सं0पी0बी0डब्ल्यू0(बी0)एफ(5)50/2019.---यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव भजवाणी, तहसील घुमारवीं, जिला बिलासपुर हिमाचल प्रदेश में औहर-कोहिना सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव 33—राजपत्र/2021-10-06-2021 (935) 936 राजपत्र, हिमाचल प्रदेश, 10 जून, 2021/20 ज्येष्ठ, 1943 एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह घोषणा, भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-19 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों को सूचना हेतु की जाती है तथा उक्त अधिनियम की धारा-19 के अधीन भू-अर्जन समाहर्ता, (मण्डी क्षेत्र) मण्डी, जिला मण्डी, हिमाचल प्रदेश को उक्त भूमि के अर्जन करने के आदेश लेने का एतद्‌ द्वारा निदेश दिया जाता है।

3. भूमि रेखांक का निरीक्षण भू-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी जिला मण्डी, (हि0 प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

संख्याः एच0टी0सी0-ए(3)-2/2020.--हिमाचल ूदेश के राज्यपाल, भारत के संविधान के अनुच्छे द 309 के परन्तुक द्वारा ूदत्त शक्तियों का ूयोग करते हु ए, हिमाचल ूदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्याः उद्यान-ख(7)-8/92-वॉल्यूम-(v) तारीख 30 मई, 2018 द्वारा अधिसूचित और राजपऽ, हिमाचल ूदेश में तारीख 2 जून, 2018 को ूकाशित हिमाचल ूदेश औद्यानिकी सेवाएं, वर्ग-I (राजपऽित) भर्ती और ूोन्नति नियम, 2018 का संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात ्ः--

ंक्षिप्त नाम और ूारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल ूदेश औद्यानिकी 1. स ् सेवाएं, वर्ग-I (राजपऽित), भर्ती और ूोन्नति (ूथम संशोधन) नियम, 2021 है।939 राजपत्र, हिमाचल प्रदेश, 10 जून, 2021/20 ज्येष्ठ, 1943 (2) ये नियम राजपऽ (ई-गजट), हिमाचल ूदेश में ूकाशन की तारीख से ूवृत्त होंगे। 2. उपाबन्ध-'क' का संशोधन.--हिमाचल ूदेश औद्यानिकी सेवाएं, वर्ग-I (राजपऽित), भर्ती और ूोन्नति नियम, 2018 (जिसे इसमें इसके पश्चात ् ''उक्त नियम'' कहा गया है ्) से संलग्न उपाबन्ध 'क' में,- (क) ःतम्भ संख्या 7 के सामने उपबन्धों के ःथान पर निम्नलिखित रखा जाएगा, अर्थात ्ः--

''(क) अनिवार्य अर्हता (एं)ः विद्या की निम्नलिखत शाखाओं/विषयों में से किसी एक विषय में औद्यानिकी/कृ षि में विज्ञान ःनातकोत्तर (एम0एस0सी0)ः--

फलकृ षि-विज्ञान, फल ूजनन एवं आनुवंशिकी संसाधन, फसलोत्तर ूौद्योगिकी/फल ूौद्योगिकी, पुंपोत्पादन एवं भू-दृँय निर्माण, कवक विज्ञान एवं पादक रोग विज्ञान/कीट विज्ञान एवं मधुमक्खी पालन या जैव ूौद्योगिकी, सब्जी-फसलें, सूआमजीव विज्ञान, मृदा-विज्ञान तथा जल ूबन्धन, कृ षि अर्थशास्र्त एवं कृ षि सांख्यिकी, कृ षि विःतार, खाद्य ूौद्योगिकी मे एम0एस0सी0, एम0एस0सी0 (उद्यान) फल विज्ञान, एम0एस0सी0 (उद्यान) सब्जी विज्ञान, एम0एस0सी0 (उद्यान), पुंपोत्पादन और भू-दृँय वाःतुकला, एम0एस0सी0 (कृ षि), पौध विकृ ति विज्ञान एम0एस0सी0(कृ षि), कीट विज्ञान, एम0एस0सी0 (कृ षि) सूऽकृ मि विज्ञान, एम0एस0सी0 (कृ षि), बीज विज्ञान एवं ूौद्योगिकी, एम0एस0सी0 (कृ षि) मृदा विज्ञान, एम0एस0सी0 (कृ षि), कृ षि अर्थशास्र्त, एम0एस0सी0 खाद्य ूौद्योगिकी, एम0एस0सी0 आण्विक जीव विज्ञान, और जैव ूौद्योगिकी, एम0एस0सी0 जीवाणु विज्ञान, एम0एस0सी0 सांख्यिकी और फल तथा सब्जी ूौद्योगिकी में ःनातकोत्तर सहयोगिता जो एम0एस0सी0 उद्यान (फसलोत्तर ूौद्योगिकी) और पौध ूजनन और आनुवांशिकी में विशेषज्ञता सहित एम0एस0सी0 (कृ षि) समतुल्य हो।

तथापि, पदधारी चार वर्षीय उपाधि कार्यबम (डिमी ूोमाम) में विज्ञान ःनातक (उद्यान) होना चाहिए।

(ख) वांछनीय अर्हता (एं): हिमाचल ूदेश की रुढ़ियों, रीतियों और बोलियों का ज्ञान और ूदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।'';

(ख) ःतम्भ संख्या 11 के पहले ूथम पैरा के उपबन्धों के ःथान पर निम्नलिखित रखा जाएगा, अर्थात ्:--

उद्यान ूसार अधिकारियों/ूदर्शकों (डिमासशेटरज) में से ूोन्नति द्वाराए जो किसी मान्यता ूाप्त विश्वविद्यालय से औद्यानिकी/कृ षि में विज्ञान ःनातक (बी0एस0सी0) की उपाधि रखते हों तथा जिसका सात वर्ष का नियमित सेवाकाल या मेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके सात वर्ष का नियमित सेवाकाल होः

परन्तु ूोन्नति के ूयोजन के लिए उद्यान ूसार अधिकारिया और ूदर्शकों (डिमासशेटरज) के पद के पाऽ पदधारियों की उनके सेवाकाल के आधार पर, उनकी सवंर्ग-वार परःपर वरिष्टता को छे ड़े बिना एक संयुक्त वरिष्ठता सूची तैयार की जाएगी:--940 राजपत्र, हिमाचल प्रदेश, 10 जून, 2021/20 ज्येष्ठ, 1943 परन्तु यह और भी कि उद्यान विकास अधिकारी के पदों को भरने के लिए निम्नलिखित दो बिंदु पद आधारित रोःटर का अनुसरण किया जाएगा:--

टिप्पणः--रोःटर ूत्येक दूसरे बिन्दु के पश्चात ् तब तक दोहराया जाता रहेगा जब तक कि दी गई ूतिशतता तक ूतिनिधित्व ूाप्त नहीं हो जाता और तत्पश्चात ् रिक्ति को उसी ूवर्ग से भरा जाएगा जिससे पद रिक्त होता है।'';

(ग) ःतम्भ संख्या 15-क (VII) के खण्ड (ख) के सामने विद्यमान उपबन्धों के ःथान पर निम्नलिखित रखा जाएगा, अर्थात ्ः--

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अःथायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्ति ूाधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से सन्तुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की ूति उसे परिदत्त की गई है, से पैंतालीस दिन (45) के भीतर अपील ूाधिकारी, जो नियुक्त ूाधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सके गा।''; और

(घ) ःतम्भ संख्या 15-क (VII) के खण्ड (च) के सामने विद्यमान उपबंन्धों के ःथान पर निम्नलिखित रखा जाएगाए अर्थात ्ः--

''(च) चयनित अभ्यर्थी को, राजपऽित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपऽित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य ूमाण-पऽ ूःतुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हें परिसंकटमय ःवरुप के कर्तव्यों को कार्यान्वित करने वाले पदो के विरुद्ध नियुक्त किया जाना है और यदि उन्हें ूशिक्षण की अवधि को सेवा-शर्त के रुप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामःवरुप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अःथायी रुप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आःथगित रखा जाएगा जब तक कि ूसवावःथा समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का ूसवावःथा की तारीख से छह सप्ताह के पश्चात ् चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा और यदि वह उपरोक्त यथाविनिर्दिष्ट ूाधिकारी से आरोग्य ूमाण-पऽ ूःतुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरिक्षत रखे गए पद पर नियुक्त की जा सके गी।''।941 राजपत्र, हिमाचल प्रदेश, 10 जून, 2021/20 ज्येष्ठ, 1943 उपाबन्ध ''ख'' का संशोधन.--(क) उक्त नियमों से संलग्न उपाबन्ध-'ख' में निबन्धन और शर्तो की संख्या 3 के उपाबन्धों के ःथान पर निम्नलिखित रखा जाएगा, अर्थात ्ः--

''3. संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अःथायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्ति ूाधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से सन्तुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की ूति उसे परिदत्त की गई है, से पैंतालीस दिन (45) के भीतर अपील ूाधिकारी, जो नियुक्त ूाधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सके गा।'' ; और

NOTIFICATION

Shimla-2, the 29th April, 2021

No. HTC-A(3)-2/2020.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal 942 राजपत्र, हिमाचल प्रदेश, 10 जून, 2021/20 ज्येष्ठ, 1943 Pradesh Public Service Commission, is pleased to make the following rules to amend the Himachal Pradesh Horticultural Services, Class-I (Gazetted), Recruitment and Promotion Rules, 2018 notified vide this Department's Notification No. Udyan-Kha(7)-8/92-Vol.-V, dated 30th May, 2018 and published in the Rajpatra, Himachal Pradesh dated 2nd June, 2018, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Horticultural Services, Class-I (Gazetted) Recruitment and Promotion (First Amendment) Rules, 2021.

(2) These rules shall come into force from the date of publication in Rajpatra (e-Gazette) Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure-"A" appended to the Himachal Pradesh Horticultural Services, Class-I (Gazetted) Recruitment and Promotion Rules, 2018 (hereinafter referred to as the "said rules"),—

(a) for the provisions against column No. 7, the following shall be substituted , namely:—

"(a) Essential Qualification(s): M.Sc. Horticulture/Agriculture in any one of the following disciplines/ subjects:—

Pomology, Fruit Breeding & Genetic Resources, Post Harvest Technology/Fruit Technology, Floriculture & Land Scaping, Mycology & Plant Pathology/Entomology & Apiculture or Biotechnology, Vegetable Crops, Microbiology, Soil Science & Water Management, Agriculture Economics & Agriculture Statistics, Agriculture Extension, M.Sc. Food Technology, Master of Science (Horticulture) Fruit Science, Master of Science (Horticulture) Vegetable Science, Master of Science (Horticulture) Floriculture and Land scape Architecture, Master of Science (Agriculture) Plant Pathology, Master of Science (Agriculture) Entomology, Master of Science (Agriculture) Nematology, Master of Science (Agriculture), Seed Science and Technology, Master of Science (Agriculture) Soil Science, Master of Science (Agriculture), Agricultural Economics, Master of Science Food Technology, Master of Science Molecular Biology and Biotechnology, Master of Science Microbiology, Master of Science Statistics and Post Graduate Associate ship in Fruit and Vegetable Technology equivalent to M.Sc. Horticulture (Post Harvest Technology) and Master of Science (Agriculture) specialization in Plant Breeding & Genetics.

However, the incumbent should be B.Sc.(Hort.) in four years degree program.

(b) DESIRABLE QUALIFICATION(S).—Knowledge of customs, manner and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.";

(b) for the provisions of first para of Column No. 11, the following shall be substituted, namely:—

"By promotion from amongst Horticulture Extension Officer/Demonstrator having B.Sc. Degree in Horticulture/Agriculture from a recognized University with 07 years' regular or regular combined with continuous adhoc service, if any in the grade":

Provided that for the purpose of promotion a combined seniority list of the eligible incumbents of the posts of Horticulture Extension Officer and Demonstrator on the basis of the length of service without disturbing their cadre-wise inter-se seniority shall be prepared:

following 02 point post based roster shall be followed:—

Note.—The roster will be repeated after 2nd point till the representation of each category is achieved by the given percentage and thereafter the vacancy shall be filled up from the category which vacates the post.";

(c) for the provisions against Column No. 15-A(VII)(b), the following shall be substituted, namely:—

"(b) The service of contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date on which a copy of termination orders is delivered to him/her."; and (d) for the provisions against 15-A(VII)(f), the following shall be substituted, namely:—

"(f) Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in the case of a Gazetted Government servant and by Government Medical Officer in the case of a Non-Gazetted Government servant. In case of women candidates who are to be appointed against posts carrying hazardous nature of duties, and in case they have to complete a period of training as a condition of service, such woman candidate, who as a result of tests is found to be pregnant of twelve week's standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such woman candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.".

3. Amendment of Annexure-"B".—(a) In Annexure-"B" appended to the "said rules" for the provisions of terms and conditions No. 3, the following shall be substituted, namely:—

"3. The service of contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date on which a copy of termination orders is delivered to him/her."; and (b) for the provisions of terms and condition No.7, the following shall be substituted, namely:—

"7.
