलेख में दर्ज करने के आदेश पारित कर दिये जायेंगे।387 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2021/30 चैत्र, 1943 आज दिनांक 30-04-2021 को मेरेे हस्ताक्षर व कार्यालय मोहर अदालत द्वारा जारी किया गया। मोहर।
