संख्याः ईडीएन (टीई)ए (3)-3/2015-V-I.—हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश तकनीकी शिक्षा, व्यावसायिक एवं औद्योगिक प्रशिक्षण विभाग में औद्योगिक प्रशिक्षण 19—राजपत्र/2021-30-04-2021 (555) 556 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 संस्थानों के व्यावसायिक अनुदेशक/दस्तकारी अनुदेशक/टे्रड अनुदेशक, वर्ग-III (अराजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश तकनीकी शिक्षा, व्यावसायिक एवं औद्योगिक प्रशिक्षण विभाग, व्यावसायिक अनुदेशक/दस्तकारी अनुदेशक/ट्रेड अनुदेशक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृत्तियां.--(1) इस विभाग की अधिसूचना संख्याःएसटीवी(टीई)बी(2)4/85-II, तारीख 15/10/87 द्वारा अधिसूचित हिमाचल प्रदेश तकनीकी शिक्षा, व्यावसायिक एवं औद्योगिक प्रशिक्षण विभाग,दस्तकारी अनुदेशक/अनुदेशक समवर्गी टे्रड वर्ग-III अराजपत्रित पद के भर्ती एवं प्रोन्नति नियम, 1987 का एतद्‌ द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपर्युक्त उपनियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

उपाबन्ध-''क'' हिमाचल प्रदेश तकनीकी शिक्षा, व्यावसायिक एवं औद्योगिक प्रशिक्षण विभाग में औद्योगिक प्रशिक्षण संस्थानों के व्यावसायिक अनुदेशक/दस्तकारी अनुदेशक/टे्रड अनुदेशक, वर्ग-III (अराजपत्रित) के पद के लिए भर्ती एवं प्रोन्नति नियम

1. पद का नाम.--औद्यागिक प्रशिक्षण संस्थान के व्यावयायिक अनुदेशक/दस्तकारी अनुदेशक/ टे्रड अनुदेशक।

2. पद (पदों) की संख्या.--1015 (एक हजार पन्द्रह) 3 वर्गीकरण वर्ग-III (अराजपत्रित) 3. वेतनमान.--नियमित पदधारी (पदधारियों) के लिए वेतनमान.--(i) पे बैंड `10300-34800 3800/- ग्रेड पे।

संविदा पर नियुक्त कर्मचारी (कर्मचारियों) के लिए उपलब्धियाँ.--(ii) स्तम्भ संख्याः 15-क में दिए गए ब्यौरे के अनुसार ` 14100/- प्रतिमास।

5. 'चयन' पद अथवा 'अचयन' पद.--लागू नहीं।

6. सीधी भर्ती के लिए आयु.--18 से 45 वर्षः

परन्तु सीधी भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगी :

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्त की तारीख को अधिक आयु का हो गया हो तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुिक्त के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगाः

परन्तु यह और कि ऊपरी आयु सीमा में अनुसूचित जातियों/अनुसूचित जन-जातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए, उस विस्तार तक शिथिलीकरण किया जाएगा जितना कि हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय है :

परन्तु यह और कि समस्त पब्लिक सेक्टर निगमों तथा स्वायत्त निकायों के कर्मचारियों को, जो ऐसे पब्लिक सेक्टर निगमों/स्वायत्त निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर, निगमों/स्वायत्त निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात की जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है, ऐसी रियायत तथापि पब्लिक सेक्टर, निगमों/स्वायत्त निकायों के ऐसे कर्मचारीवृन्द करो अनुज्ञेय नहीं होगी जो तत्पश्चात्‌ ऐसे निगमों/स्वायत्त निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत्त निकायों के प्रारम्भिक गठन के पश्चात्‌्‌्‌ ऐसे निगमों/स्वायत्त निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे ।

टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिन से की जाएगी जिसमें कि पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

7. सीधी भर्ती किए जाने वाले व्यक्ति(व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएंः (क) अनिवार्य अर्हता(एं).-1. हिमाचल प्रदेश में अवस्थित किसी स्कूल/ संस्थान से दसवीं की परीक्षा पास की होनी चाहिए। (उन पदों के लिए जहां दसवीं न्यनूतम अर्हता है)

या

हिमाचल प्रदेश में अवस्थित किसी स्कूल/संस्थान से दसवीं या 102 की परीक्षा उत्र्तीर्ण होनी चाहिए (उन पदों के लिए जहां 102 न्यूनतम अर्हता है)

परन्तु यह शर्त हिमाचल प्रदेश के मूल निवासियों को लागू नहीं होगी।

2. इन नियमों से संलग्न परिशिष्ट-III में यथाविहित अनिवार्य अर्हता और अनुभव रखते हों। (ख) वांछनीय अर्हता(एं).--हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित शैक्षिक अर्हता(एं).-- आयु.--लागू नहीं।

शैक्षिक अर्हता.--लागू नहीं।

9. परिवीक्षा की अवधि, यदि कोई हो.--(क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दे।

(ख) संविदा के आधार पर, सेवाधृति के आधार पर, अधिवर्षिता के पश्चात्‌ पुनर्नियोजन और आमेलन पर कोई परिवीक्षा नहीं होगी। 558 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 10. भर्ती की पद्धतिः भर्ती सीधी होगी या प्रोन्नति, सैकण्डमैण्ट, स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शतप्रतिशत सीधी भर्ती द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा।

11. प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां ग्रेड जिनसे प्रोन्नति/ सैकण्डमैण्ट/ स्थानान्तरण किया जाएगा : लागू नहीं।

12. यदि विभागीय प्रोन्नति समिति/स्थायीकरण समिति विद्यमान हो तो उसकी संरचना.--(क) विभागीय प्रोन्नति समिति.-लागू नहींं।

(ख) विभागीय स्थायीकरण समिति.--जैसी सरकार द्वारा समय-समय पर गठित की जाए। 13. भर्ती करने में, जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन लिखित परीक्षा के गुणागुण तथा इन नियमों से संलग्न परिशिष्ट-। में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण/प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो लिखित परीक्षा के गुणागुण और इन नियमों से संलग्न परिशिष्ट-। में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन तथा पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यावहारिक परीक्षण या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।

15-क संविदा नियुक्ति, द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के हेाते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

(I) संकल्पना.--(क) इस पॉलिसी के अधीन हिमाचल प्रदेश तकनीकी शिक्षा व्यावसायिक एवं औद्योगिक प्रशिक्षण विभाग में व्यावसायिक अनुदेशक/दस्तकारी अनुदेशक/टे्रड अनुदेशक को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

(ख) पद का हिमाचल प्रदेश कर्मचारी चयन आयोग के कार्यक्षेत्र में आना.--निदेशक (तकनीकी शिक्षा) रिक्त पद (पदों) को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर केे समक्ष रखेगा। (ग) चयन इन नियमों में विहित पात्रता शर्ताें के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियां.--संविदा के आधार पर नियुक्त व्यावसायिक अनुदेशक/दस्तकारी अनुदेशक/टे्रड अनुदेशक को `14100/- की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमाह संदत्त की जाएगी। यदि संविदा में एक वर्ष की अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष (वर्षाें) के लिए संविदात्मक उपलब्धियों में ` 423/- की रकम (पद के पे बैण्ड के न्यूनतम जमा ग्रेड पे का तीन प्रतिशत ) वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी।559 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 (III) नियुक्ति/अनुशासन प्राधिकारी.--निदेशक (तकनीकी शिक्षा, व्यावसायिक एवं औद्योगिक प्रशिक्षण विभाग) हिमाचल प्रदेश नियुक्ति और अनुशासन प्राधिकारी होगा/होगी।

(IV) चयन प्रक्रिया.--संविदा नियुक्ति के मामले में पद पर नियुक्ति के लिए चयन, लिखित परीक्षा के गुणागण तथा इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण/प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो लिखित परीक्षा के गुणागण तथा इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट रीति के अनुसार मूल्यांकन तथा पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की)/लिखित परीक्षा या व्यावहारिक परीक्षा या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग/हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा। (V) संविदात्मक नियुक्तियों के लिए चयन समिति.--जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर द्वारा समय-समय पर गठित की जाए।

(VI) करार.--अभ्यर्थी को चयन के पश्चात्‌ इन नियमों से संलग्न परिशिष्ट-"II" के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन एवं शर्तें.--(क) संविदा के आधार पर नियुक्त व्यक्ति को `14100/- की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमाह संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक रकम में `423/- (पद के पे बैण्ड के न्यूनतम्‌ जमा ग्रेड पे का तीन प्रतिशत ) की रकम की वार्षिक वृद्धि का हकदार होगा और अन्य कोई सहबद्ध प्रसुविधाएं जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थाई आधार पर होगी । यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से सन्तुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालिस दिन के भीतर अपील प्राधिकारी, जो नियुिक्त प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा। (ग) संविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत सरकारी चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालिस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0 टी0 सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर होें तो उसके नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जायेगी, किन्तु पदधारी को इस बाबत समय पर नियन्त्रण प्राधिकारी को सूचित करना होगा । तथापि संविदा पर नियुक्त व्यक्ति कर्त्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः 560 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य का प्रमाण-पत्र प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधारों पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हेंं परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदाें के विरूद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा-शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थायी रूप से अनुपयुक्त घोषित किया जाएगा और उनकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

(छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कर्त्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों, जैसे एफ0आर0, एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0 एफ0/जी0 पी0 एफ0 भी लागू नहीं होगा।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.-- लागू नहीं।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति व्यक्ति(यों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

1. यह कि प्रथम पक्षकार व्यावसायिक अनुदेशक/दस्तकारी अनुदेशक/ट्रेड अनुदेशक के रूप में.......

.............................से प्रारम्भ होने और..................................को समाप्त होने वाले दिन तक एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विनिर्दिष्ट रूप से उल्लिखित किया गया है और दोनों पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस अर्थात्‌................................... को स्वयंमेव ही पर्यवसित (समाप्त) हो जाएगी तथा सूचना नोटिस आवश्यक नहीं होगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। 562 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 2. प्रथम पक्षकार की संविदात्मक रकम `14100/- प्रतिमास होगी।

3. संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थाई आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्त प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से सन्तुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालिस दिन के भीतर अपील अधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा।

4. संविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात करवाने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी प्रमाण-पत्र प्रस्तुत करने पर पैंतालिस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या पर विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0 टी0 सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। 5. नियन्त्रक प्राधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर होें तो उसके नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जायेगी, किन्तु पदधारी को इस बाबत समय पर नियन्त्रण प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्त्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा :

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य का प्रमाण-पत्र प्रस्तुत करना होगा।

6. संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा/होगी, जहाँ भी प्रशासनिक आधारों पर ऐसा करना अपेक्षित हो।

7. चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हेंं परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदों के विरूद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा- शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थायी रूप से अनुपयुक्त घोषित किया जाएगा और उनकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवस्था की तारीख से छह सप्ताह के पश्चात्‌ उपायुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।563 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 8. संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्त्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को पद के वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

9. संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0 एफ0/जी0 पी0 एफ0 भी लागू नहीं होगा।

No. EDN (TE) A (3)-3/2015-V-I.—In exercise, of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Vocational Instructors/Craft Instructors/Trade Instructors of Industrial Training Institutes Class-III (Non-Gazetted) in the Department of Technical Education, Vocational & Industrial Training, Himachal Pradesh, as per Annexure-'A' attached to this notification, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Technical Education, Vocational & Industrial Training Department, Vocational Instructors/Craft Instructors/Trade Instructors Class-III (Non-Gazetted), Recruitment and Promotion Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajparta (e-Gazette), Himachal Pradesh.

2. Repeal & Savings.—(1) The Himachal Pradesh, Technical Education, Vocational & Industrial Training Department, the Recruitment and Promotion Rules, 1987 for the post of Craft Instructors/Instructors Allied Trade notified vide this Department Notification No.STV(TE) B(2)4/85-II dated 15/10/1987 are hereby repealed.

(2) Notwithstanding such repeal any appointment made or anything done or any action taken under the rules so repealed under Sub-rule(1) supra shall be deemed to have been validly made or done or taken under these rules.

ANNEXURE "A" RECRUITMENT AND PROMOTION RULES FOR THE POST OF VOCATIONAL INSTRUCTORS/CRAFT INSTRUCTORS/TRADE INSTRUCTORS OF INDUSTRIAL TRAINING INSTITUTES CLASS-III (NON-GAZETTED), IN THE DEPARTMENT OF TECHNICAL EDUCATION, VOCATIONAL & INDUSTRIAL TRAINING, HIMACHAL PRADESH.

1. Name of post.—Vocational Instructors / Craft Instructors / Trade Instructors of Industrial Training Institutes.

2. Number of post.—1015 (One thousand Fifteen)

3. Classification.—Class-III (Non-Gazetted)

4. Scale of Pay.—(i) Pay scale for regular incumbents:—Pay band `10300—34800+ `3800/- Grade Pay.

(ii) Emoluments for contract employees:— `14100/- PM as per details given in Col. No. 15-A.

5. Whether "Selection" post or "Non- Selection" post.—Not applicable

6. Age for direct recruitment.—Between 18 to 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc basis or on contract basis had become over-age on the date he/she was appointed as such he/she shall not be eligible for any relaxation in the prescribed age-limit by virtue of his / her such adhoc or contract appointment:

Provided further that upper age-limit is relaxable for Scheduled Castes/Scheduled Tribes/ Other Backward Classes and Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government servants before absorption in Public Sector Corporations/Autonomous Bodies at the time of initial constitution of such Corporations/ Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/Autonomous bodies who were/are subsequently appointed by such Corporations/Autonomous bodies and who are/were finally absorbed in the service of such Corporations/Autonomous after initial constitution of the Public Sector Corporations/Autonomous bodies.

Note:—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting application or notified to the Employment Exchanges or as the case may be.

7. Minimum educational and other qualifications required for direct recruit (s).— (a) Essential Qualification(s):—1. Should have passed Matriculation Examination from any school/institution situated within Himachal Pradesh.

(For the posts where Matric is the minimum qualification):

Should have passed Matriculation & 10+2 Examinations from any school/institution situated within Himachal Pradesh.

(For the posts where 10+2 is the minimum qualification)

Provided that this condition shall not apply to Bonafide Himachalis.

2. Should possess essential qualification and experience as prescribed at Appendix-III annexed to these rules.

(b) Desirable qualification(s):—Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age:—Not applicable.

Educational qualification:—Not applicable

9. Period of probation, if any.—(a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in case of appointment on contract basis, tenure basis, re-employment after superannuation and absorption.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/ secondment/transfer and the percentage of post(s) to be filled in by various methods.—100% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be.

11. In case of recruitment by promotion/secondment / transfer, grade for which

promotion/ secondment/transfer is to be made:—Not applicable

12. If a Departmental Promotion/Conformation Committee exists, what is its composition.—(a) Departmental Promotion Committee:—Not applicable.

(b) Departmental Confirmation Committee:—As may be constituted by the Government from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission

(H.P.P.S.C.) is to be consulted in making recruitment.— As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if the Himachal Pradesh Public Service Commission or other recruiting agency/authority, as the case may be, so consider necessary or expedient on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, preceded by a screening test (objective type) or practical test or skill test, the standard/syllabus etc. of which will be determined by the Himachal Pradesh Public Service Commission / other recruiting agency/ authority, as the case may be.

15.-A Selection for appointment to the post by contract appointment.— Notwithstanding anything contained in these Rules, contract appointment(s) to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT.—(a) Under this policy the Vocational Instructors/Craft Instructors/Trade Instructors in the Department of Technical Education, Vocational & Industrial Training Himachal Pradesh will be engaged on contract basis initially for one year; which may be extendable on year to year basis:

Provided that for further extension / renewal of contract period on year to year basis the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then the period of contract is to be renewed / extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPSSC:—The Director, Technical Education, Vocational & Industrial Training, Himachal Pradesh after obtaining the approval of the Government to fill up the vacant post (s) on contract basis will place the requisition with the concerned recruiting agency i.e. Himachal Pradesh Staff Selection Commission, Hamirpur.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these Rules.

(II) CONTRACTUAL EMOLUMENTS.—The Vocational Instructors/Craft Instructors/ Trade Instructors appointed on contract basis will be paid consolidated fixed amount @ `14100/- P.M. (which shall be equal to minimum of the pay band + grade pay). An amount of `423/- (3% of the minimum of pay band plus grade pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if contract is extended beyond one year.

(III) APPOINTING/ DISCIPLINARY AUTHORITY.—The Director, Technical Education, Vocational & Industrial Training, Himachal Pradesh will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of contract appointment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if the Himachal Pradesh Public Service Commission or other recruiting agency/authority, as the case may be, so considers necessary or expedient on the basis or merit or written examination followed by evaluation as specified in Appendix-I appended to these Rules, preceded by a screening test (objective type) or practical test or skill test, the standard / syllabus, etc. of which, will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission/Himachal Pradesh Staff Selection Commission Hamirpur/other recruiting agency / authority, as the case may be.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—As may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Staff Selection Commission, Hamirpur, from time to time.

(VI) AGREEMENT.—After selection of a candidate, he / she shall sign an agreement as per Appendix-II appended to these Rules.

(VII) TERMS AND CONDITIONS.—(a) The contractual appointee will be paid consolidated fixed contractual amount @ `14,100/- per month (which shall be equal to minimum of the pay band + grade pay). The contract appointee will be entitled for increase in contractual amount @ `423/- (3% of the minimum of pay band plus grade pay of the post) for further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, form the date on which a copy of order(s) appealed, is delivered to him / her.

(c) The contract appointee will be entitled for one-day's casual leave after putting one month service, 10 days medical leave and 5 days special leave in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed Casual Leave, Medical Leave and Special Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis, who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in the case of a Gazetted Government servant and by District Medical Officer in the case of a Non-Gazetted Government servant. In case of women candidates who are to be appointed against posts carrying hazardous nature of duties, e.g. in Police Organizations, etc. and they have to complete a period of training as a condition of service, such women candidates who as a result of tests is found to be pregnant of twelve weeks standing or over shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such women candidates be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness, certificate from the authority as specified above she may be appointed to the post kept reserved for her.

(g) Contract appointee will be entitled to TA / DA if required to go on tour in connection with his / her official duties at the same rate as applicable to regular counterpart official at the minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. The Employees Group Insurance Scheme as well as EPF / GPF will also not be applicable to contract appointee(s).

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.— Not applicable

18. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any class or category of person(s) or post(s).

APPENDIX – I

APPENDIX-II Form of contract/ agreement to be executed between the Vocational Instructors/Craft Instructors/Trade Instructors & the Government of Himachal Pradesh through ………………..

This agreement is made on this……………….. day of………….. in the year…………. between Sh./Smt…….………......… s/o/d/o Shri……………. r/o……………………….., contract appointee (hereinafter called the FIRST PARTY), AND The Governor, Himachal Pradesh through Director Technical Education, Vocational & Industrial Training Department, Himachal Pradesh (here-in-after called the SECOND PARTY).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as Vocational Instructors/Craft Instructors/Trade Instructors on contract basis on the following terms and conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as Vocational Instructors/Craft Instructors/Trade Instructors for a period of one year commencing on day of ……….. and ending on the day of…………… It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on……………………and information notice shall not be necessary:

Provided that for–further extension/renewal of contract period the HOD shall issue a certificate that the service and conduct of the contract appointee was satisfactory during the year and only then the period of contract is to be renewed/extended.

2. The contractual amount of the FIRST PARTY will be ` 14100 /- per month.

3. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not619 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, with in a period of 45 days, from the date on which a copy of termination orders is delivered to him/her.

4. The contract appointee will be entitled for one day's casual leave after putting one month's service, 10 days' medical leave and 5 days' special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days'. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days' (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed casual leave, medical leave and special leave can be accumulated up to the calendar year and will not be carried forward for the next calendar year.

5. That Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contact appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

6. An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative ground.

7. Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in the case of a Gazetted Government servant and by Government Medical Officer in the case of a Non- Gazetted Government servant. In case of women candidates who are to be appointed against posts carrying hazardous nature of duties, and in case they have to complete a period of training as a condition of service, such woman candidate, who as a result of tests is found to be pregnant of twelve weeks' standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such woman candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.

8. Contractual Vocational Instructors/Craft Instructors/Trade Instructors shall be entitled to TA/DA if required to go on tour in connection with his official duties at the same rate as applicable to regular counter-part Vocational Instructors / Craft Instructors / Trade Instructors.

9. That Employees Group Insurance Scheme, EPF/GPF will not be applicable to the contractual appointee(s).

No. DMC-Estt.(A)7-1/2020-411.—In exercise of the powers conferred by section 37 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (Central Act 7 of 2014), subject to the provisions of this Act or any rule or scheme made thereunder, the Dharamshala Municipal Corporation, hereby makes the following bye-laws for street vending, namely:—

CHAPTER - I

PRELIMINARY

1. Short title and commencement.—(a) This Bye-laws may be called The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Bye-laws—2021 for Dharamshala Municipal Corporation.

(b) It shall come into force on such date, as notified in the Official Gazette, by the appropriate Government.

2. Definitions.—In these bye-laws, unless the context otherwise requires:—

(a) "Act" means the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (Central Act 7 of 2014);

(b) "Appropriate Government" means the Government of Himachal Pradesh;

(Protection of Livelihood and Regulation of Street Vending) Act, 2014;

(d) "Festive market" means a market where sellers and buyers have traditionally Congregated for the sale and purchase of products or services during festival season of the city or town and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(e) "Grievance Redressal Committee" means a committee constituted by the Government of Himachal Pradesh under sub-section (1) of section 20 of the Act;

(f) "Heritage Market" means a market which has completed more than fifty years in one place where sellers and buyers have traditionally congregated for the sale and purchase of products or services and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(g) "Holding capacity" means the maximum number of street vendors who can be accommodated in any vending zone and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(h) "Local authority" means Dharamshala Municipal Corporation.

(i) "License" means certificate of vending.

(j) "Mobile vendors" means street vendors who carry out vending Activities in designated area by moving from one place to another place vending their goods and services;

(k) "Municipal Commissioner" means the commissioner of the Dharamshala Municipal Corporation, Himachal Pradesh;

(l) "Natural market" means a market where sellers and buyers have traditionally congregated for the sale and purchase of products or services and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(m) "Niche market" means a market where sellers and buyers have traditionally congregated for the sale and purchase of niche products or services and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(n) "Night bazaar" means a bazaar where sellers and buyers have traditionally congregated for the sale and purchase of products or services after evening i.e. during night and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(o) "Notification" means a notification published in the Official Gazette and the term "notify" shall be construed accordingly;

(p) "Plan" means plan prepared under section 21 of the Act;

(q) "Planning authority" means an Urban Development Authority or any other authority in any city or town designated by the appropriate Government as responsible for668 राजपत्र, हिमाचल प्रदेश, 30 अप्रैल, 2021/10 वैशाख, 1943 regulating the land use by defining the precise extent of areas for any particular activity in the master plan or development plan or zonal plan or layout plan or any other spatial plan which is legally enforceable under the applicable Improvement trust Act or the Municipal Act, as the case may be in Act;

(r) "Public purpose" includes in the context of the Act,

(i) widening of roads, streets, lanes;

(ii) shifting the alignment of roads, streets, lanes;

(iii) erecting flyovers with or without clover leaves and slip down roads;

(iv) erecting of underpasses;

(v) development of land owned by public authorities for some public projects;

(vi) laying of water, storm water or sewer lines;

(vii) erecting intermediate pumping stations for the services;

(viii) any project related with public transport like BRTS, Metro, etc.;

(ix) erection of Economically Weaker Section (EWS) Housing;

(x) Creation of Parks, Gardens and Recreational Area;

(xi) Conservation of any eco system resource in that area; and

(xii) Any other developmental work taken by the local authority, the beneficiary of which will be the community at large.

(s) "Scheme" means Himachal Pradesh Street Vendors (Protection of Livelihood and Regulation of Street Vending) Scheme, 2017.

(t) "Seasonal market" means a market where sellers and buyers have traditionally congregated for the sale and purchase of products or services during specific seasons and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(u) "Section" means section of the Act;

(v) "Stationery vendors" means street vendors who carry out vending Activities on regular basis at a specific location;

(w) "Street vendor" means a person engaged in vending of articles, goods, wares, food items or merchandise of everyday use or offering services to the general public, in a street, lane, side walk, footpath, pavement, public park or any other public place or private area, from a temporary built up structure or by moving from place to place and includes hawker, peddler, squatter and all other synonymous terms which may be local or region specific; and the words "street vending" with their grammatical variations and cognate expressions, shall be construed accordingly;

(x) "Registered Street vendor" means a person engaged in street vending as per the Act and is registered with Dharamshala Municipal Corporation under Street Vendor Act 2014.

(y) "Town vending committee" means the body constituted by the appropriate Government under section 22 of the Act.

(z) "Vending zone" means an area or a place or a location designated as such by the local authority, on the recommendations of the Town Vending Committee, for the specific use by street vendors for street vending and includes footpath, side walk, pavement, embankment, portions of a street, waiting area for public or any such place considered suitable for vending Activities and providing services to the general public.

(aa) ''Violation'' means an Act committed by vendor which contradicts the conditions given in the License/Certificate of Vending.

(bb) "Weekly market" means a market where sellers and buyers have weekly congregated for the sale and purchase of products or services and has been determined as such by the local authority on the recommendations of the Town Vending Committee;

(cc) Words and expressions defined in the Act and used in these Bye-laws shall have the same meanings as respectively assigned to them in the Act.

CHAPTER-II

MANNER OF VENDING IN DIFFERENT VENDING ZONES

3. REGULATION AND MANNER OF VENDING IN DIFFERENT VENDING

ZONES:—

(a) Vending Zone.—TVC shall have to decide about vending zones considering an intensity of foot falls, nature of road, Road width and vehicular & pedestrian movement in the city.

I. There shall not be any restriction-free-vending zones in the city. Carrying capacity of an area would put the ultimate limit on the number of street vendors which can he positioned in any area. However, there shall not be any restriction on mobile vending in these areas if venders continuously move, without affecting traffic and commuter movement. In such cases TVC has to decide the total number of such mobile vendors who can be accommodated after taking into account the area of significant footfall and 1/3 of the holding capacity of the area; otherwise there is a chance of creating problem for traffic movement, as the mobile vending invariably takes place from the carriage way.

II. Mobile vending is only allowed on vending streets as specified by TVC Dharamshala.

III. In no circumstances street venders number will increase above 2.5% population of particular ward of DMC.

IV. Minimum 1 meter space for pedestrian movement need to be ensure in front of vending area and road. This area need to be kept free from any kind of obstructions.

V. It shall be the duty of the designated official of the local authority to keep a check that number of mobile vendors shall not cross the limit at a specific place as decided by the town vending committee.

(b) The restricted vending zones are mainly linked up with the road width, and the roads of the following description have been put in this category in the plan;

(i) There shall not be any stationary street vending on a road having width equal to 3 meter. However, after due approval from the Town Vending Committee , one side street vending shall be allowed if such road is declared as no vehicular road.

(ii) There shall not be any stationary street vending on a road having width between 5 meters to 8 meters. However, after due approval from the Town Vending Committee one side street vending shall be allowed if such road is declared as one way vehicular road.

(iii) Number of street vendors shall be decided by considering holding capacity of each designated vending area on such a road.

(iv) Such stationary vending shall be allowed after taking the clearance from traffic police regarding the smooth vehicular and pedestrian movement. If required, road side parking shall be banned in such area where street vending is allowed.

(v) Mobile vending shall be allowed on such road after consideration to the traffic and pedestrian movement.

(vi) Suggestive road designing is attached as Annexure.

(c) No vending zone:

(i) No vending shall be allowed around 100 meters of the Secretariat, District Courts, District Secretariat, Municipal Corporation, Military Cant. Est. and state archeological monuments.

(ii) No vending within 25 meters from any crossing of two or more roads on all side and any declared heritage structures by the local authority. No vending with 50 meters from Mcleodganj, Dalai Lama Temple, Kachehri chowk, Fawahra chowk and Dolma chowk.

(iii) No vending shall be allowed around 50 meters on both the sides from the entry and exit of any educational institutions and hospitals.

(iv) There shall not be any vending on State Highways and National Highways.

4. Restrictions on street vendors.

(a) A street vender, who got street vending certificate for any of these vending zones, shall not—Obstruct or interfere with vehicle, bicycle or pedestrian traffic or their safety;

(b) Obstruct or interfere with doorways, entrances, fire doors or emergency exits adjacent to the street;

electricity etc. or similar installations;

(d) Obstruct or interfere with any other structures, sign boards, display units, city works or operations, on or adjacent to the street;

(e) Sell any prohibited, objectionable / pirated goods or services or merchandise etc; as per rules, regulations and notifications issued by any statutory authority from time to time;

(f) Occupy more space than allotted space by the TVC/ DMC;

(g) Sell goods or services or merchandises after fixed hours as specified by the TVC;

(h) Dispose garbage in an un-segregated manner and in any place other than specific place which is identified by the local authority.

(i) Sell the goods or services or merchandises after expiry of the vending certificate;

(j) Use of loudspeakers, megaphones, sound systems or other amplification equipment;

(k) Allow any person other than family member to vend from his vending place or sublet the place, allotted by local authority;

(l) Use any unauthorized and prohibited mechanism for energy requirement in public place, crowded area for cooking and heating purpose example open tandoor and domestic LPG;

(m) Construct any permanent or temporary structures on allotted space;

(n) Use banned polythene bags of any kind; and

(o) Transfer the certificate to any other vendors without approval.

5. Responsibility of Street Vendors.—It shall be the duty of the street vendors or his family members or employee to:

(a) Comply with all the conditions specified in the certificated of vending;

(b) Comply with all the conditions specified in The street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, HP SV Rules-2016 & HP SV Scheme, 2016 those are left out from these Bye laws.

(c) Do vending on the place as specified in the vending certificate;

(d) Comply with all conditions specified in the certificates;

(e) Prominently display ID card & Certificate of vending at vending place all times;

(f) Ensure that either the street vendor or such family member whose name has been mentioned in the vending certificate or employee remains present at vending place during vending hours;

(g) Keep the vending place safe and in good conditions all times;

any other line department of HP;

(i) Produce the certificate of vending when demanded by any of the Government authority;

(j) Comply all the requirements of the Food Adulteration Act or any other act if applicable;

(k) Clear and remove, wares and articles everyday at the end of vending hours from the site, no storage at vending site is permitted in any manner other than the facility developed by the local authority.

(l) Use recommended fire safety devices/equipments in case of registered food street vendors for heating purposes by using commercial LPG connection and also in case of other vendors selling combustible products.

(m) Comply to bye laws framed by Dharamshala Municipal Corporation for Door-to-Door Garbage Collection and Disposal ,2018.

(n) Follow all the requirements of this bye-laws and conditions mentioned in the vending certificate.

CHAPTER-III

FEES, TAXES AND PENALTIES AND TERMS & CONDITIONS

6. Vending Fees.—Every registered street vendor shall be liable to pay vending fees as prescribed by TVC from time to time as per Himachal Pradesh Street Vendors (Protection of Livelihood and Regulation of Street Vending) Scheme-2016.

7. Fee for amenities and facilities.—Every registered street vendor shall be liable to pay fee for amenities, facilities and maintenance charges e.g drinking water, public convenience, storage/refrigeration store etc. as prescribed and provided by the local authority time to time and as applicable.

8. User Fee/charges.—Every registered street vendor shall be liable to pay fee/charges as per Door-to-Door Garbage Collection and Disposal Bye laws, 2018 of Dharamshala Municipal Corporation.

9. Penalty to be levied—

(a) Every registered street vendor who commits violation of the provisions of the Street Vending Act/ Rules or Bye laws, shall be liable for penalty as per the following table:

(b) If registered street vendors violates any provision of the act / bye laws five times, then the vending certificate will be cancelled and the vendor has to apply for the license afresh (re-registration) with the approval of TVC.

10. Other Fees.—The fee to be charged from registered street vendors other than vending fee, amenities, facilities and maintenance fee and penalties are as under:

(a) Venders having daily receipts of tehbazari will not be considered as registered street venders until and unless Venders are eligible as per vending rules/ scheme of H.P. and are registered with DMC.

(b) Every registered street vendor shall be liable to pay monthly vending fee by 10th of every month in D004D office. Submission of fees is the responsibility and duty of street vendor and DMC is not going to collect it on daily bases.

(c) Vendors shall have options for payment at DMC office through digital mode of transaction i.e. debit/credit card or can directly transfer through net banking or cheque, in DMC/TVC account.

(d) The perishable items seized from un-registered street vendors will be donated to Societies/charitable trusts/ashrams/hospitals/shelter for urban homeless, old age home etc. and non-perishable items will be disposed of by way of open auction by DMC on monthly/quarterly/ annual basis. No claim can be entertained by office as unauthorized vending is strictly prohibited.

(e) The registration will be valid for five years from date of registration of vendor.

(f) There will be 5% annual compounded increase in the monthly street vending fees with effect from beginning of every financial year i.e. from 1st April.

(g) There will be discount in monthly vending fees of 25% to disabled, single women and senior citizen vendors.

(h) The monthly vending fee will be deposited on monthly basis, if one would like to deposit on quarterly/ half yearly/yearly basis then discount will be offered to the tune of 5%, 7.5% and 10% respectively.

(i) Exemptions (maximum 50%) in the form of relief to registered street vendors in case penalties imposed will be given only when, the street vendor or his/her next kin shows valid documents of urgency i.e. hospitalization, pregnancy, death episode, accident or any extreme emergency due to natural or manmade disaster or riots etc. Such cases will be examined by nodal officer and will be decided at the level of Additional Commissioner on recommendation of TVC. The maximum period for submitting claim for exemption/ relief will be within six months from the date of last fee paid. ___________

CHAPTER-IV

PROCEDURE FOR ALLOTMENT OF VENDING SITE

13. The local authority through TVC shall adopt draw of lots procedure for allotment of vending sites in the designated vending zones. The determining terms and conditions for allotment of vending sites in the vending zone on first priority, will be for following registered street vendors:

(b) Who possess Himachal Pradesh based Aadhar Cards.

(c) Who submit undertaking to TVC that:

I. He/she carry on business of street vending himself or through any of his family members whose names are entered during the survey.

II. He/she has no other means of Livelihood.

III. He/she shall not transfer in any manner whatsoever, including rent, the certificate of vending or the place specified therein to any other person.

14. TVC will give preference to reserved category (Max 24%) as per HP SV (Protection of Livelihood and Regulation of Street Vending) Scheme-2016.

15. All the surveyed street vendors who had been registered in the areas, which are declared as No Vending Zones will be relocated by the local authority for allotment of sites.

16. If the number of registered street vendors, identified in the survey are more than the holding capacity of the vending zone and exceeds the number of persons which can be accommodated in that vending zone, the TVC shall carry out a draw of lots for issuing certificate of vending for the vending zone and the remaining persons shall be accommodated in any adjoining areas will be considered.

17. If number of registered street vendors is less than the number of vending sites then the left over registered street vendors of adjoining sectors/areas will be considered.

18. If it is not possible to accommodate the registered street vendors as per the street vending zoning plan and the holding capacity of that zone, then local authority will issue a computer generated acknowledgement of application specifying waiting list number.

19. If the street vendors who have been surveyed and wishes to do street vending, can get registered as a new registered street vendor based on the waiting list number to such persons whose applications is accepted by TVC.

20. The Mobile. vendors will vend from their allocated areas or where they have been surveyed until and unless they are not violating any norms of the act. If they do so, then they will be shifted to nearby space as per vending zone norms. Such vendors can stay upto 30 minutes maximum at one place.

21. The Essential Service Providers (ESP) street vendors will vend from their allocated areas or where they have been surveyed until and unless they are not violating any norms of the act. If they do so, then they will be shifted to nearby space as per vending zone.

MISCELLAENEOUS

22. The regulation of traffic in the vending zone.—Wherever a vending zone is declared by the TVC, the traffic police shall decide about one way traffic, vending timings, speed limit, parking, movement of heavy vehicles etc. If traffic division doesn't agree with the vending zone, in that case it shall have to be shifted or cancelled in consultation with the TVC and urban development department.

Local Authority shall clearly earmark the vending area, a footpath and cartage way with in the vending zone i.e. the circulation area.

23. The Regulation of the quality of the products and services provided to the public in vending zone and maintenance of the public health, hygiene and safety standards.—

(a) Any vendor who sell food articles, readymade or processed on the street shall have to follow all the provisions of the Food Adulteration Act, 1954. In case of failure, penal measures shall be initiated by the concern department, as prescribed in the Food Adulteration Act. If there is any conviction order from the concerned department, vending certificate of such street vendor shall be cancelled by the local authority with immediate effect,

(b) Quality of articles vended from the street can only be taken care of in case, there is a prescribed standard under a relevant statue. Otherwise it will be only a qualitative assessment. In the absence of such standard it will be necessary to collect sample of such items against which some complaints are received by the vendors. Such cases can be discussed in the joint meeting of whole sellers, manufactures and vendors under the chairmanship of commissioner to arrive at amicable solutions

(Explanation for example, presence of' toxic paint and sharp edges of the different part of

the toy. There is a need to develop systematic samples taking an analysis of the same in an

accredited laboratory. In case of proved presence of toxic element in the toys. The

wholesaler should be compelled to take it back end payback the vendor price they pay if it

not supplied on credit. In case of imported items found to be suffering from similar defects,

wide publicity should be given drawing attention to the authorities empowered to take

suitable items.)

24. The regulations of the civic services in the vending zone.—

(a) The public toilet and drinking water facilities shall be provided at appropriate place by the local authority if there is unavailability;

(b) Proper collection of segregated solid waste management system have to be provided by the local authority on user charge basis but cleanliness of the allotted site is to be managed by the registered street vendors, no littering will be allowed;

(c) Lighting/power energy requirement to operate electric gadgets to the vendors shall be allowed by the solar or battery operated lamp mechanism;

(d) No individual electricity and water connection shall be permitted in vending space;

(a) The Commissioner/Chairman or the Licensing Officers may limit the time during which street vender may be permitted to operate either generally or specially in respect of any class of articles or in any particulars public street within the city.

(b) The license granted under these bye-laws shall expire on completion of 5 years from the date of issue.

(c) The registered street vendors shall not do or permit to do negligent act, likely to cause fire or otherwise endanger to the public safety.

(d) If the registered street vendor fails to comply with any terms and conditions of this license, the commissioner or the authorized officer can revoke or suspend the license.

(e) If in case of registered street vendors reports of reduction in customer base due to relocation/displacement resulting into livelihood at stake, may inform the local authority for change in the location of vending. In such cases, the local authority may discuss in the TVC for the potential relief (subject to maximum 1 relocation only).

(f) If the registered street vendors want to withdraw his/her license at any point of time, then he/she may submit an application in writing for discontinuation.

(g) Notwithstanding anything contained in these bye-laws, the TVC may on compassionate ground in case of extreme hardship grant a certificate of vending to any person who is having severe disability of any type, HIV positive, senior citizen, orphans, poor/EWS widow and divorced women etc.

(h) In case the registered street vendor dies or become incapable of running his/her business on account of old age, infirmity, or any physical or intellectual disability as per requisite valid certificate from appropriate authority, the commissioner/licensing officer may, for reasons to be recorded in writing, grant a license out of turn to his lineal descendant as per the act or the spouse. The lineal descendant or the spouse of the registered street vendor shall intimate the local authority about such death, disability, infirmity or illness with valid document e.g. death, disability etc. in writing.

(i) The license/Street Vender shall always keep the license issued to him and shall on demand procedure it to the Commissioner/Chairman or the authorized officer.

(j) The license/street vender shall not transfer the license issued to any other person, without the prior written permission of the Commissioner/Chairman or the authorized officer.

(k) Every License issued to the street vender under these bye-laws may be renewed within 30 days from its date of expiry.

(l) If the license/street vender fails to comply with any terms and condition of the license, the Commissioner/Chairman or the authorized officer can revoke or suspend the license.

(m) In event of any future planning development of site/court order/directions, the allotted size is prohibited meant for vending; the registered street vendor shall not sell the articles in such prohibited site.

Abhishek Kumar s/o Late Sh. Kamlesh Sah c/o Ghanshyam Building at Jhanjhiri, Lower Khalini, Shimla, Tehsil and District Shimla, Himachal Pradesh in the record of Secy., Birth and Death, Municipal Corporation. District Shimla .

Hence, this proclamation is issued to the general public if they have any objection/claim regarding to enter the name/date of birth of above named in the record of Municipal Corporation. Shimla, District Shimla may file their claims/objections on or before one month of publication of this notice in Govt. Gazette in this court, failing which necessary orders will be passed.
