अधिसूचना

संख्याःटीएसएम ए(3)-2/2018-II.—हिमाचल प्रदेश जल-क्रीड़ा और सहबद्ध क्रियाकलाप नियम, 2019 के प्रारूप को हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) की धारा 64 की अपेक्षानुसार जनसाधारण से आक्षेप (पों)/सुझाव (वों) को आमन्त्रित करने हेतु, 16—राजपत्र/2021-27-04-2021 (469) 470 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 अधिसूचना संख्या टी0एस0एम0 ए(3)-2/2018, तारीख 22 नवम्बर, 2019 द्वारा राजपत्र, हिमाचल प्रदेश में तारीख 6 दिसम्बर, 2019 को प्रकाशित किया गया था;

और नियत अवधि के दौरान इस निमिा कोई आक्षेप/सुझाव प्राप्त नहीं हुआ है/हुए हैं;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) की धारा 64 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

अध्याय-1

प्रारम्भिक

1. संक्षिप्त नाम, विस्तार और प्रारम्भ.—(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश जल-क्रीड़ा और सहबद्ध क्रियाकलाप नियम, 2021 है।

(2) इन नियमों का विस्तार सम्पूर्ण हिमाचल प्रदेश राज्य पर होगा।

(3) ये नियम, राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त हाेंगे। 2. परिभाषाएं.--(1) इन नियमों में, जब तक कि कोई बात विषय या सन्दर्भ के विरूद्ध न हो,- (क) "अधिनियम" से, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) अभिप्रेत है;

(ख) "सहबद्ध क्रियाकलाप" से जल-क्रीड़ा से सम्बन्धित सहबद्ध क्रियाकलाप अभिप्रेत हैं और इसके अन्तर्गत देसी नौका पर नौका विहार, चप्पू नौका विहार, विद्युत/गति/इंजन चालित नौकायन नौका विहार, शिकारा (हाउस बोट) पर नौका विहार, पोत पर अवकाश पर्यटन या कोई अन्य ऐसे क्रियाकलाप भी हैं, जो सरकार द्वारा समय-समय पर अधिसूचित किए जाएं;

(ग) "प्रचालन-क्षेत्र" से, नियम 9 के अधीन गठित समिति द्वारा प्रचालन के लिए, अनन्य रूप से या अन्य प्रचालक (कों) के साथ, चिन्हित जल क्षेत्र का भाग अभिप्रेत है;

(घ) "संगम" से, हिमाचल प्रदेश सोसाइटी रजिस्ट्रीकरण अधिनियम, 2006 के अधीन सोसाइटी के रूप में रजिस्ट्रीकृत कोई संगम अभिप्रेत है;

(ङ) "प्राधिकृत अधिकारी/कर्मचारी" के अन्तर्गत पर्यटन विभाग का आयुक्त, निदेशक/अतिरिक्त या संयुक्त निदेशक/उप-निदेशक/सहायक पर्यटन विकास अधिकारी/होटल निरीक्षक है;

(च) "नौका" से, देसी नौका, खेई जाने वाली नौका और चप्पू (पैडल) चालित नौका अभिप्रेत है;

(छ) "केवट" के अन्तर्गत नौका चलाने के लिए अर्हित और प्रशिक्षित व्यक्ति होगा;

(ज) "किसी क्षेत्र की धारण क्षमता" से, जल-क्रीड़ा इकाइयों की कुल संख्या अभिप्रेत है, जिसे उस क्षेत्र में सुरक्षित रूप से प्रचालन करना अनुज्ञात किया जा सकता है ;

(झ) "आयुक्त या निदेशक" से, यथास्थिति, आयुक्त या निदेशक, पर्यटन, हिमाचल प्रदेश अभिप्रेत है;

() "कर्मीदल-सदस्य" से, केवट, मोटर नौका चालक और जीवन रक्षक (लाइफ गार्ड) से अन्यथा कोई व्यक्ति अभिप्रेत है, जो जल-क्रीड़ाओं और सहबद्ध क्रियाकलापों के संचालन में सहायता करता है और प्रचालन के दौरान साथ रहता है;

(ट) "दिन" से, सुर्योदय से सूर्यास्त तक ही अवधि अभिप्रेत है;

(ठ) "उपस्कर" से, जलक्रीड़ा इकाइयों से अन्यथा जल-क्रीड़ा और सहबद्ध क्रियाकलापों के संचालन में उपयोग की जा रही/उपयोग किए जाने के लिए अपेक्षित कोई वस्तु अभिप्रेत है;

(ड) "अनुकूल मौसम परिस्थितियों" से, भोर की वह अवधि अभिप्रेत है, जब वर्षा नहीं हो रही होती है और हवाएं अपनी सामान्य गति से बह रही होती हैं;

(ढ) "प्ररूप" से, इन नियमों से संलग्न प्ररूप अभिप्रेत है;

(ण) "सरकार" से, हिमाचल प्रदेश सरकार अभिप्रेत है;

(त) "मोटर नौका चालक" से, मोटर नौका या कोई जल-क्रीड़ा मशीन जिसमें इंजन लगा हो, को चलाने के लिए अर्हित और प्रशिक्षित व्यक्ति अभिप्रेत है;

(थ) "ऑपरेटर" से, ऐसा जल-क्रीड़ा और सहबद्ध क्रियाकलाप ऑपरेटर चाहे कोई व्यक्ति या कम्पनी या संगम या सोसाइटी या स्थानीय प्राधिकरण अभिपे्रत हैं; जो इन नियमों के अधीन जल-क्रीड़ा और सहबद्ध क्रियाकलाप कार्यान्वित करने के लिए अधिनियम के अधीन इस रूप में रजिस्ट्री—त हैं;

(द) "प्रचालन" से, इन नियमाें के अधीन किए जाने वाले या किए गए जल-क्रीड़ा और सहबद्ध क्रियाकलाप अभिप्रेत हैं;

(ध) "सहभागी" से, ऐसा /ऐसे व्यक्ति अभिप्रेत है/हैं, जो प्रचालन में सहभागी है/हैं;

(न) "विहित" से, इन नियमों द्वारा विहित अभिप्रेत है;

(प) "विहित प्राधिकारी" से, अधिनियम की धारा 3 के खण्ड (ठ) के अधीन राज्य सरकार द्वारा अधिसूचित प्राधिकारी अभिप्रेत है;

(फ) "विद्युत नौका" से, अवकाश-पर्यटन पर पर्यटकों/सहभागियाें को ले जाने के लिए या वेक बोर्ड, वाटर स्की, फन राइड उपकरण जैसे बनाना नौका आदि को खींचने के लिए प्रयोग की जाने वाली कोई गति नौका, मोटर नौका और इंजन लगी कोई यान्त्रिक नौका अभिप्रेत है;

(ब) "स्वागत कक्ष एवं टिकट कांउटर" से, तकनीकी समिति द्वारा पोतारोहण स्थल के समीप प्रचालक के लिए सीमांकित अस्थायी स्थल अभिप्रेत है;

(भ) इन नियमों के प्रयोजन के लिए "उपयुक्त काल (सीजन)" से, 15 जुलाई से 15 सितम्बर तक की अवधि, तकनीकी समिति द्वारा प्रचालन के लिए अनुमोदित नहीं की गई अवधि और असाधारण परिस्थितियों में संबंधित जिला मजिस्ट्रेट द्वारा विनिर्दिष्ट रूप से प्रतिषिद्ध अवधि को अपवर्जित करते हुए, सम्पूर्ण वर्ष अभिप्रेत है;

(म) "धारा" से, अधिनियम की धारा अभिप्रेत है;

472 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (य) "सोसाइटी" से, हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968 के अधीन रजिस्ट्रीकृत कोई सहकारी सोसाइटी अभिप्रेत है;

(यक) "अनुसूची" से, इन नियमों से संलग्न अनुसूची अभिप्रेत है ;

(यख) "तकनीकी समिति" से, नियम 9 के अधीन आयुक्त द्वारा गठित समिति अभिप्रेत है;

(यग) "जल क्षेत्र" के अंतर्गत बांध जलाशय, प्राकृतिक और कृत्रिम झीलें/तालाब, नदियां और जलधाराएं हैं;

(यघ) "जल-क्रीड़ाओं" से, वेक बोर्डिंग, वाटर स्कींग, जैट स्कींग, स्काई बोर्डिंग, वाटर स्कूटर, फन राइड जैसे टयूब राइड, बनाना राइड, रिंगो राइड, डॉनट राइड, रोइंग, क्याकिंग और कनोइंग अभिप्रेत है ;

(यङ) "जल-क्रीड़ा इकाइयों" से, जल-क्रीड़ा और सहबद्ध क्रियाकलापों के उपस्कर जैसे देसी नौका, विद्युत नौका, शिकारा, क्रूज, वाटर स्कूटर, कायाक, रो, डोंगी और सवारी आदि के प्रचालन के लिए उपयोग किए जाने वाले अन्य सहायक उपस्करों के भाग अभिपे्रत है ; और (यच) "शिकारा (हाउस बोट)" से ऐसा शिकारा (हाउस बोट) अभिप्रेत है जो मुख्यतः आवास के प्रयोजनार्थ परिकल्पित या उपान्तरित किया गया हो किन्तु जिसमें से कुछेक शिकारे (हाउस बोटस) इंजन चालित नहीं होते हैं, क्योंकि वे सामान्यतः किसी नियत बिन्दु (स्थान) पर रस्सी से बांधकर, खड़ें रखे जाते हैं और प्रायः उपयोगिताएं प्रदान करने के लिए जमीन पर रस्सी से खूँटी से बांधे जाते हैं, तथापि इनमें अधिकतर अपनी ही ऊर्जा से प्रचालनीय हो सकते हैं।

(2) समस्त अन्य शब्दों और पदाें के जो इन नियमों में प्रयुक्त हैं, किन्तु परिभाषित नहीं हैं, वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैं।

3. जल-क्रीड़ाओं और सहबद्ध क्रियाकलापों के लिए जल क्षेत्रों की अधिसूचना.--जल-क्रीड़ाओं और सहबद्ध क्रियाकलापों का प्रचालन अनुसूची-I में सूचीबद्ध जलक्षेत्रों में तकनीकी समिति द्वारा सीमांकित प्रचालन क्षेत्र में संचालित किया जाएगा। राज्य सरकार, राज्य में जल-क्रीड़ा और सहबद्ध क्रियाकलापों के संचालन के लिए नए जल क्षेत्रों को अधिसूचित कर सकेगी और अधिसूचित सूची में से जलक्षेत्रों को अपवर्जित भी कर सकेगी। तथापि, तकनीकी समिति नए जल क्षेत्राें की पहचान करने और उनमें जल-क्रीड़ाआें और सहबद्ध क्रियाकलापों के प्रचालन के लिए अनुमोदन हेतु आयुक्त/निदेशक पर्यटन को सिफारिश करने के लिए सक्षम होगी।

अध्याय-2

रजिस्ट्रीकरण

4. जल-क्रीड़ा और सहबद्ध क्रियाकलाप ऑपरेटर के रजिस्ट्रीकरण के लिए आवेदन.—(1) जल-क्रीड़ा और सहबद्ध क्रियाकलापों के ऑपरेटर के रूप में कार्य करने का आशय रखने वाला कोई व्यक्ति आगामी सीजन के लिए प्रत्येक वर्ष जनवरी/फरवरी और जुलाई/अगस्त के महीनों में विहित प्राधिकारी के पक्ष में 2000/- रुपए के मांगदेय ड्राफ्‌ट और इन नियमों के अनुसार अपेक्षित दस्तावेजों सहित रजिस्ट्रीकरण के लिए विहित प्राधिकारी को आवेदन कर सकेगा। विहित प्राधिकारी इस प्रकार प्राप्त आवेदनों की प्रारम्भ में संवीक्षा करेगा और उन्हें तकनीकी समिति के समक्ष रखेगा, जो प्रत्येक वर्ष 15 अप्रैल और 15 अक्तूबर से पूर्व दस्तावेजों की संवीक्षा, कार्यालय और उपस्करों का निरीक्षण कर्मीदल सदस्यों, लाइफ गार्डस, केवटों और मोटर बोट चालकों आदि की व्यावहारिक परीक्षा/शारीरिक परीक्षण संचालित करने के लिए समस्त पात्र ऑपरेटरों/आवेदकों को कम से कम पूरे 15 दिन का नोटिस देकर क्रमशः तारीख, समय और स्थान नियत करके, निरीक्षण करेगी ।473 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (2) जल-क्रीड़ाओं और सहबद्ध क्रियाकलापों के ऑपरेटर के रूप में कार्य करने का आशय रखने वाला कोई व्यक्ति, रजिस्ट्री करण के लिए वर्ष में किसी भी समय आवेदन कर सकेगा, तथापि उसके आवेदन पर जनवरी-फरवरी और जुलाई-अगस्त मास में ही विचार किया जाएगा ।

(3) विहित प्राधिकारी तकनीकी समिति के अनुमोदन के पश्चात ही, तीन वर्ष की अवधि के लिए, सम्बद्ध ऑपरेटर को प्ररूप-2 में रजिस्ट्रीकरण प्रमाण-पत्र जारी करेगा । रजिस्ट्रीकरण अनंतरणीय होगा । (4) तकनीकी समिति द्वारा अनुमोदित ऑपरेटर रजिस्ट्रीकरण प्रमाण-पत्र जारी किए जाने से पूर्व 50,000/- रुपए की रकम का प्रतिदेय प्रतिभूति निक्षेप देगा ।

(5) तकनीकी समिति द्वारा अनुमोदित ऑपरेटर रजिस्ट्रीकरण प्रमाण-पत्र जारी किए जाने से पूर्व, उपाबन्ध- 'क' के अनुसार क्षत्रिपूर्ति बंधपत्र निष्पादित करेगा;

(6) किसी भी ऑपरेटर को तब तक जल-क्रीड़ाएं एवं सहबद्ध क्रियाकलापों का प्रचालन अनुज्ञात नहीं किया जाएगा; जब तक कि;

(क) वह भारत का नागरिक नहीं है;

(ख) उसके पास अर्हित केवट और जीवन रक्षक (लाइफ गार्ड) न हो जिसने मान्यता प्राप्त राष्ट्रीय या राज्य संस्थान (संस्थानों) से बुनियादी और उच्च पाठयक्रम न किया हो;

(ग) उसके पास इन नियमों के अनुसार अर्हित मोटर बोट चालक न हो और जिसने मान्यता प्राप्त राष्ट्रीय या राज्य संस्थान (संस्थानों) से बुनियादी पाठ्‌यक्रम न किया हो;

(घ) उसके पास जल-क्रीड़ा क्रियाकलापों के प्रचालन के लिए स्थानीय कार्यालय न हो;

(ङ) उसके पास कम से कम तीन जल-क्रीड़ा इकाइयाँ और अन्य आवश्यक उपस्कर न हाें; और (च) उसके पास जल-क्रीड़ा क्रियाकलापों के प्रचालन के लिए कम से कम चार वर्ष के लिए पट्‌टे पर जल-क्रीड़ा इकाइयां और अन्य आवश्यक उपस्कर न हो।

(7) तीन वर्ष की अवधि के पश्चात्‌, यदि नवीकरण के लिए आवेदन रजिस्ट्रीकरण के अवसान की तारीख से 15 दिन पूर्व प्राप्त हो जाता है, रजिस्ट्रीकरण फीस के बराबर की फीस सहित प्रचालक के आवेदन पर विहित प्राधिकारी द्वारा रजिस्ट्रीकरण का नवीकरण किया जा सकेगा। यदि नवीकरण के लिए आवेदन पूर्वतर रजिस्ट्रीकरण के अवसान की तारीख के पश्चात्‌ 15 दिन के भीतर प्राप्त होता है तो उस दशा में आवेदक रजिस्ट्रीकरण के नवीकरण के लिए 100/- रुपए प्रतिदिन जुर्माना संदाय करने के लिए दायी होगा। यदि नवीकरण के लिए आवेदन उपरोक्त नियत अवधि के भीतर नहीं दिया जाता है तो उस दशा में ऑपरेटर को नए जल-क्रीड़ाएं एवं सहबद्ध क्रियाकलापों के ऑपरेटर के रूप में रजिस्ट्रीकरण हेतु नए सिरे से आवेदन करना होगा।

(8) रजिस्ट्रीकरण किसी भी समय ऑपरेटर के अनुरोध पर या तकनीकी समिति की सिफारिश पर रद्‌द किया जा सकेगा और प्रतिभूति की रकम की प्रतिपूर्ति ऑपरेटर के दायित्व, यदि कोई है, को समायोजित करने के पश्चात की जाएगी। यदि रजिस्ट्रीकरण प्रमाण-पत्र गुम या विकृत हो जाता है तो ऑपरेटर/अन्य सम्बद्ध व्यक्ति द्विप्रतीक रजिस्ट्रीकरण प्रमाण पत्र जारी करने के लिए आवेदन कर सकेगा। विहित प्राधिकारी, यथास्थिति, रजिस्ट्रीकरण प्रमाण-पत्र गुम हो जाने की दशा में शपथ पत्र और प्रथम इतिला रिपोर्ट की प्रति प्रस्तुत करने या मूल रजिस्ट्रीकरण प्रमाण-पत्र की विरूपित प्रति प्रस्तुत करने पर 500/- रुपए की फीस प्रभारित करके द्विप्रतीक रजिस्ट्रीकरण प्रमाण-पत्र जारी कर सकेगा।

5. केवट, मोटर बोट चालक और लाइफ-गार्ड का रजिस्ट्रीकरण.—(1) जल-क्रीड़ा क्रियाकलापों में केवट या मोटर बोट चालक या लाइफ गार्ड के रूप में भाग लेने की बांछा रखने वाला कोई व्यक्ति विहित 474 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 प्राधिकारी को रजिस्ट्रीकरण के लिए, अपेक्षित दस्तावेजों और 1000/- रुपए की फीस सहित, प्ररूप-3 में आवेदन करेगा।

(2) संबद्ध क्षेत्र के विहित प्राधिकारी का पूर्ण समाधान हो जाने पर कि आवेदक रजिस्ट्रीकरण के लिए अपेक्षित अर्हताएं और मानदण्डों को पूर्ण करता है और उसके आवेदन को तकनीकी समिति द्वारा संस्तुत किया गया है, तो वह प्ररूप-4 में तीन वर्ष की अवधि के लिए रजिस्ट्रीकरण प्रमाण-पत्र जारी करेगा।

(3) यदि नवीकरण के लिए आवेदन रजिस्ट्रीकरण के अवसान की तारीख से 15 दिन पूर्व प्राप्त होता है तो तकनीकी समिति की संस्तुति के पश्चात्‌ ही रजिस्ट्रीकरण फीस के बराबर संलग्न फीस सहित, आवेदन पर तीन वर्ष के पश्चात्‌ रजिस्ट्रीकरण नवीकृत किया जा सकता है। यदि नवीकरण के लिए आवेदन पूर्वतर रजिस्ट्रीकरण के अवसान की तारीख के पश्चात्‌ 15 दिन के भीतर प्राप्त होता है तो उस दशा में आवेदक रजिस्ट्रीकरण के नवीकरण के लिए प्रतिदिन 100/- रुपए के जुर्माने का संदाय करने के लिए दायी होगा। 6. केवट, मोटर बोट चालक और लाइफ गार्ड के लिए अर्हता.—(1) केवट, मोटर बोट चालक और लाइफ गार्ड इक्कीस वर्ष या इससे अधिक आयु का अवश्य होना चाहिए और किसी सरकारी चिकित्सा अधिकारी द्वारा यथा प्रमाणित चिकित्सीय रूप से उपयुक्त होना चाहिए।

(2) उसके पास बुनियादी प्रथम चिकित्सा उपचार कोर्स का विधिमान्य प्रमाण-पत्र हो और दसवीं की परीक्षा पास की होनी चाहिए।

(3) आवेदक का अच्छा नैतिक चरित्र होना चाहिए।

(4) अपेक्षित मानदण्डों के साथ अच्छे पिछले कार्य निष्पादन के रिकार्ड सहित सम्बद्ध क्रियाकलापों में दो वर्ष का अनुभव वांछित अर्हता है।

(5) जल-क्रीड़ा और सहबद्ध क्रियाकलापों के लिए केवट, मोटर बोट चालक और लाइफ गार्ड के लिए अतिरिक्त अर्हता निम्न प्रकार से हैः-

(क) केवट राज्य या केन्द्र सरकार द्वारा मान्यता प्राप्त जल-क्रीड़ा केन्द्र से बुनियादी और उच्च पाठ्‌यक्रम में प्रमाण-पत्र धारक अवश्य होना चाहिए।

(ख) मोटर बोट चालक हिमाचल प्रदेश में किसी प्राधिकृत अधिकारी से मोटर बोट चलाने की विधिमान्य अनुज्ञप्ति धारक होना चाहिए।

(ग) मोटर बोट चालक के पास एन0आई0डब्ल्यू0एस0 से विद्युत चालित नौका संभालने का (पी0बी0एच0) विधिमान्य प्रमाण-पत्र अवश्य होना चाहिए।

(घ) लाइफ गार्ड राज्य या केन्द्रीय सरकार द्वारा मान्यता प्राप्त जल-क्रीड़ा केन्द्र द्वारा जारी जल- क्रीड़ा में बुनियादी और उच्च पाठ्‌यक्रम प्रमाण-पत्र धारक होना चाहिए।

7. ई-मेल के माध्यम से रजिस्ट्रीकरण के लिए आवेदन.—यदि आवेदन अधिनियम और इन नियमों के अधीन यथा अपेक्षित सभी प्रकार से पूर्ण है तो विहित प्राधिकारी, ऑपरेटर, केवट, मोटर बोट चालक और लाइफ गार्ड के रूप में रजिस्ट्रीकरण/नवीकरण के लिए ई-मेल के माध्यम से आवेदन स्वीकार कर सकेगा और ई-मेल के माध्यम से अभिस्वीकृति देगा और आवेदक को ऑपरेटर तथा केवट, मोटर बोट चालक और लाइफ गार्ड के रूप में रजिस्टर/नवीकृत करने के लिए कार्यवाही कर सकेगा। ई-मेल के माध्यम से स्वीकृति की दशा में, विहित प्राधिकारी, नियम 4 और 5 के अधीन, यथास्थिति, रजिस्ट्रीकरण प्रमाण-पत्र या नवीकरण प्रमाण-पत्र जारी करते समय रजिस्ट्रीकरण/नवीकरण फीस उपयोक्ता फीस और प्रतिभूति निक्षेप स्वीकार कर सकेगा।475 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 8. रजिस्टर करने से इनकार करना.--विहित प्राधिकारी किसी ऑपरेटर या केवट, मोटर बोट चालक और लाइफ गार्ड, यदि वह इन नियमों के अधीन पात्र नहीं है, तो ऑपरेटर/आवेदक को सुनवाई का अवसर देने के लिए 15 दिन का नोटिस देने के पश्चात्‌ इस प्रभाव के आदेश द्वारा रजिस्टर करने से इन्कार कर सकेगा।

अध्याय-3

संस्थागत क्रियाविधि

9. तकनीकी समिति का गठन.--(1) आयुक्त/निदेशक अधिसूचना द्वारा प्रत्येक स्ट्रैच (आयाम)/साइट (स्थल) हेतु जल-क्रीड़ा और सहबद्ध क्रियाकलापों के संचालन के लिए एक तकनीकी समिति का गठन करेगा, जिसमें निम्नलिखित सदस्य होंगे, अर्थात :-

(i) निदेशक, पर्यटन एवं नागरिक उड्‌डयन अध्यक्ष;

(ii) निदेशक, अटल बिहारी वाजपेयी पर्वतारोहण और उपाध्यक्ष; सहबद्ध खेल संस्थान, मनाली।

(iii) सम्बद्ध क्षेत्र का पुलिस अधीक्षक या उसका प्रतिनिधि सदस्य;

(iv) सम्बद्ध क्षेत्र का उप-मण्डल मजिस्ट्रेट या उसका प्रतिनिधि सदस्य;

(v) सम्बद्ध क्षेत्र का वन अरण्यपाल या उसका प्रतिनिधि सदस्य;

(vi) सम्बद्ध क्षेत्र का मुख्य चिकित्सा अधिकारी या उसका प्रतिनिधि सदस्य;

(vii) सम्बद्ध क्षेत्र का सहायक निदेशक/उप-निदेशक (मत्स्य पालन) सदस्य; या उसका प्रतिनिधि।

(viii) हिमाचल प्रदेश लोक निर्माण विभाग का अधिशाषी सदस्य; कार्यपालक/सहायक अभियन्ता (यान्त्रिकी)।

(ix) सम्बद्ध जल-विद्युत परियोजना प्राधिकरण का प्रतिनिधि सदस्य;

(x) सम्बद्ध क्षेत्र का कमोडैण्ट, गृह रक्षक या उसका प्रतिनिधि सदस्य;

(xi) जल-क्रीड़ा केन्द्र का प्रभारी या उसका सम्य्‌क रूप से सदस्य; अर्हित प्रतिनिधि।

(xii) क्षेत्र की जल-क्रीड़ा संगम का एक सदस्य सदस्य; और (xiii) उप-निदेशक, पर्यटन एवं नागरिक उड्‌डयन या जिला सदस्य-सचिव । पर्यटन विकास अधिकारी और उसकी अनुपस्थिति में सम्बद्ध क्षेत्र का सहायक पर्यटन विकास अधिकारी।

(2) उपरोक्त तकनीकी समिति के अध्यक्ष या उपाध्यक्ष सहित कम से कम सात सदस्यों की उपस्थिति से बैठक की गणपूर्ति होगी। अध्यक्ष की अनुपस्थिति में उपाध्यक्ष बैठक आयोजित कर सकेगा और सदस्य-सचिव तकनीकी समिति की बैठक बुलाने के लिए उत्तरदायी होगा। 476 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (3) तकनीकी समिति वर्ष में कम से कम दो बार बैठक करेगी।

10. तकनीकी समिति के कर्त्तव्य और कृत्य.--(1) समिति निम्नलिखित के लिए उत्तरदायी होगी,- (i) नियम 3 के अनुसार जल-क्रीड़ा और सहबद्ध क्रियाकलापों, जहां प्रचालन सुरक्षित रूप से संचालित किए जा सकते हैं, के लिए प्रचालन हेतु नए जल क्षेत्रों की संस्तुति करना;

(ii) जल-प्रवाह, जल की अपेक्षित गहराई, जलक्रीड़ा क्रियाकलापों के प्रचालन के लिए क्षेत्र की धारण क्षमता, अन्य सुरक्षा विचारणों और विद्यमान अधिसूचित पोत मार्गों को ध्यान में रखते हुए जल-क्रीड़ा और सहबद्ध क्रियाकलापों, प्रशिक्षण, इंजन चालित प्रचालनों और हस्तचालित प्रचालनों के लिए पृथक क्षेत्रों/आयामों/मार्गों की पहचान करना और उनका सीमांकन करना। समिति पूर्वोक्त कारकों पर विचार करने के पश्चात्‌ विभिन्न जल-क्रीड़ा ऑपरेटरों के लिए प्रचालन का सामान्य क्षेत्र और सहबद्ध क्रियाकलापों के लिए विभिन्न अन्तरालों पर उसी मार्ग को सीमांकित कर सकेगी;

(iii) कार्यकलाप के लिए सीमांकित क्षेत्र/आयाम में, क्षेत्र/आयाम की उपयुक्तता और उस क्रियाक्लाप के लिए क्षेत्र/आयाम की धारण क्षमता के अनुसार अनुज्ञात की जाने वाली जल-क्रीड़ा इकाइयों की संख्या विनिर्दिष्ट करना;

(iv) जल-क्रीड़ा और सहबद्ध क्रियाकलापों के लिए आरोहण/अवरोहण और अन्य सुविधाओं जैसे बैठक/प्रतीक्षालय क्षेत्र/स्वागत-सह-टिकट कांउटर के लिए स्थल का निरीक्षण करना और उसका अनुमोदन करना;

(v) सीमांकित क्षेत्र में उस मौसम में उपलब्ध जल की गहराई के अनुसार जल-क्रीड़ा क्रियाकलापों और प्रशिक्षण के प्रचालन के लिए मौसम का अवधारण करना;

(vi) इन नियमों के अनुसार जल-क्रीड़ा क्रियाकलापों के प्रचालन के लिए ऑपरेटर की जल- क्रीड़ा इकाइयों और अन्य अपेक्षित उपस्करों का निरीक्षण और प्रमाणन करना;

(vii) जल-क्रीड़ा इकाइयों और अन्य अपेक्षित उपस्करों की व्यवहार्यता निर्धारण करने के लिए परीक्षणों का संचालन करना;

(viii) केवट, मोटर बोट चालक, लाइफ गार्डस और कर्मीदल-सदस्यों के जीवन वृत्त (बायो-डाटा) की संवीक्षा करना और प्रचालनों के लिए उनकी विशेषज्ञता और चिकित्सीय उपयुक्तता अभिनिश्चित करने के आशय से उनकी शारीरिक जांच/परीक्षण का संचालन करना और रजिस्ट्रीकरण प्रमाण-पत्र को जारी करने की सिफारिश करना;

(ix) अन्य क्रीड़ाओं/कार्यकलापों को जल क्रीड़ा और सहबद्ध क्रियाकलापों के रूप में अधिसूचित करने के लिए पहचान करना और सिफारिश करना;

(x) यात्राओं/समय/दूरी आदि के संबंध में प्रत्येक जल-क्रीड़ा क्रियाकलाप के लिए पर्यटकों/सहभागियों से प्रभारित की जाने वाली दरों की विहित प्राधिकारी को संस्तुति करना। तथापि, विहित प्राधिकारी इसके द्वारा संस्तुत दराें की बाबत मामले को विशिष्ट प्रेक्षण देते हुए तकनीकी समिति को पुनर्विचार हेतु भेज सकेगा। पुनर्विचार के पश्चात उठाए गए बिंदुओं का विनिर्दिष्टतया प्रत्युत्तर देते हुए तकनीकी समिति का विनिश्चय अंतिम होगा;

(xi) सुरक्षा अपेक्षाओं के अनुसार जल-क्रीड़ा और सहबद्ध क्रियाकलापों के लिए सुरक्षा नाव(वों)/टीम (मों) की व्यवस्था के लिए संस्तुति करना। समिति ऑपरेटरों के लिए संयुक्ततः सीमांकित किसी क्षेत्र के लिए केवल देसी नौकाएं/चप्पू-चालित नौकाओं के477 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 माध्यम से उपयोजित/संचालित सहबद्ध क्रियाकलापों के लिए, संयुक्त रक्षा नाव(वों)/टीम(माें) की व्यवस्था की संस्तुति कर सकेगी। ऐसी दशा में ऐसे ऑपरेटर रक्षा नाव(वों)/टीम (मों) के प्रचालन और अनुरक्षण के लिए संयुक्ततः उत्तरदायी होंगे। यदि ऐसे ऑपरेटर रक्षा नाव(वों)/टीम(मों) के प्रचालन/अनुरक्षण में संयुक्ततः असफल रहते हैं तो वे व्यक्तिगत रूप में रक्षा नाव(वों)/टीम(मों) का प्रचालन/अनुरक्षण करने के लिए उत्तरदायी होंगे; और

(xii) इन नियमों के अनुसार अर्हित प्रशिक्षकों, जल-क्रीड़ा इकाइयों और अन्य उपस्करों की व्यवहार्यता और अन्य सुरक्षा विचारणों के संबंध में संस्थान/संगठन/संगम/परिसंघ की सक्षमता अवधारित करने के पश्चात्‌ नियम 23 के अनुसार प्रशिक्षकों का संचालन करने के लिए संस्तुति करना;

(2) यदि जल क्षेत्र का क्षेत्र उसी या अन्य जिलाें के दो उप-मण्डलों की अधिकारिता के अधीन आता है तो समिति की अधिकारिता आरोहण के स्थल के अनुसार विनिश्चित की जाएगी।

(3) समिति के कृत्यों के निर्वहन के लिए गणपूर्ति अध्यक्ष सहित इसके कुल सदस्यों के आधे सदस्यों से होगी, किन्तु जल-क्रीड़ा केन्द्र और हिमाचल प्रदेश लोक निर्माण विभाग के यांत्रिक मण्डल का प्रतिनिधित्व करने वाले सदस्यों की उपस्थिति अनिवार्य होगी।

11. विनियामक समिति का गठन और इसके कृत्य.--(1) आयुक्त/निदेशक, अधिसूचना द्वारा सम्बन्धित जिला के लिए जल-क्रीड़ा और सहबद्ध क्रियाकलापों के लिए निम्नलिखित सदस्यों से मिलकर बनने वाली एक विनायमक समिति का गठन करेगा, अर्थात :-

अध्यक्ष;

(i) उपायुक्त

(ii) निदेशक, अटल बिहारी वाजपेयी पर्वतारोहण उपाध्यक्ष; और सहबद्ध खेल संस्थान, मनाली।

(iii) सम्बद्ध क्षेत्र का उप-मण्डल मजिस्ट्रेट या उसका प्रतिनिधि सदस्य;

(iv) सम्बद्ध क्षेत्र का उप-पुलिस अधीक्षक या उसका प्रतिनिधि सदस्य;

(v) सम्बद्ध क्षेत्र का वन-मण्डल अधिकारी या उसका प्रतिनिधि सदस्य;

(vi) सम्बद्ध क्षेत्र का कमांडैण्ट, गृह रक्षक या उसका प्रतिनिधि सदस्य;

(vii) सम्बद्ध क्षेत्र का खण्ड चिकित्सा अधिकारी या उसका प्रतिनिधि सदस्य;

(viii) हिमाचल प्रदेश लोक निर्माण विभाग के सम्बद्ध क्षेत्र का सदस्य; अधिशाषी अभियन्ता (यान्त्रिकी)।

(ix) सम्बद्ध क्षेत्र का सहायक निदेशक/उप निदेशक (मत्स्यपालन) सदस्य; या उसका प्रतिनिधि।

(x) सम्बद्ध क्षेत्र के जल-क्रीड़ा संगम का अध्यक्ष या उसका प्रतिनिधि सदस्य; और (xi) उप-निदेशक, पर्यटन एवं नागरिक उड्‌डयन या जिला पर्यटन सदस्य-सचिव । विकास अधिकारी और उसकी अनुपस्थिति में सहायक पर्यटन विकास अधिकारी। 478 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (2) उपरोक्त विनियामक समिति के अध्यक्ष अपनी शक्तियों को उपाध्यक्ष को सौंप सकते हैं जो उनकी अनुपस्थिति में बैठकों की अध्यक्षता करेंगे। बैठक के संचालन के लिए कम से कम आठ सदस्यों की उपस्थिति से बैठक की गणपूर्ति होगी।

(3) समिति त्रैमासिक बैठक आयोजित करेगी।

12. विनियामक समिति के कृत्य.--विनियामक समिति निम्नलिखित कृत्यों का अनुपालन करेगी, अर्थातः-

(1) समिति, जिले में जल-क्रीड़ा और सहबद्ध क्रियाकलापों के विनियमन के लिए पूर्ण नियन्त्रण करेगी;

(2) समिति समय-समय पर नियमों में वर्णित जल-क्रीड़ा और सहबद्ध क्रियाकलापों के सुरक्षित संचालन के लिए मार्गदर्शक सिद्धान्त और परामर्श, यदि कोई है, जारी कर सकेगी;

(3) समिति प्रचालन के दौरान इन नियमों का अनुसरण सुनिश्चित करने के लिए आकस्मिक निरीक्षण का संचालन कर सकेगी; और

(4) जल-क्रीड़ा एवं सहबद्ध क्रियाकलापों के सम्बंध में कोई अन्य कृत्य जो सरकार द्वारा समय-समय पर सौंपे जाएं ।

अध्याय-4

सुरक्षा उपाय

13. सामान्य सुरक्षा मानदण्ड.--ऑपरेटर सुनिश्चित करेगा कि, -

(1) जल7क्रीड़ा एवं सहबद्ध क्रियाकलापों का प्रचालन केवल सीमांकित क्षेत्रों/मार्गों में ही कार्यान्वित किया जाए;

(2) प्रचालन दिन के दौरान केवल अभिहित मौसमों और अनुकूल मौसम में कार्यान्वित किए जाएं;

(3) प्रचालनों के लिए इन नियमों के अनुसार अर्हित जन-शक्ति नियोजित की जाए और समस्त कर्मीदल सदस्य इन नियमों के अनुसार तैराक हो;

(4) समस्त जल-क्रीड़ा कार्यकलापों का संचालन अर्हित लाइफ गार्ड की उपस्थिति में किया जाए और उसके सक्रिय पर्यवेक्षणाधीन किया जाएं;

(5) समस्त सहभागियों, मोटर बोट चालकों, लाइफ गार्डस और कर्मीदल सदस्यों को प्रचालन के दौरान पूर्ण सुरक्षा परिधान और जीवन रक्षक जैकटें उपलब्ध करवाई जांए;

(6) जल-क्रीड़ा इकाई की वहन क्षमता प्रमुखतया प्रदर्शित की गई है और वहन क्षमता की सीमा से अधिक कभी भी न हो;

(7) सहभागियों के लिए घाट या पीपे के पुल (नौकासेतु) आदि के रूप में आरोहण/अवरोहण की सुरक्षित व्यवस्थाएं की जाएं;

(8) प्रत्येक भ्रमण के प्रारम्भ पर समस्त सहभागियों के लिए सम्पूर्ण सुरक्षा अल्पगोष्ठी अनिवार्यतया की जाएं;

(9) किसी भी सहभागी को किसी भी प्रचालन के प्रारम्भ से पूर्व उपाबन्ध-ख के अनुसार बचनबंध किए बिना भाग लेना अनुज्ञात न किया जाए;

(10) किसी भी व्यक्ति को, सिवाय देशी नाव/मोटर चालित नौका पर, नौका विहार करने के लिए किसी प्रचालन में भ्रमण/भाग लेना तब तक अनुज्ञात नहीं किया जाएगा जब तक कि उसने अठारह वर्ष की आयु प्राप्त न की हो और पांच वर्ष से अधिक आयु के बच्चों का देशी नाव/मोटर चालित नौका पर नौका विहार केवल तभी अनुज्ञात किया जाए यदि उसके साथ उसके माता-पिता में से कम से कम एक उपस्थित हो और माता-पिता ने इन नियमों के अनुसार बचनबंध दे दिया है;

(11) ईंधन समुचित अग्निशमन सुविधाओं सहित अच्छी तरह से हवादार भण्डार में रखा गया है ;

(12) देशी नाव/ईंजन चालित नौका का पर्याप्त तरण क्षमता वाला समुचित आकार हो और आशयित क्रियाकलाप के लिए समुचित हो तथा निम्नलिखित सहित किसी राष्ट्रीय या अन्तर्राष्ट्रीय प्रमाण अभिकरणों द्वारा प्रमाणित/अनुमोदित हो :-

(क) यू. एस. कोस्ट गार्ड।

(ख) सी.ई. (कम्यूनेट यूरोपीन)।

(ग) ई.एन. (यूरोपियन नार्मज़)।

(घ) आई.एस.ओ. (इण्टरनेशनल स्टैण्डर्ज ऑरगेनाइजेशन)।

(ङ) आई.आर.एस. (इण्डियन रजिस्टर ऑफ शिपिंग)।

(च) महानिदेशक, भारतीय पोत परिवहन।

(छ) बी.आई.एस. (ब्यूरो ऑफ इण्डियन स्टैण्डर्ज़)।

(ज) एस.ओ.एल.ए.एस. (सेफटी ऑफ लाईफ एट सी)।

(झ) यू.एल. (अण्डरराइडरज लैबोरटेरीज)।

() आई.एम.ओ. (इण्टरनेशनल मैरीटाइम ऑरगेनाइजे़शन)।

(ट) ई.सी. (यूरोपियन कमीशन)।

(ठ) ई.यू. (यूरोपियन यूनियन)।

(ड) एम.ई.डी. (मैरीन इक्विपमैण्ट डायरैक्टिव)।

(ढ) एफ.टी.एल. (फ्लीटबुड टेस्टिंग लैबोरटरी)।

(ण) यू.के.ए.एस. (यूनाइटेड किंगडम एक्रीडीटेश्न सर्विसीज)।

(त) कोई अन्य राष्ट्रीय या अन्तर्राष्ट्रीय प्रमाणन अभिकरण। 480 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (13) उपयोग किए गए उपस्कर, क्या करें या क्या न करें, बचाव (रक्षा) और आपातकालीन प्रक्रियाओं पर प्रकाश डालते हुए समस्त जल-क्रीड़ाएं क्रियाकलापों का प्रारम्भ संपूर्ण सुरक्षा अल्पगोष्ठी सहित होता है;

(14) हृदय की कमजोर स्थिति, मिर्गी, फेफड़ों के विकार, दमा से पीड़ित सहभागियों और गर्भवती महिलाओं का भाग लेना अनुज्ञात नहीं किया जाएगा;

(15) कोई भी व्यक्ति, जिसने किसी भी रूप या मात्रा में एल्कोहल या अवैध औषधि (मादक द्रव्य) का उपयोग किया है, को प्रचालन में भाग लेना अनुज्ञात/जारी रखना अनुज्ञात नहीं किया जाएगा;

(16) समस्त सहभागी समुचित पोशाक में हो और भारी पहनावे (कपड़े) और साड़ियां पहनी हुई महिलाएं, कण्ठ लंगोटो, लम्बे घाघरों और थ्री-पीस-सूट पहने हुए व्यक्ति को सहभागिता अनुज्ञात नहीं की जाएगी;

(17) जब कभी ग्राहक अवरोहण नौकासेतु/घाट इत्यादि पर पहुंचता है तो मददगार तैयार रहे ;

(18) समस्त कर्मीदल सदस्यों और मद्‌दगारों के पास राज्य या केन्द्रीय सरकार द्वारा अधिकृत जल-क्रीड़ा केन्द्रों से बुनियादी पाठयक्रम में प्रमाण-पत्र हो ; और

(19) रक्षा नाव अन्य जल-क्रीड़ा क्रियाकलापों के लिए उपयोग न की जाए और नाव के चारों ओर भार रेखा और ऊपरी तल के मध्य में लाल रंग से लिखे हुए रक्षा नाव शब्द होने चाहिए ।

14. जल-क्रीड़ा और सहबद्ध क्रियाकलाप-प्रचालन के कार्यान्वयन और सुरक्षा मानदण्डों के लिए अपेक्षित उपस्कर.—(1) तकनीकी समिति, जल-क्रीड़ा ईकाई(यों) और अन्य समस्त सहायक मशीनरी, जीवन रक्षक उपकरणों, अग्निशामक उपकरणों और अन्य उपस्करों की जांच पड़ताल करेगी और उन्हें उप-निदेशक पर्यटन एवं नागरिक उड्‌डयन या सम्बद्ध क्षेत्र के जिला पर्यटन विकास अधिकारी के माध्यम से संख्यांकित करवाएगी।

(2) प्रत्येक ऑपरेटर को जल-क्रीड़ा और सहबद्ध क्रियाकलाप के कार्यान्वयन को अनुज्ञात करने से पूर्व उसको निम्नलिखित उपस्कार (उपस्करों) की व्यवस्था करनी होगी, अर्थात :-

अ. किसी गैर-मोटर चालित क्रियाकलाप को निम्नलिखित माध्यम से कार्यान्वित किया जाएः- (I) देशी नाव/खेने वाली नाव/चप्पू चालित नाव :-

(क) नाव रिसाव रहित होनी चाहिए ;

(ख) भार-रेखा स्पष्टतया चिन्हित की जानी चाहिए और भार क्षमता राष्ट्रीय जल-क्रीड़ा संस्थान (एन.आई.डब्ल्यू.एस.) द्वारा विहित मानदण्डाें के अनुसार तकनीकी समिति द्वारा अवश्य अनुमोदित होनी चाहिए। किसी भी परिस्थिति में नाव जलमग्न भार-रेखा के साथ नहीं चलाई जाएगी;

(ग) नाव में भार समान रूप से बिखेरा होना चाहिए;

(घ) नावों में नियम 15 के अनुसार प्रथम उपचार पेटी होनी चाहिए; और

(ङ) नावों पर पर्याप्त संख्या में फेंकने योग्य रक्षा उपकरण रखें गए हैं।481 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (II) खेने वाली नाव/पैडल से चलाई जाने वाली नाव/पैर से चलाई जाने वाली नाव चलाना :

(क) पैडल से चलाई जाने वाली नाव और पैर से चलाई जाने वाली नाव के डिजाइन और विनिर्माण के लिए आई.आर.एस. (इण्डियन रजिस्टर ऑफ शिपिंग) प्रमाणन के अधीन विनिर्मित की जानी चाहिए;

(ख) ऑपरेटर, ग्राहकों को स्वतन्त्र रूप से प्रचालन के लिए पैडल से चलने वाली नावों को देने से पूर्व पर्याप्त परिचायक प्रशिक्षण प्रदान करने के लिए उत्तरदायी होगा। परिचायक सफलतापूर्वक पूर्ण होने पर बचनबंध पर अभिलिखित किया जाएगा;

(ग) उस अवधि तक जिसके दौरान पैडल से चलाई जाने वाली नाव/पैर से चलाई जाने वाली नाव जल में हो तो सम्पूर्ण प्रचालन के दौरान चालक सहित एक रक्षक नाव तैयार होनी चाहिए। प्रचालन का क्षेत्र स्पष्टतया परिनिश्चित किया जाएगा और रक्षक नाव के ऑपरेटर की दृष्य परिसीमा में होना चाहिए;

(घ) ऑपरेटर सहभागियों के ब्योरोें की लॉग बुक का अनुरक्षण करेगा;

(ङ) यदि किसी पर्यटक के पास पैडल से चलाई जाने वाली नाव/पैर से चलाई जाने वाली नाव है और वह उसे सीमांकित क्षेत्र में चलाना चाहता है तो वह 1000/- रुपए की फीस के संदाय द्वारा विहित प्राधिकारी के पास पैडल से चलाई जाने वाली नाव को रजिस्टर करेगा और रजिस्ट्रीकरण तीन मास के लिए विधिमान्य होगा;

आ मोटर चालित और खींचने (घसीटने) वाले क्रियाकलापः--

(I) विद्युत चालित नाव/मोटर चालित नाव/रफ्तार से चलने वाली नाव/समुद्र बिहारः (क) ये डिजाइन और विनिर्माण और समस्त अन्य सहायक मशीनरी रक्षा/सुरक्षा उपकरणों, अग्निशामक उपकरणों के लिए आई.आर.एस. प्रमाणन के अधीन अवश्य विनिर्मित होनी चाहिए और किसी प्रचालन में प्रयुक्त की जाने के लिए वांछित अन्य उपस्कर आई.आर.एस. द्वारा विहित मानदण्डों और मानकों के अनुसार भारत में रजिस्ट्रीकृत किसी कम्पनी द्वारा विनिर्मित होंगे या समान/विहित गुणवत्ता मानदण्डों और मानकों वाली ख्याति प्राप्त किसी अन्तर्राष्ट्रीय संगठन/कम्पनी से आयातित होने चाहिए। पोत, हिमाचल प्रदेश तरण (फैरीज़) अधिनियम, 1956 के अधीन सक्षम प्राधिकारी द्वारा अवश्य रजिस्ट्रीकृत होना चाहिए और ऑपरेटर को अधिनियम और तद्‌धीन विरचित नियमों की अपेक्षाओं का अनुपालन अवश्य करना चाहिए ;

(ख) नाव में, या तो बाहर की ओर या अन्दर की ओर, इंजन फिट किया हो ;

(ग) ईंजन की अश्वशक्ति आराम देह रफ्तार में प्रचालित किए जाने के लिए नाव/पोत में बैठने की क्षमता के अनुपातिक होनी चाहिए। किसी भी परिस्थिति में नाव/पोत जलमग्न भार-रेखा के साथ नहीं चलाया जाएगा;

(घ) ईंजन खराब होने की दशा में सभी प्रकार की नावाें में या तो बजरे द्वारा या खेने द्वारा नदी के किनारे नाव बांधने की व्यवस्था होनी चाहिए ;

(ङ) सीटें (बैठने के स्थान) आराम देह और पर्याप्त पैर रखने के स्थान वाली होनी चाहिए ;

(च) नाव में भार (वजन) सदैव समान रूप से विखराया होना चाहिए;

482 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (छ) नाव में नियम 15 के अनुसार प्रथम उपचार पेटी होनी चाहिए;

(ज) नावों आदि पर पर्याप्त संख्या में फेंकने योग्य रक्षा उपकरण (रक्षा बोया) रखे गए हों;

(झ) नाव आदि पर पर्याप्त अग्निशमन व्यवस्थाएं की गई हों ; और

() प्रचालन की अवधि के दौरान एक चालक सहित रक्षक नाव तैयार होनी चाहिए। प्रचालन क्षेत्र स्पष्टतया परिनिश्चित होना चाहिए और रक्षक नाव ऑपरेटर की दृष्टि में होनी चाहिए ।

(II) विद्युत नाव का उपयोग करने वाली वाटर स्कीइंग और फन राईडज जिसके अंतर्गत स्की बोर्डिंग, वेकबोर्डिंग, वाटर स्कीइंग और फन राईडज जैसे ट्‌यूब राईड/बैनाना राईड/रिंगो राईड/डोनट राईड भी हैं;

(क) किसी प्रचालन में उपयोग में लाए जाने के लिए आशयित जलक्रीड़ा इकाई (इकाइयों) और अन्य सहायक मशीनरी, जीवन रक्षक उपकरण, अग्निशामक उपकरण और अन्य उपस्कर इनके लिए आई.आर.एस. द्वारा विहित गुणवत्ता मानदण्डों और मानकों के अनुसार भारत में रजिस्ट्रीकृत किसी कम्पनी द्वारा विनिर्मित किए जाने अपेक्षित है या विहित गुणवत्ता मानदण्डों और मानको के अनुसार पूर्व वर्णित वस्तुआें का विनिर्माण करने वाली किसी ख्याति प्राप्त अन्तर्राष्ट्रीय संगठन/कम्पनी से आयातित किए गए हैं।

(ख) उपयोग में लाई जाने वाली विद्युत चालित नाव पर्याप्त विद्युत शक्ति (न्यूनतम 40 हार्सपावर) (एच.पी.) वाली होनी आवश्यक है ।

(ग) रक्षक नाव के साथ, उस अवधि तक जिसके दौरान विद्युत नाव जल में है, एक चालक तैयार होना चाहिए। प्रचालन का क्षेत्र स्पष्टतया परिनिश्चित होना चाहिए और रक्षक नाव ऑपरेटर की दृष्टि में होना चाहिए।

(III) वाटर स्कूटर/जैट स्की/पर्सनल वाटर क्राफ्ट (पी. डब्ल्यू. सी.)

(क) वाटर स्कूटर/जैट स्कीइंग/पर्सनल वाटर क्राफ्ट (पी.डब्ल्यू.सी.) इनके लिए आई.आर.

एस. द्वारा विहित गुणवत्ता मानदण्डों और मानकों के अनुसार भारत में रजिस्ट्रीकृत किसी कम्पनी द्वारा विनिर्मित या विहित गुणवत्ता मानदण्डों और मानकों के अनुसार पूर्व वर्णित वस्तुओं के विनिर्माता किसी ख्याति प्राप्त अन्तर्राष्ट्रीय संगठन/कम्पनी से आयातित होने आवश्यक है;

(ख) इन जल-क्रीड़ा इकाइयों का प्रचालन सर्वथा क्षेत्र की परिनिश्चित परिसीमाओं में किया जाना चाहिए;

(ग) अन्य नावों जम्पिंग वेक बोटस के समीप या लहरों और घाट की ओर तेजी से जाना प्रतिषिद्ध है;

(घ) यात्रा किसी कुशल चालक द्वारा चालित होनी चाहिए और उसे यह सुनिश्चित करना होगा कि यात्रियों ने पूरी यात्रा के दौरान आरामदेह तरण क्षमता युक्त वस्त्र पहन रखें हों;

(ङ) कोई कुशल नौका चालक यात्रा के दौरान सदैव पीछे बैठा हो और वह यह सुनिश्चित करेगा कि सवारी द्वारा गतिसीमा और सुरक्षा अनुदेशों का अनुसरण किया जा रहा है;

(च) ग्राहक को जैट स्की के नियन्त्रणों और इनके हथालन के दौरान बुनियादी प्रक्रियाओं के संबंध में पूर्ण जानकारी दी जाएगी। ऐसी यात्रा के दौरान पीछे बैठे चालक यह सुनिश्चित करेंगे कि सवारी द्वारा गतिसीमा और सुरक्षा अनुदेशों का अनुसरण किया जा रहा है ताकि अन्य को दुर्घटना और क्षति से बचाया जा सके। यदि ग्राहक अनुदेशों की अनुपालना नहीं करता है तो चालक तुरन्त इसका नियन्त्रण अपने हाथ में लेगा। परिचय का सफलतापूर्वक पूर्ण होना बचनबंध पर अभिलिखित किया जाएगा ;

(छ) जैटस्की की इसके ग्राहक द्वारा स्वतन्त्र यात्रा राष्ट्रीय जल-क्रीड़ा संस्थान (एन.आई. डब्ल्यू.एस.) द्वारा जारी "जैट स्की'' परिचय जांच सूची के अनुसार केवल लघु जानकारी शिक्षा के संचालन के पश्चात्‌ ही अनुज्ञात की जा सकेगी। परिचय का सफलतापूर्वक पूर्ण होना सहभागीयों द्वारा नियम 13 (ix) के अनुसार दिए गए बचनबंध पर अभिलिखित किया जाएगा। अठारह वर्ष की आयु से कम बच्चों को स्वतन्त्र जैट स्की की सवारी करना अनुज्ञात नहीं किया जाएगा ;

(ज) बाहर लगी मोटराें वाले जैट स्कीज/वाटर स्कूटर (पी.डब्ल्यू.सी.) के पलट जाने की दशा में उनमें स्वतः ही ईंजन के बन्द होने की व्यवस्था होगी । यह समस्त ऑपरेटरों के लिए आवश्यक होगा कि जब वे क्राफ्ट पर हो, तो अपनी नाव को हर समय रस्सी से बांधे रखें। यदि ईंजन रस्सी को समुचित प्रकार से बिना बांधे चालू रहता है या यदि क्रियाविधि की अनदेखी की गई है, तो इसे सुरक्षा मानदण्डों के उल्लंघन के रूप में देखा जाएगा ; और

(झ) प्रचालन की सम्पूर्ण अवधि के दौरान एक चालक सहित रक्षक नाव तैयार रहेगी। प्रचालन का क्षेत्र स्पष्टतया परिनिश्चित किया जाएगा और यह रक्षक नौका ऑपरेटर की दृष्टि में होगी।

15. प्रचालक के कर्त्तव्य.--प्रचालक का कर्त्तव्य होगा कि.--

(i) जल-क्रीड़ा और सहबद्ध क्रियाकलापों के भ्रमण सहभागियों की जानकारी के लिए प्रचालन के स्थल और स्थानीय कार्यालय में प्ररूप-5 के अनुसार जानकारी प्रदर्शन करना;

(ii) प्रत्येक जल-क्रीड़ा इकाई की पहचान संख्या और वहन क्षमता को अंकित करके प्रदर्शित करना ;

(iii) इन नियमों में विहित सुरक्षा मानदण्डों का पालन करना ;

(iv) सहभागियों के लिए नाव और जल-क्रीड़ा मशीन की वहन क्षमता के अनुसार प्रति सहभागी पांच लाख रुपए तक का तृतीय पक्षकार बीमा सुनिश्चित करना;

(v) सहभागियों से प्रत्येक जल-क्रीड़ा क्रियाकलाप के लिए अनुमोदित दरें प्रभारित करना और उन्हें प्रमुखता से प्रदर्शित करना तथा जलक्रीड़ा क्रियाकलाप के लिए प्रभारित दर की रसीद प्रदान करना;

(vi) समस्त घटनाओं/दुर्घटनाओं की सम्बद्ध संगम/जिला प्रशासन/अध्यक्ष, तकनीकी समिति/उप-निदेशक पर्यटन एवं नागरिक उड्‌डयन को तुरन्त रिपोर्ट करना;

(vii) यह सुनिश्चित करना कि क्रियाकलाप केवल अनुकूल मौसम और दिन के दौरान ही किए जा रहे हैं और क्रियाकलाप केवल सीमांकित क्षेत्रों में ही किए जा रहे हैं;

(viii) ऑपरेटर स्वागत कक्ष एवं टिकट कांउटर और प्रत्येक नौका में कम से कम त्रिकोणीय पटिट्‌यों, विसंक्रमित पैड, गेज रोलर बैण्डेज़िज, प्रैशर बैण्डेज़िज, प्राथमिक उपचार चिपकने वाली पट्‌टी, खपचियां, कैंचिया युक्त प्रथम उपचार पेटी रखेगा ;

484 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (ix) पर्यावरण को स्वच्छ रखना और यह सुनिश्चित करेगा कि जल क्षेत्रों में प्रदूषण कारित न हो और जलीय जीवन को तेल छलकने, प्लास्टिक अपशिष्ट और किसी प्रकार के कूड़े-कचरे के कारण क्षति न हो और कूड़े को घाट/सीढ़ी, टिकट खिड़की के समीप रखा जाए ;

(x) उप-निदेशक पर्यटन/जिला पर्यटन विकास अधिकारी/सहायक पर्यटन विकास अधिकारी या उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा रजिस्ट्रीकरण प्रमाण-पत्र, सम्यक रूप से प्रमाणित/अनुमोदित दरों की प्रति को हर समय प्रचालन के स्थल पर और अपने कार्यालय में रखना ;

(xi) रजिस्ट्रीकरण के समय उपाबन्ध-क के अनुसार सरकार को क्षतिपूर्ति बंधपत्र प्रस्तुत करना ;

(xii) प्रचालन के प्रारम्भ से पूर्व उपाबन्ध-ख के अनुसार सहभागी से एक बचनबंध लेना ;

(xiii) उपाबन्ध-ग के अनुसार प्रत्येक जल-क्रीड़ा इकाई की एक लॉग बुक का अनुरक्षण करना, जिसमें उपयोग, निरीक्षणों, मुरम्मतों और ऑपरेटर द्वारा किए गए सुरक्षा उपायों का अभिलेख होगा। लॉग बुक उप-निदेशक पर्यटन/जिला पर्यटन विकास अधिकारी/सहायक पर्यटन विकास अधिकारी या उस द्वारा प्राधिकृत किसी अधिकारी द्वारा प्रमाणित द्विप्रतीक में सम्यक्‌ रूप से संख्यांकित की जाएगी;

(xiv) पर्यटन विभाग द्वारा सम्यक्‌ रूप से प्रमाणित शिकायत/सुझाव पुस्तिका का स्वागत काऊंटर पर रखना और उसका अनुरक्षण करना ;

(xv) उपाबन्ध-घ के अनुसार रसीद बुक का अनुरक्षण करना जो संदायों की द्विप्रतीक में रसीद के लिए सम्यक्‌ रूप से संख्यांकित हो ;

(xvi) यदि कम्प्यूटर का प्रयोग बिल बनाने/रसीद के लिए किया जा रहा है तो कम्प्यूटर पर समुचित अभिलेख और उसकी सॉफ्ट/हार्ड कॉपी का अनुरक्षण करना ;

(xvii) विहित प्राधिकारी या इसके प्रतिनिधि द्वारा समस्त बिल बुक्स और रजिस्टरों को सम्यक्‌ रूप से सत्यापित करवाना और इन्हें मांग पर प्राधिकृत अधिकारियों/कर्मचारियों को प्रस्तुत करना ;

(xviii) मांग पर प्राधिकृत अधिकारियों/कर्मचारियों को समस्त अभिलेख प्रस्तुत करना ;

(xix) रजिस्ट्रीकरण के किन्हीं निबन्धनों और शर्तों का उल्लंघन न करना ;

(xx) निम्नलिखित सुनिश्चित करना ;

(क) ज्वलनशील वस्तुओं का सुरक्षित भण्डारण ;

(ख) सुरक्षा नौका, प्रथम उपचार पेटी और अन्य अपेक्षित सुरक्षा उपस्करों की व्यवस्था ; और (ग) प्रचालन के दौरान मल्लाह, नौका चालक और जीवन रक्षक प्रमुखतया अपने रजिस्ट्रीकरण प्रमाण पत्र प्रदर्शित करे।

(xxi) नाव/विद्युत चालित नाव आदि का उपयोग केवल पर्यटन के लिए ही किया जा रहा है और सहभागी सर्वथा इन नियमों में अधिकथित मानदण्डों की अनुपालना कर रहे हैं ;

16. किसी दुर्घटना के मद्‌दे दावा.--राज्य सरकार/पर्यटन विभाग प्रचालन के दौरान किसी दुर्घटना, क्षति या जानी नुकसान के मद्दे किसी दावे के लिए किसी भी दशा में उत्तरदायी नहीं होगा।485 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 17. सहभागियों का आचरण.--(1) जल-क्रीड़ा क्रियाकलाप करते समय सहभागी;

(i) कोई भी खतरनाक वस्तुएं, जिससे आग लगने की संभावना हो, साथ नहीं ले जाएंगे;

(ii) कोई खाद्य पदार्थ, प्लास्टिक उत्पाद और कोई अन्य आपत्तिजनक वस्तुएं नहीं ले जाएगा ;

(iii) चालक/कर्मीदल के कर्त्तव्यों के निर्वहन में कोई बाधा नहीं डालेगा ;

(iv) जलक्रीड़ा इकाई/अन्य उपस्करों को क्षति नहीं पहुंचाएगा ;

(v) नशे में चूर या अपना ध्यान रखने में अव्यवस्थित या असमर्थ नहीं होगा ;

(vi) कोई उपताप (न्यूसेंस) नहीं करेगा या कोई अभद्रता का कार्य नहीं करेगा या असंसदीय भाषा का प्रयोग नहीं करेगा या साथी सहभागियों की सुख-सुविधा में हस्तक्षेप नहीं करेगा; और

(vii) किसी जल-क्रीड़ा इकाई में, यदि यह पहले से ही इसकी पूर्ण क्षमता तक लदी हुई है, सहभागिता अनुज्ञात करने के लिए हठ नहीं करेगा।

(2) आचरण के पूर्ववर्णित मानदण्डों के उल्लंघन की दशा में मल्लाह/नौका चालक/जल-क्रीड़ा इकाई का प्रभारी व्यक्ति जल-क्रीड़ा इकाई में प्रवेश से इन्कार या उसकी जल-क्रीड़ा जारी रखना अननुज्ञात कर सकेगा।

18. उपयोक्ता फीस का संग्रहण.--ऑपरेटर रजिस्ट्रीकरण करवाते समय निम्नलिखित फीस का संदाय करेगा/करेंगे :-

(i) नाव - दो सौ रुपए प्रति सीट प्रतिवर्ष।

(ii) मोटर चलित नौका - पांच हजार रुपए प्रतिवर्ष।

(iii) पोत (क्रूज) - पच्चीस हजार रुपए प्रतिवर्ष

(iv) कोई अन्य जल-क्रीड़ा - तीन हजार रुपए प्रति इकाई प्रतिवर्ष । इकाई

अध्याय-5

विविध उपबन्ध

19. संगमों की विरचना.--जल क्रीड़ा और सहबद्ध क्रियाकलापों का सुरक्षित रूप से संचालन करने के आशय से और समुचित समन्वयन तथा पारदर्शिता सुनिश्चित करने के लिए जल क्रीड़ा और सहबद्ध क्रियाकलापों के ऑपरेटर उप-मण्डल/जिला स्तरीय संगम बनाने और रजिस्टर करवाने के लिए स्वतन्त्र होंगे। संगम पर्यटन विभाग को समस्त संभव सहायता प्रदान करेंगे और जल-क्रीड़ा और सहबद्ध क्रियाकलापों के प्रचालन में शामिल समस्त सम्बद्ध सहभागियों के कल्याण के संवर्धन के लिए समुचित उपाय करेेंगे। संगम, प्रचालन के सीमांकित क्षेत्र और इसके पास-पड़ोस के पर्यावरण की स्वच्छता (सफाई) रखने और पारिस्थितिकी के संरक्षण के लिए उत्तरदायी होंगे।

20. निरीक्षण.--(1) विहित प्राधिकारी या विहित प्राधिकारी द्वारा विनिर्दिष्टतया प्राधिकृत सहायक पर्यटन विकास अधिकारी (ए.टी.डी.ओ.), इन नियमों में किए गए उपबंधों की अनुपालना सुनिश्चित करने के लिए अपनी-अपनी अधिकारिता में प्रत्येक वर्ष जनवरी और मार्च मास के मध्य प्रत्येक रजिस्ट्रीकृत ऑपरेटर का वार्षिक निरीक्षण का संचालन करेंगे। 486 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (2) विहित प्राधिकारी किसी भी समय या तो स्वप्रेरणा से या किसी शिकायत की प्राप्ति पर सुरक्षा मानदण्डों की अनुपालना सुनिश्चित करने के लिए जल-क्रीड़ा केन्द्र के तकनीकी प्राधिकारियों और सम्बद्ध हिमाचल प्रदेश लोक निर्माण विभाग (यांत्रिकी) के माध्यम से निरीक्षण संचालित करवा सकेगा।

(3) प्राधिकृत अधिकारी/कर्मचारी इन नियमों में किए गए उपबंधों की अनुपालना सुनिश्चित करने के लिए अपनी-अपनी अधिकारिता में किसी ऑपरेटर के निरीक्षण का संचालन कर सकेंगे।

21. पर्यटन विभाग के कर्त्तव्य और उत्तरदायित्व.--पर्यटन विभाग निम्नलिखित के लिए समुचित पग उठाएगा.--

(i) स्वरोजगार के अवसर सृजित करने के लिए जल-क्रीड़ा और सहबद्ध क्रियाकलापों के सम्बन्ध में कौशल की वृद्धि के लिए प्रशिक्षण का संचालन करना ;

(ii) जिन स्थानों पर पर्यटकों को सुविधाएं उपलब्ध करवाने के लिए जल-क्रीड़ा क्रियाकलापों का प्रचालन किया जा रहा है, वहां अवसंरचना का विकास करना;

(iii) जल-क्रीड़ा क्रियाकलाप के क्षेत्रों में सूचना बोर्ड़ों का प्रतिष्ठापन करना;

(iv) जल-क्रीड़ा और सहबद्ध क्रियाकलापों के ऑपरेटराें का डाटा बेस और विस्तृत सूची का सर्जन करना और जल-क्रीड़ा से सम्बन्धित जानकारी को वैबसाइट पर प्रसारित करना ;

(v) पर्यटन और अन्य सम्बन्धित विभागों के अधिकारियों और कर्मचारियों को प्रशिक्षण की व्यवस्था करना ;

(vi) इन नियमों के अधीन प्रभारित की जाने वाले विभिन्न फीस की दरों के निर्धारण/परिवर्तन के लिए अधिसूचना जारी करना और जल-क्रीड़ा और सहबद्ध क्रियाकलापों के संवर्धन के लिए उपर्युक्त फीस के उपयोग के लिए निदेश देना।

22. बांधों से पानी छोड़ने के सम्बन्ध में समय पर चेतावनी.--बांधों से पानी छोड़ने से पूर्व सम्बद्ध बांध के जलाशय प्राधिकारियों का यह कर्त्तव्य होगा कि वे यह सुनिश्चित करे कि बांध के जलाशय में और नदी की दिशा में नदी के बहाव के साथ प्रचालन करने वाले समस्त ऑपरेटरों और सम्बद्ध क्रीड़ा संगमों को सार्वजनिक रूप से उद्‌घोषणा/एस.एम.एस./ई-मेल के माध्यम से समय पर चेतावनी दे दी गई है।

23. प्रशिक्षण का संचालन करने के लिए अनुज्ञा.--विहित प्राधिकारी स्थानीय प्रशासन के सूचनाधीन तकनीकी समिति की संस्तुति पर किसी रजिस्ट्रीकृत/मान्यता प्राप्त जल-क्रीड़ा संगमों/परिसंघों और सरकारी संस्थान द्वारा किसी अन्तर्जल/ऊपरी सतह जल-क्रीड़ा के लिए प्रशिक्षण क्रियाकलाप अनुज्ञात करने के लिए सक्षम होगा।

24. रजिस्ट्रीकरण का स्थगन या रद्‌दकरण.--विहित प्राधिकारी सुरक्षा मानदण्डों के विषय में नियमों का उल्लंघन करने और बार-बार अन्य नियमों का उल्लंघन करने के लिए सुनवाई का युक्तियुक्त अवसर प्रदान करने के पश्चात्‌ किसी ऑपरेटर/मल्लाह/मोटर चालित नौका चालक/कर्मी दल के सदस्य आदि का रजिस्ट्रीकरण स्थगित या रद्‌द कर सकेगा। रजिस्ट्रीकरण के रद्‌दकरण की दशा में प्रतिभूति निक्षेप (जमा राशि) सरकार को समपहृत हो जाएगा।

मुझे सूचित किया गया है और मुझे जानकारी है कि जल-क्रीड़ा और सहबद्ध क्रियाकलाप खतरनाक हो सकते है और इसके अन्तर्गत बहुत से जोखिम और खतरे हैं, किन्तु ये दुर्घटना, बीमारी प्राकृतिक शक्तियों, देव कृत्यों, प्रतिकूल मौसम और शारीरिक परिश्रम जिसके लिए मैं तैयार न हो सकूं, के परिसंकट तक ही सीमित नहीं हैं, और निष्क्रमण कठिनाईयों में यदि मैं घायल या विकलांग हो सकता हूं जिस की बाबत मुझे सूचित किया गया है और इनकी और प्रस्तावित क्रियाकलाप के अन्य अन्र्तनिष्ठ जोखिमों की जानकारी है और मैं अभिस्वीकार करता हूं कि घर की सामान्य सुरक्षा और कार्य से परे साहसिक कार्य का आनन्द इस जल- क्रीड़ा कार्यकलाप में मेरी सहभागिता का पर्याप्त कारण है । प्रचालन के प्रारम्भ से पूर्व मैंने नियमानुसार यथा अपेक्षित सुरक्षा अल्पगोष्ठी/परिचय सत्र में भाग ले लिया है।

अतः मैं, हिमाचल प्रदेश सरकार और पयर्टन एवं नागरिक उड्‌डयन विभाग के आपातकाल/दुर्घटना आदि की दशा में बचाव/ चिकित्सा व्ययों पर उपगत किए जाने वाले व्यय से प्रतिपूरित करता हूँ। हिमाचल प्रदेश सरकार ऑपरेटर/मल्लाह/मोटर चालित नौका चालक जीवन रक्षक/कर्मी दल सदस्य या ग्राहक/सहभागियों को ऐसी जल-क्रीड़ा और सहबद्ध क्रिया कलापों में मेरी सहभागिता (भाग लेने) के कारण यदि उनकी मृत्यु हो जाती है, गंभीर या मामूली चोटें लग जाती हैं, तो कोई मुआवजा देने के लिए दायी नहीं होगी।

Shimla, the 22nd February, 2021

No. TSM-A(3)-2/2018-II.—WHEREAS, the draft Himachal Pradesh Water Sports and Allied Activities Rules, 2019 were published in the Rajpatra, Himachal Pradesh on 6-12- 2019 vide Notification No.Tsm-A(3)-2/2018 dated 22-11-2019 for inviting objection(s) or suggestion(s) from the general public, as required under section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002) ;

AND WHEREAS, no objection (s) or suggestion(s) has been received in this behalf during the stipulated period ;

NOW, therefore, in exercise of the powers conferred by section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002), the Governor, Himachal Pradesh is pleased to make the following rules, namely :—

CHAPTER-I

PRELIMINARY

1. Short title, extent and commencement.—(1) These rules may be called the Himachal Pradesh Water Sports and Allied Activities Rules, 2021.

(2) These rules shall extend to the whole of the State of Himachal Pradesh.

(3) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Definitions.—(1) In these rules, unless there is anything repugnant in the subject or context,—

(a) "Act" means the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No. 15 of 2002);

(b) "Allied Activities" shall mean allied activities related to water sports and include boating on a country boat, paddle boating, power/speed/motor boating, boating on a house boat, leisure trip on a cruise or any other such activities as may be notified by the Government from time to time;

(c) "Area of Operation" means a portion of the water body demarcated, exclusively or along with other operator(s), for an operation by the committee constituted under rule 9;

(d) "Association" means an association registered as society under the Himachal Pradesh Societies Registration Act, 2006;

(e) "Authorized Officers/Officials" include Commissioner, Director/Additional or Joint Director/Deputy Director/ATDO/Hotel Inspector of Tourism Department;

(f) "Boat" means a country boat, row boat and a paddle boat;

(g) "Boatman" shall include a person qualified and trained to drive a boat;

(h) "Carrying capacity of an area" means total number of water sports units that can be allowed to operate safely in that area;

(i) "Commissioner or Director" means Commissioner or Director, Tourism, H.P. as the case may be;

(j) "Crew Member" means any person, except boatman, motor boat driver and life guard who assists in conducting the Water Sports and Allied Activities and accompany for an operation;

(k) "Day Time" means the period between sunrise and sunset;

(l) "Equipment" means any item being used / required to be used for the operation of water sports and allied activities except water sports units;

(m) "Fair Weather conditions" means that periods of day break when there are no rains and winds are blowing at a normal speed;

(n) "Form" means a form appended to these rules;

(o) "Government" means the Government of Himachal Pradesh;

(p) "Motor Boat Driver" means a person qualified and trained to drive a motor boat or any other water sports machine fitted with an engine;

(q) "Operator" means water sports and allied activities operator(s) whether an individual or a company or an association or a society or a local authority which is registered as such under the Act for carrying out the water sports and allied activities under these rules;

(r) "Operation" means water sports and allied activities to be undertaken or undertaken under these rules;

(s) "Participant" means the person(s) who participate in an operation;

(t) "Prescribed" means prescribed by these rules;

(u) "Prescribed Authority" means authority notified by the State Government under clause (l) of section 3 of the Act;

(v) "Power Boat" means speed boat, motor boat and any mechanised boat fitted with engine used to carry tourists/participants on leisure trip or to be used to pull the wake board, water ski, fun rides apparatus like banana boat etc;

(w) "Reception-cum-ticket counter" means a temporary stall near the embarkation site demarcated for an operator by the Technical Committee;

(x) "Season" for the purposes of these rules means whole of the year excluding the periods from 15th July to 15th September, periods not approved by the Technical Committee for operation and periods specifically prohibited by concerned District Magistrate in extra-ordinary circumstances;

(y) "Section" means section of the Act;

(z) "Society" means a co-operative society registered under the Himachal Pradesh Co- Operative Societies Act, 1968;

(za) "Schedule" means the schedule appended to these rules;

(zb) "Technical Committee" means the Committee constituted by the Commissioner under rule 9;

(zc) "Water Bodies" shall include dam reservoirs, natural and artificial lakes/ ponds, rivers and streams;

(zd) "Water Sports" shall mean Wake boarding, Water Skiing, Jet Skiing, Ski Boarding, Water scooter, Fun Rides like, Tube Ride, Banana Ride/Ringo Ride/Donut Ride, Rowing, Kayaking and Canoeing;

(ze) "Water Sports Units" means water sports and allied activities apparatus like country boat, power boat, house boat, cruise, water scooter, kayak, row, canoe and other associated parts used for operation of rides etc.; and

(zf) "House Boat" means a house boat that has been designed or modified to be used primarily for accommodation purpose but some house boats are not motorized because they are usually moored, kept stationary at a fixed point and often tethered to land to provide utilities, however, many of them may be capable of operation under their own power.

(2) All other words and expressions used herein and not defined but shall have the same meaning respectively as assigned to them in the Act.

3. Notification of water bodies for water sports and allied activities.—The operation of Water Sports and Allied Activities shall be conducted in the area of operation demarcated by the Technical Committee in the water bodies listed in the Schedule-I. The State Government may notify new water bodies for conducting Water Sports and Allied Activities in the State and may exclude water bodies from the notified list. However, the Technical Committee shall be competent to identify and recommend new water bodies for the operation of water sports and allied activities to the Commissioner/Director Tourism for approval.

CHAPTER-II

REGISTRATION

4. Application for registration of Water Sports and Allied Activities Operator.—(1) Any person intending to act as a Water Sports and Allied Activities Operator may make an application in FORM-1 to the prescribed authority for registration along with a demand draft of500 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 Rs.2000/- in favour of prescribed authority and required documents as per these rules for the ensuing season in the months of January/February and July/August each year. The prescribed authority shall scrutinize the applications, so received initially and put up the same before the Technical Committee which shall hold the inspection before 15th of April and 15th of October each year, respectively by fixing date, time and venue for the scrutiny, inspection of the documents, office and equipments, conducting practical/physical tests of Crew members, Life Guards, Boatmen and Motor Boat Drivers etc. by giving at least 15 days clear notice to all the eligible Operators/Applicants.

(2) Any person intending to act as Water Sports and Allied Activities operator may apply for registration at any time during the year, however, his application shall be considered in the month of January-February and July-August.

(3) The prescribed authority shall issue a Certificate of Registration in FORM-2 to the concerned operator, only after the approval of the Technical Committee, for a period of three years. The registration shall be non-transferable.

(4) The operator approved by Technical Committee shall furnish a refundable security deposit of an amount of Rs. 50,000/- before the issue of registration certificate.

(5) The operator approved by Technical Committee shall execute indemnity bond as per Annexure-A before the issue of registration certificate.

(6) No operator shall be permitted to operate the Water Sports and Allied Activities unless:—

(a) he/she is a Citizen of India.

(b) he/she has/have qualified boat men and life guard(s) who have done basic and advance course from recognized National or State Institute(s);

(c) he/she has/have a qualified motor boat driver(s) as per these rules and has done basic course from recognized National or State Institute(s);

(d) he/she has local office to operate the water sports activity;

(e) he/she owns atleast three water sports units and other necessary equipments;

(f) he/she has water sports units and other necessary equipments on lease for at least four years, to operate the water sports activity.

(7) The registration may be renewed by the prescribed authority on an application of the operator accompanying fee equal to registration fee after three years in case the application for renewal is received 15 days prior to the date of expiry of registration. If the application for renewal is received within 15 days after the expiry of earlier registration in that eventuality the applicant shall be liable to pay fine of Rs.100/- per day for renewal of registration. In case the application for renewal is not made within the above stipulated period in that case the operator shall have to apply a fresh for the registration as a new Water Sports and Allied Activities Operator.

(8) The registration may be cancelled at any time on the request of the operator or on the recommendation of the Technical Committee and the amount of security shall be reimbursed, after adjusting the liabilities, if any, on the part of the operator. In case the registration certificate is lost501 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 or mutilated the operator/other concerned person may apply for the issuance of a duplicate registration certificate. The prescribed authority may issue duplicate registration certificate by charging a fee of Rs. 500/- on production of affidavit and a copy of FIR in case registration certificate lost or by submitting mutilated copy of original registration certificate, as the case may be.

5. Registration of Boatman, Motor Boat Driver and Life Guard.—(1) Any person intending to participate in Water Sports Activities as a Boatman or Motor Boat Driver or Life Guard, shall apply in FORM-3 to the prescribed authority for registration along with required documents and a fee of Rs.1000/-.

(2) After being fully satisfied that the applicant fulfils the requisite qualifications and standards for registration and his application has been recommended by the Technical Committee, the prescribed authority of the area concerned shall issue a certificate of registration in FORM-4 for a period of three years.

(3) The registration can be renewed on an application, accompanying fee equal to registration fee after three years only after the recommendations of the technical committee; fee equal to registration fee after three years in case the application for renewal is received 15 days prior to the date of expiry of registration. If the application for renewal is received within 15 days after the expiry of earlier registration in that eventuality the applicant shall be liable to pay fine of Rs.100/- per day for renewal of registration.

6. Qualification of Boatman, Motor Boat Driver and Life Guard.—(1) The Boatman, Motor Boat Driver and Life Guard must be of 21 years of age or above and should be medically fit as certified by a Government Medical Officer.

(2) He should hold a valid basic First Aid Course Certificate and should have passed matriculation examination.

(3) The applicant should bear good moral character.

(4) Experience of two years in concerned activities with required standards with good track record is a desired qualification.

(5) Additional qualification for the Boat Man, Motor Boat Driver and Life Guard for Water Sports and Allied Activities are as follows:

(a) The Boatman must hold a certificate of basic and advance course from Water Sports Centre recognized by the State or Central Government.

(b) Motor Boat Driver must hold a valid license to drive a motor boat from an authorised officer in Himachal Pradesh.

(c) Motor Boat Driver must hold a valid power boat handling certificate from National Institute of Water Sports.

(d) The Life Guard must hold a certificate of the basic and advanced course in water sports issued by a Water Sports Centre recognized by the State or Central Govt.

7. Application for Registration through e-mail.—The prescribed authority may accept the application for the registration/renewal as operator, Boatman, Motor Boat Driver and Life502 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 Guard through e-mail and acknowledge through e-mail and proceed to register/renew the applicant as operator and Boatman, Motor Boat Driver and Life Guard if the application is complete in all respect as required under the Act and these Rules. In case of acceptance through e-mail, the prescribed authority may accept the registration/renewal fee, user fee and security deposit at the time of issuance of the Registration Certificate or renewal of certificate under rule 4 and 5 as the case may be.

8. Refusal to register.—The Prescribed Authority may refuse to register an operator or Boatman, Motor Boat Driver and Life Guard if he/she is not eligible under these rules by making an order to this effect after giving a notice of 15 days to the operator/applicant for providing him an opportunity of being heard.

CHAPTER-III

INSTITUTIONAL MECHANISM

9. Constitution of the Technical Committee.—The Commissioner/Director shall, by notification, constitute a Technical Committee for each stretch/site for conducting Water Sports and Allied Activities, which shall consist of the following members, namely:—

(i) The Director, Tourism and Civil Aviation Chairman;

(ii) The Director, Atal Bihari Vajpayee Institute Vice Chairman; of Mountaineering and Allied Sports, Manali

(iii) The Superintendent of Police of concerned Member; area or his/her representative

(iv) The Sub-Divisional Magistrate of Member; concerned area or his/her representative

(v) The Conservator of Forest of concerned Member; area or his/her representative

(vi) Chief Medical Officer of concerned Member; area or his/her representative

(vii) Assistant Director/Deputy Director (Fisheries) Member; of concerned area or his/her representative

(viii) Executive/Assistant Engineer Member; (Mechanical) HPPWD

(ix) Representative of concerned Hydro-Power Member; Project Authorities

(x) Commandant, Home Guards Member; of concerned area or his/her representative

(xi) Incharge, Water Sports Centre or his/her Member; duly qualified representative503 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (xii) One member of the water Sports Member; and Association of the area

(xiii) Deputy Director, Tourism and Civil Aviation Member Secretary. or District Tourism Development Officer and in his absence Assistant Tourism Development Officer of the area concerned

(2) The presence of minimum of seven members of the above Technical Committee with either Chairman or Vice Chairman shall form the quorum of the meeting. In the absence of the Chairman, the Vice-Chairman may hold the meeting. The Member Secretary shall be responsible to call the meetings of the Technical Committee.

(3) The Technical Committee shall atleast meet twice in a year.

10. Duties and Functions of the Technical Committee.—(1) The Committee shall be responsible for,—

(i) the recommendation of new water bodies as per rule 3 for operation of water sports and allied activities, wherein the operations can safely be conducted;

(ii) the identification and demarcation of separate areas/stretches/routes for operation for water sports and allied activities, training, motorized operations and manual operations by taking in to consideration the flow of water, required depth of water, carrying capacity of the area for operation of water sports activities, other safety considerations and existing notified ferry routes. The committee may demarcate common area of operation to different water sports operators and same route for allied activities on different time intervals after taking aforesaid factors into consideration;

(iii) specifying the number of water sports units to be allowed in the demarcated area/ stretch as per the suitability of the area/stretch for the activity and the carrying capacity of the area/stretch for that activity;

(iv) the inspection of site for embarkment/disembarkment and other facilities like sitting/waiting area/ reception-cum-ticket counter for water sports and allied activities and approval thereof;

(v) the determination of season for operation of water sports activities and training as per available depth of water in the demarcated area in that season;

(vi) inspection and certification of the water sports units and other required equipments of the operator for operation of water sports activities as per these rules;

(vii) conducting trials to assess the workability of water sports units and other required equipments;

(viii) scrutinizing the bio data of the boatman, motor boat driver, life guards and crew members to conduct their physical tests/trials in order to ascertain their expertise and medical fitness for the operations and to recommend the issuance of registration certificate;

(ix) identifying and recommending for the notification of other sports/activities as water sports and allied activities;

(x) recommendations to the prescribed authority the rates to be charged from the tourists/participants for each water sports activity in terms of trips/time/distance etc. However the prescribed authority may send back to the technical committee the matter for re-consideration of rates by giving specific observations in respect of the rates recommended by it. The decision of Technical Committee after re-consideration by specifically responding to the points raised shall be final;

(xi) recommendations of the provision of rescue boat (s)/team(s) for water sports and allied activities as per safety requirements. The committee may recommend provision of joint rescue boat(s)/team(s) for an area jointly demarcated for the operators applying/ conducting allied activities through Country Boats/Paddle Boats only. In such a case such operators shall be jointly responsible for the operation and maintenance of rescue boat (s)/team (s). In case, such operators fail to operate/maintain jointly the rescue boat (s)/team(s) then they shall be responsible to operate/maintain the rescue boat (s)/team (s) individually; and

(xii) recommendation for conducting trainings as per rule 23 after assessing the competence of institution/organization/association/federation in term of qualified trainers, workability of water sports units and other equipments and other safety considerations as per these rules.

(2) In case, the area of the water body falls under the jurisdiction of two sub-divisions of the same or different districts, the jurisdiction of committee shall be decided as per the site of embarkation.

(3) The quorum of the Committee for discharging its functions shall be one half of its total members including the Chairman but the presence of members representing Water Sports Centre and mechanical division of Himachal Pradesh Public Works Department shall be mandatory.

11. Constitution of Regulatory Committee and its Functions.—(1) The Commissioner/ Director shall, by notification, constitute a Regulatory Committee for water sports and allied activities for the concerned districts, consisting of the following members, namely:—

(i) The Deputy Commissioner Chairman;

(ii) The Director, Atal Bihari Vajpayee Institute Vice Chairman; of Mountaineering and Allied Sports, Manali

(iii) The Sub Divisonal Magistrate of Member; Concerned area or his/her representative

(iv) The Dy. Superintendent of Police of the Member; concerned area or his/her representative

(v) The Divisonal Forest Officer of concerned Member; area or his/her representative.

(vi) The Commandant Home Guards of concerned Member; area or his/her representative.

(vii) The Block Medical Officer of the concerned Member; area or his/her representative.

(viii) Executive Engineer (Mechanical), Member; HPPWD of the concerned area.

(ix) Assistant Director/Deputy Director (Fisheries) Member; of the concerned area or his/her representative.

(x) The President, Water Sports Association the Member; and concerned area or his/her representative.

(xi) Deputy Director Tourism and Civil Aviation or Member Secretary. District Tourism Development Officer and in his absence Assistant Tourism Development Officer.

(2) The Chairman of Regulatory Committee can delegate his powers to Vice-Chairman who shall preside over the meetings in his absence. A quorum of eight members shall be necessary for the conduct of its meeting.

(3) The committee shall hold meeting on quarterly basis.

12. Functions of the Regulatory Committee.—The Regulatory Committee shall perform the following functions, namely:—

(1) The Committee shall exercise the overall control for regulating the water sports and allied activities in the District;

(2) The committee may issue guidelines and advisories, if any, for the safe conduct of the Water Sports and Allied Activities mentioned in the rules from time to time;

(3) The Committee may conduct surprise inspections during the operations to ensure that these rules are followed; and

(4) Any other function as may be entrusted by the Government in relation to Water Sports and Allied Activities from time to time.

CHAPTER-IV

SAFETY MEASURES

13. General Safety Norms.—The Operator shall ensure that.—

(1) the operation of Water Sports and Allied Activities is carried out only in the demarcated areas/routes;

(2) the Operations are carried out only in the designated seasons and fair weather condition during the day time ;

(3) qualified manpower as per these rules is deployed for operations and all the crew members are qualified swimmers as per these rules;

(4) all water sports activities are conducted in the presence of qualified life guard and undertaken under his active supervision;

provided with and wear during operations full safety gear and life jackets;

(6) the carrying capacity of the water sports unit is prominently displayed and the limit of carrying capacity is never exceeded;

(7) safe embarkation/disembarkation arrangements be made for participants in the form of a jetty or pontoon bridge etc;

(8) complete safety briefing to all the participants at the start of each trip be mandatorily made;

(9) that no participant is allowed to participate without taking an undertaking as per Annexure-B before the start of an operation;

(10) no person is allowed to tour/participate in any operation, except boating on a country/motorboat, unless he or she has attained 18 years of age and the children of more than 5 years of age may be permitted for boating on a country/motor boat only if atleast one of his/her parent is present with him/her and the parent has given undertaking as per the rules;

(11) the fuel is kept in well ventilated store provided with appropriate fire fighting facilities;

(12) The country/motor boat has appropriate size having adequate buoyancy and appropriate for intended activity and are certified /approved by any national or international certifying agencies including the following:—

(a) US Coast Guard

(b) CE (Communaute Europeene)

(c) EN (European Norms)

(d) ISO (International Standards Organisation)

(e) IRS (Indian Register of Shipping)

(f) Director General of Shipping, India

(g) BIS (Bureau of Indian Standards)

(h) SOLAS (Safety of Life At Sea)

(i) UL (Underwriters Laboratories)

(j) IMO (International Maritime Organisation)

(k) EC (European Commission)

(l) EU (European Union)

(p) Any other national or international certifying agencies

(13) all the water sports activities commence with a thorough safety briefing highlighting the equipment used, do's and don'ts, rescue and emergency procedures.

(14) participants suffering from weak heart condition, epilepsy, lungs disorders, asthma and pregnant women shall not be allowed to participate.

(15) any person having consumed alcohol in any form or quantity or illicit drugs shall not be allowed/continue to allow to participate in the operation.

(16) all the participants are in a suitable attire and bulky clothes, and person wearing sarees and persons wearing, neck ties, long skirts and three piece suites shall not be allowed to participate.

(17) helpers are stand-by whenever the customer approaches the disembarkation pontoon bridge/jetty etc;

(18) all the crew members and helpers hold a certificate in basic course from authorised water sports centres of the State or the Central Government.

(19) the rescue boat is not used for other water sports activities and the word Rescue Boat shall be painted with red colour between the load line and top of the boat on all the sides.

14. Equipment required for carrying out Water Sports and Allied Activities Operation and safety norms.—(1) The Technical Committee shall check the water sports unit (s) and all other auxiliary machinery, life saving appliances, fire appliances and other equipment (s) and get the same numbered through the Deputy Director Tourism & Civil Aviation or District Tourism Development Officer of the area concerned.

(2) Each operator shall arrange the following equipment (s) before he is permitted to carry out the water sports and allied activity, namely:—

A Non-Motorized Activity to be carried out through:

(I) Country Boat/Row Boat/Paddle Boat:

(a) the boat should be leak proof;

(b) the load line should be clearly marked and the weighing capacity must be approved by the technical committee as per norms prescribed by National Institute of Water Sports (NIWS)/Under no circumstances the boat shall be plied with submerged load line;

(c) the weight is evenly distributed in the boat;

(d) the boats shall carry a first aid box as per rule 15; and508 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (e) adequate number of throw able rescue devices (lifebuoys) are carried on the boats. (II) Rowing/ Kayaking/Canoeing:

(a) the kayaks and canoes must be manufactured under IRS (Indian Register of Shipping) certification for design and manufacture;

(b) the operator shall be responsible for imparting adequate familiarization training to customers before handing over the kayaks for independent operation. Successful completion of familiarization shall be recorded on the undertaking;

(c) there shall be rescue boat with a driver stand-by throughout the duration for which the kayaks/canoes are in water. The area of operation shall be clearly defined and be within the visual range of the rescue boat operator;

(d) the operator shall maintain a log book with details of the participants;

(e) if a tourist owns a kayak/canoe and wish to paddle it in the demarcated area, he/she shall register the kayak with the Prescribed Authority by paying a fee of Rs.1000/- and the registration shall be valid for three months;

B Motorized and Towed Activities:

(I) Power Boat/Motor Boat/Speed Boat/ Cruise:

(a) these must be manufactured under IRS (Indian Register of Shipping) certification for design and manufacture and all other auxiliary machinery, life/saving appliances, fire appliances and other equipment (s) intended to be used in an operation shall be manufactured by a company registered in India as per quality norms and standards prescribed for these by IRS (Indian Register of Shipping) or imported from an international organization/company of repute having the similar/ prescribed quality norms and standards. The Cruise must be registered by competent authority under The Himachal Pradesh Ferries Act, 1956 and the operator must comply with the requirements of the Act and rules framed thereunder;

(b) the boat may be fitted with either outboard or inboard engines;

(c) the horse power of the engine should be commensurate with the sitting capacity of the boat/cruise to be operated at a comfortable speed. Under no circumstances the boat/cruise is to be plied with submerged load line;

(d) all kinds of boats should have a provision for mooring the boats to the bank either by punting or rowing in case of engine failure;

(e) the seats should be comfortable and with adequate legs space.

(f) the weight should always be evenly distributed in the boat;

(g) the boats must carry a first aid box as per rule 15;

(h) adequate number of throw able rescue devices (lifebuoys) are carried on the boats etc;

(j) there should be rescue boat with a driver stand-by throughout the duration of operation. The area of operation should be clearly defined and be within the visual range of the rescue boat operator.

(II) waterskiing and Fun Rides using Power Boat which includes Ski Boarding,Wakeboarding, Water Skiing and Fun Rides like Tube Ride/Banana Ride/Ringo Ride/ Donut Ride:—

(a) water sports unit (s) and all other auxiliary machinery, life saving appliances, fire appliances and other equipment (s) intended to be used in an operation are required to be manufactured by a company registered in India as per quality norms and standards prescribed for these by IRS (Indian Register of Shipping) or imported from an international organization/company of repute, manufacturing aforementioned articles as per prescribed quality norms and standards;

(b) the power boat used must have adequate power (minimum 40 HP)

(c) there should be rescue boat with a driver stand-by throughout the duration for which the power boats are in water. The area of operation should be clearly defined and be within the visual range of the rescue boat operator.

(III) water scooter/Jet Ski/Personal Water Craft (PWC):—

(a) water scooter/Jet Skiing/Personal Water Craft (PWC) must be manufactured by a company registered in India as per quality norms and standards prescribed for these by IRS (Indian Register of Shipping) or imported from an international organization/company of repute, manufacturing aforementioned articles as per prescribed quality norms and standards.

(b) these water sports units are to be operated strictly within the limits of designated area;

(c) riding close to other boats, jumping wake boats or waves and fast approach towards to the jetty is forbidden;

(d) the rides should be manned by a qualified driver and he has to ensure that the passengers wear snugly fitted buoyancy aids throughout the ride;

(e) a qualified boat driver shall always sit behind during the ride and shall ensure that the speed limit and safety instructions are followed by the rider.

(f) customer shall be thoroughly briefed on the controls of the Jet Ski and basic procedures during its handling. Drivers sitting behind on such a ride shall ensure that speed limit and the safety instructions are followed by the rider so as to avoid accident and injury to others. If the customer disobeys the instructions, the driver shall immediately take over control. The successful completion of familiarization shall be recorded on the undertaking;

(g) independent riding of jet ski by its customer can be permitted only after conducting a short familiarization lesson as per "jet ski" familiarization check list issued by National Institiute of Water Sports (NIWS). Successful completion of510 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 familiarization shall be recorded on the undertaking by the participants as per Rule-13 (ix). Children below 18 years of age shall not be allowed to undertake independent Jet Ski ride;

(h) the jet skis/water scooter/PWC provided with outboard motors shall have automatic engine cut out arrangements in case of craft capsizing. It shall mandatory for all Operators to put on the keel cord at all times when on board their craft. If the engine is running without proper attachment of the keel cord or if the mechanism is bypassed it will be viewed as a violation of safety norms; and (i) there shall be rescue boat with a driver stand-by throughout the duration of operation. The area of operation shall be clearly defined and be within the visual range of the rescue boat operator.

15. Duties of Operator.—It shall be the duty of operator.—

(i) to display information as per FORM-5 at the site of operation and in the local office for the knowledge of tour participants of water sports and allied activities;

(ii) to display by using paint identification number and carrying capacity on each water sports unit;

(iii) to abide by the safety norms prescribed in these rules;

(iv) to insure the participants for third party insurance as per carrying capacity of the boat and water sports machine to the extent of five lakh per participant;

(v) to charge from the participants rates approved for each water sports activity and display the same prominently and to provide receipt for rate charged for the water sports activity;

(vi) to report all incidents/accidents immediately to the Association concerned/District Administration / Chairman, Technical Committee / Dy. Director Tourism & Civil Aviation;

(vii) to ensure that the activities are carried out only in permissible season and during day time and the activities are carried on only in demarcated areas;

(viii) the operator shall keep first aid kits consisting of triangular bandages, sterile pads, gauze roller bandages, pressure bandages, first aid adhesive tape, splints, scissors, as a bare minimum both in the reception-cum-ticket counter and in each boat;

(ix) to keep the environment clean and ensure that the pollution is not caused in water bodies and aquatic life is not harmed due to oil spills, plastic waste and any type of garbage and dustbins are placed near the jetty/ramp, ticket window;

(x) to keep copy of registration certificate, approved rates duly certified by the Deputy Director Tourism/ DTDO/ ATDO or any officer authorized by him at all times at the site of operation and in his office;

(xi) to submit the indemnity Bond to the Government as per Annexure-A at the time of registration;

(xii) to get an undertaking from the participant as per Annexure-B before the start of operation;

(xiii) to maintain a Log Book as per Annexure-C for each water sports unit which shall be a record of usage, inspections, repairs and safety measures undertaken by operator. The Log Book shall be duly numbered in duplicate certified by the Deputy Director Tourism/ DTDO/ ATDO or any officer authorized by him.

(xiv) to maintain and keep a Complaint/Suggestion Book at the reception counter duly certified by Tourism Department;

(xv) to maintain a Receipt Book as per Annexure-D which shall be duly numbered in duplicate for receipt of payments.

(xvi) to maintain proper record on the computer if computer is used for billing/receipt and keep soft/hard copies of the same;

(xvii) to get all the bill books and registers duly verified by the prescribed authority or its representative and produce it on demand to authorized officers/officials;

(xviii) to produce all records on demand to authorized officers/officials; and

(xix) not to violate any of the terms and conditions of the registration;

(xx) to ensure:

(a) the safe storage of inflammable items.

(b) provision of rescue boat, first aid box and other required safety equipments;

and

(c) that the boatmen, boat drivers and lifeguards prominently display their certificates of registration during operation.

(xxi) that the boat/power boat etc. is used for tourism purposes only and participant adhered strictly to the norms laid down in these rules.

16. Claim on account of any mishap.—The State Government/Tourism Department, shall, in no way be responsible for any claim on account of any mishap, injury or loss of life during operation.

17. Conduct of participants.—(1) The participant(s) while undertaking a water sports activity:—

(i) shall not carry any dangerous items resulting in any fire hazard;

(ii) shall not carry food stuffs, plastic products and any other offensive articles;

(iii) shall not obstruct the driver/crew in discharge of their duties;

(iv) shall not damage the water sports unit/other equipments;

(v) shall not be drunk or disorderly or incapable of taking care of himself;

(vi) shall not commit any nuisance or act of indecency, or use unparliamentarily language or interfere with the comfort of fellow participants; and512 राजपत्र, हिमाचल प्रदेश, 27 अप्रैल, 2021/07 वैशाख, 1943 (vii) shall not insist to allow participation in a water sports unit, if it is already loaded to its full capacity.

(2) The boatman/ boat driver/person incharge of water sports unit may refuse to admit or disallow his/her continuance in the water sports unit in case of violation of aforementioned norms of conduct.

18. Collection of User Fee.—The operator (s) shall, pay the following user fees at the time of registration:—

(i) Boat — Rs. 200/- per seat per year (ii) Motor Boat — Rs. 5000/- per year (iii) Cruise — Rs. 25000/- per year (iv) Any other water sports unit — Rs. 3000/- per unit per year

CHAPTER-V

MISCELLANEOUS PROVISIONS

19. Formation of Associations.—In order to conduct Water Sports and Allied Activities safely and to ensure proper co-ordination and transparency the Water sports and Allied Activities Operators are at liberty to form and register Sub Division/District Level Associations. The associations will provide all possible assistance to the Tourism Department and shall take appropriate measures to promote the welfare of all concerned involved in the operation of Water Sports and Allied Activities and the participants. The associations shall be responsible for the cleanliness and protection of ecology and environment of the demarcated areas of operation and its surroundings.

20. Inspections.—(1) The Prescribed Authority or Assistant Tourism Development Officer specifically authorised by the Prescribed Authority shall conduct annual inspection of each registered operator with in his/her jurisdiction between the months of January and March each year for ensuring compliance of the provisions made in these rules.

(2) The prescribed authority may at any time, either its own or on receipt of a complaint, get the inspection conducted through the technical authorities from Water Sports Centre and concerned HP PWD(Mechanical) authorities to conduct inspection to ensure compliance of safety norms.

(3) The authorised officers/officials may conduct inspections of an operator within his/her jurisdiction for ensuring compliance of the provisions made in these rules.

21. Duties and responsibilities of Department of Tourism.—The Department of Tourism shall take appropriate steps for.—

(i) conducting training for enhancement of skills relating to water sports and allied activities for creation of self employment opportunities;

(ii) development of infrastructure at places where water sports activities are being operated for providing facilities to the tourists;

(iii) installation of informatory boards in water sports activity areas;

(iv) creation of data base and inventory of water sports and allied activities operators and dissemination of water sports related information on website;

(v) providing training to the officers and officials of tourism and other related Departments;

(vi) issuance of notification for determination/variation in the rates of various fees to be charged under these rules and the directions for the utilization of the aforesaid fees for the promotion of water sports and allied activities;

22. Timely warning regarding release of water from Dams.—It shall be duty of the concerned Dam Reservoir Authorities to ensure timely warning to all operators operating in Dam Reservoir and down streams and concerned water sports associations through public announcements/SMS/email before release of water from the Dams.

23. Permission for Conducting Trainings.—The Prescribed Authority shall be competent to allow the training activities for any underwater/surface-water sports by a registered/recognized water sports associations/federations and government institution on the recommendation of the Technical Committee under intimation to the local administration.

24. Suspension or Cancellation of Registration.—The Prescribed Authority may suspend or cancel the registration of an operator/boatman/motor boat driver/crew member etc. for commission of breach of rules as to safety norms and repeated violation of other rules after giving reasonable opportunity of being heard. In case of cancellation of registration the security deposit shall be forfeited to the Government.
